R. 768</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210203">February 3, 2021</action-date><action-desc><sponsor name-id="M001180">Mr. McKinley</sponsor> (for himself and <cosponsor name-id="D000624">Mrs. Dingell</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HJU00">the Judiciary</committee-name>, and <committee-name committee-id="HBU00">the Budget</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Controlled Substances Act to clarify the process for registrants to exercise due diligence upon discovering a suspicious order, and for other purposes.</official-title></form><legis-body id="HE773CBF6999243A794560473C8842383" style="OLC"><section id="H72B7392266B543C6AF94CCB02C20DC17" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Block, Report, And Suspend Suspicious Shipments Act of 2021</short-title></quote>.</text></section><section id="H920032E9128E4FB9A821E9FD563EF1A1"><enum>2.</enum><header>Clarification of process for registrants to exercise due diligence upon discovering a suspicious order</header><subsection id="H924CC105066A479CBECC9372610EA9CB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (3) of section 312(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/832">21 U.S.C. 832(a)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H48E3D657E09947F0A6678A961E09D5C2" style="OLC"><paragraph id="HF64ABAFFBCB74B03A58A2183B7AC6D88"><enum>(3)</enum><text display-inline="yes-display-inline">upon discovering a suspicious order or series of orders—</text><subparagraph id="H9A15FBA55BB449078F9A85EEE4182DF2"><enum>(A)</enum><text>exercise due diligence;</text></subparagraph><subparagraph id="H55733770C3EE476998A4F81FD0B10163"><enum>(B)</enum><text>establish and maintain (for not less than a period to be determined by the Administrator of the Drug Enforcement Administration) a record of the due diligence that was performed;</text></subparagraph><subparagraph id="HE141CB574EF945C2AE66DE52FEDC7F61"><enum>(C)</enum><text>decline to fill the order or series of orders if the due diligence fails to resolve all of the indicators that gave rise to the suspicion that filling the order or series of orders would cause a violation of this title by the registrant or the prospective purchaser; and</text></subparagraph><subparagraph id="HF3977CCF71F2478C8EF1863DF6A66794"><enum>(D)</enum><text>notify the Administrator of the Drug Enforcement Administration and the Special Agent in Charge of the Division Office of the Drug Enforcement Administration for the area in which the registrant is located or conducts business of—</text><clause id="H01CA8DD31E0C4B61A30F819C0494DF6C"><enum>(i)</enum><text>each suspicious order or series of orders discovered by the registrant; and</text></clause><clause id="H5C93DABF54B44CF9A7C6EE61DB524523"><enum>(ii)</enum><text>the indicators giving rise to the suspicion that filling the order or series of orders would cause a violation of this title by the registrant or the prospective purchaser.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB243C709B18B4A73AC2B634AB44807E3"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, for purposes of section 312(a)(3) of the Controlled Substances Act, as amended by subsection (a), the Attorney General of the United States shall promulgate a final regulation specifying the indicators that give rise to a suspicion that filling an order or series of orders would cause a violation of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801</external-xref> et seq.) by a registrant or a prospective purchaser.</text></subsection><subsection id="HA94C62480D094E0180C4978DABF14ABE"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">Section 312(a)(3) of the Controlled Substances Act, as amended by subsection (a), shall apply beginning on the day that is 1 year after the date of enactment of this Act. Until such day, section 312(a)(3) of the Controlled Substances Act shall apply as such section 312(a)(3) was in effect on the day before the date of enactment of this Act.</text></subsection></section><section id="H6A3869DDF5CA4BC3AE0BE8A59C24A7DE"><enum>3.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body></bill>
