BILL</legis-type><official-title display="yes">To transfer the United States Secret Service to the Department of the Treasury.</official-title></form><legis-body id="H49D3402F41274B9A95C9A4EEAB7EC7F8" style="OLC"><section section-type="section-one" id="H91C099D1A30A4FA0B0EBCB6B0ABD88BC"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States Secret Service Mission Improvement and Realignment Act of 2022</short-title></quote>.</text></section><section id="HD844FB581CC44F07B3A376ED1A3AEB1B"><enum>2.</enum><header>Functions transferred</header><subsection id="H6C73AB59FB7B4C04BB3AE5C40CE2CEF0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In accordance with this Act, there shall be transferred to the Secretary of the Treasury the functions, personnel, assets, and obligations of the United States Secret Service, including the functions of the Secretary of Homeland Security relating thereto.</text></subsection><subsection id="H19CBAC6E3B034DCCBC701BCEAA441EF7"><enum>(b)</enum><header>Distinct entity</header><text display-inline="yes-display-inline">The United States Secret Service shall be maintained as a distinct entity within the Department of the Treasury.</text></subsection></section><section id="H2EFE496F95364E27B2C5BF9E769C18D4"><enum>3.</enum><header>Transitional authorities</header><subsection id="H697AE508E3E9474281E27B45BEDDD2FE"><enum>(a)</enum><header>Provision of assistance by officials</header><text>Until the transfer of the United States Secret Service to the Department of the Treasury, any official having authority over or functions relating to the United States Secret Service immediately before the date of enactment of this Act shall provide to the Secretary of the Treasury such assistance, including the use of personnel and assets, as the Secretary of the Treasury may request in preparing for the transfer and integration of the United States Secret Service into the Department of the Treasury.</text></subsection><subsection id="H0F246DDCF5D241F783B70F89386C89D8"><enum>(b)</enum><header>Services and personnel</header><text>During the period beginning on the date of enactment of this Act and ending on the effective date of this Act, upon the request of the Secretary of the Treasury, the head of any executive agency may, on a reimbursable basis, provide services or detail personnel to assist with the transition.</text></subsection><subsection id="H6A2CD50D3A9B49CF98D9D1169D3032AF"><enum>(c)</enum><header>Transfer of personnel, assets, obligations, and functions</header><text>Upon the transfer of the United States Secret Service to the Department of the Treasury—</text><paragraph id="HBC1D6533CED74DBEAD80253FE2BFE962"><enum>(1)</enum><text>the personnel, assets, and obligations held by or available in connection with the United States Secret Service shall be transferred to the Secretary of the Treasury for appropriate allocation, subject to the approval of the Director of the Office of Management and Budget and in accordance with section 1531(a)(2) of title 31, United States Code; and</text></paragraph><paragraph id="H66E32F7CA7F440C49F11F49AE647F34E"><enum>(2)</enum><text>the Secretary of the Treasury shall have all functions relating to the United States Secret Service that any other official could by law exercise in relation to the United States Secret Service immediately before such transfer, including all such functions vested in the Secretary of Homeland Security by the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>) or any other law.</text></paragraph></subsection></section><section id="H9F47C8D19A224AC1BD29D9BE7CA56EEC"><enum>4.</enum><header>Savings provisions</header><subsection id="H6B225C286A6048DA937D3E9A500EA151"><enum>(a)</enum><header>Completed administrative actions</header><paragraph id="HCFF23BEDC08049BF8ECD920296D51DD5"><enum>(1)</enum><header>In general</header><text>Any completed administrative action of the United States Secret Service shall not be affected by the enactment of this Act or the transfer of the United States Secret Service to the Department of the Treasury, but shall continue in effect according to the terms of the completed administrative action until the completed administrative action is amended, modified, superseded, terminated, set aside, or revoked in accordance with law by an officer of the United States or a court of competent jurisdiction, or by operation of law.</text></paragraph><paragraph id="HDAB57CA70BFF4433A11C6BF7DD9C1932"><enum>(2)</enum><header>Completed administrative action defined</header><text>In this subsection, the term <term>completed administrative action</term> includes an order, a determination, a rule, a regulation, a personnel action, a permit, an agreement, a grant, a contract, a certificate, a license, a registration, and a privilege.</text></paragraph></subsection><subsection id="H1B08D12D0B70470489B66B40EFF652C9"><enum>(b)</enum><header>Pending proceedings</header><paragraph id="H3DDD90AA3DAA4E42BB9174A713FBDEFE"><enum>(1)</enum><header>In general</header><text>Any pending proceeding in the United States Secret Service, including a notice of proposed rulemaking and an application for a license, permit, certificate, grant, or financial assistance, shall continue notwithstanding the enactment of this Act or the transfer of the United States Secret Service to the Department of the Treasury, unless the pending proceeding is discontinued or modified under the same terms and conditions and to the same extent that such discontinuance could have occurred if such enactment or transfer had not occurred.</text></paragraph><paragraph id="HE9EF11B96E074AE8B43CE3FE86BBADB1"><enum>(2)</enum><header>Orders</header><text>Any order issued in a proceeding described in paragraph (1), or an appeal therefrom, and any payment made pursuant to such an order, shall issue in the same manner and on the same terms as if this Act had not been enacted or the United States Secret Service had not been transferred, and the order shall continue in effect until amended, modified, superseded, terminated, set aside, or revoked by an officer of the United States or a court of competent jurisdiction, or by operation of law.</text></paragraph></subsection><subsection id="H983558EE2EA844C3AD11A864B9A8452E"><enum>(c)</enum><header>Pending civil actions</header><text>Any pending civil action shall continue notwithstanding the enactment of this Act or the transfer of the United States Secret Service to the Department of the Treasury, and in the pending civil action, proceedings shall be had, appeals taken, and judgments rendered and enforced in the same manner and with the same effect as if such enactment or transfer had not occurred.</text></subsection><subsection id="HF551FA53E50D4EB0AF0D736755A5F014"><enum>(d)</enum><header>References</header><text>Any reference relating to the United States Secret Service in a statute, an Executive order, a rule, a regulation, a directive, or a delegation of authority that precedes such transfer or the effective date of this Act shall be deemed to refer, as appropriate, to the Department of the Treasury and the United States Secret Service, to its officers, employees, or agents, or to its corresponding organizational units or functions.</text></subsection><subsection id="H6E0C13BF01F24852B1953FACEE74F33D"><enum>(e)</enum><header>Employment provisions</header><paragraph id="H5AE1DC47729F48E3A7AA2E41A247CA80"><enum>(1)</enum><header>Regulations</header><text>The Secretary of the Treasury may, in regulations prescribed jointly with the Director of the Office of Personnel Management, adopt the rules, procedures, terms, and conditions established by statute, rule, or regulation before the effective date of this Act relating to employment in the United States Secret Service transferred to the Department of the Treasury by this Act.</text></paragraph><paragraph id="H72B246B1DC734E2DA1F3B6F970CAC9C4"><enum>(2)</enum><header>Effect of transfer on conditions of employment</header><text>Except as otherwise provided in this Act, or under authority granted by this Act, the transfer pursuant to this Act of personnel shall not alter the terms and conditions of employment, including compensation, of any employee so transferred.</text></paragraph></subsection><subsection id="HD2E5CE34680A499E9A54F3C0CB1F9FA3"><enum>(f)</enum><header>Statutory reporting requirements</header><text>Any statutory reporting requirement that applied to the United States Secret Service transferred to the Department of Treasury by this Act immediately before the date of enactment of this Act shall continue to apply following that transfer if the statutory requirement refers to the United States Secret Service by name.</text></subsection></section><section id="HAAAD2EDCB2C14A91BF3DDA0A7FEC36B1"><enum>5.</enum><header>Incidental transfers</header><text display-inline="no-display-inline">The Director of the Office of Management and Budget, in consultation with the Secretary of the Treasury, is authorized and directed to make such additional incidental dispositions of personnel, assets, and liabilities held, used, arising from, available, or to be made available, in connection with the functions transferred by this Act, as the Director determines necessary to accomplish the purposes of this Act.</text></section><section id="HADB691D5298546A4944401ED6E7FF5B0"><enum>6.</enum><header>References</header><text display-inline="no-display-inline">With respect to any function transferred by this Act and exercised on or after the effective date of this Act, any reference in any other Federal law to the United States Secret Service or any officer or office the functions of which are so transferred shall be deemed to refer to the Secretary of the Treasury or the official or component of the Department of the Treasury to which such function is so transferred.</text></section><section section-type="subsequent-section" id="HABA981FF4CB448F4B201A992C50B5738"><enum>7.</enum><header>Report on expenditures for the purpose of providing protection during the course of travel</header><subsection id="HD9CB86B85110442FBF769E0C04048614"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="H741858119A92413F902194F2E6AC9366"><enum>(1)</enum><text>the term <term>covered travel</term>—</text><subparagraph id="H05F713312D994F9FA358846812B22917"><enum>(A)</enum><text>means any trip by a protected individual with a stop at a location that is not owned or controlled by the Federal Government; and </text></subparagraph><subparagraph id="HB7F72EEF593E48FF81D50B6EA3FB86B3"><enum>(B)</enum><text>includes any trip described in subparagraph (A) that is outside of the United States.</text></subparagraph></paragraph><paragraph id="H1C7B0104F33D4F2B87208E90E913F882"><enum>(2)</enum><text>the term <term>immediate family</term> does not include any child under the age of 26; </text></paragraph><paragraph id="H469B5A6FDEA945769765A5D797A8095A"><enum>(3)</enum><text>the term <term>incidental expenditure</term>—</text><subparagraph id="H1200BA214F5446CFB313915CA48258F1"><enum>(A)</enum><text>means a travel expenditure incurred by United States Secret Service personnel and reimbursed by the United States Secret Service; and</text></subparagraph><subparagraph id="HE38A1A7342374F26BE8820E53B76EB7E"><enum>(B)</enum><text>does not include expenditures described in clause (i) or (ii) of subsection (b)(1)(E);</text></subparagraph></paragraph><paragraph id="H2431F9D18D394EB89F5161A616C099E2"><enum>(4)</enum><text>the term <term>protected individual</term> means the President, the Vice President, and members of the immediate family of the President and Vice President during the period for which a report is submitted under subsection (b); </text></paragraph><paragraph id="HDB145541A888497994CDDDE4194DFC74"><enum>(5)</enum><text>the term <term>travel expenditure</term>—</text><subparagraph id="HF965EFABC5A64397859192DE767081AF"><enum>(A)</enum><text>means any expenditure of funds by the United States Secret Service for the purpose of providing protection to a protected individual during the course of covered travel;</text></subparagraph><subparagraph id="H2CC1B392ED464DFFA28990512F68776A"><enum>(B)</enum><text>includes any expenditure incurred by an Executive department or agency for the purpose of providing protection to a protected individual during the course of covered travel and reimbursed by the United States Secret Service; and </text></subparagraph><subparagraph id="HE8787D4408864FD9A9518A03F32C8F77"><enum>(C)</enum><text>does not include any expenditure for—</text><clause id="H5B9B1815D30C4AADADE070B4B2F348DC"><enum>(i)</enum><text>the pay of United States Secret Service personnel;</text></clause><clause id="H917ACECDBB824E19876F4C4A39662359"><enum>(ii)</enum><text>the operation or maintenance of any permanent protective asset; or</text></clause><clause id="HA49B4832231C4D40972F6B64D1341388"><enum>(iii)</enum><text>incidental expenditures.</text></clause></subparagraph></paragraph></subsection><subsection id="HF5A56BA18F89460ABC87A9F197623819"><enum>(b)</enum><header>Report</header><text> Not later than December 31 of each year, the Director of the United States Secret Service shall submit to the committees listed in section 9 of the Presidential Protection Assistance Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/18/3056">18 U.S.C. 3056</external-xref> note), an annual report that, with respect to the previous fiscal year, includes, at a minimum—</text><paragraph id="HBC7B9C5A3914498BBB4B514BDE2858B6"><enum>(1)</enum><text>for each instance of covered travel, a statement of—</text><subparagraph id="HDFA197AC001049C8BC2EE85019B3DC35"><enum>(A)</enum><text>the protected individual or protected individuals, if more than 1 protected individual is traveling;</text></subparagraph><subparagraph id="HB3468231DB1E464B9CF86A4011BBED24"><enum>(B)</enum><text>the dates of departure and return;</text></subparagraph><subparagraph id="H90F7299D97324BB2821E0ED63388075C"><enum>(C)</enum><text>each city and State or, if outside of the United States, city and country, visited;</text></subparagraph><subparagraph id="H0912427154694DF28453201EE0314719"><enum>(D)</enum><text>the total amount of travel expenditures;</text></subparagraph><subparagraph id="H1A10589DE74A4392A0263BE51F5A2811"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="H8C56001F3F154CE1834DFEA958A26974"><enum>(i)</enum><text>the total amount of expenditures for operational costs, including the cost of using—</text><subclause id="H0A47EA4093B94ACB890FBEDF4007C50C" indent="up1"><enum>(I)</enum><text>any asset to transport a protected individual; or</text></subclause><subclause id="H7C6F5782C1424A65952E4C3AB5D67CA4" indent="up1"><enum>(II)</enum><text>any space and facility for operational purposes; and</text></subclause></clause><clause id="H75F774862D8A4DFA813C3E2BE17E143A" indent="up1"><enum>(ii)</enum><text>the total amount of expenditures for transportation, lodging, and per diem; and</text></clause></subparagraph><subparagraph id="H2FCA1AC2D70C49C6A6CCBF0F495B6315"><enum>(F)</enum><text>the name of and amount paid to—</text><clause id="H6F383E462D544D0B929B2A3EA6C864AE"><enum>(i)</enum><text>if the total amount paid is greater than $5,000, any individual who is not an employee of the Federal Government or a foreign government; and</text></clause><clause id="H5312166B4F004F90AECFD0C0F2BA12E9"><enum>(ii)</enum><text>if the total amount paid is greater than $5,000, any entity that is not an entity of the Federal Government or a foreign government.</text></clause></subparagraph></paragraph><paragraph id="HB4B5E86D65754DF2801644EB0A583E17"><enum>(2)</enum><text>for each protected individual, the total amount of incidental expenditures incurred for the purpose of providing protection to the protected individual during the reporting period.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC4BF27EF0DCA421AB351E3B257DF86BB"><enum>(c)</enum><header>Form of report</header><text>The report required by subsection (b) shall be submitted in unclassified form, but may include a nonpublic annex for information reported under subsection (b)(1)(F) that the United States Secret Service determines could harm the protective mission if publicly disclosed and classified information. The nonpublic annex and any draft of the annex shall be exempt from disclosure under section 552 of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>). </text></subsection></section><section id="H82DC69881B91416EB3CFDFEEA092BED9"><enum>8.</enum><header>Technical and conforming amendments</header><subsection id="HB6EC7B7BDC994054BC452A96C4AA1C13"><enum>(a)</enum><header>Homeland Security Act of 2002</header><text>The Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>) is amended—</text><paragraph id="HD1D56625B636480297AC89F2BE55BEA2"><enum>(1)</enum><text>in section 2(11) (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101(11)</external-xref>), by striking <quote>except—</quote> and all that follows through <quote>the Coast Guard, when</quote> and inserting <quote>except the Coast Guard, when</quote>;</text></paragraph><paragraph id="H0860A46622504F60803D49C23CD525BB"><enum>(2)</enum><text>in section 103(d) (<external-xref legal-doc="usc" parsable-cite="usc/6/113">6 U.S.C. 113(d)</external-xref>)—</text><subparagraph id="HA3D6071459FB4F0394B0CB2809C65DD1"><enum>(A)</enum><text>by striking paragraph (1); and</text></subparagraph><subparagraph id="HFA8C4D8BF270448E9AC828176574F850"><enum>(B)</enum><text>by redesignating paragraphs (2) through (5) as paragraphs (1) through (4), respectively;</text></subparagraph></paragraph><paragraph id="HD737C058CC974F9CA8CFABF4567ABC44"><enum>(3)</enum><text>in section 210G (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n</external-xref>)—</text><subparagraph id="H1B90F646D0404A0DA6A6508A19DF5356"><enum>(A)</enum><text>in subsection (a)—</text><clause id="HEA1EC10E3F154A9F8E0B01950A914287"><enum>(i)</enum><text>by striking <quote>the Secretary and the Attorney General</quote> and inserting <quote>the Secretary of Homeland Security, the Secretary of the Treasury, and the Attorney General</quote>;
