R. 7685</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220506">May 6, 2022</action-date><action-desc><sponsor name-id="M001204">Mr. Meuser</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Small Business Act to limit the ability of a Federal agency to claim credit for meeting goals for contracting with small business concerns, and for other purposes.</official-title></form><legis-body id="H213ED65D04994ADD93220F8E5E0BD31A" style="OLC"><section id="H419289F4C3C447D7B96F6BE9C2EF7ECD" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Truth in Small Business Contracting Credit Act of 2022</short-title></quote>.</text></section><section id="H4E3AB1284166443D87FA14BDE1AB563E"><enum>2.</enum><header>Limitation on Federal agency credit for meeting contracting goals</header><text display-inline="no-display-inline">Section 15(g) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H17903FC7FD8F4625B59E2BB8436863FA" style="OLC"><paragraph id="HF04D674921174ABC841328BF1CF548BE"><enum>(4)</enum><header>Limitation on credit for meeting contracting goals</header><subparagraph id="H5147205DB793457DABD5F2685A7B884E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A Federal agency may allocate credit for a single prime contract not more than two times for purposes of demonstrating compliance with the Governmentwide goals established under paragraph (1)(A).</text></subparagraph><subparagraph id="H58021A05E5A84AA0BBCEF2CEED5FC6BE"><enum>(B)</enum><header>Allocation of credit</header><text display-inline="yes-display-inline">The first allocation of credit described in subparagraph (A) shall be applied toward the goal described in paragraph (1)(A)(i). A second allocation of such credit shall be applied as follows:</text><clause id="H62EF7531C67B42CFAB57451BFA97094C"><enum>(i)</enum><text display-inline="yes-display-inline">If the prime contract was awarded pursuant to a requirement to set aside such prime contract for a small business concern described in clause (ii), (iii), (iv), or (v) of paragraph (1)(A), the credit shall be applied toward the goal described in the appropriate clause that corresponds with the award.</text></clause><clause id="H1D1DAADEC5304C40ADD417EB3CBF78C9"><enum>(ii)</enum><text display-inline="yes-display-inline">If the prime contract was not awarded pursuant to a requirement to set aside such prime contract for a small business concern described in clause (ii), (iii), (iv), or (v) of paragraph (1)(A), the credit shall be applied toward any applicable goal described in such paragraph (1)(A).</text></clause></subparagraph><subparagraph id="HF25A9BE3D52043DBBE5ACF5F08AE17CC"><enum>(C)</enum><header>Credit defined</header><text display-inline="yes-display-inline">In this paragraph, the term <term>credit</term> means the value of a prime contract.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
