which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to reauthorize certain programs to reduce opioid overdose deaths, and for other purposes.</official-title></form><legis-body id="HC9B6DE74D5334300A4144C06BEF3D4F7" style="OLC"><section id="H34F8C651A36C48ADA9727F6CA1E4026A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Overdoses and Saving Lives Act 2.0</short-title></quote>.</text></section><section id="HC48BEB2A0C8342DE981243C35450743E"><enum>2.</enum><header>Reauthorization of grants for reducing overdose deaths</header><subsection id="HE1B94465E76B4EA989F5ACB516FBA583"><enum>(a)</enum><header>Grants</header><paragraph id="H1F6DF6C6A4614DABB5D4CA49F58E4097"><enum>(1)</enum><header>Repeal of maximum grant amount</header><text display-inline="yes-display-inline">Paragraph (2) of section 544(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd-3">42 U.S.C. 290dd–3(a)</external-xref>) is hereby repealed.</text></paragraph><paragraph id="H70C1E298578D407BA46785D5DEE32FFC"><enum>(2)</enum><header>Eligible entity; subgrants</header><text display-inline="yes-display-inline">Section 544(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd-3">42 U.S.C. 290dd–3(a)</external-xref>) is amended by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" id="H997068F241314187AFD29DBB3A953F3F" display-inline="no-display-inline"><paragraph id="H263008F643774AED8A0962F837C71778"><enum>(2)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>eligible entity</term> means a State, Territory, locality, Indian Tribe, Tribal organization, or Urban Indian organization.</text></paragraph><paragraph id="HD154BE023913493BA1BDE1E5195565BA"><enum>(3)</enum><header>Subgrants</header><text display-inline="yes-display-inline">For the purposes for which a grant is awarded under this section, the eligible entity receiving the grant may award subgrants to a Federally qualified health center (as defined in section 1861(aa) of the Social Security Act), an opioid treatment program (as defined in section 8.2 of title 42, Code of Federal Regulations (or any successor regulations)), any practitioner dispensing narcotic drugs pursuant to section 303(g) of the Controlled Substances Act, or any nonprofit organization that the Secretary deems appropriate.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HA8E1F48C976B4A12904122538B8397DC"><enum>(3)</enum><header>Prescribing</header><text display-inline="yes-display-inline">Section 544(a)(4) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd-3">42 U.S.C. 290dd–3(a)(4)</external-xref>) is amended—</text><subparagraph id="H9948E654AE5F4EA5AD439C714E26FC48"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>, including patients prescribed with both an opioid and a benzodiazepine</quote> before the semicolon at the end; and</text></subparagraph><subparagraph id="H92DD0F12F31C451EA4A6595B267A058A"><enum>(B)</enum><text>in subparagraph (D), by striking <quote>drug overdose</quote> and inserting <quote>substance overdose</quote>.</text></subparagraph></paragraph><paragraph id="H9D08CC49CAA04094B2AB3C7DBC362461"><enum>(4)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Paragraph (5) of section 544(c) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd-3">42 U.S.C. 290dd–3(c)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H53A96C1D120345C58FC746D5A457EDDD" display-inline="no-display-inline"><paragraph id="HA89F3C8305714738B10EDD9DA0D26950"><enum>(5)</enum><text display-inline="yes-display-inline">To establish protocols to connect patients who have experienced an overdose with appropriate treatment, including overdose reversal medications, medication assisted treatment, and appropriate counseling and behavioral therapies.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HD5B31455B6E046EFA51A83FC7ACE5471"><enum>(5)</enum><header>Waiver</header><text display-inline="yes-display-inline">Section 544 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd-3">42 U.S.C. 290dd–3</external-xref>) is amended—</text><subparagraph id="H07DC42E6093D47D0B70453D5F5960C43"><enum>(A)</enum><text>by redesignating subsections (d) through (f) as subsections (e) through (g), respectively;</text></subparagraph><subparagraph id="HC468266927C244E99647DED167653F22"><enum>(B)</enum><text>in subsection (f), as so redesignated, by striking <quote>subsection (d)</quote> and inserting <quote>subsection (e)</quote>; and</text></subparagraph><subparagraph id="H15787C3B497D4D978699CBA6CF34AC8B"><enum>(C)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" id="H81F6EBD4D37043C295FC7D4BB45A6D14" display-inline="no-display-inline"><subsection id="HFE88A9411BAE4B5B86E54E83B4A4290B"><enum>(d)</enum><header>Waiver</header><text display-inline="yes-display-inline">If the laws, regulations, or orders of a grantee under this section conflict in any respect with the requirements of the grant, the Secretary shall waive such requirements to the extent necessary to allow the grantee to carry out the activities described in subsection (c).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H0D1140A197404564BE28FC89AE0B41A8"><enum>(6)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Section 544(g) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd-3">42 U.S.C. 290dd–3</external-xref>), as redesignated, is amended by striking <quote>fiscal years 2017 through 2021</quote> and inserting <quote>fiscal years 2023 through 2027</quote>.</text></paragraph><paragraph id="H953D31C85E6D41298AA88955111902CA"><enum>(7)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Section 544 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd-3">42 U.S.C. 290dd–3</external-xref>), as amended, is further amended by striking <quote>approved or cleared</quote> each place it appears and inserting <quote>approved, cleared, or otherwise authorized</quote>.</text></paragraph></subsection><subsection id="H79F05D3E3C534407ABC5174B215D4380"><enum>(b)</enum><header>Improving access to overdose treatment</header><text>Paragraph (1) of section 107(b) of the Comprehensive Addiction and Recovery Act of 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/198">Public Law 114–198</external-xref>) is amended—</text><paragraph id="HF0BEF263CFD64EDD8198A749A8AD096D"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>Not later than 180 days after the date of enactment of this Act;</quote>;</text></paragraph><paragraph id="H56C4BC57BC9F43E3921F25A329260643"><enum>(2)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" id="H070A6F9263764BAF8352381201ABC48B" display-inline="no-display-inline"><subparagraph id="H19A73D64D99449E4BAFFED108D269EDC"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary of Health and Human Services may provide information to States, Territories, localities, Indian Tribes, Tribal organizations, and Urban Indian organizations on best practices for prescribing or co-prescribing a drug or device approved, cleared, or otherwise authorized under the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>) for emergency treatment of known or suspected opioid overdose, including for patients receiving chronic opioid therapy and patients being treated for opioid use disorders.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H4477762BB6F242A4B0147D61B04B1267"><enum>(3)</enum><text>in subparagraphs (B) and (C), by striking <quote>approved or cleared</quote> and inserting <quote>approved, cleared, or otherwise authorized</quote>. </text></paragraph></subsection></section><section id="H41EBD701DAA34384A596B41FEA3CA87F"><enum>3.</enum><header>Reauthorization of opioid overdose reversal medication access, education, and co-prescribing grant programs</header><subsection id="HDC9CF639C6D94F779E4C120280956C65"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">Section 545 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee">42 U.S.C. 290ee</external-xref>) is amended—</text><paragraph id="HE90A9A6420CB489EBE40052F73365B26"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">access, and education grant programs</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">access, education, and co-prescribing grant programs</header-in-text></quote>;</text></paragraph><paragraph id="H8B3BAA96125C4E92999B94304E792E12"><enum>(2)</enum><text>in the heading of subsection (a), by striking <quote><header-in-text level="subsection" style="OLC">Grants to States</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Grants</header-in-text></quote>;</text></paragraph><paragraph id="H79F359D48BA64AEF908AFA60B6813634"><enum>(3)</enum><text>in subsection (a), by striking <quote>shall make grants to States</quote> and inserting <quote>shall make grants to States, Territories, localities, Indian Tribes, Tribal organizations, and Urban Indian organizations</quote>;</text></paragraph><paragraph id="H9FCE37EEDF4F4FFEBF5CE9D2B7FA7FA8"><enum>(4)</enum><text>in subsection (a)(1), by striking <quote>implement strategies for pharmacists to dispense a drug or device</quote> and inserting <quote>implement strategies that increase access to drugs or devices</quote>;</text></paragraph><paragraph id="H34FA3B0A3D5246F989D88BC16679B26B"><enum>(5)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (4) and (5), respectively; and</text></paragraph><paragraph id="HF9B77B90FD61438BB970CA1E7E39ADF6"><enum>(6)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" id="HB12B10EC16CE4A7E957D67B6C6161538" display-inline="no-display-inline"><paragraph id="H381055677FB6412697ECE11F93B08484"><enum>(3)</enum><text display-inline="yes-display-inline">encourage health care providers to co-prescribe, as appropriate, drugs or devices approved, cleared, or otherwise authorized under the Federal Food, Drug, and Cosmetic Act for emergency treatment of known or suspected opioid overdose;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HFF5F5A21B4EA448DAE763BCAABD9A868"><enum>(b)</enum><header>Grant period</header><text display-inline="yes-display-inline">Section 545(d)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee">42 U.S.C. 290ee(d)(2)</external-xref>) is amended by striking <quote>3 years</quote> and inserting <quote>5 years</quote>.</text></subsection><subsection id="HF8AECE3962F7489DA477092E4F9F201B"><enum>(c)</enum><header>Limitation</header><text display-inline="yes-display-inline">Paragraph (3) of section 545(d) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee">42 U.S.C. 290ee(d)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H3EADEF3E5A594716AB107AA4E52801ED" display-inline="no-display-inline"><paragraph id="H37A341FFD1B64FAB9D5B92966A9B80F1"><enum>(3)</enum><header>Limitations</header><text display-inline="yes-display-inline">A State—</text><subparagraph id="H5C9E6BE791A146568B8D567AA18031A9"><enum>(A)</enum><text>may use not more than 10 percent of a grant under this section for educating the public pursuant to subsection (a)(5); and</text></subparagraph><subparagraph id="H1DBE0CA8CA5D4A2697AE445CCACEA9C7"><enum>(B)</enum><text display-inline="yes-display-inline">shall use at least 20 percent of a grant under this section to offset cost-sharing for distribution and dispensing of drugs or devices approved, cleared, or otherwise authorized under the Federal Food, Drug, and Cosmetic Act for emergency treatment of known or suspected opioid overdose.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE023A4C54E794B848A3E7CA22B7CB897"><enum>(d)</enum><header>Waiver</header><text display-inline="yes-display-inline">Section 545 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee">42 U.S.C. 290ee</external-xref>) is amended—</text><paragraph id="H25D107A32A5A48688D25BE3A16FCF5F1"><enum>(1)</enum><text>by redesignating subsections (f) through (h) as subsections (g) through (i), respectively; and</text></paragraph><paragraph id="H87307265C2624517A36A9A05E5C087D6"><enum>(2)</enum><text>by inserting after subsection (e) the following:</text><quoted-block style="OLC" id="H9B7A88D9F07F4A35B7952680D39FDCEA" display-inline="no-display-inline"><subsection id="H7148E062358C4367B186917F8D324626"><enum>(f)</enum><header>Waiver</header><text display-inline="yes-display-inline">If the laws, regulations, or orders of an applicant for a grantee under this section conflict in any respect with the requirements of the grant, the Secretary shall waive such requirements to the extent necessary to allow the grantee to carry out the activities described in subsection (a).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC8B7005BDDA141099F3CFF643C02AC7D"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Section 545(i)(1) of the Public Health Service Act, as redesignated, is amended by striking <quote>fiscal years 2017 through 2019</quote> and inserting <quote>fiscal years 2023 through 2027</quote>. </text></subsection><subsection id="H75DDDDFF747B4470BCC35976EA231548"><enum>(f)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Section 545 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee">42 U.S.C. 290ee</external-xref>), as amended, is further amended by striking <quote>approved or cleared</quote> each place it appears and inserting <quote>approved, cleared, or otherwise authorized</quote>.</text></subsection></section></legis-body></bill>
