<section section-type="section-one" id="H6F1C3E2BFE124F82BE0631777CE80436"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State-Based Education Loan Awareness Act</short-title></quote>.</text></section> <section section-type="subsequent-section" id="H7E29950B91604D238C0C4E16F329CDA4"><enum>2.</enum><header>State-based education loan programs</header><text display-inline="no-display-inline">Section 151 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1019">20 U.S.C. 1019</external-xref>) is amended—</text>
<paragraph id="H74845CC1CA4B4B76B57EC25BB8CD5F91"><enum>(1)</enum><text>in paragraph (8)(B)—</text> <subparagraph id="H8DE3559F408B45EE986C96DE72F00C4A"><enum>(A)</enum><text>in clause (i), by striking <quote>or</quote> after the semicolon;</text></subparagraph>
<subparagraph id="H516B0587BAA34DDF93CB5ED316351A8B"><enum>(B)</enum><text>in clause (ii), by striking the period at the end and inserting a semicolon; and</text></subparagraph> <subparagraph id="H833FCD45942947B69757D18084B5FEEC"><enum>(C)</enum><text>by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="HDE356C3118514682BE746741C16B7274">
<clause id="H9BDE7C73587840B3AC37566BA755C495"><enum>(iii)</enum><text>arrangements or agreements with respect to education loans made under a State-based education loan program; or</text></clause> <clause id="H513BEC7A4B094C50B00F75B095DA8DB8"><enum>(iv)</enum><text>arrangements or agreements with respect to education loans funded, insured, or guaranteed by any other Federal agency that is not the Department of Education.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HF14444210AE94024974A7EA1D6164041"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HD6F8E86105E2467EADCFB6E08B5A70F3"> <paragraph id="H624523598FCB4379907226527DC731B8"><enum>(10)</enum><header>State-based education loan program</header><text>The term <term>State-based education loan program</term> means an education loan program that—</text>
<subparagraph id="H824CD2336A4140FD9F85874E56F4AE9C"><enum>(A)</enum><text>is provided by a State agency, State authority, or nonprofit organization, separately or jointly;</text></subparagraph> <subparagraph id="HA426DA25575642EF93A0FBF78F453C9A"><enum>(B)</enum><text>makes loans that are not funded, insured, or guaranteed by the Federal Government;</text></subparagraph>
<subparagraph id="HA8203D275E094A3D962A57C32CF55CB7"><enum>(C)</enum><text>is authorized, established, or chartered by State law, or otherwise approved by the State;</text></subparagraph> <subparagraph id="HA919CFB422924A068839DB071F11692C"><enum>(D)</enum><text>offers one or more loans for which the interest rate and fees, as calculated in accordance with sections 106 and 107 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1605">15 U.S.C. 1605</external-xref>; 1606), are at least as favorable as the interest rate and fees of the Direct PLUS loans authorized under part D of title IV at the time such loan is originated; and</text></subparagraph>
<subparagraph commented="no" id="H076026BD3165443B846DC54C3A108F87"><enum>(E)</enum><text>is available only to a borrower who has been advised by an institution of higher education (as defined under section 102)—</text> <clause commented="no" id="HA8D4851E8B4D4769999FAE0835E6B613"><enum>(i)</enum><text>that the borrower has the opportunity to exhaust eligibility for Federal education loans made under part D of title IV prior to accepting a private education loan; and</text></clause>
<clause commented="no" id="HBEF9B34DFB524D8F954B820F5694DD4F"><enum>(ii)</enum><text>of the interest rates, fees, and benefits of such Federal education loans, including income-driven repayment options, opportunities for loan forgiveness, forbearance or deferment options, interest subsidies, and tax benefits.</text></clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
