Effective date.</toc-entry></toc></subsection></section><section id="HF7AD473C723E434BB859B2D0D1A64A98"><enum>2.</enum><header>Definitions and references</header><subsection id="H7126DB9C2B3E472DA4F1A1E663BA0007"><enum>(a)</enum><header>In general</header><text>As used in this Act:</text><paragraph id="H6124F299042A4A389AF5075B3A6C54A9"><enum>(1)</enum><text>The term <term>adjacent land</term> means any land not more than two miles from the boundary of a described land tract.</text></paragraph><paragraph id="HBE1D848A254E4D99820DACAD2D59D532"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>affiliate</term> means, with respect to any person, any of the following:</text><subparagraph id="HE3E70693B11F443A92C229FAA824444B"><enum>(A)</enum><text>Any person who controls, is controlled by, or is under common control with such person.</text></subparagraph><subparagraph id="H61AD07E0CB754A3AA9B862BC838DBFC2"><enum>(B)</enum><text>Any partner of such person.</text></subparagraph><subparagraph id="H67453DA321484F1C93925D39245B2AC9"><enum>(C)</enum><text>Any person owning at least 10 percent of the voting shares of such person.</text></subparagraph></paragraph><paragraph id="HFB69E31B96EF4A8F9235FA167EE33F76"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>agency</term> means any authority of the United States that is an <quote>agency</quote> under section 3502(1) of title 44, United States Code. </text></paragraph><paragraph id="HA6B8948C95954A718D93334327222708"><enum>(4)</enum><text>The term <term>applicant</term> means any person applying for a permit, license, or lease under this Act or a modification to or a renewal of a permit, license, or lease under this Act.</text></paragraph><paragraph id="H53B4DAD82A524955AD546642FF9F0D76"><enum>(5)</enum><text>The term <term>beneficiation</term> means the crushing and grinding of hardrock mineral ore and such processes as are employed to free the mineral from other constituents, including physical and chemical separation techniques.</text></paragraph><paragraph id="H7388DFF1B6044451BEC0EEB9F35E8792"><enum>(6)</enum><text>The term <term>casual use</term>—</text><subparagraph id="HED1C64CEDA1547C6AFAEDF385BF35458"><enum>(A)</enum><text>subject to subparagraphs (B) and (C), means mineral activities that do not ordinarily result in any disturbance of public lands and resources;</text></subparagraph><subparagraph id="HE77422001B7D47EF8BC0E90C02067D68"><enum>(B)</enum><text>includes collection of geochemical, rock, soil, or mineral specimens using handtools, hand panning, or nonmotorized sluicing; and</text></subparagraph><subparagraph id="H9B282C9964824C8D9674E414FA8DE04E"><enum>(C)</enum><text display-inline="yes-display-inline">does not include—</text><clause id="HC71408239DAB4C4F94C698AD891BC8D9"><enum>(i)</enum><text>the use of mechanized earth-moving equipment, suction dredging, or explosives;</text></clause><clause id="H7807B171C754400BA05F158166364794"><enum>(ii)</enum><text>the use of motor vehicles in areas closed to off-road vehicles;</text></clause><clause id="HCA592C27D1F9483CB92C694E8601DCB6"><enum>(iii)</enum><text>the construction of roads or drill pads; and</text></clause><clause id="H5F845415C7E246D28821D88F46FE45AE"><enum>(iv)</enum><text>the use of toxic or hazardous materials.</text></clause></subparagraph></paragraph><paragraph id="H0433EA2B598742B3A4E21F2E026A0F5B"><enum>(7)</enum><text>The term <term>claim holder</term> means a person holding a mining claim, millsite claim, or tunnel site claim located under the general mining laws and maintained in compliance with such laws. Such term may include an agent of a claim holder.</text></paragraph><paragraph id="H38E5698CEC844E6287BEDEE1A1670E71"><enum>(8)</enum><text>The term <term>control</term> means having the ability, directly or indirectly, to determine (without regard to whether exercised through one or more corporate structures) the manner in which an entity conducts mineral activities, through any means, including ownership interest, authority to commit the entity’s real or financial assets, position as a director, officer, or partner of the entity, or contractual arrangement.</text></paragraph><paragraph id="H858CF906EBA44DFA85B3A3DA4C800E26"><enum>(9)</enum><text>The term <term>crude ore</term> means ore in its unprocessed form, containing profitable amounts of the target mineral.</text></paragraph><paragraph id="H4EB391AB24B5458DB7D44E3F68B7AA5A"><enum>(10)</enum><text display-inline="yes-display-inline">The term <term>displaced material</term> means any crude ore and waste dislodged from its location at the time hardrock mineral activities begin at a surface, underground, or in-situ mine.</text></paragraph><paragraph id="HE0F3CF0F7E8D4A83BB0A9E20B39FB2B2"><enum>(11)</enum><text>The term <term>exploration</term>—</text><subparagraph id="HD565F4B67D8F4F49BD32B8D6A1A1A820"><enum>(A)</enum><text>subject to subparagraphs (B) and (C), means creating surface disturbance other than casual use, to evaluate the type, extent, quantity, or quality of minerals present;</text></subparagraph><subparagraph id="H1B0FF2C3D9844AEFBD8D7766B91A3FE2"><enum>(B)</enum><text>includes mineral activities associated with sampling, drilling, and analyzing hardrock mineral values; and</text></subparagraph><subparagraph id="HCCC6C5E66E8F4DD38ADA59048F8704D2"><enum>(C)</enum><text>does not include extraction of mineral material for commercial use or sale.</text></subparagraph></paragraph><paragraph id="H86AB3B6B44814F5B9C4613FC8FDFC7BB"><enum>(12)</enum><text display-inline="yes-display-inline">The term <term>Federal land</term> means any land, and any interest in land, that is owned by the United States, except lands in the National Park System, Indian lands, and lands on the Outer Continental Shelf.</text></paragraph><paragraph id="H38FFACBEA81E44839DD3439313F98095"><enum>(13)</enum><text>The term <term>Fund</term> means the Hardrock Minerals Reclamation Fund established by this Act.</text></paragraph><paragraph id="HC47BC018102F45E089B0D9C2CF39008E"><enum>(14)</enum><text display-inline="yes-display-inline">The term <term>Indian lands</term> means lands held in trust for the benefit of an Indian Tribe or individual or held by an Indian Tribe or individual subject to a restriction by the United States against alienation, or held by an Alaska Native village, village corporation, or regional corporation as defined in or established pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>).</text></paragraph><paragraph id="H3EA59B89E25249DFAB4171A43DB3423C"><enum>(15)</enum><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> means any Indian Tribe, band, nation, pueblo, or other organized group or community, including any Alaska Native village, village corporation, or regional corporation as defined in or established pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>), that is recognized as eligible for the special programs and services provided by the United States to Indians because of their status as Indians.</text></paragraph><paragraph id="HDAC7B72319294FBFBF5E05AEF196E932"><enum>(16)</enum><text>The term <term>hardrock mineral</term>—</text><subparagraph id="H6ADAD68729114B2487FE0FD0B3B63335"><enum>(A)</enum><text display-inline="yes-display-inline">subject to subparagraph (B), means any mineral that was subject to location under the general mining laws as of the date of enactment of this Act, and that is not subject to disposition under—</text><clause id="HF3E33152D34942BD997E0EB0F7C7FBAF"><enum>(i)</enum><text display-inline="yes-display-inline">the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>);</text></clause><clause id="HC16C61D9F04D418FBC548ACCB3BD6BA7"><enum>(ii)</enum><text display-inline="yes-display-inline">the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>);</text></clause><clause id="H181FFBDE22AE4BBA9126617294F5B9E2"><enum>(iii)</enum><text display-inline="yes-display-inline">the Act of July 31, 1947, commonly known as the Materials Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/30/601">30 U.S.C. 601 et seq.</external-xref>); or</text></clause><clause id="H433C83A716AB4114AACC79D3F1C3EA2E"><enum>(iv)</enum><text display-inline="yes-display-inline">the Mineral Leasing for Acquired Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/30/351">30 U.S.C. 351 et seq.</external-xref>); and</text></clause></subparagraph><subparagraph id="H3A07C5C0490A40D587394F4F08EA637B"><enum>(B)</enum><text>does not include any mineral that is subject to a restriction against alienation imposed by the United States and is—</text><clause id="H28F719BE0FC8403C908EB3CD5C110650"><enum>(i)</enum><text>held in trust by the United States for any Indian or Indian Tribe, as defined in section 2 of the Indian Mineral Development Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/25/2101">25 U.S.C. 2101</external-xref>); or</text></clause><clause id="HF45072123CF5412C8EDE0B75DE491EB2"><enum>(ii)</enum><text>owned by any Indian or Indian Tribe, as defined in that section.</text></clause></subparagraph></paragraph><paragraph id="HBE5E28203F0649A480ED7A3476BCE7E0" commented="no"><enum>(17)</enum><text display-inline="yes-display-inline">The term <term>mineral activities</term> means any activity on a mining claim, millsite claim, or tunnel site claim, or a lease, license, or permit issued under this Act, for, related to, or incidental to, mineral exploration, mining, beneficiation, processing, or reclamation activities for any hardrock mineral.</text></paragraph><paragraph id="H486C34BFA12B4F65AC0B28134DDB6A67"><enum>(18)</enum><text display-inline="yes-display-inline">The term <term>memorandum of agreement</term> means a document that records the terms and conditions agreed upon by an agency and an Indian Tribe through the consultation process regarding an activity. </text></paragraph><paragraph id="H5952AB93056941449981F4BB653CF2A9"><enum>(19)</enum><text display-inline="yes-display-inline">The term <term>National Conservation System unit</term> means any unit of the National Park System, National Wildlife Refuge System, National Wild and Scenic Rivers System, National Wilderness Preservation System, National Landscape Conservation System, or National Trails System, or a National Conservation Area, a National Recreation Area, a Wilderness Study Area, a National Monument, or any unit of the National Wilderness Preservation System or lands within the National Forest System, including:</text><subparagraph id="H12F1556CDFB447AB98F5058B1B96883D"><enum>(A)</enum><text>National Volcanic Monuments.</text></subparagraph><subparagraph id="H8694FAE6CE30440F9705F745C460BC97"><enum>(B)</enum><text display-inline="yes-display-inline">Recreation Areas, Scenic Recreation Areas, and Winter Recreation Areas.</text></subparagraph><subparagraph id="HE08DEBAE28A24EAA8ADC2886F2C85588"><enum>(C)</enum><text display-inline="yes-display-inline">Scenic Areas, Scenic-Research Areas, Scenic Highways, National Scenic and Wildlife Areas.</text></subparagraph><subparagraph id="H7083534910534D68AEB4C3F9A2962BFB"><enum>(D)</enum><text display-inline="yes-display-inline">National Game and Wildlife Preserves.</text></subparagraph><subparagraph id="HEA9125C4B91843728CD799F58DD32BC5"><enum>(E)</enum><text display-inline="yes-display-inline">Special Management, Wildlife, Conservation and Protection Areas, including botanical, hydrological (watershed), geological, historical, paleontological, and zoological areas.</text></subparagraph><subparagraph id="HE117A8ECA76C4405AFECFC37C757C50D"><enum>(F)</enum><text display-inline="yes-display-inline">Experimental Forests, Ranges, and Watersheds. </text></subparagraph><subparagraph id="H9F4D6F8EB1E249CF8B497EF14079EE03"><enum>(G)</enum><text>Research Sites and Research Natural Areas.</text></subparagraph><subparagraph id="HC0EBF0B65F844BC189CEADF04D08968F"><enum>(H)</enum><text display-inline="yes-display-inline">Inventoried Roadless Area, Colorado Roadless Area, and Idaho Roadless Area.</text></subparagraph><subparagraph id="HA197E0897520430CB16FC5B4F32F516C"><enum>(I)</enum><text display-inline="yes-display-inline">Recommended Wilderness and Primitive Areas.</text></subparagraph></paragraph><paragraph id="HCF9055194F314C359FBFCD0796EF62E4" commented="no"><enum>(20)</enum><text>The term <term>operator</term> means any person proposing or authorized by a permit issued under this Act to conduct mineral activities and any agent of such person.</text></paragraph><paragraph id="H6D23E214CC524891979F8B903486E993"><enum>(21)</enum><text>The term <term>person</term> means an individual, Indian Tribe, partnership, association, society, joint venture, joint stock company, firm, company, corporation, cooperative, or other organization and any instrumentality of State or local government including any publicly owned utility or publicly owned corporation of State or local government.</text></paragraph><paragraph id="HFC64A537B0164CBDAEE0A0D9939FC791"><enum>(22)</enum><text>The term <term>processing</term> means processes downstream of beneficiation employed to prepare locatable mineral ore into the final marketable product, including smelting and electrolytic refining.</text></paragraph><paragraph id="HF6E8988FC7154874AE1A57D4C3B5D22E"><enum>(23)</enum><text>The term <term>sacred site</term> means any specific delineated location on Federal land that is identified by an Indian Tribe—</text><subparagraph id="H29251881A41442D8B3EF0281C15CA182"><enum>(A)</enum><text>as sacred by virtue of its established religious significance to, or ceremonial use by, an Indian religion; or</text></subparagraph><subparagraph id="HE0FC5ABA54314B718CE37B702FC0AE75"><enum>(B)</enum><text>to be of established cultural significance.</text></subparagraph></paragraph><paragraph id="HB4F625DB6F7540A2800FE04BFE0AE488"><enum>(24)</enum><text>The term <term>Secretary</term> means the Secretary of the Interior, unless otherwise specified.</text></paragraph><paragraph id="HEFA5BCD491D347A9B5665C55BC131B5C"><enum>(25)</enum><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="H6282D8FBA4DF435DA825184884999907"><enum>(A)</enum><text>the Secretary of Agriculture (acting through the Chief of the Forest Service) with respect to National Forest System land; and</text></subparagraph><subparagraph id="H6D54B7493F3A4A9E938A7F68379CE327"><enum>(B)</enum><text>the Secretary of the Interior (acting through the Director of the Bureau of Land Management) with respect to other Federal land.</text></subparagraph></paragraph><paragraph id="HA2AA64AF4C464DCCB610868073DECAA1" commented="no"><enum>(26)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5BEB31DD6EA74345AE52D82A9FE39D55"><enum>(A)</enum><text>The term <term>small miner</term> means a person (including all related parties thereto) that—</text><clause id="HA2A219EDF74248AD97462B6290B9CB41" indent="up1" commented="no"><enum>(i)</enum><text>holds not more than 10 mining claims, mill sites, or tunnel sites, or any combination thereof, on public lands;</text></clause><clause id="HB42E832141BB459A87FDBC01E2DA6523" indent="up1" commented="no"><enum>(ii)</enum><text>holds leases and permits under this Act with respect to not more than 200 acres of Federal land;</text></clause><clause id="H830B947D1D50476CA5E8584655660104" indent="up1" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">certifies to the Secretary in writing that the person had annual gross income in the preceding calendar year from mineral production in an amount less than $50,000; and</text></clause><clause id="H751EE1430B52464BACC7097F215467E9" indent="up1" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">has performed assessment work required under the Mining Law of 1872 (<external-xref legal-doc="usc" parsable-cite="usc/30/28">30 U.S.C. 28 et seq.</external-xref>) to maintain any mining claims held by the person (including such related parties) for the assessment year ending on noon of September 1 of the calendar year in which payment of the claim maintenance fee was due.</text></clause></subparagraph><subparagraph id="H764930299FEB4AACA6741C68CBCFE53D" indent="up1" commented="no"><enum>(B)</enum><text>For purposes of subparagraph (A), with respect to any person, the term <term>all related parties</term> means—</text><clause id="H66CBEF9DD7DC425F87F24C4D694C8A9F" commented="no"><enum>(i)</enum><text>the spouse and dependent children (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/152">section 152</external-xref> of the Internal Revenue Code of 1986), of the person concerned; or</text></clause><clause id="HD3964E86FB8B4585BC14FB2BB940389C" commented="no"><enum>(ii)</enum><text>a person affiliated with the person concerned, including—</text><subclause id="H95F3849F68EA4BCDAD9D52399163DD4C" commented="no"><enum>(I)</enum><text>another person controlled by, controlling, or under common control with the person concerned; or</text></subclause><subclause id="HEC91716B9F7D4932802D58386F2C5C20" commented="no"><enum>(II)</enum><text>a subsidiary or parent company or corporation of the person concerned.</text></subclause></clause></subparagraph><subparagraph id="H738D1E7DEB0544C0A1F7DE26F27A092B" indent="up1" commented="no"><enum>(C)</enum><text>For purposes of subparagraph (A)(iii), the dollar amount shall be applied, for a person, to the aggregate of all annual gross income from mineral production under all mining claims held by or assigned to such person or all related parties with respect to such person, including mining claims located or for which a patent was issued before the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="HD15CF23738B148BF8098E31B4C080B57"><enum>(27)</enum><text>The term <term>temporary cessation</term> means a halt in mine-related production activities for a continuous period of no longer than 5 years.</text></paragraph><paragraph id="H22D7BDD3E61E47F9B11BCD03DD911267"><enum>(28)</enum><text>The term <term>ton</term> means 2,000 pounds avoirdupois (.90718 metric ton).</text></paragraph><paragraph id="H67569FB2A303464FB91F1EF8FC56FD33"><enum>(29)</enum><text>The term <term>undue degradation</term> means irreparable harm to significant scientific, cultural, or environmental resources on public lands.</text></paragraph><paragraph id="H42FDA2E25A02423A9AF59A6188E78837"><enum>(30)</enum><text>The term <term>valuable mineral deposit</term> means a deposit of hardrock minerals that is of sufficient value for a prudent operator to economically mine.</text></paragraph><paragraph id="HAC0C6F514C5B4B20BC8C0EA229D769F1"><enum>(31)</enum><text>The term <term>waste</term> means rock that must be fractured and removed in order to gain access to crude ore.</text></paragraph></subsection><subsection id="HCE02213FD2CB4B2EA662B1BAB2682D54"><enum>(b)</enum><header>References to other laws</header><paragraph commented="no" display-inline="no-display-inline" id="HCD6E9114FEF2479786E317AF42B0B8FD"><enum>(1)</enum><header>General mining laws</header><text>Any reference in this Act to the term <term>general mining laws</term> is a reference to those Acts that generally comprise chapters 2, 12A, and 16, and sections 161 and 162, of title 30, United States Code.</text></paragraph><paragraph id="H0CC1AEB33770450A933C7C1328169C8E"><enum>(2)</enum><header>Act of July 23, 1955</header><text display-inline="yes-display-inline">Any reference in this Act to the Act of July 23, 1955, is a reference to the Act entitled <quote>An Act to amend the Act of July 31, 1947 (61 Stat. 681) and the mining laws to provide for multiple use of the surface of the same tracts of the public lands, and for other purposes</quote> (<external-xref legal-doc="usc" parsable-cite="usc/30/601">30 U.S.C. 601 et seq.</external-xref>).</text></paragraph></subsection></section><section id="HA9637A2455614ED3A348AA33E7E9DC9B"><enum>3.</enum><header>Application rules</header><subsection id="HFC8B8FC5691A429F9E0FAC4AC9818D58"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">This Act applies to any mining claim, millsite claim, or tunnel site claim located under the general mining laws, before or on the date of enactment of this Act. </text></subsection><subsection id="H9AC3BD070F9C49DDA2ADFFF91D711EA1"><enum>(b)</enum><header>Application of Act to beneficiation and processing of non-Federal minerals on Federal lands</header><text display-inline="yes-display-inline">The provisions of this Act shall apply in the same manner and to the same extent to mining claims, millsite claims, tunnel site claims, and any land included in a lease or license issued under this Act, used for beneficiation or processing activities for any hardrock mineral.</text></subsection></section><title id="H23283611A7674803924F92740B26BA12"><enum>I</enum><header>Mineral Leasing, Exploration, and Development</header><section id="H5DEA01F0554A480BAE38FE3F9EFC4611"><enum>101.</enum><header>Closure to entry and location</header><subsection id="HA9C37BD61AC54C2DABA97BECEE6EA3DC"><enum>(a)</enum><header>Closure</header><text>Except as otherwise provided in this section, as of the effective date of this Act all Federal lands are closed to entry and location under the general mining laws, and no new rights under the general mining laws may be acquired.</text></subsection><subsection id="HFE6873054E7643DD9F24390C49B4CCB6"><enum>(b)</enum><header>Existing nonproducing claims</header><paragraph id="H93A89157C71441C7A86BA330A23F056C"><enum>(1)</enum><header>Claims without plan of operations</header><text display-inline="yes-display-inline">Any claim under the general mining laws existing on the effective date of this Act for which a plan of operations is not approved, or a notice of operations is not filed, before such date shall be subject to the requirements of this Act, and may remain in effect until not later than the end of the 10-year period beginning on the date of enactment of this Act if the claimholder remains in compliance with section 109, unless the claim holder—</text><subparagraph id="H67A67023A92C4B2290687C874589DFC7"><enum>(A)</enum><text>relinquishes the claim; or</text></subparagraph><subparagraph id="H7B5F08D41AA4446FA1CCE4216BC5007B"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrates eligibility for a lease and requests conversion under the regulations issued under subsection (d).</text></subparagraph></paragraph><paragraph id="H234465606A5748E0AB5CEFF8C4716C62"><enum>(2)</enum><header>Shortening of period</header><text display-inline="yes-display-inline">The 10-year period referred to in paragraph (1) shall be shortened to 3 years if—</text><subparagraph id="H9C60A617627648E9B141D35C0E9E8CB9"><enum>(A)</enum><text display-inline="yes-display-inline">the claim is for an area that is located in an area withdrawn or temporarily segregated from location under the general mining laws as of the effective date of this Act; or</text></subparagraph><subparagraph id="HAE3C6A69BE474204BB89F1AA555B5F20"><enum>(B)</enum><text>the claim belongs to a small miner.</text></subparagraph></paragraph><paragraph id="H5EFF4583BA2A40E08D0692A5F97DE9DB"><enum>(3)</enum><header>Conversion</header><text display-inline="yes-display-inline">Upon showing to the satisfaction of the Secretary of a valuable mineral deposit on lands subject to such a claim, the Secretary may convert the claim to a noncompetitive lease under the regulations issued under subsection (d).</text></paragraph><paragraph id="HF5EF6FF340E5427FA6BD67A447AA30CA"><enum>(4)</enum><header>Claims not converted</header><text display-inline="yes-display-inline">Any such claims not converted to leases at the end of the applicable period under paragraph (1) or (2) shall be considered invalid and void.</text></paragraph></subsection><subsection id="H95C7F2CE9F3C4DC8BD21FBF60CD43DC2"><enum>(c)</enum><header>Existing claims with plan of operation</header><paragraph id="HD99B7975460C4F0D9E5ACB6DDE023774"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of any claim under the general mining laws for which a plan of operations has been approved but for which operations have not commenced before the date of enactment of this Act—</text><subparagraph id="H7C0D6377C97B4096B134F9FD6938EDD3"><enum>(A)</enum><text>during the 10-year period beginning on the date of enactment of this Act—</text><clause id="H1944C5BA1CB04D858B4B8099CA2D8422"><enum>(i)</enum><text display-inline="yes-display-inline">mineral activities on lands subject to such claim shall be subject to such plan of operations; and</text></clause><clause id="H662863332EF746D7AED393127254A9B8"><enum>(ii)</enum><text>modification of such plan may be made in accordance with the provisions of law applicable before the date of enactment of this Act if such modifications are considered minor by the Secretary concerned; and</text></clause></subparagraph><subparagraph id="H49690D09084745C8A6F1F1A3666CF769"><enum>(B)</enum><text>the operator shall bring such mineral activities into compliance with this Act by the end of such 10-year period.</text></subparagraph></paragraph><paragraph id="HD8C4DAA698D24CD7B2E2A7A2C3D47D13"><enum>(2)</enum><header>Activities pending decision on modification to plan of operations</header><text display-inline="yes-display-inline">If an application for modification of a plan of operations referred to in paragraph (1)(A)(ii) has been timely submitted and an approved plan expires before the Secretary concerned takes action on the application, mineral activities and reclamation may continue in accordance with the terms of the expired plan until such Secretary makes an administrative decision on the application.</text></paragraph><paragraph id="H2C6AA492A6BB4788B820F4235BD9C820"><enum>(3)</enum><header>Conversion requirement</header><text display-inline="yes-display-inline">Any claims referred to in paragraph (1) may remain in effect for a period of up to 10 years. Any claim not converted to a lease under subsection (d) before the end of that period shall be subject to a fee of $100 per acre per day until the claim is converted to a lease.</text></paragraph></subsection><subsection id="H857C4B6308F3422DB0FC86E7E8AFDD3D"><enum>(d)</enum><header>Conversion regulations</header><paragraph id="HFE7C50364F134AE689D3AEA33732F891"><enum>(1)</enum><header>In general</header><text>The Secretary shall issue regulations not later than 1 year after the date of enactment of this Act to provide for the conversion of mining claims to noncompetitive mining leases.</text></paragraph><paragraph id="HC98008C39DF14C39884BF52A483689BA"><enum>(2)</enum><header>Content</header><text display-inline="yes-display-inline">The regulations issued under paragraph (1) shall—</text><subparagraph id="H31D233D3070A4FFEA0AB4ACA8945EC69"><enum>(A)</enum><text>prohibit the conversion of a mining claim to a mining lease by a claimholder who is in violation of this Act or other State or Federal environmental, health, or worker safety law;</text></subparagraph><subparagraph id="HA918310E94B74104BF42DFB56BDC575C"><enum>(B)</enum><text display-inline="yes-display-inline">allow the Secretary to exercise discretion to include nonmineral lands within the boundaries of any mill site associated with the mining claim to be converted to a noncompetitive lease;</text></subparagraph><subparagraph id="H2A38DC61E98D41BBBA7DB2D50864F1F0"><enum>(C)</enum><text>prohibit the area in any noncompetitive mining lease issued under this subsection to exceed the maximum area authorized by this Act to be leased to any person;</text></subparagraph><subparagraph id="H2372E83D6FF042F18688FBA7CF023788"><enum>(D)</enum><text>require the consent of the surface managing agency for conversion of a mining claim to a noncompetitive mining lease;</text></subparagraph><subparagraph id="HEAE2763EC14746D5B7A38139EE9CE71E"><enum>(E)</enum><text>require the fiscal terms of the converted noncompetitive mining lease to be the same as provided in this Act for other hardrock mining leases;</text></subparagraph><subparagraph id="H8D22BAF4686A491A89A07258EA447E6B"><enum>(F)</enum><text>require compliance with all provisions of this Act; and</text></subparagraph><subparagraph id="H772BA4DAF08A4B25B11D72FFC4BD4AA5"><enum>(G)</enum><text>include any other terms the Secretary considers appropriate.</text></subparagraph></paragraph></subsection><subsection id="H3947E23B75F14E60B929F06235C22260"><enum>(e)</enum><header>National Environmental Policy Act</header><text display-inline="yes-display-inline">The Secretary is not required to conduct an environmental analysis under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) for the issuance of a noncompetitive lease under this section, unless the noncompetitive lease modifies or extends the surface disturbance already authorized under a mine plan of operations covering the mining claim that is converted.</text></subsection></section><section id="H35402908257944CC8DD42C846E5D4995"><enum>102.</enum><header>Limitation on patents</header><subsection id="HA90D29EAF00F46CDA9CDA841EFE65D02"><enum>(a)</enum><header>Mining claims</header><paragraph id="H3074184A8ED44C47815F95305A3BEE2C"><enum>(1)</enum><header>Determinations required</header><text>After the date of enactment of this Act, no patent shall be issued by the United States for any mining claim located under the general mining laws unless the Secretary determines that, for the claim concerned—</text><subparagraph id="HEC69696FC8564E949922953DC1DF9F6D"><enum>(A)</enum><text>a patent application was filed with the Secretary on or before September 30, 1994; and</text></subparagraph><subparagraph id="H08C5E558D0534AE99D93C60F3F488D69"><enum>(B)</enum><text>all requirements established under sections 2325 and 2326 of the Revised Statutes (30 U.S.C. 29 and 30), in the case of a vein or lode claim, or sections 2329, 2330, 2331, and 2333 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/30/35">30 U.S.C. 35</external-xref>, 36, and 37), in the case of a placer claim, were fully complied with by that date.</text></subparagraph></paragraph><paragraph id="HF098489DEF7C4C27A89B1C4700F46EF9"><enum>(2)</enum><header>Right to patent</header><text>If the Secretary makes the determinations referred to in subparagraphs (A) and (B) of paragraph (1) for any mining claim, the holder of the claim shall be entitled to the issuance of a patent in the same manner and degree to which such claim holder would have been entitled to prior to the enactment of this Act, unless such determinations are withdrawn or invalidated by the Secretary or by a court of the United States.</text></paragraph></subsection><subsection id="H0145D65FA1E547EFA75C8DE84F90C45A"><enum>(b)</enum><header>Millsite claims</header><paragraph id="HC6CCA36A87D64313B8FC82DC037AFA53"><enum>(1)</enum><header>Determinations required</header><text>After the date of enactment of this Act, no patent shall be issued by the United States for any millsite claim located under the general mining laws unless the Secretary determines that for such millsite—</text><subparagraph id="HC0B671F6541C42AC8B6EBE0BD4882CE8"><enum>(A)</enum><text>a patent application for the land subject to such claim was filed with the Secretary on or before September 30, 1994; and</text></subparagraph><subparagraph id="H74E63D912C774FE9AAD7F0E6DE55795A"><enum>(B)</enum><text>all requirements applicable to such patent application were fully complied with before that date.</text></subparagraph></paragraph><paragraph id="H87A8DB6269CE4DE193096EAE714DD115"><enum>(2)</enum><header>Right to patent</header><text display-inline="yes-display-inline">If the Secretary makes the determinations described in subparagraphs (A) and (B) of paragraph (1) for any millsite claim, the holder of the claim shall be entitled to the issuance of a patent in the same manner and degree to which such claim holder would have been entitled to prior to the enactment of this Act, unless such determinations are withdrawn or invalidated by the Secretary or by a court of the United States.</text></paragraph></subsection></section><section id="H9E391C59085C474D95CD27C07821FF77"><enum>103.</enum><header>Prospecting license and hardrock leases</header><subsection id="HFC7B59B32ED34C0EBEDD365C5E67E338"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No person may conduct mineral prospecting for commercial purposes for any hardrock mineral on Federal lands without a prospecting license or a small miners lease.</text></subsection><subsection id="HF3D6A17BF3CA4284A567211D57996A61"><enum>(b)</enum><header>Prospecting licenses</header><paragraph id="HA55EE97251EA4994A2C9ABFA138620F9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may, under such rules and regulations as the Secretary may prescribe and with the concurrence of the relevant surface management agency, grant an applicant a prospecting license that shall give the exclusive right to prospect for specified hardrock minerals on Federal lands for a period of not exceeding 2 years.</text></paragraph><paragraph id="H10078959C0924E948CA8100558133A50"><enum>(2)</enum><header>Maximum area</header><text>The area subject to such a license shall not exceed 2,560 acres of land, in reasonably compact form.</text></paragraph><paragraph id="HBD5752FC685A4E5CA36EB14738005CFB"><enum>(3)</enum><header>License application fee</header><text>The Secretary shall charge a fee for each license application to cover the costs of processing the license, and the license shall be subject to annual rentals equal to $10 per acre per year.</text></paragraph><paragraph id="HCCBAF07465F041C9B3BF6B73E40600F6"><enum>(4)</enum><header>Terms and conditions</header><text display-inline="yes-display-inline">A prospecting license must conform with the terms and conditions of a comprehensive land use plan approved under the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>) or the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>). For areas where a comprehensive land use plan treating hardrock mining as a multiple-use activity has not been completed, the Secretary concerned shall ensure that the land to be covered by the license is suitable for mineral activities.</text></paragraph><paragraph id="H7E75E73B38CB46998E936D8E625B461F"><enum>(5)</enum><header>Extension</header><text>A prospecting license may be extended for up to an additional 4 years upon a showing by the licensee that the licensee explored with reasonable diligence and was unable to determine the existence and workability of a valuable deposit covered by the license, or that the failure to perform diligent prospecting activities was due to conditions beyond the licensee’s control.</text></paragraph></subsection><subsection id="H3517E04C996D44C0AEF770E0DD953D56"><enum>(c)</enum><header>Noncompetitive leases</header><paragraph id="HF7BD2E39C74D4476830CFF6BACD6C782"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Upon a showing to the satisfaction of the Secretary by a prospecting licensee under subsection (a) that a valuable deposit of a hardrock mineral has been discovered by the licensee within an area covered by the prospecting license and with the consent of the surface agency, the licensee shall be entitled to a lease for any or all of the land included in the prospecting license, as well as any nonmineral lands necessary for processing or milling operations, at a royalty of no less than 12.5 percent of the gross value of production of hardrock minerals or mineral concentrates or products derived from hardrock minerals under the lease. Rentals for such lease shall be set by the Secretary at no less than $10 per acre per year, with rentals paid in any one year credited against royalties accruing for that year. The recipient of such lease is not entitled to an operations permit. </text></paragraph><paragraph id="H5EE10EA06D764CA3AE66FBB61F40962A"><enum>(2)</enum><header>Lease period</header><subparagraph id="H0689074F52F4437787BF3D703EF4C5B8"><enum>(A)</enum><header>In general</header><text>A lease under this section shall be for a period of 20 years, with the right to renew for successive periods of 10 years if hardrock minerals are being produced in commercial quantities under the lease.</text></subparagraph><subparagraph id="H56799756554647C3BF2CB5001BFEBBD8"><enum>(B)</enum><header>Extension during nonproduction</header><text>If hardrock minerals are not being produced in commercial quantities at the end of the primary term or any subsequent term of such a lease, the Secretary may issue a 10-year extension of the lease in the interest of conservation, reclamation maintenance, or upon a successful showing by the lessee that the lease cannot be successfully operated at a profit or for other reasons. No more than one extension under this subparagraph may be issued.</text></subparagraph></paragraph></subsection><subsection id="H07714C19E3D3410884868DE7B976F69E"><enum>(d)</enum><header>Cumulative acreage limitation</header><text>No person may take, hold, own, or control at one time, whether acquired directly from the Secretary under this Act or otherwise, hardrock mining leases or licenses for an aggregate of more than 20,480 acres in any one State.</text></subsection><subsection id="H8B9B3BF8BF314A99A7A58B44B127CFEF"><enum>(e)</enum><header>Reduction of royalty rate</header><paragraph id="H326B653819124DA2B9A59E0DA12D8537"><enum>(1)</enum><text>Subject to paragraph (2), the Secretary—</text><subparagraph id="H4C854F2C8BF94E4690BB3CA6AFCE93C4"><enum>(A)</enum><text>may reduce the royalty rate for a lease upon a showing by clear and convincing evidence by the person conducting mineral activities under the lease that production would not occur without the reduction in royalty; and</text></subparagraph><subparagraph id="H2A6F32728C894E7B804DDAE70CD88E33"><enum>(B)</enum><text>may reduce royalty and rental rates for a lease to encourage exploration for and development of hardrock minerals classified as strategic and critical by the Department of Energy.</text></subparagraph></paragraph><paragraph id="H423371C7D975485FA3ACACF0B60374A2"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may not reduce the royalty rate for a lease pursuant to paragraph (1) to a royalty rate of less than 6.25 percent.</text></paragraph></subsection><subsection id="H92BB499A12E54F1799A357469443E354"><enum>(f)</enum><header>Protection of land and other resources</header><text display-inline="yes-display-inline">The Secretary may include in any lease or license issued under this Act such provisions as are necessary to adequately protect the lands and other resources in the vicinity of the area subject to the lease or license. For land not managed by the Department of the Interior, the Secretary shall consult with the appropriate surface management agency in formulating such provisions.</text></subsection></section><section id="H7CCA9E3EF33A4DED9CCA13A20B1B2995"><enum>104.</enum><header>Competitive leasing</header><subsection id="H03C4D3BB513A4887862EE662D8685CEB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to sections 111 and 112, Federal lands known to contain valuable deposits of hardrock minerals that are not covered by claims, licenses, or leases may only be open to hardrock mineral exploration or development through competitive leasing by the Secretary by such methods the Secretary may adopt by regulation and in such areas as the Secretary may determine, including nonmineral lands the Secretary considers necessary for processing or milling operations. The total area of land subject to any such lease shall not exceed 2,560 acres.</text></subsection><subsection id="HA4ED4A806B9F4AEFA5B38CEFEA3CC412"><enum>(b)</enum><header>Terms and requirements</header><text display-inline="yes-display-inline">All terms and requirements for competitive leases under this section shall be the same as if the leases were issued noncompetitively under section 103(c).</text></subsection></section><section id="H269DFB795E7F45DD9A71AEED1586D2F5"><enum>105.</enum><header>Small miners leases</header><subsection id="H489851BCF2F44E8C91FCBCD632C8053F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may issue small miners leases to qualified small miners that apply, under such rules and regulations as the Secretary may prescribe, including conditions to require diligent development of the lease and to ensure protection of surface resources and groundwater.</text></subsection><subsection id="HE7C0043BD0DF493BAAF21808265A6A6B"><enum>(b)</enum><header>Exclusive right</header><text>A small miners lease shall give the lease holder the exclusive right to prospect for hardrock minerals for 3 years on up to 200 acres of contiguous or non-contiguous Federal land.</text></subsection><subsection id="H1217A8EAD7BA4AB9A92DA6F6B869AF1D"><enum>(c)</enum><header>Application fee</header><text>The Secretary shall charge a reasonable application fee for such a lease.</text></subsection><subsection id="H87C36414491A4773A4525C3E50662755"><enum>(d)</enum><header>Rentals</header><text>Rentals for such a lease shall be $5 per acre per year for the first 3 years.</text></subsection><subsection id="H2D4CF57AE0A0481B9C258EDED585C528"><enum>(e)</enum><header>Renewal</header><text>Such leases may be renewed for additional 3-year periods, with no limit, with a $10 per acre per year rental charged for renewed leases.</text></subsection><subsection id="H4C2CD080F61743B889752D0EE6C6CD6E"><enum>(f)</enum><header>Challenge</header><text>Any individual may file a challenge with the Secretary that a lease holder is in violation of the diligence terms of a small miners lease or does not qualify as a small miner. A small miners lease that is under such a challenge may not be renewed unless the Secretary has determined that the lease holder is a small miner and is in compliance with all the terms of the lease.</text></subsection><subsection id="HD761BCCD692F4F0796FE2008464EA08A"><enum>(g)</enum><header>No royalties</header><text>No royalties shall be charged for commercial production under a small miners lease.</text></subsection><subsection id="H713D3F3DC4104041A768555DF6603DD0"><enum>(h)</enum><header>Conversion of existing claims</header><text display-inline="yes-display-inline">An existing claim, as of the date of enactment of this Act, that belongs to an individual that qualifies as a small miner may be converted to a small miners lease under the same terms and conditions that apply to other small miners leases, except that such lease—</text><paragraph id="H511E84A707874C78AE0E1A39C0F2D76C"><enum>(1)</enum><text>shall not be subject to rental during the primary term of the lease;</text></paragraph><paragraph id="H96666D874CBE4CF989A659176CFF7241"><enum>(2)</enum><text>shall be subject to a rental of $5 per acre per year for the first 3-year renewal of the lease; and</text></paragraph><paragraph id="H8DF5D2D6069441A69BD400EEB62D6E90"><enum>(3)</enum><text>shall be subject to a rental of $10 per acre per year for any subsequent 3-year renewal of the lease.</text></paragraph></subsection><subsection id="HE949062A078D4F9CAA2D306E6BB696D3"><enum>(i)</enum><header>Limitations</header><text>A small miners lease—</text><paragraph id="H1A24462D56584532A2C9AED7AA5750E9"><enum>(1)</enum><text>may only be held by the primary lease holder, a spouse thereof, or a direct descendent thereof;</text></paragraph><paragraph id="HC0C06C628FC24DB1A9D918508A59FE21"><enum>(2)</enum><text>may not be sold or transferred, other than to a spouse or direct descendent of the primary lease holder; and</text></paragraph><paragraph id="H5C377AC4B5F440AB9D46A217861ECB66"><enum>(3)</enum><text>is subject to all permitting requirements under this Act.</text></paragraph></subsection><subsection id="HDF89EDC00D124F52AEE9F1ECF8EE0BFB"><enum>(j)</enum><header>Conversion to hardrock mineral lease</header><text display-inline="yes-display-inline">If, with regards to a lease, the lease holder no longer qualifies as a small miner at the time such lease holder applies for a renewal of such lease, such lease holder shall not be eligible to renew the small miners lease, but shall be eligible for a noncompetitive hardrock mineral lease issued under section 103(c). Notwithstanding section 103(c)(1), royalties under such a lease shall only be due on the gross income that exceeds the amount of gross income specified in such definition as of the time the hardrock mineral lease is issued.</text></subsection></section><section id="H5CAAF6F81DF7411B90361596B26EFF0A"><enum>106.</enum><header>Lands containing nonhardrock minerals; other uses</header><subsection id="H2BE6049C8E894B078C96CAC4F975EDB0"><enum>(a)</enum><header>In general</header><text>In issuing licenses and leases under this Act for lands that contain deposits of coal or other nonhardrock minerals, the Secretary shall reserve to the United States such nonhardrock minerals for disposal under applicable laws.</text></subsection><subsection id="H7E7E36117E4E4C2187508CF3097DA3A6"><enum>(b)</enum><header>Other uses of licensed and leased lands</header><paragraph id="H19F8911801524E0999BCB0F7D34716A3"><enum>(1)</enum><header>In general</header><text>The Secretary shall promulgate regulations to allow for other uses of the lands covered by a prospecting license under this Act, including leases for other minerals, if such other uses would not unreasonably interfere with operations under the prospecting license.</text></paragraph><paragraph id="HEFDE2AA24D4E4765AA130D50B7A704D9"><enum>(2)</enum><header>Prospecting licenses</header><text>The Secretary shall include in such prospecting licenses such terms and conditions as the Secretary finds necessary to avoid unreasonable interference with other uses occurring on, or other leases of, the licensed lands.</text></paragraph><paragraph id="HC81215B7057F4F06B29F5ACB8C92A3D7"><enum>(3)</enum><header>Leases</header><text>The Secretary shall include in leases under this Act stipulations to allow for simultaneous operations under other leases for the same lands.</text></paragraph></subsection></section><section id="HE9FC0BB4DD7E4CF68C7A8C5BBCE3B45C"><enum>107.</enum><header>Royalty</header><subsection id="HCAA3709E084542F59BC877698AE4C928"><enum>(a)</enum><header>Existing production</header><text display-inline="yes-display-inline">Production of hardrock minerals on Federal land under an operations permit from which valuable hardrock minerals were produced in commercial quantities before the date of enactment of this Act, other than production under a small miners lease, shall be subject to a royalty established by the Secretary at no less than 8 percent of the gross value of such production, or of mineral concentrates or products derived from hardrock minerals. Any Federal land added through a plan modification to an operations permit on Federal land that is submitted after the date of enactment of this Act shall be subject to a royalty established by the Secretary for such lease of no less than 12.5 percent of the gross value of production of hardrock minerals, or mineral concentrates or products derived from hardrock minerals.</text></subsection><subsection id="H8B4750B9AA1443B7B544673E58169D77"><enum>(b)</enum><header>Liability</header><text>The claim or lease holder, or any operator to whom the claim or lease holder has assigned the obligation to make royalty payments under the claim or lease and any person who controls such claim or lease holder or operator, shall be liable for payment of such royalties.</text></subsection><subsection id="H4EC72D0857404FE7B94353FEBB3C255A"><enum>(c)</enum><header>Disposition</header><text>Of the revenues collected under this title, including rents, royalties, claim maintenance fees, interest charges, fines, and penalties—</text><paragraph id="HA9299E09AF6F496295B6442C602BF611"><enum>(1)</enum><text>25 percent shall be paid to the State within the boundaries of which the leased, licensed, or claimed lands, or operations subject to such interest charges, fines, or penalties are or were located; and</text></paragraph><paragraph id="HFC874E89788243CEA1D51390EE2E353C"><enum>(2)</enum><text display-inline="yes-display-inline">the remainder shall be deposited in the account established under section 401.</text></paragraph></subsection><subsection id="H6278199395FC4E6987DA432339691A7A"><enum>(d)</enum><header>Duties of claim or lease holders, operators, and transporters</header><paragraph id="HBC4D6C445822433D9B87CB679B9FE9C6"><enum>(1)</enum><header>Regulation</header><text display-inline="yes-display-inline">The Secretary shall prescribe by rule the time and manner in which—</text><subparagraph id="H313C012E8FFD4FA2AF604E7758D14771"><enum>(A)</enum><text>a person who is required to make a royalty payment under this section shall make such payment; and</text></subparagraph><subparagraph id="H531625557B244B8782707DCD02696872"><enum>(B)</enum><text>shall notify the Secretary of any assignment that such person may have made of the obligation to make any royalty or other payment under a mining claim or lease under this title.</text></subparagraph></paragraph><paragraph id="HF7C37501591245EF96444AAE0C25FD9C"><enum>(2)</enum><header>Written instrument</header><text>Any person paying royalties under this section shall file a written instrument, together with the first royalty payment, affirming that such person is responsible for making proper payments for all amounts due for all time periods for which such person has a payment responsibility.</text></paragraph><paragraph id="H18A8E68398264A00AB49AD5F29CE992C"><enum>(3)</enum><header>Additional amounts</header><text display-inline="yes-display-inline">Such responsibility for the periods referred to in paragraph (2) shall include any and all additional amounts billed by the Secretary and determined to be due by final agency or judicial action.</text></paragraph><paragraph id="HFA9D6E864CFA4218A513C9688DB623E4"><enum>(4)</enum><header>Joint and several liability</header><text>Any person liable for royalty payments under this section who assigns any payment obligation shall remain jointly and severally liable for all royalty payments due for the period.</text></paragraph><paragraph id="HEB67CAE71D1B41C885E0995F29968189"><enum>(5)</enum><header>Obligations</header><text>A person conducting mineral activities shall—</text><subparagraph id="HCC2173E7D99C4A68962A86598800CDBF"><enum>(A)</enum><text>develop and comply with the site security provisions in the operations permit designed to protect from theft the hardrock minerals, concentrates, or products derived therefrom that are produced or stored on the area subject to a mining claim or lease, and such provisions shall conform with such minimum standards as the Secretary may prescribe by rule, taking into account the variety of circumstances on areas subject to mining claims and leases; and</text></subparagraph><subparagraph id="H25B5DEED92BB45ADBD1D1546F63751AF"><enum>(B)</enum><text>not later than the fifth business day after production begins anywhere on an area subject to a mining claim or lease, or production resumes after more than 90 days after production was suspended, notify the Secretary, in the manner prescribed by the Secretary, of the date on which such production has begun or resumed.</text></subparagraph></paragraph><paragraph id="H22042DE528A34E2BAC4EAFA0001E31C1"><enum>(6)</enum><header>Required documentation</header><text>The Secretary may by rule require any person engaged in transporting a hardrock mineral, concentrate, or product derived therefrom to carry on his or her person, in his or her vehicle, or in his or her immediate control, documentation showing, at a minimum, the amount, origin, and intended destination of the hardrock mineral, concentrate, or product derived therefrom in such circumstances as the Secretary determines is appropriate.</text></paragraph></subsection><subsection id="HB4A412D7011F475295FDF40FA20B142F"><enum>(e)</enum><header>Recordkeeping and reporting requirements</header><paragraph id="HCC23018071C645B7A67790C43B8D867C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A claim or lease holder, operator, or other person directly involved in developing, producing, processing, transporting, purchasing, or selling hardrock minerals, concentrates, or products derived therefrom, subject to this Act, through the point of royalty computation shall establish and maintain any records, make any reports, and provide any information that the Secretary may reasonably require for the purposes of implementing this section or determining compliance with rules or orders under this section. Such records shall include periodic reports, records, documents, and other data. Such reports may also include pertinent technical and financial data relating to the quantity, quality, composition volume, weight, and assay of all minerals extracted from the mining claim or lease.</text></paragraph><paragraph id="H8D8594E174074A3AA01532DD40E90417"><enum>(2)</enum><header>Availability for inspection</header><text>Upon the request of any officer or employee duly designated by the Secretary conducting an audit or investigation pursuant to this section, the appropriate records, reports, or information that may be required by this section shall be made available for inspection and duplication by such officer or employee.</text></paragraph><paragraph id="HA08F810DEDB040A98804E1BDD7814732"><enum>(3)</enum><header>Forfeiture</header><text>Failure by a claim or lease holder, operator, or other person referred to in the first sentence to cooperate with such an audit, provide data required by the Secretary, or grant access to information may, at the discretion of the Secretary, result in involuntary forfeiture of the claim or lease.</text></paragraph><paragraph id="H8BAF3A385D5F442D957B895DBCF60148"><enum>(4)</enum><header>Maintenance of records</header><text display-inline="yes-display-inline">Records required by the Secretary under this section shall be maintained for 7 years after release of financial assurance under section 306 unless the Secretary notifies the operator that the Secretary has initiated an audit or investigation involving such records and that such records must be maintained for a longer period. In any case when an audit or investigation is underway, records shall be maintained until the Secretary releases the operator of the obligation to maintain such records.</text></paragraph></subsection><subsection id="H354249C8000249859EA4D95E7EA92D25"><enum>(f)</enum><header>Audits</header><text>The Secretary is authorized to conduct such audits of all claim or lease holders, operators, transporters, purchasers, processors, or other persons directly or indirectly involved in the production or sale of minerals covered by this Act, as the Secretary deems necessary for the purposes of ensuring compliance with the requirements of this section. For purposes of performing such audits, the Secretary shall, at reasonable times and upon request, have access to, and may copy, all books, papers and other documents that relate to compliance with any provision of this section by any person.</text></subsection><subsection id="H3C46BB8C271F4AA5995EA7026D51DE9D"><enum>(g)</enum><header>Cooperative agreements</header><paragraph id="H54517966D32B41ADBF4102E3B4831D14"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary is authorized to enter into cooperative agreements with the Secretary of Agriculture to share information concerning the royalty management of hardrock minerals, concentrates, or products derived therefrom, to carry out inspection, auditing, investigation, or enforcement (not including the collection of royalties, civil or criminal penalties, or other payments) activities under this section in cooperation with the Secretary, and to carry out any other activity described in this section.</text></paragraph><paragraph id="H63A4AEBB492741D389E4FD88585BEBBD"><enum>(2)</enum><header>Secretary of Agriculture</header><text>Except as provided in paragraph (3), and pursuant to a cooperative agreement, the Secretary of Agriculture shall, upon request, have access to all royalty accounting information in the possession of the Secretary respecting the production, removal, or sale of hardrock minerals, concentrates, or products derived therefrom from claims or leases on lands open to location under this Act.</text></paragraph><paragraph id="HE4670FE872114960B2062DA956CEB0E6"><enum>(3)</enum><header>Trade secrets</header><text>Trade secrets, proprietary, and other confidential information protected from disclosure under section 552 of title 5, United States Code, shall be made available by the Secretary to other Federal agencies as necessary to assure compliance with this Act and other Federal laws. The Secretary, the Secretary of Agriculture, the Administrator of the Environmental Protection Agency, and other Federal officials shall ensure that such information is provided protection in accordance with the requirements of that section.</text></paragraph></subsection><subsection id="HAA0909AA9C0D4B59B9AEF89DE4962ACF"><enum>(h)</enum><header>Interest and substantial underreporting assessments</header><paragraph id="H6AA83877933B432E93D7F82E8C8BCFD7"><enum>(1)</enum><header>Payments not received</header><text display-inline="yes-display-inline">In the case of mining claims or leases where royalty payments are not received by the Secretary on the date that such payments are due, the Secretary shall charge interest on such underpayments at the same interest rate as the rate applicable under <external-xref legal-doc="usc" parsable-cite="usc/26/6621">section 6621(a)(2)</external-xref> of the Internal Revenue Code of 1986. In the case of an underpayment, interest shall be computed and charged only on the amount of the deficiency and not on the total amount.</text></paragraph><paragraph id="HD760AAFC203D41BEB453472CDF6F9E72"><enum>(2)</enum><header>Underreporting</header><text>If there is any underreporting of royalty owed on production from a claim or lease for any production month by any person liable for royalty payments under this section, the Secretary shall assess a penalty of not greater than 25 percent of the amount of that underreporting.</text></paragraph><paragraph id="H90231992B6194B9AAFF936E01FF5FA6F"><enum>(3)</enum><header>Self-reporting</header><text>The Secretary may waive or reduce the assessment provided in paragraph (2) of this subsection if the person liable for royalty payments under this section corrects the underreporting before the date such person receives notice from the Secretary that an underreporting may have occurred, or before 90 days after the date of enactment of this section, whichever is later.</text></paragraph><paragraph id="H650B0D4ABF1A4CF3949FD6F641E09F92"><enum>(4)</enum><header>Waiver</header><text>The Secretary shall waive any portion of an assessment under paragraph (2) of this subsection attributable to that portion of the underreporting for which the person responsible for paying the royalty demonstrates that—</text><subparagraph id="HCB6CC48201E34D09AEBE7F9038A14BF8"><enum>(A)</enum><text>such person had written authorization from the Secretary to report royalty on the value of the production on basis on which it was reported;</text></subparagraph><subparagraph id="H0AB38863D5E34C039B256C98F0577C9B"><enum>(B)</enum><text>such person had substantial authority for reporting royalty on the value of the production on the basis on which it was reported;</text></subparagraph><subparagraph id="H1E8EEA7FB0994978AFE89474323BEBD0"><enum>(C)</enum><text>such person previously had notified the Secretary, in such manner as the Secretary may by rule prescribe, of relevant reasons or facts affecting the royalty treatment of specific production which led to the underreporting; or</text></subparagraph><subparagraph id="H1684F89831FB4493BB106239651BAFDF"><enum>(D)</enum><text>such person meets any other exception which the Secretary may, by rule, establish.</text></subparagraph></paragraph><paragraph id="HC5197840CB2E49FEA9CAB9EFDF046AED"><enum>(5)</enum><header>Definition</header><text>For the purposes of this subsection, the term <term>underreporting</term> means the difference between the royalty on the value of the production that should have been reported and the royalty on the value of the production which was reported, if the value that should have been reported is greater than the value that was reported.</text></paragraph><paragraph id="H302C32E8715548B388975A0AC5E020B4"><enum>(6)</enum><header>Hardrock Minerals Reclamation Fund</header><text display-inline="yes-display-inline">All penalties collected under this subsection shall be deposited in the Hardrock Minerals Reclamation Fund established by this Act.</text></paragraph></subsection><subsection id="HF793D02876034DD5AF20910E8EDF7893"><enum>(i)</enum><header>Expanded royalty obligations</header><text display-inline="yes-display-inline">Each person liable for royalty payments under this section shall be jointly and severally liable for royalty on all hardrock minerals, concentrates, or products derived therefrom lost or wasted from a mining claim or lease when such loss or waste is due to negligence on the part of any person or due to the failure to comply with any rule, regulation, or order issued under this section.</text></subsection><subsection id="HCF42C805F1B7456BAB0F88E8531C952B"><enum>(j)</enum><header>Gross income from mining defined</header><text display-inline="yes-display-inline">For the purposes of this section, for any hardrock mineral, the term <term>gross income from mining</term> has the same meaning as the term <term>gross income</term> in <external-xref legal-doc="usc" parsable-cite="usc/26/613">section 613(c)</external-xref> of the Internal Revenue Code of 1986.</text></subsection><subsection id="H2F35264987E64F8AA8ACED9271B99C77"><enum>(k)</enum><header>Effective date</header><text>Royalties under this Act shall take effect with respect to the production of hardrock minerals after the enactment of this Act, but any royalty payments attributable to production during the first 12 calendar months after the enactment of this Act shall be payable at the expiration of such 12-month period.</text></subsection><subsection id="HE2BD5F8767B14DE39ED20C6151285AE4"><enum>(l)</enum><header>Failure To comply with royalty requirements</header><text display-inline="yes-display-inline">Any person who fails to comply with the requirements of this section or any regulation or order issued to implement this section shall be liable for a civil penalty under section 109 of the Federal Oil and Gas Royalty Management Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1719">30 U.S.C. 1719</external-xref>) to the same extent as if the claim or lease maintained in compliance with this Act were a lease under such Act.</text></subsection></section><section id="H2AB8D0A760ED49608C5A947B0C6430C0"><enum>108.</enum><header>Existing production</header><text display-inline="no-display-inline">The holder of a mining claim located or converted under this Act for which mineral activities have already commenced under an approved plan of operations as of the date of enactment of this Act shall have the exclusive right of possession and use of the claimed land for mineral activities, including the right of ingress and egress to such claimed lands for such activities, subject to the rights of the United States under this Act and other applicable Federal law. Such rights of the claim holder shall terminate upon completion of mineral activities on such lands to the satisfaction of the Secretary.</text></section><section id="H0C1A7F14D13C409BA201BA90DE42B6E8"><enum>109.</enum><header>Hardrock mining claim maintenance fee</header><subsection id="H8AF51138ADAE49EBB2298BB277131ECB"><enum>(a)</enum><header>Fee</header><paragraph id="H57FAB68E61A04787B815CD92965C4274"><enum>(1)</enum><header>In general</header><subparagraph id="H31FD55D8A6314CB4920CD4CA4BF68660"><enum>(A)</enum><header>Required fees</header><text>Except as provided in section 2511(e)(2) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/30/242">30 U.S.C. 242</external-xref>), or as otherwise provided in this Act, for each unpatented mining claim, mill, or tunnel site on federally owned lands, whether located before or on the date of enactment of this Act, each claimant shall pay to the Secretary, on or before August 31 of each year, a claim maintenance fee of $200 per claim to hold such unpatented mining claim, mill or tunnel site for the assessment year beginning at noon on the next day, September 1. Such claim maintenance fee shall be in lieu of the assessment work requirement contained in the Mining Law of 1872 (<external-xref legal-doc="usc" parsable-cite="usc/30/28">30 U.S.C. 28 et seq.</external-xref>) and the related filing requirements contained in section 314 (a) and (c) of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1744 (a) and (c)).</text></subparagraph><subparagraph id="H73B1CA88F1B144DDA95F35E8410255E0"><enum>(B)</enum><header>Fee adjustments</header><text display-inline="yes-display-inline">Any adjustment to the fees under this subsection under section 502 shall begin to apply the calendar year following the calendar year in which such adjustment is made.</text></subparagraph><subparagraph id="H79D8FC57E3C64AB2A85FF43431D62BF0"><enum>(C)</enum><header>Exception for small miners</header><text>Subparagraph (A) and the assessment work requirement contained in the Mining Law of 1872 (<external-xref legal-doc="usc" parsable-cite="usc/30/28">30 U.S.C. 28 et seq.</external-xref>) shall not apply with respect to any claim held by a small miner.</text></subparagraph></paragraph><paragraph id="HF8AC1C32D26D41B1BB31F342AD5FEE94"><enum>(2)</enum><text display-inline="yes-display-inline">Moneys received under this subsection that are not otherwise allocated for the administration of the mining laws by the Department of the Interior shall be deposited in the Hardrock Minerals Reclamation Fund established by section 401.</text></paragraph></subsection><subsection id="H88E30CB3B53B40819A036927BE4B52B2"><enum>(b)</enum><header>Co-Ownership</header><text>The co-ownership provisions of the Mining Law of 1872 (<external-xref legal-doc="usc" parsable-cite="usc/30/28">30 U.S.C. 28 et seq.</external-xref>) shall remain in effect except that the annual claim maintenance fee, where applicable, shall replace applicable assessment requirements and expenditures.</text></subsection><subsection id="H53F8833BEF6E4C7E9B08A79EB9941548"><enum>(c)</enum><header>Failure To pay</header><text display-inline="yes-display-inline">Failure to pay the claim maintenance fee as required by subsection (a) shall conclusively constitute a forfeiture of the unpatented mining claim, mill or tunnel site by the claimant and the claim shall be deemed null and void by operation of law.</text></subsection><subsection id="H9D7FFCF279FC4388BCE1BC6E601E755F"><enum>(d)</enum><header>Other requirements</header><paragraph id="HCA298D00B8564272AF08F5D3EB21B0C1"><enum>(1)</enum><header>Required filings</header><text>Nothing in this section shall change or modify the requirements of section 314(b) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1744">43 U.S.C. 1744(b)</external-xref>), or the requirements of section 314(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1744">43 U.S.C. 1744(c)</external-xref>) related to filings required by section 314(b), which remain in effect.</text></paragraph><paragraph commented="no" id="H60D9A5964ADC47A499290E61FB60E4BE"><enum>(2)</enum><header>Mining Law of 1872</header><text>Section 2324 of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/30/28">30 U.S.C. 28</external-xref>) is amended by inserting <quote>or section 103(a) of the <short-title>Clean Energy Minerals Reform Act of 2022</short-title></quote> after <quote>Act of 1993</quote>.</text></paragraph></subsection></section><section display-inline="no-display-inline" id="HCED31252BE404054A29988159DA3F50C" section-type="subsequent-section"><enum>110.</enum><header>Effect of payments for use and occupancy of claims</header><text display-inline="no-display-inline">Except as otherwise provided in section 101, timely payment of the claim maintenance fee required by section 109 or any related law relating to the use of Federal land, asserts the claimant’s authority to use and occupy the Federal land concerned for prospecting and exploration, consistent with the requirements of this Act and other applicable law.</text></section><section id="HF8FFE40531194BA387C112D482F5DDA9"><enum>111.</enum><header>Protection of special places</header><subsection id="H6C0BEE8B9E574EF9AF31111E9736878F"><enum>(a)</enum><header>Protection of national park system units and national monuments</header><text>No permit shall be issued under this Act that authorizes mineral activities that would impair the land or resources of a unit of the National Park System or a national monument. For purposes of this subsection, the term <term>impair</term> includes any diminution of the affected land including wildlife, scenic assets, water resources, air quality, and acoustic qualities, or other changes that would impair a citizen’s experience at the National Park System unit or a national monument.</text></subsection><subsection id="H28845CCE48434D13A4F31BFB79331301"><enum>(b)</enum><header>Protection of conservation areas</header><text>In order to protect the resources and values of National Conservation System units, the Secretary, as appropriate, shall utilize authority under this Act and other applicable law to the fullest extent necessary to prevent mineral activities that could have an adverse impact on the resources or values for which such units were established.</text></subsection><subsection id="H6765790D30B248F08A7107F36809DEAD"><enum>(c)</enum><header>Lands not open to mining</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law and subject to valid existing rights, no hardrock mining activity shall be allowed in any of the following:</text><paragraph id="HA2241AF83F404B80B52296038CED87C5"><enum>(1)</enum><text>Sacred sites.</text></paragraph><paragraph id="H5A9C37C77B3F4A7FBBF6746F44FADE36"><enum>(2)</enum><text>Wilderness study areas.</text></paragraph><paragraph id="HD887211E6966429B9B8CB45812578611"><enum>(3)</enum><text display-inline="yes-display-inline">Designated critical habitat.</text></paragraph><paragraph id="H14EDDF932CA94667ACB3A61B87D42B43"><enum>(4)</enum><text>Areas of critical environmental concern.</text></paragraph><paragraph id="H35E6CAF095E04C75AB22A94943882ABA"><enum>(5)</enum><text display-inline="yes-display-inline">Units of the National Conservation System.</text></paragraph><paragraph id="HF62BDBABA80C41A183D9E556288E6B49"><enum>(6)</enum><text>Areas designated for inclusion in the National Wild and Scenic Rivers System pursuant to the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271 et seq.</external-xref>), areas designated for potential addition to such system pursuant to section 5(a) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1276">16 U.S.C. 1276(a)</external-xref>), and areas determined to be eligible for inclusion in such system pursuant to section 5(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1276">16 U.S.C. 1276(d)</external-xref>).</text></paragraph><paragraph id="H45C2596F28FB44D8A1483830BE6A5DC8"><enum>(7)</enum><text display-inline="yes-display-inline">Inventoried Roadless Areas under the Roadless Area Conservation Rule, part 294 of title 36, Code of Federal Regulations, Colorado Roadless Areas, or Idaho Roadless Areas.</text></paragraph></subsection></section><section id="H4B8B18D507404E14A8AA8C9EA0C5FB1A"><enum>112.</enum><header>Suitability determination</header><subsection id="H9AD25F5972B345878641AE90BF1664E1"><enum>(a)</enum><header>In general</header><text>The Secretary concerned shall make each determination of whether lands are suitable for mineral activities that is otherwise required by this Act, in accordance with subsection (b).</text></subsection><subsection id="HEEF914FC177245399370A5F64932A6F1"><enum>(b)</enum><header>Suitability</header><paragraph id="HBAEC2BD5FBD74DF99819E4373E8F8D7A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary concerned shall consider lands suitable for mineral activities if the Secretary concerned finds that such activities would not result in undue degradation to a special characteristic described in paragraph (2) that cannot be prevented by the imposition of conditions in the permit required for such activities under title III.</text></paragraph><paragraph id="HBB8FBED8BA9D446B83AB9A8F6E9EF422"><enum>(2)</enum><header>Special characteristics</header><text display-inline="yes-display-inline">For purposes of paragraph (1) the Secretary concerned shall consider each of the following to be a special characteristic:</text><subparagraph id="H9FAF0EF2185F4BAA8A02237A326E093A"><enum>(A)</enum><text>The existence of a significant water resource or supply in or associated with such lands, including any aquifer or aquifer recharge area.</text></subparagraph><subparagraph id="HA33940C0F58F4994ACCB3144BD5239D5"><enum>(B)</enum><text>The presence on such lands, or any adjacent land, of a publicly owned place that is listed on, or determined by the Secretary of the Interior to be eligible for listing on, the National Register of Historic Places.</text></subparagraph><subparagraph id="H9B36F32F4A5C47AFB5BFA7C86D519102"><enum>(C)</enum><text>The designation of all or any portion of such lands, or any adjacent land, as a National Conservation System unit.</text></subparagraph><subparagraph id="H2E5BAF73C565407AA646BF262F387BA7"><enum>(D)</enum><text>The designation of all or any portion of such lands, or any adjacent land, as critical habitat under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></subparagraph><subparagraph id="HA5272832E4D6418B968C1B77889FF088"><enum>(E)</enum><text display-inline="yes-display-inline">The designation of all or any portion of such lands, or any adjacent land, as a class I area under section 162 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7472">42 U.S.C. 7472</external-xref>).</text></subparagraph><subparagraph id="HBB3FA3C5AB88491C87338E60714CCE0B"><enum>(F)</enum><text display-inline="yes-display-inline">The presence of such other resource values as the Secretary concerned may by rule specify, determined based upon field testing, evaluation, or credible information that verifies such values.</text></subparagraph><subparagraph id="H2A2B966CAD1847B699DB0B21270DB3CF"><enum>(G)</enum><text>The designation of such lands, or adjacent land, as a Research Natural Area.</text></subparagraph><subparagraph id="H0C8C5790141140749C27CBA38DAAB309"><enum>(H)</enum><text display-inline="yes-display-inline">The presence on such lands, or any adjacent land, of a sacred site.</text></subparagraph><subparagraph id="H645319620C7B49DABEB6EECDAECB512B"><enum>(I)</enum><text display-inline="yes-display-inline">The presence or designation of such lands adjacent to lands not open to mining pursuant to section 111.</text></subparagraph></paragraph><paragraph id="HF73DD4D87DAE42F29BD67A98FBD78A92"><enum>(3)</enum><text display-inline="yes-display-inline">A determination under this subsection of suitability for mineral activities shall be made after publication of notice and an opportunity for submission of public comment for a period of not less than 60 days.</text></paragraph><paragraph id="H3EF8436045C74632A64EA08FAA041787"><enum>(4)</enum><text>Any determination made in accordance with this subsection with respect to lands shall be incorporated into each Federal land use plan applicable to such lands, at the time such plan is adopted, revised, or significantly amended pursuant to any Federal law other than this Act.</text></paragraph></subsection><subsection id="HCA099211F37A4F89858AF22D4EF740A3"><enum>(c)</enum><header>Change request</header><text display-inline="yes-display-inline">The Secretary concerned shall, by rule, provide for an opportunity for any person to request a change in determination for any Federal land found suitable under subsection (a).</text></subsection><subsection id="H93810CABF90B4DE8989B4A45487B59AC"><enum>(d)</enum><header>Existing operations</header><text>Nothing in this section shall be construed as affecting lands on which mineral activities were being conducted on the date of enactment of this Act under an approved plan of operations or under notice.</text></subsection></section></title><title id="H0D663354FCE44849A2AFEC0822148E7C"><enum>II</enum><header>Consultation Procedure</header><section id="H449D7FE15CA24A298E43824EA4A59569"><enum>201.</enum><header>Requirement for consultation</header><subsection id="H8AFB6E07B0E44329B5164CA370967736"><enum>(a)</enum><header>Scope</header><text display-inline="yes-display-inline">Agencies shall ensure meaningful and timely consultation with Indian Tribes and Tribal officials prior to undertaking any mineral activities that may have substantial direct, indirect, or cumulative impacts on—</text><paragraph id="H141DFD59653F441BAD6BD8DF6E3B1B17"><enum>(1)</enum><text>the lands, including allotted, ceded, or traditional lands, or interests of an Indian Tribe or a member of an Indian Tribe;</text></paragraph><paragraph id="HCFCC3FEF9A8A4CFBBCCF0FD5CD21DA6D"><enum>(2)</enum><text>any part of any Federal land that shares a border with Indian country, as such term is defined in section 1151 of title 18, United States Code;</text></paragraph><paragraph id="HF5D49692C1E54B23B2CE9C7AC1B9CDE3"><enum>(3)</enum><text>the relationship between the Federal Government and an Indian Tribe; or</text></paragraph><paragraph id="H16CCEAAA63AC4362B92F74D5A70926B4"><enum>(4)</enum><text>the distribution of power and responsibilities between the Federal Government and an Indian Tribe. </text></paragraph></subsection><subsection id="HBEE494A22B9B423FB11D3E67B1AA2489"><enum>(b)</enum><header>Multiagency mineral activities</header><text display-inline="yes-display-inline">If more than one agency is involved in a mineral activity, some or all of the agencies may designate a lead agency, which shall be responsible for fulfilling the consultation required under subsection (a). An agency that does not designate a lead agency shall remain individually responsible for the consultation required under subsection (a). All agencies involved in the mineral activity shall remain involved in and engaged with the consultation process regardless of whether or not a lead agency has been designated. </text></subsection><subsection id="HD21D4149F47E4C7987432B47544B9CD8"><enum>(c)</enum><header>Limitation</header><text>Nothing in this Act shall exempt an agency from additional consultation required under any other law or from taking any other consultative actions as required by any other law or agency prerogative in addition to those required by this Act. Nor does it preclude an agency from additional consultation that complies with agency regulations for consultation, advances agency consultation practices, or supports agency efforts to build or strengthen government-to-government relationships with an Indian Tribe.</text></subsection><subsection id="H10B6E6DA90604F0799E2CE6C5DCD9009"><enum>(d)</enum><header>Temporary waiver</header><paragraph id="HB0542E870DC44EF389DF6F2448CDF9E1"><enum>(1)</enum><header>In general</header><text>The agency may temporarily waive the requirements of this title in all or any portion of any emergency area during all or any portion of an emergency period.</text></paragraph><paragraph id="H1F9A0AE8A4B54AA184E2FE0F28ACFACC"><enum>(2)</enum><header>Duration of waiver</header><text display-inline="yes-display-inline">A temporary waiver under this subsection shall end upon the termination of the applicable emergency period.</text></paragraph><paragraph id="HF5F9F778C5554B298DA4DE8AF13260BD"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purposes of this subsection—</text><subparagraph id="H965BAE5DD09849D6B51C84E70FF166EF"><enum>(A)</enum><text>the term <term>emergency area</term> means a geographical area in which there exists an emergency or disaster declared by the President pursuant to the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>) or the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>); and</text></subparagraph><subparagraph id="H4FD8613FAFF34DEC8E628114EACDE841"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>emergency period</term> means the period during which there exists an emergency or disaster declared by the President pursuant to the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>) or the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>).</text></subparagraph></paragraph></subsection></section><section id="HCECD16256D33431DAA9399631F8F3090"><enum>202.</enum><header>Timing</header><text display-inline="no-display-inline">Consultation under sections 203 and 204 shall be completed before any Federal funds are expended for the mineral activity and before the issuance of any license. </text></section><section id="HC662ED1570B84007BE5F619F403DF66B"><enum>203.</enum><header>Scoping stage consultation</header><subsection id="HA91FAC29CC2843FDA932F9ECC1D99677"><enum>(a)</enum><header>Planning document</header><text display-inline="yes-display-inline">As early as possible in the planning stage of a mineral activity, the agency shall compile a draft of the scope of the project. The agency shall make a reasonable and good faith effort, consistent with section 800.4(b)(1) of title 36, Code of Federal Regulations, as such regulation was in effect on July 6, 2004, to identify areas that contain sites important to Indian Tribes whether or not such sites are explicitly known to the agency. The agency shall make a reasonable and good faith effort to identify any geographic areas important to Indian Tribes that might be affected and any other anticipated impacts to Tribal interests.</text></subsection><subsection id="H80AD1A8406134725801A7501F3A259A0"><enum>(b)</enum><header>Initial consultation contact</header><text>The agency—</text><paragraph id="H143BE0191E9641C9992FFD0E8E35D282"><enum>(1)</enum><text display-inline="yes-display-inline">shall send, via United States mail and, if possible, email, a copy of the planning document and a letter requesting consultation meetings to the relevant Tribal Government officials, including the Tribal leader and all members of any elected Tribal governing body, relevant Tribal governmental agencies (including the Tribal Historic Preservation Officer or cultural resource manager), owners of individual allotments, other stakeholders identified by the Tribe, and relevant non-Tribal stakeholders (including the State Historic Preservation Officer and local governments that have jurisdiction on any affected land via agreement with the agency); and</text></paragraph><paragraph id="HC1C0AE626FED41FEBA900122DC09D379"><enum>(2)</enum><text>shall follow up with phone calls to confirm receipt of the documents by all intended recipients.</text></paragraph></subsection><subsection id="H572DBBBCFC1649009859829825A1E5BD"><enum>(c)</enum><header>Consultation meeting arrangements</header><text display-inline="yes-display-inline">The agency shall negotiate with the affected Indian Tribes to determine the time, place, agenda, travel funds, facilitator, format, and goals of a consultation meeting. The agency shall keep thorough documentation of all steps taken to contact and engage the affected Indian Tribes in consultation. If, after a good faith effort, the agency fails to engage the affected Indian Tribes, it may terminate its scoping stage consultation efforts by providing all consultation partners with a written notification and explanation for its decision to end scoping stage consultation efforts, signed by the head of the agency, and proceed to the decision stage procedures described in section 204. A good faith effort to consult must involve consistent and sustained efforts to contact and engage with the appropriate-level officials via the available channels of communication (United States mail, e-mail, and telephone).</text></subsection><subsection id="HCD5EA70B9702469FBCE59DA01DCA1A0C"><enum>(d)</enum><header>Scoping stage consultation meeting</header><text display-inline="yes-display-inline">A scoping stage consultation meeting shall begin with confirmation of the format, facilitator, and agenda, with adequate time scheduled for introductions and for interaction throughout the meeting among participants. Whenever possible, Tribal stakeholders (such as allottees or interested Tribal members) shall be brought into the on-going planning process directly by forming ad hoc workgroups (including Tribal leaders or their designees) and, if appropriate, initiating a process for consensual development of regulations, such as negotiated rulemaking. A scoping stage consultation meeting shall conclude with planning for the next meeting, if necessary.</text></subsection><subsection id="HA7F5F407FAED47A1A0E02317598C01BB"><enum>(e)</enum><header>Termination of scoping stage consultation with a memorandum of agreement</header><paragraph id="H2AD475772F6D4B9983966C6CDF6EF560"><enum>(1)</enum><header>Termination</header><text display-inline="yes-display-inline">Except as provided by subsection (c), scoping stage consultation shall terminate upon the execution of a memorandum of agreement signed by the head of the agency and the affected Indian Tribes.</text></paragraph><paragraph id="H5470ADF431AA4E4AAD21912D9B556037"><enum>(2)</enum><header>Signatories</header><text>The affected Indian Tribes and the agency may jointly invite additional parties to be signatories of the memorandum of agreement. The signatories have sole authority to execute, amend, or terminate the memorandum of agreement. If any signatory determines that the terms of the memorandum of agreement cannot be carried out, the signatories shall consult to seek amendment of the memorandum of agreement. If the memorandum of agreement is not amended, any signatory may terminate the agreement, and the process will return to scoping stage consultation. The agency shall provide all nonsignatory consulting partners with the opportunity to submit a written statement, explanation, or comment on the consultation proceedings that shall become part of the agency’s official consultation record.</text></paragraph><paragraph id="H3907A42DE0994F2AB3C0DD6215293CBE"><enum>(3)</enum><header>Memorandum of agreement</header><text>The memorandum of agreement—</text><subparagraph id="HD97916D3AC464612A657A770D4857005"><enum>(A)</enum><text display-inline="yes-display-inline">may address multiple activities if—</text><clause id="HBECFB04B4CAB4A51AFF62F16012380FC"><enum>(i)</enum><text>the activities are similar and repetitive or are multistate or regional in scope, or where routine management activities are undertaken at Federal installations, facilities, or other land management units; and</text></clause><clause id="H9281CBF5E9F54F3DBF4B89B51793BBD0"><enum>(ii)</enum><text>the scope of the activities is clearly delineated;</text></clause></subparagraph><subparagraph id="HDAED0DDF5D134AD5B88879D6EA7EF6B6"><enum>(B)</enum><text>may establish standard processes for certain categories of activities determined through consultation and defined in the memorandum of agreement;</text></subparagraph><subparagraph id="H8A3D57D3431C4E4F9A2274EF4B0114D0"><enum>(C)</enum><text>shall include a provision for monitoring and reporting on its implementation;</text></subparagraph><subparagraph id="HB7B11B26B9B4443ABCBBB8B14BECE05D"><enum>(D)</enum><text>shall include provisions for termination or reconsideration if the activity has not been completed within a specified time; </text></subparagraph><subparagraph id="H88D84284B2714DD994F4EE69CD314790"><enum>(E)</enum><text>shall include provisions to address new discoveries, which may include halting the activity and returning to scoping stage consultation;</text></subparagraph><subparagraph id="H75CB68760A004A22B58E4C9011064064"><enum>(F)</enum><text display-inline="yes-display-inline">shall include provisions to address changes or modifications to the scope or nature of the activity, impacts or conditions of the project or site;</text></subparagraph><subparagraph id="H64CE78B19D56413C9AD03BD54959CCB2"><enum>(G)</enum><text>may incorporate relevant Tribal laws, standards, regulations, or policies;</text></subparagraph><subparagraph id="H10BBA16E8A7C49779E8674CD941A24D3"><enum>(H)</enum><text>may include provisions for the protection of culturally sensitive information; and</text></subparagraph><subparagraph id="HF836BD6D733D458F955126554CC4FECD"><enum>(I)</enum><text>shall include provisions to address and resolve disputes.</text></subparagraph></paragraph></subsection><subsection id="H06A63369DEE9435296CA194098BC0FF9"><enum>(f)</enum><header>Termination of scoping stage consultation without a memorandum of agreement</header><text display-inline="yes-display-inline">The agency shall make a good faith effort through sustained interaction and collaboration to reach a consensus resulting in a memorandum of agreement. If, after a good faith effort and a reasonable amount of time given the nature and complexities of the proposed activity and potential impacts, the agency determines that further consultation will not be productive, it may terminate consultation by providing all consultation partners with a written notification and explanation for its decision, signed by the head of the agency, and proceed to the decision stage procedures described in section 204. Any decision by an agency to terminate consultation must be supported by an adequate documentation and evidence of its good faith efforts and the basis for its decision. The affected Indian Tribes may at any point decide to terminate consultation. In case of termination by either party, the agency shall provide the affected Indian Tribes or other affected parties with the opportunity to submit a written statement, explanation, or comment on the consultation proceedings that will become part of the agency’s official consultation record.</text></subsection></section><section id="H3996E03C83A34CB7A245FBCFD5D0923E"><enum>204.</enum><header>Decision stage procedures</header><subsection id="HD1FC71AB1E7147B6B2024390BD6C43D8"><enum>(a)</enum><header>Proposal document</header><text display-inline="yes-display-inline">The agency shall compile a document consisting of the plan for the activity, its anticipated impacts to Tribal interests, any memorandum of agreement, and any written statements made by consulting partners during the scoping stage as described in section 203. The agency shall include sufficient supporting documentation to the extent permitted by law and within available funds to enable any reviewing parties to understand its basis. The agency may use documentation prepared to comply with other laws to fulfill the requirements of this provision to the extent that such documentation is sufficiently pertinent to and focused on the relevant issues as to allow reasonable ease of review. The agency shall mail and, if possible, email a copy of the Proposal Document to all affected Indian Tribes and stakeholders, including those that withdrew from the process. At a minimum, the document shall go to the Tribal leader, all members of any elected Tribal governing body, and stakeholders. The agency shall follow up to confirm receipt of the document. After these steps have been completed, the Proposal Document shall be published in the Federal Register, subject to the provisions of section 207.</text></subsection><subsection id="H794906873C7E4771B67E5CFF551CF3D2"><enum>(b)</enum><header>Public comment period</header><text>The agency shall provide a period of not less than 90 days after publication in the Federal Register for comments on the Proposal Document. A reasonable extension shall be granted upon request of not less than 30 days by any member of any of the affected Indian Tribal governing bodies or a stakeholder.</text></subsection><subsection id="H31799FEAF38B4584931F428F5DB0BF10"><enum>(c)</enum><header>Preliminary decision</header><text>After expiration of the comment period, the agency shall prepare a preliminary decision letter, signed by the head of the agency. The letter shall state the decision to proceed or not proceed with the mineral activity, the decision’s rationale, any changes in the proposal made in response to comments, and any points where the decision conflicts with the expressed requests of any of the affected Indian Tribes or stakeholders. It shall particularly address why the decision was made to disregard any such requests. The agency shall mail and, if possible, email a copy of the letter to all affected Indian Tribes and stakeholders, including those that withdrew from the process. At a minimum, the letter shall go to the Tribal leader, all members of the Tribal governing body, and stakeholders. The agency shall follow up to confirm receipt of the letter.</text></subsection><subsection id="HCDC56E54FBB94B3A8042C470EA607E7D"><enum>(d)</enum><header>Final decision</header><text>The agency shall provide a 60-day period following the issuance of the preliminary decision letter for response by the affected Indian Tribes and stakeholders. Thereafter, the agency shall notify in writing, signed by the head of the agency, the affected Indian Tribes and stakeholders, including those that withdrew from the process, of the agency’s final decision.</text></subsection></section><section id="H5FBC6D61A17B4EB2B1B5DFDCA554D700"><enum>205.</enum><header>Documentation and reporting</header><subsection id="HDF587492E27649F2BCAB41039B0BC891"><enum>(a)</enum><header>Official consultation record</header><text>The agency shall keep an official consultation record that allows accurate tracking of the process so that agencies and consulting parties can correct any errors or omissions, and provides an official record of the process that can be referred to in any litigation that may arise. The agency shall document all efforts to initiate consultation as well as documenting the process once it has begun. Such documentation, including correspondence, telephone logs, and emails, shall be included in the agency’s official consultation record. The agency shall also keep notes so that the consultation record documents the content of consultation meetings, site visits, and phone calls in addition to information about dates and who participated.</text></subsection><subsection id="H3AABCD18A6EE49E1A08FE8FA53EB766C"><enum>(b)</enum><header>Payment for Tribal documentation work</header><text display-inline="yes-display-inline">If the agency asks an Indian Tribe for specific information or documentation regarding the location, nature, and condition of individual sites, to conduct a survey, or in any way fulfill the duties of the agency in a role similar to that of a consultant or contractor, then the agency must pay for such services, if so requested by the Indian Tribe, as it would for any private consultant or contractor. An Indian Tribe may select a contractor to perform such work on its behalf, to be paid for by the agency. </text></subsection><subsection id="H46FCCB8658C04871B7FF0F5F6D556BBB"><enum>(c)</enum><header>Report to Congress</header><text>Each agency shall on a biennial basis submit to Congress a report on its consultation activities.</text></subsection></section><section id="HE22FF515461B4C459FB2CE8724472507"><enum>206.</enum><header>Implementation</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the head of each agency shall designate an official with principal responsibility for the agency’s review of existing consultation and coordination policies and procedures, and implementation of this Act. Not later than 60 days after the effective date of this order, the designated official shall submit to the Office of Management and Budget a description of the agency’s revised consultation process in conformity with this Act.</text></section><section id="H5D7A5FAB76974896B651EEA37BD5F493"><enum>207.</enum><header>Sensitive Tribal information</header><subsection id="H11F2CF11F339489980413C424AFD32C2"><enum>(a)</enum><header>Closed meetings</header><text display-inline="yes-display-inline">Notwithstanding any provision of the Administrative Procedures Act, consultation meetings shall be closed to the public at the request of the Indian Tribal Government.</text></subsection><subsection id="H024480D5F128417C9D6CB7B5CCF60EC0"><enum>(b)</enum><header>Sensitive information</header><text>Notwithstanding any provision of section 552 of title 5, United States Code (commonly known as the Freedom of Information Act), the Administrative Procedures Act, or any other applicable laws or regulations, all information designated by the Indian Tribe as sensitive, such as the location of sacred sites or other details of cultural or religious practices, shall be deleted from any public publication made as part of the consultation process or in the process of carrying out the activity.</text></subsection><subsection id="HB98430B6EB9D461A81C03A230FBA8A3B"><enum>(c)</enum><header>Limited information access</header><text>The agency, in consultation with the Indian Tribe or such Tribe’s designee, shall determine who may have access to the information for the purposes of carrying out the mineral activity.</text></subsection><subsection id="H5048C6D362404EC2BD2F9820FA989281"><enum>(d)</enum><header>Individual allotments</header><text>Instances where sacred sites are located on individual allotments or public domain allotments shall be addressed on a case-by-case basis and shall involve the allottees.</text></subsection><subsection id="HBADF2F7E8B1E421881B87C9278E94A2E"><enum>(e)</enum><header>Sacred sites</header><text>The location and uses of a sacred site shall be protected in accordance with this provision and section 111. </text></subsection></section></title><title id="HF77D242C5AD14FFCAF117F6F3BFA7056"><enum>III</enum><header>Environmental Considerations of Mineral Exploration and Development</header><section id="HD57C40126921437F8CD063AD2CBBD8BA"><enum>301.</enum><header>General standard for hardrock mining on Federal land</header><text display-inline="no-display-inline">Notwithstanding section 302(b) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1732">43 U.S.C. 1732(b)</external-xref>), the first section of the Act of June 4, 1897 (chapter 2; 30 Stat. 36; <external-xref legal-doc="usc" parsable-cite="usc/16/478">16 U.S.C. 478</external-xref>), and the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>), and in accordance with this title and applicable law, unless expressly stated otherwise in this Act, the Secretary shall ensure that mineral activities on any Federal land that is subject to a mining claim, millsite claim, tunnel site claim, or any authorization issued under title I of this Act are carefully controlled to prevent undue degradation of public lands and resources.</text></section><section id="H8CDD616365294F349630325808E7E8BC"><enum>302.</enum><header>Permits</header><subsection id="HCCE32AC522FC4A05827A2FA9A6597EFF"><enum>(a)</enum><header>Permits required</header><text display-inline="yes-display-inline">No person may engage in mineral activities on Federal land that may cause a disturbance of surface resources, including land, air, ground water and surface water, and fish and wildlife, unless a permit was issued to such person under this title authorizing such activities.</text></subsection><subsection id="H802690C2F9F249FC8E5535513930DC9F"><enum>(b)</enum><header>Negligible disturbance</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), a permit under this title shall not be required for mineral activities that are a casual use of the Federal land.</text></subsection><subsection id="H81E7AD8289334D0D9F0B46D440BE5713"><enum>(c)</enum><header>Coordination with National Environmental Policy Act process</header><text display-inline="yes-display-inline">The Secretary and the Secretary of Agriculture shall conduct the permit processes under this Act in accordance with the timing and other requirements under section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>). To the extent practicable, the Secretary and Secretary of Agriculture shall coordinate the permit process.</text></subsection></section><section id="HACFDCEC172FE4179BCF02A1249305BE5"><enum>303.</enum><header>Exploration permit</header><subsection id="H99A7650BC06A499FAE5EFD8832C6A17E"><enum>(a)</enum><header>Authorized exploration activity</header><text display-inline="yes-display-inline">Any applicant may apply for an exploration permit for any mining claim, license, or lease authorizing the applicant to remove a reasonable amount of the hardrock minerals, as defined in the license or lease or established in such regulations as the Secretary shall promulgate, from the area that is subject to the claim, license, or lease, respectively, for analysis, study, and testing. Such permit shall not authorize the applicant to remove any mineral for sale nor to conduct any activities other than those required for exploration for hardrock minerals and reclamation.</text></subsection><subsection id="HC5AC8EDA75B54C37A3C02455957AA0BC"><enum>(b)</enum><header>Permit application requirements</header><text>An application for an exploration permit under this section shall be submitted in a manner satisfactory to the Secretary concerned, and shall contain an exploration plan, a reclamation plan for the proposed exploration, and such documentation as necessary to ensure compliance with applicable Federal and State environmental laws and regulations.</text></subsection><subsection id="HD2EA6144028C492090682BF247EA92AE"><enum>(c)</enum><header>Reclamation plan requirements</header><text display-inline="yes-display-inline">The reclamation plan required to be included in a permit application under subsection (b) shall include such provisions as may be jointly prescribed by the Secretary and the Secretary of Agriculture by regulations. Such regulations shall, at a minimum, require the following:</text><paragraph id="H6BE11FF9BBB54FCF97836C9DF882ABE4"><enum>(1)</enum><text>The applicant has demonstrated that proposed reclamation can be accomplished.</text></paragraph><paragraph id="HAC8A076FBE5945339D819801A667F2A5"><enum>(2)</enum><text>The proposed exploration activities and condition of the land after the completion of exploration activities and final reclamation will conform with the land use plan applicable to the area subject to mineral activities.</text></paragraph><paragraph id="H58D2FEBEE3744BFF8CC6DE94EB86D329"><enum>(3)</enum><text display-inline="yes-display-inline">The area subject to the proposed permit is not included within an area listed in section 111.</text></paragraph><paragraph id="H69BCB4A1829141F4BFB27D73D97FC39B"><enum>(4)</enum><text>The applicant has demonstrated that the exploration plan and reclamation plan will be in compliance with the requirements of this Act and all other applicable Federal requirements, and any State requirements agreed to by the Secretary concerned.</text></paragraph><paragraph id="H0AC7FCE63C614A0AB4AEFB4700812ADE"><enum>(5)</enum><text display-inline="yes-display-inline">The applicant has demonstrated that the requirements of section 306 will be met.</text></paragraph><paragraph id="HC17D9D07986C464F9913D498264F27ED"><enum>(6)</enum><text display-inline="yes-display-inline">The applicant is eligible to receive a permit under section 305.</text></paragraph></subsection><subsection id="H458232FD01174B6B872B228BC0709B47"><enum>(d)</enum><header>Term of permit</header><text>An exploration permit shall be for a stated term. The term shall be no greater than that necessary to accomplish the proposed exploration, and in no case for more than 10 years.</text></subsection><subsection id="H0A8C81F2A84C4847ACB825E0ECEC631F"><enum>(e)</enum><header>Permit modification</header><text>During the term of an exploration permit the permit holder may submit an application to modify the permit. To approve a proposed modification to the permit, the Secretary concerned shall make the same determinations as are required in the case of an original permit, except that the Secretary and the Secretary of Agriculture may specify by joint rule the extent to which requirements for initial exploration permits under this section shall apply to applications to modify an exploration permit based on whether such modifications are deemed significant or minor.</text></subsection><subsection id="HA9B3C4F6D5E84DF689ECCAC3EF2824A5"><enum>(f)</enum><header>Transfer, assignment, or sale of rights</header><paragraph id="HE0D3F2730B5A4A94B24FCD169818CD7E"><enum>(1)</enum><header>Prior written approval</header><text display-inline="yes-display-inline">No transfer, assignment, or sale of rights granted by a permit issued under this section shall be made without the prior written approval of the Secretary concerned.</text></paragraph><paragraph id="H15B87D836EB54CB1865F8D0B1E2D8354"><enum>(2)</enum><header>Approval</header><text>Such Secretary shall allow a person holding a permit to transfer, assign, or sell rights under the permit to a successor, if the Secretary finds in writing that the successor—</text><subparagraph id="H1D29B6FD38FB4006BE02F7E4F9F26AA6"><enum>(A)</enum><text display-inline="yes-display-inline">is eligible to receive a permit under section 304;</text></subparagraph><subparagraph id="HAF70E03904654BC3AAC31C384BDEE07B"><enum>(B)</enum><text display-inline="yes-display-inline">has submitted evidence of financial assurance satisfactory under section 306; and</text></subparagraph><subparagraph id="HF438E89E30BC4833BA40D8B90DE0F4F8"><enum>(C)</enum><text>meets any other requirements specified by the Secretary.</text></subparagraph></paragraph><paragraph id="HDB9BB7338D7540BBBB74F9CFA0C1FA37"><enum>(3)</enum><header>Assumed liability</header><text>The successor in interest shall assume the liability and reclamation responsibilities established by the existing permit and shall conduct the mineral activities in full compliance with this Act, and the terms and conditions of the permit as in effect at the time of transfer, assignment, or sale.</text></paragraph><paragraph id="H105625D843B84758B10CC7C1601A2697"><enum>(4)</enum><header>Fee</header><text>Each application for approval of a permit transfer, assignment, or sale pursuant to this subsection shall be accompanied by a fee payable to the Secretary of the Interior in such amount as may be established by such Secretary. Such amount shall be equal to the actual or anticipated cost to the Secretary or the Secretary of Agriculture, as appropriate, of reviewing and approving or disapproving such transfer, assignment, or sale, as determined by the Secretary of the Interior.</text></paragraph></subsection></section><section id="HB3D59BD97AB94F299C6BFE692CE36478"><enum>304.</enum><header>Operations permit</header><subsection id="H1B53A124F2FE42B59AE2FB3C02ED9CFD"><enum>(a)</enum><header>Operations permit</header><paragraph commented="no" display-inline="yes-display-inline" id="H0224411C41A04CCDB93D9F63DEAF893E"><enum>(1)</enum><text>Any applicant that is in compliance with all provisions of this Act may apply to the Secretary concerned for an operations permit authorizing the applicant to carry out mineral activities, other than casual use, on—</text><subparagraph id="H1ADD7DE40F644BE8B747675A9EF061E6" indent="up1"><enum>(A)</enum><text>any valid mining claim, valid millsite claim, valid tunnel site claim, or lease issued under this Act; and</text></subparagraph><subparagraph id="H772F4C02B62D4C5EB7B4B650EE98F960" indent="up1"><enum>(B)</enum><text>such additional Federal land as the Secretary may determine is necessary to conduct the proposed mineral activities, if the operator obtains a right-of-way permit for use of such additional lands under title V of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1761">43 U.S.C. 1761 et seq.</external-xref>) and agrees to pay all fees required under that title for the permit under that title.</text></subparagraph></paragraph><paragraph id="HE40D0A80F6D742969DF3E23C87E17774" indent="up1"><enum>(2)</enum><text>If the Secretary decides to issue such permit, the permit shall include such terms and conditions as prescribed by such Secretary to carry out this title.</text></paragraph></subsection><subsection id="HF6CC985B2A6D407F9E9605A3DD9346C0"><enum>(b)</enum><header>Permit application requirements</header><text>An application for an operations permit under this section shall be submitted in a manner satisfactory to the Secretary concerned and shall contain site characterization data, an operations plan, a reclamation plan, monitoring plans, long-term maintenance plans, to the extent necessary, and such documentation as necessary to ensure compliance with applicable Federal and State environmental laws and regulations. If the proposed mineral activities will be carried out in conjunction with mineral activities on adjacent non-Federal lands, information on the location and nature of such operations may be required by the Secretary.</text></subsection><subsection id="H32F66E3E1DD54CFCBB868293817FB135"><enum>(c)</enum><header>Permit issuance or denial</header><paragraph commented="no" display-inline="yes-display-inline" id="H81A6773707AB43D9ADDE0765E99FC264"><enum>(1)</enum><text display-inline="yes-display-inline">After providing for public participation pursuant to subsection (i), the Secretary concerned shall issue an operations permit if such Secretary makes each of the following determinations in writing, and shall deny a permit if such Secretary finds that the application and applicant do not fully meet the following requirements:</text><subparagraph id="HD3810BE13EAD456985CF5C822D8D1B00" indent="up1"><enum>(A)</enum><text>The permit application, including the site characterization data, operations plan, and reclamation plan, are complete and accurate and sufficient for developing a good understanding of the anticipated impacts of the mineral activities and the effectiveness of proposed mitigation and control.</text></subparagraph><subparagraph id="H93C8B3970AE140C0AB9563F75B52C57F" indent="up1"><enum>(B)</enum><text>The applicant has demonstrated that the proposed reclamation in the operation and reclamation plan can be and is likely to be accomplished by the applicant and will not cause undue degradation.</text></subparagraph><subparagraph id="H008D1719F0B04DAD9EF345D831D0DE5D" indent="up1"><enum>(C)</enum><text>The condition of the land, including the fish and wildlife resources and habitat contained thereon, will be restored after the completion of mineral activities.</text></subparagraph><subparagraph id="HACACE03456DF4B7D9CA360E607076B81" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">The area subject to the proposed plan is not listed in section 111 or otherwise ineligible for mineral activities.</text></subparagraph><subparagraph commented="no" id="H5CE6752EE23E40D88EB18AC6C6F02090" indent="up1"><enum>(E)</enum><text>The proposed operation has been designed to prevent material damage to the hydrologic balance outside the permit area.</text></subparagraph><subparagraph id="H3F93F7680A9E4D1A9566FEA081C862B5" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">The applicant will fully comply with the requirements of section 306 prior to the initiation of operations.</text></subparagraph><subparagraph id="HA477BC0729AE47D5810F9D34147CC1CB" indent="up1"><enum>(G)</enum><text>Neither the applicant nor operator, nor any subsidiary, affiliate, or person controlled by or under common control with the applicant or operator, is ineligible to receive a permit under section 305.</text></subparagraph><subparagraph id="H0B14108AD3D94E96A15EC7C1765FE632" indent="up1"><enum>(H)</enum><text>The reclamation plan demonstrates that 10 years following mine closure, no treatment of surface or ground water for carcinogens or toxins will be required to meet water quality standards at the point of discharge.</text></subparagraph></paragraph><paragraph id="H349D854954AF4A7D88B3EE049D13E045" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to any activities specified in the reclamation plan referred to in subsection (b) that constitute a removal or remedial action under section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>), the Secretary shall consult with the Administrator of the Environmental Protection Agency prior to the issuance of an operations permit. The Administrator of the Environmental Protection Agency shall ensure that the reclamation plan does not require activities that would increase the costs or likelihood of removal or remedial actions under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>) or corrective actions under the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>).</text></paragraph></subsection><subsection id="H8F644FC2FAC047A5B761AC480BF073BE"><enum>(d)</enum><header>Term of permit; renewal</header><paragraph id="HDE1E9D61043A49B880F290507BB3FB2B"><enum>(1)</enum><header>In general</header><text>An operations permit—</text><subparagraph id="H6742C389F2AB4C669D64E3D7132F933C"><enum>(A)</enum><text>shall be for an initial term not longer than the shorter of—</text><clause id="HA00493F233E2486D82A9773181CEA7B8"><enum>(i)</enum><text>the period necessary to accomplish the proposed mineral activities subject to the permit; and</text></clause><clause id="HEB0C295D773841A6A898EBD6900533D6"><enum>(ii)</enum><text display-inline="yes-display-inline">the length of time remaining on the applicant's hardrock mining lease; </text></clause></subparagraph><subparagraph id="H31B091E76C554F699305019E856F9B23"><enum>(B)</enum><text>shall be renewed for an additional 10-year period if the operation is in compliance with the requirements of this Act and other applicable law; and</text></subparagraph><subparagraph id="HEA19234FC7BD439AA27618B7A1E5E4EE"><enum>(C)</enum><text display-inline="yes-display-inline">shall expire 5 years following the commencement of a temporary cessation unless, prior to the expiration of the 5 years, the mine operator has filed with the Secretary a request for approval to resume operations. </text></subparagraph></paragraph><paragraph id="H9595B1284AF9410B97F83D6D8D462DB7"><enum>(2)</enum><header>Failure to commence mineral activities</header><text display-inline="yes-display-inline">Failure by the operator to commence mineral activities within 2 years of the date scheduled in an operations permit shall require a modification of the permit if the Secretary concerned determines that modifications are necessary to comply with section 111.</text></paragraph></subsection><subsection id="H07710AD443EC4481BE1E38CF1BF742DE"><enum>(e)</enum><header>Permit modification</header><paragraph id="H840F67CA3A714926B45A0BA0316BEEC1"><enum>(1)</enum><header>Application</header><text>During the term of an operations permit the operator may submit an application to modify the permit (including the operations plan or reclamation plan).</text></paragraph><paragraph id="H3D1A011DEEA64771A2E20230716C1DEF"><enum>(2)</enum><header>Modification by the Secretary concerned</header><text>The Secretary concerned may, at any time, require reasonable modification to any operations plan or reclamation plan upon a determination that the requirements of this Act cannot be met if the plan is followed as approved. Such determination shall be based on a written finding and subject to public notice and hearing requirements established by the Secretary concerned.</text></paragraph><paragraph id="H11BBA9CD80C146E0BFCB61A26C2D56C0"><enum>(3)</enum><header>Unanticipated events or conditions</header><text>A permit modification is required before changes are made to the approved plan of operations, or if unanticipated events or conditions exist on the mine site, including in the case of—</text><subparagraph id="H41C6FF72E7714842AA7D746B042378C1"><enum>(A)</enum><text>development of acid or toxic drainage;</text></subparagraph><subparagraph id="H5341EF9CF99E44DB94AF5E46A695BB49"><enum>(B)</enum><text>loss of springs or water supplies;</text></subparagraph><subparagraph id="H8AB74605C49748CB87246C2E76E4B042"><enum>(C)</enum><text>water quantity, water quality, or other resulting water impacts that are significantly different than those predicted in the application;</text></subparagraph><subparagraph id="HB26038905094434FBDBE3B001A8BC92A"><enum>(D)</enum><text>the need for long-term water treatment;</text></subparagraph><subparagraph id="H5514AE70137D4EC19E8CD0497AF7187B"><enum>(E)</enum><text>significant reclamation difficulties or reclamation failure;</text></subparagraph><subparagraph id="HBE046307B5244C35A511439554E53C1D"><enum>(F)</enum><text>the discovery of significant scientific or biological resources that were not addressed in the original plan;</text></subparagraph><subparagraph id="H92A360F9B66A4AEC84A230340420032F"><enum>(G)</enum><text display-inline="yes-display-inline">the discovery of a properties eligible for listing on the National Register of Historic Places; or</text></subparagraph><subparagraph id="H5F526D308D324C58BE970178CB755F43"><enum>(H)</enum><text>the discovery of hazards to public safety.</text></subparagraph></paragraph></subsection><subsection id="H2778DDBB70A84B9689618E42960FE9A3"><enum>(f)</enum><header>Temporary cessation of operations</header><paragraph id="HC97736DC92F64F0AA8C1F098A53BB505"><enum>(1)</enum><header>Secretarial approval required</header><text>An operator conducting mineral activities under an operations permit in effect under this title may not temporarily cease mineral activities for a period greater than 180 days unless the Secretary concerned has approved such temporary cessation or unless the temporary cessation is permitted under the original permit.</text></paragraph><paragraph id="H23979D750FC2483FA0C947C2B19CC3BE"><enum>(2)</enum><header>Previously issued operations permits</header><text>Any operator temporarily ceasing mineral activities for a period greater than 90 days under an operations permit issued before the date of enactment of this Act shall submit, before the expiration of such 90-day period, a complete application for temporary cessation of operations to the Secretary concerned for approval unless the temporary cessation is permitted under the original permit.</text></paragraph><paragraph id="H66ACDFDE47884558A814A3929F6DA924"><enum>(3)</enum><header>Required information</header><text display-inline="yes-display-inline">An application for approval of temporary cessation of operations shall include such information required under subsection (b) and any other provisions prescribed by the Secretary concerned to minimize impacts on human health, the environment, or properties eligible for listing on the National Register of Historic Places. After receipt of a complete application for temporary cessation of operations such Secretary shall conduct an inspection of the area for which temporary cessation of operations has been requested.</text></paragraph><paragraph id="H12E44E0232AC47F385CE37EBABDBAB8A"><enum>(4)</enum><header>Conditions for approval</header><text>To approve an application for temporary cessation of operations, the Secretary concerned shall make each of the following determinations:</text><subparagraph id="H6B84FE9F080E4C0DA753BDA8463C7820"><enum>(A)</enum><text display-inline="yes-display-inline">A determination that the methods for securing surface facilities and restricting access to the permit area, or relevant portions thereof, will effectively protect against hazards to the health and safety of the public and fish and wildlife or damage to properties eligible for listing on the National Register of Historic Places.</text></subparagraph><subparagraph id="H334C3F8578494683B625C4C0D33BFA80"><enum>(B)</enum><text>A determination that reclamation is in compliance with the approved reclamation plan, except in those areas specifically designated in the application for temporary cessation of operations for which a delay in meeting such standards is necessary to facilitate the resumption of operations.</text></subparagraph><subparagraph id="HF3E5DBE598344B1CA63A6C0C087C8C4B"><enum>(C)</enum><text>A determination that the amount of financial assurance filed with the permit application is sufficient to assure completion of the reclamation activities identified in the approved reclamation plan in the event of forfeiture.</text></subparagraph><subparagraph id="H1F5A5EC5DC5D4E88A8C7D632F74EE5B3"><enum>(D)</enum><text>A determination that any outstanding notices of violation and cessation orders incurred in connection with the plan for which temporary cessation is being requested are either stayed pursuant to an administrative or judicial appeal proceeding or are in the process of being abated to the satisfaction of the Secretary concerned.</text></subparagraph></paragraph></subsection><subsection id="H748549F5CC974CF2B83BD19F24429BE3"><enum>(g)</enum><header>Permit reviews</header><text display-inline="yes-display-inline">The Secretary concerned shall review each permit issued under this section every 10 years during the term of such permit, and before approving the resumption of operations under subsection (f), such Secretary shall require the operator to take such actions as the Secretary deems necessary to assure that mineral activities conform to the permit, including adjustment of financial assurance requirements.</text></subsection><subsection id="H1C6F4D4193B24EBC975CE058A878F55A"><enum>(h)</enum><header>Transfer, assignment, or sale of rights</header><paragraph id="H4E2DAA3716A94E178A83F5B25F7F24EF"><enum>(1)</enum><header>Written approval</header><text display-inline="yes-display-inline">No transfer, assignment, or sale of rights granted by a permit under this section shall be made without the prior written approval of the Secretary concerned.</text></paragraph><paragraph id="HDE5CCA048F614CDE96230CA9411BBC10"><enum>(2)</enum><header>Conditions of approval</header><text>The Secretary concerned may allow a person holding a permit to transfer, assign, or sell rights under the permit to a successor, if such Secretary finds, in writing, that the successor—</text><subparagraph id="HE1B34E4F7C5E4E89843C3BD31C109FFB"><enum>(A)</enum><text display-inline="yes-display-inline">has submitted all required information and is eligible to receive a permit in accordance with section 305;</text></subparagraph><subparagraph id="H3B98C419B32E4359AA55549536607A05"><enum>(B)</enum><text display-inline="yes-display-inline">has submitted evidence of financial assurance satisfactory under section 306; and</text></subparagraph><subparagraph id="HA35E3C40DDBB4DE39ABCDA1C4BF4C1C8"><enum>(C)</enum><text>meets any other requirements specified by such Secretary.</text></subparagraph></paragraph><paragraph id="HBF0DC4799A41432FA85E22CF07E72825"><enum>(3)</enum><header>Assumed liability</header><text>The successor in interest shall assume the liability and reclamation responsibilities established by the existing permit and shall conduct the mineral activities in full compliance with this Act, and the terms and conditions of the permit as in effect at the time of transfer, assignment, or sale.</text></paragraph><paragraph id="H49AB897A8E2B45F08219B92B3FF40897"><enum>(4)</enum><header>Fee</header><text>Each application for approval of a permit transfer, assignment, or sale pursuant to this subsection shall be accompanied by a fee payable to the Secretary concerned in such amount as may be established by such Secretary. Such amount shall be equal to the actual or anticipated cost of reviewing and approving or disapproving such transfer, assignment, or sale, as determined by such Secretary.</text></paragraph></subsection><subsection id="H58E00468C3574904BDCF32D2F3BD59B6"><enum>(i)</enum><header>Public participation</header><text display-inline="yes-display-inline">The Secretary of the Interior and the Secretary of Agriculture shall jointly promulgate regulations to ensure transparency and public participation in permit decisions required under this Act, consistent with any requirements that apply to such decisions under section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>).</text></subsection></section><section id="HF0420EE086404AF78D18C5391DE6EC90"><enum>305.</enum><header>Persons ineligible for permits</header><subsection id="H08912976E99049FB844CD96074842392"><enum>(a)</enum><header>Current violations</header><text display-inline="yes-display-inline">Unless corrective action has been taken in accordance with subsection (c), no permit under this title shall be issued or transferred to an applicant if the applicant or any agent of the applicant, the operator (if different than the applicant), any claim, license, or lease holder (if different than the applicant) of the claim, license, or lease concerned, or any affiliate or officer or director of the applicant is currently in violation of any of the following:</text><paragraph id="HDF74AE51C5694F77B224FF09CB50B4EB"><enum>(1)</enum><text>A provision of this Act or any regulation under this Act.</text></paragraph><paragraph id="H999EE7EDE5D542678A7442B0AC56786A"><enum>(2)</enum><text>An applicable State or Federal toxic substance, solid waste, air, water quality, or fish and wildlife conservation law or regulation at any site where mining, beneficiation, or processing activities are occurring or have occurred.</text></paragraph><paragraph id="H4D03E12EE32A4BA89358A983DA70A3C7"><enum>(3)</enum><text display-inline="yes-display-inline">The Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1201">30 U.S.C. 1201 et seq.</external-xref>) or any regulation implementing that Act at any site where surface coal mining operations have occurred or are occurring.</text></paragraph></subsection><subsection id="H0C38E3FB7DE24ACE864C354901F10E6E"><enum>(b)</enum><header>Suspension</header><text display-inline="yes-display-inline">The Secretary concerned shall suspend an operations permit, in whole or in part, if such Secretary determines that any of the entities described in subsection (a) were in violation of any requirement listed in subsection (a) at the time the permit was issued.</text></subsection><subsection id="H814066B25AD649BDABBB50543845D7BC"><enum>(c)</enum><header>Correction</header><paragraph id="H5BB5BBD438054191BD3B573D0D6A6A24"><enum>(1)</enum><header>Reinstatement</header><text display-inline="yes-display-inline">The Secretary concerned may issue or reinstate a permit under this title if the applicant submits proof that the violation referred to in subsection (a) or (b) has been corrected or is in the process of being corrected to the satisfaction of such Secretary and the regulatory authority involved or if the applicant submits proof that the violator has filed and is presently pursuing, a direct administrative or judicial appeal to contest the existence of the violation. For purposes of this section, an appeal of any applicant’s relationship to an affiliate shall not constitute a direct administrative or judicial appeal to contest the existence of the violation.</text></paragraph><paragraph id="H39A80099BCCD479C9C9AC62DC217BA61"><enum>(2)</enum><header>Conditional approval</header><text>Any permit which is issued or reinstated based upon proof submitted under this subsection shall be conditionally approved or conditionally reinstated, as the case may be. If the violation is not successfully abated or the violation is upheld on appeal, the permit shall be suspended or revoked.</text></paragraph></subsection><subsection id="H2CBC056650C14C0F8D5FE2D56833BE2A"><enum>(d)</enum><header>Pattern of willful violations</header><text display-inline="yes-display-inline">No permit may be issued under this Act to any applicant if there is a demonstrated pattern of willful violations of the environmental protection requirements of this Act by the applicant, any affiliate of the applicant, or the operator or claim, license, or lease holder if different than the applicant.</text></subsection></section><section id="HEE8A75D3C97548D6B5088A67C1D2F9E3"><enum>306.</enum><header>Financial assurance</header><subsection id="HDCE213AD747B4BD4A169E6EF0F3675B2"><enum>(a)</enum><header>Financial assurance required</header><paragraph id="H23E360D7B70B4CBD8625DA0A6FD51EC2"><enum>(1)</enum><header>Form of assurance</header><text>After a permit is issued under this title and before any exploration or operations begin under the permit, the operator shall file with the Secretary concerned evidence of financial assurance payable to the United States. The financial assurance shall be provided in the form of a surety bond, letters of credit, certificates of deposit, or cash.</text></paragraph><paragraph id="HECDE5722540347959F7533B59DB4CF1C"><enum>(2)</enum><header>Covered activities</header><text display-inline="yes-display-inline">The financial assurance shall cover all lands within the initial permit area and all affected waters that may require restoration, treatment, or other management as a result of mineral activities, and shall be extended to cover all lands and waters added pursuant to any permit modification made under section 303(e) or section 304(e), or affected by mineral activities.</text></paragraph></subsection><subsection id="HF1C8506813D94E96B5DEFF2BE192CADF"><enum>(b)</enum><header>Amount</header><text>The amount of the financial assurance required under this section shall be sufficient to assure the completion of reclamation and restoration satisfying the requirements of this Act if the work were to be performed by the Secretary concerned in the event of forfeiture, including the construction and maintenance costs for any treatment facilities necessary to meet Federal and State environmental requirements. The calculation of such amount shall take into account the maximum level of financial exposure which shall arise during the mineral activity and administrative costs associated with a government agency reclaiming the site.</text></subsection><subsection id="HF556EE7B54EF43BDBED2A3CFF36F8234"><enum>(c)</enum><header>Duration</header><text display-inline="yes-display-inline">The financial assurance required under this section shall be held for the duration of the mineral activities and for an additional period to cover the operator’s responsibility for reclamation, restoration, and long-term maintenance, and effluent treatment as specified in subsection (g).</text></subsection><subsection id="H79314B76D9E244A7A5F26793F2C19518"><enum>(d)</enum><header>Adjustments</header><text display-inline="yes-display-inline">The amount of the financial assurance and the terms of the acceptance of the assurance may be adjusted by the Secretary concerned from time to time as the area requiring coverage is increased or decreased, or where the costs of reclamation or treatment change, or pursuant to section 304(f), but the financial assurance shall otherwise be in compliance with this section. The Secretary concerned shall review the financial guarantee every 3 years and as part of the permit application review under section 304(g).</text></subsection><subsection id="HDEA7BC40F8EB46D28B28910B1A9FB57B"><enum>(e)</enum><header>Release</header><text>Upon request, and after notice and opportunity for public comment, and after inspection by the Secretary concerned, such Secretary may, after consultation with the Administrator of the Environmental Protection Agency, release in whole or in part the financial assurance required under this section if the Secretary makes both of the following determinations:</text><paragraph id="H664176A7BF4F405BA8ED83E4741DCA8E"><enum>(1)</enum><text>A determination that reclamation or restoration covered by the financial assurance has been accomplished as required by this Act.</text></paragraph><paragraph id="H74C58F81A4E34BB0BBAFFADB855D84BC"><enum>(2)</enum><text>A determination that the terms and conditions of any other applicable Federal requirements, and State requirements applicable pursuant to cooperative agreements under section 308, have been fulfilled.</text></paragraph></subsection><subsection id="H81CC4D8A3D8F42539342BE36E21C2D19"><enum>(f)</enum><header>Release schedule</header><text display-inline="yes-display-inline">The release referred to in subsection (e) shall be according to the following schedule:</text><paragraph id="H7A48B40F1441457E868152A39ECB0803"><enum>(1)</enum><text>After the operator has completed any required backfilling, regrading, and drainage control of an area subject to mineral activities and covered by the financial assurance, and has commenced revegetation on the regraded areas subject to mineral activities in accordance with the approved plan, that portion of the total financial assurance secured for the area subject to mineral activities attributable to the completed activities may be released except that sufficient assurance must be retained to address other required reclamation and restoration needs and to assure the long-term success of the revegetation.</text></paragraph><paragraph id="H4C7757E3412F438F8733374D8FB0AFF0"><enum>(2)</enum><text>After the operator has completed successfully all remaining mineral activities and reclamation activities and all requirements of the operations plan and the reclamation plan, and all other requirements of this Act have been fully met, the remaining portion of the financial assurance may be released.</text></paragraph><continuation-text continuation-text-level="subsection">During the period following release of the financial assurance as specified in paragraph (1), until the remaining portion of the financial assurance is released as provided in paragraph (2), the operator shall be required to comply with the permit issued under this title. </continuation-text></subsection><subsection id="H3643CE61DF64467081F1FA64E443225C"><enum>(g)</enum><header>Effluent</header><text display-inline="yes-display-inline">Notwithstanding section 307(b)(4), where any discharge or other water-related condition resulting from the mineral activities requires treatment in order to meet the applicable effluent limitations and water quality standards, the financial assurance shall include the estimated cost of maintaining such treatment for the projected period that will be needed after the cessation of mineral activities. The portion of the financial assurance attributable to such estimated cost of treatment shall not be released until the discharge has ceased for a period of 5 years, as determined by ongoing monitoring and testing, or, if the discharge continues, until the operator has met all applicable effluent limitations and water quality standards for 5 full years without treatment.</text></subsection><subsection id="HCCB817D7CB314758B550DE714827CFCA"><enum>(h)</enum><header>Environmental hazards</header><text display-inline="yes-display-inline">If the Secretary concerned determines, after final release of financial assurance, that an environmental hazard resulting from the mineral activities exists, or the terms and conditions of the explorations or operations permit of this Act were not fulfilled in fact at the time of release, such Secretary shall issue an order under section 507 requiring the claim holder or operator (or any person who controls the claim holder or operator) to correct the condition such that applicable laws and regulations and any conditions from the plan of operations are met.</text></subsection></section><section id="HC2E43884939D4EACB99E612E2FE5CD67"><enum>307.</enum><header>Operation and reclamation</header><subsection id="HD2DA89AF97394DB6847819916C2BB5A1"><enum>(a)</enum><header>General rule</header><paragraph commented="no" display-inline="yes-display-inline" id="H8C8A00236F1F44AB9934316743E39A6F"><enum>(1)</enum><text>The operator shall restore lands subject to mineral activities carried out under a permit issued under this title to a condition capable of supporting—</text><subparagraph id="H9E4EDC23152642F6920840CD0F7F4E2F" indent="up1"><enum>(A)</enum><text>the uses which such lands were capable of supporting prior to surface disturbance by the operator; or</text></subparagraph><subparagraph id="HD40C216952E0415EAB9B8074A19D2C21" indent="up1"><enum>(B)</enum><text>other beneficial uses which conform to applicable land use plans as determined by the Secretary concerned.</text></subparagraph></paragraph><paragraph id="H54A5A12F86C5456C94571813A4CC3174" indent="up1"><enum>(2)</enum><text>Reclamation shall proceed as contemporaneously as practicable with the conduct of mineral activities. In the case of a cessation of mineral activities beyond that provided for as a temporary cessation under this Act, reclamation activities shall begin immediately.</text></paragraph></subsection><subsection id="H41459177C3CE4AC490532E85505BC3B9"><enum>(b)</enum><header>Operation and reclamation standards</header><text display-inline="yes-display-inline">The Secretary of the Interior and the Secretary of Agriculture shall jointly promulgate regulations that establish operation and reclamation standards for mineral activities permitted under this Act. The Secretaries may determine whether outcome-based performance standards or technology-based design standards are most appropriate. The regulations shall address the following:</text><paragraph id="H4733F636684042BD823E230BC690132B"><enum>(1)</enum><text>Segregation, protection, and replacement of topsoil or other suitable growth medium, and the prevention, where possible, of soil contamination.</text></paragraph><paragraph id="HA4CA20E8C93E44D4B40BC02301CCE2F1"><enum>(2)</enum><text>Maintenance of the stability of all surface areas.</text></paragraph><paragraph id="H16D8B499C4FD4AF0999B932A5541C8F0"><enum>(3)</enum><text>Control of sediments to prevent erosion and manage drainage.</text></paragraph><paragraph id="H70EF6AC61E994974983C55CD4590CD65"><enum>(4)</enum><text>Minimization of the formation and migration of acidic, alkaline, metal-bearing, or other deleterious leachate.</text></paragraph><paragraph id="H54FD530F594A4C67A688C64AB9C6D82D"><enum>(5)</enum><text>Reduction of the visual impact of mineral activities to the surrounding topography, including as necessary pit backfill.</text></paragraph><paragraph id="H15A3E86C7481424ABFC322522AE37C56"><enum>(6)</enum><text>Establishment of a diverse, effective, and permanent vegetative cover of the same seasonal variety native to the area affected by mineral activities, and equal in extent of cover to the natural vegetation of the area.</text></paragraph><paragraph id="HB5DE6B079637490A812E0B38D3465F23"><enum>(7)</enum><text>Design and maintenance of leach operations, impoundments, and excess waste according to standard engineering standards to achieve and maintain stability and reclamation of the site.</text></paragraph><paragraph id="H617AFAA1A1044C2DADF0BF10AA2150BC"><enum>(8)</enum><text>Removal of structures and roads and sealing of drill holes.</text></paragraph><paragraph id="H118AF9F074CA483FA8D51938876A5891"><enum>(9)</enum><text>Restoration of, or mitigation for, fish and wildlife habitat disturbed by mineral activities.</text></paragraph><paragraph id="H20E60112493A4D8DB3A2F22D93011FD5"><enum>(10)</enum><text>Preservation of cultural, paleontological, and cave resources.</text></paragraph><paragraph id="H768CADB5FA52404AB0DF0A0936452765"><enum>(11)</enum><text>Prevention and suppression of fire within the leased area.</text></paragraph></subsection><subsection id="H3F0F59A60FFB4A83B0EE2D0685840188"><enum>(c)</enum><header>Surface or Ground Water Withdrawals</header><text>The Secretary concerned shall work with State and local governments with authority over the allocation and use of surface and ground water in the area around the mine site as necessary to ensure that any surface or ground water withdrawals made as a result of mining activities approved under this section do not cause undue degradation.</text></subsection><subsection id="HACA3EA3EF91341C3A209B678EF3DFAA7"><enum>(d)</enum><header>Special rule</header><text>Reclamation activities for a mining claim, license, or lease that has been forfeited, relinquished, or lapsed, or a plan that has expired or been revoked or suspended, shall continue subject to review and approval by the Secretary concerned.</text></subsection></section><section id="H080F97726B474C439D2629C7C7980E55"><enum>308.</enum><header>State law and regulation</header><subsection id="H46E92B4895C44AB6ABF3004532221D2B"><enum>(a)</enum><header>State law</header><paragraph id="HF9A3E089109B4E3DA98D934C4DCE2CE1"><enum>(1)</enum><header>Reclamation, land use, environmental, and public health standards</header><text>Any reclamation, land use, environmental, or public health protection standard or requirement in State law or regulation that meets or exceeds the requirements of this Act shall not be construed to be inconsistent with any such standard.</text></paragraph><paragraph id="HCBD600E1113741EBA0B1DD3D800F41E5"><enum>(2)</enum><header>Bonding requirements</header><text>Any bonding standard or requirement in State law or regulation that meets or exceeds the requirements of this Act shall not be construed to be inconsistent with such requirements.</text></paragraph><paragraph id="H257D410521334A13AA7EC524789E7CD7"><enum>(3)</enum><header>Inspection standards</header><text>Any inspection standard or requirement in State law or regulation that meets or exceeds the requirements of this Act shall not be construed to be inconsistent with such requirements.</text></paragraph></subsection><subsection id="H03DCA91AFDD24287BC472B9C5BBCD9EA"><enum>(b)</enum><header>Applicability of other State requirements</header><paragraph id="H76A1A8CBDBDE4849AFEAB222D907AB48"><enum>(1)</enum><header>Environmental standards</header><text>Nothing in this Act shall be construed as affecting any toxic substance, solid waste, or air or water quality, standard or requirement of any State, county, local, or Tribal law or regulation, which may be applicable to mineral activities on lands subject to this Act.</text></paragraph><paragraph id="H15B4B03EA36048F88ADA837996ED2417"><enum>(2)</enum><header>Water resources</header><text>Nothing in this Act shall be construed as affecting in any way the right of any person to enforce or protect, under applicable law, such person’s interest in water resources affected by mineral activities on lands subject to this Act.</text></paragraph></subsection><subsection id="H3B5BC993EC3F4C58A68878ADF013DBF6"><enum>(c)</enum><header>Cooperative agreements</header><paragraph id="H885AABB86DF343BB937BE86430EA5773"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any State may enter into a cooperative agreement with the Secretary concerned for the purposes of such Secretary applying such standards and requirements referred to in subsection (a) and subsection (b) to mineral activities or reclamation on lands subject to this Act.</text></paragraph><paragraph id="H6AB0CBFA99F64B50A2B64C944F6A5AD9"><enum>(2)</enum><header>Common regulatory framework</header><text>In such instances where the proposed mineral activities would affect lands not subject to this Act in addition to lands subject to this Act, in order to approve a plan of operations the Secretary concerned shall enter into a cooperative agreement with the State that sets forth a common regulatory framework consistent with the requirements of this Act for the purposes of such plan of operations. Any such common regulatory framework shall not negate the authority of the Federal Government to independently inspect mines and operations and bring enforcement actions for violations.</text></paragraph><paragraph id="H5F6CD04B46A047F7AD74A81F615D2686"><enum>(3)</enum><header>Notice and public comment</header><text>The Secretary concerned shall not enter into a cooperative agreement with any State under this section until after notice in the Federal Register and opportunity for public comment and hearing.</text></paragraph></subsection><subsection id="H9F2A9DBF501C4794AE2A53705A4AB338"><enum>(d)</enum><header>Prior agreements</header><text>Any cooperative agreement or such other understanding between the Secretary concerned and any State, or political subdivision thereof, relating to the management of mineral activities on lands subject to this Act that was in existence on the date of enactment of this Act may only continue in force until 1 year after the date of enactment of this Act. During such 1-year period, the State and the Secretary shall review the terms of the agreement and make changes that are necessary to be consistent with this Act.</text></subsection></section></title><title id="H43DEBBBC0DD740C5AB3352368D96FE96"><enum>IV</enum><header>Abandoned Hardrock Mine Reclamation</header><section id="H010C26D3AC13407A804DC64D24CD5C87"><enum>401.</enum><header>Establishment of Fund</header><subsection id="HE060F0915EC643BA99C09EC7C4B0EF7A"><enum>(a)</enum><header>Establishment</header><text>There is established in the Department of the Treasury a separate account to be known as the Hardrock Minerals Reclamation Fund.</text></subsection><subsection id="H6FE95E2523A94AB1A7C58698EB90CBBD"><enum>(b)</enum><header>Investment</header><text>The Secretary shall notify the Secretary of the Treasury as to what portion of the Fund is not, in the Secretary’s judgment, required to meet current withdrawals. The Secretary of the Treasury shall invest such portion of the Fund in public debt securities with maturities suitable for the needs of such Fund and bearing interest at rates determined by the Secretary of the Treasury, taking into consideration current market yields on outstanding marketplace obligations of the United States of comparable maturities.</text></subsection><subsection id="H4FE0D9194F28435F9EE5562B016B22BE"><enum>(c)</enum><header>Administration</header><text display-inline="yes-display-inline">In addition to other uses authorized by this title, the Secretary may use amounts in the Fund as necessary for the administrative expenses of the United States, Indian Tribes, and the States to implement this title.</text></subsection></section><section id="H8AC310FC3B5845FF8AD1C552B168E603"><enum>402.</enum><header>Contents of Fund</header><subsection id="HA41D5EE1933E48908169B24480DFC034"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The following amounts shall be credited to the Fund:</text><paragraph id="H93D6B6937A304E71AC3696147CCC0B7F"><enum>(1)</enum><text display-inline="yes-display-inline">All moneys collected pursuant to section 502 and section 506.</text></paragraph><paragraph id="H502677BC74FF4CFC990ED671CDC8C1CD"><enum>(2)</enum><text display-inline="yes-display-inline">All fees received under section 304(a)(1)(B).</text></paragraph><paragraph id="H59153145CF9B482D88515B072F66EBCE"><enum>(3)</enum><text>All donations by persons, corporations, associations, and foundations for the purposes of this title.</text></paragraph><paragraph id="H6C24CDF7FF044532B865AA5B13580C5B"><enum>(4)</enum><text display-inline="yes-display-inline">All amounts deposited in the Fund under title I.</text></paragraph><paragraph id="HEC97ACE2E5AD4D07BC5634641A1D1639"><enum>(5)</enum><text display-inline="yes-display-inline">All income on investments under section 401(b).</text></paragraph><paragraph id="H0F9EF427201C491E8FF2421E712C53B8"><enum>(6)</enum><text display-inline="yes-display-inline">All amounts deposited in the Fund under section 403.</text></paragraph></subsection><subsection id="HA805E72A6E1E43AB813B6D406FFA4633"><enum>(b)</enum><header>Donations</header><text>The Secretary may accept for the Government a gift of money to be deposited into the Fund. The Secretary may reject a gift to the Fund if such rejection is in the interest of the Government.</text></subsection></section><section id="HF7025E7F89B8476387DB4FE337506EF9" commented="no"><enum>403.</enum><header>Displaced material reclamation fee</header><subsection id="H6D91B30C7986493D94F066FC38F5303A" commented="no"><enum>(a)</enum><header>Imposition of fee</header><text display-inline="yes-display-inline">Except as provided in subsection (g), each operator conducting hardrock mineral activities shall pay to the Secretary, for deposit in the Hardrock Minerals Fund established by section 401, a displaced material reclamation fee of 7 cents per ton of displaced material.</text></subsection><subsection id="HDA68ADC0F872405BA77AD80C1F8E96C6" commented="no"><enum>(b)</enum><header>Payment deadline</header><text>Such reclamation fee shall be paid not later than 60 days after the end of each calendar year beginning with the first calendar year occurring after the date of enactment of this Act.</text></subsection><subsection id="H9672904838D44DAE9DC0A0CB3E054B02" commented="no"><enum>(c)</enum><header>Submission of statement</header><text display-inline="yes-display-inline">Together with such reclamation fee, all operators conducting hardrock mineral activities shall submit to the Secretary a statement of the amount of displaced material produced during mineral activities during the previous calendar year, the accuracy of which shall be sworn to by the operator and notarized.</text></subsection><subsection id="HD4297467098246B383ACBC38FC2494B7" commented="no"><enum>(d)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any corporate officer, agent, or director of a person conducting hardrock mineral activities, and any other person acting on behalf of such a person, who knowingly makes any false statement, representation, or certification, or knowingly fails to make any statement, representation, or certification, required under this section with respect to such operation shall, upon conviction, be punished by a fine of not more than $10,000.</text></subsection><subsection id="H514F599EF43241B1B025240232D192D2" commented="no"><enum>(e)</enum><header>Civil Action To recover fee</header><text>Any portion of such reclamation fee not properly or promptly paid pursuant to this section shall be recoverable, with statutory interest, from the hardrock mineral activities operator, in any court of competent jurisdiction in any action at law to compel payment of debts.</text></subsection><subsection id="H4DE5578BAB4E44C1B44C23175A76910D" commented="no"><enum>(f)</enum><header>Effect</header><text>Nothing in this section requires a reduction in, or otherwise affects, any similar fee required under any law (including regulations) of any State.</text></subsection><subsection id="H56E9BD8D49DD4B76A140F267EBB89712" commented="no"><enum>(g)</enum><header>Exemption</header><text display-inline="yes-display-inline">The fee under this section shall not apply for small miners.</text></subsection></section><section id="HB5F9122A3EAB4B75BDB2939A356B73B8" commented="no"><enum>404.</enum><header>Use of the Fund</header><text display-inline="no-display-inline">Subject to the availability of appropriations, the Secretary shall use moneys in the Fund to carry out section 40704 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1245">30 U.S.C. 1245</external-xref>).</text></section></title><title id="H6BF0D4341AE94D22BB8C9104A8616506"><enum>V</enum><header>Additional Provisions</header><section id="HD9CC016DACB14F579171DE7980210E90"><enum>501.</enum><header>Policy functions</header><subsection commented="no" id="HFED00C5E4A484EF7B53E0960E6EFCB5A"><enum>(a)</enum><header>Minerals policy</header><text display-inline="yes-display-inline">Section 101 of the Mining and Minerals Policy Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/21a">30 U.S.C. 21a</external-xref>) is amended—</text><paragraph commented="no" id="H7D998B7B808F449EB64F5C88FFB0BC66"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>and to ensure that mineral extraction and processing not cause undue degradation of the natural and cultural resources of the public lands</quote> after <quote>activities</quote>; and</text></paragraph><paragraph commented="no" id="H962156E05E3347058928C2313FDC9227"><enum>(2)</enum><text>by adding at the end the following: <quote>It shall also be the responsibility of the Secretary of Agriculture to carry out the policy provisions of clauses (1) and (2) of the first paragraph of this section.</quote>.</text></paragraph></subsection><subsection commented="no" id="HCA6614C084CB4D1BB8473C5F01976C1C"><enum>(b)</enum><header>Mineral data</header><text>Section 5(e)(3) of the National Materials and Minerals Policy, Research and Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/30/1604">30 U.S.C. 1604(e)(3)</external-xref>) is amended by inserting before the period the following: <quote>, except that for National Forest System lands the Secretary of Agriculture shall promptly initiate actions to improve the availability and analysis of mineral data in public land use decisionmaking</quote>.</text></subsection></section><section id="H12484DE5AF164154982AC11FFD2C80D0"><enum>502.</enum><header>User fees and inflation adjustment</header><subsection id="H35415F57D2A649ED8BA005A05D3E4E91"><enum>(a)</enum><header>In general</header><paragraph id="HA5FA673787354E3790BB8C2A023B06DE"><enum>(1)</enum><text>The Secretary and the Secretary of Agriculture may each establish and collect from persons subject to the requirements of this Act such user fees as may be necessary to reimburse the United States for the expenses incurred in administering such requirements. Fees may be assessed and collected under this section only in such manner as may reasonably be expected to result in an aggregate amount of the fees collected during any fiscal year which does not exceed the aggregate amount of administrative expenses referred to in this section.</text></paragraph></subsection><subsection id="HD0C4309B41BA46E5AA320887417C6049"><enum>(b)</enum><header>Adjustment</header><paragraph id="HD49055733BF0475AB2DC7ABB14464D44"><enum>(1)</enum><header>Inflation</header><text>The Secretary shall adjust the fees required by this section, and all claim maintenance fees, rental rates, penalty amounts, and other dollar amounts established in this Act, to reflect changes in the Consumer Price Index published by the Bureau of Labor Statistics of the Department of Labor every 3 years after the date of enactment of this Act, or more frequently if the Secretary determines an adjustment to be reasonable.</text></paragraph><paragraph id="H0037CC9B90A64E968E12274906F7C99C"><enum>(2)</enum><header>Notice</header><text>The Secretary shall provide claimants, license holders, and lease holders notice of any adjustment made under this subsection not later than July 1 of any year in which the adjustment is made.</text></paragraph><paragraph id="H4B25B0DC79CF48FE9D914EB970B902F3"><enum>(3)</enum><header>Applicability</header><text>A fee adjustment under this subsection shall begin to apply the calendar year following the calendar year in which it is made.</text></paragraph></subsection></section><section id="H3FE26A85BF7F44288DB8FC91E9F4E7F2"><enum>503.</enum><header>Inspection and monitoring</header><subsection id="H64E06B5E566B4E4CBA51FBF967E8B90A"><enum>(a)</enum><header>Inspections</header><paragraph id="H4AEA6E770FE446BA84A6F7A83EA46532"><enum>(1)</enum><header>In general</header><text>The Secretary concerned shall make inspections of mineral activities so as to ensure compliance with the requirements of this Act.</text></paragraph><paragraph id="H4C797558D51046F3875965E762601DCE"><enum>(2)</enum><header>Frequency</header><text display-inline="yes-display-inline">The Secretary concerned shall establish a frequency of inspections for mineral activities conducted under a permit issued under title III, but in no event shall such inspection frequency be less than one complete inspection per calendar quarter or, two per calendar quarter in the case of a permit for which the Secretary concerned approves an application under section 304(f). After revegetation has been established in accordance with a reclamation plan, such Secretary shall conduct 2 complete inspections annually. Such Secretary shall have the discretion to modify the inspection frequency for mineral activities that are conducted on a seasonal basis. Inspections shall continue under this subsection until final release of financial assurance.</text></paragraph><paragraph id="H561312FAC2CC4751967703A9EC59336D"><enum>(3)</enum><header>By request</header><subparagraph id="HFA5DBD11E80C4EC39D07862114637CE6"><enum>(A)</enum><header>In general</header><text>Any person who has reason to believe he or she is or may be adversely affected by mineral activities due to any violation of the requirements of a permit approved under this Act may request an inspection.</text></subparagraph><subparagraph id="H376CCC09FC24469FA1409D7202258EC2"><enum>(B)</enum><header>Review period</header><text>The Secretary concerned shall determine within 10 working days of receipt of the request whether the request states a reason to believe that a violation exists.</text></subparagraph><subparagraph id="H41943F402F454391AC86C2987E6A5A69"><enum>(C)</enum><header>Imminent threat</header><text>If the person alleges and provides reason to believe that an imminent threat to the environment or danger to the health or safety of the public exists, the 10-day period shall be waived and the inspection shall be conducted immediately.</text></subparagraph><subparagraph id="HE91CA0D4152F4973B170CAFEA4659D2A"><enum>(D)</enum><header>Notification</header><text>When an inspection is conducted under this paragraph, the Secretary concerned shall notify the person requesting the inspection, and such person shall be allowed to accompany the Secretary concerned or the Secretary’s authorized representative during the inspection.</text></subparagraph><subparagraph id="H1D35FDBFFB8A4E76AC6C39635EA90090"><enum>(E)</enum><header>Liability</header><text>The Secretary shall not incur any liability for allowing such person to accompany an authorized representative.</text></subparagraph><subparagraph id="H61FF27CCE60646388357EEDFF0DA7D48"><enum>(F)</enum><header>Anonymity</header><text>The identity of the person supplying information to the Secretary relating to a possible violation or imminent danger or harm shall remain confidential with the Secretary if so requested by that person, unless that person elects to accompany an authorized representative on the inspection.</text></subparagraph><subparagraph id="HBFA2745796FB4F35BBC36BE9A993DA0C"><enum>(G)</enum><header>Procedures</header><text>The Secretaries shall, by joint rule, establish procedures for the review of—</text><clause id="H2FC666EE846D4B119CA28A59EE67A312"><enum>(i)</enum><text>any decision by an authorized representative not to inspect; or</text></clause><clause id="HB408E39B39F5423A869D0FF44871C926"><enum>(ii)</enum><text>any refusal by such representative to ensure that remedial actions are taken with respect to any alleged violation.</text></clause></subparagraph><subparagraph id="H4B28011A6DA74766B6A26D8408D35FF2"><enum>(H)</enum><header>Written statement</header><text>The Secretary concerned shall furnish a person requesting a review a written statement of the reasons for the Secretary’s final disposition of the case.</text></subparagraph></paragraph></subsection><subsection id="H8C75D47D8D644A939F3127BD6EADB596"><enum>(b)</enum><header>Monitoring</header><paragraph id="HDA8309DD0DCC4F13A4ED3446ABAAF987"><enum>(1)</enum><header>Monitoring system</header><text>The Secretary concerned shall require all operators to develop and maintain a monitoring and evaluation system that shall identify compliance with all requirements of a permit approved under this Act. The Secretary concerned may require additional monitoring to be conducted as necessary to assure compliance with the reclamation and other environmental standards of this Act. Such plan must be reviewed and approved by the Secretary and shall become a part of the explorations or operations permit.</text></paragraph><paragraph id="H6D822F9060B54698A513A186F761753D"><enum>(2)</enum><header>Reporting requirements</header><text>The operator shall file reports with the Secretary concerned, on a frequency determined by the Secretary concerned, on the results of the monitoring and evaluation process, except that if the monitoring and evaluation show a violation of the requirements of a permit approved under this Act, it shall be reported immediately to the Secretary concerned. The Secretary shall evaluate the reports submitted pursuant to this paragraph, and based on those reports and any necessary inspection shall take enforcement action pursuant to this section. Such reports shall be maintained by the operator and by the Secretary and shall be made available to the public.</text></paragraph><paragraph id="HD6F0EE2723E04854B45B98370DCC52DE"><enum>(3)</enum><header>Failure to report</header><text display-inline="yes-display-inline">The Secretary concerned shall determine what information shall be reported by the operator pursuant to paragraph (2). A failure to report as required by the Secretary concerned shall constitute a violation of this Act and subject the operator to enforcement action pursuant to section 506.</text></paragraph></subsection></section><section id="HB5A2E46995204050881B451CA0E9A9B4"><enum>504.</enum><header>Citizens suits</header><subsection id="H1377007FE0EF426F91F29AC54BC4A090"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (c), any person may commence a civil action on his or her own behalf to compel compliance—</text><paragraph id="HF80F5A4464314E0C8FCF95C233D42B24"><enum>(1)</enum><text display-inline="yes-display-inline">against any person (including the Secretary or the Secretary of Agriculture) who is alleged to be in violation of any of the provisions of this Act or any regulation promulgated pursuant to this Act or any term or condition of any lease, license, or permit issued under this Act; or</text></paragraph><paragraph id="H8AEACDE2DE204B8BB3CC15494E6EEA92"><enum>(2)</enum><text>against the Secretary or the Secretary of Agriculture where there is alleged a failure of such Secretary to perform any act or duty under this Act, or to promulgate any regulation under this Act, which is not within the discretion of the Secretary concerned.</text></paragraph></subsection><subsection id="H0A98AB8D0DCC4AC7B1660E7228B8DA73"><enum>(b)</enum><header>District court jurisdiction</header><text display-inline="yes-display-inline">The United States district courts shall have jurisdiction over actions brought under this section, without regard to the amount in controversy or the citizenship of the parties, including actions brought to apply any civil penalty under this Act. The district courts of the United States shall have jurisdiction to compel agency action unreasonably delayed, except that an action to compel agency action reviewable under section 505 may only be filed in a United States district court within the circuit in which such action would be reviewable under section 505.</text></subsection><subsection id="H168B028FD0C948D98E36BCB08AF9A89B"><enum>(c)</enum><header>Exceptions</header><paragraph id="H6EEE6D079F04410EB0ABEAF64CCD47F1"><enum>(1)</enum><header>Notice</header><text display-inline="yes-display-inline">No action may be commenced under subsection (a) before the end of the 60-day period beginning on the date the plaintiff has given notice in writing of such alleged violation to the alleged violator and the Secretary concerned, except that any such action may be brought immediately after such notification if the violation complained of constitutes an imminent threat to the environment or to the health or safety of the public or to properties eligible for listing on the National Register of Historic Places.</text></paragraph><paragraph id="H0ECEE8F718DB46849EAE94E84C6815EB"><enum>(2)</enum><header>On-going litigation</header><text display-inline="yes-display-inline">No action may be brought against any person other than the Secretary or the Secretary of Agriculture under subsection (a)(1) if such Secretary has commenced and is diligently prosecuting a civil or criminal action in a court of the United States to require compliance.</text></paragraph><paragraph id="H0E0265BB85CA4AD4B547A821FB87BFB6"><enum>(3)</enum><header>Exception</header><text display-inline="yes-display-inline">No action may be commenced under subsection (a)(2) against either Secretary to review any rule promulgated by, or to any permit issued or denied by such Secretary if such rule or permit issuance or denial is judicially reviewable under section 505 or under any other provision of law at any time after such promulgation, issuance, or denial is final.</text></paragraph></subsection><subsection id="H4A801A5D215F4AB380B3754D8B6E9060"><enum>(d)</enum><header>Venue</header><text>Venue of all actions brought under this section shall be determined in accordance with section 1391 of title 28, United States Code.</text></subsection><subsection id="H836F6748B29D4D989FBE5C133FAB8A2A"><enum>(e)</enum><header>Costs</header><text>The court, in issuing any final order in any action brought pursuant to this section may award costs of litigation (including attorney and expert witness fees) to any party whenever the court determines such award is appropriate. The court may, if a temporary restraining order or preliminary injunction is sought, require the filing of a bond or equivalent security in accordance with the Federal Rules of Civil Procedure.</text></subsection><subsection id="HB546ADFFC0C84F198307B22DA2084260"><enum>(f)</enum><header>Savings clause</header><text>Nothing in this section shall restrict any right which any person (or class of persons) may have under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code, under this section, or under any other statute or common law to bring an action to seek any relief against the Secretary or the Secretary of Agriculture or against any other person, including any action for any violation of this Act or of any regulation or permit issued under this Act or for any failure to act as required by law. Nothing in this section shall affect the jurisdiction of any court under any provision of title 28, United States Code, including any action for any violation of this Act or of any regulation or permit issued under this Act or for any failure to act as required by law.</text></subsection></section><section id="HE578593ABFAA4B899FD30F485504F61B"><enum>505.</enum><header>Administrative and judicial review</header><subsection id="HB5A7B1D6930D411A8B8998259959988E"><enum>(a)</enum><header>Review by secretary</header><paragraph id="H101685D9035D407998B89FFBAF6E5CC3"><enum>(1)</enum><header>Notice of violation</header><text display-inline="yes-display-inline">Any person issued a notice of violation or cessation order under section 507, or any person having an interest which is or may be adversely affected by such notice or order, may apply to the Secretary concerned for review of the notice or order within 30 days after receipt thereof, or as the case may be, within 30 days after such notice or order is modified, vacated, or terminated.</text></paragraph><paragraph id="H0631736909C94884A073C19CEA77FF5E" display-inline="no-display-inline"><enum>(2)</enum><header>Review of penalty</header><text display-inline="yes-display-inline">Any person who is subject to a penalty assessed under section 507 may apply to the Secretary concerned for review of the assessment within 45 days of notification of such penalty.</text></paragraph><paragraph id="HE5C44F12CA464B62920B2E6F3254E466"><enum>(3)</enum><header>Third-party requests</header><text display-inline="yes-display-inline">Any person may apply to the Secretary concerned for review of a decision under this subsection within 30 days after such decision is issued.</text></paragraph><paragraph id="H6BAB50EF3B724CA2A2837FF32277C947"><enum>(4)</enum><header>Stays pending review</header><text display-inline="yes-display-inline">Pending a review by the Secretary or resolution of an administrative appeal, final decisions (except enforcement actions under section 507) shall be stayed.</text></paragraph><paragraph id="HF620E897259B4BB196F622EE7A0646BE"><enum>(5)</enum><header>Public hearing</header><text display-inline="yes-display-inline">The Secretary concerned shall provide an opportunity for a public hearing at the request of any party to the proceeding as specified in paragraph (1). The filing of an application for review under this subsection shall not operate as a stay of any order or notice issued under section 506.</text></paragraph><paragraph id="HA86AB536159748F087B17E95F9BA4940"><enum>(6)</enum><header>Written decision</header><text display-inline="yes-display-inline">For any review proceeding under this subsection, the Secretary concerned shall make findings of fact and shall issue a written decision incorporating therein an order vacating, affirming, modifying, or terminating the notice, order, or decision, or with respect to an assessment, the amount of penalty that is warranted. Where the application for review concerns a cessation order issued under section 506 the Secretary concerned shall issue the written decision within 30 days of the receipt of the application for review or within 30 days after the conclusion of any hearing referred to in paragraph (5), whichever is later, unless temporary relief has been granted by the Secretary concerned under paragraph (7).</text></paragraph><paragraph id="HB3E63E09D7D047AF9E8B9DE62C3956B7"><enum>(7)</enum><header>Temporary relief</header><text display-inline="yes-display-inline">Pending completion of any review proceedings under this subsection, the applicant may file with the Secretary concerned a written request that the Secretary grant temporary relief from any order issued under section 506 together with a detailed statement giving reasons for such relief. The Secretary concerned shall expeditiously issue an order or decision granting or denying such relief. The Secretary concerned may grant such relief under such conditions as he or she may prescribe only if such relief shall not adversely affect the health or safety of the public or cause imminent environmental harm to land, air, or water resources.</text></paragraph><paragraph id="HDC02CA8AAB6D4D67A0D5151B5C4A03AD"><enum>(8)</enum><header>Savings clause</header><text display-inline="yes-display-inline">The availability of review under this subsection shall not be construed to limit the operation of rights under section 504.</text></paragraph></subsection><subsection id="H9C5FD2C97E6848B096286D7E33D4D068"><enum>(b)</enum><header>Judicial review</header><paragraph id="H297DBAD5855245AEA680BC0B007F8C92"><enum>(1)</enum><header>Court of Appeals for the District of Columbia</header><text display-inline="yes-display-inline">Any final action by the Secretaries of the Interior and Agriculture in promulgating regulations to implement this Act, or any other final actions constituting rulemaking to implement this Act, shall be subject to judicial review only in a United States Court of Appeals for a circuit in which an affected State is located or within the District of Columbia. Any action subject to judicial review under this subsection shall be affirmed unless the court concludes that such action is arbitrary, capricious, or otherwise inconsistent with law. A petition for review of any action subject to judicial review under this subsection shall be filed within 60 days from the date of such action, or after such date if the petition is based solely on grounds arising after the 60th day. Any such petition may be made by any person who commented or otherwise participated in the rulemaking or any person who may be adversely affected by the action of the Secretaries.</text></paragraph><paragraph id="H3A654DC330CD4D32991CE771C115D227"><enum>(2)</enum><header>Standard of review</header><text display-inline="yes-display-inline">Final agency action under this subsection, including such final action on those matters described under subsection (a), shall be subject to judicial review in accordance with paragraph (4) and pursuant to section 1391 of title 28, United States Code, on or before 60 days from the date of such final action. Any action subject to judicial review under this subsection shall be affirmed unless the court concludes that such action is arbitrary, capricious, or otherwise inconsistent with law.</text></paragraph><paragraph id="H4E93C721527D4B18AC38271E2BD1A01A"><enum>(3)</enum><header>Savings clause</header><text>The availability of judicial review established in this subsection shall not be construed to limit the operations of rights under section 504.</text></paragraph><paragraph id="HA40C6FB43A3D4B9FABC74CBCF480F432"><enum>(4)</enum><header>Record</header><text>The court shall hear any petition or complaint filed under this subsection solely on the record made before the Secretary or Secretaries concerned. The court may affirm or vacate any order or decision or may remand the proceedings to the Secretary or Secretaries for such further action as it may direct.</text></paragraph><paragraph id="H191F564E38F74B568646821231C69541"><enum>(5)</enum><header>Commence of a proceeding not a stay</header><text>The commencement of a proceeding under this section shall not, unless specifically ordered by the court, operate as a stay of the action, order, or decision of the Secretary or Secretaries concerned.</text></paragraph></subsection><subsection id="H4610EE8CE22E4BFB92624C6C45EE3C89"><enum>(c)</enum><header>Costs</header><text display-inline="yes-display-inline">Whenever a proceeding occurs under subsection (a) or (b), at the request of any person, a sum equal to the aggregate amount of all costs and expenses (including attorney fees) as determined by the Secretary or Secretaries concerned or the court to have been reasonably incurred by such person for or in connection with participation in such proceedings, including any judicial review of the proceeding, may be assessed against either party as the court, in the case of judicial review, or the Secretary or Secretaries concerned in the case of administrative proceedings, deems appropriate if it is determined that such party prevailed in whole or in part, achieving some success on the merits, and that such party made a substantial contribution to a full and fair determination of the issues.</text></subsection></section><section id="H4D3696331E2B4E0B9BC1A7D95B8CA88C"><enum>506.</enum><header>Reporting requirements</header><subsection id="HABBAE717FB554545A7A4B66A05AB3CD9"><enum>(a)</enum><header>Report to Secretary</header><text>An operator engaging in any mineral activities located on Federal land or on Indian land shall submit to the Secretary an annual report, in a time and manner prescribed by the Secretary, describing the total amount (in metric tons) and value of hardrock minerals produced through such mineral activities, including the total amount and value of any minerals produced from a mine partially located on either Federal land or Indian land, disaggregated by mineral and by percentage extracted from Federal land and percentage extracted from Indian land.</text></subsection><subsection id="H2ECFFAD4532F4A89B9773C08755313C3"><enum>(b)</enum><header>Failure To report</header><text display-inline="yes-display-inline">Any person who fails to comply with the requirements of subsection (a) shall be subject to a civil penalty not to exceed $25,000 per day during which such failure continues, which may be assessed by the Secretary.</text></subsection><subsection id="HFD537CC870394724B4768B1B94782A06"><enum>(c)</enum><header>Report to Congress</header><text>The Secretary shall submit an annual report to Congress providing the following information for each hardrock mine located on Federal land or on Indian land:</text><paragraph id="H7876E7BC69694CC3987E6C0CC4117BC7"><enum>(1)</enum><text display-inline="yes-display-inline">The data submitted for such mine under subsection (a).</text></paragraph><paragraph id="HAE7F99E9931C4DC1947AD75323B69C0B"><enum>(2)</enum><text>The name of the mine operator.</text></paragraph><paragraph id="H344FB2A3B7FC4206B781E5FC98339919"><enum>(3)</enum><text>The State in which such mine is located.</text></paragraph><paragraph id="H420EE4DDDC644067A75A61AD9DE3BFB5"><enum>(4)</enum><text>The Bureau of Land Management Field Office with jurisdiction over such mine.</text></paragraph><paragraph id="HBB7E2B9ECD3A4B24A1C88BB5BEBFE685"><enum>(5)</enum><text>Whether such mine is located on Federal land.</text></paragraph><paragraph id="HA2A5F00EA6D743478E16D931DE22F76A"><enum>(6)</enum><text>Whether such mine is located on Indian land.</text></paragraph></subsection><subsection id="H4E548B7591C848CC839C477B586131F1"><enum>(d)</enum><header>Regulations</header><text>The Secretary shall promulgate such regulations as are necessary to carry out this section not later than 180 days after the date of enactment of this Act.</text></subsection></section><section id="H5F2B91C535CD4CB1B20886C96FD08099"><enum>507.</enum><header>Enforcement</header><subsection id="HEC6D57A2975F4A6BA83CCF6904F5D1E2"><enum>(a)</enum><header>Orders</header><paragraph id="HB83F8198A44C473BBCA95EA4D949334D"><enum>(1)</enum><header>Notice of violation</header><text>If the Secretary concerned, or an authorized representative of such Secretary, determines that any person is in violation of any environmental protection requirement or any regulation issued by the Secretaries to implement this Act, such Secretary or authorized representative shall issue to such person a notice of violation describing the violation and the corrective measures to be taken. The Secretary concerned, or the authorized representative of such Secretary, shall provide such person with a period of time not to exceed 30 days to abate the violation. Such period of time may be extended by the Secretary concerned upon a showing of good cause by such person. If, upon the expiration of time provided for such abatement, the Secretary concerned, or the authorized representative of such Secretary, finds that the violation has not been abated he or she shall immediately order a cessation of all mineral activities or the portion thereof relevant to the violation.</text></paragraph><paragraph id="H8F4767E9C4254CC0A6983159F4600870"><enum>(2)</enum><header>Order for immediate cessation</header><text>If the Secretary concerned, or the authorized representative of the Secretary concerned, determines that any condition or practice exists, or that any person is in violation of any requirement under a permit approved under this Act, and such condition, practice or violation is causing, or can reasonably be expected to cause either of the following, such Secretary or authorized representative shall immediately order a cessation of mineral activities or the portion thereof relevant to the condition, practice, or violation:</text><subparagraph id="HE5229FA778CB475CA797749DEFFE889B"><enum>(A)</enum><text>An imminent danger to the health or safety of the public.</text></subparagraph><subparagraph id="H802DD1B08C124C96A41EB50BB24B1EDD"><enum>(B)</enum><text>Significant, imminent environmental harm to land, air, water, or fish or wildlife resources.</text></subparagraph></paragraph><paragraph id="H62E03BC4C8864D2EA0E23C78338A6698"><enum>(3)</enum><header>Duration</header><subparagraph id="H68938FCD05C24F27BA67912A74985178"><enum>(A)</enum><header>Termination</header><text display-inline="yes-display-inline">A cessation order pursuant to paragraph (1) or (2) shall remain in effect until such Secretary, or authorized representative, determines that the condition, practice, or violation has been abated, or until modified, vacated or terminated by the Secretary or authorized representative. In any such order, the Secretary or authorized representative shall determine the steps necessary to abate the violation in the most expeditious manner possible and shall include the necessary measures in the order.</text></subparagraph><subparagraph id="H42A0105E6D5944F3BDCF2CBCD6F87E48"><enum>(B)</enum><header>Financial assurances</header><text>The Secretary concerned shall require appropriate financial assurances to ensure that the abatement obligations are met when issuing an order under this section.</text></subparagraph><subparagraph id="H753B2FFF1BE04A729AE88BA65740B773"><enum>(C)</enum><header>Authority of the Secretary</header><text>Any notice or order issued pursuant to paragraph (1) or (2) may be modified, vacated, or terminated by the Secretary concerned or an authorized representative of such Secretary. Any person to whom any such notice or order is issued shall be entitled to a hearing on the record.</text></subparagraph></paragraph><paragraph id="HC7502460D80D4E23899088BD5E7521EE"><enum>(4)</enum><header>Alternative enforcement action</header><text>If, after 30 days of the date of the order referred to in subsection (a) the required abatement has not occurred, the Secretary concerned shall take such alternative enforcement action against the claim holder, license holder, lease holder, or operator (or any person who controls the claim holder, license holder, lease holder, or operator) as will most likely bring about abatement in the most expeditious manner possible. Such alternative enforcement action may include seeking appropriate injunctive relief to bring about abatement. Nothing in this paragraph shall preclude the Secretary concerned from taking alternative enforcement action prior to the expiration of 30 days.</text></paragraph><paragraph id="H0DC728143A704B1390F92A16703FB46E"><enum>(5)</enum><header>Failure or default</header><text>If a claim holder, license holder, lease holder, or operator (or any person who controls the claim holder, license holder, lease holder, or operator) fails to abate a violation or defaults on the terms of the permit, the Secretary concerned shall forfeit the financial assurance for the plan as necessary to ensure abatement and reclamation under this Act. The Secretary concerned may prescribe conditions under which a surety may perform reclamation in accordance with the approved plan in lieu of forfeiture.</text></paragraph><paragraph id="HCB496CB6F2BC42BB8134531F8370DB5B"><enum>(6)</enum><header>Pending review</header><text>The Secretary concerned shall not cause forfeiture of the financial assurance while administrative or judicial review is pending.</text></paragraph><paragraph id="HF9023C2305C0483F8AD80962A167B51B"><enum>(7)</enum><header>Liability in the event of forfeiture</header><text>In the event of forfeiture, the claim holder, license holder, lease holder, operator, or any affiliate thereof, as appropriate as determined by the Secretary by rule, shall be jointly and severally liable for any remaining reclamation obligations under this Act.</text></paragraph></subsection><subsection id="HBEF7A4D7820F4CD0A51D95C3431E3685"><enum>(b)</enum><header>Compliance</header><text>The Secretary concerned may request the Attorney General to institute a civil action for relief, including a permanent or temporary injunction or restraining order, or any other appropriate enforcement order, including the imposition of civil penalties, in the district court of the United States for the district in which the mineral activities are located whenever a person—</text><paragraph id="H01D6CC422ADD491B8A849D8B9BFE3D35"><enum>(1)</enum><text display-inline="yes-display-inline">violates, fails, or refuses to comply with any order issued by the Secretary concerned under subsection (a); or</text></paragraph><paragraph id="H4408926CAD4042A6990610D09BF7F097"><enum>(2)</enum><text display-inline="yes-display-inline">interferes with, hinders, or delays the Secretary concerned in carrying out an inspection under section 503.</text></paragraph><continuation-text continuation-text-level="subsection">Such court shall have jurisdiction to provide such relief as may be appropriate. Any relief granted by the court to enforce an order under paragraph (1) shall continue in effect until the completion or final termination of all proceedings for review of such order unless the district court granting such relief sets it aside. </continuation-text></subsection><subsection id="H872CE45805A04203B1CF0283FFFC3FA7"><enum>(c)</enum><header>Delegation</header><text>Notwithstanding any other provision of law, the Secretary may utilize personnel of the Office of Surface Mining Reclamation and Enforcement to ensure compliance with the requirements of this Act.</text></subsection><subsection id="H780D48B10AD7424E9736BF731A1805FD"><enum>(d)</enum><header>Penalties</header><paragraph id="H100471DB732F49C792A6FE00F1C93D64"><enum>(1)</enum><header>Failure to comply with requirements of a permit</header><text>Any person who fails to comply with any requirement of a permit approved under this Act or any regulation issued by the Secretaries to implement this Act shall be liable for a penalty of not more than $25,000 per violation. Each day of violation may be deemed a separate violation for purposes of penalty assessments.</text></paragraph><paragraph id="HA0EDDCABE7F5419DAC64EDDE865AB8E1"><enum>(2)</enum><header>Failure to comply with a cessation order</header><text>A person who fails to correct a violation for which a cessation order has been issued under subsection (a) within the period permitted for its correction shall be assessed a civil penalty of not less than $1,000 per violation for each day during which such failure continues.</text></paragraph><paragraph id="H8EB37EFBD91D483289CFF39525FF39CF"><enum>(3)</enum><header>Penalties for directors, officers, and agents</header><text>Whenever a corporation is in violation of a requirement of a permit approved under this Act or any regulation issued by the Secretaries to implement this Act or fails or refuses to comply with an order issued under subsection (a), any director, officer, or agent of such corporation who knowingly authorized, ordered, or carried out such violation, failure, or refusal shall be subject to the same penalties as may be imposed upon the person referred to in paragraph (1).</text></paragraph></subsection><subsection id="H8031CDDD2F9A4D5381822BFE0AE31792"><enum>(e)</enum><header>Suspensions or revocations</header><text>The Secretary concerned shall suspend or revoke a permit issued under title II, in whole or in part, if the operator—</text><paragraph id="H82CE53237EBD4F81A840B771EFBBDEF0"><enum>(1)</enum><text>knowingly made or knowingly makes any false, inaccurate, or misleading material statement in any mining claim, notice of location, application, record, report, plan, or other document filed or required to be maintained under this Act;</text></paragraph><paragraph id="H3D617353E62C4A86BF3085BC478A2512"><enum>(2)</enum><text display-inline="yes-display-inline">fails to abate a violation covered by a cessation order issued under subsection (a);</text></paragraph><paragraph id="HFF577566292642B2AC733E9B80CE0FF7"><enum>(3)</enum><text>fails to comply with an order of the Secretary concerned;</text></paragraph><paragraph id="H8D4474C5C37A4990BA9F31C266778229"><enum>(4)</enum><text>refuses to permit an audit pursuant to this Act;</text></paragraph><paragraph id="H57226AF30E904A7BB8F964421ADA9094"><enum>(5)</enum><text display-inline="yes-display-inline">fails to maintain an adequate financial assurance under section 306;</text></paragraph><paragraph id="H0E614CAB94BE471E819DA8412C0B809C"><enum>(6)</enum><text>fails to pay claim maintenance fees, rentals, or other moneys due and owing under this Act; or</text></paragraph><paragraph id="HCEABC84867AD44ABB0769D9908597AD6"><enum>(7)</enum><text display-inline="yes-display-inline">with regard to plans conditionally approved under section 305(c)(2), fails to abate a violation to the satisfaction of the Secretary concerned, or if the validity of the violation is upheld on the appeal which formed the basis for the conditional approval.</text></paragraph></subsection><subsection id="H7098ADF11A3B4A199393560BF781135C"><enum>(f)</enum><header>False statements; tampering</header><text>Any person who knowingly—</text><paragraph id="HCA95ECCFEF9D4A069480942653AA816D"><enum>(1)</enum><text>makes any false material statement, representation, or certification in, or omits or conceals material information from, or unlawfully alters, any mining claim, notice of location, application, record, report, plan, or other documents filed or required to be maintained under this Act; or</text></paragraph><paragraph id="H29878F3C0E694DEB8FB9FD1EE4F535E0"><enum>(2)</enum><text>falsifies, tampers with, renders inaccurate, or fails to install any monitoring device or method required to be maintained under this Act,</text></paragraph><continuation-text continuation-text-level="subsection">shall upon conviction, be punished by a fine of not more than $10,000, or by imprisonment for not more than 2 years, or by both. If a conviction of a person is for a violation committed after a first conviction of such person under this subsection, punishment shall be by a fine of not more than $20,000 per day of violation, or by imprisonment of not more than 4 years, or both. Each day of continuing violation may be deemed a separate violation for purposes of penalty assessments. </continuation-text></subsection><subsection id="HD485F0C6D27949C9BE69B727CBF54B0B"><enum>(g)</enum><header>Knowing violations</header><text>Any person who knowingly—</text><paragraph id="H5E8709B214064E4D9552F46AE2DB4C2B"><enum>(1)</enum><text>engages in mineral activities without a permit required under title II; or</text></paragraph><paragraph id="HFDFD3571FB6D4ADF9ED3DEA744850CDA"><enum>(2)</enum><text display-inline="yes-display-inline">violates any other requirement of a permit issued under this Act, or any condition or limitation thereof,</text></paragraph><continuation-text continuation-text-level="subsection">shall upon conviction be punished by a fine of not less than $5,000 nor more than $50,000 per day of violation, or by imprisonment for not more than 3 years, or both. If a conviction of a person is for a violation committed after the first conviction of such person under this subsection, punishment shall be a fine of not less than $10,000 per day of violation, or by imprisonment of not more than 6 years, or both. </continuation-text></subsection><subsection id="HB467E887F26A496A904D3C9A4C1FB5D9"><enum>(h)</enum><header>Knowing and willful violations</header><text>Any person who knowingly and willfully commits an act for which a civil penalty is provided in paragraph (1) of subsection (g) shall, upon conviction, be punished by a fine of not more than $50,000, or by imprisonment for not more than 2 years, or both.</text></subsection><subsection id="H58C6DFA69DF643E29F2E6958555FA764"><enum>(i)</enum><header>Definition</header><text>For purposes of this section, the term <term>person</term> includes any officer, agent, or employee of a person.</text></subsection></section><section id="H10B78319E0FD4BEAA26BD7B80AFA5A69"><enum>508.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary and the Secretary of Agriculture shall issue such regulations as are necessary to implement this Act. The regulations implementing titles II and III and this title that affect the Forest Service shall be joint regulations issued by both Secretaries, and shall be issued not later than 180 days after the date of enactment of this Act.</text></section><section commented="no" id="H449A2B83AAC643F8BBB237C8F3DDB783"><enum>509.</enum><header>Oil shale claims</header><text display-inline="no-display-inline">Section 2511(f) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/30/242">30 U.S.C. 242(f)</external-xref>; <external-xref legal-doc="public-law" parsable-cite="pl/102/486">Public Law 102–486</external-xref>) is amended—</text><paragraph commented="no" id="HE58D0E71DD3840118E98926C5A9A2DF3"><enum>(1)</enum><text>by striking <quote>as prescribed by the Secretary</quote>; and</text></paragraph><paragraph commented="no" id="HBBAFAB6F663648B48A898341F2BFEDCA"><enum>(2)</enum><text>by inserting before the period the following: <quote>in the same manner as required by title II of the <short-title>Clean Energy Minerals Reform Act of 2022</short-title></quote>.</text></paragraph></section><section id="HCD1A78B431764B7195AF61A11F978134"><enum>510.</enum><header>Savings clause</header><subsection id="H846A90CB997F495BBC27FAA81EAB1ED0"><enum>(a)</enum><header>Special Application of mining laws</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed as repealing or modifying any Federal law, regulation, order, or land use plan, in effect prior to the date of enactment of this Act that prohibits or restricts the application of the general mining laws, including laws that provide for special management criteria for operations under the general mining laws as in effect prior to the date of enactment of this Act, to the extent such laws provide for protection of natural and cultural resources and the environment greater than required under this Act, and any such prior law shall remain in force and effect with respect to claims converted to leases under this Act. Nothing in this Act shall be construed as applying to or limiting mineral investigations, studies, or other mineral activities conducted by any Federal or State agency acting in its governmental capacity pursuant to other authority. Nothing in this Act shall affect or limit any assessment, investigation, evaluation, or listing pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>), or the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3251">42 U.S.C. 3251 et seq.</external-xref>).</text></subsection><subsection id="H5F3ABD2C754E4A0581871F48C3DEF2E7"><enum>(b)</enum><header>Effect on other Federal laws</header><paragraph id="HEDDE28944F1F43A2BB4A0F2A89A8AD8D" commented="no"><enum>(1)</enum><header>General mining laws</header><text>The provisions of this Act shall supersede the general mining laws.</text></paragraph><paragraph id="H1385655F8A964AFA9690F4B7E3825B42"><enum>(2)</enum><header>Other laws</header><text>Except for the general mining laws, nothing in this Act shall be construed as superseding, modifying, amending, or repealing any provision of Federal law not expressly superseded, modified, amended, or repealed by this Act.</text></paragraph><paragraph id="HE0E77549368549E68838CA7DAC1BA9A8"><enum>(3)</enum><header>Environmental laws</header><text>Nothing in this Act shall be construed as altering, affecting, amending, modifying, or changing, directly or indirectly, any law which refers to and provides authorities or responsibilities for, or is administered by, the Environmental Protection Agency or the Administrator of the Environmental Protection Agency, including—</text><subparagraph id="HD190720B37D74A1C853437EF0E45D72C"><enum>(A)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>);</text></subparagraph><subparagraph id="HEEE64A902CD94D5DAD5CBE5DFA75142D"><enum>(B)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); </text></subparagraph><subparagraph id="H69D0016A813B4B0EB05D507C27E56C43"><enum>(B)</enum><text>American Indian Religious Freedom Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1996">42 U.S.C. 1996</external-xref>);</text></subparagraph><subparagraph id="HC9C05B54B3C246C2AD8572BDAFF144F3"><enum>(C)</enum><text>the National Historic Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/470">16 U.S.C. 470 et seq.</external-xref>); or</text></subparagraph><subparagraph id="HD63AE24693B54E2984558992CE3E1B7F"><enum>(E)</enum><text display-inline="yes-display-inline">the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="HAE5136D9495E41149AE869AD8F9F0633"><enum>(c)</enum><header>Sovereign immunity of Indian Tribes</header><text display-inline="yes-display-inline">Nothing in this section shall be construed so as to waive the sovereign immunity of any Indian Tribe.</text></subsection></section><section id="H7B2FE9725951465DAA81358B04F26CD7"><enum>511.</enum><header>Availability of public records</header><text display-inline="no-display-inline">Copies of records, reports, inspection materials, or information obtained by the Secretary or the Secretary of Agriculture under this Act shall be made immediately available to the public, consistent with section 552 of title 5, United States Code, in central and sufficient locations in the county, multicounty, and State area of mineral activities or reclamation so that such items are conveniently available to residents in the area proposed or approved for mineral activities and on the internet.</text></section><section id="H94B84966102441D2A00BBF9BE31D9593"><enum>512.</enum><header>Miscellaneous powers</header><subsection id="HBFCA32D3411D45C888236531DB0EDCA7"><enum>(a)</enum><header>In general</header><text>In carrying out his or her duties under this Act, the Secretary concerned may conduct any investigation, inspection, or other inquiry necessary and appropriate and may conduct, after notice, any hearing or audit, necessary and appropriate to carrying out his or her duties.</text></subsection><subsection id="H817297C1998D49DB878C5F72F184DFBB"><enum>(b)</enum><header>Ancillary powers</header><text>In connection with any hearing, inquiry, investigation, or audit under this Act, the Secretary, or for National Forest System lands the Secretary of Agriculture, is authorized to take any of the following actions:</text><paragraph id="H0FB88C9CC3244112BC6625AF4607D832"><enum>(1)</enum><text>Require, by special or general order, any person to submit in writing such affidavits and answers to questions as the Secretary concerned may reasonably prescribe, which submission shall be made within such reasonable period and under oath or otherwise, as may be necessary.</text></paragraph><paragraph id="H2BCD567B4B3D477EB261BE1CE366F27F"><enum>(2)</enum><text>Administer oaths.</text></paragraph><paragraph id="H77F8A85646914B68B1E87B4251A90AA5"><enum>(3)</enum><text>Require by subpoena the attendance and testimony of witnesses and the production of all books, papers, records, documents, matter, and materials, as such Secretary may request.</text></paragraph><paragraph id="HFF71183BC510452B955649B6D939BE17"><enum>(4)</enum><text>Order testimony to be taken by deposition before any person who is designated by such Secretary and who has the power to administer oaths, and to compel testimony and the production of evidence in the same manner as authorized under paragraph (3) of this subsection.</text></paragraph><paragraph id="HB66FC8DF2B70430A9D9F2E510BEC2539"><enum>(5)</enum><text>Pay witnesses the same fees and mileage as are paid in like circumstances in the courts of the United States.</text></paragraph></subsection><subsection id="H1108E641DA104CDBB0F0F76B9311063E"><enum>(c)</enum><header>Enforcement</header><text>In cases of refusal to obey a subpoena served upon any person under this section, the district court of the United States for any district in which such person is found, resides, or transacts business, upon application by the Attorney General at the request of the Secretary concerned and after notice to such person, shall have jurisdiction to issue an order requiring such person to appear and produce documents before the Secretary concerned. Any failure to obey such order of the court may be punished by such court as contempt thereof and subject to a penalty of up to $10,000 a day.</text></subsection><subsection id="H124B58ABCFBC41A0B83F2AAC1BD7C200"><enum>(d)</enum><header>Entry and access</header><text>Without advance notice and upon presentation of appropriate credentials, the Secretary concerned or any authorized representative thereof—</text><paragraph id="H34755494A2004B718A2D9F7684B22175"><enum>(1)</enum><text display-inline="yes-display-inline">shall have the right of entry to, upon, or through the site of any claim, license, lease, mineral activities, or any premises in which any records required to be maintained under this Act are located;</text></paragraph><paragraph id="HE53924AC64EC4A45976F013F250BAE14"><enum>(2)</enum><text>may at reasonable times, and without delay, have access to records, inspect any monitoring equipment, or review any method of operation required under this Act;</text></paragraph><paragraph id="HEF51854286944131AEA218233065DA11"><enum>(3)</enum><text>may engage in any work and do all things necessary or expedient to implement and administer the provisions of this Act;</text></paragraph><paragraph id="HE9AD52FF689047D1A3F8E517B5407815"><enum>(4)</enum><text display-inline="yes-display-inline">may, on any mining claim, license, or lease maintained in compliance with this Act, and without advance notice, stop and inspect any motorized form of transportation that such Secretary has probable cause to believe is carrying hardrock minerals, concentrates, or products derived therefrom from a claim site for the purpose of determining whether the operator of such vehicle has documentation related to such hardrock minerals, concentrates, or products derived therefrom as required by law, if such documentation is required under this Act; and</text></paragraph><paragraph id="H6DC503156B6145ABB5103DAE6FF90FEE"><enum>(5)</enum><text>may, if accompanied by any appropriate law enforcement officer, or an appropriate law enforcement officer alone, stop and inspect any motorized form of transportation which is not on a claim site if he or she has probable cause to believe such vehicle is carrying hardrock minerals, concentrates, or products derived therefrom from a claim site, license, or lease on Federal lands or allocated to such claim site, license, or lease. Such inspection shall be for the purpose of determining whether the operator of such vehicle has the documentation required by law, if such documentation is required under this Act.</text></paragraph></subsection></section><section commented="no" id="H7B4BDE2346D94B37A87801E44BFB0723"><enum>513.</enum><header>Mineral materials</header><subsection commented="no" id="H58FED1CAC0C1444C9FEA7433651D8003"><enum>(a)</enum><header>Determinations</header><text>Section 3 of the Act of July 23, 1955 (<external-xref legal-doc="usc" parsable-cite="usc/30/611">30 U.S.C. 611</external-xref>), is amended—</text><paragraph id="H4271843A97B44C0A8F979995B9A77ED0"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="section" style="OLC">or cinders</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">cinders, and clay</header-in-text></quote>; </text></paragraph><paragraph commented="no" id="H2D570A324B4D4ACA9C9FAB693989EFE7"><enum>(2)</enum><text>by striking <quote>No</quote> and inserting <quote>(a) No</quote>; </text></paragraph><paragraph commented="no" id="HC256EF81A4274A298FAF51343AE667E7"><enum>(3)</enum><text>by inserting <quote>mineral materials, including</quote> after <quote>varieties of</quote>;</text></paragraph><paragraph commented="no" id="H5BB4127433E64762A85E22A433E07C25"><enum>(4)</enum><text>by striking <quote>or cinders</quote> and inserting <quote>cinders, and clay</quote>; and</text></paragraph><paragraph commented="no" id="H257C4E89FF0147748193A44B0E07715B"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block id="HA61FCE7A333D47B898A7A7A03144525D" style="OLC"><subsection commented="no" id="H6096C10731FC4705B3B4DEDE3A163695"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H0805B27FFE94461482B2C0EACF45867A"><enum>(1)</enum><text>Subject to valid existing rights, after the date of enactment of the <short-title>Clean Energy Minerals Reform Act of 2022</short-title>, notwithstanding the reference to common varieties in subsection (a) and to the exception to such term relating to a deposit of materials with some property giving it distinct and special value, all deposits of mineral materials referred to in such subsection, including the block pumice referred to in such subsection, shall be subject to disposal only under the terms and conditions of the Materials Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/30/601">30 U.S.C. 601–603</external-xref>).</text></paragraph><paragraph commented="no" id="HA6104A00B533483BAC75D523A711B3BA" indent="up1"><enum>(2)</enum><text>For purposes of paragraph (1), the term <term>valid existing rights</term> means that a mining claim located for any such mineral material—</text><subparagraph commented="no" id="H5DF3EFC55E5C4C2B8D5B64452C077F7A"><enum>(A)</enum><text>had and still has some property giving it the distinct and special value referred to in subsection (a), or as the case may be, met the definition of block pumice referred to in such subsection;</text></subparagraph><subparagraph commented="no" id="H2318073595084E6394D65E93AAB4D6BC"><enum>(B)</enum><text>was properly located and maintained under the general mining laws prior to the date of enactment of the <short-title>Clean Energy Minerals Reform Act of 2022</short-title>; and</text></subparagraph><subparagraph commented="no" id="H9D177C0DACE84108895D122CD56B4B15"><enum>(C)</enum><text>was supported by a discovery of a valuable mineral deposit within the meaning of the general mining laws as in effect immediately prior to the date of enactment of the <short-title>Clean Energy Minerals Reform Act of 2022</short-title>.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H5DF9FD8D33E5433CA20784141AA629BD"><enum>(b)</enum><header>Mineral materials disposal clarification</header><text>Section 4 of the Act of July 23, 1955 (<external-xref legal-doc="usc" parsable-cite="usc/30/612">30 U.S.C. 612</external-xref>), is amended—</text><paragraph commented="no" id="HC7140024CC7C4B24ABE2820DE0B0AA17"><enum>(1)</enum><text>in subsection (b) by inserting <quote>and mineral material</quote> after <quote>vegetative</quote>; and</text></paragraph><paragraph commented="no" id="HE90F1696056F4172954276AFDAF6FAD7"><enum>(2)</enum><text>in subsection (c) by inserting <quote>and mineral material</quote> after <quote>vegetative</quote>.</text></paragraph></subsection><subsection commented="no" id="H7FA6EE2E2ED84368AD8122EFF66AD9EA"><enum>(c)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 1 of the Act of July 31, 1947, entitled <quote>An Act to provide for the disposal of materials on the public lands of the United States</quote> (<external-xref legal-doc="usc" parsable-cite="usc/30/601">30 U.S.C. 601 et seq.</external-xref>) is amended by striking <quote>common varieties of</quote> in the first sentence.</text></subsection><subsection commented="no" id="H23C5756389B84B2897B541BDADAE4045"><enum>(d)</enum><header>Short titles</header><paragraph commented="no" id="H30510DDA16854674B9BA28172953B2E0"><enum>(1)</enum><header>Surface resources</header><text>The Act of July 23, 1955, is amended by inserting after section 7 the following new section:</text><quoted-block id="H6616CDCE6D2344DD9595E677D046F468" style="traditional"><section commented="no" id="H8E11B3FE287C407A969B9807E41A7AF8"><enum>8.</enum><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Surface Resources Act of 1955</short-title></quote>.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H68DC34CFEE5744CAA4B98DFBC08F5F9D"><enum>(2)</enum><header>Mineral materials</header><text display-inline="yes-display-inline">The Act of July 31, 1947, entitled <quote>An Act to provide for the disposal of materials on the public lands of the United States</quote> (<external-xref legal-doc="usc" parsable-cite="usc/30/601">30 U.S.C. 601 et seq.</external-xref>) is amended by inserting after section 4 the following new section:</text><quoted-block id="HB8599F5368084345A0C50B66211B1B8A" style="traditional"><section commented="no" id="H5C2A3C99A6A3417883BFA0FA7CE2B56A"><enum>5.</enum><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Materials Act of 1947</short-title></quote>.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H039178B76AB74EBF851EE1D1E684D84B"><enum>(e)</enum><header>Repeals</header><paragraph commented="no" display-inline="yes-display-inline" id="H136BD49BFA8F426ABF643AEC454716F6"><enum>(1)</enum><text>Subject to valid existing rights, the Act of August 4, 1892 (chapter 375; 27 Stat. 348; <external-xref legal-doc="usc" parsable-cite="usc/30/161">30 U.S.C. 161</external-xref>), commonly known as the Building Stone Act, is hereby repealed.</text></paragraph><paragraph commented="no" id="H8614D94D84994671B8F8B2B47264BBDD" indent="up1"><enum>(2)</enum><text>Subject to valid existing rights, the Act of January 31, 1901 (chapter 186; 31 Stat. 745; <external-xref legal-doc="usc" parsable-cite="usc/30/162">30 U.S.C. 162</external-xref>), commonly known as the Saline Placer Act, is hereby repealed.</text></paragraph></subsection></section><section id="H25B3CCC635574676A0BD6AC862AA4EC5"><enum>514.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act shall take effect on the date of enactment of this Act, except as otherwise provided in this Act.</text></section></title></legis-body></bill>
