which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To improve State, local, and Tribal public health security.</official-title></form><legis-body id="HDDD763EC9A1B4C0C8106FBAF4B3384CA" style="OLC"><section section-type="section-one" id="H36937D977C054EA9B88C9B2807A90AE9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>CDC Tribal Public Health Security and Preparedness Act</short-title></quote>.</text></section><section id="H620B6E27416B4192B31A6D689ACA2DA3"><enum>2.</enum><header>Improving State, local, and Tribal public health security</header><text display-inline="no-display-inline">Section 319C–1 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-3a">42 U.S.C. 247d–3a</external-xref>) is amended—</text><paragraph id="H8FD6C7935392467CB3D4B21BD1A25D11"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">and local</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">, local, and Tribal</header-in-text></quote>;</text></paragraph><paragraph id="HC18AF3058E2F4E728D6016A7855331EE"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HB7C923F9CB7D411897F1D1A0687B2190"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H686D8CAD525B4B03ACD73EF2365FB848"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>or</quote> at the end;</text></clause><clause id="H26002B8AB4DF40A6912B0247754F3BB8"><enum>(ii)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end and inserting <quote>or</quote>; and</text></clause><clause id="H7B333C22653041AEB3D03BEDD5296871"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6A2D491872BA4CDFB506D46552F1BCC7"><subparagraph id="H0E7D78387D53427DB798E6E495A8A124" indent="up1"><enum>(D)</enum><text>be an Indian Tribe, a Tribal organization, or a consortium of Indian Tribes or Tribal organizations; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H6B16FEAEC35947FB88667BCFC1C73EFC"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="HA80A256A664B4984B790761B232DAF71"><enum>(i)</enum><text>in subparagraph (A)(viii)—</text><subclause id="H3104D2F035D34985A5E37F749B0EEDBA"><enum>(I)</enum><text>by inserting <quote>and Tribal</quote> after <quote>with State</quote>;</text></subclause><subclause id="H02AB9875750B4A29B9B20A4042D7A555"><enum>(II)</enum><text>by striking <quote>(as defined in section 8101 of the Elementary and Secondary Education Act of 1965)</quote> and inserting <quote>and Tribal educational agencies (as defined in sections 8101 and 6132, respectively, of the Elementary and Secondary Education Act of 1965)</quote>; and</text></subclause><subclause id="H9B8F55B45FE74A0C9662219F26618CD5"><enum>(III)</enum><text>by inserting <quote>and Tribal</quote> after <quote>and State</quote>;</text></subclause></clause><clause id="H77414050799441E18C955E7423153C0C"><enum>(ii)</enum><text>in subparagraph (G), by inserting <quote>(including Tribes, Tribal organizations, and urban Indian organizations)</quote> after <quote>stakeholders</quote>; and</text></clause><clause id="H867C4AE0E9F640778748B027EF513431"><enum>(iii)</enum><text>in subparagraph (H), by inserting <quote>, Indian Tribes, and urban Indian organizations</quote> after <quote>public health</quote>; </text></clause></subparagraph></paragraph><paragraph id="HD5C8F2B74CA747DC89D20B19A0BEDAF0"><enum>(3)</enum><text>in subsection (e), by inserting <quote>Indian Tribes, Tribal organizations, urban Indian organizations,</quote> after <quote>local emergency plans,</quote>;</text></paragraph><paragraph id="H84703B5BCD3744C5A8D5A56A09067591"><enum>(4)</enum><text>in subsection (h)—</text><subparagraph id="H19AD4DEF1AC74EFEBB2941615E9BD92B"><enum>(A)</enum><text>in paragraph (1)(A), by striking <quote>$685,000,000 for each of fiscal years 2019 through 2023 for awards pursuant to paragraph (3) (subject to the authority of the Secretary to make awards pursuant to paragraphs (4) and (5))</quote> and inserting <quote>$750,000,000 for each of fiscal years 2023 through 2025 for awards pursuant to paragraph (3) (subject to the authority of the Secretary to make awards pursuant to paragraphs (4) and (5)) and paragraph (8), of which not less than 5 percent shall be reserved each fiscal year for awards under paragraph (8)</quote>;</text></subparagraph><subparagraph id="H0B841AFDCED541DDA43415520C82C18C"><enum>(B)</enum><text>in the heading of paragraph (3), by inserting <quote><header-in-text level="paragraph" style="OLC">for States</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">amount</header-in-text></quote>; and</text></subparagraph><subparagraph id="H9D8F004C53CE4B73855D37DF7842A7E3"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H51D9E3D5C2E144CB814B1F9B2129F098"><paragraph id="H3F2445A25B914104A6C2C00B4A6ED7CF"><enum>(8)</enum><header>Tribal eligible entities</header><subparagraph id="HD382912307544C80B032F9087B0DF4F1"><enum>(A)</enum><header>Determination of funding amount</header><clause id="H62A6753487A647E692663DF2BB4A3B51"><enum>(i)</enum><header>In general</header><text>The Secretary shall award at least 10 cooperative agreements under this section, in amounts not less than the minimum amount determined under clause (ii), to eligible entities described in subsection (b)(1)(D) that submit to the Secretary an application that meets the criteria of the Secretary for the receipt of such an award and that meets other reasonable implementation conditions established by the Secretary, in consultation with Indian Tribes, for such awards. </text></clause><clause commented="no" id="H53D97A1388644E3CA833461CC562CCEB"><enum>(ii)</enum><header>Minimum amount</header><text>In determining the minimum amount of an award pursuant to clause (i), the Secretary, in consultation with Indian Tribes, shall first determine an amount the Secretary considers appropriate for the eligible entity.</text></clause></subparagraph><subparagraph id="H245FE0C19C4446C7A31A7989720A6C5C"><enum>(B)</enum><header>Available until expended</header><text>Amounts provided to a Tribal eligible entity under a cooperative agreement under this section for a fiscal year and remaining unobligated at the end of such year shall remain available to such entity during the entirety of the performance period, for the purposes for which said funds were provided. </text></subparagraph><subparagraph id="H6CC8A37E81A04E3D998BCE3B6A28525C"><enum>(C)</enum><header>No matching requirement</header><text>Subparagraphs (B) and (C) of paragraph (1) shall not apply with respect to cooperative agreements awarded under this section to eligible entities described in subsection (b)(1)(D).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H807C0C14CC50489393BD790DB7B82185"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4E851A702E8740CAA26128AC6EB21F5B"><subsection id="H7C968D349091465AA8D156F7F3E9D7A7"><enum>(l)</enum><header>Special rules related to tribal eligible entities</header><paragraph id="H86EDDD347B184DD894857DBB0404531C"><enum>(1)</enum><header>Modifications</header><text>After consultation with Indian Tribes, the Secretary may make necessary and appropriate modifications to the program under subsections (b)(2), (g), and (i) to facilitate the use of the cooperative agreement program by eligible entities described in subsection (b)(1)(D). </text></paragraph><paragraph id="HDBB3384B687D45249CB7C623DD5E79A4"><enum>(2)</enum><header>Waivers</header><subparagraph id="HD2D655912730444097DC450A789FDE59"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Secretary shall waive or specify alternative requirements for any provision of this section (including regulations) that the Secretary administers in connection with this section if the Secretary, after consultation with Indian Tribes, finds that the waiver or alternative requirement is appropriate for the effective delivery and administration of this program with respect to eligible entities described in subsection (b)(1)(D). </text></subparagraph><subparagraph id="HD17FF83BA0B2487BB434129EE7546F65"><enum>(B)</enum><header>Exception</header><text>The Secretary may not waive or specify alternative requirements under subparagraph (A) relating to labor standards or the environment. </text></subparagraph></paragraph><paragraph id="HFE9076ADB38B42F283B44F01BECE477D"><enum>(3)</enum><header>Consultation</header><text>The Secretary shall consult with Indian Tribes and Tribal organizations on the design of this program with respect to such Tribes and organizations to ensure the effectiveness of the program in enhancing the security of Indian Tribes with respect to public health emergencies.</text></paragraph><paragraph id="H2E729BAFFC6F4D2E8F27F1EDE522E109"><enum>(4)</enum><header>Reporting</header><subparagraph id="H589BE58DC1EC4DAF9F25AD2679ADBDBC"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this subsection, and as an addendum to the biennial evaluations required under subsection (k), the Secretary, in coordination with the Director of the Indian Health Service, shall—</text><clause id="H6EEF8C5DEF4944E5B6E6583B4869B1FC"><enum>(i)</enum><text>conduct a review of the implementation of this section with respect to eligible entities described in subsection (b)(1)(D), including any factors that may have limited its success; </text></clause><clause id="HBAC486829C564CFA9B7935B8F50A992A"><enum>(ii)</enum><text>compile a report containing—</text><subclause id="H60D2C70E35DD42E8B588F6A08D33DD74"><enum>(I)</enum><text>a description of the results of the review described in clause (i);</text></subclause><subclause id="H7841CEFAAA0F40C8A3D432BE2E0E5747"><enum>(II)</enum><text>a breakdown of the eligible entities described in subsection (b)(1)(D) that—</text><item id="H6AC4BB1DE25D47B894F9BDC2670C23DF"><enum>(aa)</enum><text>received an award under this section;</text></item><item id="H87BDE7CA959C451585938B325EE0DF92"><enum>(bb)</enum><text>received an award under this section and a waiver as described in paragraph (2); and</text></item><item id="H00B489438B0543B4830C217CB3623A27"><enum>(cc)</enum><text>applied under this section but did not receive an award;</text></item></subclause><subclause id="HE81DBB6221ED41D28185F5D5B561686B"><enum>(III)</enum><text>a list of any waived or alternative requirements of this section and the reasoning for issuing a waiver or alternative requirement; and</text></subclause><subclause id="H9DCEAB65CFE24BE48FEBB51F991CEF91"><enum>(IV)</enum><text>recommendations to the Congress for program modifications necessary to improve the implementation of the program with respect to eligible entities described in subsection (b)(1)(D); and</text></subclause></clause><clause id="H9207504F0A374C7E80B123B1F1447D4B"><enum>(iii)</enum><text display-inline="yes-display-inline">submit the report described in clause (ii) to—</text><subclause id="H885DD4347C8741A98FBF2B366FB982BD"><enum>(I)</enum><text>the Committee on Indian Affairs, the Committee on Health, Education, Labor, and Pensions, and the Committee on Appropriations of the Senate; and</text></subclause><subclause id="H0232332929B449EFB608C8CF6CA017B7"><enum>(II)</enum><text>the Subcommittee on Indigenous People of the Committee on Natural Resources, the Committee on Energy and Commerce, and the Committee on Appropriations of the House of Representatives. </text></subclause></clause></subparagraph><subparagraph id="H8315FCA1057E4193AAA5D93C5B9DC32C"><enum>(B)</enum><header>Analysis of Tribal public health emergency infrastructure limitation</header><text>The Secretary shall include in the initial report submitted under subparagraph (A) a description of any public health emergency infrastructure limitation encountered by eligible entities described in subsection (b)(1)(D).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
