R. 755</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210203">February 3, 2021</action-date><action-desc><sponsor name-id="G000595">Mr. Good of Virginia</sponsor> (for himself, <cosponsor name-id="B001299">Mr. Banks</cosponsor>, <cosponsor name-id="B000825">Mrs. Boebert</cosponsor>, <cosponsor name-id="G000578">Mr. Gaetz</cosponsor>, and <cosponsor name-id="M001212">Mr. Moore of Alabama</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Social Security Act to require a certification that States and units of local governments will not impact the operations of a small business concern to receive funds from the Coronavirus Relief Fund, and for other purposes.</official-title></form><legis-body id="H88B841126F514259B6E1CD0B79C48641" style="OLC"><section id="H2B2250092C9346659328BC5BFF5208DA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Right to Earn a Living Act of 2021</short-title></quote>.</text></section><section id="H826B433BA7314B0D989F48A81218FF84"><enum>2.</enum><header>Certification to receive funds from coronavirus relief fund</header><text display-inline="no-display-inline">Section 601 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/801">42 U.S.C. 801</external-xref>) is amended—</text><paragraph id="HDA4CD804988147B8AD4B162CEC82BDFC"><enum>(1)</enum><text>by redesignating subsections (f) and (g) as subsections (g) and (h), respectively;</text></paragraph><paragraph id="H39F1D31F8AA54727A250E66E9BD1F14B"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (e) the following new subsection:</text><quoted-block style="OLC" id="HD66A661EF1E24D99A0575F6F1B67A139" display-inline="no-display-inline"><subsection id="H96D2D77F49294651842E27AB2CCF6B19"><enum>(f)</enum><header>Certification requirement To keep small business concerns open</header><paragraph id="HDA7EE9FE12964EEBAF01045CDD1778DC"><enum>(1)</enum><header>In general</header><text>In order to receive a payment under this section, a State or unit of local government shall provide the Secretary with a certification signed by the Chief Executive of such State or unit of local government that such Chief Executive shall not implement an order, without legislative action by the State or unit of local government, that—</text><subparagraph id="H5AD1496EF4BC49EBA81E888753F69A32"><enum>(A)</enum><text>prevents a small business concern from operating; or </text></subparagraph><subparagraph id="H8978B61407CC406FA1C5F887BC123279"><enum>(B)</enum><text>places limitations on the hours or occupancy of a small business concern. </text></subparagraph></paragraph><paragraph id="HFB9679474AA74E8D9658485FD55E81E3"><enum>(2)</enum><header>Applicability</header><text display-inline="yes-display-inline">The certification required under paragraph (1) shall apply to any receipt of funds after the date of the enactment of the <quote>Right to Earn a Living Act of 2021</quote>. </text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H63A99CC60A754B97932092C759031A55"><enum>(3)</enum><text>in subsection (h), as redesignated by paragraph (1), by inserting the following new paragraph: </text><quoted-block style="OLC" id="H506E3755713045EA97C318FDBCCB6973" display-inline="no-display-inline"><paragraph id="H13AE7184B6F8457C89F9EC4EC944592C"><enum>(6)</enum><header>Small business concern</header><text display-inline="yes-display-inline">The term <quote>small business concern</quote> has the meaning given such term under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>). </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
