R. 754</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210203">February 3, 2021</action-date><action-desc><sponsor name-id="G000595">Mr. Good of Virginia</sponsor> (for himself, <cosponsor name-id="L000564">Mr. Lamborn</cosponsor>, <cosponsor name-id="B000825">Mrs. Boebert</cosponsor>, <cosponsor name-id="G000578">Mr. Gaetz</cosponsor>, <cosponsor name-id="R000103">Mr. Rosendale</cosponsor>, <cosponsor name-id="M001195">Mr. Mooney</cosponsor>, and <cosponsor name-id="M001212">Mr. Moore of Alabama</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prevent States and local jurisdictions from interfering with services held at houses of worship, and for other purposes.</official-title></form><legis-body id="HAD0C12AC48A14802BDCCA791C2FC5C41" style="OLC"><section id="H9CF5E5E9FB8043BF9014AF8FCB596BBF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Religion from Government Act of 2021</short-title></quote>.</text></section><section id="HC5EA8F09C2D743FDAB89147F378542A8"><enum>2.</enum><header>Prohibition against interference by State and local governments with services held at houses of worship</header><text display-inline="no-display-inline">Consistent with First Amendment to the Constitution of the United States, the government of a State or locality therein may not impose any law or regulation limiting the ability for any house of worship to hold any religious service or celebrate any religious ceremony in person as such house of worship determines is appropriate.</text></section><section id="H55F8DAC2DDD54F3F87E6E6EC088A0ABE"><enum>3.</enum><header>Federal cause of action to challenge State and local regulation of interstate commerce</header><subsection id="HFC795F60E871497A852ABA23C4082DEC"><enum>(a)</enum><header>Private right of action</header><text>A person, including an individual or religious institution, affected by a law or regulation of a State or unit of local government limiting the ability for any house of worship to hold services in person may bring an action in the appropriate district court to invalidate such a law or regulation.</text></subsection><subsection id="HADC80557DA7D40CDB0BEE4BA296FE953"><enum>(b)</enum><header>Preliminary injunction</header><text>Upon a motion of the plaintiff described in subsection (a), the court shall issue a preliminary injunction to preclude the State or unit of local government from enforcing the law or regulation at issue until such time as the court enters a final judgment in the case, unless the State or unit of local government proves by clear and convincing evidence that—</text><paragraph id="H6A9B5E7EC665456E9E76C5C34C92C7F8"><enum>(1)</enum><text>the State or unit of local government is likely to prevail on the merits at trial; and</text></paragraph><paragraph id="H50290BEF080C4C7DABFF6DBAEA084E7F"><enum>(2)</enum><text>the injunction would cause irreparable harm to the State or unit of local government.</text></paragraph></subsection><subsection id="HC0A8FA800A624A26A04C1C7FC994E623"><enum>(c)</enum><header>Statute of limitations</header><text>No action shall be maintained under this section unless it is commenced within 10 years after the cause of action arose.</text></subsection></section></legis-body></bill>
