Maloney of New York</cosponsor>, and <cosponsor name-id="C001068">Mr. Cohen</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to require that certain rotorcraft manufactured before April 5, 2020, comply with requirements relating to fuel system crash resistance, and for other purposes.</official-title></form><legis-body id="H2974FBA633084EE39D55216F20717653" style="OLC"><section id="HA8196930B8DC4933A550C1212E661B42" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helicopter Passenger Protection Act</short-title></quote>.</text></section><section id="HC5CC99163E2B4F2FA0755292F91FCCC8" section-type="subsequent-section"><enum>2.</enum><header>Helicopter fuel system safety</header><text display-inline="no-display-inline">Section 44737 of title 49, United States Code, is amended—</text><paragraph id="H8400C710722844E5884457008C20022D"><enum>(1)</enum><text>in subsection (a)(2) by striking <quote>the date that is 18 months after the date of enactment of this section</quote> and inserting <quote>April 5, 2020</quote>; </text></paragraph><paragraph id="H88626080493A4E33875CF6650B8C0B4A"><enum>(2)</enum><text>by redesignating subsections (b) and (c) as subsections (c) and (d), respectively; and</text></paragraph><paragraph id="HCE0281A2331F4468BA38D140045E3E00"><enum>(3)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="USC" id="HC90AEA2A5EFC42EEA3A409DE8F38D6B5" display-inline="no-display-inline"><subsection id="H88E1F9E434B14DFC9DC0E8F8955D1620"><enum>(b)</enum><header>Prohibition for rotorcraft manufactured before April 5, 2020</header><paragraph id="HB43EB7ADDB5C4D3E8112596952871417"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 5 years after the date of enactment of this subsection, a person may not operate in United States airspace a rotorcraft manufactured before April 5, 2020, for which the Administrator of the Federal Aviation Administration has issued a standard airworthiness certificate, unless such rotorcraft includes a fuel system that is certified by the Administrator to—</text><subparagraph id="H006BEEBB400F45E38C66D53BD2E77548"><enum>(A)</enum><text display-inline="yes-display-inline">comply with the requirements applicable to the category of the rotorcraft under paragraphs (1), (2), (3), (5), and (6) of section 27.952(a), section 27.952(f), and section 27.963(g) (but allowing for a minimum puncture force of 250 pounds) or paragraphs (1), (2), (3), (5), and (6) of section 29.952(a), section 29.952(f), and section 29.963(b) (but allowing for a minimum puncture force of 250 pounds) of title 14, Code of Federal Regulations, as in effect on the date of enactment of this subsection; or</text></subparagraph><subparagraph id="HD8DA15A0E2554E87AEF206DA8C4DC9F5"><enum>(B)</enum><text>employ other means acceptable to the Administrator to provide an equivalent level of fuel system crash resistance.</text></subparagraph></paragraph><paragraph id="H1239B414AC55413585EE70174CE15B23"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">This subsection shall not apply to an unmanned aircraft that does not carry any occupants. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H8BB3D7C76138436F933CB59FBC161854"><enum>3.</enum><header>Credit for improving safety of fuel systems in rotorcraft</header><subsection id="HD522BC924E8044C685299A1B350BE608"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart B of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 30D the following new section:</text><quoted-block style="OLC" id="H1961CBAC19E94DD196EBB0DC131F3308" display-inline="no-display-inline"><section id="HEC6D45F796CE4AFC9DC17EDCB7ED829B"><enum>30E.</enum><header>Improving safety of fuel systems in rotorcraft</header><subsection id="H641BCF65BA354E96A56532463D2BC138"><enum>(a)</enum><header>In general</header><text>There shall be allowed as a credit against the tax imposed by this chapter for the taxable year an amount equal to 10 percent of the qualified fuel system improvement costs which are paid or incurred by the taxpayer during the taxable year.</text></subsection><subsection id="H4B46374850E64BE599D93065C6856A1B"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section—</text><paragraph id="H857E33B4A5AB45AB80E2AB4C30C4D246"><enum>(1)</enum><header>Qualified fuel system improvement costs</header><text>The term <quote>qualified fuel system improvement costs</quote> means costs paid or incurred to make qualified changes to a fuel system in a rotorcraft that did not, before such changes, meet the requirements described in paragraph (2)(A).</text></paragraph><paragraph id="HF8C51F6842E9428AA2D31EBC3808DEAD"><enum>(2)</enum><header>Qualified changes</header><text>The term <quote>qualified changes</quote> means—</text><subparagraph id="HFBDC95A204FF47B19BE38884E03B001B"><enum>(A)</enum><text>changes necessary to make a fuel system compliant with the requirements under—</text><clause id="HC33E25D5548C4DA68A35348F3B7817B3"><enum>(i)</enum><text>paragraphs (1), (2), (3), (5), and (6) of section 27.952(a), section 27.952(c), section 27.952(f), section 27.952(g), section 27.963(g) (but allowing for a minimum puncture force of 250 pounds if successfully drop tested in-structure), and section 27.975(b) of title 14, Code of Federal Regulations as in effect on the date of enactment of this section, or</text></clause><clause id="H785AA4A39CF04DE79751FBE5C80FCDAA"><enum>(ii)</enum><text>paragraphs (1), (2), (3), (5), and (6) of section 29.952(a), section 29.952(c), section 29.952(f), section 29.952(g), section 29.963(b) (but allowing for a minimum puncture force of 250 pounds if successfully drop tested in-structure), and 29.975(a)(7) of such title as so in effect, and</text></clause></subparagraph><subparagraph id="HA42C4894704A40A78DC3A755A9762624"><enum>(B)</enum><text>such changes as the Secretary determines are necessary to result in a fuel system that has equivalent crash resistance to a fuel system compliant with the requirements under clause (i) or (ii) of subparagraph (A).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB57AC4853CEB46DCA92C0AD8156A7F17"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for such subpart A is amended by inserting after the item relating to section 30D the following new item:</text><quoted-block style="OLC" id="H1200658E77C84530ABF99BE6FCF083D3" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 30E. Improving safety of fuel systems in rotorcraft.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0A8BCC048D1D4DB19121E48623D857C1"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2022.</text></subsection></section></legis-body></bill>
