<section id="H02DAD2423330470E9D016F52ADEB1729" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Cost of Mental Illness Act of 2022</short-title></quote>.</text></section> <section id="H6E4DF3DFB4A14CD384B530EB920CC8DB"><enum>2.</enum><header>Study on the costs of serious mental illness</header> <subsection id="H158D260F7A544175A11D487A5F5C6740"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Health and Human Services, in consultation with the Assistant Secretary for Planning and Evaluation, the Attorney General of the United States, the Secretary of Labor, and the Secretary of Housing and Urban Development, shall conduct a study on the direct and indirect costs of serious mental illness with respect to—</text> 
<paragraph id="H23058F04F0B74F8CAFD61F564C01E1E9"><enum>(1)</enum><text>nongovernmental entities; and</text></paragraph> <paragraph id="H734E6FBE5631456291061620F1239CE0"><enum>(2)</enum><text>the Federal Government and State, local, and Tribal governments.</text></paragraph></subsection> 
<subsection id="H419F7494326D4104A1CDBD5FBC08072B"><enum>(b)</enum><header>Content</header><text display-inline="yes-display-inline">The study under subsection (a) shall consider each of the following:</text> <paragraph id="H6755AF64394748B68BEB6149848385CA"><enum>(1)</enum><text display-inline="yes-display-inline">The costs of the health care system for all facilities and health services, including—</text> 
<subparagraph id="H03C0C8677ABE4679BA3FF01D1BBFFD64"><enum>(A)</enum><text>public and private inpatient hospitals, outpatient health care, and home health care;</text></subparagraph> <subparagraph id="H6FBAA166B51742AD8CBDED3ACA704259"><enum>(B)</enum><text>office-based physician visits;</text></subparagraph> 
<subparagraph id="H01E42533C968442A8854D1EDC08F041E"><enum>(C)</enum><text>prescription drugs and digital therapeutics;</text></subparagraph> <subparagraph id="HA277E96C1A1240528E20DC1E5ED4A07B"><enum>(D)</enum><text>emergency room visits;</text></subparagraph> 
<subparagraph id="H50331C7878B64692978DA181046A355D"><enum>(E)</enum><text>substance use treatment;</text></subparagraph> <subparagraph id="HE8A847FA66D14B74B156B4C5C88C95FF"><enum>(F)</enum><text display-inline="yes-display-inline">skilled nursing and long-term care facilities for residential, custodial, and general health care;</text></subparagraph> 
<subparagraph id="H4F9C31C3D6DC4F93A81CA72E8F471BE4"><enum>(G)</enum><text>with respect to the costs described in subparagraphs (A) through (F), out-of-pocket costs and costs for different types of behavioral health and psychiatric illness; and</text></subparagraph> <subparagraph id="H23239A425C7047C399A40D627135CDFC"><enum>(H)</enum><text>other professional health services.</text></subparagraph></paragraph> 
<paragraph id="HF64D7B0C7A98401287F0E14E63605117"><enum>(2)</enum><text display-inline="yes-display-inline">The costs of homelessness, including—</text> <subparagraph id="HE3D5C0EB387F442197F825CCC0F58A66"><enum>(A)</enum><text>homeless shelters;</text></subparagraph> 
<subparagraph id="HB0E9773710EF4764B65A5DAA4B2DED1F"><enum>(B)</enum><text>street outreach activities;</text></subparagraph> <subparagraph id="H9B5EFACC8DAF48F6B1A3CB22E4ABD801"><enum>(C)</enum><text>crisis response center visits; and</text></subparagraph> 
<subparagraph id="H8CCB719C17224BBF9EA531A2F9DB1AF4"><enum>(D)</enum><text>other supportive services.</text></subparagraph></paragraph> <paragraph id="H27B5C962588A45C1935B20D8E530CF50"><enum>(3)</enum><text display-inline="yes-display-inline">The costs of structured residential facilities and other supportive housing for residential and custodial care services.</text></paragraph> 
<paragraph id="HDBB41F3D432B4A599F4FF82F2FADE8CE"><enum>(4)</enum><text display-inline="yes-display-inline">The costs of law enforcement encounters and encounters with the criminal justice system, including—</text> <subparagraph id="H082138EC3B594B7DB582A43956AD6006"><enum>(A)</enum><text>encounters that do and do not result in an arrest;</text></subparagraph> 
<subparagraph id="HB1E96A64EA9C48BA9D15E5119644FA74"><enum>(B)</enum><text>investigating a crime and judicial proceedings, including the process of sentencing;</text></subparagraph> <subparagraph id="HBAC12376A01F4F27A4EDA51B04B62A86"><enum>(C)</enum><text>services provided by police officers, sheriff deputies, police departments and sheriff offices, and judicial staff (including public defenders, prosecutors, and private attorneys);</text></subparagraph> 
<subparagraph id="H9DC97719A5B54C4093C45F70A6EADD3E"><enum>(D)</enum><text>services provided by public institutions (including local and county jails, State prisons, and paid legal guardians);</text></subparagraph> <subparagraph id="H832A120BBE744405975DBF35C737F912"><enum>(E)</enum><text display-inline="yes-display-inline">public safety costs to transport an individual with a serious mental illness to receive mental health or substance use treatment services or be incarcerated (including vehicle miles and personnel expenses);</text></subparagraph> 
<subparagraph id="HC3CE6B0107904BB184DD145281E2E825"><enum>(F)</enum><text display-inline="yes-display-inline">with respect to inmates with a serious mental illness, incarceration costs in Federal prison, State prison, and local jails (including residential, custodial, and on-site and off-site health care); and</text></subparagraph> <subparagraph id="H80A301FE6B8C4F71B32EC532F6B7C7CF"><enum>(G)</enum><text>solitary confinement, security, and other similar costs.</text></subparagraph></paragraph> 
<paragraph id="H7A2E93AEEF7142AAA5EB5FC76E4E8560"><enum>(5)</enum><text display-inline="yes-display-inline">The costs of addressing serious mental illness as a disability in the workplace, including—</text> <subparagraph id="H050B497F04914E48B892392673B185BD"><enum>(A)</enum><text>reduced wages for individuals with a serious mental illness who are employed; and</text></subparagraph> 
<subparagraph id="HB57901C7F5DF47CDA81059445F68DA93" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the estimated costs attributable to—</text> <clause id="H6ECE8E4FBB1C4EBEA33365BAEEB57DE8" commented="no"><enum>(i)</enum><text>the nationwide unemployment rate for individuals with a serious mental illness;</text></clause> 
<clause id="H03FEB933DB3B435783B0C31DD1370A74" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">benefits payable on the basis of disability to individuals with a serious mental illness—</text> <subclause id="H80A154A690AD4B85845379C2867CC43F" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">under title II or XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>, 1381 et seq.); or</text></subclause> 
<subclause id="H788A4F73C90C41F38F771B287FDE65D6" commented="no"><enum>(II)</enum><text>from a State or other governmental entity; or</text></subclause></clause> <clause id="H636BCC7F44B749D6A8B1951C70C798EF"><enum>(iii)</enum><text display-inline="yes-display-inline">to the extent feasible, lost lifetime productivity due to disability.</text></clause> </subparagraph></paragraph> 
<paragraph id="H27BF50C78F1B49D4B9834C9EBF78E29D"><enum>(6)</enum><text display-inline="yes-display-inline">With respect to family members and caregivers, the costs of caring for an individual with a serious mental illness, including—</text> <subparagraph id="H226F09E007BF41C39A5F5A762B595824"><enum>(A)</enum><text>the cost of unpaid labor;</text></subparagraph> 
<subparagraph id="HBFE10E0800C045FCBA7DC006457EC541"><enum>(B)</enum><text>additional health care costs associated with providing ongoing care for an individual with a serious mental illness, including higher health care costs resulting from stress and anxiety;</text></subparagraph> <subparagraph id="H2E73A56B6AC84CDB990DB7CEDDC8C5AC"><enum>(C)</enum><text>taking leave from work; and</text></subparagraph> 
<subparagraph id="H606C572C75544FC6AEDAC66B451B172B"><enum>(D)</enum><text>out-of-pocket costs incurred while caring for such individual.</text></subparagraph></paragraph> <paragraph id="HC654B560FB674CC485AD8C23E7195C23"><enum>(7)</enum><text display-inline="yes-display-inline">Costs with respect to funding for grants or cooperative agreements for programs or services for basic, translational, and applied research for individuals with a serious mental illness.</text></paragraph> 
<paragraph id="HFD87FE389A47466281177E3AD351A8EF"><enum>(8)</enum><text display-inline="yes-display-inline">The costs of workforce development and training for personnel that interact with individuals with a serious mental illness, and insurance for such development and training, including health care workers, social service employees, law enforcement, and first responders.</text></paragraph> <paragraph id="H36A8E2878C9E437E82CC54AFB28BE390"><enum>(9)</enum><text>Other costs for programs and services administered by the Federal Government or State, Tribal, or local governments.</text></paragraph></subsection> 
<subsection id="H3C156F85351E4E989CD43FA045B590FB"><enum>(c)</enum><header>Data disaggregation</header><text display-inline="yes-display-inline">In conducting the study under subsection (a), the Secretary shall (to the extent feasible)—</text> <paragraph id="HFAF12828A1FA47339B206944C0A67589"><enum>(1)</enum><text display-inline="yes-display-inline">disaggregate data by—</text> 
<subparagraph id="H113744EFCF0A44BA9283950E2004B961"><enum>(A)</enum><text>costs to nongovernmental entities, the Federal Government, and State, local, and Tribal governments;</text></subparagraph> <subparagraph id="HB06B1918AC95420A96B08FB4F23ACA7F"><enum>(B)</enum><text display-inline="yes-display-inline">types of serious mental illnesses and medical chronic diseases common in patients with a serious mental illness; and</text></subparagraph> 
<subparagraph id="H2A342F4B79C94E9FB9A7482447A714BE"><enum>(C)</enum><text>demographic characteristics, including race, ethnicity, sex, age (including pediatric subgroups), and other characteristics determined by the Secretary; and</text></subparagraph></paragraph> <paragraph id="H6E228344A1424E9CA7CE5554AF9242E1" commented="no"><enum>(2)</enum><text>include an estimate of—</text> 
<subparagraph id="H38DD1128762C4F388A75508C0656114A" commented="no"><enum>(A)</enum><text>the total number of individuals with a serious mental illness in the United States, including in traditional and nontraditional housing; and</text></subparagraph> <subparagraph id="HAFECB22F5C3E4386BAA78A4408D34C63" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">taking into account the information collected pursuant to section 3(b)(3), the percentage of such individuals in—</text> 
<clause id="H444E78B4EE25422DB3762E957A90E41D"><enum>(i)</enum><text>homeless shelters;</text></clause> <clause id="H93F6BC52763A4994BA52EFC2D105E11A"><enum>(ii)</enum><text>penal facilities, including Federal prisons, State prisons, and county and municipal jails; and</text></clause> 
<clause id="H338B2BA545BF46B3AA1279039C4F7354"><enum>(iii)</enum><text>nursing facilities.</text> </clause></subparagraph></paragraph></subsection> <subsection id="HBC81B158546F47CCA2A2579D07786A38"><enum>(d)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of this Act, the Secretary shall—</text> 
<paragraph id="H20D3FC3F36F14B9E858D62DB4EF373C4"><enum>(1)</enum><text>submit to the Congress a report containing the results of the study conducted under this section; and</text></paragraph> <paragraph id="H06A57272919140D88ABACB2179951A2A"><enum>(2)</enum><text>make such report publicly available.</text> </paragraph></subsection> 
<subsection id="H102AB45D32C643FD887645EA9F732972"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H93CDC321F8434F33A3DC3C6B0BB10BD8"><enum>(1)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Health and Human Services. </text></paragraph> 
<paragraph id="H85383F1677F24A5F835406F003172847"><enum>(2)</enum><header>Serious mental illness</header><text>The term <term>serious mental illness</term> means a mental, behavioral, or emotional disorder resulting in a serious functional impairment that substantially interferes with or limits one or more major life activities, including the following:</text> <subparagraph id="H61D86219BACB438892CEAAE4524C0EAD"><enum>(A)</enum><text display-inline="yes-display-inline">Schizophrenia, including schizoaffective disorder and other related psychosis.</text></subparagraph> 
<subparagraph id="H4FF2CDA9F5C245F1B5A6C7A6EFCA961C"><enum>(B)</enum><text display-inline="yes-display-inline">Schizoaffective disorder.</text></subparagraph> <subparagraph id="HE2FDB03F3D1C4F51BFCD4078F2FAB1FF"><enum>(C)</enum><text>Persistent mood disorder, including bipolar disorder I and II.</text></subparagraph> 
<subparagraph id="H3A95B7FAB34B4DF091891DFD3A516E83"><enum>(D)</enum><text>Major depressive disorder.</text></subparagraph> <subparagraph id="HF5F6781AECAE4E33BF0ECADE647DD3C0"><enum>(E)</enum><text display-inline="yes-display-inline">Any other such mental, behavioral, or emotional disorder, as determined by the Secretary.</text></subparagraph></paragraph></subsection> 
<subsection id="HEBAE0FF2CDC54B168A353C690624FFD0"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this section $3,500,000 for each of fiscal years 2023 and 2024.</text></subsection></section> <section id="H87594A1E9C844521ABE7893251C44FFA"><enum>3.</enum><header>Schizophrenia surveillance survey</header> <subsection id="H83F1FECCED234CA7952B778DB9619632"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>), acting through the Assistant Secretary for Mental Health and Substance Use, and in coordination with the Director of the Centers for Disease Control and Prevention and the Director of the National Institute of Mental Health, shall—</text> 
<paragraph id="H6BC492EA0F214C2598E1A348B117F149"><enum>(1)</enum><text>conduct a surveillance survey to collect the information described in subsection (b) about individuals with schizophrenia in the United States; and</text></paragraph> <paragraph id="H7DE399E06CE34BEC95823302BD119BC1"><enum>(2)</enum><text>not less than every 5 years, update such survey.</text> </paragraph></subsection> 
<subsection id="H70ABAE94A1C84AEEBAD99902A44166FE"><enum>(b)</enum><header>Content</header><text>In carrying out subsection (a), the Secretary shall collect—</text> <paragraph id="H179DB90F1E3F4F03AF2386DA4D6408E9"><enum>(1)</enum><text>to the extent practicable, information relating to individuals with schizophrenia, such as—</text> 
<subparagraph id="H97B8A4735C334AB387E523DEA20E0944"><enum>(A)</enum><text>demographics, such as age, race, ethnicity, sex, geographic location, family history, and other information as appropriate;</text></subparagraph> <subparagraph id="H3E5184159DD646E3B0F754B0A442751D"><enum>(B)</enum><text>risk factors that may be associated with schizophrenia such as environmental risk factors and other information as appropriate; and</text></subparagraph> 
<subparagraph id="HC7F81E66AC2E41EA94F312F1EC2DC9D8"><enum>(C)</enum><text>average age at the time of initial diagnosis and time lapses, if any, between the initial diagnosis and the initiation of mental health care; </text></subparagraph></paragraph> <paragraph id="H77FD3CF8E10D483CBFE32BF778E6A80A"><enum>(2)</enum><text>to the extent practicable, information on the health status of individuals with schizophrenia, including—</text> 
<subparagraph id="H43CA3648621B40778ED078BFD82ED81B"><enum>(A)</enum><text>mortality and morbidity rates;</text></subparagraph> <subparagraph id="H0775B3747BB94D28816CF37149DE2B12"><enum>(B)</enum><text>incidences of comorbid chronic diseases, including diabetes, cardiac conditions, emphysema, cirrhosis, HIV/AIDS, and hepatitis C; and</text></subparagraph> 
<subparagraph id="HD201BC3964D04C2EAA3BD48DEFBF371E"><enum>(C)</enum><text>the frequency of hospital emergency department utilization; and</text></subparagraph></paragraph> <paragraph id="H1C39F3B597FE4D3F8A4DB68EA5542137"><enum>(3)</enum><text display-inline="yes-display-inline">the percentage of individuals with schizophrenia in—</text> 
<subparagraph id="H936FA7D24D3941C79819011D39536B21"><enum>(A)</enum><text>homeless shelters;</text></subparagraph> <subparagraph id="H64ABF037FF644E0AB9FFC3752970A093"><enum>(B)</enum><text>penal facilities, including Federal prisons, State prisons, and county and municipal jails;</text></subparagraph> 
<subparagraph id="H4C727B896F4C4FB3B929428D2784B254"><enum>(C)</enum><text>nursing facilities; and</text></subparagraph> <subparagraph id="H918A78A6C19B45318292A031DC215630"><enum>(D)</enum><text>inpatient hospitals.</text></subparagraph></paragraph></subsection> 
<subsection id="HB825DCE7D85844B2AA55D1B4FB51EE07"><enum>(c)</enum><header>Consultation</header><text>In carrying out this section, the Secretary shall consult with individuals with appropriate expertise, which may include—</text> <paragraph id="HE9892560E22F4CAF944D95B2E49A85AD"><enum>(1)</enum><text>epidemiologists with experience in mental health conditions surveillance; and</text></paragraph> 
<paragraph id="H14CECB50499643D58F108E31DF1E0D4D"><enum>(2)</enum><text>representatives of national voluntary health association and nonprofit citizens organizations that—</text> <subparagraph id="H75F08F1608A644FAB958ECE8E730DE09"><enum>(A)</enum><text>focus on schizophrenia and related psychotic conditions; and</text></subparagraph> 
<subparagraph id="HF0D1D71AF5184D6FB4D704E1AAA32057"><enum>(B)</enum><text>have experience in research, care, and patient services.</text></subparagraph></paragraph></subsection> <subsection id="HE64576E172FA46B68F930E17B0706CEE"><enum>(d)</enum><header>Coordination</header><text>In carrying out this section, the Secretary shall—</text> 
<paragraph id="HAFC63EA8E07A4379B0E323F35F83D0E3"><enum>(1)</enum><text>coordinate with the National Neurological Conditions Surveillance System under section 399S–1 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-7a">42 U.S.C. 280g–7a</external-xref>) to determine any overlap between—</text> <subparagraph id="H2EAEC4309A4443B28E224E40B96EADAC"><enum>(A)</enum><text>individuals with schizophrenia counted for purposes of the survey under this section; and</text></subparagraph> 
<subparagraph id="H813F52AC04B24CBEA9140AE3C84168C9"><enum>(B)</enum><text>individuals with neurological conditions identified by the Director of the Centers for Disease Control and Prevention for purposes of the National Neurological Conditions Surveillance System; and</text></subparagraph></paragraph> <paragraph id="H91EA3A40771E44509D7386B065B1DA0B"><enum>(2)</enum><text display-inline="yes-display-inline">coordinate with other Federal agencies, including the Social Security Administration, the Department of the Treasury, and the Department of Labor, to use administrative data, to the extent feasible, to provide information for the survey authorized by subsection (a).</text></paragraph> </subsection> 
<subsection id="H169DD931DC624985B03CFA14FB4E1E85"><enum>(e)</enum><header>Grants</header><text>The Secretary may award grants to, or enter into contracts or cooperative agreements with, public or private nonprofit entities to carry out activities in furtherance of the surveillance survey under this section, including the convening of stakeholder meetings.</text></subsection> <subsection id="H634D6D62308B43799D17F4E42D54A51A"><enum>(f)</enum><header>Reporting</header> <paragraph id="H6DDD335CBA0D4EA987A0EEFF8DF18F18"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate—</text> 
<subparagraph id="HD5121270EF224ED8B20C133303B0E813"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 2 years after the date of enactment of this Act, a report containing findings of the surveillance survey under this section, including aggregate information collected and epidemiological analyses, as appropriate; and</text></subparagraph> <subparagraph id="HCD8170A3121D4C0EA47C87128787A4A1"><enum>(B)</enum><text>not less than every 5 years when an updated survey is conducted pursuant to subsection (a)(2), an updated report.</text> </subparagraph></paragraph> 
<paragraph id="HB7B870F337D34471B5E4E243FD4AB29A"><enum>(2)</enum><header>Posting</header><text display-inline="yes-display-inline">The Secretary shall post the report under paragraph (1) and each update under paragraph (2) on the public website of the Department of Health and Human Services.</text></paragraph></subsection> <subsection id="H78006AC248D0499A8745FE4ADA86A00A"><enum>(g)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $50,000,000 for the period of fiscal years 2023 through 2027.</text> </subsection></section>
