<official-title display="yes">To direct the Administrator of the Federal Emergency Management Agency to revise the policy of the Agency to address the threats of climate change, to include considerations of climate change in the strategic plan of the Agency, and for other purposes.</official-title>

<section id="H3ED589B61C6743A0BC5C90A3A5A58236" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>FEMA Climate Change Preparedness Act</short-title></quote>.</text></section> <section id="H984BA78092FC492CBEC5F499C91437EF"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="H43B8C1D92EB346E6A30D8E8A3B7C6E01"><enum>(1)</enum><text>Under the previous Administration, the term <quote>climate change</quote> was intentionally stripped from the Agency’s 2018–2022 Strategic Plan, despite the mounting threat posed by climate change as a source of changing and increasing national disaster risks.</text></paragraph> <paragraph id="HA2269CD7C4504176A32F2A8908884630"><enum>(2)</enum><text>It is the general consensus of the global scientific community that—</text>
<subparagraph id="H3E75A9A575BC4892B4B41BCC4DE94DD4"><enum>(A)</enum><text>the evidence of climate change is unequivocal;</text></subparagraph> <subparagraph id="HDC3ACB0BA949430097164AFB3F427F87"><enum>(B)</enum><text>anthropogenic greenhouse gas emissions are the primary cause of climate change; and</text></subparagraph>
<subparagraph id="H2A415CE10A3B4846953056481E993334"><enum>(C)</enum><text>as a direct result of climate change, sea levels are rising and extreme weather events are becoming more commonplace and severe.</text></subparagraph></paragraph> <paragraph id="H8F89168CBEC84F48B29A8781C1D546D2"><enum>(3)</enum><text>The last 7 years have been the warmest years on record since the National Oceanic and Atmospheric Administration began recording global air temperatures in 1895.</text></paragraph>
<paragraph id="H5DBAFAD4CE894ECA92FF6EB0828C52AF"><enum>(4)</enum><text>In 2020, there were a record total of 22 climate disaster events with losses exceeding $1 billion each to affect the United States—amounting to 5 more disasters of such magnitude than each of the previous record years of 2011 and 2017.</text></paragraph> <paragraph id="H44845DB965904DFC85AC8FB00A4936EE"><enum>(5)</enum><text>It is the mission of FEMA to reduce the loss of life and property and protect our institutions from all hazards by leading and supporting the Nation in a comprehensive, risk-based emergency management program of mitigation, preparedness, response, and recovery.</text></paragraph>
<paragraph id="H7DE9EFEBFE6544ED868E0E9362FFA0DE"><enum>(6)</enum><text>It is detrimental to the mission of FEMA, and the Agency’s ability to follow its mandate, to explicitly or implicitly deny or ignore the existence of climate change or the implications of such on national security and national emergency management.</text></paragraph> <paragraph id="H8134343FD24E42CB8EBF2ABF49B2194A"><enum>(7)</enum><text>To fully and effectively carry out its mandate, FEMA must comprehensively assess and incorporate the current and future natural disaster risks and impacts posed by climate change throughout the Agency’s policies, plans, programs, strategies, and operations.</text></paragraph></section>
<section id="HD3B4D927EC5B47A2A5992F0D70CABFD3"><enum>3.</enum><header>Statements of intent and policy</header><text display-inline="no-display-inline">Section 101 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref>) is amended—</text> <paragraph id="HAB436B2064BF4189940FFB376259A57F"><enum>(1)</enum><text>in subsection (b)—</text>
<subparagraph id="H9D90820A3495401AAF87B5FC94564621"><enum>(A)</enum><text>in paragraph (5) by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H19BCBBBD372F4449A6B81400E1870934"><enum>(B)</enum><text>in paragraph (6) by striking the period at the end and inserting a semicolon; and</text></subparagraph>
<subparagraph id="H2510B2337873405D94516A5331C32256"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H55B2C96A69DD4B368A9BCDD5724AEED6" style="OLC"> <paragraph id="H028EE73BB3E44650BBAAA0F7E7D3BCF7"><enum>(7)</enum><text display-inline="yes-display-inline">integrating, to the greatest extent practicable, climate change adaptation planning and actions into the programs, policies, and operations of the Federal Emergency Management Agency; and</text></paragraph>
<paragraph id="H50452B90019745209C62883537232D4D"><enum>(8)</enum><text>assisting State, local, volunteer, and private partners in preparing for and mitigating the risks posed by climate change as listed in subsection (c)(2), as well as any other climate change risks.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HEAEAA3FE3FC64E9E9AC7F6EDBAD14DFA"><enum>(2)</enum><text>by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H1496AEFE3B5248B59E86CF7C0687492C" style="OLC">
<subsection id="HDA79A80A143540F28462ABB11662D3BF"><enum>(c)</enum><header>Climate change</header><text display-inline="yes-display-inline">It is the policy of the Federal Emergency Management Agency to recognize that—</text> <paragraph id="H45FF828BB0AC460F89342DC9213A369E"><enum>(1)</enum><text>climate change is—</text>
<subparagraph id="HBA309EC64519482FAA60B9C76931AA6D"><enum>(A)</enum><text>an irrefutable, multidimensional, and significant near and long-term threat to United States—</text> <clause id="HF7DE5391FF5045F78FC4F91FF13A5DC2"><enum>(i)</enum><text>homeland security;</text></clause>
<clause id="HFC1A4CCE2B2E495BA9B19E7CDD6797B4"><enum>(ii)</enum><text>national security; and</text></clause> <clause id="HEED307F91D6F4E8DACC6DFBBAA53AA69"><enum>(iii)</enum><text>national disaster risk; and</text></clause></subparagraph>
<subparagraph id="HAA9D401B66B14F2FA637C92F14656910"><enum>(B)</enum><text>primarily caused by anthropogenic greenhouse gas emissions; and</text></subparagraph></paragraph> <paragraph id="HE86831A8E8BE4AA6A4674D0DDF330B42"><enum>(2)</enum><text>as a direct result of climate change, the United States faces the increased threat of—</text>
<subparagraph id="HE9AA376C5D314943B4381430FCA3AC19"><enum>(A)</enum><text>changing, more frequent, and more severe extreme weather events;</text></subparagraph> <subparagraph id="H3C1C08035BEB4912AA337561CEC330D9"><enum>(B)</enum><text>rising natural hazard risk;</text></subparagraph>
<subparagraph id="H557B56E00C68408CAE2AAF268664C1B7"><enum>(C)</enum><text display-inline="yes-display-inline">disruptions to or failure of critical infrastructure;</text></subparagraph> <subparagraph id="HEFEB263888044AFFAAB0A9519508C192"><enum>(D)</enum><text>sea-level rise;</text></subparagraph>
<subparagraph id="H1AB8E054367E45BF868E64F8C5B4B062"><enum>(E)</enum><text>internal population displacement;</text></subparagraph> <subparagraph id="HC96FAF2BE43A49B68A12C35B53E408A2"><enum>(F)</enum><text>the spread of life-threatening diseases;</text></subparagraph>
<subparagraph id="HA0BD1F3313AD42439D86895DB934C6AC"><enum>(G)</enum><text>rising annual disaster costs; and</text></subparagraph> <subparagraph id="H7A412A8E7CDF437BBF3043A831C7EA29"><enum>(H)</enum><text display-inline="yes-display-inline">disproportionately high risks and impacts to low-income communities, communities of color, Tribal communities, and other frontline communities.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HAFC9E92C724A45F184E02A4C718D21E1"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HAE2C64277129443383BE665F75823743" style="OLC"> <paragraph id="H333D3B9617214C7580048F6D62101012"><enum>(13)</enum><header>Climate change</header><text>The term <quote>climate change</quote> means the long-term shifts in global and regional climate patterns, and associated phenomena, that are occurring primarily as a result of anthropogenic greenhouse gas emissions.</text></paragraph>
<paragraph id="H394E2210664847A48F1B23BCF46EC9A7"><enum>(14)</enum><header>Sea-level rise</header><text display-inline="yes-display-inline">The term <quote>sea-level rise</quote> means the local, regional, and global long-term trends in rising average sea levels that are occurring as a direct result of climate change and additional local factors such as land subsidence.</text></paragraph> <paragraph commented="no" id="H9EDA35808ABE48E0BDE8EA0E5CAD08E8"><enum>(15)</enum><header>Extreme weather events</header><text display-inline="yes-display-inline">The term <quote>extreme weather events</quote> means historically rare or severe natural disasters such as heat waves, droughts, floods, tornadoes, and hurricanes.</text></paragraph>
<paragraph id="H4BDAAB3859344D0D8F88C69FCEE91CD0"><enum>(16)</enum><header>Frontline community</header><text display-inline="yes-display-inline">The term <quote>frontline community</quote> means a low-income community, community of color, or Tribal community that is disproportionately impacted or burdened by climate change and associated phenomena.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HD88F2BDA176F4A9F9BE2ED5E85A619DA"><enum>5.</enum><header>Inclusion of climate change in strategic plan</header> <subsection id="H224B8622C41D4EC4A87CBA7554717CDD"><enum>(a)</enum><header>Current strategic plan</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall revise the 2018–2022 Strategic Plan to—</text>
<paragraph id="HD7CA33E36C054C308801A69924024ACA"><enum>(1)</enum><text display-inline="yes-display-inline">ensure the text of such plan explicitly mentions climate change, in accordance with the policy of FEMA in section 101 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref>), as amended by section 3; and</text></paragraph> <paragraph id="H639AC8D826134947915F0125B02015E6"><enum>(2)</enum><text>address the implications of climate change on homeland security and near- and long-term national disaster risk, including emergency preparedness, response, recovery, and mitigation.</text></paragraph></subsection>
<subsection id="H3C8BB256133E4712B769F6C4646CFE94"><enum>(b)</enum><header>Future strategic plans</header><text display-inline="yes-display-inline">Any strategic plan subsequent to the 2018–2022 Strategic Plan developed by FEMA shall—</text> <paragraph id="HD1855FAD3FAB48388B91C8120E1A27AC"><enum>(1)</enum><text display-inline="yes-display-inline">explicitly mention climate change, in accordance with the policy of FEMA under section 101 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref>), as amended by section 3; and</text></paragraph>
<paragraph id="HACE6C75B7C15406F849240648F6050C1"><enum>(2)</enum><text display-inline="yes-display-inline">address the implications of climate change on homeland security and near- and long-term national disaster risk, including emergency preparedness, response, recovery, and mitigation, drawing upon findings and recommendations, once available, from the Climate Change Subcommittee described in section 6 and the assessment of climate change risks and preparedness described in section 7.</text></paragraph></subsection></section> <section id="H71D5572BE1DD4DCE9807C26D8019DBEA"><enum>6.</enum><header>National Advisory Council Climate Change Subcommittee</header> <subsection id="H1A6C9CE7513348B49FCA01C090BE7856"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary of Homeland Security shall establish, as a subcommittee of the National Advisory Council, the Climate Change Subcommittee (in this Act referred to as the <quote>Subcommittee</quote>).</text></subsection>
<subsection id="HED5589ECD9034C20A7BB727845647104"><enum>(b)</enum><header>Membership</header>
<paragraph id="HAD78036C90D244E1919083E8B30A94AF"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Subcommittee shall consist of—</text> <subparagraph id="H62289B227E1F49048ADF9DC189847284"><enum>(A)</enum><text>the Administrator of FEMA;</text></subparagraph>
<subparagraph id="H122C9B9154E74DBCBFC6DA27116C1604"><enum>(B)</enum><text>the Director of the United States Geological Survey of the Department of the Interior;</text></subparagraph> <subparagraph id="HAB9AE95A80F341209F3C795BEEE4204A"><enum>(C)</enum><text>the Director of the Bureau of Safety and Environmental Enforcement of the Department of the Interior;</text></subparagraph>
<subparagraph id="HDDFEB5239DB445ABAD5AF8E1AAAE9F81"><enum>(D)</enum><text>the Under Secretary of Commerce for Oceans and Atmosphere;</text></subparagraph> <subparagraph id="HC25BABDDFCD54142BF053BD33C49814E"><enum>(E)</enum><text>the Commanding Officer of the United States Army Corps of Engineers;</text></subparagraph>
<subparagraph id="HA121D2C0DCF94FBDAB42A4DDA6CC19A2"><enum>(F)</enum><text>the Director of the Office of Homeland Security and Emergency Coordination of the Department of Agriculture;</text></subparagraph> <subparagraph id="HA4FEF056E0684162BC992D6C4BF2F6B2"><enum>(G)</enum><text>the Executive Director of the Federal Highway Administration of the Department of Transportation;</text></subparagraph>
<subparagraph id="HDE0E3F5336E14919AE5CA01F5CCF69BD"><enum>(H)</enum><text>the Executive Director of the Federal Transit Administration of the Department of Transportation;</text></subparagraph> <subparagraph id="H89202F42E99D4624B3AC0153A5B2D562"><enum>(I)</enum><text>the Under Secretary of Energy of the Department of Energy;</text></subparagraph>
<subparagraph id="H98314D7C503E4A97B3A32A49BC89AC79"><enum>(J)</enum><text>the Commissioner of the Federal Housing Administration of the Department of Housing and Urban Development;</text></subparagraph> <subparagraph id="H7BB02004AF72414AB52E836C90656342"><enum>(K)</enum><text>the Assistant Administrator of the Office of Land and Emergency Management of the Environmental Protection Agency;</text></subparagraph>
<subparagraph id="H1919857D24D440F0A82945F538E49BDA"><enum>(L)</enum><text>the Acting Director of the Center for Preparedness and Response of the Department of Health and Human Services;</text></subparagraph> <subparagraph id="HAA437F422508416DA3323FD756771E00"><enum>(M)</enum><text display-inline="yes-display-inline">the National Climate Advisor of the Office of Domestic Climate Policy of the Executive Office of the President;</text></subparagraph>
<subparagraph id="HA4DA576A385D4F4E979BCB69356BEC3C"><enum>(N)</enum><text display-inline="yes-display-inline">the Chair of the Environmental Justice Interagency Council of the Executive Office of the President;</text></subparagraph> <subparagraph id="H55BE140FFF4B403F9368D7112169D22E"><enum>(O)</enum><text display-inline="yes-display-inline">such other qualified individuals as the Administrator shall appoint as soon as practicable from among the following—</text>
<clause id="H76631ADB764B40AE94E5CD1C17B7E3D9"><enum>(i)</enum><text>members of the National Advisory Council that have the requisite technical knowledge and expertise to address climate change threats to homeland security, including—</text> <subclause id="HB37E170DCAB44B6D80E55F31C9FE74CE"><enum>(I)</enum><text>emergency management and emergency response providers;</text></subclause>
<subclause id="H2B4EDED260D64956AD05D1F262E5262E"><enum>(II)</enum><text>State, local, and Tribal government officials;</text></subclause> <subclause id="H8A6C148E79384DC3B673B40E81DFC516"><enum>(III)</enum><text>climate scientists and experts in natural disaster risk assessment; and</text></subclause>
<subclause id="HCBCAF27EB7714901A43A43569E4152EC"><enum>(IV)</enum><text>experts in climate change adaption, mitigation, and resilience; and</text></subclause></clause> <clause id="HE270554F5E3F400D97AC9CD9A48AF93B"><enum>(ii)</enum><text>individuals who have the requisite technical knowledge and expertise to serve on the Climate Change Subcommittee, including at least 1 representative from each of—</text>
<subclause id="H1738AB76D64E4BC39D376B3BC9112DBA"><enum>(I)</enum><text>an environmental justice organization representing low-income communities and communities of color that are disproportionately impacted by climate change;</text></subclause> <subclause id="H1C38D6D51FF5419EA585317519874E96"><enum>(II)</enum><text>a Tribal community that is disproportionately impacted by climate change or environmental pollution;</text></subclause>
<subclause id="HE8C324C99A2C4B6B884DB00B1EBBB789"><enum>(III)</enum><text>an organized labor group within the resilient infrastructure sector;</text></subclause> <subclause id="H18D21E92952A4776A7B687DC1A4CA668"><enum>(IV)</enum><text>a private-sector company that designs, develops, or constructs resilient infrastructure, or an organization that represents such companies;</text></subclause>
<subclause id="H599D02F183C84050801C80A550DAD7D1"><enum>(V)</enum><text>a city or county that is directly impacted by coastal sea-level rise;</text></subclause> <subclause id="H5ED780639FEB4C6B9CEC08EE5ECF8841"><enum>(VI)</enum><text>a State that is directly impacted by coastal sea-level rise;</text></subclause>
<subclause id="HB26D24697F3943698CD966681C3060FE"><enum>(VII)</enum><text>a city or county that is highly impacted by wildfires or droughts;</text></subclause> <subclause id="H453F4218EA1D42EFADC9FEE823E37AAF"><enum>(VIII)</enum><text>a State that is highly impacted by wildfires or droughts;</text></subclause>
<subclause id="H27FE88A65C5E490498F0992BB1F0EF39"><enum>(IX)</enum><text>scientists with expertise in climate science and natural disaster risk assessment who are faculty members at an accredited university; and</text></subclause> <subclause id="H39A69E91CC664B09A319313DD9896B28"><enum>(X)</enum><text>experts in homeland security threat assessment and intelligence analysis, especially as it concerns natural disasters; and</text></subclause></clause></subparagraph>
<subparagraph id="HC889B15E89A34B0C96768AE0DA0084B5"><enum>(P)</enum><text display-inline="yes-display-inline">representatives of such other stakeholders and interested and affected parties as the Administrator determines appropriate.</text></subparagraph></paragraph> <paragraph id="HC07EA078E8704A16ABB461DBFD1C35A0"><enum>(2)</enum><header>Representation</header><text>The Administrator shall ensure, to the extent practicable, that members of the Subcommittee represent a geographic (including urban, rural, and coastal) and substantive diversity of State, local, and Tribal government officials, emergency managers, and emergency response providers, scientific and technical experts, private-sector companies, and nongovernmental organizations.</text></paragraph></subsection>
<subsection id="H65ABBEC087A9410692DFA61886AF9138"><enum>(c)</enum><header>Responsibilities</header><text>The Subcommittee shall advise the Administrator on how to best incorporate climate change, including risk assessments and strategies for adaptation and mitigation, into and throughout FEMA’s policies, plans, programs, and operations, including through the performance of the following duties:</text> <paragraph id="HEE3410EB3982489C83CF7F04DFD9B642"><enum>(1)</enum><header>Assessment</header><text>Not later than 18 months after the date of enactment of this Act, the Subcommittee shall develop and submit to the Administrator and Congress, and make available to the public, an assessment of all relevant FEMA policies, plans, programs, strategies, and operations with a focus on climate change-related risks, impacts, adaptation, preparedness, mitigation, and resilience. The assessment shall address—</text>
<subparagraph id="H081FB2E28FAB45E1BD7B42DBE32801F7"><enum>(A)</enum><text>existing and future risks and impacts posed by climate change to States, cities, and communities throughout the United States, including the current and potential impacts of climate change on national emergency management, annual disaster costs, and natural disaster mitigation, preparedness, response, and recovery;</text></subparagraph> <subparagraph id="H4706B431C2864CFFB0AA24EA5C8B7B2E"><enum>(B)</enum><text>the extent to which climate change, including risk assessments, resilience, adaptation, and mitigation, is currently integrated within FEMA policies, plans, programs, strategies, and operations, as well as the extent to which and areas where such integration is lacking;</text></subparagraph>
<subparagraph id="H5F2F3C8494AB4C00B4E4AB2E3368B9C9"><enum>(C)</enum><text>the extent to which climate change, including risk assessments, resilience, adaptation, and mitigation, is currently incorporated into technical assistance, outreach, grant, and loan programs, as well as the extent to which and programs where such integration is lacking;</text></subparagraph> <subparagraph id="H0B39F888A8AC4C0A92A5709DF5ACC1C4"><enum>(D)</enum><text>partnerships and coordination with Federal, State, and local agencies and authorities, as well as volunteer and private entities;</text></subparagraph>
<subparagraph id="H8607DC252F9D49D3B66C4A39E3B6FA7B"><enum>(E)</enum><text>data collection, management, and analysis;</text></subparagraph> <subparagraph id="H581084468516438F8DC66487D86E0438"><enum>(F)</enum><text>recommendations regarding how FEMA can better incorporate climate change throughout FEMA policies, plans, programs, strategies, and operations, which shall address—</text>
<clause id="H7E4400E3DD47415384FA29955BFCA6B1"><enum>(i)</enum><text>risk assessments, including ways to more comprehensively predict and incorporate current and future risks as they relate to climate change;</text></clause> <clause id="H1025524F990049A2AC71EE8B058C0249"><enum>(ii)</enum><text>strategies to increase climate change adaptation, mitigation, and resilience in communities throughout the United States;</text></clause>
<clause id="HD9680DA75F2C44B790191B07796EBDE9"><enum>(iii)</enum><text>ways to ensure that investments and strategies around climate change adaptation, mitigation, and resilience benefit all communities, especially frontline communities;</text></clause> <clause id="H455AC3606A524200BA43FA11576CA440"><enum>(iv)</enum><text>critical information, communication, and policy gaps, barriers, and challenges;</text></clause>
<clause id="H97F8FC58607C494BAAB5C515B189F198"><enum>(v)</enum><text>technical assistance, outreach, grant, and loan programs, including ways that FEMA can use and expand such programs to increase climate change preparedness throughout the emergency management community, and strengthen climate change adaptation, mitigation, and resilience across the United States, particularly in frontline communities;</text></clause> <clause id="H2A898C53D535420C9F83D7F0ED147872"><enum>(vi)</enum><text>coordination with all relevant partners, including Federal, State, and local agencies and authorities, as well as private entities and volunteers;</text></clause>
<clause id="H4EEF5E7362994ECBAA6B357A36F0931D"><enum>(vii)</enum><text>monitoring, recording, and analyzing FEMA actions, data management, and budget allocations to help advance climate resilience;</text></clause> <clause id="H088C30A923714A819DA425E24A95CAA4"><enum>(viii)</enum><text>methodologies for integrating and disseminating scientific knowledge of projected climate change impacts and risks, and other relevant data and information, into policies, guidance, and public communications;</text></clause>
<clause id="H3205F410B9E344178A55EE0F1710B863"><enum>(ix)</enum><text>platforms for sharing best practices, information, and lessons learned with the national emergency management community and general public, including public web pages, webinars, and workshops;</text></clause> <clause id="H0D46CF7332E34BA28B2A80AED888F576"><enum>(x)</enum><text>FEMA’s 2018–2022 Strategic Plan, and ways for FEMA to better incorporate climate change into all future such plans; and</text></clause>
<clause id="HABABB5BA406D4D968E37417F9ED63CAA"><enum>(xi)</enum><text>any other matters, as the Administrator determines to be appropriate; and</text></clause></subparagraph> <subparagraph id="HF46A66C832D74D18940B0CE3B24D75E4"><enum>(G)</enum><text display-inline="yes-display-inline">timeframes for implementing any such recommendations that do not require congressional action, and the identification of any such recommendations that require congressional action.</text></subparagraph></paragraph>
<paragraph id="HCFAD99C8CE1B4127A2160D430D08506D"><enum>(2)</enum><header>Ongoing duties</header><text display-inline="yes-display-inline">Upon request of the Administrator, the Subcommittee shall, on an ongoing basis—</text> <subparagraph id="HF41EB1AF825C44BCBF854962128EA4DF"><enum>(A)</enum><text>review any relevant Agency policies, plans, programs, strategies, and operations, and make any necessary recommendations thereof, regarding climate change;</text></subparagraph>
<subparagraph id="HE3D69BCBCC6843A697579D4B7ADE20B6"><enum>(B)</enum><text>support the Administrator in incorporating and implementing findings and recommendations from the assessment described in paragraph (1) into all relevant Agency policies, plans, programs, strategies, and operations, including the assessment of climate change risks and preparedness described in section 7; and</text></subparagraph> <subparagraph id="H5A561695D12040ACB888E0D7D78AF15A"><enum>(C)</enum><text>perform any other relevant duties, as the Administrator determines to be appropriate.</text></subparagraph></paragraph></subsection>
<subsection id="HC728201814944D6EB24DA60E82691ECF"><enum>(d)</enum><header>Public meetings</header><text>In carrying out its duties under this section, the Subcommittee shall—</text> <paragraph id="H8AE409E53DFF4ADAA0E6E946C3FCF0F1"><enum>(1)</enum><text>consult with stakeholders through not less than 2 public meetings each year, the total of which not less than 3 shall be during the time in which the Subcommittee is conducting the assessment described in subsection (c)(1); and</text></paragraph>
<paragraph id="H87F231FDA01A4EA9BEB70DFB7D3AEB60"><enum>(2)</enum><text>seek input from all stakeholder interests including State and local representatives, environmental and climate justice organizations, private industry representatives, advocacy groups, planning and resilience organizations, labor representatives, and representatives from frontline communities.</text></paragraph></subsection> <subsection id="H574DFB8FBA724E91ACE53BF90DA443D2"><enum>(e)</enum><header>Compensation and expenses</header><text>Any non-federally employed member of the Subcommittee, when attending meetings of the Subcommittee or when otherwise engaged in the business of the Subcommittee, shall receive—</text>
<paragraph id="H580E857D2CB34365BD4C14AFE79036A0"><enum>(1)</enum><text>compensation at a rate fixed by the Secretary of Homeland Security, not exceeding the daily equivalent of the current rate of basic pay in effect for GS–15 of the General Schedule under section 5332 of title 5, United States Code, including travel time; and</text></paragraph> <paragraph id="H1A60048CBC1D4478A768516434293C24"><enum>(2)</enum><text>travel or transportation expenses under section 5703 of title 5, United States Code.</text></paragraph></subsection>
<subsection id="H981F36F07E4742FF94E1DB9A8676CFC3"><enum>(f)</enum><header>Chair</header><text>The Administrator shall serve as the Chair of the Subcommittee.</text></subsection> <subsection id="HA06A0B94A9B54C57A92CBC059F326499"><enum>(g)</enum><header>Staff</header> <paragraph id="H6B702EB0BBE24BD8A5B0691D42318F28"><enum>(1)</enum><header>FEMA</header><text>Upon request of the Subcommittee, the Administrator may detail, on a non-reimbursable basis, personnel of FEMA to assist the Subcommittee in carrying out its duties.</text></paragraph>
<paragraph id="HE2F7BB938596448F916AE15DF594606C"><enum>(2)</enum><header>Other Federal agencies</header><text>Upon request of the Subcommittee, any other Federal agency that is a member of the Subcommittee may detail, on a nonreimbursable basis, personnel to assist the Subcommittee in carrying out its duties.</text></paragraph></subsection> <subsection id="H31C980998C244EF29AFC2641468356E6"><enum>(h)</enum><header>Powers</header><text>In carrying out this section, the Subcommittee may hold hearings, receive evidence and assistance, provide information, conduct research, and author reports, as the Subcommittee considers appropriate.</text></subsection>
<subsection id="H5AEF9103FCC2486488C4E87D4CC592D9"><enum>(i)</enum><header>Termination</header><text display-inline="yes-display-inline">The Subcommittee shall terminate not later than 3 years after the submission of the report required under subsection (c)(1).</text></subsection> <subsection id="H42D97703BE244A439472C5F51A8A872C"><enum>(j)</enum><header>Updates and implementation</header> <paragraph id="HF31EEBCB73F4449EB397933B3C1DC2A1"><enum>(1)</enum><header>In general</header><text>Beginning not later than 90 days after the submission of the assessment under subsection (c)(1), the Administrator shall—</text>
<subparagraph id="H3FCC0066E6D841C39E483C5116C28977"><enum>(A)</enum><text>coordinate the implementation of the recommendations, and actions to address the findings, as described in such assessment, where appropriate; and</text></subparagraph> <subparagraph id="H03A6C0C7ED80410D87BA294B1B933B89"><enum>(B)</enum><text display-inline="yes-display-inline">provide updates annually thereafter, until the date that is 1 year after the date on which the Subcommittee terminates, to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate containing—</text>
<clause id="HBA841CE040DB4E77B913E851117D4395"><enum>(i)</enum><text>the implementation status of the findings and recommendations of the assessment; and</text></clause> <clause id="HA76FE647754049758B9EF88A6B522035"><enum>(ii)</enum><text>any other findings and recommendations that the Subcommittee may provide in the course of its duties.</text></clause></subparagraph></paragraph>
<paragraph id="H985615A8113F4F47923D09068805C0DC"><enum>(2)</enum><header>Findings</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, and annually thereafter until the termination of the Subcommittee, the Administrator shall submit to the Committee on Homeland Security of the House of Representatives, submit to the Committee on Homeland Security and Governmental Affairs of the Senate, and make available to the public a report on the actions taken by the Administrator to incorporate and implement the findings and recommendations from the assessment described in subsection (c)(1), and any other findings and recommendations that the Subcommittee may provide, into all relevant Agency policies, plans, programs, strategies, and operations.</text></paragraph></subsection></section> <section id="HC85574A9953847DD91B91E93332E6E86"><enum>7.</enum><header>Assessment of climate change risks and preparedness</header> <subsection id="H5044569CDBB9439B86ED22A8774870C4"><enum>(a)</enum><header>In general</header><text>Not later than 4 years after the date of enactment of this Act, and every 4 years thereafter, the Administrator shall publish as a report, submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate, and make available to Congress and the public, a comprehensive assessment of climate change risks and preparedness, which shall—</text>
<paragraph id="HC98766DFB4CB45558AFE80D06E9407B0"><enum>(1)</enum><text>incorporate and expand upon the findings and recommendations made by the Subcommittee;</text></paragraph> <paragraph id="H954C5F6973084FE594DF2CEA9CDADC5D"><enum>(2)</enum><text>identify, predict, and assess existing and future natural disaster risks and impacts posed by climate change to States, cities, and communities throughout the United States, including the current and potential impact to annual disaster, mitigation, and insurance costs, as well as to natural disaster mitigation, adaptation, preparedness, response, and recovery capabilities and efforts;</text></paragraph>
<paragraph id="H0690B90C53FE40D69E3D3D7E7048D9B6"><enum>(3)</enum><text>identify, predict, and assess risks and impacts to frontline communities, particularly low-income communities, communities of color, and Tribal communities;</text></paragraph> <paragraph id="H53EE8A547BD24BF2B7E62C3FC535EB45"><enum>(4)</enum><text>assess the current state of preparedness throughout the emergency management community, and across all levels of government, in relation to the expected natural disaster risks and impacts posed by climate change;</text></paragraph>
<paragraph id="HD65C18ED26F640D6B21E3B8AAC93B6BC"><enum>(5)</enum><text>identify steps taken by FEMA to integrate climate change into all relevant Agency policies, plans, programs, strategies, and operations;</text></paragraph> <paragraph id="HFDCAE3E8C6924578A794D5793D49F240"><enum>(6)</enum><text>identify measures taken by FEMA to increase climate change resilience, adaptation, and mitigation throughout the United States, and to increase overall preparedness of the entire emergency management community;</text></paragraph>
<paragraph id="H0F6D92D98F534FBD830B12BA1D99B79B"><enum>(7)</enum><text>provide recommendations and best practices for how FEMA, all relevant partners, and the national emergency management community can better prepare for, mitigate, and adapt to the present and future national disaster risks and impacts posed by climate change, including specific recommendations and best practices for increasing climate change resilience, adaptation, and mitigation in frontline communities;</text></paragraph> <paragraph id="H9705360EAD2446A7857842E7BD84A560"><enum>(8)</enum><text>describe climate change mitigation, adaptation, and resilience methods adopted in no fewer than 5 communities across the United States, including at least—</text>
<subparagraph id="H4486B7FC1D144B9BBA4B7ECF1EF79F65"><enum>(A)</enum><text>1 urban community;</text></subparagraph> <subparagraph id="HA3177F44A2F947BCAAA71BEA1875D78C"><enum>(B)</enum><text>1 rural community;</text></subparagraph>
<subparagraph id="H6EAC14E4416A42778B40D222B62F3218"><enum>(C)</enum><text>1 coastal community; and</text></subparagraph> <subparagraph id="HBF34A54263564CBD9AE413AFA2FCACEC"><enum>(D)</enum><text>1 frontline community; and</text></subparagraph></paragraph>
<paragraph id="HBA9F86E8BE2A4231A11C726305AEDB97"><enum>(9)</enum><text>incorporate any other components and sections as the Administrator determines appropriate.</text></paragraph></subsection> <subsection id="H03081AD0CE1A473ABC026D7E6085CF1C"><enum>(b)</enum><header>Methodology</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall report to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate on the methodology that will be used to conduct the analysis and produce the assessment required under subsection (a).</text></subsection></section>
<section id="H6093DE2AD7FF4D00B5292830A68B58B0"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text> <paragraph id="H6F74220CDB4046ABB34E1C62CCF0C11F"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <quote>Administrator</quote> means the Administrator of FEMA.</text></paragraph>
<paragraph id="H0506D95BC4F34FB781E7502A53CC51B4"><enum>(2)</enum><header>Agency; FEMA</header><text display-inline="yes-display-inline">The terms <quote>Agency</quote> and <quote>FEMA</quote> mean the Federal Emergency Management Agency.</text></paragraph> <paragraph id="H73CD0FBD98C4433E96B416A3E7D1E8AB"><enum>(3)</enum><header>Climate change</header><text>The term <quote>climate change</quote> means the long-term shifts in global and regional climate patterns, and associated phenomena, that are occurring primarily as a result of anthropogenic greenhouse gas emissions.</text></paragraph>
<paragraph id="HD2B044149EEA4EB494D149E89E2922B6"><enum>(4)</enum><header>Extreme weather events</header><text display-inline="yes-display-inline">The term <quote>extreme weather events</quote> means historically rare or severe natural disasters such as heat waves, droughts, floods, tornadoes, and hurricanes.</text></paragraph> <paragraph id="H3704205ED2414694853F83A86F59B672"><enum>(5)</enum><header>Frontline community</header><text display-inline="yes-display-inline">The term <quote>frontline community</quote> means a low-income community, community of color, or Tribal community that is disproportionately impacted or burdened by climate change and associated phenomena.</text></paragraph>
<paragraph id="H452AE443DFD94596B403D84DC9DA139C"><enum>(6)</enum><header>Sea-level rise</header><text display-inline="yes-display-inline">The term <quote>sea-level rise</quote> means the local, regional, and global long-term trends in rising average sea levels that are occurring as a direct result of climate change and additional local factors such as land subsidence.</text></paragraph></section> </legis-body> </bill>
