Select)</committee-name>, and <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish prohibitions on the use of automated systems in a discriminatory manner, and for other purposes.</official-title></form><legis-body id="H05C68E897D604DAF8284C0758C665248" style="OLC"><section id="H6D025A556AE847CFA3CEFC61AAADD7A5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Digital Civil and Human Rights Act of 2022</short-title></quote>.</text></section><section id="H99E8B14D54014B59B44870131DEB79BF"><enum>2.</enum><header>Prohibition of discriminatory use of automated systems</header><subsection id="H9B80E2EFE76048CE9583A004E8804B47"><enum>(a)</enum><header>In general</header><text>No Federal agency, court of the United States, State government, local government, or tribal government may use any automated decision system that has a disparate impact on the basis of race, national origin, color, religion, disability, or sex.</text></subsection><subsection id="H890360E0D6294FA4AEE8A2904B625777"><enum>(b)</enum><header>Publicly available repository</header><text>The head of each Federal agency shall maintain a site on the public website of the Federal agency that contains a bias datasheet for each automated decision system used by such Federal agency with the potential for a disparate impact on the bases established under subsection (a).</text></subsection><subsection id="HF114EBA37A014DB797CF455EF778DB4A"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section the term <quote>bias datasheet</quote> means a datasheet conforming to the standard published pursuant to section 22B of the National Institute of Standards and Technology Act.</text></subsection><subsection id="H076DB02C639B443EA0252DF33CA90F96"><enum>(d)</enum><header>Prohibition against discrimination or segregation in places of public accommodation</header><text>Section 201 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a">42 U.S.C. 2000a</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H2AE47FC84BB94E5086C4C58983624342" display-inline="no-display-inline"><subsection id="HD301A0F6DC744CEFBF6C73962B1496BB"><enum>(f)</enum><text display-inline="yes-display-inline">It shall be an unlawful practice for a place of public accommodation to use in its operations affecting commerce any automated decision system (as such term is defined in section 701) that has a disparate impact on the basis of race, color, religion, sex, or national origin.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE7080677DBC84E09B6245A3BEDDBD51F"><enum>(e)</enum><header>Unlawful employment practices</header><text display-inline="yes-display-inline">Section 703 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-2">42 U.S.C. 2000e–2</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H694521A7D2244B269E70FB5DC08A7843" display-inline="no-display-inline"><subsection id="HE2A413CA92CE455BAD615E8D74093B7A"><enum>(o)</enum><text display-inline="yes-display-inline">It shall be an unlawful employment practice for a respondent, in connection with the selection or referral of applicants or candidates for employment or promotion, to use any automated decision system that has a disparate impact on the basis of race, color, religion, sex, or national origin.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEC683B94F4F043FE94345041A220458F"><enum>(f)</enum><header>Definitions in Civil Rights Act of 1964</header><text display-inline="yes-display-inline">Section 701 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-2">42 U.S.C. 2000e–2</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HC0712A620FF740B986A32A092D93F239" display-inline="no-display-inline"><subsection id="HF60CDD0FAD6C43C2A1420AB729327263"><enum>(o)</enum><text display-inline="yes-display-inline">The term <quote>automated decision system</quote> means any system, software, or process (including one derived from machine learning, statistics, or other data processing or artificial intelligence techniques and excluding passive computing infrastructure) that uses computation, the result of which serves as a basis for a decision or judgment.</text></subsection><subsection id="H700213E1D0394EAD9EA88A71D5C51960"><enum>(p)</enum><text>The term <quote>court of the United States</quote> has the meaning given such term in section 451 of title 28, United States Code. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H06A11AC5405F40949A9B5C39C4277901"><enum>(g)</enum><header>rulemaking</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the head of each Federal agency, in coordination with the Director of the Office of Management and Budget, shall make rules to carry out this section and the amendments made by this section.</text></subsection></section><section id="H03980459DC9641FC8686321454E0E684"><enum>3.</enum><header>Prohibition of bias in use of automated systems by the department of defense</header><subsection id="HC20E7C7B081B4B1D992A8FE647AC863E"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/3">Chapter 3</external-xref> of title 10, United States Code, is amended by adding at the end the following new section:</text><quoted-block id="HA78B931AA6954CB78AF0122FB7D858AE" style="USC"><section id="HA9BAF232205E4B67A8135199B7A002F8"><enum>130l.</enum><header>Prohibition of use of automated systems with bias</header><subsection id="H86A7FCD0C78644B192D87292A5AD5055"><enum>(a)</enum><header>In general</header><text>None of the funds authorized to be appropriated or otherwise made available for any fiscal year for the Department of Defense may be used for the use of any automated decision system with any adverse distinction based on race, religion, sex, health, age, or any other similar criteria.</text></subsection><subsection id="HD1B25BBA1235422AB613B39A3C05D45B"><enum>(b)</enum><header>Publicly available repository</header><text>Not later than one year after the effective date of this section, the Secretary of Defense shall maintain a site on the public website of the Department of Defense that contains a bias datasheet for each automated decision system used by the Department of Defense with the potential for an adverse distinction on the bases established under subsection (a).</text></subsection><subsection id="H7A133F76B93A4500A03E06DA6997C557"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3084E7D511FA4D83A2764459515D8A1F"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>automated decision system</quote> has the meaning given such term in section 701 of the Civil Rights Act of 1964.</text></paragraph><paragraph id="H731F326560024E24B33C4384132A960F"><enum>(2)</enum><text>The term <quote>adverse distinction</quote> has the meaning given such term through the application of the Geneva Conventions and customary international law.</text></paragraph><paragraph id="H7ABBB7A9C321492F83E5606F64022C83"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>bias datasheet</quote> means a datasheet conforming to the standard published pursuant to section 22B of the National Institute of Standards and Technology Act and includes an addendum related to international law.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCD8C32853F314AF380C8C9648BBE1C03"><enum>(b)</enum><header>Report required</header><paragraph id="HAAB61AAEA55A4FA6BE82F4DC922AF318"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of Defense, in coordination with the Secretary of State, shall submit to the appropriate congressional committees a report on the implementation of the amendments made by this section.</text></paragraph><paragraph id="H57E4A063E4694CCB88E153D95874F4A8"><enum>(2)</enum><header>Elements</header><text>The report required by subsection (b) shall include the following:</text><subparagraph id="HAC226F8A92644DD6A76E36BFE5D3A4A9"><enum>(A)</enum><text>An accounting of regulations prescribed, revised, or withdrawn in the implementation of the prohibition created under subsection (a).</text></subparagraph><subparagraph id="H2B9506EB2A9847AF8837D8D488FB5ED5"><enum>(B)</enum><text>An identification and assessment of any automated decision systems used by the Department of Defense prior to the enactment of this Act which had an adverse distinction based on race, religion, sex, health, age, or any other similar criteria.</text></subparagraph><subparagraph id="H123E8AB9A8054ADF848926B9A33B3ECB"><enum>(C)</enum><text>Recommendations for actions to affirm the same prohibition for all parties to the Geneva Conventions.</text></subparagraph></paragraph><paragraph id="H7F6295F307D84475AF92719686FFC577"><enum>(3)</enum><header>Form</header><text>The report under paragraph (1) shall be submitted in unclassified form, but may contain a classified annex. The unclassified portion of the report shall be posted on a publicly available website of the Department of Defense.</text></paragraph></subsection><subsection id="HA464BC3E9B06478F8F3105C47159AB72"><enum>(c)</enum><header>Definition</header><text>In this section the term <quote>appropriate congressional committees</quote> means—</text><paragraph id="H1E9A26C5BF7B4681889DABF6D415CF14"><enum>(1)</enum><text>the congressional defense committees;</text></paragraph><paragraph id="HB5D3C7EE206E47158A5F4F06EB3EF9A6"><enum>(2)</enum><text>the Committee on Foreign Relations and the Select Committee on Intelligence of the Senate; and</text></paragraph><paragraph id="H81E13A715BE441F1968F8C7C08317DF6"><enum>(3)</enum><text>the Committee on Foreign Affairs and the Permanent Select Committee on Intelligence of the House of Representatives.</text></paragraph></subsection><subsection id="H38F44FCCF4644DF8A822C5631653E356"><enum>(d)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 130k the following new item:</text><quoted-block id="H8B6A403EDC2D41129D9E3E510601620C" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">130l. Prohibition of use of automated systems with bias.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9B3BF5C56CA041BC99E29F0F2201EB0E"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date that is one year after the date of the enactment of this Act.</text></subsection></section><section id="H3FF500CF0275441AAEC976E3CC44A224"><enum>4.</enum><header>Report on intelligence community use of automated decision systems with bias</header><subsection id="H3D35F0B3610D4168A85689C04CD56F49"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the appropriate congressional committees a report on the use within the intelligence community of automated decision systems with an adverse distinction based on race, religion, sex, health, age, or any other similar criteria.</text></subsection><subsection id="H9AEB2E31EA574CB3878E0DE09A2866C9"><enum>(b)</enum><header>Elements</header><text>The report required by subsection (a) shall include the following:</text><paragraph id="HBC489191FB724F11B9052C37AFAD2D98"><enum>(1)</enum><text>An accounting of the automated decision systems used by the intelligence community, excluding cyberspace operations, with the potential for an adverse distinction based on race, religion, sex, health, age, or any other similar criteria.</text></paragraph><paragraph id="HD100D2AB4E0F4CCB8ACD3A2CF44D0913"><enum>(2)</enum><text>An assessment of any adverse distinctions based on race, religion, sex, health, age, or any other similar criteria.</text></paragraph><paragraph id="HC54E0345B65F4A0F95B72BB3842468C7"><enum>(3)</enum><text>An assessment of the impact of a prohibition within the intelligence community on automated decision systems with an adverse distinction based on race, religion, sex, health, age, or any other similar criteria.</text></paragraph><paragraph id="H155F56FBEE224AE0A807751283C54248"><enum>(4)</enum><text>An assessment of the programs and funding required to replace within the intelligence community any automated decision systems with an adverse distinction based on race, religion, sex, health, age, or any other similar criteria.</text></paragraph></subsection><subsection id="HD4740651A68C4CAF9DC609D1C956C579"><enum>(c)</enum><header>Form</header><text>The report under subsection (a) may be submitted in classified form, but if so submitted shall include an unclassified executive summary. The unclassified portion of the report shall be posted on a publicly available website of the Office of the Director of National Intelligence.</text></subsection><subsection id="HE0280036FCAE473A9251CE37CC00F3BD"><enum>(d)</enum><header>Definition</header><text>In this section:</text><paragraph id="H6EB35DD553364B168447E2057019E5BC"><enum>(1)</enum><text>The term <quote>appropriate congressional committees</quote> means—</text><subparagraph id="H0A5246B7BD404A3AA1249DC7BC154C8F"><enum>(A)</enum><text>the congressional defense committees;</text></subparagraph><subparagraph id="HCAC37146580E4B1192597D0A8F9B26E5"><enum>(B)</enum><text>the Committee on Foreign Relations and the Select Committee on Intelligence of the Senate; and</text></subparagraph><subparagraph id="HA024C0BFA9004737A8BF465B0BF44D75"><enum>(C)</enum><text>the Committee on Foreign Affairs and the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph><paragraph id="HF60FE6289E9E4A38835E24AC59168AD5"><enum>(2)</enum><text>The term <quote>intelligence community</quote> has the meaning given such term in section 3003(4) of title 50, United States Code.</text></paragraph><paragraph id="HE9288CFA7182429685E46C4A81188C4C"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>automated decision system</quote> has the meaning given such term in section 701 of the Civil Rights Act of 1964.</text></paragraph><paragraph id="HA90A773DFAA14177A17105919D38CBD4"><enum>(4)</enum><text>The term <quote>adverse distinction</quote> has the meaning given such term through the application of the Geneva Conventions and customary international law.</text></paragraph></subsection></section><section id="HC9C102D0F43B4A14A0009FFE2E76A857"><enum>5.</enum><header>Establishment of datasheet standards on automated decision system bias</header><subsection id="H2ACF4B582A1F40208C0FD95BB015BFA0"><enum>(a)</enum><header>In general</header><text>The National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/271">15 U.S.C. 271 et seq.</external-xref>) is amended by inserting after section 22A the following new section:</text><quoted-block id="H2D64E02CA1E94B618584C6A3179D7487" style="OLC"><section id="HAF862E172E824DEAB2723B49A4B792D1"><enum>22B.</enum><header>Automated decision system bias datasheets</header><subsection id="H3D0E41F479574F878220652C804006F8"><enum>(a)</enum><header>In general</header><text>The Director of the Institute, in consultation with such researchers, private sector industry experts, legal experts, and civil rights experts as the Director considers appropriate, shall develop, publish, and maintain standards for reporting bias in an automated decision system.</text></subsection><subsection id="HC9D105BCBF32478486F39CC501811883"><enum>(b)</enum><header>Elements</header><text>The standards described in subsection (a) shall require the following:</text><paragraph id="H7BAD19B97E1F44F581873F3291375020"><enum>(1)</enum><text>An assessment of bias on the basis of race, national origin, color, religion, disability, sex, sexual orientation, or gender identity.</text></paragraph><paragraph id="HF5E52D97BADE40179930075E0A83EE18"><enum>(2)</enum><text>The source, size, and characteristics of any dataset used as the basis for the automated decision system.</text></paragraph><paragraph id="H4E7ED610FDD74A8EA7D8C64F12DB0931"><enum>(3)</enum><text>The content is accessible and machine readable in accordance with the 21st Century Integrated Digital Experience Act (<external-xref legal-doc="usc" parsable-cite="usc/44/3501">44 U.S.C. 3501</external-xref> note).</text></paragraph><paragraph id="HFA6EEA9EDC0E4F72AACEA434F3D75EDA"><enum>(4)</enum><text>Any other requirements as determined by the Director.</text></paragraph></subsection><subsection id="HAAB5164E42FE4F24BCE5EDF67379DB32"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section the term <quote>automated decision system</quote> has the meaning given such term in section 701 of the Civil Rights Act of 1964.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HBE62198F6D3648798A1D7D9F8AA96B98"><enum>(b)</enum><header>Deadline for implementation</header><text>Not later than 18 months after the date of the enactment of this Act, the Director shall initially publish the standards required under subsection (a).</text></subsection></section></legis-body></bill>
