which was referred to the <committee-name committee-id="HSY00">Committee on Science, Space, and Technology</committee-name>, and in addition to the Committee on <committee-name committee-id="HAS00">Armed Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require a study on the resiliency of space access infrastructure for national security requirements, and for other purposes.</official-title></form><legis-body id="H4E9CB2C178974DA5BC2A8D18754F5D4B" style="OLC"><section id="H9EEF8F74BE0D496E84DE00D25A3A403B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Spaceport Tiering for Access Resiliency Act</short-title></quote> or the <quote><short-title>STAR Act</short-title></quote>.</text></section><section id="H679EE91EB1DA44728701EBE20BCAD3F0"><enum>2.</enum><header>Study on space access infrastructure for national security resiliency</header><subsection id="HF897F6BE70444E8CBDF938E203225D2D"><enum>(a)</enum><header>Report</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Defense, in coordination with the Secretary of Transportation, shall submit to the appropriate congressional committees a report on the resiliency of space access infrastructure to meet national security requirements.</text></subsection><subsection id="HC01632D2D7CA40449FB4960455B56AE5"><enum>(b)</enum><header>Elements</header><text>The report under subsection (a) shall include the following:</text><paragraph id="HF12EC358D78D431D8B56BB1C51FB5165"><enum>(1)</enum><text>An identification of the current and projected launch requirements for national security missions, including with respect to payload, orbit type, orbit longitude, and orbit inclination.</text></paragraph><paragraph id="H122FC5C4206C446E9231F51B1D76F272" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">A categorization of each spaceport and other launch site by the capability of the spaceport and site—</text><subparagraph id="HEC972AD7476B458A955708BCE757355D" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">to meet the launch requirements of all national security missions;</text></subparagraph><subparagraph id="H844431687798459F9BED94C31D7B8BBC" commented="no"><enum>(B)</enum><text>to meet the launch requirements of a portion of national security missions;</text></subparagraph><subparagraph id="H55F84E61BDD44949BCEB331896A6A8E4" commented="no"><enum>(C)</enum><text>with respect to spaceports and sites not identified under subparagraph (A), to meet the launch requirements of all national security missions if the spaceport received improvements; and</text></subparagraph><subparagraph id="HD7C5CEF90FE84F3FAB684330A9B6705D" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">with respect to spaceports and sites not identified under subparagraph (A), (B), or (C), to meet the launch requirements of a portion of national security missions if the spaceport or site received improvements.</text></subparagraph></paragraph><paragraph id="H08EC5AC165604E9EA1B58FE1BEEC1DEC"><enum>(3)</enum><text>An assessment of the operational risks to each spaceport and site identified under paragraph (2).</text></paragraph><paragraph id="HF1A7FACBDF374EB189D2420FF308D64D"><enum>(4)</enum><text display-inline="yes-display-inline">An aggregation of the operational risks to the spaceports and sites identified under paragraph (2).</text></paragraph><paragraph id="HBFA502717AE64AB4806E06A9E7B12EE0"><enum>(5)</enum><text>An assessment of the vulnerabilities and the overall resiliency of space access for national security missions.</text></paragraph><paragraph id="H43A2452B62D44E1BB263EAB77F007C69" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">A strategy for spaceport infrastructure by the Federal Government, State or local government, or the private sector to ensure space access resiliency for national security missions.</text></paragraph><paragraph id="H00E4888DC6744C7EB1F23F6FD787683B" commented="no"><enum>(7)</enum><text>Recommendations for prioritization of Federal investment in spaceports to mitigate vulnerabilities to space access and improve resiliency.</text></paragraph><paragraph id="HDAC0AAB5A7A645B19A8BF35145C8688A"><enum>(8)</enum><text>Any other information as determined by the Secretaries specified in subsection (a).</text></paragraph></subsection><subsection id="H5AD242A41ECA4EE08AF32B00AF56C7F6"><enum>(c)</enum><header>Form</header><text>The report under subsection (a) shall be submitted in an unclassified form, but may include a classified annex if necessary. The Secretary shall make the unclassified portions of such report publicly available pursuant to section 122a of title 10, United States Code.</text></subsection><subsection id="H363E2AACA0DB4C308DC0FCCABB93F13C"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H17D202E569B74CD6AC357A6817846C49"><enum>(1)</enum><text>The term <term>appropriate congressional committees</term> means the following:</text><subparagraph id="H703851B31B38427D9B1AD501772373FC"><enum>(A)</enum><text>The congressional defense committees.</text></subparagraph><subparagraph id="H6365AB6889F3424A969F181DA5EFBD81"><enum>(B)</enum><text display-inline="yes-display-inline">The Committee on Transportation and Infrastructure, the Committee on Science, Space, and Technology, and the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph><subparagraph id="HBAFD13C0D1144A65B63ACE93C7B4FAD3"><enum>(C)</enum><text display-inline="yes-display-inline">The Committee on Commerce, Science, and Transportation and the Select Committee on Intelligence of the Senate.</text></subparagraph></paragraph><paragraph id="HFDACDAFE8105439CB4291FDB55B05879"><enum>(2)</enum><text>The term <term>congressional defense committees</term> has the meaning given that term in section 101(a)(16) of title 10, United States Code.</text></paragraph><paragraph id="HC19B4F4945514546946D2DB8984F13DB"><enum>(3)</enum><text>The term <term>operational risk</term> includes—</text><subparagraph id="HB0DFBEA58BF54613AB19AAD1E1381764"><enum>(A)</enum><text>a cyber attack;</text></subparagraph><subparagraph id="HB7CF15A88DB148BBAC949D27EB056BC9"><enum>(B)</enum><text>a conventional military or terrorist attack;</text></subparagraph><subparagraph id="H629CBF0B7A204F5BA1A70613E2EFB467" commented="no"><enum>(C)</enum><text>an extreme weather event that could occur during the fifteen-year period beginning on the date of the enactment of this Act;</text></subparagraph><subparagraph id="H75F0224AF6CC4BE4902875B509EAE3D8"><enum>(D)</enum><text>an action by an adversary to deny space access, including intentional creation of orbital debris;</text></subparagraph><subparagraph id="H5BB2B94614E74716BE92FF308C6F2C28"><enum>(E)</enum><text>a limitation due to launch vehicle design constraint;</text></subparagraph><subparagraph id="HE064189474894147B68956BED2E9793E"><enum>(F)</enum><text>a disruption to critical infrastructure necessary for launch activity; and</text></subparagraph><subparagraph id="HB1C9BA30F89A48038FE6D16EE1BF83CD"><enum>(G)</enum><text>any other threat to space access as determined by the Secretaries specified in subsection (a).</text></subparagraph></paragraph><paragraph id="H8ED86BEC8FE348B089B0F135C7AF7D9A"><enum>(4)</enum><text display-inline="yes-display-inline">The term <quote>other launch site</quote> means a non-governmental launch and re-entry site used exclusively by a private entity. </text></paragraph><paragraph id="H0F5AF2BD80074FFBBA44E94F447C490D"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>spaceport</term> has the meaning given such term in section 80101 of title 51, United States Code, as added by section 3.</text></paragraph></subsection></section><section id="H4DD8E2C8F60F44A489D59875DD20F88A"><enum>3.</enum><header>Establishment of spaceport policy and planning</header><subsection id="HADA0C1FD1BD84846BD8EA719BF28BEB9" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title 51, United States Code, is amended—</text><paragraph id="H81ED3E109BD4490E9B498D0C442CDB51" commented="no"><enum>(1)</enum><text>by adding at the end the following new subtitle:</text><quoted-block style="USC" id="HAE4848566C6649F8A10B4500E3A8A7A6" display-inline="no-display-inline"><subtitle id="H9463514AE4694334963B9C98819E4691" commented="no"><enum>VIII</enum><header>Spaceports</header><chapter id="H3F9266981BAA438C88CA804053687294" commented="no"><enum>801</enum><header>Spaceports</header><toc regeneration="no-regeneration"><toc-entry level="section">Sec. </toc-entry><toc-entry level="section">80101. Definition. </toc-entry><toc-entry level="section">80102. Policy. </toc-entry><toc-entry level="section">80103. Establishment of Office of Spaceports. </toc-entry><toc-entry level="section">80104. Tiering. </toc-entry><toc-entry level="section">80105. National plan for spaceports.</toc-entry></toc><section id="H2D803D8C99654E8F8A4925C2E3AF3BFE" commented="no"><enum>80101.</enum><header>Definition</header><text display-inline="no-display-inline">In this subtitle, the term <quote>spaceport</quote> means a launch or reentry site that is—</text><paragraph id="HF5CE197C4C954F08B8E8BDF81689B051"><enum>(1)</enum><text display-inline="yes-display-inline">operated by an entity licensed by the Secretary of Transportation; or</text></paragraph><paragraph id="H4C7EFDBA722344E5BB5CC1F3B6AEC890"><enum>(2)</enum><text display-inline="yes-display-inline">owned or operated by the Secretary of Defense.</text></paragraph></section><section id="HFC8AAAEBDAF549F1A049F159593B27CB" commented="no"><enum>80102.</enum><header>Policy</header><subsection id="H530866AC53D34E9ABD3B469280E25D9F" commented="no"><enum>(a)</enum><header>In general</header><text>It is the policy of the United States—</text><paragraph id="HAE33E6F7A59643F5A114FB2DB31FF7EE" commented="no"><enum>(1)</enum><text>to encourage the development of spaceports to serve efficiently and effectively private sector and United States Government access to space;</text></paragraph><paragraph id="H926CCDB5F86F45ED8BDCFD6730C716C3" commented="no"><enum>(2)</enum><text>that redundant and resilient access to space is foundational to promoting economic development and national security;</text></paragraph><paragraph id="HCC23A46FFDCD4993A9D54C2503B728D4"><enum>(3)</enum><text>that access to space must be efficiently and fully integrated with the national airspace system; and</text></paragraph><paragraph id="H36B6B3045002462FBA9EDD2D65B575A4"><enum>(4)</enum><text>that safety and environmental considerations are critical components of access to space.</text></paragraph></subsection><subsection id="HCD9587C0BF624B61A12D00F356ED5EED" commented="no"><enum>(b)</enum><header>Priority policy</header><text>It is the policy of the United States to give special emphasis to developing spaceports capable of satisfying national security launch requirements.</text></subsection></section><section id="HB7D63D2D99EB49CBAF9316E83E85B61C" commented="no"><enum>80104.</enum><header>Tiering</header><subsection id="H800ABFC7309749A9916C932B7EDC8B56" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation shall establish a tiering system for spaceports that categorizes their operation for purposes of planning, development, and expenditure of funds.</text></subsection><subsection id="HE980DE716EFF4BCDBB3F985E67D532BF" commented="no"><enum>(b)</enum><header>Considerations</header><text>In establishing the tiering system for spaceports under subsection (a), the Secretary of Transportation shall consider the following:</text><paragraph id="HEB1426AF530548198E42EA41C150DAF0" commented="no"><enum>(1)</enum><text>The type of orbit which may be reached from the spaceport at issue, including if such spaceport is limited to suborbital launches.</text></paragraph><paragraph id="H586139FFB0CF4DCD82DBE3FD3DF4D0FB" commented="no"><enum>(2)</enum><text>The maximum payload capacity of such spaceport.</text></paragraph><paragraph id="H196C6DD3AF0243F480785612EFF57AF8" commented="no"><enum>(3)</enum><text>The annual launch capacity of such spaceport.</text></paragraph><paragraph id="H283DBA58CCD14A7BAEADB8FA1B3AC949" commented="no"><enum>(4)</enum><text>National security requirements.</text></paragraph></subsection></section><section id="HB32669F2F7EE435399AFF3D62B685CB5" commented="no"><enum>80105.</enum><header>National plan for spaceports</header><subsection id="H1158CA6E0F824CA1AD3085480BCC2FB3" commented="no"><enum>(a)</enum><header>In general</header><text>The Secretary of Transportation, in consultation with the Secretary of Defense, shall develop a plan, to be known as the <quote>national plan for spaceports</quote> (in this section referred to as the <quote>plan</quote>), for developing spaceports in the United States.</text></subsection><subsection id="HE7B4C03FFFDB491695DDD061B697F0E6" commented="no"><enum>(b)</enum><header>Considerations</header><text>The plan shall include the types and estimated cost of eligible spaceport development the Secretary of Transportation considers necessary to provide redundant and resilient access to space necessary to carry out the policies specified in section 80102.</text></subsection><subsection id="H2C6B345858A04ED791BF6DC8A028B8F0" commented="no"><enum>(c)</enum><header>Specific requirements</header><text>The plan shall include a categorization of spaceports pursuant to the tiers established under section 80104.</text></subsection><subsection id="H6208524CC69544AB87CF9CBE28197F23" commented="no"><enum>(d)</enum><header>Consultation</header><text>In developing the plan, the Secretary of Transportation shall, to the extent possible and as appropriate, consult with—</text><paragraph id="H579123F4407349399D5082BF99693BBE" commented="no"><enum>(1)</enum><text>departments, agencies, and instrumentalities of the United States Government;</text></paragraph><paragraph id="H95659CF6BC974273A50DCF21A8E07658" commented="no"><enum>(2)</enum><text>public agencies; and</text></paragraph><paragraph id="H92358AC6484545BB839D6CF7256A714F" commented="no"><enum>(3)</enum><text>the space community.</text></paragraph></subsection><subsection id="H38A9BD69F1C94D68B106861FDB6D1A7B" commented="no"><enum>(e)</enum><header>Availability of domestic military spaceport and spaceport facilities</header><text>To the extent possible, the Secretary of Defense shall make domestic military spaceports and spaceport facilities available for civil use. In consulting with the Secretary of Transportation under subsection (a), the Secretary of Defense shall indicate the extent to which domestic military spaceports and spaceport facilities are available for civil use.</text></subsection><subsection id="H3CE2F870AE9D489C9183DA620C89911E" commented="no"><enum>(f)</enum><header>Publication</header><text>The Secretary of Transportation shall publish the plan every two years.</text></subsection></section></chapter></subtitle><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HCFAF42E5CC9546FEAD906AB71884D3FD" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">by—</text><subparagraph id="HCECF599F78B94A6BAF3A0920568F5A9A" commented="no"><enum>(A)</enum><text>transferring section 51501 to subtitle VIII, as added by paragraph (1);</text></subparagraph><subparagraph id="H1E55223DEE2C4F7B8E47174A85F87FB0" commented="no"><enum>(B)</enum><text>inserting such section 51501 after section 80102, as so added by such paragraph; and</text></subparagraph><subparagraph id="H9AEFE890A1C9442D85FC7B320A39BE4C" commented="no"><enum>(C)</enum><text>redesignating such section 51501, as so transferred and inserted, as section 80103; and</text></subparagraph></paragraph><paragraph id="HE79F5B07D5884B15BBDA62494DCAAE0F" commented="no"><enum>(3)</enum><text>in such section 80103, as so transferred and redesignated—</text><subparagraph id="HB42F0372910D481799FFF0E494521E1A" commented="no"><enum>(A)</enum><text>in subsection (c)—</text><clause id="HF1C9F7F718F54366A2D4281BC6E5C562" commented="no"><enum>(i)</enum><text>in the matter preceding paragraph (1), by striking <quote>host</quote>; and</text></clause><clause id="HBFC766D02F0047E1B7B832D9AD4D9E18" commented="no"><enum>(ii)</enum><text>in paragraph (1), by inserting <quote>host</quote> before <quote>launches</quote>; and</text></clause></subparagraph><subparagraph id="H53CD092B31914FFC812CAA6DE40D3640" commented="no"><enum>(B)</enum><text>by striking subsection (e).</text></subparagraph></paragraph></subsection><subsection id="H7B7E90349D574A3185AABCAEB8363BD7"><enum>(b)</enum><header>Clerical amendments</header><text display-inline="yes-display-inline">Title 51, United States Code, is amended—</text><paragraph id="HB21A18FC8B0F4CABAC278D68E579F898"><enum>(1)</enum><text>in the table of subtitles—</text><subparagraph id="H370D91886553411EA5149D99B3EF31B8"><enum>(A)</enum><text>by adding at the end the following new items:</text><quoted-block style="USC" id="H48717F47DF8C415DB53B8F51B05D40AB" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="subtitle">Subtitle VIII—Spaceports </toc-entry><multi-column-toc-entry level="chapter"><toc-enum>801.</toc-enum><level-header level="chapter">Spaceports</level-header><target>80101</target></multi-column-toc-entry></toc><after-quoted-block>; </after-quoted-block></quoted-block><continuation-text continuation-text-level="subparagraph">and</continuation-text></subparagraph><subparagraph id="H837B760FE5D94D67A2D2F70A75B71A22"><enum>(B)</enum><text>by striking the item relating to chapter 515; and</text></subparagraph></paragraph><paragraph id="HCC81BCF783C64684ACB488AACF27F120" commented="no"><enum>(2)</enum><text>in subtitle V, by striking the heading relating to chapter 515.</text></paragraph></subsection></section><section id="H153F1B321164402290DF3047E4CBEC1B"><enum>4.</enum><header>Study on the establishment of a spaceport improvement plan</header><subsection id="H0B319C78EDC54C84B50BB33A91231BAF"><enum>(a)</enum><header>In general</header><text>Not later than two years after the date of the enactment of this Act, the Secretary of Transportation, in coordination with the Secretary of Defense and the Secretary of Commerce, after providing an opportunity for public comment, shall submit to the appropriate congressional committees a report on the implementation of a spaceport improvement program.</text></subsection><subsection id="H5B01D4A7D7EA4228AB0153C58827AA47"><enum>(b)</enum><header>Elements</header><text>The report under subsection (a) shall include the following:</text><paragraph id="H487EB7027AAC40458251C0A130FA78AB"><enum>(1)</enum><text>An assessment of the feasibility of establishing a spaceport trust fund for the improvement of spaceports.</text></paragraph><paragraph id="HDEB0A3170BEA4852BD7CD14D0C71AA07"><enum>(2)</enum><text>Recommendations for a fee structure to fund such a trust fund.</text></paragraph><paragraph id="HDC7C231F153A4DA6B1F6CB4444B7ACA5"><enum>(3)</enum><text>Recommendations for establishing a spaceport improvement program, including a grant program through which to distribute funds from such a trust fund.</text></paragraph><paragraph id="HBE39E5EFA8C74D1EA633BDE11D884448"><enum>(4)</enum><text>Recommendations for the tiers of spaceports under section 80104 of title 51, United States Code, as added by section 3, to be eligible to receive a grant under such spaceport improvement program.</text></paragraph><paragraph id="H141F1A0C6975495CAD8C27E55C7750BF"><enum>(5)</enum><text>Recommendations for the apportionment of funds to spaceports, including minimums, maximums, and prioritization of the distribution of such funds.</text></paragraph><paragraph id="HA57295003DB74A33AAF203CC428ED1BD"><enum>(6)</enum><text>Recommended modifications to the national plan for spaceports under section 80105 of title 51, United States Code, as added by section 3, to incorporate such spaceport improvement program.</text></paragraph></subsection><subsection id="HD176D83C78D0440F8684A702465DFDDE"><enum>(c)</enum><header>Form</header><text>The report under subsection (a) shall be—</text><paragraph id="H4DDF8A12012840E3B57A9C27667D317E"><enum>(1)</enum><text>submitted in an unclassified form; and</text></paragraph><paragraph id="H5B829C6F200348759D1F50DD032787B9"><enum>(2)</enum><text>posted on a publicly available website of the Department of Transportation.</text></paragraph></subsection><subsection id="H3970D4413E534918954D8B857765EC90"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HB4BB269B0B55436DA67B23BFF56E289C"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means the following:</text><subparagraph id="H496F5B6A3DB84745AE8CCEA49C962B27"><enum>(A)</enum><text>The Committee on Transportation and Infrastructure of the House of Representatives.</text></subparagraph><subparagraph id="H09AA77F79AC5499983503CEF6E5FF94E"><enum>(B)</enum><text>The Committee on Commerce, Science, and Transportation of the Senate.</text></subparagraph><subparagraph id="H48521B92351C477DBCE65C72DC193950"><enum>(C)</enum><text>The Committee on Science, Space, and Technology of the House of Representatives.</text></subparagraph><subparagraph id="HDCB8D6227B3C4ED78C85A9505DD136E5"><enum>(D)</enum><text>The congressional defense committees.</text></subparagraph></paragraph><paragraph id="H8D9F40FDD84F4BD6A7D6DE16B0DE6600"><enum>(2)</enum><header>Congressional defense committees</header><text>The term <quote>congressional defense committees</quote> has the meaning given such term in section 101(a)(16) of title 10, United States Code.</text></paragraph></subsection></section></legis-body></bill>
