R. 7390</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220404">April 4, 2022</action-date><action-desc><sponsor name-id="S001207">Ms. Sherrill</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To expand labor representation on State and local workforce development boards, to provide a definition of labor organization, and for other purposes.</official-title></form><legis-body id="H1A19AF717F224226A3B1EF6D809093A3" style="OLC"><section id="H3BD89C2C41B84A418ED891C0AE2F2882" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Labor Representation in the Workforce System Act</short-title></quote>.</text></section><section id="H381E8F5A749B4A6FA79A6ADA0B27FCFA"><enum>2.</enum><header>State workforce development boards</header><text display-inline="no-display-inline">Section 101(b)(1)(C)(ii)) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111(b)(1)(C)(ii)</external-xref>) is amended by striking <quote>20 percent</quote> and inserting <quote>30 percent</quote>.</text></section><section id="H1C05EF28DCCF407DAAFECABBCA7338E1"><enum>3.</enum><header>Local workforce development boards</header><text display-inline="no-display-inline">Section 107(b)(2)(B) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3122">29 U.S.C. 3122(b)(2)(B)</external-xref>) is amended by striking <quote>20</quote> and inserting <quote>30</quote>.</text></section><section id="H3CEA4C9918384A5FAF707FA69909D51C"><enum>4.</enum><header>Definition of labor organization</header><text display-inline="no-display-inline">Section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H00454FED0488478784CB67A65FEADB0A" display-inline="no-display-inline"><paragraph id="H7E334B8ADFC74332A4FE8353BA0B2119"><enum>(72)</enum><header>Labor organization</header><text display-inline="yes-display-inline">The term <term>labor organization</term> has the meaning given the term in section 2(5) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152(5)</external-xref>), except that such term shall also include—</text><subparagraph id="H1F6886F8F8CF451CB39D7008EFA73BAF"><enum>(A)</enum><text>any organization composed of labor organizations, such as a labor union federation or a State or municipal labor body; and</text></subparagraph><subparagraph id="H889F8C29A82E4A7198DF4D94F4CA3D7A"><enum>(B)</enum><text>any organization which would be included in the definition for such term under such section 2(5) but for the fact that the organization represents—</text><clause id="H50508585B96F4F1597B89DBF57116DBB"><enum>(i)</enum><text>individuals employed by the United States, any wholly owned Government corporation, any Federal Reserve Bank, or any State or political subdivision thereof;</text></clause><clause id="H99C64DEC4AB74C398D16B3E8672A1FC9"><enum>(ii)</enum><text>individuals employed by persons subject to the Railway Labor Act (<external-xref legal-doc="usc" parsable-cite="usc/45/151">45 U.S.C. 151 et seq.</external-xref>); or</text></clause><clause id="HEB5D8401C062487A8FAB9F6F3CBBDF5D"><enum>(iii)</enum><text>individuals employed as agricultural laborers.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
