which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To recapture certain unused immigrant visa numbers, and for other purposes.</official-title></form><legis-body id="HDE4A819505284299B3F5EC206D65C03A" style="OLC"><section id="HA3921D414AF9498CB5C98D1D3E776F4A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as—</text><paragraph id="H9B6F3040518F4781B9A0C80F79193282"><enum>(1)</enum><text>the <quote><short-title>Jumpstart Our Legal Immigration System Act</short-title></quote>; or</text></paragraph><paragraph id="HE20D30BFDCFA407BA1E75E69C4C70504"><enum>(2)</enum><text>the <quote><short-title>Jumpstart Act</short-title></quote>.</text></paragraph></section><section id="H03FB4E6EAB2F4B3E9B382E7B19CB0152"><enum>2.</enum><header>Recapture of unused immigrant visa numbers</header><subsection id="HC8D3A9DB396640509E9A49D45C89EC32"><enum>(a)</enum><header>Ensuring future use of all immigrant visas</header><text>Section 201(c)(1)(B)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(c)(1)(B)(ii)</external-xref>) is amended to read as follows:</text><quoted-block id="HB3869903550844A3AC5C849F185040A3" style="traditional"><clause id="H37F6EDD0877345E19C1B34DCF6703EB5" indent="up3"><enum>(ii)</enum><text>In no case shall the number computed under subparagraph (A) be less than the sum of—</text><subclause id="HCA13227C80BE4B5486921EB8EC3051FF"><enum>(I)</enum><text>226,000; and</text></subclause><subclause id="H8CDC784281E746C683D5045502A59308"><enum>(II)</enum><text>the number computed under paragraph (3).</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2AB68FCFA0F64E9DAE4C7A17AF77F0D8"><enum>(b)</enum><header>Recapturing unused visas</header><text>Section 201 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HEF354642637248EA8B1BE0CED5E66733" style="OLC"><subsection id="HF9463A7355CF4B149304E77B8DB22586"><enum>(g)</enum><header>Recapturing unused visas</header><paragraph id="H8152FC6FE8D548E89F106DA8A38C9538"><enum>(1)</enum><header>Family-sponsored visas</header><subparagraph id="HFEB00228B8F843D989A08FB73783317C"><enum>(A)</enum><header>In general</header><text>Notwithstanding the numerical limitations set forth in this section or in sections 202 or 203, beginning in fiscal year 2022, the number of family-sponsored immigrant visas that may be issued under section 203(a) shall be increased by the number computed under subparagraph (B).</text></subparagraph><subparagraph id="H5CCA3AE9357F47D2B6D3404922950574"><enum>(B)</enum><header>Unused visas</header><text>The number computed under this subparagraph is the difference, if any, between—</text><clause id="HB0FBB112E29C4B0E865B250D35CEA940"><enum>(i)</enum><text>the difference, if any, between—</text><subclause id="HC73FCEFF0FF04827AD882A36A515D575"><enum>(I)</enum><text>the number of visas that were originally made available to family-sponsored immigrants under section 201(c)(1) for fiscal years 1992 through 2021, setting aside any unused visas made available to such immigrants in such fiscal years under section 201(c)(3); and</text></subclause><subclause id="H468302ED114D477E8FAD718F71132D96"><enum>(II)</enum><text>the number of visas described in subclause (I) that were issued under section 203(a), or, in accordance with section 201(d)(2)(C), under section 203(b); and</text></subclause></clause><clause id="H2AF1B29FB8364C58A341E94CA864A05E"><enum>(ii)</enum><text>the number of visas resulting from the calculation under clause (i) issued under section 203(a) after fiscal year 2021.</text></clause></subparagraph></paragraph><paragraph id="HAC0802B17DF54136AA05ECC5EDC327DC"><enum>(2)</enum><header>Employment-based visas</header><subparagraph id="H4BE95636673C4ABC8E9CBEA09A75708B"><enum>(A)</enum><header>In general</header><text>Notwithstanding the numerical limitations set forth in this section or in sections 202 or 203, beginning in fiscal year 2022, the number of employment-based immigrant visas that may be issued under section 203(b) shall be increased by the number computed under subparagraph (B).</text></subparagraph><subparagraph id="H8FC09CA3509247B68126A52F47B102FD"><enum>(B)</enum><header>Unused visas</header><text>The number computed under this paragraph is the difference, if any, between—</text><clause id="H87B28F82728D4A5E85A66AF78282548E"><enum>(i)</enum><text>the difference, if any, between—</text><subclause id="H6146FCF3923444B587F9B9DB659B1243"><enum>(I)</enum><text>the number of visas that were originally made available to employment-based immigrants under section 201(d)(1) for fiscal years 1992 through 2021, setting aside any unused visas made available to such immigrants in such fiscal years under section 201(d)(2); and</text></subclause><subclause id="H2862EA5C925148A28EEEEB3ADA64328B"><enum>(II)</enum><text>the number of visas described in subclause (I) that were issued under section 203(b), or, in accordance with section 201(c)(3)(C), under section 203(a); and</text></subclause></clause><clause id="H65FF56C2B62C47EEAE599DC104B49AE7"><enum>(ii)</enum><text>the number of visas resulting from the calculation under clause (i) issued under section 203(b) after fiscal year 2021.</text></clause></subparagraph></paragraph><paragraph id="H63DB8C0DD0A7496F88FA74BBA0D52DEA"><enum>(3)</enum><header>Diversity visas</header><text>Notwithstanding section 204(a)(1)(I)(ii)(II), an immigrant visa for an alien selected in accordance with section 203(e)(2) in fiscal year 2017, 2018, 2019, 2020, or 2021 shall remain available to such alien (and the spouse and children of such alien) if—</text><subparagraph id="HBDA9D3F80CE0457F884E9FE856FECA7F"><enum>(A)</enum><text>the alien was refused a visa, prevented from seeking admission, or denied admission to the United States solely because of Executive Order 13769, Executive Order 13780, Presidential Proclamation 9645, or Presidential Proclamation 9983; or</text></subparagraph><subparagraph id="H3AE38D08FA714B07A06358D836AE3934"><enum>(B)</enum><text>because of restrictions or limitations on visa processing, visa issuance, travel, or other effects associated with the COVID–19 public health emergency—</text><clause id="H3CC022DCB65E4D95A3ABA55FF229654A"><enum>(i)</enum><text>the alien was unable to receive a visa interview despite submitting an Online Immigrant Visa and Alien Registration Application (Form DS–260) to the Secretary of State; or</text></clause><clause id="HC5C9DAE32E1746C89C3AA155E2DC12D2"><enum>(ii)</enum><text>the alien was unable to seek admission or was denied admission to the United States despite being approved for a visa under section 203(c).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H7E60183804AB44A4A35DA99F215B93F4"><enum>3.</enum><header>Adjustment of status</header><text display-inline="no-display-inline">Section 245 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HB35887E3DD8948A08F0DC085007C032E" style="OLC"><subsection id="H57DD4F00BD5F4B61A208A2AA105B633E"><enum>(n)</enum><header>Visa availability</header><paragraph id="H11AB1CDB70754391BECD4A0D1509F15B"><enum>(1)</enum><header>In general</header><text>Notwithstanding subsection (a)(3), the Secretary of Homeland Security may accept for filing an application for adjustment of status from an alien (and the spouse and children of such alien) if such alien is otherwise eligible for such adjustment and—</text><subparagraph id="H03D110E6E88F4C5B82CFA7AFFA96034F"><enum>(A)</enum><text>such alien—</text><clause id="HC37E4282DE764573B3DD95C854886EC4"><enum>(i)</enum><text display-inline="yes-display-inline">is the beneficiary of an approved petition under subparagraph (A)(i) or (B)(i)(I) of section 204(a)(1); and</text></clause><clause id="H036AFF01D6D64305B531C0428899F6E9"><enum>(ii)</enum><text>pays a supplemental fee of $1,500, plus $250 for each derivative beneficiary;</text></clause></subparagraph><subparagraph id="HCE5895471D4A41A0A136B26405524B4E" display-inline="no-display-inline"><enum>(B)</enum><text>such alien—</text><clause id="HBB70C784DE0743969DC50A7B4BF7929B"><enum>(i)</enum><text display-inline="yes-display-inline">is the beneficiary of an approved petition under subparagraph (E) or (F) of section 204(a)(1); and</text></clause><clause id="HA2D53A7D728147A2B781E18D40088B32"><enum>(ii)</enum><text>pays a supplemental fee of $3,000; or</text></clause></subparagraph><subparagraph id="H2380B6760D87468AAE9948E41CCF4262" display-inline="no-display-inline"><enum>(C)</enum><text>such alien—</text><clause id="H3ECC21C735E74D3684EA9CF05654EDE8"><enum>(i)</enum><text display-inline="yes-display-inline">is the beneficiary of an approved petition under subparagraph (H) of section 204(a)(1); and</text></clause><clause id="H74E4ADC0C0FF4567B9C5DC032ADF1CEC"><enum>(ii)</enum><text>pays a supplemental fee of $15,000.</text></clause></subparagraph></paragraph><paragraph id="HCFA51773C79E4927A62CC87D21FD4AFB"><enum>(2)</enum><header>Exemption</header><text>The Secretary of State shall exempt an alien (and the spouse and children of such alien) from the numerical limitations described in sections 201, 202, and 203, and the Secretary of Homeland Security may adjust the status of such alien (and the spouse and children of such alien) to lawful permanent resident, if such alien submits or has submitted an application for adjustment of status and—</text><subparagraph id="HA0A5661C39C4488BBA1AF68EB690FC9E"><enum>(A)</enum><text>such alien—</text><clause id="H2D5A5609851E4BDAA69F46A63F42F472"><enum>(i)</enum><text>is the beneficiary of an approved petition under subparagraph (A)(i) or (B)(i)(I) of section 204(a)(1) that bears a priority date that is more than 2 years before the date the alien requests an exemption the numerical limitations; and</text></clause><clause id="H549F1F028FE24CC9AF5774472EBB2489"><enum>(ii)</enum><text>pays a supplemental fee of $2,500;</text></clause></subparagraph><subparagraph id="H3A6AB129CD6741A1B2C84FFA6B8DD2D5"><enum>(B)</enum><text>such alien—</text><clause id="H1AC1AD6F103342D5B996911DEBFBBFED"><enum>(i)</enum><text>is the beneficiary of an approved petition under subparagraph (E) or (F) of section 204(a)(1) that bears a priority date that is more than 2 years before the date the alien requests an exemption of the numerical limitations; and</text></clause><clause id="H3312965BEBB743788BA2317994DB7BD9"><enum>(ii)</enum><text>pays a supplemental fee of $7,500; or</text></clause></subparagraph><subparagraph id="H0F4D36C6DC9240E1B4DD6AA77A2A29C4"><enum>(C)</enum><text>such alien—</text><clause id="HDDD2212883744D23BF1A9D14000A4BFC"><enum>(i)</enum><text>is the beneficiary of an approved petition under subparagraph (H) of section 204(a)(1) that bears a priority date that is more than 2 years before the date the alien requests an exemption of the numerical limitations; and</text></clause><clause id="H945EE62573F445D5B424D53BF62807A3"><enum>(ii)</enum><text>pays a supplemental fee of $100,000.</text></clause></subparagraph></paragraph><paragraph id="H15C38A388E2F4514B9749443868FFAF5"><enum>(3)</enum><header>Effective date</header><subparagraph id="HF0C368ED58264FF79FF430B4326DB409"><enum>(A)</enum><header>In general</header><text>The provisions of this subsection—</text><clause id="H41C3B9CADD804C2692305A85F6110AA2"><enum>(i)</enum><text>shall take effect on the earlier of the date that is—</text><subclause id="H42D1DD92696C408E89A7BC7312A17B2D"><enum>(I)</enum><text>180 days after the date of the enactment of this subsection; or</text></subclause><subclause id="H9FF86063200A4CC9BA7FBB7C5E73F3BE"><enum>(II)</enum><text>October 1, 2022; and</text></subclause></clause><clause id="HB4855A806002443FBE025DDBC58CDA8E"><enum>(ii)</enum><text>except as provided in subparagraph (B), shall cease to have effect on the date that is 10 years after the date of the enactment of this subsection.</text></clause></subparagraph><subparagraph id="H30724CBE930B4795B1D940A604A99F11"><enum>(B)</enum><header>Continuation</header><text>Paragraph (2) shall continue in effect with respect to an alien who requested a waiver of the numerical limitations and paid the requisite fee prior to the date described in subparagraph (A)(ii), until the Secretary of Homeland Security renders a final administrative decision on such application.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HD1BC75AA781547BCA6FB1B4E2EB86D29"><enum>4.</enum><header>Additional supplemental fees</header><subsection id="HC3AFF58333014849A02D7754A14E7465"><enum>(a)</enum><header>Treasury</header><text display-inline="yes-display-inline">Except as provided under subsection (e), the fees collected under this section and under section 245(n) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255(n)</external-xref>), as added by section 3 of this Act— </text><paragraph id="H2A6BFAAF0B904EE7AFC78DB1D74FC779"><enum>(1)</enum><text>shall be deposited in the general fund of the Treasury of the United States; and</text></paragraph><paragraph id="H7F7F0C48F8D0488986E8C1929C4F00B0"><enum>(2)</enum><text>may not be waived, in whole or in part, by the Secretary of Homeland Security.</text></paragraph></subsection><subsection id="H011303FB1D334583B8B2A3C50B41CB51"><enum>(b)</enum><header>Immigrant visa petitions</header><text display-inline="yes-display-inline">In addition to any other fee collected in connection with a petition referred to in this subsection, the Secretary of Homeland Security shall collect a supplemental fee in the amount of—</text><paragraph id="HF16F0C3FC43A46D4BFF135640EB966FB"><enum>(1)</enum><text>$100 in connection with each petition filed under—</text><subparagraph id="H81DC06B2D2E1402F8C3B4FBD2FCBCEE1"><enum>(A)</enum><text>section 204(a)(1)(A)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(A)(i)</external-xref>) for classification by reason of a relationship described under paragraph (1), (3), or (4) of section 203(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref>); and</text></subparagraph><subparagraph id="H23D328347E9840DDBDC96E1A9EAE8065"><enum>(B)</enum><text display-inline="yes-display-inline">section 204(a)(1)(B)(i)(I) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(B)(i)(I)</external-xref>);</text></subparagraph></paragraph><paragraph id="HE268AD9CD66549D495935C271D9B6859"><enum>(2)</enum><text>$800 in connection with each petition filed under subparagraph (E) or (F) of section 204(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)</external-xref>); and</text></paragraph><paragraph id="HA6CDCD3F4AF44FF69B3AB9F4AC1B2885"><enum>(3)</enum><text display-inline="yes-display-inline">$15,000 in connection with each petition filed under subparagraph (H) of section 204(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)</external-xref>). </text></paragraph></subsection><subsection id="HBF41178624A34FA8A7893DE91539629B"><enum>(c)</enum><header>Nonimmigrant visa petitions</header><text display-inline="yes-display-inline">In addition to any other fee collected in connection with a petition filed under section 214 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>), the Secretary of Homeland Security shall collect a supplemental fee of $500 in connection with each such petition for classification as a nonimmigrant under subparagraph (E), (H)(i)(b), (L), (O), or (P) of section 101(a)(15) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>). </text></subsection><subsection id="HB92AB312A2BD4F309E0A6FCC9685B0F1"><enum>(d)</enum><header>Employment authorization</header><text display-inline="yes-display-inline">In addition any other fee collected in connection with an application for employment authorization, the Secretary of Homeland Security shall collect a supplemental fee of $500 in connection with each such application filed by an individual seeking such authorization as the spouse of a nonimmigrant described in subparagraph (E), (H), or (L) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>). </text></subsection><subsection id="H496F137298DB4DA0BE7C3A2FDE5DE88F" commented="no"><enum>(e)</enum><header>Offsetting collections</header><text display-inline="yes-display-inline">The first $400,000,000 collected in the aggregate from fees authorized under this section and section 245(n) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>), as added by section 3 of this Act, shall be deposited in the <quote>Immigration Examinations Fee Account</quote> established under section 286(m) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356(m)</external-xref>) as offsetting collections, to be available until expended, to the extent and in the amounts provided in advance in appropriations Acts, for necessary expenses of U.S. Citizenship and Immigration Services for application processing, the reduction of backlogs within asylum, field, and service center offices, and support of the refugee program.</text></subsection><subsection id="H6C7A95000FB04C1182C8AE357B18A906"><enum>(f)</enum><header>Effective date</header><text>This section shall—</text><paragraph id="HB2A07B3ACB1B417F905958769C7AC0E4"><enum>(1)</enum><text>take effect on the earlier of the date that is—</text><subparagraph id="H8328D0866F0E46B9B26D0E1338E80F53"><enum>(A)</enum><text>180 days after the date of the enactment of this Act; or</text></subparagraph><subparagraph id="H63EE3ED8EECF4FA4933298DB0682B999"><enum>(B)</enum><text>October 1, 2022; and</text></subparagraph></paragraph><paragraph id="H514BF542AE8945F89C57D162F315B77F"><enum>(2)</enum><text display-inline="yes-display-inline">cease to have effect on the date that is 10 years after the date of the enactment of this section.</text></paragraph></subsection></section></legis-body></bill>
