which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Ukraine Freedom Support Act of 2014 to require the President to establish a semiconductor supply chain working group in response to the Russian invasion of Ukraine and submit reports to Congress on potential future disruptions to the supply chain.</official-title></form><legis-body id="HA9F60CF47ACD4925BC685E70102061EA" style="OLC"><section id="HEFD2C1B3C688426A877522633B5E6A6A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Semiconductor Supply Chain Materials from Authoritarians Act</short-title></quote>.</text></section><section id="H05A24EB780DD4552A1B962D1A7A79AB3"><enum>2.</enum><header>Amendments to the Ukraine Freedom Support Act of 2014</header><text display-inline="no-display-inline">The Ukraine Freedom Support Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/22/8921">22 U.S.C. 8921 et seq.</external-xref>) is amended—</text><paragraph id="H48F890B1B4554E9CBBAF92A4B066B0F7"><enum>(1)</enum><text>by redesignating section 11 as section 13; and</text></paragraph><paragraph id="H6C1364D02AD24B7BBD94107940C46FCF"><enum>(2)</enum><text>by inserting after section 10 the following new sections:</text><quoted-block style="OLC" id="H1E004E5E8C1941BABB29E3D870FA0452" display-inline="no-display-inline"><section id="H70B2B4480E8F45988B0A9ADE587019DB"><enum>11.</enum><header>Working Group on Semiconductor Supply Disruptions</header><subsection id="HB8706ABAF68043C8B556DBAA57D545F2"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this section, the President shall establish an interagency working group to address semiconductor supply chain issues caused by the Russia’s illegal and unprovoked attack on Ukraine.</text></subsection><subsection id="HFDDECCF1352C4F28B22446BA8C740D87"><enum>(b)</enum><header>Membership</header><text>The interagency working group established pursuant to subsection (a) shall be comprised of the head, or designee of the head, of each of the following:</text><paragraph id="H6008285212D441869BA068392E05D164"><enum>(1)</enum><text>The Department of State.</text></paragraph><paragraph id="H4984B7DC1440465F937E6B293A722355"><enum>(2)</enum><text>The Department of Defense.</text></paragraph><paragraph id="HFA29AF45ADFA4B02898C3E0CE2308216"><enum>(3)</enum><text>The Department of Commerce.</text></paragraph><paragraph id="H82FC4C9A66414C6D85F4D594E29FFA24"><enum>(4)</enum><text>The Department of the Treasury.</text></paragraph><paragraph id="HAE13AC1765654023BFE6BABA6213E2B8"><enum>(5)</enum><text>The Office of the United States Trade Representative.</text></paragraph><paragraph id="H1D166BFDC3644BC49DF542A040681B9A"><enum>(6)</enum><text>The Department of Interior.</text></paragraph><paragraph id="H525900B7E0C4462C998FE880A0072A1B"><enum>(7)</enum><text>The Department of Energy.</text></paragraph><paragraph id="HCBEF88BE3B6A4A0A92C1CA38DF0B6ADC"><enum>(8)</enum><text>The Department of Homeland Security.</text></paragraph><paragraph id="H2A7DD52C55D346DD9AD93942B0DE586B"><enum>(9)</enum><text>The Department of Labor.</text></paragraph><paragraph id="HC01D8EB69D4A442887C5547073DF19B9"><enum>(10)</enum><text>Any other Federal department or agency the President determines appropriate.</text></paragraph></subsection><subsection id="H2EB201CEE572472D8C025EF599B2A5EC"><enum>(c)</enum><header>Chair</header><text>The Secretary of State shall serve as the chair of the working group established pursuant to subsection (a).</text></subsection></section><section id="H520A74407BE74FD7BF48F7E5360D5DF1"><enum>12.</enum><header>Reports on semiconductor supply chain disruptions</header><subsection id="HBA6A615E7FB245A8B2D41E483BCCC0C8"><enum>(a)</enum><header>Report on impact of Russia’s invasion of Ukraine</header><text>Not later than 60 days after the date of the enactment of this section, the Secretary of State shall submit to the committees listed in subsection (b) a report of the interagency working group that—</text><paragraph id="H9610167996F04863A971989D8EEE853D"><enum>(1)</enum><text>reviews and analyzes—</text><subparagraph id="HF7382CE43BF4474FB5171F2A345326E4"><enum>(A)</enum><text>the impact of Russia’s unprovoked attack on Ukraine on the supply of palladium, neon gas, helium, and hexafluorobutadiene (C4F6); and</text></subparagraph><subparagraph id="H9AEE9C3399344215917FDC49555B0CDE"><enum>(B)</enum><text>the impact, if any, on supply chains and the global economy;</text></subparagraph></paragraph><paragraph id="HF601721C45054F0BBA40B1FD7735CCA4"><enum>(2)</enum><text>recounts diplomatic efforts by the United States to work with other countries that mine, synthesize, or purify palladium, neon gas, helium, or hexafluorobutadiene (C4F6);</text></paragraph><paragraph id="H6E23A463393F4009B89FF388A0BA5688"><enum>(3)</enum><text>quantifies the actions resulting from these efforts to diversify sources of supply of these items;</text></paragraph><paragraph id="H81FC74B43CFB4FFCBCCC1366664104F7"><enum>(4)</enum><text>sets forth steps the United States has taken to bolster its production or secure supply of palladium or other compounds and elements listed in paragraph (1)(A);</text></paragraph><paragraph id="HFDB73ABCB1D64DD9A7EBEA46CC7D9FCC"><enum>(5)</enum><text>lists any other important elements, compounds, or products in the semiconductor supply chain that have been affected by Russia’s illegal attack on Ukraine; and</text></paragraph><paragraph id="HE69372FA741643D3936334327D9FFD3E"><enum>(6)</enum><text>recommends any potential legislative steps that could be taken by Congress to further bolster the supply of elements, compounds, or products for the semiconductor supply chain that have been curtailed as a result of Russia’s actions.</text></paragraph></subsection><subsection id="H7F9E23ABA03B4D0AB1E276785DDF061B"><enum>(b)</enum><header>Committees listed</header><text display-inline="yes-display-inline">The committees listed in this subsection are—</text><paragraph id="H30C881266EC54D0FAC60F87E3F6F1ACB"><enum>(1)</enum><text>the Committee on Foreign Affairs and the Committee on Energy and Commerce of the House of Representatives; and</text></paragraph><paragraph id="H4EC65EE55CF045ACBD55D4320BC5110C"><enum>(2)</enum><text>the Committee on Foreign Relations and the Committee on Commerce, Science, and Transportation of the Senate.</text></paragraph></subsection><subsection id="H2DFBB2749AA04DFF9E17EAB784352269"><enum>(c)</enum><header>Annual report on potential future shocks to semiconductor supply chains</header><paragraph id="HED177F33CBE6489B8413B3B8F786168B"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this section, and annually thereafter for 5 years, the Secretary of State shall submit to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate a report of the interagency working group that—</text><subparagraph id="HE9D4A920DC584518A090C3AEDC9CCA64"><enum>(A)</enum><text>outlines and plans for the most likely future geopolitical developments that could severely disrupt global semiconductor supply chains in ways that could harm the national security or economic interests of the United States;</text></subparagraph><subparagraph id="H83EB13F5CB6D41A5B7C5BFB59A68668E"><enum>(B)</enum><text>forecasts the various potential impacts on the global supply chain for semiconductors, and products that use semiconductors, from the developments outlined pursuant to subparagraph (A), as well as the following contingencies—</text><clause id="H32A2B3E5AEAB4034956167A574423BAE"><enum>(i)</enum><text>an invasion of Taiwan or geopolitical instability or conflict in East Asia;</text></clause><clause id="HDAB6FF1FAFC54603AB8ED731A3F5ACE6"><enum>(ii)</enum><text>a broader war or geopolitical instability in Europe;</text></clause><clause id="HD3F76C2A8CF84E348395F924AC32D9F1"><enum>(iii)</enum><text>strategic competitors dominating parts of the supply chain and leveraging that dominance coercively;</text></clause><clause id="HDAB202965B894A94B1BDFF81F61BDCFB"><enum>(iv)</enum><text>a future international health crisis; and</text></clause><clause id="HDC066713ED574E4099B8EAB1314BFEA3"><enum>(v)</enum><text>natural disasters or shortages of natural resources and raw materials;</text></clause></subparagraph><subparagraph id="H127407B884424E1BB360A3494D01A01B"><enum>(C)</enum><text>describes the kind of continency plans that would be needed for the safe evacuation of individuals with deep scientific and technical knowledge of semiconductors and their supply chain from areas under risk from conflict or natural disaster; and</text></subparagraph><subparagraph id="HB99DB2DD9AD3498BB8CA09E5C2C18670"><enum>(D)</enum><text>evaluates the current technical and supply chain work force expertise within the Federal government to carry out these assessments.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
