R. 7358</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220401">April 1, 2022</action-date><action-desc><sponsor name-id="D000216">Ms. DeLauro</sponsor> (for herself and <cosponsor name-id="S001216">Ms. Schrier</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Food, Drug, and Cosmetic Act to apply the exempt infant formula requirements to certain human donor milk, and for other purposes.</official-title></form><legis-body id="H0140582943C34D4699C53B35968C3F38" style="OLC"><section id="H5E9440DFBDA8441C8592E0C4C394DE05" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Donor Milk Safety Act</short-title></quote>. </text></section><section id="H843A174055A64C1F858A55B2A9004A54"><enum>2.</enum><header>Application of exempt infant formula requirements to certain human donor milk</header><text display-inline="no-display-inline">Section 412(h) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350a">21 U.S.C. 350a(h)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="traditional" id="H4FB06A4A19CD47EE9FE7E46AC7AA725D" display-inline="no-display-inline"><paragraph id="H2C61A581A9964A26A44BD1D5D2FB5C0A" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Effective beginning one year after the date of the enactment of this paragraph, the exemption under paragraph (1) shall apply with respect to human milk which has undergone any bioburden reduction process in the same manner as such exemption applies with respect to infant formula described in such paragraph. Not later than one year after such date of enactment, the Secretary shall make such revisions as may be necessary to the regulations prescribed by the Secretary under paragraph (2) to carry out the preceding sentence. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
