which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act to modify the procedure to designate a foreign state, and for other purposes.</official-title></form><legis-body id="HE1A093FA22C74A918E802B64339510DA" style="OLC"><section id="HCFB51156AC3649F981049502CA21F5A6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>TPS Reform Act of 2022</short-title></quote>.</text></section><section id="H90723C8721AF4C7DA71E64295F11BEF8" section-type="subsequent-section"><enum>2.</enum><header>Temporary Protected Status</header><subsection id="H9C255FE556214F48AF102295FA7B8896"><enum>(a)</enum><header>Power To designate a foreign state</header><text display-inline="yes-display-inline">Section 244(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(b)</external-xref>) is amended—</text><paragraph id="H10B90747CF3349179163F2EC4676F1C4"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraphs (1), (2), and (3) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H1C08788D53D4400ABC3433FB39722820" style="OLC"><paragraph id="H0D3AF956F4D9479881F3260E7DDA613F"><enum>(1)</enum><header>Initial designation</header><text display-inline="yes-display-inline">For purposes of this section, a foreign state shall be designated upon the enactment of an Act that satisfies the following requirements:</text><subparagraph id="H057C824F17204969A1A9D78F7270C09D"><enum>(A)</enum><text>The Act shall contain a finding—</text><clause id="HBF3169E1798046BFBE1E3CB31D5FFCC6"><enum>(i)</enum><text>that there is an ongoing armed conflict within the state and, due to such conflict, requiring the return of aliens who are nationals of that state (or to the part of the state) would pose a serious threat to their personal safety;</text></clause><clause id="H92C4AAF125494BFC97311D1818A4212A"><enum>(ii)</enum><text>that—</text><subclause id="H619FE58E3CD04CB1B1EC3B1B2391E3DC"><enum>(I)</enum><text>there has been an earthquake, flood, drought, epidemic, or other immediately life-threatening environmental disaster in the state resulting in a substantial, but temporary, disruption of living conditions in the area affected;</text></subclause><subclause id="HA5752F82ECF048A19AC7C08A98359C5C"><enum>(II)</enum><text>the foreign state is unable, temporarily, to handle adequately the return to the state of aliens who are nationals of the state; and</text></subclause><subclause id="H889C85F9D179436C9657D8113274236B"><enum>(III)</enum><text>the foreign state officially has requested designation under this subparagraph; or</text></subclause></clause><clause id="HF594F545CA13491281EA2177C49BFD3F"><enum>(iii)</enum><text>that there exist extraordinary and temporary conditions in the foreign state that prevent aliens who are nationals of the state from returning to the state in safety and that permitting the aliens to remain temporarily in the United States is not contrary to the national interest of the United States.</text></clause></subparagraph><subparagraph id="H5BE85C9638144A09A9BBF1B5F3FC3B5D"><enum>(B)</enum><text display-inline="yes-display-inline">The Act shall include—</text><clause id="H32F1CA28F7364A3C9DCFDEA20DD4C5A6"><enum>(i)</enum><text display-inline="yes-display-inline">an estimate of the number of nationals of the foreign state who are (or within the effective period of the designation are likely to become) eligible for temporary protected status under this section;</text></clause><clause id="H195BC508BAC746F59566383D0259D955"><enum>(ii)</enum><text display-inline="yes-display-inline">such nationals’ immigration status in the United States; and</text></clause><clause id="HDB4190B3AE584EC9A94216EA6B9C38C9"><enum>(iii)</enum><text display-inline="yes-display-inline">a time period for the effectiveness of the designation that is not greater than 18 months.</text></clause></subparagraph></paragraph><paragraph id="H9ECDD7387A7F49B19BD1AEDFB8696158"><enum>(2)</enum><header>Termination</header><subparagraph id="H838E70675082496C9BEA4732F4C66105"><enum>(A)</enum><header>Timely termination</header><text>If an initial designation of a foreign state is not extended under paragraph (3), the initial designation shall terminate at the end of the time period described in paragraph (1)(B)(iii).</text></subparagraph><subparagraph id="H3D6C0024CA544F02915E28D91F29CEB0"><enum>(B)</enum><header>Early termination</header><text display-inline="yes-display-inline">For purposes of this section, the designation of a foreign state shall be terminated upon the enactment of an Act that contains a finding that the foreign state (or part of such foreign state) no longer meets the conditions for designation under paragraph (1)(A).</text></subparagraph></paragraph><paragraph id="H9E797DDE10D94B24A699E33A5AE5BA8A"><enum>(3)</enum><header>Extension</header><text display-inline="yes-display-inline">For purposes of this section, the time period for the effectiveness of the designation of a foreign state shall be extended upon the enactment of an Act that includes—</text><subparagraph id="HCBEFCD335B96407BBB28B013EB7F63C8"><enum>(A)</enum><text>a finding that the conditions for designation under paragraph (1)(A) continue to be met; and</text></subparagraph><subparagraph id="H7EB8CAD85D5C4197B6AB53BD666BEE02"><enum>(B)</enum><text>a time period for the effectiveness of the extension that is not greater than 12 months.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HCEC695102C4C414982F5C55611E0C02A"><enum>(2)</enum><text>in paragraph (5)(A), by striking <quote>of the Attorney General</quote> and inserting <quote>made in any Act</quote>.</text></paragraph></subsection><subsection id="H0FEAC2E815DA45608BFD4B86CFDC8492"><enum>(b)</enum><header>Aliens lacking lawful immigration status</header><text display-inline="yes-display-inline">Section 244(c)(2)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(c)(2)(B)</external-xref>) is amended—</text><paragraph id="H76B3A89DB3D34BCB970F68DA661E2E87"><enum>(1)</enum><text>in clause (i), by striking <quote>, or</quote> at the end and inserting a semicolon;</text></paragraph><paragraph id="H5A8E3FE3FC6B4E87A90307BF148A473E"><enum>(2)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H550AB5A21AF34AEBB6CA2556134DF0F1"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HE89B99C7DC0242DFA9B4921476B70839" style="OLC"><clause id="HDE27C75D6F424509B94195D620B551F4"><enum>(iii)</enum><text display-inline="yes-display-inline">the alien lacks a lawful immigration status.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H547A65B4BCB94B12A8A846A86C05A81E"><enum>(c)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a et seq.</external-xref>) is amended—</text><paragraph id="H20C9112531304D8AB171CA0CB1B856D2"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d)(3), by striking <quote>If the Attorney General terminates the designation of a foreign state (or part of such foreign state) under subsection (b)(3)(B)</quote> and inserting <quote>If the designation of a foreign state (or part of such foreign state) is terminated under section 244(b)(2)</quote>; and</text></paragraph><paragraph id="HF94D83C8EAAF42458D475A4C73381AE1"><enum>(2)</enum><text>in subsection (i)(1)—</text><subparagraph id="HB247871CD590483ABA20E1C05CD89475"><enum>(A)</enum><text>in subparagraph (A), by striking the comma at the end and adding <quote>; and</quote>;</text></subparagraph><subparagraph id="H148719F27FB344C2A23E6F1CC4BB8B60"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>, and</quote> at the end and inserting a period; and</text></subparagraph><subparagraph id="HE1A6C52DD32447D082A1FAB1B756FB22"><enum>(C)</enum><text>by striking subparagraph (C).</text></subparagraph></paragraph></subsection><subsection id="H15BEEA68FD1E44D786FE26242825A10A"><enum>(d)</enum><header>Technical corrections</header><text>Section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>), as amended by subsections (a) and (b) of this Act, is further amended by striking <quote>Attorney General</quote> each place it appears and inserting <quote>Secretary of Homeland Security</quote>.</text></subsection></section></legis-body></bill>
