R. 7352</legis-num><associated-doc role="report" display="yes">[Report No. 117–328]</associated-doc><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220331">March 31, 2022</action-date><action-desc><sponsor name-id="V000081">Ms. Velázquez</sponsor> (for herself and <cosponsor name-id="L000569">Mr. Luetkemeyer</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><action display="yes"><action-date date="20220517">May 17, 2022</action-date><action-desc>Additional sponsors: <cosponsor name-id="M000687">Mr. Mfume</cosponsor>, <cosponsor name-id="D000629">Ms. Davids of Kansas</cosponsor>, and <cosponsor name-id="V000134">Ms. Van Duyne</cosponsor></action-desc></action><action display="yes"><action-date date="20220517">May 17, 2022</action-date><action-desc>Reported from the <committee-name committee-id="HSM00">Committee on Small Business</committee-name>; committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Small Business Act to extend the statute of limitation for fraud by borrowers under the Paycheck Protection Program, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="H0AB1F1028F5F4B5A965A8AE1873ED551" style="OLC"><section id="H331C884210164EE3B201CB7F55A7E6BF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PPP and Bank Fraud Enforcement Harmonization Act of 2022</short-title></quote>.</text></section><section id="HB04BEE1C0CBE435889AC8A6B3025D4BE"><enum>2.</enum><header>Fraud enforcement harmonization</header><subsection id="HB3AB55127E7E4FDBA24A861DB7FD3E74"><enum>(a)</enum><header>Paycheck Protection Program</header><text display-inline="yes-display-inline">Section 7(a)(36) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block id="H56AA96DC23F944918F5BE54D3E1A31C6" style="OLC"><subparagraph id="H0D7138FB45DF4CB880ECA59367F9F38E"><enum>(W)</enum><header>Fraud enforcement harmonization</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any criminal charge or civil enforcement action alleging that a borrower engaged in fraud with respect to a covered loan guaranteed under this paragraph shall be filed not later than 10 years after the offense was committed.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD54CD88CB2B84C479759C4013CDEBFE5"><enum>(b)</enum><header>Paycheck protection program second draw loans</header><text display-inline="yes-display-inline">Section 7(a)(37) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(37)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block id="H54EB6A5F8D934DBC85F40CA686C67FBE" style="OLC"><subparagraph id="HDAD4F24D34E4492282D83DBE9BEF403A"><enum>(P)</enum><header>Fraud enforcement harmonization</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any criminal charge or civil enforcement action alleging that a borrower engaged in fraud with respect to a covered loan guaranteed under this paragraph shall be filed not later than 10 years after the offense was committed.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body><endorsement><action-date date="20220517">May 17, 2022</action-date><action-desc> Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
