R. 732</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210202">February 2, 2021</action-date><action-desc><sponsor name-id="S001175">Ms. Speier</sponsor> (for herself, <cosponsor name-id="C001068">Mr. Cohen</cosponsor>, <cosponsor name-id="J000032">Ms. Jackson Lee</cosponsor>, <cosponsor name-id="J000306">Mr. Jones</cosponsor>, <cosponsor name-id="S001205">Ms. Scanlon</cosponsor>, and <cosponsor name-id="C001072">Mr. Carson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit unconscionable pricing of emergency supplies for responders during a Federal emergency period, and for other purposes.</official-title></form><legis-body id="HD35DFADC6E3D4F1EB3142094E4CCB03B" style="OLC"><section id="H55093301CC8A479EA03B24B47AAD797D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unconscionable Pricing Act</short-title></quote>.</text></section><section id="HB8AF2443429A474C97F5F4A2FCFE09E2" commented="no"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="H15B69EA4D51D4F61AEE7DD2FE3D76F31" commented="no"><enum>(1)</enum><text>to protect local and State government agencies and private and nonprofit organizations acting in response to the covered emergency to protect the health, safety, and welfare of persons; and</text></paragraph><paragraph id="H780F181246A34EF6945696BFCBEA3D48" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">to make it unlawful for any person to impose or otherwise charge unconscionable prices to responders in the region or State affected by a covered emergency for the purchase or procurement of emergency supplies during the period of the covered emergency.</text></paragraph></section><section id="HEB52296434AD4852A4178E6EBA0B5F42"><enum>3.</enum><header>Prohibition of unconscionable pricing during declared state of emergency</header><subsection id="H8005F272257049F4ACF617BC23D874F4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">During an emergency period it shall be unlawful for any person to impose unconscionable prices in the region or State affected by the emergency declaration for the sale, rental, lease, or procurement of any emergency supply.</text></subsection><subsection id="HB4868F7D020D4D38ACB85A6175957DD2"><enum>(b)</enum><header>Factors for consideration</header><text>In determining whether a seller has violated subsection (a), a price shall be considered unconscionable if any person during the emergency period charges a price that exceeds, by an amount equal to or in excess of 10 percent the average price at which the same or similar emergency supply was obtainable in the affected area during 30 days before the emergency declaration was issued and the increase in price charged is not attributable to reasonable costs incurred in connection with the rental or sale of the emergency supply.</text></subsection><subsection id="HBCD1D1ED8746458C982B2EBEDA0B41D5"><enum>(c)</enum><header>Enforcement</header><paragraph id="H4A6190D4D38748AE8E09D87C7EB4AD58"><enum>(1)</enum><header>Enforcement by the Federal Trade Commission</header><subparagraph id="HF7B63F40A29E485B848AF84A3411743C"><enum>(A)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of subsection (a) shall be treated as a violation of a regulation under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></subparagraph><subparagraph id="H5195F62BD74A41EBB2EBE428FCD09F27"><enum>(B)</enum><header>Powers of commission</header><text>The Commission shall enforce subsection (a) in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41</external-xref> et seq.) were incorporated into and made a part of this Act. Any person who violates such subsection shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></subparagraph></paragraph><paragraph id="HFE639A8C783744F09436EB0FDB0247CB"><enum>(2)</enum><header>Effect on other laws</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed in any way to limit the authority of the Commission under any other provision of law or to limit the application of any Federal or State law.</text></paragraph><paragraph id="H4A503783E2AF4773A7095196104837C1"><enum>(3)</enum><header>Enforcement by State attorneys general</header><subparagraph id="H39326499D3294FBBB178D4D5514FC6F6"><enum>(A)</enum><header>In general</header><text>If the chief law enforcement officer of a State, or an official or agency designated by a State, has reason to believe that any person has violated or is violating subsection (a), the attorney general, official, or agency of the State, in addition to any authority it may have to bring an action in State court under its consumer protection law, may bring a civil action in any appropriate United States district court or in any other court of competent jurisdiction, including a State court, to—</text><clause id="HD552D2E9039B479C919AEDFCEAA81D6F"><enum>(i)</enum><text>enjoin further such violation by such person;</text></clause><clause id="H2AD7C311CC964919BC3B158D71018F89"><enum>(ii)</enum><text>enforce compliance with such subsection;</text></clause><clause id="H1FC7ABCEEDEE44AC8C5FCE05F0CFB570"><enum>(iii)</enum><text>obtain civil penalties; and</text></clause><clause id="H4FFF33FF1DC64177903B3878651E8876"><enum>(iv)</enum><text>obtain damages, restitution, or other compensation on behalf of residents of the State.</text></clause></subparagraph><subparagraph id="H672BE2C8922E405F8CEA7C5413A1F6C6"><enum>(B)</enum><header>Notice and intervention by the Federal Trade Commission</header><text>The attorney general of a State shall provide prior written notice of any action under subparagraph (A) to the Commission and provide the Commission with a copy of the complaint in the action, except in any case in which such prior notice is not feasible, in which case the attorney general shall serve such notice immediately upon instituting such action. The Commission shall have the right—</text><clause id="H1B4AEF56F24D44479C9634D031389F6D"><enum>(i)</enum><text>to intervene in the action;</text></clause><clause id="H2F630CBF41C24478BB04E1185E8B59B0"><enum>(ii)</enum><text>upon so intervening, to be heard on all matters arising therein; and</text></clause><clause id="H427D4F0D8A37489C906B6F7B3B53C0B8"><enum>(iii)</enum><text>to file petitions for appeal.</text></clause></subparagraph><subparagraph id="H7D8DFE3095694321B4430AD7958E8C35"><enum>(C)</enum><header>Limitation on State action while Federal action is pending</header><text>If the Commission has instituted a civil action for violation of this section, no State attorney general, or official or agency of a State, may bring an action under this paragraph during the pendency of that action against any defendant named in the complaint of the Commission for any violation of this Act alleged in the complaint.</text></subparagraph></paragraph></subsection><subsection id="HC0670931B34542998F3681A27A33352D"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HC80CC9DE90304BD0B8C39525C2DE112B"><enum>(1)</enum><header>Emergency declaration</header><text>The term <term>emergency declaration</term> means—</text><subparagraph id="H57987872FFEB4770881E9C6B1B55F242"><enum>(A)</enum><text>a public health emergency declared pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>); and</text></subparagraph><subparagraph id="H0FD8FFD54BC443FF999C9CEFB4625EA3"><enum>(B)</enum><text>a declaration of emergency declared pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref> note).</text></subparagraph></paragraph><paragraph id="H309C856D248F4CFCA2B293E1298A7AC4"><enum>(2)</enum><header>Emergency period</header><text>The term <term>emergency period</term> means the period of time following an emergency declaration, including a renewal thereof, and for a period of 30 days after such period ends.</text></paragraph><paragraph id="HA6F4997F636442938AB9D1C8DF984F47"><enum>(3)</enum><header>Emergency supply</header><text>The term <term>emergency supply</term> means any good, material, or equipment needed by responders to protect the health, safety, and welfare of persons during the emergency period.</text></paragraph><paragraph id="H2051C4DF7E774641A609492940FF9C19"><enum>(4)</enum><header>Person</header><text>The term <term>person</term> shall include, but not be limited to, natural persons, corporations, trusts, partnerships, incorporated or unincorporated associations, and any other legal entity.</text></paragraph><paragraph id="HC66131FD667146DAB7D4DEEB4E9CFBF7"><enum>(5)</enum><header>Responders</header><text>The term <term>responders</term>—</text><subparagraph id="HA8D15FDA95CF407998EB8FFC2AD18416"><enum>(A)</enum><text>means any local or State governmental agency and private and nonprofit organizations, whether incorporated or unincorporated, acting in response to the covered emergency to protect the health, safety, and welfare of persons; and</text></subparagraph><subparagraph id="HEE517594294E4814B059246E5F17B904"><enum>(B)</enum><text>includes State and local departments responsible for health and human services, State procurement agencies, hospitals, and medical facilities.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
