which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Workforce Innovation and Opportunity Act to clarify the career services provided to adults and dislocated workers, and for other purposes.</official-title></form><legis-body id="H94EA2B31D6D841E2A89574D7DE832D73" style="OLC"><section id="H5F6AECD1723C4E55BE1D9FEBB880453D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Navigating to Success Act</short-title></quote>.</text></section><section id="H05F39BA72EF54256B44C2D0C24633664"><enum>2.</enum><header>Career services</header><subsection id="HDA2FB94DAC884D4BBDDD402A178F9358"><enum>(a)</enum><header>Services provided</header><text display-inline="yes-display-inline">Subparagraph (A) of section 134(c)(2) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(c)(2)</external-xref>) is amended—</text><paragraph id="HE6E80A9EAEDC452AAE10A4C2759F0995"><enum>(1)</enum><text>by amending clause (iii) to read as follows: </text><quoted-block style="OLC" id="H6F8428E16ECB41549F060B37F3BFCE9E" display-inline="no-display-inline"><clause id="H4C2237244D844C05AF41A10429B35A78"><enum>(iii)</enum><text display-inline="yes-display-inline">initial assessment of skill levels (including literacy, digital literacy, numeracy, and English language proficiency), competencies, abilities, current applicable foreign academic and professional credentials, guidance and services on transferring high-skilled foreign certifications, and supportive service needs, which may include diagnostic testing and use of other assessment tools;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H38F7F2C088B947FE8CE0BD6CB26CF86C"><enum>(2)</enum><text>by amending clause (vi) to read as follows: </text><quoted-block style="OLC" id="H86E223679422482CA2EC7BE0F8C314E2" display-inline="no-display-inline"><clause id="H0EC5D688FF774FC5A600F1CF6C9F6404"><enum>(vi)</enum><text display-inline="yes-display-inline">provision of workforce and labor market employment statistics information and related skills development information, including the provision of accurate information relating to local, regional, and national labor market areas, including—</text><subclause id="H9E5A99EB4F10405FB45DE5FDC655BCF6"><enum>(I)</enum><text>job vacancy listings in such labor market areas;</text></subclause><subclause id="H0CE9BF1BF3534FFB98A7D2F7F14C62C3"><enum>(II)</enum><text>information on job skills and credentials necessary to obtain the jobs described in subclause (I); and</text></subclause><subclause id="HF3DF6E883ACB493AA3B131462044592E"><enum>(III)</enum><text>information on education and skills development programs that are available for attaining needed skills and credentials for the jobs described in subclause (I), including information—</text><item id="H3B324CDBB15045A0AAAD7BE6E24E264B"><enum>(aa)</enum><text>on the pathways to such skills and credentials (including information on career pathway programs in the local area); </text></item><item id="HF93C2725BF3F480E888C7BFCD442D435"><enum>(bb)</enum><text>on the quality of such education and training programs, consistent with the performance information provided under clause (vii); and</text></item><item id="HBC48A0B3AA584FE6AD83C585F1AF9B67"><enum>(cc)</enum><text display-inline="yes-display-inline">on the comparability of current foreign academic and professional certifications to needed skills and credentials; and </text></item></subclause><subclause id="H94ED90E93E92448FA8D7F7781CF9C543"><enum>(IV)</enum><text>information relating to local occupations in demand and the earnings, skill requirements, and opportunities for advancement for such occupations; and</text></subclause></clause><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="H375CA49BB67245F197B641CE53DC4DB7"><enum>(3)</enum><text>by amending clause (xi) to read as follows: </text><quoted-block style="OLC" id="H130A74502543497BAF0BC58F3C4D335E" display-inline="no-display-inline"><clause id="H3815C93FD74145DDB1608830749F0E45"><enum>(xi)</enum><text display-inline="yes-display-inline">assistance in identifying and establishing eligibility for programs of financial aid assistance for training and education programs that are not funded under this Act, including Federal financial aid under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>) and through State-funded education and training programs;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HB94797680DE24BD29A095365D19B31E9"><enum>(4)</enum><text>in clause (xii), by striking subclauses (IV) through (XI) and inserting the following: </text><quoted-block style="OLC" id="H41F1C77836984E39B98B8F0919B3286F" display-inline="no-display-inline"><subclause id="HAA4A2EFB06D34CF9931E1BCC8400BCE0"><enum>(IV)</enum><text display-inline="yes-display-inline">individual counseling, including career counseling;</text></subclause><subclause id="H83B717AA12734B32B1D4AEC8C54ACF69"><enum>(V)</enum><text>career planning; </text></subclause><subclause id="H1DDBD80C26104D95BA6E87AAEE077909"><enum>(VI)</enum><text>assessment and development of employability skills, including development of learning skills, communication skills, interviewing skills, punctuality, and professional conduct, to prepare individuals for unsubsidized employment or training; </text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H329235517504404FAAE6D1D5DBAFA2CF" commented="no"><enum>(b)</enum><header>Delivery of services</header><text display-inline="yes-display-inline">Subparagraph (C) of section 134(c)(2) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(c)(2)</external-xref>) is amended by inserting <quote>or community-based organizations to serve individuals with barriers to employment,</quote> after <quote>nonprofit service providers,</quote>. </text></subsection></section></legis-body></bill>
