R. 7301</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220330">March 30, 2022</action-date><action-desc><sponsor name-id="P000096">Mr. Pascrell</sponsor> (for himself and <cosponsor name-id="B001298">Mr. Bacon</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To protect survivors from brain injury by authorizing the Secretary of Health and Human Services to collect data on the prevalence of brain injuries resulting from domestic and sexual violence.</official-title></form><legis-body id="H5B64DC4D40C1410D942965824B537034" style="OLC"><section section-type="section-one" id="H14E0386344D14D038705300A941FF503"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Survivors from Traumatic Brain Injury Act of 2022</short-title></quote>.</text></section><section id="H5E62FEE8EADA45998FB983A88FA53178"><enum>2.</enum><header>Data collection</header><subsection id="HA052EB2257E8485DAC1F781F66C7C5EF"><enum>(a)</enum><header>Collection of data on brain injuries related to domestic and sexual violence</header><paragraph id="H30C0449D717C4C599ED3C225EE840954"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>) shall collect data on the prevalence of brain injuries resulting from domestic and sexual violence in order to assist the Department in understanding, addressing, and allocating resources to reduce and treat such injuries and the cause of such injuries. </text></paragraph><paragraph id="H2F796D7B569642BF9BE088184CF01704"><enum>(2)</enum><header>Collection</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Secretary shall distribute a survey that follows up on, and operates under the National Intimate Partner and Sexual Violence Survey (NISVS) that will ask questions about the prevalence and circumstances surrounding brain injuries due to domestic and sexual violence. The Secretary shall allow for data collection for not fewer than 2 years. </text></paragraph><paragraph id="H82A7855CCA1C409B9A90784E5818D6BF"><enum>(3)</enum><header>Privacy</header><text display-inline="yes-display-inline">Data shall be collected, stored, and analyzed under this section in a manner that protects individual privacy and confidentiality.</text></paragraph></subsection><subsection id="H2CBEDF833F90428B97D3DF1986AA0B7E"><enum>(b)</enum><header>Report</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall submit to relevant congressional committees, and post on the website of the Department of Health and Human Services, a report that shall contain— </text><paragraph id="HAEBD0A6F7E2A4784B6BF27E78F6FB6DB"><enum>(1)</enum><text display-inline="yes-display-inline">an analysis of the data collected under subsection (a) relating to the connection between domestic and sexual violence and brain injuries; and</text></paragraph><paragraph id="HFFDD42E92C9443B1A7AE6A6B6D4B1719"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the steps that the Department of Health and Human Services is taking to increase awareness, increase services, decrease prevalence, and otherwise respond to the public health issue of brain injury that results from domestic and sexual violence.</text></paragraph></subsection><subsection id="HFBBF7701D1BC461D96D9928B433EE6B6"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated such sums as may be necessary to carry out this section. Amounts appropriated under this subsection shall remain available for a 3-year period.</text></subsection><subsection id="HF8B48D3F655D4C4D93EC22BC5D46A5E9"><enum>(d)</enum><header>Definition</header><text>In this section, the term <term>brain injury</term> means an injury that impacts the function of the brain as a result of trauma, choking, or strangulation due to domestic or sexual violence. </text></subsection></section></legis-body></bill>
