R. 72</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210104">January 4, 2021</action-date><action-desc><sponsor name-id="B001260">Mr. Buchanan</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to provide additional aggravating factors for the imposition of the death penalty based on the status of the victim.</official-title></form><legis-body id="H2D7FC4768B9F4AB6831F2721F5AFA30C" style="OLC"><section id="HE9DAAB4DDDF344DEAF43775FC46E1209" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Thin Blue Line Act</short-title></quote>.</text></section><section id="H34282800142E4C71B48867A41491782F"><enum>2.</enum><header>Aggravating factors for death penalty</header><text display-inline="no-display-inline">Section 3592(c) of title 18, United States Code, is amended by inserting after paragraph (16) the following:</text><quoted-block id="H0C3AFC994C2F4C30961BB3387A0BE15B" style="OLC"><paragraph id="H4516D894950541B4A99F87090494C6E2"><enum>(17)</enum><header>Killing or targeting of law enforcement officer</header><subparagraph id="H5977344AFD194ADB98DE1C956B1F83B7"><enum>(A)</enum><text>The defendant killed or attempted to kill, in the circumstance described in subparagraph (B), a person who is authorized by law—</text><clause id="H208788C5ECD8493F83C631CD1E01C626"><enum>(i)</enum><text>to engage in or supervise the prevention, detention, investigation, or prosecution, or the incarceration of any person for any criminal violation of law;</text></clause><clause id="HE838968394064B9EBC2CF40D3D905DA9"><enum>(ii)</enum><text>to apprehend, arrest, or prosecute an individual for any criminal violation of law; or</text></clause><clause id="HEE11C8FAB1E940E3A657CE0EAD8E2D7F"><enum>(iii)</enum><text>to be a firefighter or other first responder.</text></clause></subparagraph><subparagraph id="H83EB6E18793D45B2878D78B8AC898516"><enum>(B)</enum><text>The circumstance referred to in subparagraph (A) is that the person was killed or targeted—</text><clause id="H0D7A91EBB0E54B16BE14C68B1DE88312"><enum>(i)</enum><text>while he or she was engaged in the performance of his or her official duties;</text></clause><clause id="H9667B6C0FF964BB6B64A951477015723"><enum>(ii)</enum><text>because of the performance of his or her official duties; or</text></clause><clause id="HF1AA461E5C8544CEAD209CB4F3397485"><enum>(iii)</enum><text>because of his or her status as a public official or employee.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
