R. 7283</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220801">August 1, 2022</action-date><action-desc>Received</action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Infrastructure Investment and Jobs Act to make certain activities eligible for grants from the Abandoned Mine Reclamation Fund, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="H192F26FA3BF442A2B2E1B06B03ED856C"><pagebreak></pagebreak><section id="H9E81D5847C2048469384963232B4479F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding Treatment for the Restoration of Ecosystems from Abandoned Mines Act</short-title></quote> or the <quote><short-title>STREAM Act</short-title></quote>.</text></section><section id="H558C4876E91F42C3AE55282981E5A0DD"><enum>2.</enum><header>Activities that are eligible for grants from the Abandoned Mine Reclamation Fund</header><text display-inline="no-display-inline">Section 40701(c) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1231a">30 U.S.C. 1231a(c)</external-xref>) is amended—</text><paragraph id="H6A6DFD7D229B4C9794935FCC9FD33AC0"><enum>(1)</enum><text>by striking <quote>Grants under</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9B73780EEE53459EABBBF7A84D37B6BB"><paragraph id="HAF2C3FB8E4D74B79AA41E7A646FD4333"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), grants under</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H35847F89599D4746A663CBA3B891E9C1"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC04548BA04E646F7953691534B5877CF"><paragraph id="H57DD5DC18E9E483AA116AA137E4AD423"><enum>(2)</enum><header>Acid mine drainage abatement and treatment</header><subparagraph id="H4BCCD4C1F27449649BA960726A4FB2A8"><enum>(A)</enum><header>In general</header><text>Not more than 30 percent of the total amount of a grant made annually under subsection (b)(1) may be retained by the recipient of the grant, if those amounts are deposited into an acid mine drainage abatement and treatment fund established under State law, from which amounts (together with all interest earned on the amounts) are expended by the State for the abatement of the causes and the treatment of the effects of acid mine drainage resulting from coal mining practices, including for the costs of building, operating, maintaining, and rehabilitating acid mine drainage treatment systems.</text></subparagraph><subparagraph id="H3AFB527D9B2D49328684A18BA8CA0568"><enum>(B)</enum><header>Reporting requirements</header><text>Each recipient of a grant under subsection (b)(1) that deposits grant amounts into an acid mine drainage abatement and treatment fund under subparagraph (A) shall—</text><clause id="H3D0B9A98B3464124A577FBDFD4CFB4F6"><enum>(i)</enum><text>offer amendments to the inventory maintained under section 403(c) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1233">30 U.S.C. 1233(c)</external-xref>) to reflect the use of the amounts for acid mine drainage abatement and treatment; and </text></clause><clause id="HD8F3CC5C054443678453BCD631B5C4E2"><enum>(ii)</enum><text>include in the annual grant report of the recipient information on the status and balance of amounts in the acid mine drainage abatement and treatment fund. </text></clause></subparagraph><subparagraph id="HD8926BD21C6A4B49A59B3EECF87570C1"><enum>(C)</enum><header>Term</header><text>Amounts retained under subparagraph (A) shall not be subject to—</text><clause id="H72DB253F95364E30A3091B3FCE856FAC"><enum>(i)</enum><text>subsection (d)(4)(B); or</text></clause><clause id="HC11F9505971D4A8CB6FF991858FC98F2"><enum>(ii)</enum><text>any other limitation on the length of the term of an annual grant under subsection (b)(1).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><attestation><attestation-group><attestation-date date="20220728" chamber="House">Passed the House of Representatives July 29, 2022.</attestation-date><attestor display="yes">Cheryl L.
