which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize the Secretary of Health and Human Services to award grants to eligible entities to conduct diagnostic testing for COVID–19, and related activities such as contact tracing, through mobile health units and, as necessary, at individuals’ residences, and for other purposes.</official-title></form><legis-body id="HBC5F3320A30A4A2AB25AA7CBEF8ACADD" style="OLC"><section id="H16410210B5164B498D2D217719F90AAD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>COVID–19 Testing, Reaching, And Contacting Everyone (TRACE) Act</short-title></quote>.</text></section><section id="H5E14D697476F4D9FAB8512C9252E2096"><enum>2.</enum><header>COVID–19 testing and contact tracing using mobile health units</header><subsection id="H010712740DC241789D81B8C2BCE52722"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention, may award grants to eligible entities to conduct diagnostic testing for COVID–19, to trace and monitor the contacts of infected individuals, and to support the quarantine of such contacts, through—</text><paragraph id="H1E2304DF12C44715AC56C01E51BE642D"><enum>(1)</enum><text>mobile health units; and</text></paragraph><paragraph id="H380EDE746CF84F999FB3CEF98F1D5B28"><enum>(2)</enum><text>as necessary, testing individuals and providing individuals with services related to testing and quarantine at their residences.</text></paragraph></subsection><subsection id="H0D2C15EC83FE41008E8808112F83BC8D"><enum>(b)</enum><header>Permissible uses of funds</header><text>A grant recipient under this section may use the grant funds, in support of the activities described in subsection (a)—</text><paragraph id="H994C4D70021E4ACCAEBB0D80B1C892E7"><enum>(1)</enum><text display-inline="yes-display-inline">to hire, train, compensate, and pay the expenses of individuals; and</text></paragraph><paragraph id="H23F0905655E843EFAE414B2E17B8F8BC"><enum>(2)</enum><text>to purchase personal protective equipment and other supplies.</text></paragraph></subsection><subsection id="H08A7C7D40B38452D9A8A0BD262198B0D"><enum>(c)</enum><header>Priority</header><text display-inline="yes-display-inline">In selecting grant recipients under this section, the Secretary shall give priority to—</text><paragraph id="HE473E4EF6EE947968293CBFE0D1A1D9C"><enum>(1)</enum><text>applicants proposing to conduct activities funded under this section in hot spots and medically underserved communities; and</text></paragraph><paragraph id="H2821C4A5E8114292BF620AAB8DDE9D48"><enum>(2)</enum><text display-inline="yes-display-inline">applicants that agree, in hiring individuals to carry out activities funded under this section, to hire residents of the area or community where the activities will primarily occur, with higher priority among applicants described in this paragraph given based on the percentage of individuals to be hired from such area or community.</text></paragraph></subsection><subsection id="H63F4235876604C4D982D2B64ECD0B3A8"><enum>(d)</enum><header>Distribution</header><text>In selecting grant recipients under this section, the Secretary shall ensure that grants are distributed across urban and rural areas.</text></subsection><subsection id="H2640D59D3F8D4E6D949B9A2FEA689364"><enum>(e)</enum><header>Federal privacy requirements</header><text>Nothing in this section shall be construed to supersede any Federal privacy or confidentiality requirement, including the regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/191">Public Law 104–191</external-xref>; 110 Stat. 2033) and section 543 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd-2">42 U.S.C. 290dd–2</external-xref>).</text></subsection><subsection id="HF193EA1366234E84A3688BD7F4BCBE29"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3F616D341DB148F698A28ADE85C54883"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="H7A7F04B193684CF59C910257EC24CC87"><enum>(A)</enum><text display-inline="yes-display-inline">a federally qualified health center (as defined in section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>));</text></subparagraph><subparagraph id="H50C82123859C4489955ED2C174C751AD"><enum>(B)</enum><text>a school-based health clinic;</text></subparagraph><subparagraph id="H5C1C285510C641749622F6D69930E342"><enum>(C)</enum><text display-inline="yes-display-inline">a disproportionate share hospital (as defined under the applicable State plan under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.) pursuant to section 1923(a)(1)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-4">42 U.S.C. 1396r–4</external-xref>));</text></subparagraph><subparagraph id="HB168B400B2884877AD21F123FBB6BAB7"><enum>(D)</enum><text>an academic medical center;</text></subparagraph><subparagraph id="HCD65A3D1BD98495D938933C520C89B95"><enum>(E)</enum><text>a nonprofit organization (including any such faith-based organization);</text></subparagraph><subparagraph id="H38E0CD8F5D674010A3EE77AB841F0D15"><enum>(F)</enum><text>an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>));</text></subparagraph><subparagraph id="H6818F9A2E8C7449EBA87D86D53CFE1DF"><enum>(G)</enum><text>a high school (as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)); or</text></subparagraph><subparagraph id="HC4B32CD51AD941D3943E956B795E5B88"><enum>(H)</enum><text>any other type of entity that is determined by the Secretary to be an eligible entity for purposes of this section.</text></subparagraph></paragraph><paragraph id="H9D1D0ABF44FF4A98BC73DC2853B62872"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>emergency period</term> has the meaning given to that term in section 1135(g)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>).</text></paragraph><paragraph id="H14DC0032073B4688A5333BF70AF4CA5A"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>hot spot</term> means a geographic area where the rate of infection with the virus that causes COVID–19 exceeds the national average.</text></paragraph><paragraph id="H678B7514F79341E891FDC1FD9DD93EFA"><enum>(4)</enum><text>The term <term>medically underserved community</term> has the meaning given to that term in section 799B of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/295p">42 U.S.C. 295p</external-xref>).</text></paragraph><paragraph id="H6F09416F490949158B719339CEB192B5"><enum>(5)</enum><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph></subsection><subsection id="HD73944D0E0CB4AE0AD7BCC87CF025D0D"><enum>(g)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">To carry out this section, there are authorized to be appropriated—</text><paragraph id="HB868C77965F24FCDB8573EC00EB3ABC4"><enum>(1)</enum><text>$100,000,000,000 for fiscal year 2021; and</text></paragraph><paragraph id="HF9EC112EFCE8477EA582E0B154EFD942"><enum>(2)</enum><text>such sums as may be necessary for each of fiscal year 2022 and any subsequent fiscal year during which the emergency period continues.</text></paragraph></subsection></section></legis-body></bill>
