which was referred to the <committee-name committee-id="HBU00">Committee on the Budget</committee-name>, and in addition to the Committees on <committee-name committee-id="HHA00">House Administration</committee-name>, and <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To remove the discretionary inflater from the baseline and to provide that the salaries of Members of a House of Congress will be held in escrow if that House has not agreed to a concurrent resolution on the budget for fiscal year 2023.</official-title></form><legis-body id="HE66D61256EC74CBC9BF2780B818C3F99" style="OLC"><section id="HC63DDB604A3348E3AA356E4D7D1C5996" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Budget Process Enhancement Act</short-title></quote>.</text></section><title id="H038F9078343649EE82484EFB1CF871B0"><enum>I</enum><header>Changes in the Baseline</header><section id="HC52F90F300884FF195FF27B5CDB47522" section-type="subsequent-section"><enum>101.</enum><header>Changes in the baseline</header><text display-inline="no-display-inline">Section 257(c) of the Balanced Budget and Emergency Deficit Control Act of 1985 is amended—</text><paragraph id="H627E09B0B04249D9ABC36C8A62A1FE70"><enum>(1)</enum><text>in the second sentence of paragraph (1), by striking everything that follows <quote>current year,</quote> and inserting <quote>excluding resources designated as an emergency requirement and any resources provided in supplemental appropriation laws.</quote>;</text></paragraph><paragraph id="H0C7FA933B88E438A9275058D111BF2D0"><enum>(2)</enum><text>by striking paragraphs (2), (3), (4), and (5);</text></paragraph><paragraph id="H591FACD2A023474D9FCE93959AC24EC7"><enum>(3)</enum><text>by redesignating paragraph (6) as paragraph (2); and</text></paragraph><paragraph id="H7DBE14CFAD5140128ED2811CFD4FB0FD"><enum>(4)</enum><text>by inserting after paragraph (2) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H22D27415FB354EA5917217F7A7D06931" style="OLC"><paragraph id="H2AF1BDFE69E54DACAB6213CBC8895A34"><enum>(3)</enum><header>No adjustment for inflation</header><text>No adjustment shall be made for inflation or for any other factor.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="H8D9AEAE7736C4CF6AB8AF9924D44E038"><enum>II</enum><header>Budget Accountability of Members of Congress</header><section id="H6DC254FC088A42D8B6102D6B8D3B3F80"><enum>201.</enum><header>Holding salaries of Members of Congress in escrow upon failure to agree to budget resolution</header><subsection id="HE9766C10A0C14189AD60CAEB342321CD"><enum>(a)</enum><header>Holding salaries in escrow</header><paragraph id="H060AA4E708B94C37B8C37303F9659A3E"><enum>(1)</enum><header>In general</header><text>If by April 15, 2022, a House of Congress has not agreed to a concurrent resolution on the budget for fiscal year 2023 pursuant to section 301 of the Congressional Budget Act of 1974, during the period described in paragraph (2) the payroll administrator of that House of Congress shall deposit in an escrow account all payments otherwise required to be made during such period for the compensation of Members of Congress who serve in that House of Congress, and shall release such payments to such Members only upon the expiration of such period.</text></paragraph><paragraph id="H466CF9523B20461588F37602C5364F47"><enum>(2)</enum><header>Period described</header><text>With respect to a House of Congress, the period described in this paragraph is the period which begins on April 16, 2022, and ends on the earlier of—</text><subparagraph id="H4A85BDC44C524101A6DBE9216463A448"><enum>(A)</enum><text>the day on which the House of Congress agrees to a concurrent resolution on the budget for fiscal year 2023 pursuant to section 301 of the Congressional Budget Act of 1974; or</text></subparagraph><subparagraph id="HD63D26A7776C41ACB77640D84137FEDF"><enum>(B)</enum><text>the last day of the One Hundred Seventeenth Congress.</text></subparagraph></paragraph><paragraph id="HA3852784FBE246A396A6F6E62D15F17E"><enum>(3)</enum><header>Withholding and remittance of amounts from payments held in escrow</header><text>The payroll administrator shall provide for the same withholding and remittance with respect to a payment deposited in an escrow account under paragraph (1) that would apply to the payment if the payment were not subject to paragraph (1).</text></paragraph><paragraph id="H7076EDE1B65949F584F52C24F219978B"><enum>(4)</enum><header>Release of amounts at end of the Congress</header><text>In order to ensure that this section is carried out in a manner that shall not vary the compensation of Senators or Representatives in violation of the twenty-seventh article of amendment to the Constitution of the United States, the payroll administrator of a House of Congress shall release for payments to Members of that House of Congress any amounts remaining in any escrow account under this section on the last day of the One Hundred Seventeenth Congress.</text></paragraph><paragraph id="H6FB0AB48414045BB810E9B327F4A474E"><enum>(5)</enum><header>Role of Secretary of the Treasury</header><text>The Secretary of the Treasury shall provide the payroll administrators of the Houses of Congress with such assistance as may be necessary to enable the payroll administrators to carry out this section.</text></paragraph></subsection><subsection id="H5CBBFF995D054690AF2F8A328BA19DF3"><enum>(b)</enum><header>Treatment of Delegates as Members</header><text>In this section, the term <term>Member of Congress</term> includes a Delegate or Resident Commissioner to the Congress.</text></subsection><subsection id="H0B4FB04AAD3A4C4B9D5469D114366D20"><enum>(c)</enum><header>Payroll administrator defined</header><text>In this section, the term <term>payroll administrator</term> of a House of Congress means—</text><paragraph id="HEE8A87F7D492492EA35D2378D339A54E"><enum>(1)</enum><text>in the case of the House of Representatives, the Chief Administrative Officer of the House of Representatives, or an employee of the Office of the Chief Administrative Officer who is designated by the Chief Administrative Officer to carry out this section; and</text></paragraph><paragraph id="H168FA7519C684CB2934C9B804BC9990A"><enum>(2)</enum><text>in the case of the Senate, the Secretary of the Senate, or an employee of the Office of the Secretary of the Senate who is designated by the Secretary to carry out this section.</text></paragraph></subsection></section><section id="H177F68903349477F9292153180B9B297"><enum>202.</enum><header>Determination of compliance with statutory requirement to submit the President’s budget</header><text display-inline="no-display-inline">Not later than 3 days after the President’s budget is due, the Inspector General of the Office of Personnel Management shall—</text><paragraph id="H694596F4E81D413EBF1856899031DB9F"><enum>(1)</enum><text>make an annual determination of whether the Director of the Office of Management and Budget (OMB) and the President are in compliance with section 1105 of title 31, United States Code; and</text></paragraph><paragraph id="H9140CD9197D24C1B80337FACCC4EF55F"><enum>(2)</enum><text>provide a written notification of such determination to the Chairs of the Committee on the Budget and the Committee on Appropriations of the Senate and the Chairs of the Committee on the Budget and the Committee on Appropriations of the House of Representatives.</text></paragraph></section><section id="HEE36520FC85A4CB597E621E96165F1DF"><enum>203.</enum><header>No pay upon failure to timely submit the President’s budget to Congress</header><subsection id="H2EE69F9CBD86427097915FC84109CE46"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, no funds may be appropriated or otherwise be made available from the United States Treasury for the pay of the Director of OMB, Deputy Director of OMB, and the Deputy Director for Management of OMB during any period of noncompliance determined by the Inspector General of the Office of Personnel Management under section 202.</text></subsection><subsection id="H92BCEA55D355442B957B90AA17FFD464"><enum>(b)</enum><header>No retroactive pay</header><text>The Director of OMB, Deputy Director of OMB, and the Deputy Director for Management of OMB may not receive pay for any period of noncompliance determined by the Inspector General of the Office of Personnel Management under section 202 at any time after the end of that period.</text></subsection></section><section id="HBD845F5D41024187AC159E343D6D35B5"><enum>204.</enum><header>Effective date</header><text display-inline="no-display-inline">Sections 202 and 203 shall take effect upon the date of enactment of this Act.</text></section></title></legis-body></bill>
