which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XIX of the Public Health Service Act to make certain improvements with respect to block grants for substance use prevention, treatment, and recovery services, and for other purposes.</official-title></form><legis-body id="H45034F6BF2314B748D2A3FD181B407B2" style="OLC"><section id="H3B2459B7168E4387AFCC5E784B5AE850" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Substance Use Prevention, Treatment, and Recovery Services Block Grant Act of 2022</short-title></quote>.</text></section><section id="HB6C5867180374CAEBB166498CCDA8AE1"><enum>2.</enum><header>Eliminating stigmatizing language relating to substance use</header><subsection id="H1846E47A94F94A9381EBFD5882D0432B"><enum>(a)</enum><header>Block Grants for Prevention and Treatment of Substance Use</header><text display-inline="yes-display-inline">Part B of title XIX of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x">42 U.S.C. 300x et seq.</external-xref>) is amended—</text><paragraph id="HB5B410CB8DA940A299ED7A8C5C1E5F7A"><enum>(1)</enum><text>in the part heading, by striking <quote><header-in-text level="part" style="OLC">Substance Abuse</header-in-text></quote> and inserting <quote><header-in-text level="part" style="OLC">Substance Use</header-in-text></quote>; </text></paragraph><paragraph id="H75EB2D0A37394489AF7A3AB37477C36D"><enum>(2)</enum><text>in subpart II, by amending the subpart heading to read as follows: <quote><header-in-text level="subpart" style="OLC">Block grants for substance use prevention, treatment, and recovery services</header-in-text></quote>;</text></paragraph><paragraph id="H5577F1B5ABAE45AB9784F82142F1BAA6"><enum>(3)</enum><text>in section 1922(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-22">42 U.S.C. 300x–22(a)</external-xref>)—</text><subparagraph id="H2D7AB01CEEE042C3958EEFDEDCCA46CB"><enum>(A)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>substance abuse</quote> and inserting <quote>substance use disorders</quote>; </after-quoted-block></quoted-block></paragraph><paragraph id="H6280620F61CB4B7C8A1949F841DE6128"><enum>(10)</enum><text>in section 1935 (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-35">42 U.S.C. 300x–35</external-xref>)—</text><subparagraph id="HF0907D44D64341D89F4F7CC215112E04"><enum>(A)</enum><text>in subsection (a), by striking <quote>substance abuse</quote> and inserting <quote>substance use disorders</quote>; and</text></paragraph><paragraph id="HAAACC1BCBE8346CA826D5AF4C363D6D1"><enum>(14)</enum><text display-inline="yes-display-inline">in section 1956 (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-66">42 U.S.C. 300x–66</external-xref>), by striking <quote>substance abuse</quote> each place it appears and inserting <quote>substance use disorders</quote>.</text></paragraph></subsection><subsection id="H0B03EDF1D05D41109E75C3844BD18B4F"><enum>(b)</enum><header>Certain programs regarding mental health and substance abuse</header><text display-inline="yes-display-inline">Part C of title XIX of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300y">42 U.S.C. 300y et seq.</external-xref>) is amended—</text><paragraph id="HB1F2B1B30D0349099279289DDF7F06AA"><enum>(1)</enum><text display-inline="yes-display-inline">in the part heading, by striking <quote><header-in-text level="part" style="OLC">Substance Abuse</header-in-text></quote> and inserting <quote><header-in-text level="part" style="OLC">Substance Use</header-in-text></quote>; </text></paragraph><paragraph id="H4A58FBDCC2354C27848AD02973D0C9FC"><enum>(2)</enum><text display-inline="yes-display-inline">in section 1971 (<external-xref legal-doc="usc" parsable-cite="usc/42/300y">42 U.S.C. 300y</external-xref>), by striking <quote>substance abuse</quote> each place it appears in subsections (a), (b), and (f) and inserting <quote>substance use</quote>; and</text></paragraph><paragraph id="HF742D37A187C4361B4342B7CD593FC9A"><enum>(3)</enum><text display-inline="yes-display-inline">in section 1976 (<external-xref legal-doc="usc" parsable-cite="usc/42/300y-11">42 U.S.C. 300y–11</external-xref>), by striking <quote>intravenous abuse</quote> and inserting <quote>intravenous use</quote>.</text></paragraph></subsection></section><section id="H5FF59A22F3CC45C89B5014A349D23E0C"><enum>3.</enum><header>Authorized activities</header><text display-inline="no-display-inline">Section 1921(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-21">42 U.S.C. 300x–21(b)</external-xref>) is amended by striking <quote>prevent and treat substance use disorders</quote> and inserting <quote>prevent, treat, and provide recovery support services for substance use disorders</quote>.</text></section><section id="HD28C75CB62D04A3595DABC8086E355BE"><enum>4.</enum><header>Requirements relating to certain infectious diseases and human immunodeficiency virus</header><text display-inline="no-display-inline">Section 1924 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-24">42 U.S.C. 300x–24</external-xref>) is amended—</text><paragraph id="HABCE2ACDE4FE4024BA72FB3B782F7238"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">Tuberculosis and Human Immunodeficiency Virus</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Tuberculosis, Viral Hepatitis, and Human Immunodeficiency Virus</header-in-text></quote>;</text></paragraph><paragraph id="H3D824B1D6A3E48E68748E1C7E4A1D8AA"><enum>(2)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="HD513F27F97204066940576AC15BD1876"><enum>(3)</enum><text>by inserting after subsection (b) the following: </text><quoted-block style="OLC" id="H14F53E3EF34B4BF0ABFFA5B8AAD142EF" display-inline="no-display-inline"><subsection id="H92B2342E61DD4C05950846FA89CB0ACC" display-inline="no-display-inline"><enum>(c)</enum><header>Viral hepatitis</header><paragraph id="H1202AA1A2AD2483B99B3570DA2F9C39D"><enum>(1)</enum><header>In general</header><text>A funding agreement for a grant under section 1921 is that the State involved will require that any entity receiving amounts from the grant for operating a program of treatment for substance use disorders—</text><subparagraph id="H265BCE341DE0472BBEB978A4C6E6E82B"><enum>(A)</enum><text>will, directly or through arrangements with other public or nonprofit private entities, routinely make available viral hepatitis services to each individual receiving treatment for such disorders; and</text></subparagraph><subparagraph id="H61817365373B4A3CB55E239C5A2A5B5F"><enum>(B)</enum><text>in the case of an individual in need of such treatment who is denied admission to the program on the basis of the lack of the capacity of the program to admit the individual, will refer the individual to another provider of viral hepatitis services.</text></subparagraph></paragraph><paragraph id="H968195EE3A784C61B79EBF05CD843681"><enum>(2)</enum><header>Viral hepatitis services</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the term <term>viral hepatitis services</term>, with respect to an individual, means—</text><subparagraph id="H26D5FD372B004572BED02E70A591EDAC"><enum>(A)</enum><text>screening the individual for viral hepatitis; and</text></subparagraph><subparagraph id="HFF2BF6CE8D8C4D38B0F8E0A636F29546"><enum>(B)</enum><text>referring the individual to a provider specializing in viral hepatitis treatment. </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HBC6DA5B8F448422B9C5415E369845608" commented="no"><enum>5.</enum><header>State plan requirements</header><text display-inline="no-display-inline">Section 1932(b)(1)(A) is amended—</text><paragraph id="H4C25E5C8A02D4E46AC22C62DBFE225D2" commented="no"><enum>(1)</enum><text>by redesignating clauses (vi) through (ix) as clauses (vii) through (x), respectively; and</text></paragraph><paragraph id="HBF4253FF1E914A1D96BCDCE5C75BDFB9" commented="no"><enum>(2)</enum><text>by inserting after clause (v) the following:</text><quoted-block style="OLC" id="H4DCD59C8767F495EB092507EE0A6CB43" display-inline="no-display-inline"><clause id="H70A9486657F94F8BBAD6F6E33F56506D" commented="no"><enum>(vi)</enum><text display-inline="yes-display-inline">provides a description of—</text><subclause id="HC870C40993354637AB6C8CF527CD838B"><enum>(I)</enum><text>the State’s comprehensive statewide recovery support services activities, including the number of individuals being served, target populations, and priority needs; and</text></subclause><subclause id="H3E597839F99C4A229B2C468C3D0A5449"><enum>(II)</enum><text>the amount of funds received under this subpart expended on recovery support services;</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H66755078D1EA46EF9A75CDFA74213019"><enum>6.</enum><header>Updating certain language relating to Tribes</header><text display-inline="no-display-inline">Section 1933(d) of the Public Health Service Act (300x–33(d)) is amended—</text><paragraph id="HE0944FBFC37A48DB8C21055C02FBA703"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">tribes and tribal organizations</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Tribes and Tribal organizations</header-in-text></quote>;</text></paragraph><paragraph id="HDFAEED19BF72495594D7C5FC53D64885"><enum>(2)</enum><text>in paragraph (1)—</text><subparagraph id="H457F58C9A56B4897A962440C60134326"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="HB4C6A5FBBA0C48C7AC56234B3310DB46"><enum>(i)</enum><text>by striking <quote>of an Indian tribe or tribal organization</quote> and inserting <quote>of an Indian Tribe or Tribal organization</quote>; and </text></subparagraph><subparagraph id="H12CE98641C1B4D2A9DD0AB6DAFC631B4"><enum>(B)</enum><text>by striking <quote>The terms</quote> and all that follows through <quote>given such terms</quote> and inserting the following: <quote>The terms <term>Indian Tribe</term> and <term>Tribal organization</term> have the meanings given the terms <term>Indian tribe</term> and <term>tribal organization</term></quote>. </text></subparagraph></paragraph></section><section id="HD4951C6D8ECB4BCC8C818350199166F9"><enum>7.</enum><header>Block grants for substance use prevention, treatment, and recovery services</header><subsection id="H2994A95C3D19497DB7DA21279D343F45"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1935(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-35">42 U.S.C. 300x–35(a)</external-xref>), as amended by section 2, is further amended by striking <quote>appropriated</quote> and all that follows through <quote>2022..</quote> and inserting the following: <quote>appropriated $1,908,079,000 for each of fiscal years 2023 through 2027.</quote>.</text></subsection><subsection id="H7A9A4D858005412480F4C9C4D8A98C79"><enum>(b)</enum><header>Technical corrections</header><text display-inline="yes-display-inline">Section 1935(b)(1)(B) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-35">42 U.S.C. 300x–35(b)(1)(B)</external-xref>) is amended by striking <quote>the collection of data in this paragraph is</quote>.</text></subsection></section><section id="HD22830DA338A475F8A75CFFCA99ED943"><enum>8.</enum><header>Study on assessment for use in distribution of limited State resources</header><subsection id="H1FFEAA9EAF6247DD9F54169EB061756E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, acting through the Assistant Secretary for Mental Health and Substance Use (in this section referred to as the <quote>Secretary</quote>), shall, in consultation with States and other local entities providing prevention, treatment, or recovery support services related to substance use, conduct a study to develop a model needs assessment process for States to consider to help determine how best to allocate block grant funding received under subpart II of part B of title XIX of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-21">42 U.S.C. 300x–21</external-xref>) to provide services to substance use disorder prevention, treatment, and recovery support. The study must include cost estimates with each model needs assessment process.</text></subsection><subsection id="H75667FB767714188870124A1AEED77CF"><enum>(b)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of this Act, the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor and Pensions of the Senate a report on the results of the study conducted under paragraph (1). </text></subsection></section></legis-body></bill>
