which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend titles XIX and XXI of the Social Security Act to require coverage under the Medicaid program and Children’s Health Insurance Program for vaccines and treatment for COVID–19 without the imposition of cost sharing requirements, and for other purposes.</official-title></form><legis-body id="HE6B6FE5F97244716A5495D588DDF51F8" style="OLC"><section id="HF5B43B59E14843E4B54F82C1EF167403" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Vaccination and Treatment Affordability Act</short-title></quote>.</text></section><section id="H16436B17A82A41B4AE515C608EC38024"><enum>2.</enum><header>Coverage at no cost sharing of COVID–19 vaccine and treatment</header><subsection id="H9C29CEED5A874705BC17D4CD60E3E239"><enum>(a)</enum><header>Medicaid</header><paragraph id="HC022254E0E68479BA77F658ED289B5DB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905(a)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)(4)</external-xref>) is amended—</text><subparagraph id="HB6C096D5E4774FEBBE870B2A82EF381A"><enum>(A)</enum><text>by striking <quote>and (D)</quote> and inserting <quote>(D)</quote>; and</text></subparagraph><subparagraph id="H9386D72DB2554669A07BD85530A9BF5B"><enum>(B)</enum><text>by striking the semicolon at the end and inserting <quote>; (E) a COVID–19 vaccine licensed under section 351 of the Public Health Service Act and the administration of such vaccine; and (F) items and services furnished for the treatment of COVID–19 or a condition that may complicate the treatment of COVID–19;</quote>.</text></subparagraph></paragraph><paragraph id="H52BBD5DD5F27434EB2A33522E684D1B2"><enum>(2)</enum><header>Prohibition of cost sharing</header><subparagraph id="H15CDB4A00D7543C3B525E8991D3180E0"><enum>(A)</enum><header>In general</header><text>Subsections (a)(2) and (b)(2) of section 1916 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o">42 U.S.C. 1396o</external-xref>) are each amended—</text><clause id="H0C3DF764B5094105AD82CA66E1FBA5F8"><enum>(i)</enum><text>in subparagraph (F), by striking <quote>or</quote> at the end; </text></clause><clause id="H38CD003B02684A819EF3585E18279006"><enum>(ii)</enum><text>in subparagraph (G), by striking <quote>; and</quote> and inserting <quote>, or</quote>; and</text></clause><clause id="HF5D8C26CEA6546398D225669D76EC0EF"><enum>(iii)</enum><text>by adding at the end the following subparagraphs:</text><quoted-block id="HE86A835E1BE14E95BDB3FD89E98F4DCA" style="traditional" act-name=""><subparagraph id="H3411768D148C452E870B8DAC21AB5263"><enum>(H)</enum><text display-inline="yes-display-inline">a COVID–19 vaccine licensed under section 351 of the Public Health Service Act and the administration of such vaccine, or</text></subparagraph><subparagraph id="H1C50F1289D7543EDB4604531448FB562"><enum>(I)</enum><text display-inline="yes-display-inline">any item or service furnished for the treatment of COVID–19 or a condition that may complicate the treatment of COVID–19; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HA2228FFC674B444F888019EE44F85A07"><enum>(B)</enum><header>Application to alternative cost sharing</header><text>Section 1916A(b)(3)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o-1">42 U.S.C. 1396o–1(b)(3)(B)</external-xref>) is amended— </text><clause id="HAADC0D6799184F74BE0C4FA951B40DA3"><enum>(i)</enum><text>in clause (xi), by striking <quote>any visit</quote> and inserting <quote>any service</quote>; and</text></clause><clause id="H6FDF3D709F3A4D7DB1A74FDE29EF8B8B"><enum>(ii)</enum><text>by adding at the end the following clauses:</text><quoted-block id="H000C49F9F79D4C799EBAFFC9D73A2C2B" style="traditional" act-name=""><clause id="H743D25260E0C486CBD178688935893F5"><enum>(xii)</enum><text display-inline="yes-display-inline">A COVID–19 vaccine licensed under section 351 of the Public Health Service Act and the administration of such vaccine.</text></clause><clause id="H0A6AAA2D4FC44228820B828333BB5BF1"><enum>(xiii)</enum><text display-inline="yes-display-inline">An item or service furnished for the treatment of COVID–19 or a condition that may complicate the treatment of COVID–19.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HC738D8D15DAE4444958769ED057F6C41"><enum>(C)</enum><header>Clarification</header><text>The amendments made this subsection shall apply with respect to a State plan of a territory in the same manner as a State plan of one of the 50 States.</text></subparagraph></paragraph></subsection><subsection id="H9F627A2BCA294EF8AC9F1537376CF36A" commented="no"><enum>(b)</enum><header>State pediatric vaccine distribution program</header><text>Section 1928 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396s">42 U.S.C. 1396s</external-xref>) is amended—</text><paragraph commented="no" id="HBB8FFAF7D31A479EA5EC00FA0800EE49"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph commented="no" id="H07CA4D9A561A40589F94A3D3885E9BF0"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph commented="no" id="H44A807EB81134DF6AA2D078F7C8CEA7D"><enum>(B)</enum><text>in subparagraph (B), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" id="H0583B5D898FC4D3FAEF57651DD0022A4"><enum>(C)</enum><text>by adding at the end the following subparagraph: </text><quoted-block id="HE82546AB40594E8B80E429B48333BF2F" style="traditional" act-name=""><subparagraph id="H5740914107B344E98722CFCA4F109371"><enum>(C)</enum><text display-inline="yes-display-inline">each vaccine-eligible child (as defined in subsection (b)) is entitled to receive a COVID–19 vaccine from a program-registered provider (as defined in subsection (h)(8)) without charge for— </text><clause id="HA8D9225875994E1387FF01E436AD237A"><enum>(i)</enum><text display-inline="yes-display-inline">the cost of such vaccine; or</text></clause><clause id="H645C018D7FAA43168F4E86EFBDE4FF26"><enum>(ii)</enum><text display-inline="yes-display-inline">the administration of such vaccine.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="HCB6BC422E7964070A1A63E34695343CC"><enum>(2)</enum><text>in subsection (c)(2)—</text><subparagraph commented="no" id="HEFC09A422BE34A1EA0119DDD26C96C97"><enum>(A)</enum><text>in subparagraph (C)(ii), by inserting <quote>, but may not impose a fee for the administration of a COVID–19 vaccine</quote> before the period; and</text></subparagraph><subparagraph commented="no" id="H99D1832EDB894F5F8BD41B671E2F51E1"><enum>(B)</enum><text>by adding at the end the following subparagraph:</text><quoted-block id="HE2C38A394B62422FB7F1B3A86C6ECCEB" style="traditional" act-name=""><subparagraph id="H5AAC70468D5A4C039B8AAAA5978B74A7" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">The provider will provide and administer an approved COVID–19 vaccine to a vaccine-eligible child in accordance with the same requirements as apply under the preceding subparagraphs to the provision and administration of a qualified pediatric vaccine to such a child.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="H1E3C8B8F3C0A4D1D81E3D65CC53F6E8E"><enum>(3)</enum><text>in subsection (d)(1), in the first sentence, by inserting <quote>, including with respect to a COVID–19 vaccine licensed under section 351 of the Public Health Service Act</quote> before the period.</text></paragraph></subsection><subsection id="H3326030CE46A451CB99657F3730EA904"><enum>(c)</enum><header>CHIP</header><paragraph id="H8CC3673CD96F4769A8E84225FAFF7CB8"><enum>(1)</enum><header>In general</header><text>Section 2103(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397cc">42 U.S.C. 1397cc(c)</external-xref>) is amended by adding at the end the following paragraph: </text><quoted-block id="H6683206E7C054818847D8E38D0C5E18A" style="traditional" act-name=""><paragraph id="HF1E28597ACD34190A954B4671CD28232"><enum>(11)</enum><header>Coverage of COVID–19 vaccines and treatment</header><text display-inline="yes-display-inline">The child health assistance provided to a targeted low-income child shall include coverage of—</text><subparagraph id="H5EE113BF0CD4496D979339615FF1357F"><enum>(A)</enum><text display-inline="yes-display-inline">any COVID–19 vaccine licensed under section 351 of the Public Health Service Act and the administration of such vaccine; and</text></subparagraph><subparagraph id="HAA22AC4A68F0462882C44FB2B2597F9B"><enum>(B)</enum><text display-inline="yes-display-inline">any item or service furnished for the treatment of COVID–19 or a condition that may complicate the treatment of COVID–19.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H58B75E511DF8463A920F22DB8EAB2081"><enum>(2)</enum><header>Prohibition of cost sharing</header><text>Section 2103(e)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397cc">42 U.S.C. 1397cc(e)(2)</external-xref>), as amended by section 6004(b)(3) of the Families First Coronavirus Response Act, is amended—</text><subparagraph id="H5BDD6F58CE5F4687A141FA63930C9625"><enum>(A)</enum><text>in the paragraph header, by inserting <quote><header-in-text style="traditional" level="subparagraph">a COVID–19 vaccine, COVID–19 treatment,</header-in-text></quote> before <quote><header-in-text style="traditional" level="subparagraph">or pregnancy-related assistance</header-in-text></quote>; and</text></subparagraph><subparagraph id="HE85A06E1812440248F1576A6746360E3"><enum>(B)</enum><text>by striking <quote>visits described in section 1916(a)(2)(G), or</quote> and inserting <quote>services described in section 1916(a)(2)(G), vaccines described in section 1916(a)(2)(H), items or services described in section 1916(a)(2)(I), or</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HF0C1DF3FF20A4130934E618032D19566"><enum>(d)</enum><header>Conforming amendments</header><text>Section 1937 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-7">42 U.S.C. 1396u–7</external-xref>) is amended— </text><paragraph commented="no" id="HFE837023DCAD4DC7966F67F8F03AAF31"><enum>(1)</enum><text>in subsection (a)(1)(B), by inserting <quote>, under subclause (XXIII) of section 1902(a)(10)(A)(ii),</quote> after <quote>section 1902(a)(10)(A)(i)</quote>; and</text></paragraph><paragraph commented="no" id="H3985ECA959FA475A8DDAD1F22927D1DE"><enum>(2)</enum><text>in subsection (b)(5), by adding before the period the following: <quote>, and, effective on the date of the enactment of the Ensuring Vaccination and Treatment Affordability Act, must comply with subparagraphs (F) through (I) of subsections (a)(2) and (b)(2) of sections 1916 and 1916A</quote>.</text></paragraph></subsection><subsection commented="no" id="HF8B3C435E36842C4925BD63E34FD9DCB"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of enactment of this Act and shall apply with respect to a COVID–19 vaccine beginning on the date that such vaccine is licensed under section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>). </text></subsection></section></legis-body></bill>
