concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Transportation to establish a program to award grants to State and Tribal governments to facilitate the placement of disability identifier symbols on certain identification cards, and for other purposes.</official-title></form><legis-body id="HEEE22EED48E441AB8CA89E39E595C99B" style="OLC"><section id="H9D6E95830D0F4440AFBA308B71591721" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disability ID Act of 2022</short-title></quote>.</text></section><section id="H54209065E0E74329B04EEF97964031AC"><enum>2.</enum><header>Disability identifier symbols on identification cards</header><subsection id="H1D3FBF6B3D124A94ABACDC335E9BD21F" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall establish a grant program to award, on a competitive basis, grants to covered entities to carry out programs that allow an individual with an eligible disability to have a disability identifier symbol placed on an identification card of such individual.</text></subsection><subsection id="H39C0470E4A754A25B61A0590343A2654"><enum>(b)</enum><header>Applications</header><text>To be eligible for a grant under this section, a covered entity shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate.</text></subsection><subsection id="HC52B89AB4CCA42ABAC560268DC302A92"><enum>(c)</enum><header>Grant uses</header><paragraph id="HD1499A51D4844F2F95707AFC2965EB7B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A covered entity may use grant funds awarded under this section only for expenses, as determined necessary by the Secretary, to carry out a program that—</text><subparagraph id="HC8485C3565BB4674A797A572D1909033" display-inline="no-display-inline"><enum>(A)</enum><text>is established not later than 1 year after the date on which such funds are awarded;</text></subparagraph><subparagraph id="H899AC9BE45B24C4CA30E522B034514AF"><enum>(B)</enum><text>upon the request of an individual and the presentation of a signed affirmation by a qualified professional that such individual has an eligible disability, places, at no cost to such individual, a disability identifier symbol on an identification card issued to such individual;</text></subparagraph><subparagraph id="H38AB08CF9BA24FCFB5E947F2ABBBAF1C" display-inline="no-display-inline"><enum>(C)</enum><text>upon the request of an individual, removes, at no cost to such individual, such symbol from an identification card of such individual; and</text></subparagraph><subparagraph id="H0F1E11F5C2FC490D85091911202A2AF0"><enum>(D)</enum><text display-inline="yes-display-inline">provides first responders with—</text><clause id="H557DF21571114473B1A4DB52B33A0840"><enum>(i)</enum><text>notification that—</text><subclause id="HA561ACE8E5CF45B0A16FDB5A177FDDEB"><enum>(I)</enum><text>the presence of such symbol on an identification card indicates that the cardholder has a disability; and</text></subclause><subclause id="H76508324FF93474EAB0619C970171134"><enum>(II)</enum><text>the absence of such symbol from an identification card does not indicate that the cardholder does not have a disability;</text></subclause></clause><clause id="H439769983EB04CBF84103672C9AE3B95"><enum>(ii)</enum><text>training to assist first responders—</text><subclause id="H2284292E1C1E4577BD82077DAAA1E5AA"><enum>(I)</enum><text>to recognize individuals with disabilities; and</text></subclause><subclause id="H440767A8E2CE435A9731D197A3EBC1FB"><enum>(II)</enum><text>to interact appropriately with such individuals; and</text></subclause></clause><clause id="H771979D77048460D96D536C0FE18242C"><enum>(iii)</enum><text>information on—</text><subclause id="H801C27C8F4044117B329FDBA5CA4F10C"><enum>(I)</enum><text display-inline="yes-display-inline">resources available to individuals with disabilities;</text></subclause><subclause id="HEE68CEC6E96546E686F06647797C878E"><enum>(II)</enum><text>resources available to those interacting with such individuals; and</text></subclause><subclause id="HD987606AEA5645BB83AC38EC8A481738"><enum>(III)</enum><text display-inline="yes-display-inline">the requirements of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>).</text></subclause></clause></subparagraph></paragraph><paragraph id="H84C95035FD3D4C91A00159636645152F"><enum>(2)</enum><header>Disability identifier symbol</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary, in consultation with the Invisible Disabilities Association, shall designate for use by a covered entity awarded a grant under this section a disability identifier symbol that is discreet in appearance and has proportions similar to those of symbols placed on identification cards to indicate organ donor status.</text></paragraph></subsection><subsection id="H99934811DDD242A8A97F683AB8C782A3"><enum>(d)</enum><header>Grant limitations</header><paragraph id="H5628A620E42A4275AAC34A67F26559BE"><enum>(1)</enum><header>Amount</header><text display-inline="yes-display-inline">The Secretary may not award a grant under this section in an amount that exceeds $200,000.</text></paragraph><paragraph id="H0215A3491B0146318A12028A18B6F443"><enum>(2)</enum><header>Federal share</header><subparagraph id="H34C7CADDBA74447BB96417DD3A4F65D4"><enum>(A)</enum><header>Federal share</header><text>The Federal share of the costs of a program carried out with a grant awarded under this section may not exceed 75 percent.</text></subparagraph><subparagraph id="H5078DA5DF5904A23B4DB0062E3A0F322"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) does not apply to a grant awarded to a Tribal government.</text></subparagraph></paragraph></subsection><subsection id="H0B038CF07CC54EB6A7BB7B1CB050586C"><enum>(e)</enum><header>Reports</header><paragraph id="H9325416D69CE4D4AAE6F747D608875ED"><enum>(1)</enum><header>Preliminary report</header><text>Not later than 180 days after the date on which the Secretary awards the first grant under this section, the Secretary shall submit to Congress a report on the programs carried out by covered entities with grants awarded under this section, including information on the following for each such program:</text><subparagraph id="H835CCEA8AFC642F7A035D54B0AF88359"><enum>(A)</enum><text display-inline="yes-display-inline">The number of applications submitted for identification cards with a disability identifier symbol.</text></subparagraph><subparagraph id="HFA2AB1E88D034C1CBF80409DA2ACAAB4"><enum>(B)</enum><text display-inline="yes-display-inline">The number of identification cards issued with a disability identifier symbol.</text></subparagraph><subparagraph id="HCD166C4CA280450AA520FECE41BF4CD6"><enum>(C)</enum><text>The costs of the program.</text></subparagraph></paragraph><paragraph id="H7EC9C7EBBF6148FC96D87EF2E1A7FD56"><enum>(2)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than 3 years after the date on which the Secretary awards the first grant under this section, the Secretary shall submit to Congress and make available on the website of the Department of Transportation a report on the programs carried out by covered entities with grants awarded under this section, including information on the following for each such program:</text><subparagraph id="H6F5281E4EF9A494DAC1314D4F45C60CC"><enum>(A)</enum><text display-inline="yes-display-inline">The number of applications submitted for identification cards with a disability identifier symbol.</text></subparagraph><subparagraph id="H4978080ADDAA4B34807B836B21700190"><enum>(B)</enum><text display-inline="yes-display-inline">The number of identification cards issued with a disability identifier symbol.</text></subparagraph><subparagraph id="HFA117BE788C54395A89C43EB47AB3940"><enum>(C)</enum><text>The costs of the program.</text></subparagraph><subparagraph id="H5510020F136B451C915AFD1B0B0735F2"><enum>(D)</enum><text>The best practices of each such covered entity and the impact of such program.</text></subparagraph></paragraph></subsection><subsection id="HCB54B24DDB7248029067150CC3D42A5D"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HBEBDBBECDC1D4818AE851EB721CC585C"><enum>(1)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means a State or Tribal government.</text></paragraph><paragraph id="H4B5FE8A1300B4438BE0FC0EA04BDBDFB" commented="no"><enum>(2)</enum><header>Eligible disability</header><text display-inline="yes-display-inline">The term <quote>eligible disability</quote> has the meaning given the term <quote>disability</quote> in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>). </text></paragraph><paragraph id="HDC0C0FE18E1A4D0CA6D3F744AEAEF8F8"><enum>(3)</enum><header>First responder</header><text display-inline="yes-display-inline">The term <term>first responder</term> means an individual with job duties related to emergency response, including emergency medical technicians, firefighters, and law enforcement officers.</text></paragraph><paragraph id="H317922919E1F42C68FB6C25A98D00315"><enum>(4)</enum><header>Identification card</header><text display-inline="yes-display-inline">The term <term>identification card</term> means a personal identification card, as such term is defined in section 1028(d) of title 18, United States Code, or a motor vehicle operator’s license, as such term is defined in section 30301 of title 49, United States Code.</text></paragraph><paragraph id="H1D20DEE98C8D4F019841C8AC57903760" commented="no"><enum>(5)</enum><header>Qualified professional</header><text>The term <quote>qualified professional</quote> means—</text><subparagraph id="H13946E5B0AFB4E5DA8B297B0CC5CB366" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a physician;</text></subparagraph><subparagraph id="H9E91C29CECF745D0B7065D7776649473" commented="no"><enum>(B)</enum><text>a physician assistant;</text></subparagraph><subparagraph id="HF83C5FFD59FC4C8B9CB241AD60AD760D" commented="no"><enum>(C)</enum><text>a mental health professional;</text></subparagraph><subparagraph id="H705147B93F72420A8321DB49AA974F01" commented="no"><enum>(D)</enum><text>an advanced practice nurse; </text></subparagraph><subparagraph id="HD19839AD070A4A0F9AA56CA53A22DB73" commented="no"><enum>(E)</enum><text>an individual with a master’s degree in rehabilitation counseling; and</text></subparagraph><subparagraph id="HBA01C5DB08EC457CB8499D34955628B9"><enum>(F)</enum><text>any other professional determined appropriate by the Secretary of Transportation.</text></subparagraph></paragraph><paragraph id="HA7422381CA0F43D8BF3193986E82F0B4"><enum>(6)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each State, the District of Columbia, and each commonwealth, territory, or possession of the United States.</text></paragraph><paragraph id="H0ACF8194EDF04789BF0A825090824442"><enum>(7)</enum><header>Tribal government</header><text display-inline="yes-display-inline">The term <term>Tribal government</term> means the government of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) in the list published most recently as of March 11, 2021, pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
