R. 7212</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220324">March 24, 2022</action-date><action-desc><sponsor name-id="K000395">Mr. Keller</sponsor> (for himself, <cosponsor name-id="C001104">Mr. Cawthorn</cosponsor>, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, <cosponsor name-id="M000194">Ms. Mace</cosponsor>, and <cosponsor name-id="G000552">Mr. Gohmert</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 with respect to the release of unaccompanied alien children, and for other purposes.</official-title></form><legis-body id="H44AB5D7DF16E4CF39E282C3AF46B3263" style="OLC"><section id="H3EBB7977D9D34945B659846B7CCF0D8E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Sponsor Act of 2022</short-title></quote>.</text></section><section id="H25EEB199E1134F8AA2656405A2A14405"><enum>2.</enum><header>Release from custody</header><subsection id="H03838E3BA997435FB8AE67D259E81464"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 235(c)(3) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(c)(3)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HC5835A4619AC47F981614AD31C2D23E1" display-inline="no-display-inline"><subparagraph id="H34286FB7C5F441E8A1FAC77CB7364A53"><enum>(D)</enum><header>Citizenship or lawful permanent residency status</header><clause id="H5CE49663DBD544328E01C5CD72ADD03D"><enum>(i)</enum><header>In general</header><text>An unaccompanied alien child may not be placed with a proposed custodian unless the Secretary of Health and Human Services, in consultation with the Secretary of Homeland Security, determines that such custodian is a citizen of the United States or an alien lawfully admitted for permanent residence.</text></clause><clause id="HBEF49F0D738A4AE59F69B31918240BAD"><enum>(ii)</enum><header>Proof of status</header><text display-inline="yes-display-inline">For the purpose of clause (i), a proposed custodian shall demonstrate that they are a United States citizen or alien lawfully admitted for permanent residency by producing one of the following documents:</text><subclause id="HA341B84829FA4DDDA594486D03E86F16"><enum>(I)</enum><text>A valid unexpired United States passport or United States passport card.</text></subclause><subclause id="HD48EF8D8B490462CB5D1E8E2FAE7E242"><enum>(II)</enum><text>A birth certificate proving birth in the United States.</text></subclause><subclause id="HE48FC0776C2546D6AA07F242F6C5CE38"><enum>(III)</enum><text>A certificate of naturalization.</text></subclause><subclause id="H533FE5A488184AD7BC18E8D5847D39F6"><enum>(IV)</enum><text>A certificate of citizenship.</text></subclause><subclause id="HA0770E13173344159DFC6A10A2093F77" display-inline="no-display-inline"><enum>(V)</enum><text display-inline="yes-display-inline">A report designated as a <quote>Report of Birth Abroad of a Citizen of the United States</quote>, issued by a consular officer to document a citizen born abroad. </text></subclause><subclause id="H7320FD212BA147F8A97B67021D37CF06"><enum>(VI)</enum><text>An alien registration card or permanent resident card.</text></subclause></clause></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="HF5EB9510700B47F7830B4BEB793DB904"><enum>(b)</enum><header>Requirement of bond for placement</header><text>Section 235(c) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(c)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HCC018F16F56D4644A1068EF4A9194B4F" display-inline="no-display-inline"><paragraph id="H8BD3B2DAA05745B39003FFBEEEFD1A67"><enum>(7)</enum><header>Bond required for placement</header><text display-inline="yes-display-inline">In addition to the requirements of this section and before placing an unaccompanied alien child with a proposed custodian, the Secretary of Health and Human Services shall require a bond of at least $1,500, to be paid by the proposed custodian, in assurance that the unaccompanied alien child will attend, as necessary, each legal proceeding with respect to their immigration status.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
