R. 7205</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220324">March 24, 2022</action-date><action-desc><sponsor name-id="D000624">Mrs. Dingell</sponsor> (for herself and <cosponsor name-id="U000031">Mr. Upton</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 28, United States Code, to ensure those who incur losses as a result of hostile invasion in Europe have access to the United States courts to recover damages, and for other purposes.</official-title></form><legis-body id="H85EBFF47F2644A939E4EF5DE1CD16004" style="OLC"><section id="H160AC6E902F84B399B7BA5AB04E29698" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ukrainian Sovereignty Act of 2022</short-title></quote>.</text></section><section id="H5082BEA21D244AECAA5FB72B73E0384F"><enum>2.</enum><header>Authorizing certain actions in United States courts</header><subsection id="H384F4A4263694B2BAB8C1F9FE99A8CE8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/97">Chapter 97</external-xref> of title 28, United States Code, is amended by adding after section 1605B the following:</text><quoted-block style="USC" id="H1DFA0D9F34B846BCBED9A87B2E35A205" display-inline="no-display-inline"><section id="HD20AF22CF1C0404ABD02026C3768AF72"><enum>1605C.</enum><header>Authorizing certain actions in United States courts</header><subsection id="H0461B83B788042069FE83A140674EC83"><enum>(a)</enum><header>Civil action</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a foreign state shall not be immune from the jurisdiction of the courts of the United States in any case in which money damages are sought against the foreign state for physical injury, including death, property damage, or loss of property caused by the foreign state’s invasion of another sovereign nation located in Europe if such invasion—</text><paragraph id="H39832DD27AC247F7B762F9DB53971337"><enum>(1)</enum><text>was by or at the direction of the foreign state irrespective of where such injury, death, damage, or loss occurred; and</text></paragraph><paragraph id="H298A588377344815BE2D71B1A4348827"><enum>(2)</enum><text>has been, at any time, condemned by the General Assembly of the United Nations and by a concurrent resolution or separate resolutions of the United States House of Representatives and the United States Senate.</text></paragraph></subsection><subsection id="HF40B42ADA6E246128D05F7C6CE8701BE"><enum>(b)</enum><header>Attachment</header><text>Notwithstanding any other provision of law, including the limitations in section 1610, the property in the United States of the aggressor foreign state shall not be immune from attachment in aid of execution, or from execution, upon a judgment entered by a court of the United States or of a State after the effective date of this Act.</text></subsection><subsection id="H15EA9F2A96914F89ACB11FE69250DD3A"><enum>(c)</enum><header>Jurisdiction</header><text>The district courts of the United States shall have original jurisdiction, without regard to the amount in controversy, of any civil action made under this section. Personal jurisdiction over a foreign state shall exist as to each claim for relief where service has been made pursuant to section 1608.</text></subsection><subsection id="H01301978B3F4486B9534DFAD3E037341"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the term:</text><paragraph id="HCF83204897394A3EA747BCED0BD1931F" commented="no"><enum>(1)</enum><header>Foreign state</header><text>The term <quote>foreign state</quote> includes—</text><subparagraph id="HF84D6C128E884AB1BB2DE898518D1A1B" commented="no"><enum>(A)</enum><text>a foreign state as defined by section 1603(a);</text></subparagraph><subparagraph id="H6D3416459280489CA38934C806ED68A4" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">an agency or instrumentality of a foreign state as defined by section 1603(b); and </text></subparagraph><subparagraph id="H79DD76F08F814B85825E85857D410B2B" commented="no"><enum>(C)</enum><text>any official of a foreign state and any citizen of such state subject to any sanction by the United States through the Department of Commerce, the Department of Justice, or the Department of State.</text></subparagraph></paragraph><paragraph id="HF50C4A783D5144459A3C2D95877864D7"><enum>(2)</enum><header>Europe</header><text>The term <quote>Europe</quote> includes the following sovereign nations:</text><subparagraph id="H7E5EBAA3C6014EC9A759E7697B2DC85D"><enum>(A)</enum><text>Each sovereign nation that is a member of the European Union.</text></subparagraph><subparagraph id="HF7D4D522169149B6ADC740CB84E8438E"><enum>(B)</enum><text>United Kingdom.</text></subparagraph><subparagraph id="HF9F8B4C3E3F0435B88A87F05968AAF91"><enum>(C)</enum><text>Norway.</text></subparagraph><subparagraph id="H2AD20D029F5C42BF96E5AD5B7593BAA3"><enum>(D)</enum><text>Switzerland.</text></subparagraph><subparagraph id="HC6DB6657C8914BCB80BD23577BF47283"><enum>(E)</enum><text>Danish autonomous territory of Greenland.</text></subparagraph><subparagraph id="H9127CD9CB5564FF48BA3B86C3B9F081B"><enum>(F)</enum><text>Bulgaria.</text></subparagraph><subparagraph id="H7E4B344F42AD4ADFB32DD2725005174C"><enum>(G)</enum><text>Romania.</text></subparagraph><subparagraph id="HD90B44E783FA4EEC994016D23036B8DC"><enum>(H)</enum><text>Ukraine, including Crimea, Luhansk, and Donetsk.</text></subparagraph><subparagraph id="HEBBFF635F0FB47398540A852FCFECE82"><enum>(I)</enum><text>Croatia.</text></subparagraph><subparagraph id="H281521B2D8B1435F83C26BD0B9A56D11"><enum>(J)</enum><text>Republic of North Macedonia.</text></subparagraph><subparagraph id="H0B5FC3D1B4F24267BFF5D863AEAED756"><enum>(K)</enum><text>Albania.</text></subparagraph><subparagraph id="HC4BBC5EDC0CF470D8473A84C6786B367"><enum>(L)</enum><text>Bosnia and Herzogovina.</text></subparagraph><subparagraph id="HB1DB43F141BD4848B04A157CAAECD2B6"><enum>(M)</enum><text>Montenegro.</text></subparagraph><subparagraph id="H28BD3B6BA5A949BFB88ED1EEC181D6C9"><enum>(N)</enum><text>Moldova.</text></subparagraph><subparagraph id="HB2624C81B0134E38AFB225A4927C842F"><enum>(O)</enum><text>Andorra.</text></subparagraph><subparagraph id="H7BE3AC3CEA674C96ADD9AE057CCBE2B4"><enum>(P)</enum><text>Iceland.</text></subparagraph><subparagraph id="HEB211381E12E47998DC4AC8A86C1EEA6"><enum>(Q)</enum><text>Liechtenstein.</text></subparagraph><subparagraph id="HAF17591BE60240AB9F55EACE9F84DFB8"><enum>(R)</enum><text>San Marino.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB74D6A80789C48228FADCFE55BA8BDB3" commented="no"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/97">chapter 97</external-xref> of title 28, United States Code, is amended by inserting before the item relating to section 1605B the following new item:</text><quoted-block style="USC" id="H154BD36E19AC41C4922936771AC47757" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">1605C. Authorizing certain actions in United States courts.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5C67ADDBDEB6459A89FD80EC44AE6D1F"><enum>(c)</enum><header>Effective date; applicability</header><text display-inline="yes-display-inline">The amendments made by this Act shall take effect on the date of the enactment of this Act and shall apply with respect to any invasion of a sovereign nation occurring one year prior to, on, or after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
