<section id="HDA14ED1776E8448986D2EDD85E1DA716" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Flood Insurance Program Affordability Act</short-title></quote>. </text></section> <section id="H799D031BB92446CF9AE369883C11F9CB"><enum>2.</enum><header>Means-tested assistance for national flood insurance program policyholders</header> <subsection id="HE4A26F7BC8E44CF8AE6345A56A723667"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Federal Emergency Management Agency shall, not later than 1 year after the date of the enactment of this Act, establish a means-tested program under which the Administrator provides assistance to eligible policyholders in the form of graduated discounts for insurance costs with respect to covered properties.</text></subsection>
<subsection id="H931FFAC83E404446BB71681246B2B323"><enum>(b)</enum><header>Discounts</header><text display-inline="yes-display-inline">The Administrator shall use amounts provided under this section to establish graduated discounts available to eligible policyholders under this section, with respect to covered properties, such that the chargeable premium rate for an eligible policyholder that applies for assistance under this section may not exceed 1 percent of the area median income for the area in which the property to which the policy applies is located.</text></subsection> <subsection id="H7F8EBB1430D3432ABAA3E2F2D6E9819C"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">To receive assistance under this Act, an eligible policyholder shall submit an application to the Administrator at such time, in such manner, and containing such information as the Administrator may reasonably require and assistance will no longer be available when the amounts appropriated pursuant to subsection (f) have been expended for a fiscal year. </text></subsection>
<subsection id="H486B3ADE3EA448BDA25A5AA08C1F3B48" commented="no"><enum>(d)</enum><header>Rulemaking and guidance</header><text>Not later than 1 year after the date of the enactment of this Act, the Administrator shall issue such regulations and guidance as the Administrator determines necessary to carry out this Act, including a hardship metric for small businesses and not-for-profit entities to qualify for assistance under this Act. </text></subsection> <subsection id="HBDB766B4CCE544F6954CD34E5F1EFB26"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, the Administrator shall submit to the Congress, a report that—</text>
<paragraph id="H4B048E1690B142A4AED69FC6ADF0FA8D"><enum>(1)</enum><text>addresses the feasibility of making eligibility for assistance under the program established under this Act based on a consideration of an eligible policyholder’s principal, interest, taxes, and insurance instead of household income as a percent of area medium income; and</text></paragraph> <paragraph id="H687D749415A44E8FAE7549E73AFADE9A"><enum>(2)</enum><text>outlines how the Administrator could use income eligibility for other Federal programs to determine eligibility for participation in the program established under this Act. </text></paragraph></subsection>
<subsection id="HB716E09F13CE43DC8A9857703BE46813"><enum>(f)</enum><header>Appropriation</header>
<paragraph id="H2E77F0E9FCE24F2B897212A3C8224D5B"><enum>(1)</enum><header>In general</header><text>There is appropriated, annually, to the Administrator, out of any money in the Treasury not otherwise appropriated, $250,000,000, to carry out the program established by the Administrator under subsection (a). </text></paragraph> <paragraph id="HF121F9B77325491DAB2930EBA24D7375"><enum>(2)</enum><header>Expenditure requirement</header><text>The Administrator shall, each fiscal year, expend not less than 95 percent of the amount appropriated for such fiscal year under paragraph (1). </text></paragraph></subsection></section>
<section id="HE2B6A6EBAC984AB2930E8C69E85EB772"><enum>3.</enum><header>Monthly installment payment for premiums</header><text display-inline="no-display-inline"> Not later than 180 days after the date of enactment of this Act, the Administrator shall—</text> <paragraph id="HC1A0727B84274E2684E871FE1595C62A"><enum>(1)</enum><text>implement the requirement for monthly installment payments of premiums provided under section 1308(g) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015(g)</external-xref>); or</text></paragraph>
<paragraph id="HA797B9334EE14A11813262430482A351"><enum>(2)</enum><text>submit to Congress an explanation of the reasons why the Administrator cannot implement the requirement described in paragraph (1) during that 180-day period.</text></paragraph></section> <section id="H8B1AA8FABC0D4D03A83014BE16149AB6"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H8C426C06A25548648469C0301E2E1631"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency.</text></paragraph> <paragraph id="H91E608F88F124E6EB3903D61BE2A3BA2"><enum>(2)</enum><header>Covered property</header><text>The term <term>covered property</term> means—</text>
<subparagraph id="HA280AA913B0144F783B3E31CC373D90F"><enum>(A)</enum><text>a primary residential dwelling designed; or</text></subparagraph> <subparagraph id="H05F5A39491E444A7BC349B4F842A680C"><enum>(B)</enum><text>personal property relating to a dwelling described in subparagraph (A).</text></subparagraph></paragraph>
<paragraph id="H44A3B17184AD4B6FAFC078B1D19FEDC5"><enum>(3)</enum><header>Eligible policyholder</header><text>The term <term>eligible policyholder</term> means—</text> <subparagraph id="HC3E3DF19837E42B0B159A5BD13456048"><enum>(A)</enum><text>a person who—</text>
<clause id="HBC86C95EC7984718AF9AED88EBA80445"><enum>(i)</enum><text>is a national flood insurance program policyholder on or after the date of the enactment of this Act; and</text></clause> <clause id="H43F23255749E456C8640C51FC8D266C3"><enum>(ii)</enum><text>has a household income that is not more than 120 percent of the area median income for the area in which the property to which the policy applies is located;</text></clause></subparagraph>
<subparagraph id="H6965BC4FAF0A4ED983BB7ED2192018ED"><enum>(B)</enum><text>a business with not more than 100 employees that—</text> <clause id="H45A9404530F34229A35E8DDD79BE5C2C"><enum>(i)</enum><text>is a national flood insurance program policyholder on or after the date of the enactment of this Act; and</text></clause>
<clause id="H4B1BF069A87A431FB6172061B756FA95"><enum>(ii)</enum><text>satisfies the hardship metric published by the Administrator under section 2; or</text></clause></subparagraph> <subparagraph id="HB2B9F843FB1C41E7892742B1DB69CC93"><enum>(C)</enum><text>a not-for-profit organization that—</text>
<clause id="HE788F71C8A7644F185E22AA3E9E9AAB8"><enum>(i)</enum><text>is a national flood insurance program policyholder on or after the date of the enactment of this Act; and</text></clause> <clause id="HD30E28D926CD483B869BC0F6B6C64F9A"><enum>(ii)</enum><text>satisfies the hardship metric published by the Administrator under section 2.</text></clause></subparagraph></paragraph>
<paragraph id="H66A56D0D034A40CEBDFB22C96586CB23"><enum>(4)</enum><header>Insurance costs</header><text>The term <term>insurance costs</term> means, with respect to a covered property for a year—</text> <subparagraph id="H5252DEE2416B48D1A2F4EDDA27419EDC"><enum>(A)</enum><text>risk premiums and fees estimated under section 1307 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4014">42 U.S.C. 4014</external-xref>) and charged under section 1308 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015</external-xref>);</text></subparagraph>
<subparagraph id="HD0E3475ABB1E487DAF3C80278848C2DD"><enum>(B)</enum><text>surcharges assessed under sections 1304 and 1308A of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4011">42 U.S.C. 4011</external-xref>, 4015a); and</text></subparagraph> <subparagraph id="HB32237C915F94A34A2A8683F46740290"><enum>(C)</enum><text>any amount established under section 1310A(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4017a">42 U.S.C. 4017a</external-xref>).</text></subparagraph></paragraph></section>
