which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><action display="yes"><action-date date="20220720">July 20, 2022</action-date><action-desc>Reported with amendments, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on March 24, 2022</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for certain whistleblower incentives and protections.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HBA00" reported-display-style="italic" id="H135F78E64D0147C78451CC0215E8A6D4"><section id="H6C67ABB8D8ED4E2A919D4D76B880F67A" section-type="section-one"><enum>1.</enum><header>Whistleblower incentives and protections</header><subsection id="H226FB3F6C6A0435A9C9E05A38DCC8F4E"><enum>(a)</enum><header>Awards for whistleblowers</header><paragraph id="H78FC0BAF5B8F44109999F9BFDB72A0F3"><enum>(1)</enum><header>In general</header><text>Section 5323 of title 31, United States Code, is amended by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2F3CE1EC15654E7D803D701970B63A76" changed="added" reported-display-style="italic" committee-id="HBA00"><subsection id="HC7BB57CEC214495497CE920F3E3BEC42"><enum>(b)</enum><header>Awards</header><paragraph id="H062BF444DB884AF3B09EAA1D0C20F3C6"><enum>(1)</enum><header>In general</header><text>In any covered judicial or administrative action, or related action, the Secretary, under regulations prescribed by the Secretary, in consultation with the Attorney General and subject to subsection (c), shall pay an award or awards to 1 or more whistleblowers who voluntarily provided original information to the employer of the individual, the Secretary, or the Attorney General, as applicable, that led to the successful enforcement of the covered judicial or administrative action, or related action, in an aggregate amount equal to—</text><subparagraph id="H713C37DF8FA64F11B42499A8BB5022DB"><enum>(A)</enum><text>not less than 10 percent, in total, of what has been collected of the monetary sanctions imposed in the action or related actions; and</text></subparagraph><subparagraph id="H212B2171F8B247F4AC12C96387E5C504"><enum>(B)</enum><text>not more than 30 percent, in total, of what has been collected of the monetary sanctions imposed in the action or related actions.</text></subparagraph></paragraph><paragraph id="H54E1456F3FE44738B208AD8526CDFB02"><enum>(2)</enum><header>Payment of awards</header><subparagraph id="H0AB223999D054DE19BFA2F8B898D998C"><enum>(A)</enum><header>In general</header><text>Any amount paid under paragraph (1) shall be paid from the Fund established under paragraph (3).</text></subparagraph><subparagraph id="H4ACDEBA6AC954214A608A6E7BB47AEF2"><enum>(B)</enum><header>Related actions</header><text>The Secretary may pay awards less than the amount described in paragraph (1)(A) for related actions in which a whistleblower may be paid by another whistleblower award program. </text></subparagraph></paragraph><paragraph id="H272D1EF2E43E49D7999A72E856FCF361"><enum>(3)</enum><header>Source of awards</header><subparagraph id="H3A0EDE46C6DE4601AA495FAFC06BEA47"><enum>(A)</enum><header>In general</header><text>There shall be established in the Treasury of the United States a revolving fund to be known as the Financial Integrity Fund (referred to in this subsection as the <quote>Fund</quote>).</text></subparagraph><subparagraph id="H35F98D773FBF4842BD8B0B9DA1297114"><enum>(B)</enum><header>Use of fund</header><text>The Fund shall be available to the Secretary, without further appropriation or fiscal year limitations, only for the payment of awards to whistleblowers as provided in subsection (b).</text></subparagraph><subparagraph id="H4067033E92DA4A9B90FABEB9A92973DD"><enum>(C)</enum><header>Restrictions on use of fund</header><text>The Fund shall not be available to pay any personnel or administrative expenses.</text></subparagraph></paragraph><paragraph id="H27ABB4C6D7B747E88DADC059F912861C"><enum>(4)</enum><header>Deposits and credits</header><subparagraph id="HBF8362BD24954D09BB076A0D03A6FC5E"><enum>(A)</enum><header>In general</header><text>There shall be deposited into or credited to the Fund an amount equal to—</text><clause id="H729FFF683AE7488495639EEE964BD40A"><enum>(i)</enum><text>any monetary sanction collected by the Secretary or Attorney General in any judicial or administrative action under this title or a covered statute, unless the balance of the Fund at the time the monetary sanction is collected exceeds $300,000,000; and </text></clause><clause id="H4E73B13C61094D11AFCD9C62E585151D"><enum>(ii)</enum><text>all income from investments made under paragraph (5).</text></clause></subparagraph><subparagraph id="H15087CB6E45F4BFC8EE88DF118DA71FA"><enum>(B)</enum><header>Additional amounts</header><text>If the amounts deposited into or credited to the Fund under subparagraph (A) are not sufficient to satisfy an award made under this subsection, there shall be deposited into or credited to the Fund an amount equal to the unsatisfied portion of the award from any monetary sanction collected by the Secretary of the Treasury or Attorney General in the covered judicial or administrative action on which the award is based.</text></subparagraph><subparagraph id="HBFA184D9DFEA40EF9A658B182783F45F"><enum>(C)</enum><header>Exception</header><text>No amounts to be deposited or transferred into the United States Victims of State Sponsored Terrorism Fund established under to the Justice for United States Victims of State Sponsored Terrorism Act (<external-xref legal-doc="usc" parsable-cite="usc/34/20144">34 U.S.C. 20144</external-xref>) or the Crime Victims Fund established under section 1402 of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/34/20101">34 U.S.C. 20101</external-xref>) shall be deposited into or credited to the Fund.</text></subparagraph></paragraph><paragraph id="H6FC34A6763F24D26876CF14723AAC8D2"><enum>(5)</enum><header>Investments</header><subparagraph id="H53E6FEF554F94F0088BEAC37058605C5"><enum>(A)</enum><header>Amounts in fund may be invested</header><text>The Secretary of the Treasury may invest the portion of the Fund that is not required to meet the current needs of the Fund.</text></subparagraph><subparagraph id="H59F513B8161741C2BA2443CDAA55E5D5"><enum>(B)</enum><header>Eligible investments</header><text>Investments shall be made by the Secretary of the Treasury in obligations of the United States or obligations that are guaranteed as to principal and interest by the United States, with maturities suitable to the needs of the Fund as determined by the Secretary.</text></subparagraph><subparagraph id="H9A53E27888E24B33A114A9CD5A7A850E"><enum>(C)</enum><header>Interest and proceeds credited</header><text>The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to, and form a part of, the Fund.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HFAFDF13F5B4246BAA22B714C2435B10D"><enum>(2)</enum><header>Covered statute defined</header><text display-inline="yes-display-inline">Section 5323(a) of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H5BC93D647D5440BBB32A99A905F1CE9C" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><paragraph id="HE685203AC1714B53A7D2280699EB65C6"><enum>(6)</enum><header>Covered statute defined</header><text display-inline="yes-display-inline">In this section, the term <quote>covered statute</quote> means—</text><subparagraph id="H017075CE48EB42CB96D693A51C87AD72"><enum>(A)</enum><text display-inline="yes-display-inline">the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>);</text></subparagraph><subparagraph id="HA0619C5D9E05437C871604A4368BF3B3"><enum>(B)</enum><text>sections 5 and 12 of the Trading With the Enemy Act (<external-xref legal-doc="usc" parsable-cite="usc/50/4305">50 U.S.C. 4305</external-xref>; 4312); and</text></subparagraph><subparagraph id="H79813FCC0BA148599FE81CFA505A3722"><enum>(C)</enum><text display-inline="yes-display-inline">the Foreign Narcotics Kingpin Designation Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1901">21 U.S.C. 1901 et seq.</external-xref>).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD31EEDE5E3F345398442B9EF82F3D161"><enum>(b)</enum><header>Technical and conforming amendments</header><text>Section 5323 of title 31, United States Code, is amended—</text><paragraph id="H6DA2A4FC359B4DD68233332F1CBA32FF"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H968DB95BAD844A298B5F88A4D2705DD8"><enum>(A)</enum><text>in paragraphs (1) and (5), by striking <quote>this subchapter or subchapter III</quote> each place the term appears and inserting <quote>this subchapter or a covered statute, or for a conspiracy to violate such subchapter or covered statute,</quote>; and</text></subparagraph><subparagraph id="H15E60A81836F40A5943792D5EA3E7F75" commented="no"><enum>(B)</enum><text>in paragraph (4)—</text><clause id="HA8AB287FA70C4507A1F6E1375B1DD990" commented="no"><enum>(i)</enum><text>by striking <quote>with respect to</quote> and all that follows through <quote>subchapter III</quote> and inserting <quote>with respect to any covered judicial or administrative action</quote>; and</text></clause><clause id="H96233BFDBFBF4FE4A157DD18F4F9C09C" commented="no"><enum>(ii)</enum><text>by striking <quote>action by the Secretary or the Attorney General</quote> and inserting <quote>covered judicial or administrative action</quote>;</text></clause></subparagraph></paragraph><paragraph id="H0179078B76BD4534B031E0DD99C1AB69" display-inline="no-display-inline"><enum>(2)</enum><text>in subsection (c)(1)(B)(iii)—</text><subparagraph id="H64972231E8234713A6434B93578D1735"><enum>(A)</enum><text>by striking <quote>subchapter and subchapter III</quote> and inserting <quote>this subchapter or a covered statute, or a conspiracy or attempt to violate such subchapter or covered statute,</quote>; and</text></subparagraph><subparagraph id="H2B4C11AB9CAD48E6B963E32D2BBB6F5D"><enum>(B)</enum><text>by striking <quote>either such subchapter</quote> and inserting <quote>the applicable subchapter or covered statute</quote>; and</text></subparagraph></paragraph><paragraph id="HAE6647E8C5D54FBFBD16FCFB58C9C6D3"><enum>(3)</enum><text>in subsection (g)(4)(D)(i), by inserting <quote>or a covered statute</quote> after <quote>subchapter,</quote>.</text></paragraph></subsection></section></legis-body><official-title-amendment>Amend the title so as to read: <quote>A bill to amend title 31, United States Code, to provide for certain whistleblower incentives and protections.</quote>.</official-title-amendment><endorsement display="yes"><action-date date="20220720">July 20, 2022</action-date><action-desc>Reported with amendments, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
