committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to provide a special rule for designating former industrial tracts contiguous to designated opportunity zones, and for other purposes.</official-title></form><legis-body id="H16F8172C2DFC447BB6293C8BC991D959" style="OLC"><section id="HE8D092C0583D4F39BFA11C0272800527" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rust to Revitalization Act of 2022</short-title></quote>.</text></section><section id="HA601F1F0A3E24ADFA01F8D7C41D78B98"><enum>2.</enum><header>Certain former industrial tracts designated as opportunity zones</header><subsection id="HB4949A445DCB4CC7A6744B69F7F340C9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/1400Z">Section 1400Z–1(b)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H2B335887277E4BA08EA09E7001DBB0E2"><paragraph id="H957DB0EA19F24599834A57471E2EBCCB"><enum>(4)</enum><header>Special rule for former industrial tracts contiguous to designated opportunity zones</header><subparagraph id="H040936A18D244731A3E37B4CDEE70F0E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each population census tract described in subparagraph (B) shall be deemed to be certified and designated as a qualified opportunity zone, effective on the date of the enactment of this paragraph.</text></subparagraph><subparagraph id="HEEA44EEBC1034EBD9F443677CEE72E60"><enum>(B)</enum><header>Population census tract described</header><text display-inline="yes-display-inline">A population census tract is described in this subparagraph if—</text><clause id="HDE39DB0BD0324053AB3C33D437EB065C"><enum>(i)</enum><text>the tract—</text><subclause id="H08D2930A42D247D6BF92244C309E177D"><enum>(I)</enum><text>has a population of zero, </text></subclause><subclause id="HFFCC7531DC9E4EB9B8DA658288E8E6D1"><enum>(II)</enum><text>was previously used for industrial purposes and is a brownfield industrial site, and </text></subclause><subclause id="H49637C7F5D4D4664A38F0CB9797D0F72"><enum>(III)</enum><text display-inline="yes-display-inline">is contiguous, including by water, to a population census tract that has been designated as a qualified opportunity zone under this section, or</text></subclause></clause><clause id="HC1C3E54C622C4420A2367BF8D657BFEC"><enum>(ii)</enum><text>the tract was merged, as a result of the 2020 decennial census, into a census tract described in clause (i)(III) and met all requirements described in subclause (i) prior to such merger.</text></clause></subparagraph><subparagraph id="H17A78F9C82D44A1A949F4E51031FABB8"><enum>(C)</enum><header>Determination of census tract information</header><text display-inline="yes-display-inline">For purposes of this paragraph, the boundaries and population of a census tract shall be determined based on United States Census Bureau data for the 2010 decennial census. </text></subparagraph><subparagraph id="H73D1EC28F3CB48A788CBCDFE9ACA8E60"><enum>(D)</enum><header>Notification</header><text display-inline="yes-display-inline">The Secretary shall notify in writing the chief executive officer of the State in which a population census tract is certified and designated as a qualified opportunity zone under this paragraph of such designation.</text></subparagraph><subparagraph id="H98C832EAB21D41BDB6905DF1849351A7"><enum>(E)</enum><header>Number of designations</header><text display-inline="yes-display-inline">Population census tracts certified and designated as a qualified opportunity zone under this paragraph shall not be taken into account for purposes of subsection (d).</text></subparagraph><subparagraph id="HF69F0A939BA449BE97C395E7ED33DA15"><enum>(F)</enum><header>Definitions</header><text>For purposes of this paragraph—</text><clause id="HFE22BF7FC28E4930814FB52B37C3FC59"><enum>(i)</enum><header>Brownfield industrial site</header><text display-inline="yes-display-inline">The term <quote>brownfield industrial site</quote> means a census tract that includes real property the expansion, redevelopment, or reuse of which may be complicated by the presence or potential presence of a hazardous substance or pollutant or contaminant, including real property covered by a prospective purchaser agreement or similar agreement entered into by the Environmental Protection Agency or the appropriate State authority. </text></clause><clause id="H9AACDD0DCEA240E0897CB7AEC7644828"><enum>(ii)</enum><header>Hazardous substance</header><text display-inline="yes-display-inline">The term <quote>hazardous substance</quote> means—</text><subclause id="HE88DE86BEAAA4BA9BE167B151458BF70"><enum>(I)</enum><text display-inline="yes-display-inline">a hazardous substance as defined in section 101(14) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (42 U.S.C 9601(14)), or</text></subclause><subclause id="HCDBB90CA09024E9AB34EF45AA1C8F3F5"><enum>(II)</enum><text>petroleum or a petroleum product. </text></subclause></clause><clause id="H4933EF93A1A5416EA91FE473B9121C49"><enum>(iii)</enum><header>Pollutant or contaminant</header><text>The term <quote>pollutant or contaminant</quote> has the meaning given such term in section 101(33) of such Act. </text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFC106394FEB3443B8DB183D454331EFF"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
