Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Lobbying Disclosure Act of 1995 to require certain lobbyists to report certain contacts with agencies within 48 hours, and for other purposes.</official-title></form><legis-body id="H44299AB09C6B466DB125B88E4AA50229" style="OLC"><section id="H5E9F40E0FACD4E70A641ED5E748AD3EA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Closing Loopholes, Ending Anonymous Revolving Doors Act</short-title></quote> or the <quote><short-title>CLEAR Doors Act</short-title></quote>.</text></section><section id="H445408B5606B4C39B87E39EFBE83C6CA"><enum>2.</enum><header>Reporting requirements</header><subsection id="H13EC5DE2BFFA4EE4BA3B49B8BB1AFFEA"><enum>(a)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">Section 5 of Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604</external-xref>) is amended—</text><paragraph id="H4FAD93EE36BF46BB831713B8B8A6F2CC"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph><paragraph id="H4258757AB95B4BF49F3ADC3A2C5E694F"><enum>(2)</enum><text>by inserting after subsection (d) the following new subsection:</text><quoted-block style="OLC" id="H2533881AE759426F98E6D773B6629EBE" display-inline="no-display-inline"><subsection id="H132DD3D9D74E49639CB83B3EF7ED5174"><enum>(e)</enum><header>48-Hour reports</header><paragraph id="HFE8FBCD539964FBFAAD8EB5A1D15CFD8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No later than 48 hours after a lobbyist engages in special lobbying activities, the registrant involved shall file a report with the Secretary of the Senate and the Clerk of the House of Representatives on such activities.</text></paragraph><paragraph id="H23C9E404609240358FADB3B490CF301E"><enum>(2)</enum><header>Contents of report</header><text>Each report filed under paragraph (1) shall contain the following items:</text><subparagraph id="H6448E8027E2F44C1B9A0CBF48D5C9FE5"><enum>(A)</enum><text display-inline="yes-display-inline">The name of the registrant.</text></subparagraph><subparagraph id="HD8321C76CBAB448CBEE77E24C088E993"><enum>(B)</enum><text>The name of the client.</text></subparagraph><subparagraph id="H67ECEBA9B62A472F9A208834374E2BAE"><enum>(C)</enum><text>The name of the covered executive branch official of the agency.</text></subparagraph><subparagraph id="HD405C74BA1624C6880BD29DAA8FCF4E3"><enum>(D)</enum><text>A description of the issue discussed before such agency official.</text></subparagraph><subparagraph id="H8B48C4DB8A924443B5BB2143499F84B5"><enum>(E)</enum><text>The date on which such lobbying activities occurred.</text></subparagraph></paragraph><paragraph id="H3052F6170C6848589C019BFF39122745"><enum>(3)</enum><header>Special rule for new registrants</header><text display-inline="yes-display-inline">If a lobbyist engages in special lobbying activities prior to the registration of the lobbyist (or, if applicable, the organization employing such lobbyist) with the Secretary of the Senate and the Clerk of the House of Representatives under section 4(a), the lobbyist or organization shall register with the Secretary and the Clerk under such section not later than 48 hours after the lobbyist or organization engages in such activities.</text></paragraph><paragraph id="HBB06A33D5AF54964B8F907F2C2A9C240" commented="no"><enum>(4)</enum><header>Special lobbying activities defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>special lobbying activities</term> means any lobbying activity consisting of a lobbying contact made by an employee of a client with a covered executive branch official of an agency of which such lobbyist was formerly employed during the 4–year period that ends on the date of such contact.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H77DF36F9370946709E06872B6480231E"><enum>(b)</enum><header>Lobbyist definition</header><text display-inline="yes-display-inline">Section 3(10) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1602">2 U.S.C. 1602(10)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H99325483F2734C81A1D506CABB8C6F04" display-inline="no-display-inline"><paragraph id="HD79D49AACC304D59BED3D60EEF495C6F"><enum>(10)</enum><header>Lobbyist</header><subparagraph id="HE18D7ECBE4D848D09AF09A3463A5C4E0"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), term <quote>lobbyist</quote> means any individual who is employed or retained by a client for financial or other compensation for services that include more than one lobbying contact.</text></subparagraph><subparagraph id="HE53812F4807D40FA85E8196CCA26A896"><enum>(B)</enum><header>Exception</header><clause id="H54400F503C224CBFA29D40DBF27EBDA4"><enum>(i)</enum><header>20 percent rule</header><text>Except as provided in clause (ii), subparagraph (A) does not apply to an individual with respect to a client if the individual’s lobbying activities constitute less than 20 percent of the time engaged in the services provided by such individual to that client over a 3–month period.</text></clause><clause id="HC604E47D6BEF48FCB1B50868EAA74818"><enum>(ii)</enum><header>Special lobbying activities exception</header><text>Clause (i) does not apply to special lobbying activities under section 5(e).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H40B9D82ABDBF4046AF24B8D9A64AAA51"><enum>(c)</enum><header>Conforming and technical amendments</header><paragraph id="H5C1009CD811E49D0A65C5CE4D3506922" commented="no"><enum>(1)</enum><header>Lobbyist registration</header><text display-inline="yes-display-inline">Section 4(a)(1) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1603">2 U.S.C. 1603(a)(1)</external-xref>) is amended by striking <quote>No later than</quote> and inserting <quote>Except as provided in section 5(e)(3), no later than</quote>.</text></paragraph><paragraph id="H6E793D966B5C40E0976CC79B0CF33F2B"><enum>(2)</enum><header>Cross-reference</header><text>Section 6(a)(4) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1605">2 U.S.C. 1605(a)(4)</external-xref>) is amended by striking <quote>section 5(e)</quote> and inserting <quote>section 5(f)</quote>.</text></paragraph></subsection><subsection id="HCAB05C5FD0EA497A92FCA2B073DC4DE7"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to lobbying activities occurring on or after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
