which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a grant program to assist States to establish or expand universal prekindergarten in public schools and public charter schools.</official-title></form><legis-body id="HF4D311BDB3A44A77B780B6638C6A19FC" style="OLC"><section id="HC85C24D18E9045AF8864068AA02B8D61" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Universal Prekindergarten and Early Childhood Education Act of 2022</short-title></quote>.</text></section><section id="H92C836066743408BB5000E2F69A5D471"><enum>2.</enum><header>Universal Prekindergarten and Early Childhood Education grant program</header><subsection id="HA664147AF8D7466480486D703800D707"><enum>(a)</enum><header>Program authorization</header><text display-inline="yes-display-inline">From amounts appropriated under section 3, the Secretary of Education is authorized to award grants, on a competitive basis, to States to pay the Federal share of establishing or expanding full-day prekindergarten programs.</text></subsection><subsection id="H9E61C1D3186B4A86AE4E234EEC29EAC9"><enum>(b)</enum><header>State application</header><text display-inline="yes-display-inline">To receive a grant under this Act, a State shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="H8F092EBB939A46E5AC5F207906E899F5"><enum>(c)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A State that receives a grant under this Act shall use such grant funds to establish or expand a prekindergarten program that, at a minimum—</text><paragraph id="HF9E18A11CE5E495692F8BBBADDBD2791"><enum>(1)</enum><text display-inline="yes-display-inline">is located at a public school in the State;</text></paragraph><paragraph id="H58342B0B904A4A1C9342820DA19AF246"><enum>(2)</enum><text display-inline="yes-display-inline">permits each 3- or 4-year-old child in the State to be voluntarily enrolled by the child’s parent, regardless of income, in the program at a school in which the child may be enrolled for kindergarten;</text></paragraph><paragraph id="H9058A7F7ADF941AF84090F538E9EBE4E"><enum>(3)</enum><text>is a full-day program that runs the length of the regular school year;</text></paragraph><paragraph id="H5ABAECFF91AD42C794BB2484344947BF"><enum>(4)</enum><text>is taught by teachers who possess equivalent or similar qualifications to the qualifications of teachers of other grades in the school involved; and</text></paragraph><paragraph id="H02626CCF8784474F881D3D951F3341B4"><enum>(5)</enum><text>meets any other criteria that the Secretary may require.</text></paragraph></subsection><subsection id="HD5D8B91AC7964AE5AE3873A2CA103D03"><enum>(d)</enum><header>Federal share</header><text display-inline="yes-display-inline">The Federal share of a grant under this Act shall be not more than 80 percent of the costs of carrying out the activities described in subsection (c).</text></subsection><subsection id="H0D4ED16C69F448D590DCB58A9618F1BB"><enum>(e)</enum><header>Supplement not supplant</header><text display-inline="yes-display-inline">Grant funds received under this Act shall be used to supplement and not supplant other Federal early childhood education funds in the State.</text></subsection></section><section display-inline="no-display-inline" id="HCB0007BBA0834645A736B5B3B296E62D"><enum>3.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this Act such sums as may be necessary for fiscal years 2022 through 2027.</text></section><section id="H52D0FA0A411D44C0B71B6D0D6E8275D8"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H9A3F240B3CEE498C9F931C98C846AE03"><enum>(1)</enum><header>Full-day</header><text display-inline="yes-display-inline">The term <term>full-day</term> used with respect to a program, means a program with a minimum of a 6-hour schedule per day.</text></paragraph><paragraph id="HC0DDF49604234511A67A9709A7084C03"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Education.</text></paragraph><paragraph id="H274275F1C5CD4085B8705FCE5674B922"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="H710F3755E78448D0A4EF62C97FF855F9"><enum>(4)</enum><header>Parent</header><text display-inline="yes-display-inline">The term <term>parent</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="HF784A1E4D2F449578CFDD4374C47D96B"><enum>(5)</enum><header>Public school</header><text display-inline="yes-display-inline">The term <term>public school</term> has the meaning given the term <term>elementary school</term> or <term>secondary school</term> in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>), except that the term does not include private schools.</text></paragraph></section></legis-body></bill>
