R. 704</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>June 24, 2021</action-date><action-desc>Received; read twice and placed on the calendar</action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend section 708 of title 17, United States Code, to permit the Register of Copyrights to waive fees for filing an application for registration of a copyright claim in certain circumstances, and for other purposes.</official-title></form><legis-body id="H003A9D64CC3C422DAF1D1BA6DE867016" style="OLC"><section id="HC239E1CA61D042B7A3055D266D44A901" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Artistic Recognition for Talented Students Act</short-title></quote> or the <quote><short-title>ARTS Act</short-title></quote>.</text></section><section id="H4F6C8DA8A2484728867D718A8D099F6D"><enum>2.</enum><header>Waiver of fees for winners of certain competitions</header><text display-inline="no-display-inline">Section 708 of title 17, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H432D5621A3A447A3B07209254D7462EE" style="USC"><subsection id="H5D672448E799432F8C20FF266597B23F"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HA1844CA9F9A54D978D2A9A2F9FDB9CC7"><enum>(1)</enum><text>In this subsection, the term <term>covered competition</term> means—</text><subparagraph id="H8FCBB3A463B04C0F810473067C30953E" indent="up1"><enum>(A)</enum><text>an art competition sponsored by the Congressional Institute that is open only to high school students; and</text></subparagraph><subparagraph id="HF7011EBB8FA645898294226986701FBC" indent="up1"><enum>(B)</enum><text>the competition described in section 3 of H. Res. 77, as adopted by the 113th Congress.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H6136A9D865AE49BF8E5CCFA105DF47B8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to a work that wins a covered competition, the Register of Copyrights—</text><subparagraph display-inline="no-display-inline" id="HE16A2CA2493640188355A7163B40BEFF"><enum>(A)</enum><text>shall waive the requirement under subsection (a)(1) with respect to an application for registration of a copyright claim for that work if that application is filed not later than the last day of the calendar year following the year in which the work claimed by the application wins the covered competition (referred to in this paragraph as the <quote>covered year</quote>); and</text></subparagraph><subparagraph display-inline="no-display-inline" id="H33E14AFA45564B20902D45DF93CE4A8F"><enum>(B)</enum><text>may waive the fee described in subparagraph (A) for an application filed after the end of the covered year if the fee would have been waived under that subparagraph had the application been submitted before the last day of the covered year.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><attestation><attestation-group><attestation-date date="20210623" chamber="House">Passed the House of Representatives June 23, 2021.</attestation-date><attestor display="yes">Cheryl L.
