<committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Office of Rural Prosperity, and for other purposes.</official-title></form><legis-body id="HD0B2A2CC47194A9C8C6E080A3E75EB40" style="OLC"><section section-type="section-one" id="HFA31672FD0EA4CEA907AC6832D3A9BC1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Prosperity Act of 2022</short-title></quote>.</text></section><section id="HC6DDE04846024DF48494A948A2810100"><enum>2.</enum><header>Office of Rural Prosperity</header><subsection id="H57951ACF7E39423691BF8159697E403C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established in the Executive Office of the President the Office of Rural Prosperity (referred to in this section as the <term>Office</term>).</text></subsection><subsection id="HC26F805B2B114A928C9325DB30936D00"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Office is to address the social, economic, and community well-being and resilience of rural areas in the United States by addressing unique structural challenges experienced by rural communities, including housing, education, healthcare, small business development, and job creation.</text></subsection><subsection id="HAF80ACF411A4465D9641F4176A66583E"><enum>(c)</enum><header>Chief Rural Advisor</header><paragraph id="H680AEF2811F643B1B60350FD9D4D58EE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Office shall be headed by the Chief Rural Advisor, who shall be appointed by the President.</text></paragraph><paragraph id="H2E9010E139534A26A7B452DFCF006804"><enum>(2)</enum><header>Compensation</header><text display-inline="yes-display-inline">The Chief Rural Advisor shall be compensated at the rate provided for level II of the Executive Schedule in section 5313 of title 5, United States Code.</text></paragraph></subsection><subsection id="H59675CACB24A4CCE9D555F0587ADE565"><enum>(d)</enum><header>Duties</header><text>The Chief Rural Advisor shall—</text><paragraph id="HCAB699C59FE94820971C52C39DCB6717"><enum>(1)</enum><text>not later than 1 year after the date of enactment of this Act, develop, and not less frequently than every 3 years thereafter, update, a comprehensive strategy for rural development across the Executive Branch, which shall—</text><subparagraph id="HCBED88F75A9745CC8C2E830C339F5F52"><enum>(A)</enum><text>identify the most pressing priorities of the United States to promote rural prosperity in the 10-year period following the date of submission of the report under subsection (f)(2); and</text></subparagraph><subparagraph id="HF07E5423C60748EB936D2285ADEA287E"><enum>(B)</enum><text>describe the policy actions that will be taken by the Federal Government, across Federal agencies and programs, to accelerate and support social and economic prosperity in rural areas; </text></subparagraph></paragraph><paragraph id="HF58990016B8F46DB86A852272D6A5E9A"><enum>(2)</enum><text>using the metrics developed under subsection (e), develop whole-of-government recommendations to improve the return on investment of Federal resources and engagement relating to the needs of rural areas in the United States; </text></paragraph><paragraph id="H974CCCDBF6824E079AFB71766D53ABB8" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>make recommendations to the President on coordinating, streamlining, and leveraging Federal investments in rural areas to increase the impact of Federal dollars to improve economic opportunities and the quality of life in rural areas in the United States;</text></paragraph><paragraph id="H77CA5CF8581A4EE8B17C1804AEB769EE"><enum>(4)</enum><text>coordinate, and improve community-level outcomes and return on investment of, Federal engagement relating to the needs of rural areas in the United States with stakeholders based in rural communities, including—</text><subparagraph id="HA056FCC98F8144F5949D39186C86AA39"><enum>(A)</enum><text>agricultural organizations;</text></subparagraph><subparagraph id="H71A35B894FFC4A3A90BDCEC71C4E73C2"><enum>(B)</enum><text>small businesses;</text></subparagraph><subparagraph id="H3F9E5603CE7A444E8CCE66473ABF7FAC"><enum>(C)</enum><text>education and training institutions;</text></subparagraph><subparagraph id="HF23C3F81B4704723AD2CB0652AD878AE"><enum>(D)</enum><text>health care providers;</text></subparagraph><subparagraph id="H6A9DF32514724DBAB74137B3B9FE356F"><enum>(E)</enum><text>telecommunications services providers;</text></subparagraph><subparagraph id="H71E29F470388425C96D70E8F5F8CF985"><enum>(F)</enum><text>electric service providers;</text></subparagraph><subparagraph id="H3C9836DCCEB74A8DAB6E912B1B36345A"><enum>(G)</enum><text>transportation providers;</text></subparagraph><subparagraph id="HEDB7A1517FF04BE78194730E648589A8"><enum>(H)</enum><text>research and land-grant institutions;</text></subparagraph><subparagraph id="HB2D9298E726D4A2D922A4D7275E43A6E"><enum>(I)</enum><text>law enforcement agencies;</text></subparagraph><subparagraph id="H563B16AADAD84E26B016C3B9E65D11C7"><enum>(J)</enum><text>State, local, and Tribal governments (including a Native village and a Native Corporation, as those terms are defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>)); and</text></subparagraph><subparagraph id="HCCAE778CE30845B7B5766BB30EACCA8F"><enum>(K)</enum><text>nongovernmental organizations; </text></subparagraph></paragraph><paragraph id="H868392E8BF1D4544AA29B6A9F7EC3C13"><enum>(5)</enum><text>coordinate Federal efforts directed toward the growth and development of rural geographic regions that encompass metropolitan and nonmetropolitan areas;</text></paragraph><paragraph id="H32F4DCD297BA400F9865CE7F2489E99D"><enum>(6)</enum><text>identify and facilitate rural economic opportunities associated with energy transitions, outdoor recreation, and other conservation-related activities; </text></paragraph><paragraph id="HE064B504852B42B6AB65CE8379A05C4C"><enum>(7)</enum><text>identify common economic and social challenges faced by rural communities that could be overcome through better coordination of existing Federal and non-Federal resources; and</text></paragraph><paragraph id="HD0FC687E0F5C4AB587A1E08CBF38F49B"><enum>(8)</enum><text>convene public hearings (including with the power to call witnesses and request documents from Federal agencies) on the state of rural areas in the United States and the comprehensive strategy for rural development developed under paragraph (1). </text></paragraph></subsection><subsection id="H4C329868A33B4A6998167425DF740DBA"><enum>(e)</enum><header>Metrics</header><paragraph id="H36F25242A21C41DCB1CF0472CD48AB26"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Chief Rural Advisor shall develop metrics to measure the effect of Federal programs on rural areas in the United States.</text></paragraph><paragraph id="H2E1CDF17A8154637ABD6361BB7383C32"><enum>(2)</enum><header>Requirements</header><text>In developing the metrics under paragraph (1), the Chief Rural Advisor shall—</text><subparagraph id="HF529EC670D5B4F76B5BE8E0ADD40D6AB"><enum>(A)</enum><text>develop a comprehensive list of federally administered programs that are available to individuals, businesses, nonprofit organizations, units of local government, or other entities located in rural areas in the United States; and</text></subparagraph><subparagraph id="HD96643102AD14C1D9BAAC89E05ABA833"><enum>(B)</enum><text>develop a comprehensive set of metrics, including—</text><clause id="H14511BAC2BBE4130BCA5FD3606ABC0A4"><enum>(i)</enum><text>employment in a rural area;</text></clause><clause id="H979221D8CE5046C2871C87269F100824"><enum>(ii)</enum><text>inequality in a rural area;</text></clause><clause id="H81D0D8E695034553B3595AAFE0A6D4B6"><enum>(iii)</enum><text>economic competitiveness of a rural area;</text></clause><clause id="H1000DB4D853F4A95BB85C13CB16F1376"><enum>(iv)</enum><text>inflation or deflation in a rural area;</text></clause><clause id="H0ED774030E3849E7AB431E101C50FE82"><enum>(v)</enum><text>housing availability and costs in a rural area;</text></clause><clause id="H9BD0E3A4C9BC4753B63DA6177F368229"><enum>(vi)</enum><text>access to health care or telehealth in a rural area;</text></clause><clause id="HB09A8333697142D290B560D33F536C26"><enum>(vii)</enum><text>the rate of small business startups in a rural area;</text></clause><clause id="H386D1D2544E04C47A39C88FBA7D29565"><enum>(viii)</enum><text>educational attainment in a rural area;</text></clause><clause id="HAAC0C434955A4C758CAA7E4B6C40C8A4"><enum>(ix)</enum><text>workforce participation in a rural area; and</text></clause><clause id="H4EE77840DB3F476A80951060B6B88816"><enum>(x)</enum><text>other metrics, as determined appropriate by the Chief Rural Advisor.</text></clause></subparagraph></paragraph><paragraph id="HFB441DA8C71442888804C6B85D15C557"><enum>(3)</enum><header>Availability of data of other Federal agencies</header><subparagraph id="H3912E31E95B242809AD9B7BCCE35F932"><enum>(A)</enum><header>In general</header><text>For purposes of developing metrics under paragraph (1), the head of any other Federal agency shall provide to the Chief Rural Advisor, on request by the Chief Rural Advisor and at no cost to the Office, any data relating to the work of the Office collected by the Federal agency.</text></subparagraph><subparagraph id="HD6E3752CDFC244EABD27397E1335C003"><enum>(B)</enum><header>Privacy and security</header><text>The Chief Rural Advisor shall take any necessary steps to maintain the privacy and security of data provided under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="H44926395ED6E4682AA6CE76C9DA85451"><enum>(f)</enum><header>Reports to Congress</header><text>The Chief Rural Advisor shall—</text><paragraph id="HF9D9FC2B2FCF440292CC6B6FAD64DC26"><enum>(1)</enum><text>not later than 1 year after establishing the metrics under subsection (e), and not less frequently than annually thereafter—</text><subparagraph id="HA1F7389AC85D4F7AAF6C631B708FAF70"><enum>(A)</enum><text>prepare a report describing the effect that the programs on the list developed under subsection (e)(2)(A) have on rural areas, based on the metrics developed under subsection (e)(2)(B), with demographic breakdowns by race, age, and geographic region; and</text></subparagraph><subparagraph id="H3CCBEAA17A2549B4B0FDDD2AA2B8AED9"><enum>(B)</enum><text>submit to the Committee on Agriculture, Nutrition, and Forestry and the Committee on Appropriations of the Senate and the Committee on Agriculture and the Committee on Appropriations of the House of Representatives, and make publicly available, the report prepared under subparagraph (A); and</text></subparagraph></paragraph><paragraph id="H042FB91071A349ECB70C4764E1C704B5"><enum>(2)</enum><text>not later than 1 year after the date of enactment of this Act, and not less frequently than every 3 years thereafter, submit to the Committee on Agriculture, Nutrition, and Forestry and the Committee on Appropriations of the Senate and the Committee on Agriculture and the Committee on Appropriations of the House of Representatives the comprehensive strategy for rural development developed under subsection (d)(1). </text></paragraph></subsection><subsection id="HCB2C2213F25B4336BF56F77527BC1AA0"><enum>(g)</enum><header>Funding</header><text>This section shall be carried out using existing amounts otherwise available to the Executive Office of the President. </text></subsection><subsection id="HAD62AE17BF92462399123F573239D108"><enum>(h)</enum><header>Savings provision</header><text>Nothing in this section authorizes the hiring of additional staff. </text></subsection></section><section id="H9DE4083DD8B840BB8391D694894E5174"><enum>3.</enum><header>Rural Prosperity Council</header><subsection id="H721D7F57E03842D789CE1959995F5301"><enum>(a)</enum><header>In general</header><text>There is established a Rural Prosperity Council (referred to in this section as the <quote>Council</quote>).</text></subsection><subsection id="H8111B31CC49D4CAFBBC2858682741326"><enum>(b)</enum><header>Chair</header><text>The Secretary of Agriculture shall serve as the Chair of the Council.</text></subsection><subsection id="H24057561FD5145559E023329368F6129"><enum>(c)</enum><header>Members</header><text>The Council shall be composed of the heads of the following executive branch departments, agencies, and offices:</text><paragraph id="HB8D64CCC5D2F4D43B10AF62AA35CC89C"><enum>(1)</enum><text>The Office of Rural Prosperity.</text></paragraph><paragraph id="H3083044903BC40CDB1D006FE74C271BA"><enum>(2)</enum><text>The Department of Agriculture.</text></paragraph><paragraph id="HA92618EAE97A4E9190FA0B9AC276036A"><enum>(3)</enum><text>The Department of the Treasury.</text></paragraph><paragraph id="HBF72259D6DC642B1BC1B4AA0E3274191"><enum>(4)</enum><text>The Department of Defense.</text></paragraph><paragraph id="HFA8856226AE441189E9B32532C01E43A"><enum>(5)</enum><text>The Department of Justice.</text></paragraph><paragraph id="HF3F1CA5AB7A84BBBB8658A2E8D15DEE6"><enum>(6)</enum><text>The Bureau of Indian Affairs.</text></paragraph><paragraph id="HCFB7F0235E3C46DE880BC71859924B2A"><enum>(7)</enum><text>The Department of the Interior.</text></paragraph><paragraph Business Administration.</text></paragraph><paragraph id="H4B2742A12F8D400B87D20A5BB7B1BE2E"><enum>(27)</enum><text>The Council on Environmental Quality.</text></paragraph></subsection><subsection id="H412F9D8450A74BEF842CB9AEA6D6B7C7"><enum>(d)</enum><header>Designees</header><text>A member of the Council may designate, to perform the Council functions of the member, a senior-level official who is—</text><paragraph id="HA5FAAF6E42F94C23ACC733E22FAE9CE6"><enum>(1)</enum><text>part of the department, agency, or office of the member; and</text></paragraph><paragraph id="H7CC0FCE448084AF68361C8912C3EECC1"><enum>(2)</enum><text>a full-time officer or employee of the Federal Government.</text></paragraph></subsection><subsection id="HF3B7E17CA59941FC8B105D92D69EE83A"><enum>(e)</enum><header>Duties</header><text>The Council shall—</text><paragraph id="H11D02E587EF64A15BB8D3CC845FD5543"><enum>(1)</enum><text>ensure coordination among Federal agencies, States, units of local government, nonprofit organizations, and other stakeholders, as appropriate, in addressing the needs of rural areas in the United States;</text></paragraph><paragraph id="H03540683BDF54D77ADF049290B7D4BA9"><enum>(2)</enum><text>coordinate Federal efforts directed toward the growth and development of rural geographic regions that encompass both metropolitan and nonmetropolitan areas;</text></paragraph><paragraph id="HF472CBF896414B6EBB15C6DECBFA48E9"><enum>(3)</enum><text>identify and facilitate rural economic opportunities associated with energy transitions, outdoor recreation, and other conservation-related activities;</text></paragraph><paragraph id="H43FB3ED91B30437484C39FBD24E34CE7"><enum>(4)</enum><text>make recommendations to the President, acting through the Chief Rural Advisor, on streamlining and leveraging Federal investments in rural areas, where appropriate, to increase the impact of Federal dollars and create economic opportunities to improve the quality of life in rural areas in the United States;</text></paragraph><paragraph id="HAB69D85651A34448ABCDFC574ADB7A46"><enum>(5)</enum><text>provide a means for discussion and resolution of disputes between Federal agencies with regard to programs that address the needs of rural areas in the United States; and</text></paragraph><paragraph id="H0892A81F0D7045179E09046C6BDB5A23"><enum>(6)</enum><text>develop plans and strategies to address the needs of rural areas in the United States.</text></paragraph></subsection><subsection id="H50DDD70EDF6C4D468EAA1CE6386146CF"><enum>(f)</enum><header>Public Outreach</header><text>Not less frequently than twice annually, the Council shall hold public meetings in a rural community for the purpose of—</text><paragraph id="H9F07501C34DF4F8FA31D20870BB2BB29"><enum>(1)</enum><text>soliciting feedback from the public, units of local government, Indian Tribes, and dislocated workers on concerns relating to the social, economic, and community well-being and resilience of rural areas; and</text></paragraph><paragraph id="HBF7A6499837A4AA0A3E5DD15AF0FF7E1"><enum>(2)</enum><text>soliciting recommendations on actions the departments, agencies, and offices represented on the Council may consider to support the economic development of rural communities. </text></paragraph></subsection></section><section id="HAFE5C3EC2C6F4E25A0B25C9BC5E16ED8"><enum>4.</enum><header>Rural prosperity action plan</header><subsection id="HC2B844A6F9DD4A7E901D09607611A417"><enum>(a)</enum><header>In general</header><text>The Secretary of Agriculture (referred to in this section as the <term>Secretary</term>), in coordination with the Under Secretary for Rural Development, shall develop a rural prosperity action plan (referred to in this section as the <term>action plan</term>), which shall describe the actions to be carried out by the Secretary for the purposes of addressing the social, economic, and community well-being and resilience of rural areas in the United States by addressing unique structural challenges experienced by rural communities.</text></subsection><subsection id="H9260FB4DA828450B93130DA2EE726A05"><enum>(b)</enum><header>Coordination</header><text>Each activity carried out under this section shall be carried out in coordination with the Office of Rural Prosperity.</text></subsection><subsection id="H91B5A6886BDE4DE8853CBC865F41C5D1"><enum>(c)</enum><header>Administrative support and funding</header><text>The Secretary shall provide administrative support and funding in the development of the action plan, to the extent permitted by law and using appropriations available to the Secretary as of the date of enactment of this Act.</text></subsection><subsection id="H0861CE02390247EBA2CFD7B002794982"><enum>(d)</enum><header>Activities</header><text>In developing the action plan, the Secretary shall—</text><paragraph id="H0150708DBC724CD7BCAFA4F82446F1A8"><enum>(1)</enum><text>examine each rural development activity carried out by the Secretary as of the date of enactment of this Act; and </text></paragraph><paragraph id="H21E1E6E98F9A4461B6239A606D508E03"><enum>(2)</enum><text>identify regulatory and policy changes that could be made by the Secretary that would accomplish the goals described in subsection (a), including changes that would—</text><subparagraph id="H61223DFED0BA412CAF5A5A58D90746C0"><enum>(A)</enum><text>remove barriers to economic prosperity and quality of life in rural areas of the United States;</text></subparagraph><subparagraph id="HA4C558A2F7584A62ACA5C8C2D335B421"><enum>(B)</enum><text>strengthen and expand educational opportunities for students in rural communities, particularly in agricultural education, science, technology, engineering, and mathematics;</text></subparagraph><subparagraph id="HDDF76DCA1937471DA21D07FD2C68A1AD"><enum>(C)</enum><text>empower the State, local, and Tribal agencies that implement rural economic development, agricultural, and environmental programs to tailor those programs to relevant regional circumstances;</text></subparagraph><subparagraph id="H701A4C7E3F694F7AB43F9C9CB898F526"><enum>(D)</enum><text>respect the unique circumstances of small businesses that serve rural communities and the unique business structures and regional diversity of farms and ranches;</text></subparagraph><subparagraph id="H7591C309BC6A4C81B89AFF7F7E68562F"><enum>(E)</enum><text>ensure access to a reliable workforce and increase employment opportunities in rural-focused businesses, including agriculture;</text></subparagraph><subparagraph id="H989D807816AD45269ADEC3ADF6D50D3C"><enum>(F)</enum><text>promote the preservation of family farms as they are passed from generation to generation;</text></subparagraph><subparagraph id="H11B298FC607848599283281A9410247F"><enum>(G)</enum><text>ensure that private property rights of water users are not encumbered when the water users attempt to secure permits to operate on Federal land;</text></subparagraph><subparagraph id="HF8BEC514677C4AB1AF2399BBBAA0D938"><enum>(H)</enum><text>improve food safety and ensure that regulations and policies implementing Federal food safety laws are based on science and account for the unique circumstances of farms and ranches;</text></subparagraph><subparagraph id="H2EFEA7D96FAA45FD9D90BA6158BE8F7B"><enum>(I)</enum><text>encourage the production, export, and use of domestically produced agricultural products;</text></subparagraph><subparagraph id="H103DD98935784033B9DB483D70DD29DF"><enum>(J)</enum><text>further the energy security of the United States in the rural landscape; </text></subparagraph><subparagraph id="H8374DAE3AD734044A0FC6F050F8466BF"><enum>(K)</enum><text>address hurdles associated with access to resources on Federal land for rural communities that rely on cattle grazing, timber harvests, mining, recreation, and other multiple uses;</text></subparagraph><subparagraph id="H83B242FAE7F0447D93AFDD9F82724C71"><enum>(L)</enum><text>identify and facilitate rural economic opportunities associated with energy development, outdoor recreation, and other conservation-related activities; and</text></subparagraph><subparagraph id="H2868554D4E1C43B3A835FE11A7E1B106"><enum>(M)</enum><text>coordinate and improve the effectiveness of Federal engagement with rural stakeholders, including agricultural organizations, small businesses, education and training institutions, health care providers, telecommunications services providers, research and land-grant institutions, law enforcement, State, local, and Tribal governments, and nongovernmental organizations, regarding the needs of rural areas of the United States.</text></subparagraph></paragraph></subsection><subsection id="H5D2AF579F95646B6B364CD6BAC39B9F8"><enum>(e)</enum><header>Submission of action plan</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit the action plan, including recommendations for regulatory and policy changes identified under subsection (d)(2) that the Secretary considers appropriate, to—</text><paragraph id="H06F9E70247ED4DB1ADC69F765B006BB0"><enum>(1)</enum><text>the Chief Rural Advisor; </text></paragraph><paragraph id="H48F6CCC448544AEDBFE1C14F9EBB397C"><enum>(2)</enum><text>the Committee on Agriculture, Nutrition, and Forestry of the Senate; </text></paragraph><paragraph id="H89525CE1BCFF4914AED41F77507AB068"><enum>(3)</enum><text>the Committee on Appropriations of the Senate;</text></paragraph><paragraph id="H2527B58998964A7DB85DAA5DC24405A8"><enum>(4)</enum><text>the Committee on Agriculture of the House of Representatives; and</text></paragraph><paragraph id="H143137DF9CEC44C0869CCDC5879FBC8C"><enum>(5)</enum><text>the Committee on Appropriations of the House of Representatives.</text></paragraph></subsection><subsection id="H5AF4D11620B740248A22544B53D201DD"><enum>(f)</enum><header>Progress report</header><text>Not later than 1 year after the action plan is submitted in accordance with subsection (e), the Secretary shall submit a report describing the progress of the Secretary in meeting benchmarks described in the action plan to—</text><paragraph id="H8C5C59BA1AE543CBA58C7BB3C004FDEC"><enum>(1)</enum><text>the Chief Rural Advisor; </text></paragraph><paragraph id="H32FA233D0BBC4270985F431B67FAA216"><enum>(2)</enum><text>the Committee on Agriculture, Nutrition, and Forestry of the Senate;</text></paragraph><paragraph id="H9BCA3DD1EC34488B8713F38B8072DBCB"><enum>(3)</enum><text>the Committee on Appropriations of the Senate;</text></paragraph><paragraph id="HECA1F3F0BE684BBABA57C4D87DA6BBB4" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>the Committee on Agriculture of the House of Representatives; and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="H6F630B1930CA4BB3A61AED336DA33A24"><enum>(5)</enum><text>the Committee on Appropriations of the House of Representatives.</text></paragraph></subsection></section></legis-body></bill>
