which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Animal Welfare Act to prohibit the confinement of pregnant pigs, and for other purposes.</official-title></form><legis-body id="H031AA74860FD48268C1FACA6C92BB7BA" style="OLC"><section id="H5A0AC735CE0B46EBB060B2F0B751807E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pigs in Gestation Stalls Act of 2022</short-title></quote> or the <quote><short-title>PIGS Act of 2022</short-title></quote>.</text></section><section id="HCC0CC78AA5CE4FB284478B8C67C72B4F"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="H280CFB62DA4F43389633F57E5AD7CC95"><enum>(1)</enum><text display-inline="yes-display-inline">Intensive confinement of pigs is a significant animal welfare issue, causing physical problems and psychological anguish for the animals.</text></paragraph><paragraph id="HC10A03D5DC9945879041330744DB4724"><enum>(2)</enum><text>Dozens of major food retailers and more than 10 states have taken action to phase out the use of intensive confinement for pigs, reflecting the will and concerns of the public.</text></paragraph><paragraph id="HFE3CCF771F164152A8B07C9F4820E693"><enum>(3)</enum><text>At least two States have adopted policies to forbid the sale of pork from factory farms that use gestation crates, with that policy predicated on human health and animal welfare concerns.</text></paragraph><paragraph id="HB4E4551465AC4B788071A6F73D3099B2"><enum>(4)</enum><text>As more consumers turn away from purchasing pork products derived from intensive confinement practices, the pork industry will be better aligned with its customers by ending these unpopular and inhumane housing methods.</text></paragraph></section><section id="H0BF3669F9F8345E091613CD36AD064D5"><enum>3.</enum><header>Prohibition on confining breeding pigs</header><subsection id="H0DA14E7F70284AD9940C9ED1691E0E28"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2131">7 U.S.C. 2131 et seq.</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="HAC1459EDF84A4F92A5A0D3DB7C613600" display-inline="no-display-inline"><section id="HFCBF6FA972704C66A80F04047CBF5126"><enum>30.</enum><header>Prohibition on confining breeding pigs</header><subsection id="H7870870789B245569878CA2335F99C80"><enum>(a)</enum><header>Prohibition</header><paragraph id="HC307E76247BF44CFBCAD70285D4A43DF"><enum>(1)</enum><header>In general</header><text>It shall be unlawful for a person to cause any breeding pig to be confined in—</text><subparagraph id="H999C802629B048C0BFBEECAFEC927D28"><enum>(A)</enum><text display-inline="yes-display-inline">such a manner that prevents the pig from lying down, standing up, or turning around—</text><clause id="H6E4EDD5E52E848D494E1B23887EA37E9"><enum>(i)</enum><text>in a complete circle without any impediment, including a tether; and</text></clause><clause id="H689D575BDBC44AD8A2AF12CF6DFF3C53"><enum>(ii)</enum><text>without touching the side of an enclosure or another animal; and</text></clause></subparagraph><subparagraph id="H1BC187F157C044C5BF7131333A751B48"><enum>(B)</enum><text display-inline="yes-display-inline">beginning on December 31, 2022, a space with less than 24 square feet of usable floorspace per pig, as calculated under paragraph (3). </text></subparagraph></paragraph><paragraph id="HF01DF2895C534DF8B131BCBDD64E4DE5" commented="no"><enum>(2)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The Secretary shall not, in applying paragraph (1), consider a breeding pig to be confined in a cruel manner if such confinement occurs during—</text><subparagraph id="H709ED857859A449D9CA44AA9735E56D8" commented="no"><enum>(A)</enum><text>transportation;</text></subparagraph><subparagraph id="HCFBC05D571FA430497A2498C8B787B94" commented="no"><enum>(B)</enum><text>examination, testing, treatment, or an operation conducted for veterinary purposes, but only if performed by or under the direct supervision of a licensed veterinarian;</text></subparagraph><subparagraph id="H87EC3749EDB840BA9FEBE282E35B916E" commented="no"><enum>(C)</enum><text>the five-day period before the pig’s expected date of farrowing; and</text></subparagraph><subparagraph id="H5ECB8D549FF44BE591D075D46E36ECCB" commented="no"><enum>(D)</enum><text>slaughter conducted in accordance with the Humane Methods of Slaughter Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1901">7 U.S.C. 1901 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="H9BAA660537C24D2BB80D4141952AEB68"><enum>(3)</enum><header>Calculation of usable floorspace</header><text display-inline="yes-display-inline">For purposes of paragraph (1)(B), the total square footage of floorspace provided to each breeding pig in an enclosure shall be determined by dividing—</text><subparagraph id="HCC34CED4B822489091C993F065F5E2F5"><enum>(A)</enum><text>the total square footage of floorspace provided to all the animals in such enclosure; by</text></subparagraph><subparagraph id="HF07C3BC8C6CD4BD4A19A14147F49F2E7"><enum>(B)</enum><text>the number of animals in that enclosure.</text></subparagraph></paragraph></subsection><subsection id="H69361404B3714CB99B7CC60F751EEDCA"><enum>(b)</enum><header>Penalties</header><text display-inline="yes-display-inline">For the purpose of administering and enforcing this section, the authorities provided under sections 10414 and 10415 of the Animal Health Protection Act (7 U.S.C. 8313 and 8314) shall apply to this section in a similar manner as those sections apply to the Animal Health Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8301">7 U.S.C. 8301 et seq.</external-xref>). Any person that violates the prohibition under subsection (a) shall be subject to penalties provided in such section 10414.</text></subsection><subsection id="H606B70C5C1B742BEA479E06F059B8862"><enum>(c)</enum><header>No preemption</header><text display-inline="yes-display-inline">Nothing in this section preempts any State or local laws, regulations, orders, or other requirements with respect to animal welfare that are identical to or are in addition to the requirements of this section. </text></subsection><subsection id="H76A6C731AAFA460C881FBD86A1BF4D1B"><enum>(d)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed as limiting the authority of the Secretary under this Act or another Federal law to protect animal welfare.</text></subsection><subsection id="HFFAADD1B38044874AE850200F4348CA7"><enum>(e)</enum><header>Severability</header><text display-inline="yes-display-inline">If this section is held unconstitutional as to some provisions or circumstances, it shall remain in force as to the remaining provisions and other circumstances.</text></subsection><subsection id="H0865F00EF631404EBF7C449DEA9A3769" commented="no"><enum>(f)</enum><header>Financial assistance</header><paragraph id="H4BF612228A634D71AC8C2C2E54122664" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program under which the Secretary will provide financial assistance to pig producers to assist such producers in complying with the requirements of this section. </text></paragraph><paragraph id="H496AA51514DA499B82C77549858FE9E8" commented="no"><enum>(2)</enum><header>Priority</header><text>The Secretary shall allocate funds made available under paragraph (3) among pig producers in a manner that prioritizes independent pig producers.</text></paragraph><paragraph id="H484D4D792B4E4F358B877BE41E97757E" commented="no"><enum>(3)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary shall amend the order in effect as of the date of the enactment of this section under section 1616(c) of the Pork Promotion, Research, and Consumer Information Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/7/4805">7 U.S.C. 4805(c)</external-xref>), to direct the National Pork Board, notwithstanding section 1620(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/4809">7 U.S.C. 4809(c)</external-xref>), to set aside not less than $10,000,000 of the funds collected from assessments made under such Act for the first fiscal year that begins after the date of the enactment of this section and the following fiscal year to provide assistance to pig producers, as described in paragraph (1). </text></paragraph></subsection><subsection id="HA736912A32144D2E9BDE58913DB9B1E8"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HCC598F32D89B40F2BD1E06FD7B122C77"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>breeding pig</term> means any female pig that is—</text><subparagraph id="HC8105A9B0902435BB49A53D5B63F9903"><enum>(A)</enum><text>kept for the purpose of commercial breeding who is six months of age or older; or</text></subparagraph><subparagraph id="H7161DDA613574154BCDFB5DB77F400A7"><enum>(B)</enum><text>pregnant.</text></subparagraph></paragraph><paragraph id="H9DBBFC25F792477E9D4492D475BE2F54"><enum>(2)</enum><text>The term <term>enclosure</term> means any cage, crate or other enclosure in which a pig is kept, including, a gestation crate.</text></paragraph><paragraph id="H113EC46456944C62902FD4F2FFFD5350"><enum>(3)</enum><text>The term <term>pig</term> means any animal of the porcine species.</text></paragraph><paragraph id="H0426D9B68C8646EEA3310AC6F75E4A9E"><enum>(4)</enum><text>The term <term>independent pig producer</term> means a pig producer who owns their own pigs and is not contracted to raise pigs that belong to another entity.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0EE879EAB6F842B1807BE3F7D04B52E5"><enum>(b)</enum><header>Applicability</header><text>The amendment made by this section shall apply beginning on the date that is one year after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
