<official-title display="yes">To implement merit-based reforms to the civil service hiring system that replace degree-based hiring with skills- and competency-based hiring, and for other purposes.</official-title>

<section id="H4EBADF8C3BE1465AB9CAA6AFA7B301A2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chance to Compete Act of 2022</short-title></quote>.</text></section> <section id="H726412EF0FEC4DDC9150913257BEF6FA"><enum>2.</enum><header>Definitions</header> <subsection id="HAF81635011BF4EC8B0E1090A786D08C3"><enum>(a)</enum><header>Terms defined in section 3304 of title 5, United States Code</header><text display-inline="yes-display-inline">In this Act, the terms <term>agency</term>, <term>Director</term>, <term>examining agency</term>, <term>Office</term>, <term>subject matter expert</term>, and <term>technical assessment</term> have the meanings given those terms in subsection (c)(1) of section 3304 of title 5, United States Code, as added by section 3(a).</text></subsection> 
<subsection id="H1DB96A6DE6244ECCAB7F63E1D7A24EDB"><enum>(b)</enum><header>Other terms</header><text>In this Act, the term <term>competitive service</term> has the meaning given the term in section 2102 of title 5, United States Code.</text></subsection></section> <section id="HD4BA3BA71AC84962B8C87697DD7248B0"><enum>3.</enum><header>Defining the term <term>examination</term> for purposes of hiring in the competitive service</header> <subsection id="H86261ECDE12F401A85043EC664E93D19"><enum>(a)</enum><header>Examinations; technical assessments</header> <paragraph id="H1CCCB073C215431881126967C9720A77"><enum>(1)</enum><header>In general</header><text>Section 3304 of title 5, United States Code, is amended—</text> 
<subparagraph id="H739B911265774DACB5AD5B89570500DD"><enum>(A)</enum><text>by redesignating subsections (c) through (f) as subsections (d) through (g), respectively; and</text></subparagraph> <subparagraph id="H740B5FDB8FEA43B782B22C05439CD120"><enum>(B)</enum><text>by inserting after subsection (b) the following:</text>

<subsection id="H93996C39DB0A4D0F9FD57C72DD5C788D"><enum>(c)</enum><header>Examinations</header> 
<paragraph id="HACBAB82E08034AF8ACC967982906B572"><enum>(1)</enum><header>Definitions</header> 
<subparagraph id="HAECB607EE153491E979ED80061B2000B"><enum>(A)</enum><header>Examination</header> 
<clause id="H8CD123ADA23A44E4B5B2BFAB896D20A9"><enum>(i)</enum><text>In this chapter, the term <term>examination</term>—</text> <subclause id="H66E61F0A7CBB444285F2B925BC2E898E"><enum>(I)</enum><text display-inline="yes-display-inline">means an opportunity to directly demonstrate knowledge, skills, abilities, and competencies, through an assessment;</text></subclause> 
<subclause id="HA8B34BA0325040BA83B41F646992DA32"><enum>(II)</enum><text>includes a résumé review that is—</text> <item id="H1EA96D4301984CB8BE2F5863F75F3139"><enum>(aa)</enum><text>conducted by a subject matter expert; and</text></item> 
<item id="H07FE84D7B79F457ABF4B559991BBF3CE"><enum>(bb)</enum><text>based upon indicators that—</text> <subitem id="H031317674C8842D5BF2656A843B0C317"><enum>(AA)</enum><text>are derived from a job analysis; and</text></subitem> 
<subitem id="H008DBECA01484E108CDA5602872EB507"><enum>(BB)</enum><text>bear a rational relationship to performance in the position for which the examining agency is hiring; and</text></subitem></item></subclause> <subclause id="H9F625978627247EA92FF7A7B39C6F33D"><enum>(III)</enum><text>on and after the date that is 2 years after the date of enactment of the <short-title>Chance to Compete Act of 2022</short-title>, does not include a self-assessment from an automated examination, a résumé review (except as provided in subclause (II)), or any other method of determining the experience or level of educational attainment of an individual, alone.</text></subclause></clause> 
<clause id="HC38A05D0376C4F798BE32A995ABE17F7"><enum>(ii)</enum> 
<subclause id="H617FEC1C667A4347A74E37C408453521" display-inline="yes-display-inline"><enum>(I)</enum><text>An agency’s Chief Human Capital Officer may waive clause (i)(III) if the Officer provides a written report to the Director of the Office of Personnel Management within 30 days of authorizing the waiver that justifies the need for such waiver and articulates the data, evidence, and circumstances for such need.</text></subclause> <subclause id="H75E9A475DF524AE3909139CCB8A4A109" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">The Director is authorized to provide agencies guidance and instruction on the data, evidence, and circumstances that should be included in the waiver described in subclause (I) and shall post any waiver on a public website within 30 days of receipt of the waiver.</text></subclause> 
<subclause id="H274C7B7B09A0489996A47585B8B3DE21" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">A waiver shall not be considered in effect until it is posted on the public website pursuant to subclause (II).</text></subclause></clause></subparagraph> <subparagraph id="H970E25F816E64E63825DB34117CCFF6F" commented="no"><enum>(B)</enum><header>Other definitions</header><text>In this subsection—</text> 
<clause id="H171A18203A2B46C594380B216ECAB6BB" commented="no"><enum>(i)</enum><text>the term <term>agency</term> means an agency described in section 901(b) of title 31;</text></clause> <clause id="H6F1E4554933B44898492211C6806D945" commented="no"><enum>(ii)</enum><text>the term <term>Director</term> means the Director of the Office;</text></clause> 
<clause id="HBB333EFF6E894DFE9BBD4A144A9AE0F5" commented="no"><enum>(iii)</enum><text>the term <term>examining agency</term> means—</text> <subclause id="HE10A2F4A8DE64FC9BA4C76A4C15D522D" commented="no"><enum>(I)</enum><text>the Office; or</text></subclause> 
<subclause id="H639B50947F87419E98BDCE7EA26E02F3" commented="no"><enum>(II)</enum><text>an agency to which the Director has delegated examining authority under section 1104(a)(2) of this title; </text></subclause></clause> <clause id="H1DEBF220B54143E78A0A0E7058868C2F" commented="no"><enum>(iv)</enum><text>the term <term>subject matter expert</term> means an employee or selecting official—</text> 
<subclause id="H97DC6DADF4EE4BCBBC7D65F713C946B6" commented="no"><enum>(I)</enum><text>who possesses understanding of the duties of, and knowledge, skills, and abilities required for, the position for which the employee or selecting official is developing or administering an assessment; and</text></subclause> <subclause id="H60A703DFB3F04DFBABB883C08AB1CACC" commented="no"><enum>(II)</enum><text>whom the agency that employs the employee or selecting official designates to assist in the development and administration of technical assessments under paragraph (2); and</text></subclause></clause> 
<clause id="HB4ECBACD3E794D948E6891AF50F38083" commented="no"><enum>(v)</enum><text>the term <term>technical assessment</term> means an assessment developed under paragraph (2)(A)(i) that—</text> <subclause id="H1584353ED43F407189995D519CFE7E3F" commented="no"><enum>(I)</enum><text>allows for the demonstration of job-related technical skills, abilities, and knowledge;</text></subclause> 
<subclause id="HE2522FF2FF444CB5BA50505CD0321453" commented="no"><enum>(II)</enum> 
<item commented="no" display-inline="yes-display-inline" id="HFBDB43C8B697456E8273FD10E8EDD86F"><enum>(aa)</enum><text>is based upon a job analysis; and</text></item> <item id="HE96CE46AD0D448D0B03FF1F6299225D4" indent="up1" commented="no"><enum>(bb)</enum><text>is relevant to the position for which the assessment is developed; and</text></item></subclause> 
<subclause id="HB5E68E46FE9D4F24B41DD558F19C5951" commented="no"><enum>(III)</enum><text>may include—</text> <item id="H0AA2D26FFE0C4E22966CD125E2538E58" commented="no"><enum>(aa)</enum><text>a structured interview;</text></item> 
<item id="H600C90020748414EBC5361EA5F5A4D86" commented="no"><enum>(bb)</enum><text>a work-related exercise;</text></item> <item id="H5C1614269C12448C959E300D986DE842" commented="no"><enum>(cc)</enum><text>a custom or generic procedure used to measure an individual’s employment or career-related qualifications and interests; or</text></item> 
<item id="H2444E1CDA8934981918653E2AEC70626" commented="no"><enum>(dd)</enum><text>another assessment that meets the criteria under subclauses (I) and (II).</text></item></subclause></clause></subparagraph></paragraph> <paragraph id="H4D4720A2CDF248549036B424511573BE"><enum>(2)</enum><header>Technical assessments</header> <subparagraph id="H0608BEE034C44BA38F072DC7770E9DDD"><enum>(A)</enum><header>In general</header><text>For the purpose of conducting an examination for a position in the competitive service, an individual or individuals whom an agency determines to have an expertise in the subject and job field of the position, as affirmed and audited by the Chief Human Capital Officer or Human Resources Director (as applicable) of that agency, may—</text> 
<clause id="HA232E97684C7484E88D6D8AC110EAC75"><enum>(i)</enum><text>develop, in partnership with human resources employees of the examining agency, a position-specific assessment that is relevant to the position; and</text></clause> <clause id="H8C9308EA82E04E71A9BDA4EEAB7A9C12"><enum>(ii)</enum><text>administer the assessment developed under clause (i) to—</text> 
<subclause id="H2C847D8CC7EE4F699D000AA6D45FBC91"><enum>(I)</enum><text display-inline="yes-display-inline">determine whether an applicant for the position has demonstrated qualification for the position; or</text></subclause> <subclause id="H0EB46F5D47384FA3B1FE54D38192EF41"><enum>(II)</enum><text>rank applicants for the position for category rating purposes under section 3319.</text></subclause></clause></subparagraph> 
<subparagraph display-inline="no-display-inline" commented="no" id="HD5A3EA49E21F4AEA8913004821AE78A4"><enum>(B)</enum><header>Sharing and customization of assessments</header> 
<clause display-inline="no-display-inline" commented="no" id="HFB135D9056EE4688A7A064624EB793B4"><enum>(i)</enum><header>Sharing</header><text>An examining agency may share a technical assessment with another examining agency if each agency maintains appropriate control over examination material.</text></clause> <clause display-inline="no-display-inline" commented="no" id="H54AAF96EE4E74F5AA23D10323F885E21"><enum>(ii)</enum><header>Customization</header><text>An examining agency with which a technical assessment is shared under clause (i) may customize the assessment as appropriate, provided that the resulting assessment satisfies the requirements under part 300 of title 5, Code of Federal Regulations (or any successor regulation).</text></clause> 
<clause display-inline="no-display-inline" commented="no" id="HADE4FB52DF5F43ABAB1312BAC95D2037"><enum>(iii)</enum><header>Platform for sharing and customization</header> 
<subclause display-inline="no-display-inline" commented="no" id="HE17DD6B0E98B405199D49C152D637779"><enum>(I)</enum><header>In general</header><text>The Director shall establish and operate an online platform on which examining agencies can share and customize technical assessments under this subparagraph.</text></subclause> <subclause id="H6D5FB615EB39441399D39C7B62C85674"><enum>(II)</enum><header>Online platform</header><text display-inline="yes-display-inline">The Director shall—</text> 
<item id="H4A0B676ECE274163B317153C50296C8E" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">not be responsible for independently validating the utility of the content and technical assessments shared in the online platform described in subclause (I); and</text></item> <item id="H990734D2CE4D48868E442B66FCF46D79"><enum>(bb)</enum><text display-inline="yes-display-inline">ensure that such online platform includes the ability of its users to rate the utility of the content and technical assessments shared in the online platform to allow for a ranking of such contents.</text></item></subclause></clause></subparagraph></paragraph> 
<paragraph id="H84BF9D311ACF4477AE7FFDBCDE69E3E7" commented="no"><enum>(3)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of the <short-title>Chance to Compete Act of 2022</short-title>, the Office of Personnel Management shall prescribe regulations necessary for the administration of this subsection with respect to employees in each agency. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H8E823BAF0F5649C7919626144B9F0AE8"><enum>(2)</enum><header>Alternative ranking and selection procedures</header><text>Section 3319(a) of title 5, United States Code, is amended by adding at the end the following: <quote>To be placed in a quality category under the preceding sentence, an applicant shall be required to have passed an examination in accordance with section 3304(b), subject to the exceptions in that section.</quote>.</text></paragraph> 
<paragraph id="HCC05C74F2A6345B38C9635430C42735D"><enum>(3)</enum><header>Technical and conforming amendment</header><text>Section 3330a(a)(1)(B) of title 5, United States Code, is amended by striking <quote>section 3304(f)(1)</quote> and inserting <quote>section 3304(g)(1)</quote>.</text></paragraph></subsection> <subsection id="H6DC52A776F394990A2CCCF8C43FD01AB"><enum>(b)</enum><header>OPM reporting</header> <paragraph id="H240DC887D37A4E278463CC350E328307"><enum>(1)</enum><header>Public online tool</header> <subparagraph id="HCF46B8A28422454D90320F35F3DCFA8B"><enum>(A)</enum><header>In general</header><text>The Director of the Office of Personnel Management shall maintain and periodically update a publicly available online tool that, with respect to each position in the competitive service for which an examining agency examined applicants during the applicable period, includes—</text> 
<clause id="H4FBD0E394B9040DFA62EE4E3DB3696FA"><enum>(i)</enum><text>the type of assessment used, such as—</text> <subclause id="H58531ADA624F4E38B93FBC7AC2B47F0F"><enum>(I)</enum><text>a behavioral off-the-shelf assessment;</text></subclause> 
<subclause id="HB61907BEDD9F4A27BF10AF8B6C8F5B80"><enum>(II)</enum><text>a résumé review conducted by a subject matter expert;</text></subclause> <subclause id="H9AE5EAB863154964B3E1D7C1151DC63D"><enum>(III)</enum><text>an interview conducted by a subject matter expert;</text></subclause> 
<subclause id="H762876BE54F74425AB0B76FC4AC937FE"><enum>(IV)</enum><text>a technical off-the-shelf assessment; or</text></subclause> <subclause id="HF771EBC0A09B49CABB809A84900AE1DB"><enum>(V)</enum><text>a cognitive ability test;</text></subclause></clause> 
<clause id="H0C6CCD7254874CEA948854D5DE35AF64"><enum>(ii)</enum><text>whether or not the agency selected a candidate for the position; and</text></clause> <clause id="H9E16481099B943A4A0A76793F32C3D2A"><enum>(iii)</enum><text>the hiring authority used to fill the position.</text></clause></subparagraph> 
<subparagraph id="H9AAF739871254628B32F4F64337DABC4"><enum>(B)</enum><header>Timing</header> 
<clause id="HD378C49742FA4DED80605DA7629F54E3"><enum>(i)</enum><header>Initial data</header><text>Not later than 180 days after the date of enactment of this Act, the Director shall update the online tool described in subparagraph (A) with data for positions in the competitive service for which an examining agency examined applicants during the period beginning on the date of enactment of this Act and ending on the date of submission of the report.</text></clause> <clause id="H02A2BFCFE5D04204AF1B53BCF6804B0B"><enum>(ii)</enum><header>Subsequent updates</header><text display-inline="yes-display-inline">Not later than October 1 of each fiscal year beginning after the date on which the online tool is initially updated under clause (i), the Director shall update the online tool described in subparagraph (A) with data for positions in the competitive service for which an examining agency examined applicants during the preceding fiscal year.</text></clause></subparagraph></paragraph> 
<paragraph id="H0E638F60E1514E20AC6EFCBDF0B8CEC2"><enum>(2)</enum><header>Annual progress report</header> 
<subparagraph id="H6A28DDC2A1124CF8AF15675CF933A184"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each year, the Director, in accordance with subparagraphs (B) and (C), shall make publicly available and submit to Congress an overall progress report that includes summary data from examinations that are closed, audited, and anonymous on the use of examinations (as defined in subsection (c)(1)(A) of section 3304 of title 5, United States Code, as added by subsection (a) of this section) for the competitive service, including technical assessments.</text></subparagraph> <subparagraph id="H34AEFFF8A74F4CC1AAB239DD8DDF3452"><enum>(B)</enum><header>Categories; baseline data</header><text>In carrying out subparagraph (A), the Director shall—</text> 
<clause id="HBE8998C72EA841CDAA189C71BB3EB8EC"><enum>(i)</enum><text>break the data down by applicant demographic indicator, including veteran status, race, gender, disability, and any other measure the Director determines appropriate; and</text></clause> <clause id="HFABAD695CE2549509693A59C722BA557"><enum>(ii)</enum><text>use the data available as of October 1, 2020, as a baseline.</text></clause></subparagraph> 
<subparagraph id="H437B131A493648E5AAA4FDE113A97794"><enum>(C)</enum><header>Limitations</header><text>In carrying out subparagraph (A), the Director may only make publicly available and submit to Congress data relating to examinations for which—</text> <clause id="H18F421D4B9F046FBB135639425280192"><enum>(i)</enum><text>the related announcement is closed;</text></clause> 
<clause id="HCCE58807D8BD421E9EE714EB9B3BE7A9"><enum>(ii)</enum><text>certificates have been audited; and</text></clause> <clause id="HF424739BE11D4FA585B65CFCBBED9616"><enum>(iii)</enum><text>all hiring processes are completed.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H9A03878647EA4D77A567983E933A475D"><enum>(c)</enum><header>GAO report</header><text>Not later than 5 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report that—</text> <paragraph id="H77C67E351DCF4369A98869E485BF4E38"><enum>(1)</enum><text>assesses the implementation of this section and the amendments made by this section;</text></paragraph> 
<paragraph id="H99A9CA5BFDF144B48C5E97041E0188D7"><enum>(2)</enum><text>assesses the impact and modifications to the hiring process for the competitive service made by this section and the amendments made by this section; and</text></paragraph> <paragraph id="H3F6B72A9E3CB42DAB8CFFC039623E95A"><enum>(3)</enum><text>makes recommendations for the improvement of the hiring process for the competitive service.</text></paragraph></subsection></section> 
<section id="H529F1B60CB6F4469BE56CC104B1BEC00"><enum>4.</enum><header>Amendments to Competitive Service Act of 2015</header> 
<subsection id="HA660FC828F1C49E4813396C58893602A"><enum>(a)</enum><header>Platforms for sharing certificates of eligibles</header> 
<paragraph id="H7373DAAD6E684804953A49DB8395936E"><enum>(1)</enum><header>In general</header><text>Section 3318(b) of title 5, United States Code, is amended—</text> <subparagraph id="HF435B9237A694018B8CDF516A86FB9B7"><enum>(A)</enum><text>in paragraph (1), by striking <quote>240-day</quote> and inserting <quote>1-year</quote>;</text></subparagraph> 
<subparagraph id="H56EA3A643F9141898593B5DD809917A1"><enum>(B)</enum><text>by redesignating paragraph (5) as paragraph (6); and</text></subparagraph> <subparagraph id="H24BA161910E640F29EC7B32271EDDE5C"><enum>(C)</enum><text>by inserting after paragraph (4) the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H07A2C997FC8B4F1492C0837C606D8041"> 
<paragraph id="H5E34681E046E49DF95308E04FCC5B96B"><enum>(5)</enum><header>Online tool for sharing résumés of individuals on certificates of eligibles</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of the Chance to Compete Act of 2022, the Director of the Office of Personnel Management shall establish and operate an online tool on which an appointing authority can share, with other appointing authorities and the Chief Human Capital Officers Council established under section 1303 of the Chief Human Capital Officers Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/5/1401">5 U.S.C. 1401</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>), the resumes of individuals who are on a certificate of eligibles requested by the appointing authority. In carrying out this paragraph, the Director shall consult with the Chief Human Capital Officers Counsel and its membership to develop a plan to establish such online tool. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HA48514CF85764642A05D0C585B633B1B"><enum>(2)</enum><header>Plan</header><text display-inline="yes-display-inline">Not later than 270 days year after the date of enactment of this Act, the Director shall provide to Congress a plan to develop the online tool required in paragraph (5) of section 3318(b) of title 5, United States Code, as added by paragraph (1) of this subsection. Such plan shall—</text> 
<subparagraph id="H84441EF40A5741ABB53B6E225A55F587"><enum>(A)</enum><text>incorporate the input and feedback collected during the required consultation under such paragraph; and</text></subparagraph> <subparagraph id="H75F4640082EB4F3BB06ED6CE04235164"><enum>(B)</enum><text>include estimated costs for building and operating the online tool for ten years.</text></subparagraph></paragraph></subsection> 
<subsection id="HD11D2E8E3AAE4AE4B5CD1B36C42EEFF6"><enum>(b)</enum><header>Maximizing sharing of applicant information</header><text>Section 2 of the Competitive Service Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/137">Public Law 114–137</external-xref>; 130 Stat. 310) is amended—</text> <paragraph id="H63D258AE2C2C4D3B82CE21EB11CD5277"><enum>(1)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph> 
<paragraph id="HD794AF583F044A7A8A4F834EFD25F09F"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HC9FAE24DE5A148BABE2C81C68CDA2011"> <subsection id="H3C561CB473644172B9973C27DD3D622F"><enum>(c)</enum><header>Exploring the benefits of maximizing sharing of applicant information</header> <paragraph id="H3E9FD8BC437C448E9560B7193151BE83"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text> 
<subparagraph id="H7DEEF8A3F1CE4B7AB9F235643DD03730"><enum>(A)</enum><text>the terms <term>agency</term>, <term>Director</term>, and <term>Office</term> have the meanings given those terms in section 3304(c)(1) of title 5, United States Code; and</text></subparagraph> <subparagraph id="H3A8FBEBA88404C1FAA4560899A1EB0F9"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>competitive service</term> has the meaning given the term in section 2102 of title 5, United States Code.</text></subparagraph></paragraph> 
<paragraph id="HE7160D4531FB41F1AAC90C77A47D21FC"><enum>(2)</enum><header>Maximizing sharing</header><text display-inline="yes-display-inline">The Director shall research the benefits of maximizing the sharing of information among agencies regarding qualified applicants for positions in the competitive service, including by—</text> <subparagraph id="HC7D7CA8C8858499BB8BDDB73C2E14F5A"><enum>(A)</enum><text>providing for the delegation to other agencies of the authority of the Office to host multi-agency hiring actions to increase the return on investment on high-quality pooled announcements; and</text></subparagraph> 
<subparagraph id="HDC343995D3FC4AA58B50C10A6D1C83D0" commented="no"><enum>(B)</enum><text>sharing certificates of eligibles and accompanying résumés for appointment.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H6E3D9516EC69480F9F6D9C457C325479"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this Act, the Director shall provide a written report to Congress on the findings of the research required by the amendment made by subsection (b)(2). Such report shall include a plan to implement the most effective methods of maximizing the sharing of qualified candidates for positions in the competitive service. </text></subsection></section> 
<section id="H1737B72D72504CFFACA42FBB1098D6A9"><enum>5.</enum><header>Modernizing and reforming the assessment and hiring of Federal job candidates</header> 
<subsection id="H7891251724B84579B799583266833FA5"><enum>(a)</enum><header>OPM review</header><text display-inline="yes-display-inline">The Director shall conduct a review of all examinations for hiring for a position that the Office or any other examining agency has determined requires a minimum educational requirement because of the nature of the duties of such position is of a scientific, technical, or professional position pursuant to section 3308 of title 5, United States Code, to determine whether there are data, evidence, or other information that justifies the need for educational requirements for such position. The Director shall consult with appropriate agencies, employee representatives, external experts, and other stakeholders when making any such determinations.</text></subsection> <subsection id="HA2319F5E57BA4133BBEECDA025BC73AC"><enum>(b)</enum><header>Online tool regarding position duties</header> <paragraph id="HC3EC6C979AA04B5D852F591F36ACEFA6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than two years after the date of enactment of this Act, the Director shall create and maintain an online tool that lists each of the duties determined to require minimum educational requirements and the data, evidence, or other information that justifies the need for these educational requirements. This online tool shall include a mechanism to receive feedback regarding data, evidence, or information that could affect the determination that a duty requires a minimum educational requirement.</text></paragraph> 
<paragraph id="H480665D31DDD4F1AA7AD457A7D0F2411"><enum>(2)</enum><header>Hiring practices</header><text display-inline="yes-display-inline">Not later than one year after the creation of the online tool under paragraph (1), the Director and the head of any other examining agency shall amend the hiring practices of the Office or the other examining agency, respectively, in accordance with the findings of the review made by subsection (a). </text></paragraph></subsection> <subsection id="H2CAE14048A344425B719E15ACE885857"><enum>(c)</enum><header>Online tool regarding recruiting</header><text display-inline="yes-display-inline">Upon the date of enactment of this Act, the Director shall establish and maintain an online tool that provides Federal agencies guidance on, and information about, all programs and authorities that help agencies attract, recruit, hire, and retain individuals. </text></subsection></section> 
<section id="H069EAAEBCDFB438CB3D31CE89CC36BD4"><enum>6.</enum><header>Talent teams</header> 
<subsection id="H8A72C85422D4467D9E4BAD97686AA643"><enum>(a)</enum><header>Federal agency talent teams</header> 
<paragraph id="H9C736788B658419CA6964B1FB52949FF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An agency may establish one or more talent teams (referred to in this section as <term>agency talent teams</term>), including at the component level.</text></paragraph> <paragraph id="HC6F8F1226D8048179190A3FC420D72A6"><enum>(2)</enum><header>Duties</header><text display-inline="yes-display-inline">An agency talent team shall provide hiring support to the agency and other agencies, including by—</text> 
<subparagraph id="H1D86B7754AF140F2BE178C91A3EF1724"><enum>(A)</enum><text display-inline="yes-display-inline">improving examinations (as defined in subsection (c)(1)(A) of section 3304 of title 5, United States Code, as added by section 3(a));</text></subparagraph> <subparagraph id="HEE17206153754826B4413AAA8C92AFB3"><enum>(B)</enum><text>facilitating writing job announcements for the competitive service;</text></subparagraph> 
<subparagraph id="H6077975CF4DB4BAA971D4655AF087F63"><enum>(C)</enum><text>sharing high-quality certificates of eligibles; and</text></subparagraph> <subparagraph id="HC2EC0195FBEB44DFB19E1139FDE7505F"><enum>(D)</enum><text>facilitating hiring for the competitive service using examinations (as defined in such subsection (c)(1)(A)) and subject matter experts.</text></subparagraph></paragraph></subsection> 
<subsection id="HDAF39D79409747BEB0715530494E39C8"><enum>(b)</enum><header>Office of Personnel Management</header><text>The Director may establish a Federal talent team to support agency talent teams in facilitating pooled hiring actions across the Federal Government, providing training, and creating technology platforms to facilitate hiring for the competitive service, including—</text> <paragraph id="H06F9974F37D94AF9B93C6C1F2804A670"><enum>(1)</enum><text>the development of technical assessments; and</text></paragraph> 
<paragraph id="HD16115284C0F449AB03393047068E374" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the sharing of certificates of eligibles and accompanying résumés under sections 3318(b) and 3319(c) of title 5, United States Code.</text></paragraph></subsection></section> <section id="HAEDF160A796A4ECE9DAB8C23B92A04F2"><enum>7.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section>
