which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To impose additional prohibitions relating to foreign boycotts under the Export Control Reform Act of 2018, and for other purposes.</official-title></form><legis-body id="H265AF901D1F44E1F8DB5AA78351A0760" style="OLC"><section id="H7042772C019E41A295ECFEA66D5E2EDE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Israel Anti-Boycott Act</short-title></quote>.</text></section><section id="H3A58186BB9C84F5F9CCEEEB0BA0F911B"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="H6210CB17C0F14695AC189887AAD3FE67"><enum>(1)</enum><text display-inline="yes-display-inline">the Government of the United States should use its voice, vote, and influence with and in international governmental organizations to actively oppose politically motivated actions to boycott, divest from, or sanction Israel;</text></paragraph><paragraph id="HBC3E9A3BC670493AA194421DA1B98E53"><enum>(2)</enum><text>the Government of the United States combats anti-Israel boycotts and other discriminatory activity under the Export Control Reform Act of 2018 (subtitle B of title XVII of <external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>), under part VI of title X of the Tax Reform Act of 1976 (<external-xref legal-doc="public-law" parsable-cite="pl/94/455">Public Law 94–455</external-xref>; 90 Stat. 1649) (commonly referred to as the <quote>Ribicoff Amendment</quote>), through trade promotion authorities, in free trade agreements, and in accession negotiations to the World Trade Organization; however, due to the increased anti-Israel economic activity in international governmental organizations, it is necessary to update Federal authorities to combat anti-Israel boycotts and other discriminatory activity in such fora, including the United Nations Human Rights Council;</text></paragraph><paragraph id="H85BB72661DE64712878A1D16DB6747BC"><enum>(3)</enum><text display-inline="yes-display-inline">actions to boycott, divest from, or sanction Israel represent a concerted effort to extract concessions from Israel outside of direct negotiations between the Israelis and Palestinians; and</text></paragraph><paragraph id="H32B23A48495E43E295C2575D49D61AE9"><enum>(4)</enum><text display-inline="yes-display-inline">the United States-Israel Strategic Partnership Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/296">Public Law 113–296</external-xref>; 128 Stat. 4075) should be fully implemented through enhanced, governmentwide, coordinated United States-Israel scientific and technological cooperation in civilian areas, such as with respect to energy, water, agriculture, alternative fuel technology, civilian space technology, and security in order to counter the effects of actions to boycott, divest from, or sanction Israel.</text></paragraph></section><section commented="no" id="H79CF76A26FB1474B971FC40D6C7B9518"><enum>3.</enum><header>Additional prohibitions relating to foreign boycotts under Export Control Reform Act of 2018</header><subsection commented="no" id="H408B0CDB8F0B4652AF25818F201D55EE"><enum>(a)</enum><header>Declaration of policy</header><text display-inline="yes-display-inline">Section 1772 of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4841">50 U.S.C. 4841</external-xref>) is amended—</text><paragraph id="H0DE9812EC2394BE59ADA4DAABBD506BC"><enum>(1)</enum><text>by amending paragraph (1) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H89534BB7F47E4397AB492DB6B60FC62C" style="OLC"><paragraph id="H5F61D4AEBC75406ABE02F4EBFF039DBE"><enum>(1)</enum><text display-inline="yes-display-inline">to oppose restrictive trade practices or boycotts fostered or imposed by foreign countries or international governmental organizations, or efforts by foreign countries or international governmental organizations to collect information that have the effect of furthering or supporting restrictive trade practices or boycotts fostered or imposed by foreign countries or international governmental organizations, against other countries friendly to the United States or against any United States person;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H8050A22A476D4437B11B0633843A5B35"><enum>(2)</enum><text>in paragraph (2), by inserting <quote>or international governmental organization</quote> after <quote>any foreign country</quote>.</text></paragraph></subsection><subsection commented="no" id="HC1A8923A03D54F50AB261C2A34472E93"><enum>(b)</enum><header>Foreign boycotts</header><text display-inline="yes-display-inline">Section 1773 of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4842">50 U.S.C. 4842</external-xref>) is amended—</text><paragraph id="HB935DA532A5945E38BDCB25829B9F36B"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H3B3D8F26703746DD9A96EC895E5A2646"><enum>(A)</enum><text>in paragraph (1)—</text><clause commented="no" id="HD67AFEFDBA6F43C398BBF3B0B63916E0"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A)—</text><subclause commented="no" id="H2211477A5B884334B5750D5FAEC7D0B6"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>United States person</quote> and inserting <quote>covered person</quote>; and</text></subclause><subclause commented="no" id="H9184124BA31045E48642AB62B78C87D8"><enum>(II)</enum><text display-inline="yes-display-inline">by inserting after <quote>foreign country</quote> the following: <quote>or an international governmental organization, or efforts by a foreign country or international governmental organization to collect information that have the effect of furthering or supporting restrictive trade practices or boycotts fostered or imposed by a foreign country or international governmental organization,</quote>;</text></subclause></clause><clause id="H779C3BB95344498BA6B1FE9EB45D1476"><enum>(ii)</enum><text>in subparagraph (A), by inserting <quote>or international governmental organization (as the case may be)</quote> after <quote>of the boycotting country</quote>;</text></clause><clause id="H7C80C8D85C9A4D2488C09CC149E60CFF"><enum>(iii)</enum><text display-inline="yes-display-inline">in subparagraph (D)—</text><subclause id="H432751E2D4C348F8B659F4AA0CA02149"><enum>(I)</enum><text>by inserting <quote>(i)</quote> after <quote>(D)</quote>;</text></subclause><subclause id="H1084E6AE3DC143E58FA51C6167B91A29"><enum>(II)</enum><text>by inserting <quote>or with the international governmental organization (as the case may be)</quote> after <quote>in the boycotting country</quote>; and</text></subclause><subclause id="HBD296C73A2B7498C96672BA0D1ED393F"><enum>(III)</enum><text>by striking the last sentence and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H004C7722FB454C4EBE79C91AD450AC6F" style="OLC"><clause id="H928F87213A5E4792B7D0B3982269B361" indent="up1"><enum>(ii)</enum><text>Furnishing information to a foreign country or international governmental organization in response to efforts by a foreign country or international governmental organization to collect information that have the effect of furthering or supporting a restrictive trade practice or boycott fostered or imposed by a foreign country or international governmental organization. Such information includes information about whether any person has, has had, or proposes to have any business relationship (including a relationship by way of sale, purchase, legal or commercial representation, shipping or other transport, insurance, investment, or supply)—</text><subclause id="HF0DA402607EE4014953A7A5F74C98805"><enum>(I)</enum><text>with or in the country to which the restrictive trade practice or boycott applies;</text></subclause><subclause id="H8DAFD9276A214E4689D6DC894F842860"><enum>(II)</enum><text>with any business concern organized under the laws of that country;</text></subclause><subclause id="H29C08D18DC344005A20978C68A4B611D"><enum>(III)</enum><text>with any national or resident of that country; or</text></subclause><subclause id="H0073C875F3534ECF945ED5131F16F645"><enum>(IV)</enum><text>with any other person which is known or believed to be restricted from having any business relationship with or in a foreign country, or with an international governmental organization, that fosters or imposes the restrictive trade practice or boycott.</text></subclause></clause><clause id="HD3C79A43A1904197A6ABDDD47FC298AB" indent="up1"><enum>(iii)</enum><text>Nothing in this paragraph shall prohibit the furnishing of normal business information in a commercial context as defined by the Secretary.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause id="H85E76E708FCF4B2ABD4A661B13E9AEF6"><enum>(iv)</enum><text>in subparagraph (F), by striking <quote>United States person</quote> and inserting <quote>covered person</quote>;</text></clause></subparagraph><subparagraph id="H17B889E3871141A48744EEE5523F10BF"><enum>(B)</enum><text>in paragraph (2)(F), by striking <quote>United States person</quote> and inserting <quote>covered person</quote>; and</text></subparagraph><subparagraph id="H18D4F6F491DE40E5A15C044882E63838"><enum>(C)</enum><text>in paragraph (5), by striking <quote>United States person</quote> and inserting <quote>covered person</quote>;</text></subparagraph></paragraph><paragraph commented="no" id="HCAFFB0A08185453999F24427AC5B3391"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c), by inserting <quote>or international governmental organizations against other countries, or regarding efforts by foreign countries or international governmental organizations to collect information that have the effect of furthering or supporting restrictive trade practices or boycotts fostered or imposed by foreign countries or international governmental organizations</quote> after <quote>foreign countries</quote>; and</text></paragraph><paragraph commented="no" id="HE828191C55744968AC5550895B7C4BF1"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H131505CA14F94DA78D551166E7CA13F5" style="OLC"><subsection id="H02A44E4E8FE34702BE4D8046C0544515"><enum>(d)</enum><header>Covered person defined</header><paragraph id="HD5F2478A46464A39A33E5D2E0BCA9BE6"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>covered person</term> means—</text><subparagraph id="HA502B4249D43421591BB3A01D53F1D23"><enum>(A)</enum><text>any domestic concern (including any permanent domestic establishment of any foreign concern);</text></subparagraph><subparagraph id="H41029A295A844BAF8BB0C3BA2E49EDC7"><enum>(B)</enum><text>any foreign subsidiary or affiliate (including any permanent foreign establishment) of any domestic concern which is controlled in fact by such domestic concern, as determined under regulations of the President;</text></subparagraph><subparagraph id="H362EF266EFD14803A587E03F17AD4E0D"><enum>(C)</enum><text>the Government of the United States or any State, territory, or possession of the United States, or any subdivision, department, agency, or commission of any such government; or</text></subparagraph><subparagraph id="H8A1F9E04C4ED4421A4693A78AD248ADB"><enum>(D)</enum><text>an individual who is—</text><clause id="HF7AE942BA9084E2E8490C1C4CDEA519C"><enum>(i)</enum><text>a United States resident or national (other than such an individual residing outside the United States and employed by other than a United States person);</text></clause><clause id="H41615333425D4178AA0A89235031020F"><enum>(ii)</enum><text>an owner, officer, director, employee, or agent of a domestic concern described in subparagraph (A) or a foreign subsidiary or affiliate described in subparagraph (B) or an officer, director, employee, or agent of an entity described in subparagraph (C); and</text></clause><clause id="H5A694E9C55A74C4FBB0127A91F00BAB2"><enum>(iii)</enum><text>acting in the individual’s official capacity as such an owner, officer, director, employee, or agent.</text></clause></subparagraph></paragraph><paragraph id="HBF3B5F919E7F49019CF39ECE5055BA90"><enum>(2)</enum><header>Domestic concern</header><text>For purposes of paragraph (1), the term <term>domestic concern</term> does not include an individual.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="HDDA90A1038B9400B87601C4355C544AF"><enum>(c)</enum><header>Violations of section <enum-in-header>1773(a)</enum-in-header></header><text>Section 1774 of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4843">50 U.S.C. 4843</external-xref>) is amended—</text><paragraph commented="no" id="H1FC7A3B6245342E6B4B7DA4BA984EFA1"><enum>(1)</enum><text>in subsection (a), by striking <quote>A person</quote> and inserting <quote>Except as provided in subsection (e), a person</quote>; and</text></paragraph><paragraph commented="no" id="H90A51BB53E3949279AE1F4E68919B418"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H296395DD9D7848E4976A60C79B35F024" style="OLC"><subsection commented="no" id="HC2CDF34B47CD42F88D84CB419CB9116F"><enum>(e)</enum><header>Certain violations of section <enum-in-header>1773(a)</enum-in-header></header><paragraph commented="no" id="HE1A5F735417C467BA3A52A926D9B7A79"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever knowingly violates or conspires to or attempts to violate a regulation issued under section 1773(a) prohibiting an action described in paragraph (2) shall be subject to only a monetary penalty under subsection (a) or (b).</text></paragraph><paragraph commented="no" id="H58821FA7A75E42A8BF87E2DA3E25C2F9"><enum>(2)</enum><header>Actions described</header><text display-inline="yes-display-inline">An action described in this paragraph is any action described in subparagraphs (A) through (F) of section 1773(a)(1) taken by a covered person (as defined in section 1773(d)), or knowingly agreed to be taken by such a person, with respect to the person's activities in the interstate or foreign commerce of the United States, with the intent to comply with, further, or support—</text><subparagraph commented="no" id="H9420898350FC485A9088DE7EF1450AAC"><enum>(A)</enum><text display-inline="yes-display-inline">any boycott fostered or imposed by an international governmental organization against a country which is friendly to the United States and which is not itself the object of any form of boycott pursuant to United States law or regulation; or</text></subparagraph><subparagraph commented="no" id="HA37789E06ACC4B80B6DE8CE230EB1A56"><enum>(B)</enum><text display-inline="yes-display-inline">efforts by a foreign country or international governmental organization to collect information that have the effect of furthering or supporting restrictive trade practices or boycotts fostered or imposed by a foreign country or international governmental organization against a country described in subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="HD6A3079D3F8D43B696380CB0CB96D745"><enum>(d)</enum><header>Definitions</header><text>Part II of the Export Control Reform Act of 2018 is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H3A52ABE661E24848A5819AECE52ED498" style="OLC"><section id="HF28406A77C7E4FFBA742F1C4A1A52D16"><enum>1775.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text><paragraph commented="no" id="H542E174922F343C2A96057E7CFD55F53"><enum>(1)</enum><header>International governmental organization</header><text>The term <term>international governmental organization</term> includes—</text><subparagraph commented="no" id="H383C3BCAEEFC4DF38A7692C963D1F856"><enum>(A)</enum><text>the United Nations, including organizations within the United Nations such as the United Nations Human Rights Council; and</text></subparagraph><subparagraph commented="no" id="H2E094A97AF054CA39BF0CAA47A2EDAC4"><enum>(B)</enum><text>the European Union.</text></subparagraph></paragraph><paragraph commented="no" id="H741B27A5DD9F4A79B584FF170AFF6D5A"><enum>(2)</enum><header>Efforts by a foreign country or international governmental organization, etc</header><text>The term <term>efforts by a foreign country or international governmental organization to collect information that have the effect of furthering or supporting a restrictive trade practice or boycott fostered or imposed by a foreign country or international governmental organization</term> includes efforts by the United Nations Human Rights Council to collect information for the establishment of a database of entities that operate, or have business relations with entities that operate, beyond Israel’s 1949 Armistice lines, including East Jerusalem.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="HDCF699E9E1D94613A692A13B78AD1C3B"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act and apply with respect to actions described in section 1773(a) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4842">50 U.S.C. 4842(a)</external-xref>) taken or knowingly agreed to be taken on or after such date of enactment.</text></subsection></section><section id="HADC6022878434A26BCC713CFF8E390DE"><enum>4.</enum><header>Rules of construction</header><subsection id="H60D6CC1953E54BC0BDDD9131D8B13BEA"><enum>(a)</enum><header>Nothing diminishing first amendment</header><text>Nothing in this Act or an amendment made by this Act shall be construed to diminish or infringe upon any right protected under the first amendment to the Constitution.</text></subsection><subsection id="H577199D0385F471FB7457B90045E755A"><enum>(b)</enum><header>Noncommercial speech or other expressive activity</header><text>Consistent with current enforcement practices of the Department of Commerce, nothing in this Act or an amendment made by this Act shall be construed to permit a person’s noncommercial speech or other noncommercial expressive activity to be used—</text><paragraph id="HB18815DE91524482BFA8DA7681AFC7F3"><enum>(1)</enum><text display-inline="yes-display-inline">as evidence to prove a violation of section 1773(a) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4842">50 U.S.C. 4842(a)</external-xref>), as amended by section 3(b), including as evidence to prove intent to violate such section 1773(a); or</text></paragraph><paragraph id="H050B2C0A69D0465A968F8BB38530B1CB"><enum>(2)</enum><text>as support for initiating an investigation into whether such a violation has occurred.</text></paragraph></subsection></section></legis-body></bill>
