Water rights.</toc-entry></toc></subsection></section><section id="HA157A1A70F4F4E24868D7146BFF5492A"><enum>2.</enum><header>Definition of State</header><text display-inline="no-display-inline">In this Act, the term <term>State</term> means the State of California.</text></section><title id="H8C6DA9BBE7DA45379195C6E9E6E780D1"><enum>I</enum><header>SAN GABRIEL NATIONAL RECREATION AREA</header><section id="H79454C8290A14A23A4B5F062228D94EE"><enum>101.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this title are—</text><paragraph id="H12A28C9FBAA241579EE7376DF2B05A46"><enum>(1)</enum><text>to conserve, protect, and enhance for the benefit and enjoyment of present and future generations the ecological, scenic, wildlife, recreational, cultural, historical, natural, educational, and scientific resources of the Recreation Area;</text></paragraph><paragraph id="H6ED3270AD36944A2ABDEF1EF48001F6C"><enum>(2)</enum><text>to provide environmentally responsible, well-managed recreational opportunities within the Recreation Area;</text></paragraph><paragraph id="H7B424084FE70493FA39D8B26370E644A"><enum>(3)</enum><text>to improve access to and from the Recreation Area;</text></paragraph><paragraph id="H452E79CE5DEB4275B6502424AEACB625"><enum>(4)</enum><text>to provide expanded educational and interpretive services to increase public understanding of, and appreciation for, the natural and cultural resources of the Recreation Area;</text></paragraph><paragraph id="H2616243CE6C64C8EBFBB01077A42B715"><enum>(5)</enum><text>to facilitate the cooperative management of the land and resources within the Recreation Area, in collaboration with the State and political subdivisions of the State, historical, business, cultural, civic, recreational, tourism and other nongovernmental organizations, and the public; and</text></paragraph><paragraph id="H067EF7C7B7F24B508E546AAB07EB8D59"><enum>(6)</enum><text>to allow the continued use of the Recreation Area by all individuals, entities, and local government agencies in activities relating to integrated water management, flood protection, water conservation, water quality, water rights, water supply, groundwater recharge and monitoring, wastewater treatment, public roads and bridges, and utilities within or adjacent to the Recreation Area.</text></paragraph></section><section id="HD7E66810BAC3498C8C4E6C1F28C59B71"><enum>102.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H58C7B39BEC154B119380881C487E4E6E"><enum>(1)</enum><header>Adjudication</header><text>The term <term>adjudication</term> means any final judgment, order, ruling, or decree entered in any judicial proceeding adjudicating or affecting water rights, surface water management, or groundwater management.</text></paragraph><paragraph id="H977BE2A870AB4A74A68C5A50A65B493A"><enum>(2)</enum><header>Advisory council</header><text>The term <term>Advisory Council</term> means the San Gabriel National Recreation Area Public Advisory Council established under section 107(a).</text></paragraph><paragraph id="H2FD422176A474A54B3B91C32238E53AA"><enum>(3)</enum><header>Federal lands</header><text>The term <term>Federal lands</term> means—</text><subparagraph id="HC6E71153DFFB46C3BFF5193BE172DB7A"><enum>(A)</enum><text>public lands under the jurisdiction of the Secretary of the Interior; and</text></subparagraph><subparagraph id="H7F0183C00D9A4EEBA95F2AA5392488E0"><enum>(B)</enum><text>lands under the jurisdiction of the Secretary of Defense, acting through the Chief of Engineers.</text></subparagraph></paragraph><paragraph id="HAC9CE331188A4402BA18981A270C0736"><enum>(4)</enum><header>Management plan</header><text>The term <term>management plan</term> means the management plan for the Recreation Area required under section 104(d).</text></paragraph><paragraph id="H7959C4F65AAC48469C3D2D4102D861F9"><enum>(5)</enum><header>Partnership</header><text>The term <term>Partnership</term> means the San Gabriel National Recreation Area Partnership established by section 108(a).</text></paragraph><paragraph id="H2642790BFB4D406C9803BC23654CBDA2"><enum>(6)</enum><header>Public water system</header><text>The term <term>public water system</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/42/300">42 U.S.C. 300(f)(4)</external-xref> or in section 116275 of the California Health and Safety Code.</text></paragraph><paragraph id="H832044687C5C44D0B4A8F5049086295C"><enum>(7)</enum><header>Recreation area</header><text>The term <term>Recreation Area</term> means the San Gabriel National Recreation Area established by section 103(a).</text></paragraph><paragraph id="H1C57B62DE3D345D6AB0A14321B770127"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="H2071D1B41863430CB09BF72B4BDB13B0"><enum>(9)</enum><header>Utility facility</header><text>The term <term>utility facility</term> means—</text><subparagraph id="HB6200B5E8A5F40B3847FF83B0EB50782"><enum>(A)</enum><text>any electric substations, communication facilities, towers, poles, and lines, ground wires, communication circuits, and other structures, and related infrastructure; and</text></subparagraph><subparagraph id="HBFA9B84FB20B404193B9109FAC0F1AF3"><enum>(B)</enum><text>any such facilities associated with a public water system.</text></subparagraph></paragraph><paragraph id="H108ECEEE205D4251A252131F146CF1BC"><enum>(10)</enum><header>Water resource facility</header><text>The term <term>water resource facility</term> means irrigation and pumping facilities, dams and reservoirs, flood control facilities, water conservation works, including debris protection facilities, sediment placement sites, rain gauges and stream gauges, water quality facilities, recycled water facilities, water pumping, conveyance and distribution systems, water storage tanks and reservoirs, and water treatment facilities, aqueducts, canals, ditches, pipelines, wells, hydropower projects, and transmission and other ancillary facilities, groundwater recharge facilities, water conservation, water filtration plants, and other water diversion, conservation, groundwater recharge, storage, and carriage structures.</text></paragraph></section><section id="H347A04CF4B6346C3AE724ABB77363ED7"><enum>103.</enum><header>San Gabriel National Recreation Area</header><subsection id="HB1B22932351A4698B2CC6618DC27946B"><enum>(a)</enum><header>Establishment; boundaries</header><text>Subject to valid existing rights, there is established as a unit of the National Park System in the State the San Gabriel National Recreation Area, which shall consist of approximately 49,387 acres of Federal land and interests in land in the State depicted as the <quote>Proposed San Gabriel National Recreation Area</quote> on the map entitled <quote>San Gabriel National Recreation Area Proposed Boundary</quote> and dated July 2019.</text></subsection><subsection id="H0B7D4B7DF92D4AD7ADEE15B6C08FB359"><enum>(b)</enum><header>Map and legal description</header><paragraph id="H8B21F8E07EB64D83A1D3B9C0FFEC5988"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of the enactment of this Act, the Secretary shall file a map and a legal description of the Recreation Area with—</text><subparagraph id="H9E2E61366750407A9809ECCC9383E19A"><enum>(A)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text></subparagraph><subparagraph id="H24445719FA864370A96E73E73D0A1BD5"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H05A45519C8D346CA94A3706303E549A1"><enum>(2)</enum><header>Force of law</header><text>The map and legal description filed under paragraph (1) shall have the same force and effect as if included in this Act, except that the Secretary may correct any clerical or typographical error in the map or legal description.</text></paragraph><paragraph id="H0F3B601566874E938026A49717A89A22"><enum>(3)</enum><header>Public availability</header><text>The map and legal description filed under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text></paragraph></subsection><subsection id="H5B836A6E195E4142ACCA025B7AE77672"><enum>(c)</enum><header>Administration and jurisdiction</header><paragraph id="HDB30A8CB6B2B4644B929DF5EDF17A0D1"><enum>(1)</enum><header>Public lands</header><text>The public lands included in the Recreation Area shall be administered by the Secretary, acting through the Director of the National Park Service.</text></paragraph><paragraph id="H1960FA9DAD214FA8B838DEB606EAF302"><enum>(2)</enum><header>Department of defense land</header><text>Although certain Federal lands under the jurisdiction of the Secretary of Defense are included in the recreation area, nothing in this title transfers administration jurisdiction of such Federal lands from the Secretary of Defense or otherwise affects Federal lands under the jurisdiction of the Secretary of Defense.</text></paragraph><paragraph id="HC18982B38DD841DBB31B4B1376FB5222"><enum>(3)</enum><header>State and local jurisdiction</header><text>Nothing in this title alters, modifies, or diminishes any right, responsibility, power, authority, jurisdiction, or entitlement of the State, a political subdivision of the State, including, but not limited to courts of competent jurisdiction, regulatory commissions, boards, and departments, or any State or local agency under any applicable Federal, State, or local law (including regulations).</text></paragraph></subsection></section><section id="H261FD2EB272547FEB2ABCC5EBA4DCC17"><enum>104.</enum><header>Management</header><subsection id="HF5D55F001CDF48CDB115E0747EB45A95"><enum>(a)</enum><header>National park system</header><text>Subject to valid existing rights, the Secretary shall manage the public lands included in the Recreation Area in a manner that protects and enhances the natural resources and values of the public lands, in accordance with—</text><paragraph id="H39CC62FB954A48D3BCDC82AF79B9F733"><enum>(1)</enum><text>this title;</text></paragraph><paragraph id="H11FBBE7FEBBD4E43A950E3E87792A189"><enum>(2)</enum><text display-inline="yes-display-inline">section 100101(a), chapter 1003, and sections 100751(a), 100752, 100753, and 102101 of title 54, United States Code (formerly known as the <quote>National Park Service Organic Act</quote>);</text></paragraph><paragraph id="HFB2DD7A32872461FB2B369BCAA201FFC"><enum>(3)</enum><text>the laws generally applicable to units of the National Park System; and</text></paragraph><paragraph id="HBC40EE8F76E14C019CEE209BBA89D400"><enum>(4)</enum><text>other applicable law, regulations, adjudications, and orders.</text></paragraph></subsection><subsection id="HC1F244B96D67487498ABF45064F34542"><enum>(b)</enum><header>Cooperation with secretary of defense</header><text>The Secretary shall cooperate with the Secretary of Defense to develop opportunities for the management of the Federal land under the jurisdiction of the Secretary of Defense included in the Recreation Area in accordance with the purposes described in section 101, to the maximum extent practicable.</text></subsection><subsection id="H40B87BB65BDD4E018AF0DB0E4B7B7F1B"><enum>(c)</enum><header>Treatment of non-Federal land</header><paragraph id="H436B9C86BE274E26B4FB813624F91A4C"><enum>(1)</enum><header>In general</header><text>Nothing in this title—</text><subparagraph id="HD68DE37E417C416E94E30F881A8784A1"><enum>(A)</enum><text>authorizes the Secretary to take any action that would affect the use of any land not owned by the United States within the Recreation Area;</text></subparagraph><subparagraph id="H45DAB56FF9694E8AB7FBD9FAA0675084"><enum>(B)</enum><text>affects the use of, or access to, any non-Federal land within the Recreation Area;</text></subparagraph><subparagraph id="H3B07E693205141A0AE0961C70ED1A7B7"><enum>(C)</enum><text>modifies any provision of Federal, State, or local law with respect to public access to, or use of, non-Federal land;</text></subparagraph><subparagraph id="HC15A31CF09C84627B1CFCA6CD6A0D143"><enum>(D)</enum><text>requires any owner of non-Federal land to allow public access (including Federal, State, or local government access) to private property or any other non-Federal land;</text></subparagraph><subparagraph id="HCFC4011B10904AFAA5263EF11FF950C9"><enum>(E)</enum><text>alters any duly adopted land use regulation, approved land use plan, or any other regulatory authority of any State or local agency or unit of Tribal government;</text></subparagraph><subparagraph id="H2C7F8AF6962B4342A72AB7E7D89DAE13"><enum>(F)</enum><text>creates any liability, or affects any liability under any other law, of any private property owner or other owner of non-Federal land with respect to any person injured on the private property or other non-Federal land;</text></subparagraph><subparagraph id="HBB2B9C70EAE240FD967F8729B51971DE"><enum>(G)</enum><text>conveys to the Partnership any land use or other regulatory authority;</text></subparagraph><subparagraph id="H597EF74596C84FDB846F7F07AA762D1E"><enum>(H)</enum><text>shall be construed to cause any Federal, State, or local regulation or permit requirement intended to apply to units of the National Park System to affect the Federal lands under the jurisdiction of the Secretary of Defense or non-Federal lands within the boundaries of the recreation area; or</text></subparagraph><subparagraph id="H110A50CF0F554724815438C0A43A9049"><enum>(I)</enum><text>requires any local government to participate in any program administered by the Secretary.</text></subparagraph></paragraph><paragraph id="HEB9033F4A2D1481C89A566BBBBE8C8F7"><enum>(2)</enum><header>Cooperation</header><text>The Secretary is encouraged to work with owners of non-Federal land who have agreed to cooperate with the Secretary to advance the purposes of this title.</text></paragraph><paragraph id="HDB8DE73105A04E0590433BC2F8E5B9EB"><enum>(3)</enum><header>Buffer zones</header><subparagraph id="H669EE7DB72944EA8B342D76EA63082A3"><enum>(A)</enum><header>In general</header><text>Nothing in this title establishes any protective perimeter or buffer zone around the Recreation Area.</text></subparagraph><subparagraph id="H6806375CA3AE4BA7809C8D00FF3B7CFD"><enum>(B)</enum><header>Activities or uses up to boundaries</header><text>The fact that an activity or use of land can be seen or heard from within the Recreation Area shall not preclude the activity or land use up to the boundary of the Recreation Area.</text></subparagraph></paragraph><paragraph id="HE21DCB2F736A42459B69DA79ABA446C3"><enum>(4)</enum><header>Facilities</header><text>Nothing in this title affects the operation, maintenance, modification, construction, destruction, removal, relocation, improvement or expansion of any water resource facility or public water system, or any solid waste, sanitary sewer, water or waste-water treatment, groundwater recharge or conservation, hydroelectric, conveyance distribution system, recycled water facility, or utility facility located within or adjacent to the Recreation Area.</text></paragraph><paragraph id="H4011BE0CB525438CB8C6188239FBF12D"><enum>(5)</enum><header>Exemption</header><text>Section 100903 of title 54, United States Code, shall not apply to the Puente Hills landfill, materials recovery facility, or intermodal facility.</text></paragraph></subsection><subsection id="H7D9D1B68F2644DD79B4CF4E78B5341B4"><enum>(d)</enum><header>Management plan</header><paragraph id="H159475F02E9547939A2EF48A79C03AD8"><enum>(1)</enum><header>Deadline</header><text>Not later than 3 years after the date of the enactment of this Act, the Secretary and the Advisory Council shall establish a comprehensive management plan for the Recreation Area that supports the purposes described in section 101.</text></paragraph><paragraph id="H3FF6B7BB8A9945838F16D1C13DAC7BAD"><enum>(2)</enum><header>Use of existing plans</header><text>In developing the management plan, to the extent consistent with this section, the Secretary may incorporate any provision of a land use or other plan applicable to the public lands included in the Recreation Area.</text></paragraph><paragraph id="H3A77400F88BA4804A3636D8B85BE3C20"><enum>(3)</enum><header>Incorporation of visitor services plan</header><text>To the maximum extent practicable, the Secretary shall incorporate into the management plan the visitor services plan under section 109(a)(2).</text></paragraph><paragraph id="HED9963452BFA45BAA4B8869306DEAB5F"><enum>(4)</enum><header>Partnership</header><text>In developing the management plan, the Secretary shall consider recommendations of the Partnership. To the maximum extent practicable, the Secretary shall incorporate recommendations of the Partnership into the management plan if the Secretary determines that the recommendations are feasible and consistent with the purposes in section 101, this title, and applicable laws (including regulations).</text></paragraph></subsection><subsection id="H5E9008FE8B4A4BD0B6F8450B8CD74730"><enum>(e)</enum><header>Fish and wildlife</header><text>Nothing in this title affects the jurisdiction of the State with respect to fish or wildlife located on public lands in the State.</text></subsection></section><section id="H266329E69E8249F1A2C0B99F0EF420EA"><enum>105.</enum><header>Acquisition of non-Federal land within Recreation Area</header><subsection id="H6199045398F24C789736D62C66BC831F"><enum>(a)</enum><header>Limited acquisition authority</header><paragraph id="H906F601EF9E34BF4AEB323D747AAE9D1"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary may acquire non-Federal land within the boundaries of the Recreation Area only through exchange, donation, or purchase from a willing seller.</text></paragraph><paragraph id="HCDDEEEBC083547C2AF401BCC97822499"><enum>(2)</enum><header>Additional requirement</header><text>As a further condition on the acquisition of land, the Secretary shall make a determination that the land contains important biological, cultural, historic, or recreational values.</text></paragraph></subsection><subsection id="H744395D6125F464B9768F1AF45561960"><enum>(b)</enum><header>Prohibition on use of eminent domain</header><text>Nothing in this title authorizes the use of eminent domain to acquire land or an interest in land.</text></subsection><subsection id="H12928BC9DD3940E6885941980ECFFC23"><enum>(c)</enum><header>Treatment of acquired land</header><text>Any land or interest in land acquired by the United States within the boundaries of the Recreation Area shall be—</text><paragraph id="HDC24E1A85E854D1086E7868C1DFEB803"><enum>(1)</enum><text>included in the Recreation Area; and</text></paragraph><paragraph id="H9473429E374C4C6289698A1F75E2B22F"><enum>(2)</enum><text>administered by the Secretary in accordance with—</text><subparagraph id="HE962D88E13DC42BFB2F242AB2FA79340"><enum>(A)</enum><text>this title; and</text></subparagraph><subparagraph id="H72BF0FCFCB3E4667A8FFF9BA72C4CEF1"><enum>(B)</enum><text>other applicable laws (including regulations).</text></subparagraph></paragraph></subsection></section><section id="H58167735143A4A5AAA5454FB6AD45F64"><enum>106.</enum><header>Water rights; water resource facilities; public roads; utility facilities</header><subsection id="HBFD28268166D4B989C936A103AEBDC09"><enum>(a)</enum><header>No effect on water rights</header><text>Nothing in this title or section 202—</text><paragraph id="HC166BA22AC7D4A178096C362DD0CBD10"><enum>(1)</enum><text>shall affect the use or allocation, as in existence on the date of the enactment of this Act, of any water, water right, or interest in water (including potable, recycled, reclaimed, waste, imported, exported, banked, or stored water, surface water, groundwater, and public trust interest);</text></paragraph><paragraph id="H0BC4B4C2F56F47F2894CD013FFBC9CFA"><enum>(2)</enum><text>shall affect any public or private contract in existence on the date of the enactment of this Act for the sale, lease, loan, or transfer of any water (including potable, recycled, reclaimed, waste, imported, exported, banked, or stored water, surface water, and groundwater);</text></paragraph><paragraph id="H908B038946B0424487D658A0566AAC7A"><enum>(3)</enum><text>shall be considered to be a relinquishment or reduction of any water rights reserved or appropriated by the United States in the State on or before the date of the enactment of this Act;</text></paragraph><paragraph id="HA9273AF6731C4DEF85F6051FC54C11E3"><enum>(4)</enum><text>authorizes or imposes any new reserved Federal water right or expands water usage pursuant to any existing Federal reserved, riparian or appropriative right;</text></paragraph><paragraph id="HEE7CD1A99A2D4479B05FD1A81E80A43B"><enum>(5)</enum><text>shall be considered a relinquishment or reduction of any water rights (including potable, recycled, reclaimed, waste, imported, exported, banked, or stored water, surface water, and groundwater) held, reserved, or appropriated by any public entity or other persons or entities, on or before the date of the enactment of this Act;</text></paragraph><paragraph id="H2F17314467014323865E04374B38A757"><enum>(6)</enum><text>shall be construed to, or shall interfere or conflict with the exercise of the powers or duties of any watermaster, public agency, public water system, court of competent jurisdiction, or other body or entity responsible for groundwater or surface water management or groundwater replenishment as designated or established pursuant to any adjudication or Federal or State law, including the management of the San Gabriel River watershed and basin, to provide water supply or other environmental benefits;</text></paragraph><paragraph id="HE08DB30359A64AA8AA3F278F5E53F75F"><enum>(7)</enum><text>shall be construed to impede or adversely impact any previously adopted Los Angeles County Drainage Area project, as described in the report of the Chief of Engineers dated June 30, 1992, including any supplement or addendum to that report, or any maintenance agreement to operate that project;</text></paragraph><paragraph id="HE0CA5FBE7A234F6E92F25AAEE47ECB4F"><enum>(8)</enum><text>shall interfere or conflict with any action by a watermaster, water agency, public water system, court of competent jurisdiction, or public agency pursuant to any Federal or State law, water right, or adjudication, including any action relating to water conservation, water quality, surface water diversion or impoundment, groundwater recharge, water treatment, conservation or storage of water, pollution, waste discharge, the pumping of groundwater; the spreading, injection, pumping, storage, or the use of water from local sources, storm water flows, and runoff, or from imported or recycled water, that is undertaken in connection with the management or regulation of the San Gabriel River;</text></paragraph><paragraph id="H6C335394F91349ACAC1BDDEADB9590D3"><enum>(9)</enum><text>shall interfere with, obstruct, hinder, or delay the exercise of, or access to, any water right by the owner of a public water system or any other individual or entity, including the construction, operation, maintenance, replacement, removal, repair, location, or relocation of any well; pipeline; or water pumping, treatment, diversion, impoundment, or storage facility; or other facility or property necessary or useful to access any water right or operate an public water system;</text></paragraph><paragraph id="HA737AA5BB7BD4C829B2C262A620DE5A3"><enum>(10)</enum><text>shall require the initiation or reinitiation of consultation with the United States Fish and Wildlife Service under, or the application of any provision of, the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) relating to any action affecting any water, water right, or water management or water resource facility in the San Gabriel River watershed and basin; or</text></paragraph><paragraph id="HC13F32C6908743E0BAA7E83958EB2BF0"><enum>(11)</enum><text>authorizes any agency or employee of the United States, or any other person, to take any action inconsistent with any of paragraphs (1) through (10).</text></paragraph></subsection><subsection id="H387A13E0087B47A2B16943BAFEA03035"><enum>(b)</enum><header>Water resource facilities</header><paragraph id="HB6498C676F434D22BE76F49BC8EC5C8A"><enum>(1)</enum><header>No effect on existing water resource facilities</header><text>Nothing in this title or section 202 shall affect—</text><subparagraph id="HF98428E1C7B24D4DBBAECCC43CE2B0DB"><enum>(A)</enum><text>the use, operation, maintenance, repair, construction, destruction, removal, reconfiguration, expansion, improvement or replacement of a water resource facility or public water system within or adjacent to the Recreation Area or San Gabriel Mountains National Monument; or</text></subparagraph><subparagraph id="H1527EE0A1BA142FFB01E3DE0D68FAC46"><enum>(B)</enum><text>access to a water resource facility within or adjacent to the Recreation Area or San Gabriel Mountains National Monument.</text></subparagraph></paragraph><paragraph id="H6721D65F51264ED2A57E5B46847432A0"><enum>(2)</enum><header>No effect on new water resource facilities</header><text>Nothing in this title or section 202 shall preclude the establishment of a new water resource facility (including instream sites, routes, and areas) within the Recreation Area or San Gabriel Mountains National Monument if the water resource facility or public water system is necessary to preserve or enhance the health, safety, reliability, quality or accessibility of water supply, or utility services to residents of Los Angeles County.</text></paragraph><paragraph id="H892AD15DE2324B3592331101865A1A54"><enum>(3)</enum><header>Flood control</header><text>Nothing in this title or section 202 shall be construed to—</text><subparagraph id="H20E6EE4241054F42B1965F4BBDF9D4D5"><enum>(A)</enum><text>impose any new restriction or requirement on flood protection, water conservation, water supply, groundwater recharge, water transfers, or water quality operations and maintenance; or</text></subparagraph><subparagraph id="H41734EA89754480CAE894FE7BAEAA763"><enum>(B)</enum><text>increase the liability of an agency or public water system carrying out flood protection, water conservation, water supply, groundwater recharge, water transfers, or water quality operations.</text></subparagraph></paragraph><paragraph id="HF55138C9316C479FA5C219C0707FFFEF"><enum>(4)</enum><header>Diversion or use of water</header><text>Nothing in this title or section 202 shall authorize or require the use of water or water rights in, or the diversion of water to, the Recreation Area or San Gabriel Mountains National Monument.</text></paragraph></subsection><subsection id="HFE40997B01AC41F7B65578D727D5AAE4"><enum>(c)</enum><header>Utility facilities and rights of way</header><text>Nothing in this title or section 202 shall—</text><paragraph id="HE3ED0E03CAB14ABAADE150E9A911EE8C"><enum>(1)</enum><text>affect the use, operation, maintenance, repair, construction, destruction, reconfiguration, expansion, inspection, renewal, reconstruction, alteration, addition, relocation, improvement, removal, or replacement of a utility facility or appurtenant right-of-way within or adjacent to the Recreation Area or San Gabriel Mountains National Monument;</text></paragraph><paragraph id="HD13F391521BC4A42889A460B014A28B0"><enum>(2)</enum><text>affect access to a utility facility or right-of-way within or adjacent to the Recreation Area or San Gabriel Mountains National Monument; or</text></paragraph><paragraph id="H549BB81F669B4EF99B9B348B444C86EF"><enum>(3)</enum><text>preclude the establishment of a new utility facility or right-of-way (including instream sites, routes, and areas) within the Recreation Area or San Gabriel Mountains National Monument if such a facility or right-of-way is necessary for public health and safety, electricity supply, or other utility services.</text></paragraph></subsection><subsection id="HFD10B01009034860AA7547CEFF19C229"><enum>(d)</enum><header>Roads; public transit</header><paragraph id="HDC0415F832594065B0044CB2076FDA18"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HF1DF028C634B44FC8943E1989285AA82"><enum>(A)</enum><header>Public road</header><text>The term <term>public road</term> means any paved road or bridge (including any appurtenant structure and right-of-way) that is—</text><clause id="HB229675AF0EF423DAFD481CF087A7047"><enum>(i)</enum><text>operated or maintained by a non-Federal entity; and</text></clause><clause id="HC651EC9B1290435EB1845A732845A719"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H6206E16C12934A12AD7D988E371C5F6C"><enum>(I)</enum><text>open to vehicular use by the public; or</text></subclause><subclause id="H339E847011DC4F85B3341E68F7AEF19D" indent="up1"><enum>(II)</enum><text>used by a public agency or utility for the operation, maintenance, improvement, repair, removal, relocation, construction, destruction or rehabilitation of infrastructure, a utility facility, or a right-of-way.</text></subclause></clause></subparagraph><subparagraph id="H8319996B6CB3424AAFDC1F56BA65261D"><enum>(B)</enum><header>Public transit</header><text>The term <term>public transit</term> means any transit service (including operations and rights-of-way) that is—</text><clause id="H5131CA2A6E1D4CE6992EDC105186EC88"><enum>(i)</enum><text>operated or maintained by a non-Federal entity; and</text></clause><clause id="H1E6FEA9F77E848CDB407D7CEF9A134FC"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H9978E087228648BEA1C1CF1FC6177B09"><enum>(I)</enum><text>open to the public; or</text></subclause><subclause id="H8B408008D792462DBA3B8AD46786A1B0" indent="up1"><enum>(II)</enum><text>used by a public agency or contractor for the operation, maintenance, repair, construction, or rehabilitation of infrastructure, a utility facility, or a right-of-way.</text></subclause></clause></subparagraph></paragraph><paragraph id="H0A0C3CDEB00641739E6DACFDCF46890A"><enum>(2)</enum><header>No effect on public roads or public transit</header><text>Nothing in this title or section 202—</text><subparagraph id="HDA41CA40989844F3B6E193C49E771A73"><enum>(A)</enum><text>authorizes the Secretary to take any action that would affect the operation, maintenance, repair, or rehabilitation of public roads or public transit (including activities necessary to comply with Federal or State safety or public transit standards); or</text></subparagraph><subparagraph id="HAF2367FA0EF443B291478C6C1B27C9FF"><enum>(B)</enum><text>creates any new liability, or increases any existing liability, of an owner or operator of a public road.</text></subparagraph></paragraph></subsection></section><section id="H044A10D4988C4D80AFED5AB30D16CDC6"><enum>107.</enum><header>San Gabriel National Recreation Area Public Advisory Council</header><subsection id="H8ABFD7BE2796408F98C4DE74616D53B0"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall establish an advisory council, to be known as the <quote>San Gabriel National Recreation Area Public Advisory Council</quote>.</text></subsection><subsection id="H2A230D8FBA524687A1E6F4F8DB3B2A96"><enum>(b)</enum><header>Duties</header><text>The Advisory Council shall advise the Secretary regarding the development and implementation of the management plan and the visitor services plan.</text></subsection><subsection id="HAE5E5D92C5684145BDFAB4390E66610B"><enum>(c)</enum><header>Applicable law</header><text>The Advisory Council shall be subject to—</text><paragraph id="H87A6EB3D30BF4FD89228A5F11DE6685E"><enum>(1)</enum><text>the Federal Advisory Committee Act (5 U.S.C. App.); and</text></paragraph><paragraph id="HED640D3F809C41B3BAE72672C5E0E6C3"><enum>(2)</enum><text>all other applicable laws (including regulations).</text></paragraph></subsection><subsection id="H6438529BE1E04C77AC92DE1B83D69054"><enum>(d)</enum><header>Membership</header><text>The Advisory Council shall consist of 22 members, to be appointed by the Secretary after taking into consideration recommendations of the Partnership, of whom—</text><paragraph id="H45ABDA8FF5444223A3D57F6952D5E95A"><enum>(1)</enum><text>2 shall represent local, regional, or national environmental organizations;</text></paragraph><paragraph id="H523BA6C330984031BCB58C1AE653CCBE"><enum>(2)</enum><text>2 shall represent the interests of outdoor recreation, including off-highway vehicle recreation, within the Recreation Area;</text></paragraph><paragraph id="H9B939D303B50479C822DBA60ECE9C383"><enum>(3)</enum><text>2 shall represent the interests of community-based organizations, the missions of which include expanding access to the outdoors;</text></paragraph><paragraph id="HF78D94BC26A44CA48539DD4B18C69229"><enum>(4)</enum><text>2 shall represent business interests;</text></paragraph><paragraph id="H31413E93C902437A9F5C9892B5AA884F"><enum>(5)</enum><text>1 shall represent Indian Tribes within or adjacent to the Recreation Area;</text></paragraph><paragraph id="HDE3D159DB7BB4E9A9F2319C607967D79"><enum>(6)</enum><text>1 shall represent the interests of homeowners’ associations within the Recreation Area;</text></paragraph><paragraph id="HE2DC9A7ECF6A4FD3896732D4C2DA3B54"><enum>(7)</enum><text>3 shall represent the interests of holders of adjudicated water rights, public water systems, water agencies, wastewater and sewer agencies, recycled water facilities, and water management and replenishment entities;</text></paragraph><paragraph id="HD9A3BAE78C994BA895B897CA45304FD1"><enum>(8)</enum><text>1 shall represent energy and mineral development interests;</text></paragraph><paragraph id="H23844029986D437E943E9594BFF917FF"><enum>(9)</enum><text>1 shall represent owners of Federal grazing permits or other land use permits within the Recreation Area;</text></paragraph><paragraph id="HB8F103BD37544EE399268E6C9D8B899E"><enum>(10)</enum><text>1 shall represent archaeological and historical interests;</text></paragraph><paragraph id="H6F37362BCFDF4787A50428C91C9984E7"><enum>(11)</enum><text>1 shall represent the interests of environmental educators;</text></paragraph><paragraph id="H1772529CD1BA48E1997B308A4BA6FBC5"><enum>(12)</enum><text>1 shall represent cultural history interests;</text></paragraph><paragraph id="HF317EE4F3374472583EC1A0B9C04C0E8"><enum>(13)</enum><text>1 shall represent environmental justice interests;</text></paragraph><paragraph id="HF313921EEFAC4B6DA83F27FACF1A3421"><enum>(14)</enum><text>1 shall represent electrical utility interests; and</text></paragraph><paragraph id="H2A13D48123354CCA996E9D7696CA42C8"><enum>(15)</enum><text>2 shall represent the affected public at large.</text></paragraph></subsection><subsection id="H085C13356EE5429DAB4CE56EDBB75F47"><enum>(e)</enum><header>Terms</header><paragraph id="HD20C1475FCE44E79AB2E00989C4413DF"><enum>(1)</enum><header>Staggered terms</header><text>A member of the Advisory Council shall be appointed for a term of 3 years, except that, of the members first appointed, 7 of the members shall be appointed for a term of 1 year and 7 of the members shall be appointed for a term of 2 years.</text></paragraph><paragraph id="H43C35A150F2343D4B928025661E0D651"><enum>(2)</enum><header>Reappointment</header><text>A member may be reappointed to serve on the Advisory Council on the expiration of the term of service of the member.</text></paragraph><paragraph id="HD2C4490745494D198C5AF3BD14D64321"><enum>(3)</enum><header>Vacancy</header><text>A vacancy on the Advisory Council shall be filled in the same manner in which the original appointment was made.</text></paragraph></subsection><subsection id="HA261E93DC66B4B18A68FE85DD957C62B"><enum>(f)</enum><header>Quorum</header><text>A quorum shall be ten members of the advisory council. The operations of the advisory council shall not be impaired by the fact that a member has not yet been appointed as long as a quorum has been attained.</text></subsection><subsection id="HA709CEED58574B2A81A152E241104924"><enum>(g)</enum><header>Chairperson; procedures</header><text>The Advisory Council shall elect a chairperson and establish such rules and procedures as the advisory council considers necessary or desirable.</text></subsection><subsection id="HB41AAF997F294B50B7BBFC4FE590EA77"><enum>(h)</enum><header>Service without compensation</header><text>Members of the Advisory Council shall serve without pay.</text></subsection><subsection id="H242B59C6457D4E8EB44DBE753A7A7671"><enum>(i)</enum><header>Termination</header><text>The Advisory Council shall cease to exist—</text><paragraph id="H3B860F497A92426FA1A270C3405C9702"><enum>(1)</enum><text>on the date that is 5 years after the date on which the management plan is adopted by the Secretary; or</text></paragraph><paragraph id="H2BDD233081364B3283541B7BD05B68C3"><enum>(2)</enum><text>on such later date as the Secretary considers to be appropriate.</text></paragraph></subsection></section><section id="HB19E57FA2D9C4E21BA815C721FB73F36"><enum>108.</enum><header>San Gabriel National Recreation Area Partnership</header><subsection id="H7E7335D9C8874A82A0D09D536B42176A"><enum>(a)</enum><header>Establishment</header><text>There is established a Partnership, to be known as the <quote>San Gabriel National Recreation Area Partnership</quote>.</text></subsection><subsection id="H542A1D87F7174E0F8C5B3F3FDFDFA4CD"><enum>(b)</enum><header>Purposes</header><text>The purposes of the Partnership are to—</text><paragraph id="HD70EE614D3A548438E465C4662883109"><enum>(1)</enum><text>coordinate the activities of Federal, State, Tribal, and local authorities and the private sector in advancing the purposes of this title; and</text></paragraph><paragraph id="HD2ADE33661974805AE994C7503C088F2"><enum>(2)</enum><text>use the resources and expertise of each agency in improving management and recreational opportunities within the Recreation Area.</text></paragraph></subsection><subsection id="HE9A526383F094133BAEDACB5E1D293EC"><enum>(c)</enum><header>Membership</header><text>The Partnership shall include the following:</text><paragraph id="HD917A7FB22E1447EBAF543AC95818CD8"><enum>(1)</enum><text>The Secretary (or a designee) to represent the National Park Service.</text></paragraph><paragraph id="H90F427333DDE475E883422263A83C53E"><enum>(2)</enum><text>The Secretary of Defense (or a designee) to represent the Corps of Engineers.</text></paragraph><paragraph id="HAB1AA49D36704D8791388D437B5FDBB6"><enum>(3)</enum><text>The Secretary of Agriculture (or a designee) to represent the Forest Service.</text></paragraph><paragraph id="HA3D30A48E03F42CCA4629261A876E36A"><enum>(4)</enum><text>The Secretary of the Natural Resources Agency of the State (or a designee) to represent—</text><subparagraph id="H836FDF686C624CB58BE653D2177D43AB"><enum>(A)</enum><text>the California Department of Parks and Recreation; and</text></subparagraph><subparagraph id="HBED8EBA43C3645B2AA64F4EC355233CC"><enum>(B)</enum><text>the Rivers and Mountains Conservancy.</text></subparagraph></paragraph><paragraph id="HC9B143C901364556986046F25B5F2B94"><enum>(5)</enum><text>1 designee of the Los Angeles County Board of Supervisors.</text></paragraph><paragraph id="H6B17DF84C2B1406788ED8070CF25F9A4"><enum>(6)</enum><text>1 designee of the Puente Hills Habitat Preservation Authority.</text></paragraph><paragraph id="H91557E1ED7A04E0FA6FF64E79017BCD7"><enum>(7)</enum><text>4 designees of the San Gabriel Council of Governments, of whom 1 shall be selected from a local land conservancy.</text></paragraph><paragraph id="H321E4D1334E34075B6C622042939AFE2"><enum>(8)</enum><text>1 designee of the San Gabriel Valley Economic Partnership.</text></paragraph><paragraph id="H9F06B15E1FC84DF9A6EB2CEB25EDA67D"><enum>(9)</enum><text>1 designee of the Los Angeles County Flood Control District.</text></paragraph><paragraph id="H05574660936E4064B6904DBFBFA4679E"><enum>(10)</enum><text>1 designee of the San Gabriel Valley Water Association.</text></paragraph><paragraph id="H2A9552361F8F42548BC2B6EEB352C216"><enum>(11)</enum><text>1 designee of the Central Basin Water Association.</text></paragraph><paragraph id="H5DB063AAC1694A98ABD44777F14CF763"><enum>(12)</enum><text>1 designee of the Main San Gabriel Basin Watermaster.</text></paragraph><paragraph id="HFFF59C181ED145E6903081218C601408"><enum>(13)</enum><text>1 designee of a public utility company, to be appointed by the Secretary.</text></paragraph><paragraph id="H753E0A33496A45CEA24B3BD80EA41801"><enum>(14)</enum><text>1 designee of the Watershed Conservation Authority.</text></paragraph><paragraph id="H0235E8874EAA4FF0BBE6A1F020258EED"><enum>(15)</enum><text>1 designee of the Advisory Council for the period during which the Advisory Council remains in effect.</text></paragraph><paragraph id="HB986B8061A3A461FA1612772945A4265"><enum>(16)</enum><text>1 designee of San Gabriel Mountains National Monument Community Collaborative.</text></paragraph></subsection><subsection id="HC929472B298F4B03B272882CD6EEF283"><enum>(d)</enum><header>Duties</header><text>To advance the purposes described in section 101, the Partnership shall—</text><paragraph id="H1CB33294654C4E1DA1244FE708F666CC"><enum>(1)</enum><text>make recommendations to the Secretary regarding the development and implementation of the management plan;</text></paragraph><paragraph id="H4F5FEF637DDC491B88C19AFFC7816936"><enum>(2)</enum><text>review and comment on the visitor services plan under section 109(a)(2), and facilitate the implementation of that plan;</text></paragraph><paragraph id="H03749E4FC83D4F9DA7A11D5EAD808491"><enum>(3)</enum><text>assist units of local government, regional planning organizations, and nonprofit organizations in advancing the purposes of the Recreation Area by—</text><subparagraph id="HA23A75A578424A76B53BAC68D86483F9"><enum>(A)</enum><text>carrying out programs and projects that recognize, protect, and enhance important resource values within the Recreation Area;</text></subparagraph><subparagraph id="HD96E6AF922444353B9718438099FAEB0"><enum>(B)</enum><text>establishing and maintaining interpretive exhibits and programs within the Recreation Area;</text></subparagraph><subparagraph id="H1126734CE9A940488E0AA51D089637D4"><enum>(C)</enum><text>developing recreational and educational opportunities in the Recreation Area in accordance with the purposes of this title;</text></subparagraph><subparagraph id="H1EAB2B60FC87420BBB9D0BEB92D5506E"><enum>(D)</enum><text>increasing public awareness of, and appreciation for, natural, historic, scenic, and cultural resources of the Recreation Area;</text></subparagraph><subparagraph id="HA401F9DEEF504910B76B50975F3D26EB"><enum>(E)</enum><text>ensuring that signs identifying points of public access and sites of interest are posted throughout the Recreation Area;</text></subparagraph><subparagraph id="H23B4E3E2C0764AEF9BFFDC0F2DE3CD51"><enum>(F)</enum><text>promoting a wide range of partnerships among governments, organizations, and individuals to advance the purposes of the Recreation Area; and</text></subparagraph><subparagraph id="HFAA800FA28074C4B81BFA693FE758A65"><enum>(G)</enum><text>ensuring that management of the Recreation Area takes into consideration—</text><clause id="H44BEEE6590514D8098E52034663CABA5"><enum>(i)</enum><text>local ordinances and land-use plans; and</text></clause><clause id="H481482D5ABA3411B9BDBA6AF28587D03"><enum>(ii)</enum><text>adjacent residents and property owners;</text></clause></subparagraph></paragraph><paragraph id="HA319B07634904DA4BA562E362B9973F4"><enum>(4)</enum><text>make recommendations to the Secretary regarding the appointment of members to the Advisory Council; and</text></paragraph><paragraph id="H4C4699AA9F734CA48581469C664F2775"><enum>(5)</enum><text>carry out any other actions necessary to achieve the purposes of this title.</text></paragraph></subsection><subsection id="HD38F0B475BE14703BAB271771FFC2EA0"><enum>(e)</enum><header>Authorities</header><text>Subject to approval by the Secretary, for the purposes of preparing and implementing the management plan, the Partnership may use Federal funds made available under this section—</text><paragraph id="HF8520DD3B652446399D76CB7A6724B14"><enum>(1)</enum><text>to make grants to the State, political subdivisions of the State, nonprofit organizations, and other persons;</text></paragraph><paragraph id="H08C9D4C884B44815BDED4FCEAFA3EFCB"><enum>(2)</enum><text>to enter into cooperative agreements with, or provide grants or technical assistance to, the State, political subdivisions of the State, nonprofit organizations, Federal agencies, and other interested parties;</text></paragraph><paragraph id="H2447830867F44F4A97DF904AFA35030C"><enum>(3)</enum><text>to hire and compensate staff;</text></paragraph><paragraph id="H6EB7400115B34D7DAC7FE197C450333E"><enum>(4)</enum><text>to obtain funds or services from any source, including funds and services provided under any other Federal law or program;</text></paragraph><paragraph id="H2BCBFC0BF27844D685CA88E357F4C192"><enum>(5)</enum><text>to contract for goods or services; and</text></paragraph><paragraph id="H9DD6A3B2BF534D9D8374B154BF6DFFDA"><enum>(6)</enum><text>to support activities of partners and any other activities that—</text><subparagraph id="HE291DD0FA4524217A1511F942DEC4AAD"><enum>(A)</enum><text>advance the purposes of the Recreation Area; and</text></subparagraph><subparagraph id="H4225EED824394B0293840FEFF8CD82DC"><enum>(B)</enum><text>are in accordance with the management plan.</text></subparagraph></paragraph></subsection><subsection id="HE886A560C6054E4797D458FC4DDB5CFF"><enum>(f)</enum><header>Terms of office; reappointment; vacancies</header><paragraph id="HD3D0BBCB2F8E430792399F310F2F0111"><enum>(1)</enum><header>Terms</header><text>A member of the Partnership shall be appointed for a term of 3 years.</text></paragraph><paragraph id="H9C9BB18C84C3429882FB9054BB172533"><enum>(2)</enum><header>Reappointment</header><text>A member may be reappointed to serve on the Partnership on the expiration of the term of service of the member.</text></paragraph><paragraph id="H32B0973BA45E49808CFD7E701D973630"><enum>(3)</enum><header>Vacancy</header><text>A vacancy on the Partnership shall be filled in the same manner in which the original appointment was made.</text></paragraph></subsection><subsection id="HB13384098510489D8309BB4B422E8F58"><enum>(g)</enum><header>Quorum</header><text>A quorum shall be eleven members of the Partnership. The operations of the Partnership shall not be impaired by the fact that a member has not yet been appointed as long as a quorum has been attained.</text></subsection><subsection id="HF0C0EE94A4324931B793DF6CC6922FC0"><enum>(h)</enum><header>Chairperson; procedures</header><text>The Partnership shall elect a chairperson and establish such rules and procedures as it deems necessary or desirable.</text></subsection><subsection id="H27C4391A6E964AD1BE013418EDAB6D61"><enum>(i)</enum><header>Service without compensation</header><text>A member of the Partnership shall serve without compensation.</text></subsection><subsection id="H2FA678780CB746269CB67273401748FB"><enum>(j)</enum><header>Duties and authorities of secretary</header><paragraph id="HE6D46C5BF6414E9EB95CFEEFD49FC6B4"><enum>(1)</enum><header>In general</header><text>The Secretary shall convene the Partnership on a regular basis to carry out this title.</text></paragraph><paragraph id="H44853E1165674A6D80EF1A352ED1284E"><enum>(2)</enum><header>Technical and financial assistance</header><text>The Secretary may provide to the Partnership or any member of the Partnership, on a reimbursable or nonreimbursable basis, such technical and financial assistance as the Secretary determines to be appropriate to carry out this title.</text></paragraph><paragraph id="HB98E705D848048A6B2DD4F85DC447A26"><enum>(3)</enum><header>Cooperative agreements</header><text>The Secretary may enter into a cooperative agreement with the Partnership, a member of the Partnership, or any other public or private entity to provide technical, financial, or other assistance to carry out this title.</text></paragraph><paragraph id="H6F60717A0A8D4F789DB49D842AC6E94D"><enum>(4)</enum><header>Construction of facilities on non-federal land</header><subparagraph id="HD03F7234841543D293FEDD6960296B88"><enum>(A)</enum><header>In general</header><text>In order to facilitate the administration of the Recreation Area, the Secretary is authorized, subject to valid existing rights, to construct administrative or visitor use facilities on land owned by a nonprofit organization, local agency, or other public entity in accordance with this Act and applicable law (including regulations).</text></subparagraph><subparagraph id="H9629D41BF7884A478287583E8BE4A8CA"><enum>(B)</enum><header>Additional requirements</header><text>A facility under this paragraph may only be developed—</text><clause id="H8462CF4559C6437CA4474DEF4939F719"><enum>(i)</enum><text>with the consent of the owner of the non-Federal land; and</text></clause><clause id="H68D52087CBF549BF8E60C5E5E2A6016D"><enum>(ii)</enum><text>in accordance with applicable Federal, State, and local laws (including regulations) and plans.</text></clause></subparagraph></paragraph><paragraph id="H0BAE554541554767A53AB72F4C711D3A"><enum>(5)</enum><header>Priority</header><text>The Secretary shall give priority to actions that—</text><subparagraph id="H0B7CA95A8719493087FE139B08FAE747"><enum>(A)</enum><text>conserve the significant natural, historic, cultural, and scenic resources of the Recreation Area; and</text></subparagraph><subparagraph id="HEB318FC284F9498E99A865F8DE8F1419"><enum>(B)</enum><text>provide educational, interpretive, and recreational opportunities consistent with the purposes of the Recreation Area.</text></subparagraph></paragraph></subsection><subsection id="HF34DBF0372F94407AA75FF05FCC134D9"><enum>(k)</enum><header>Committees</header><text>The Partnership shall establish—</text><paragraph id="HE9544682ADAF41FC9EAF93B93055CEC4"><enum>(1)</enum><text>a Water Technical Advisory Committee to advise the Secretary regarding water-related issues relating to the Recreation Area; and</text></paragraph><paragraph id="HDEAA8124245F4891823606319E39ABFC"><enum>(2)</enum><text>a Public Safety Advisory Committee to advise the Secretary regarding public safety issues relating to the Recreation Area.</text></paragraph></subsection></section><section id="H16A595A646C64107AB6A4C708CEFA340"><enum>109.</enum><header>Visitor services and facilities</header><subsection id="H409AA754D68E498AA62CFCBD7B9FB36F"><enum>(a)</enum><header>Visitor services</header><paragraph id="H769ABB96A8B64646929EB49A4CC76CF6"><enum>(1)</enum><header>Purpose</header><text>The purpose of this subsection is to facilitate the development of an integrated visitor services plan to improve visitor experiences in the Recreation Area through expanded recreational opportunities and increased interpretation, education, resource protection, and enforcement.</text></paragraph><paragraph id="H76F1E566BB2144619BE457FD097C21F0"><enum>(2)</enum><header>Visitor services plan</header><subparagraph id="H2EC01D265EB24F0486EDA0332E6BACF0"><enum>(A)</enum><header>In general</header><text>Not later than 3 years after the date of the enactment of this Act, the Secretary shall develop and carry out an integrated visitor services plan for the Recreation Area in accordance with this paragraph.</text></subparagraph><subparagraph id="H8D484736722B4F3A9307C32E7BD7C416"><enum>(B)</enum><header>Contents</header><text>The visitor services plan shall—</text><clause id="HB169F62C739F4A48A6ED4B9E06C2EC2F"><enum>(i)</enum><text>assess current and anticipated future visitation to the Recreation Area, including recreation destinations;</text></clause><clause id="H6F49D9509D28465D9DF4A5209DEE134D"><enum>(ii)</enum><text>consider the demand for various types of recreation (including hiking, picnicking, horseback riding, and the use of motorized and mechanized vehicles), as permissible and appropriate;</text></clause><clause id="HD0CB53FBEAE342CE8BED14A12141BAB2"><enum>(iii)</enum><text>evaluate the impacts of recreation on natural and cultural resources, water rights and water resource facilities, public roads, adjacent residents and property owners, and utilities within the Recreation Area, as well as the effectiveness of current enforcement and efforts;</text></clause><clause id="H0FC6F3B1E56E4EC6AC655CDEA0F340B9"><enum>(iv)</enum><text>assess the current level of interpretive and educational services and facilities;</text></clause><clause id="H45CB4C754E5C4B69A45D1EF77B713506"><enum>(v)</enum><text>include recommendations to—</text><subclause id="HD442B64837ED46F2928146AF0FAFA7E4"><enum>(I)</enum><text>expand opportunities for high-demand recreational activities, in accordance with the purposes described in section 101;</text></subclause><subclause id="H659412FB9CF94654B486EBB34D9B5C2C"><enum>(II)</enum><text>better manage Recreation Area resources and improve the experience of Recreation Area visitors through expanded interpretive and educational services and facilities, and improved enforcement; and</text></subclause><subclause id="HC4A7BA1E356C4623B8C9C71CBAB9512B"><enum>(III)</enum><text>better manage Recreation Area resources to reduce negative impacts on the environment, ecology, and integrated water management activities in the Recreation Area;</text></subclause></clause><clause id="HED140F4574514067BB5CCEB6BC6FD847"><enum>(vi)</enum><text>in coordination and consultation with affected owners of non-Federal land, assess options to incorporate recreational opportunities on non-Federal land into the Recreation Area—</text><subclause id="HDD091FCA046C439BBE4F3243A13D2BD9"><enum>(I)</enum><text>in manner consistent with the purposes and uses of the non-Federal land; and</text></subclause><subclause id="HF4844DB8905A42538070DC84F9C8EC36"><enum>(II)</enum><text>with the consent of the non-Federal landowner;</text></subclause></clause><clause id="HB8EAF5D6DA944217BFE4C9D2FEB1C8DB"><enum>(vii)</enum><text>assess opportunities to provide recreational opportunities that connect with adjacent National Forest System land; and</text></clause><clause id="H41AFBC272A824FEDAC879D7B90B6AC59"><enum>(viii)</enum><text>be developed and carried out in accordance with applicable Federal, State, and local laws and ordinances.</text></clause></subparagraph><subparagraph id="HCCE981109FBF4EF1B92F66232AAF7C4E"><enum>(C)</enum><header>Consultation</header><text>In developing the visitor services plan, the Secretary shall—</text><clause id="HB17C146A0A304DB19A4FD4A6D83CADD7"><enum>(i)</enum><text>consult with—</text><subclause id="HEE98284E0BF9456F89BE4F1CA5BCF7CB"><enum>(I)</enum><text>the Partnership;</text></subclause><subclause id="HB8BAE1BBDF7A4FAF9250A3ED3F2DC54F"><enum>(II)</enum><text>the Advisory Council;</text></subclause><subclause id="H4192293E2A61425C839EEEF029607675"><enum>(III)</enum><text>appropriate State and local agencies; and</text></subclause><subclause id="HFFC67361DAAA466692A89CD1F2A3FF82"><enum>(IV)</enum><text>interested nongovernmental organizations; and</text></subclause></clause><clause id="H7448C500A2404F548180291F484639CC"><enum>(ii)</enum><text>involve members of the public.</text></clause></subparagraph></paragraph></subsection><subsection id="HFD6C323E42164F1BBACF13FC0DA272CE"><enum>(b)</enum><header>Visitor use facilities</header><paragraph id="HF11F04EF9175450B9D82997F94DAAEE1"><enum>(1)</enum><header>In general</header><text>The Secretary may construct visitor use facilities in the Recreation Area.</text></paragraph><paragraph id="H6C873EC04C284EF797C5FDD3C069BE44"><enum>(2)</enum><header>Requirements</header><text>Each facility under paragraph (1) shall be developed in accordance with applicable Federal, State, and local—</text><subparagraph id="H1A240FAE90054600AB224D8F8D18F07B"><enum>(A)</enum><text>laws (including regulations); and</text></subparagraph><subparagraph id="H934BD5C98728457FAF02E10064D2BBB7"><enum>(B)</enum><text>plans.</text></subparagraph></paragraph></subsection><subsection id="HEC696716C7FE48F19323347303988961"><enum>(c)</enum><header>Donations</header><paragraph id="H54161C31FFF947FB9FCA5C12F13EC737"><enum>(1)</enum><header>In general</header><text>The Secretary may accept and use donated funds, property, in-kind contributions, and services to carry out this title.</text></paragraph><paragraph id="H43EE6DD48321461C8522541FF8834B02"><enum>(2)</enum><header>Prohibition</header><text>The Secretary may not use the authority provided by paragraph (1) to accept non-Federal land that has been acquired after the date of the enactment of this Act through the use of eminent domain.</text></paragraph></subsection><subsection id="HE7F6638082334EA3BC628FA7C915DAF7"><enum>(d)</enum><header>Cooperative agreements</header><text>In carrying out this title, the Secretary may make grants to, or enter into cooperative agreements with, units of State, Tribal, and local governments and private entities to conduct research, develop scientific analyses, and carry out any other initiative relating to the management of, and visitation to, the Recreation Area.</text></subsection></section></title><title id="HBBF555EC42634A30841C86525EA194BB"><enum>II</enum><header>SAN GABRIEL MOUNTAINS</header><section id="HAAB2C30B99F04DB3B6E87E458F8300AD"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="HD3BE7F4597184139A53E635B2A23A317"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="H96BA0EE4395A4DB6B75B5B8D4B132FE7"><enum>(2)</enum><header>Wilderness area or addition</header><text>The term <term>wilderness area or addition</term> means any wilderness area or wilderness addition designated by section 203(a).</text></paragraph></section><section id="H9FC94E9787794BC2B83D467E7422172B"><enum>202.</enum><header>National Monument Boundary Modification</header><subsection id="H5790703BC4014CC3938063A634E21122"><enum>(a)</enum><header>In general</header><text>The Secretary shall modify the boundaries of the San Gabriel Mountains National Monument in the State to include the approximately 109,167 acres of additional National Forest System land depicted as the <quote>Proposed San Gabriel Mountains National Monument Expansion</quote> on the map entitled <quote>Proposed San Gabriel Mountains National Monument Expansion</quote> and dated June 26, 2019.</text></subsection><subsection id="H4A3F2CD2C9D74B32AB7A420B791493C2"><enum>(b)</enum><header>Administration</header><text>On inclusion of the National Forest System land described in subsection (a), the Secretary shall administer that land as part of the San Gabriel Mountains National Monument in accordance with the laws generally applicable to the Monument and this Act.</text></subsection><subsection id="H7974C9FFA49D4AD3B3F2EDE4A7330FF4"><enum>(c)</enum><header>Management plan</header><text>Not later than 3 years after the date of the enactment of this Act, the Secretary shall consult with State and local governments and the interested public to update the existing San Gabriel Mountains National Monument Plan to incorporate and provide management direction and protection for the lands added to the Monument.</text></subsection></section><section id="H0B46743C08174BB9B9D807E6BD192D2B"><enum>203.</enum><header>Designation of Wilderness Areas and Additions</header><subsection id="H7EC96E2DC32249EE9F82629EE59B8F16"><enum>(a)</enum><header>Designation</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), the following parcels of National Forest System land in the State are designated as wilderness and as components of the National Wilderness Preservation System:</text><paragraph id="HA4810B93895A4624B90434EC41E795CC"><enum>(1)</enum><header>Condor peak wilderness</header><text>Certain Federal land in the Angeles National Forest, comprising approximately 8,207 acres, as generally depicted on the map entitled <quote>Condor Peak Wilderness—Proposed</quote> and dated June 6, 2019, which shall be known as the <quote>Condor Peak Wilderness</quote>.</text></paragraph><paragraph id="HB4921CD6E2A346C38921EF95176291B0"><enum>(2)</enum><header>San gabriel wilderness additions</header><text>Certain Federal land in the Angeles National Forest, comprising approximately 2,032 acres, as generally depicted on the map entitled <quote>San Gabriel Wilderness Additions</quote> and dated June 6, 2019, which is incorporated in, and considered to be a part of, the San Gabriel Wilderness designated by <external-xref legal-doc="public-law" parsable-cite="pl/90/318">Public Law 90–318</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; 82 Stat. 131).</text></paragraph><paragraph id="H5261C2F55BF14E7FAD0F8D25383DC4D9"><enum>(3)</enum><header>Sheep mountain wilderness additions</header><text>Certain Federal land in the Angeles National Forest, comprising approximately 13,726 acres, as generally depicted on the map entitled <quote>Sheep Mountain Wilderness Additions</quote> and dated June 6, 2019, which is incorporated in, and considered to be a part of, the Sheep Mountain Wilderness designated by section 101(a)(29) of the California Wilderness Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; 98 Stat. 1623; <external-xref legal-doc="public-law" parsable-cite="pl/98/425">Public Law 98–425</external-xref>).</text></paragraph><paragraph id="HF6FF63F2A5DB48E196DE8CBA63487C80"><enum>(4)</enum><header>Yerba buena wilderness</header><text>Certain Federal land in the Angeles National Forest, comprising approximately 6,694 acres, as generally depicted on the map entitled <quote>Yerba Buena Wilderness—Proposed</quote> and dated June 6, 2019, which shall be known as the <quote>Yerba Buena Wilderness</quote>.</text></paragraph></subsection><subsection id="HAD0B8508F6304D9B879EA601BAEBF2B2"><enum>(b)</enum><header>Map and legal description</header><paragraph id="H70932799CF974C0A91A162534F202696"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of the enactment of this Act, the Secretary shall file a map and a legal description of the wilderness areas and additions with—</text><subparagraph id="HD70554EBA2CE45ECB422A9EB46867361"><enum>(A)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text></subparagraph><subparagraph id="H2844E4E9CB5E4CA1A2FAD1447A41F834"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph><paragraph id="HC84581A4A9EA4D12BDB8316CF1DA5430"><enum>(2)</enum><header>Force of law</header><text>The map and legal description filed under paragraph (1) shall have the same force and effect as if included in this title, except that the Secretary may correct any clerical or typographical error in the map or legal description.</text></paragraph><paragraph id="H4B997BE60C15465DBDB5984D216982C0"><enum>(3)</enum><header>Public availability</header><text>The map and legal description filed under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Forest Service.</text></paragraph></subsection></section><section id="H673031DA5B794C2D815E8DB5A38636F3"><enum>204.</enum><header>Administration of Wilderness Areas and Additions</header><subsection id="HF26F7C2CBCD24E90AA73CF7BBF1E362E"><enum>(a)</enum><header>In general</header><text>Subject to valid existing rights, the wilderness areas and additions shall be administered by the Secretary in accordance with this section and the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), except that any reference in that Act to the effective date of that Act shall be considered to be a reference to the date of the enactment of this Act.</text></subsection><subsection id="H7A07E12DDBBC4F98BB791E8CAAE98A28"><enum>(b)</enum><header>Fire management and related activities</header><paragraph id="H8ADBAB7D1E6746CD92AC4D430A06357E"><enum>(1)</enum><header>In general</header><text>The Secretary may take such measures in a wilderness area or addition designated in section 203 as are necessary for the control of fire, insects, or diseases in accordance with—</text><subparagraph id="HE3E1408178EB4DEA955F70F1F9888B07"><enum>(A)</enum><text>section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>); and</text></subparagraph><subparagraph id="HB6A4684CC3A040F1B34AD7AA0D9EC890"><enum>(B)</enum><text>House Report 98–40 of the 98th Congress.</text></subparagraph></paragraph><paragraph id="H5D08A3615871493587F79468D476A2F7"><enum>(2)</enum><header>Funding priorities</header><text>Nothing in this title limits funding for fire or fuels management in a wilderness area or addition.</text></paragraph><paragraph id="HF31A343B18804E6B95B8DBE532A2F5A9"><enum>(3)</enum><header>Revision and development of local fire management plans</header><text>As soon as practicable after the date of the enactment of this Act, the Secretary shall amend, as applicable, any local fire management plan that applies to a wilderness area or addition designated in section 203.</text></paragraph><paragraph id="HB8427AB490D64161918B53B3620F12D4"><enum>(4)</enum><header>Administration</header><text>In accordance with paragraph (1) and any other applicable Federal law, to ensure a timely and efficient response to a fire emergency in a wilderness area or addition, the Secretary shall—</text><subparagraph id="H1E3F1EBA53914CCFBA127179E05D04F0"><enum>(A)</enum><text>not later than 1 year after the date of the enactment of this Act, establish agency approval procedures (including appropriate delegations of authority to the Forest Supervisor, District Manager, or other agency officials) for responding to fire emergencies; and</text></subparagraph><subparagraph id="H5D0F06C203734D5198F34EA7293716E0"><enum>(B)</enum><text>enter into agreements with appropriate State or local firefighting agencies.</text></subparagraph></paragraph></subsection><subsection id="H49412E3845F04BBB9DAA7ADCE1C0A543"><enum>(c)</enum><header>Grazing</header><text>The grazing of livestock in a wilderness area or addition, if established before the date of the enactment of this Act, shall be administered in accordance with—</text><paragraph id="H1D5DBC2BCEBE4CED875E8C00E84ACBA7"><enum>(1)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text></paragraph><paragraph id="H5263F8E9B00C4E39831DFA6C5ED03B6A"><enum>(2)</enum><text>the guidelines contained in Appendix A of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text></paragraph></subsection><subsection id="H7F4AB28F7BCB4B05B9C30672A64F404E"><enum>(d)</enum><header>Fish and wildlife</header><paragraph id="H6B3033FF13994A5C96F9739A3A1C98FF"><enum>(1)</enum><header>In general</header><text>In accordance with section 4(d)(7) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(7)</external-xref>), nothing in this title affects the jurisdiction or responsibility of the State with respect to fish or wildlife on public land in the State.</text></paragraph><paragraph id="HDBA062431DA24D46BEE5A410D075FC53"><enum>(2)</enum><header>Management activities</header><subparagraph id="H0706452AEB204ECD93BEDCA821C261D7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In furtherance of the purposes and principles of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), the Secretary may conduct any management activities that are necessary to maintain or restore fish or wildlife populations or habitats in the wilderness areas and wilderness additions designated in section 203, if the management activities are—</text><clause id="HC0C90D82A4444E0FBFF9F2C96ACE7496"><enum>(i)</enum><text>consistent with relevant wilderness management plans; and</text></clause><clause id="H485C956655114E82A217F774AC9AD9CD"><enum>(ii)</enum><text>conducted in accordance with appropriate policies, such as the policies established in Appendix B of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text></clause></subparagraph><subparagraph id="H7260009665824EAE99FED33B38A51ED1"><enum>(B)</enum><header>Inclusions</header><text>A management activity under subparagraph (A) may include the occasional and temporary use of motorized vehicles, if the use, as determined by the Secretary, would promote healthy, viable, and more naturally distributed wildlife populations that would enhance wilderness values while causing the minimum impact necessary to accomplish those tasks.</text></subparagraph><subparagraph id="HB0690B13ABCE4780BEA7F28E69374685"><enum>(C)</enum><header>Existing activities</header><text>In accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>) and appropriate policies (such as the policies established in Appendix B of House Report 101–405), the State may use aircraft (including helicopters) in a wilderness area or addition to survey, capture, transplant, monitor, or provide water for a wildlife population, including bighorn sheep.</text></subparagraph></paragraph></subsection><subsection id="H1D4630AED5EE45D8925EBD05681E16B1"><enum>(e)</enum><header>Buffer zones</header><paragraph id="H39D74EDC630A492C924357CF376156F6"><enum>(1)</enum><header>In general</header><text>Congress does not intend for the designation of wilderness areas or wilderness additions by section 203 to lead to the creation of protective perimeters or buffer zones around each wilderness area or wilderness addition.</text></paragraph><paragraph id="H91C5D687433B435CA1FC2724F2055D26"><enum>(2)</enum><header>Activities or uses up to boundaries</header><text>The fact that nonwilderness activities or uses can be seen or heard from within a wilderness area or wilderness addition designated by section 203 shall not, of itself, preclude the activities or uses up to the boundary of the wilderness area or addition.</text></paragraph></subsection><subsection id="HA0A8C58C70F34C1999EDBB96A2E5B3D3"><enum>(f)</enum><header>Military activities</header><text>Nothing in this Act precludes—</text><paragraph id="H20D4E8FAA9E742E9A90E79AFB1691A9E"><enum>(1)</enum><text>low-level overflights of military aircraft over the wilderness areas or wilderness additions designated by section 203;</text></paragraph><paragraph id="HACA4F8410D024B17ADBBC049B2CA9C04"><enum>(2)</enum><text>the designation of new units of special airspace over the wilderness areas or wilderness additions designated by section 203; or</text></paragraph><paragraph id="H93770F00B24D459F80D94595FDCF8944"><enum>(3)</enum><text>the use or establishment of military flight training routes over wilderness areas or wilderness additions designated by section 203.</text></paragraph></subsection><subsection id="H6789BD9B8B9D4EFF8D46776A0D02444F"><enum>(g)</enum><header>Horses</header><text>Nothing in this title precludes horseback riding in, or the entry of recreational or commercial saddle or pack stock into, an area designated as a wilderness area or wilderness addition by section 203—</text><paragraph id="H0338C66E449A4A9596383680A9A122C9"><enum>(1)</enum><text>in accordance with section 4(d)(5) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(5)</external-xref>); and</text></paragraph><paragraph id="H60100F268F8C4B10B42DC5F5D22C1EA9"><enum>(2)</enum><text>subject to such terms and conditions as the Secretary determines to be necessary.</text></paragraph></subsection><subsection id="HE30780A6FDE8452FAD3FD1279D363934"><enum>(h)</enum><header>Law enforcement</header><text>Nothing in this title precludes any law enforcement or drug interdiction effort within the wilderness areas or wilderness additions designated by section 203 in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.).</text></subsection><subsection id="H54599BA837A745CD88BF7E3970FD96B0"><enum>(i)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the wilderness areas and additions designated by section 203 are withdrawn from—</text><paragraph id="H6A62CCEC93284A1EBB888112B584F1B6"><enum>(1)</enum><text>all forms of entry, appropriation, and disposal under the public land laws;</text></paragraph><paragraph id="H5ECBE57874B842E1A05DB8EE69AA6EF7"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph><paragraph id="H9EAD690437FB4D7087D04BAFFAAEA26F"><enum>(3)</enum><text>operation of the mineral materials and geothermal leasing laws.</text></paragraph></subsection><subsection id="H68F3ED59A194437D91D452424779F1FB"><enum>(j)</enum><header>Incorporation of acquired land and interests</header><text>Any land within the boundary of a wilderness area or addition that is acquired by the United States shall—</text><paragraph id="H78177125BB894CA6965F6E27EFEB3B80"><enum>(1)</enum><text>become part of the wilderness area or addition in which the land is located; and</text></paragraph><paragraph id="H0E1B6A3FD0B94838A6B52E02F75483EE"><enum>(2)</enum><text display-inline="yes-display-inline">be managed in accordance with this section, the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), and any other applicable laws (including regulations).</text></paragraph></subsection><subsection id="H2899B8CB50B945F8B82A73B3E4E81229"><enum>(k)</enum><header>Climatological data collection</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.) and subject to such terms and conditions as the Secretary may prescribe, the Secretary may authorize the installation and maintenance of hydrologic, meteorologic, or climatological collection devices in a wilderness area or addition if the Secretary determines that the facilities and access to the facilities is essential to a flood warning, flood control, or water reservoir operation activity.</text></subsection><subsection id="H7F92550EDC2244E98BCBE8655A7EB903"><enum>(l)</enum><header>Authorized events</header><text>The Secretary of Agriculture may authorize the Angeles Crest 100 competitive running event to continue in substantially the same manner and degree in which this event was operated and permitted in 2015 within additions to the Sheep Mountain Wilderness in section 203 of this Act and the Pleasant View Ridge Wilderness Area designated by section 1802 of the Omnibus Public Land Management Act of 2009, provided that the event is authorized and conducted in a manner compatible with the preservation of the areas as wilderness.</text></subsection></section><section id="H3C6DE3354566406C8A3149F6AB059FB7"><enum>205.</enum><header>Designation of Wild and Scenic Rivers</header><subsection id="HFB8CFE6C2D0C4FC1B3DB78BB84D3ACCA"><enum>(a)</enum><header>Designation</header><text>Section 3(a) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H04EEE1AF5DB844F2837B473D45F73E60" style="OLC"><paragraph id="HA192CD85A1DB4987A6DBBE5DF19FA2D9"><enum>(__)</enum><header>East Fork San Gabriel River, California</header><text>The following segments of the East Fork San Gabriel River, to be administered by the Secretary of Agriculture in the following classes:</text><subparagraph id="H98DADC6ED58C429EB6F4D14F3974AE54"><enum>(A)</enum><text>The 10-mile segment from the confluence of the Prairie Fork and Vincent Gulch to 100 yards upstream of the Heaton Flats trailhead and day use area, as a wild river.</text></subparagraph><subparagraph id="H1ECD441FB251455EBAECB741AEE0340C"><enum>(B)</enum><text>The 2.7-mile segment from 100 yards upstream of the Heaton Flats trailhead and day use area to 100 yards upstream of the confluence with Williams Canyon, as a recreational river.</text></subparagraph></paragraph><paragraph id="H1410C0814CC3452890857B3516772065"><enum>(__)</enum><header>North Fork San Gabriel River, California</header><text>The 4.3-mile segment of the North Fork San Gabriel River from the confluence with Cloudburst Canyon to 0.25 miles upstream of the confluence with the West Fork San Gabriel River, to be administered by the Secretary of Agriculture as a recreational river.</text></paragraph><paragraph id="HC257B96203164C27BAB460235F0EECA0"><enum>(__)</enum><header>West Fork San Gabriel River, California</header><text>The following segments of the West Fork San Gabriel River, to be administered by the Secretary of Agriculture in the following classes:</text><subparagraph id="HB3F325CC550F406D9BE0F81D66CB6DB2"><enum>(A)</enum><text>The 6.7-mile segment from 0.25 miles downstream of its source near Red Box Gap in sec. 14, T. 2 N., R. 12 W., to the confluence with the unnamed tributary 0.25 miles downstream of the power lines in sec. 22, T. 2 N., R. 11 W., as a recreational river.</text></subparagraph><subparagraph id="H0CFD2DA6633C4A7C8F0001D451EAAEFF"><enum>(B)</enum><text>The 1.6-mile segment of the West Fork from 0.25 miles downstream of the powerlines in sec. 22, T. 2 N., R. 11 W., to the confluence with Bobcat Canyon, as a wild river.</text></subparagraph></paragraph><paragraph id="H94F89395B1AB470681E4FFCFAED646EF"><enum>(__)</enum><header>Little Rock Creek, California</header><text>The following segments of Little Rock Creek and tributaries, to be administered by the Secretary of Agriculture in the following classes:</text><subparagraph id="H153761244DCD4B15AB7A12FE49536793"><enum>(A)</enum><text>The 10.3-mile segment from its source on Mt. Williamson in sec. 6, T. 3 N., R. 9 W., to 100 yards upstream of the confluence with the South Fork Little Rock Creek, as a wild river.</text></subparagraph><subparagraph id="H5B268B894C95409F8047D393B4A000B3"><enum>(B)</enum><text>The 6.6-mile segment from 100 yards upstream of the confluence with the South Fork Little Rock Creek to the confluence with Santiago Canyon, as a recreational river.</text></subparagraph><subparagraph id="H35E1A91FF08E4282801AF831DA08EEC8"><enum>(C)</enum><text>The 1-mile segment of Cooper Canyon Creek from 0.25 miles downstream of Highway 2 to 100 yards downstream of Cooper Canyon Campground, as a scenic river.</text></subparagraph><subparagraph id="HA7BFE911CED44E90AF1F1C7A42744549"><enum>(D)</enum><text>The 1.3-mile segment of Cooper Canyon Creek from 100 yards downstream of Cooper Canyon Campground to the confluence with Little Rock Creek, as a wild river.</text></subparagraph><subparagraph id="H86EDA4DEC6E24133AF51A1A332E1062D"><enum>(E)</enum><text>The 1-mile segment of Buckhorn Creek from 100 yards downstream of the Buckhorn Campground to its confluence with Cooper Canyon Creek, as a wild river.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H04501C05188F40F78ED9A61CD54A4D8C"><enum>(b)</enum><header>Water resource facilities; and water use</header><paragraph id="H50C1DBB109FB474783161DB81484A44E"><enum>(1)</enum><header>Water resource facilities</header><subparagraph id="H0ECDE6907CBC47A5988E2F9D628152C4"><enum>(A)</enum><header>Definition</header><text>In this section, the term <term>water resource facility</term> means irrigation and pumping facilities, dams and reservoirs, flood control facilities, water conservation works and facilities, including debris protection facilities, sediment placement sites, rain gauges and stream gauges, water quality facilities, recycled water facilities and water pumping, conveyance distribution systems, water storage tanks and reservoirs, and water treatment facilities, aqueducts, canals, ditches, pipelines, wells, hydropower projects, and transmission and other ancillary facilities, groundwater recharge facilities, water conservation, water filtration plants, and other water diversion, conservation, groundwater recharge, storage, and carriage structures.</text></subparagraph><subparagraph id="H9DF212BA1D33432898B9443AC9990657"><enum>(B)</enum><header>No effect on existing water resource facilities</header><text>Nothing in this section shall alter, modify, or affect—</text><clause id="H8D06A214ADEA47B5991072A55557A3AE"><enum>(i)</enum><text>the use, operation, maintenance, repair, construction, destruction, reconfiguration, expansion, relocation or replacement of a water resource facility downstream of a wild and scenic river segment designated by this section, provided that the physical structures of such facilities or reservoirs shall not be located within the river areas designated in this section; or</text></clause><clause id="HC404DC93ED7542AC87A80EED19E59DBA"><enum>(ii)</enum><text>access to a water resource facility downstream of a wild and scenic river segment designated by this section.</text></clause></subparagraph><subparagraph id="H40EE38CBAE734B9B814B6152DF41FCFC"><enum>(C)</enum><header>No effect on new water resource facilities</header><text>Nothing in this section shall preclude the establishment of a new water resource facilities (including instream sites, routes, and areas) downstream of a wild and scenic river segment.</text></subparagraph></paragraph><paragraph id="H333F333216F941A28AF2A9427B67503C"><enum>(2)</enum><header>Limitation</header><text>Any new reservation of water or new use of water pursuant to existing water rights held by the United States to advance the purposes of the National Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271</external-xref> et seq.) shall be for nonconsumptive instream use only within the segments designated by this section.</text></paragraph><paragraph id="H8B949D0FBD9F4D73A1F36CFA14F26857"><enum>(3)</enum><header>Existing law</header><text>Nothing in this section affects the implementation of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.).</text></paragraph></subsection></section><section id="HAD4DAC961B2A43D99E20A730DB875A81"><enum>206.</enum><header>Water rights</header><subsection id="HF7F3042EDE864FEEB1CD331F7BE73C62"><enum>(a)</enum><header>Statutory construction</header><text>Nothing in this Act, and no action to implement this Act—</text><paragraph id="H418A5910AAEA4DB594A2CA6ABE6D8053"><enum>(1)</enum><text>shall constitute an express or implied reservation of any water or water right, or authorizing an expansion of water use pursuant to existing water rights held by the United States, with respect to the land designated as a wilderness area or wilderness addition by section 203 or land adjacent to the wild and scenic river segments designated by the amendment made by section 205;</text></paragraph><paragraph id="HE3B3BC83DCC2449698A9BA37AC190562"><enum>(2)</enum><text>shall affect, alter, modify, or condition any water rights in the State in existence on the date of the enactment of this Act, including any water rights held by the United States;</text></paragraph><paragraph id="HD0D49EA2D1DF406A9ED46B35199E05C4"><enum>(3)</enum><text>shall be construed as establishing a precedent with regard to any future wilderness or wild and scenic river designations;</text></paragraph><paragraph id="H08361ADFEDA64DB5BDBE1490793D15FF"><enum>(4)</enum><text>shall affect, alter, or modify the interpretation of, or any designation, decision, adjudication or action made pursuant to, any other Act; or</text></paragraph><paragraph id="H4055ABFA130546DBAFFB923E157B0905"><enum>(5)</enum><text>shall be construed as limiting, altering, modifying, or amending any of the interstate compacts or equitable apportionment decrees that apportions water among or between the State and any other State.</text></paragraph></subsection><subsection id="H98C20BE29B5E47A58CAB87C3EADA5920"><enum>(b)</enum><header>State water law</header><text>The Secretary shall comply with applicable procedural and substantive requirements of the law of the State in order to obtain and hold any water rights not in existence on the date of the enactment of this Act with respect to the San Gabriel Mountains National Monument, wilderness areas and wilderness additions designated by section 203, and the wild and scenic rivers designated by amendment made by section 205.</text></subsection></section></title></legis-body></bill>
