R. 692</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210202">February 2, 2021</action-date><action-desc><sponsor name-id="C001109">Ms. Cheney</sponsor> (for herself, <cosponsor name-id="Y000033">Mr. Young</cosponsor>, <cosponsor name-id="N000189">Mr. Newhouse</cosponsor>, <cosponsor name-id="C001087">Mr. Crawford</cosponsor>, <cosponsor name-id="P000605">Mr. Perry</cosponsor>, <cosponsor name-id="B001248">Mr. Burgess</cosponsor>, <cosponsor name-id="E000298">Mr. Estes</cosponsor>, <cosponsor name-id="S001212">Mr. Stauber</cosponsor>, and <cosponsor name-id="J000299">Mr. Johnson of Louisiana</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Environmental Policy Act of 1969 to provide a rule to determine venue for a proceeding for judicial review of certain agency actions.</official-title></form><legis-body id="H55E10615A3564B468F8A7D66CF00201E" style="OLC"><section id="H55EF2FD1252C4BD4A1B1ABA4BB1A68EB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Recognition of Local Interests in NEPA Decision Making</short-title></quote>.</text></section><section id="H9C89A0EA48C545C0830DF8A7BD08E9BF"><enum>2.</enum><header>Venue for judicial review</header><text display-inline="no-display-inline">Title I of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H7EED4A3F682644119E44FB82E2B6BD84" display-inline="no-display-inline"><section id="H173B071D79A144D1BEDEC4C7302FFAC1"><enum>106.</enum><header>Venue for judicial review</header><subsection id="HD6798E0F74184F7E9A21956DAB65FE36"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A proceeding for judicial review of an agency action when there is an alleged failure to fulfill the requirements of section 102(2)(C) shall be brought exclusively in any of the following:</text><paragraph id="HD1A155B0929845D5A1F8DB1B7A8B48DE"><enum>(1)</enum><text display-inline="yes-display-inline">A United States district court for a district in which the authorized activity is proposed to be carried out.</text></paragraph><paragraph id="H280824192AB54942813348AB34A955ED"><enum>(2)</enum><text display-inline="yes-display-inline">The United States district court for the District of Columbia.</text></paragraph></subsection><subsection id="H9E1EB247D7ED4A5A9674FB0E6EACDC63"><enum>(b)</enum><header>Agency action defined</header><text>The term <term>agency action</term> has the meaning given such term in section 551 of title 5, United States Code.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></section></legis-body></bill>
