<section id="H9EAE1A21F3014445AA42E3486534A67D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Opportunity through Pre-Apprenticeships Act</short-title></quote>. </text></section> <section id="H89CBF8EF82E94026BC08B7FD6553B623"><enum>2.</enum><header>Pre-apprenticeship program standards</header> <subsection id="HBAB1EB4BD7E148D3AEDADA26A7F6B615"><enum>(a)</enum><header>In general</header><text>In this Act, a <quote>pre-apprenticeship program</quote> means a program—</text>
<paragraph id="H1E33326AC323420ABC6E766EDDAB7CB3"><enum>(1)</enum><text>designed to—</text> <subparagraph id="H981465EBAE844844A582191A397C1FE1"><enum>(A)</enum><text>assist individuals who do not meet minimum qualifications for an apprenticeship program; and</text></subparagraph>
<subparagraph id="HA786792DC09748D8B3C44776CFA8AB7E"><enum>(B)</enum><text> prepare such individuals to enter and succeed in such an apprenticeship program, including by providing the skills and competency attainment needed to enter the apprenticeship program; and</text></subparagraph></paragraph> <paragraph id="HB545F30E94D04BBDAE10816500D7885C"><enum>(2)</enum><text>that meets the requirements described in subsections (b) and (c).</text></paragraph></subsection>
<subsection id="H9AC7238945734E49AD5BC2EB9BEBB125"><enum>(b)</enum><header>Requirements</header><text>The program—</text> <paragraph id="HF82FE86288E043598AABBBEBDB70AE80"><enum>(1)</enum><text>is carried out in partnership with at least one sponsor of an apprenticeship program;</text></paragraph>
<paragraph id="H7512E8F1A0D84285B4E352C8E2D6DB31"><enum>(2)</enum><text>demonstrates the existence of an active advisory partnership with an industry or sector partnership to inform the training and education services necessary for a pre-apprenticeship program; </text></paragraph> <paragraph id="H89677EBB91124945A2936104CB6F7945"><enum>(3)</enum><text>demonstrates evidence of sufficient openings in an apprenticeship program at the completion of a pre-apprenticeship program to support a transition from a pre-apprenticeship to an apprenticeship;</text></paragraph>
<paragraph id="H1705AAED25C54D2B9081C3C500AD3CBF"><enum>(4)</enum><text display-inline="yes-display-inline">has strategies in place with apprenticeship programs that will increase employment opportunities for individuals with barriers to employment and create a diverse talent pipeline, such that, upon completion of a pre-apprenticeship program, they will meet the entry requirements for success in such programs;</text></paragraph> <paragraph id="HCD2E8701F7194ECABD89F3F77A9684F8"><enum>(5)</enum><text>has plans in place, either directly or through partnerships, to provide supportive services to pre-apprentices, to support the recruitment, retention, and completion of the program; </text></paragraph>
<paragraph id="H32B95EEC18AE4ADDA1C39FA16EE9C8EE"><enum>(6)</enum><text display-inline="yes-display-inline">provides hands-on training to participants, when possible, that does not supplant the work of a full-time, paid employee but accurately simulates the occupational conditions of a partnering apprenticeship program, with proper supervision and safety protocols; and</text></paragraph> <paragraph id="HC21DC925DE3B4F2181D2988AF91AD437"><enum>(7)</enum><text display-inline="yes-display-inline">provides a certificate of completion by the State apprenticeship agency, awarded to each individual who completes the program requirements set forth by the plan sponsor.</text></paragraph></subsection>
<subsection id="H49C2CA0B263446848FCAAD791DBE5B39"><enum>(c)</enum><header>Written plan requirements</header><text>The program includes a written plan developed by the sponsor that—</text> <paragraph id="HBE47E98BD5D9431E91AE1C17A4200056"><enum>(1)</enum><text>provides for work-based learning in which an industry or sector partnership and a related instruction provider collaborate to provide training that will introduce participants to the skills, competencies, and materials used in one or more apprenticeable occupations;</text></paragraph>
<paragraph id="H39AF7FE80C90452B9FC192CFF294D100"><enum>(2)</enum><text display-inline="yes-display-inline">is based on and aligned with national, State, regional, or local industry standards for high-skill, high-wage, or in-demand industry sectors or occupations and the requirements of the related apprenticeship program;</text></paragraph> <paragraph id="H2A63FCEB6A654682B6A703769ED07D5F"><enum>(3)</enum><text>ensures all individuals have an equal opportunity to participate in the program, as required by section 30 of title 29, Code of Federal Regulations (as in effect on the date of enactment of this Act), and that the program will provide adequate and safe equipment, environments, and facilities for training and supervision, free from discrimination (including harassment and retaliation);</text></paragraph>
<paragraph id="H7DA495AF46B64743881394E19A25C315"><enum>(4)</enum><text>ensures the program has remote instruction contingency plans, if feasible, including providing educational technology that aids in regular and substantive interactions between pre-apprentice and classroom instructor; </text></paragraph> <paragraph id="H0FDBAA16CB514EA8A9E49DA9B9B1875A"><enum>(5)</enum><text display-inline="yes-display-inline">provides training and professional development for instructors and staff to use technology and services, including for remote instruction;</text></paragraph>
<paragraph id="HC33E758022654F62A9CE6A534ECF9217"><enum>(6)</enum><text>to the extent appropriate and practicable includes enabling an individual to attain a secondary school diploma or its recognized equivalent, and at least 1 recognized postsecondary credential; and</text></paragraph> <paragraph id="H24ED25EF30D247049E9604C38448227B"><enum>(7)</enum><text display-inline="yes-display-inline">includes activities designed for career exposure, career planning, and career awareness.</text></paragraph></subsection></section>
<section id="HAD51F162817A407682F9BA3463581207"><enum>3.</enum><header>Evaluation</header>
<subsection id="HA9C3ECF03753427D8FF4FF25B31188C3"><enum>(a)</enum><header>Performance data collection</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary of Labor shall collect data on—</text> <paragraph id="H2AF4EB8F4CD94148BD5E6422532EE547"><enum>(1)</enum><text display-inline="yes-display-inline">the performance of each pre-apprenticeship program using the disaggregated indicators of performance in section 116(b)(2)(A)(i) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141(b)(2)(A)(i)</external-xref>), including participants who are people of color, women, veterans, those who have been impacted by the youth or adult criminal justice system, and individuals with barriers to employment between the ages of 16 and 24; </text></paragraph>
<paragraph id="H13F9B208B5004493B8E0C32A15647C7F"><enum>(2)</enum><text>how each such program spends resources; and</text></paragraph> <paragraph id="H5770619FB4BF4235918D377EC3CD7B61"><enum>(3)</enum><text>the diversity and equal opportunity in apprenticeships programs.</text></paragraph></subsection>
<subsection id="HB6BE827BE66241819DD96DF1F934A053"><enum>(b)</enum><header>Research and plan for expansion of participation of certain populations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Labor, acting through the Administrator of the Office of Apprenticeship, shall use the collected data to conduct research in State labor markets, in partnership with State apprenticeship agencies, to create a plan, on the basis of such research, to expand participation in registered pre-apprenticeship programs by nontraditional populations or individuals with barriers to employment such as youth, women, people of color, long-term unemployed, individuals with disabilities, individuals with substance abuse issues, individuals impacted by the criminal justice system, and veterans.</text></subsection></section> <section id="HE6254A55D6954DB298BAF7AA5D515B94" display-inline="no-display-inline"><enum>4.</enum><header>Grants</header> <subsection id="HDD6F9A9BF19A418CB3BA38FF02F1E6C7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From the amounts appropriated to carry out this section, the Secretary of Labor shall award grants, on a competitive basis, to eligible entities.</text></subsection>
<subsection id="H9E02551E83B8482AA296280977CF3606"><enum>(b)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to eligible entities that serve a high number or high percentage of individuals who are from nontraditional apprenticeship populations (with priority given to women, people of color, veterans, those who have been impacted by the juvenile or adult criminal justice system, and individuals with barriers to employment between the ages of 16 and 24).</text></subsection> <subsection id="HE8B467D32A92474695704BAAB4956072"><enum>(c)</enum><header>Application</header><text>To receive a grant under this section, an eligible entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary determines may be necessary.</text></subsection>
<subsection id="H836D165B8D844D2CBD1A8D7CAFC95C4B"><enum>(d)</enum><header>Limitation on use of funds</header><text display-inline="yes-display-inline">No less than 5 percent of the funds awarded under this section shall be used to provide direct financial assistance to pre-apprentices to support financial needs to enter, remain enrolled in, and complete the apprenticeship program including, related costs of training, supplies, food and nutrition, housing, transportation, child care, mental health and substance abuse services, or other targeted costs deemed allowable by the Secretary.</text></subsection> <subsection id="H4833CB13A77F4F8BADAA7AEE8C7F0E55"><enum>(e)</enum><header>Eligible entities defined</header><text display-inline="yes-display-inline">In this section, an <quote>eligible entity</quote> includes—</text>
<paragraph id="H412BC18D58F2403D9F077D8E7FCA949F"><enum>(1)</enum><text display-inline="yes-display-inline">a community-based organization;</text></paragraph> <paragraph id="H758B6A40E4404C9E94858ECB488CEA0A"><enum>(2)</enum><text>a pre-apprenticeship sponsor;</text></paragraph>
<paragraph id="HF1759A13E7B048D79D379CB56D8A9F72"><enum>(3)</enum><text>an employer for an in-demand industry sector or occupation;</text></paragraph> <paragraph id="H0938F03076F44456B119A5328EFC9B5C"><enum>(4)</enum><text display-inline="yes-display-inline">a joint labor-management training program; or</text></paragraph>
<paragraph id="HBDD10E3F453B490B968E97AF229DAF8B"><enum>(5)</enum><text display-inline="yes-display-inline">a partnership among community-based organizations, public education entities, and apprenticeships.</text></paragraph></subsection> <subsection id="H3293697D026E48A289CF2DD6AA0A408F"><enum>(f)</enum><header>Uses of funds</header><text>A grant awarded under this section to an eligible entity may be used to carry out one or more of the following:</text>
<paragraph id="H506FBA0407984A51BC95B4FC6B4183D9"><enum>(1)</enum><text display-inline="yes-display-inline">To provide technical assistance to pre-apprentices to help navigate supportive services and other Federal assistance programs (such as the supplemental nutrition assistance program under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> et seq.)) to enter and remain enrolled in apprenticeship programs.</text></paragraph> <paragraph id="H5BAB5818AF724D389A1863FDF3E4D51C"><enum>(2)</enum><text>To conduct and improve outreach to nontraditional apprenticeship population.</text></paragraph>
<paragraph id="H8BF9E5FA9BBB46A4A9B47C557C9E63F1"><enum>(3)</enum><text display-inline="yes-display-inline">To participate in pre-apprenticeship programs.</text></paragraph> <paragraph id="H7F63C7ADD70545009505C00400AE6E4D"><enum>(4)</enum><text display-inline="yes-display-inline">To facilitate a successful transition between pre-apprenticeship programs and apprenticeship programs.</text></paragraph></subsection></section>
<section id="H4DBDEF80599A4F5E840A26047FCD259E"><enum>5.</enum><header>Additional definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H5F76AC0BDA4A48C9992DEC3E1E3D7E77"><enum>(1)</enum><header>Apprenticeship program</header><text display-inline="yes-display-inline">The term <term>apprenticeship program</term> means an apprenticeship program registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50</external-xref> et seq.), including any requirement, standard, or rule promulgated under such Act, as such requirement, standard, or rule was in effect on December 30, 2019.</text></paragraph>
<paragraph id="HA47E50B507E1489AAB96032802DCB9C6"><enum>(2)</enum><header>Nontraditional Apprenticeship Population</header><text>The term <term>nontraditional apprenticeship population</term> means a group of individuals (such as a group of individuals from the same gender or race) the members of which comprise fewer than 25 percent of the individuals participating in a program under the national apprenticeship system.</text></paragraph> <paragraph id="H03B33E1A165C4C5E8230E57C32447583"><enum>(3)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph>
<paragraph id="H933C589E785449A88EA62D27A4EFA7C2"><enum>(4)</enum><header>WIOA terms</header><text>The terms <term>community-based organization</term>, <term>in-demand industry sectors or occupations</term>, <term>individual with a barrier to employment</term>, <term>recognized postsecondary credential</term>, and <term>supportive services</term> have the meanings given the terms in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph></section> </legis-body> </bill>
