<section id="HC8808302347C" section-type="section-one"><enum>1.</enum><header>Suppression of wildfires</header> 
<subsection id="H6CFD3D100DC445BB9DBDE3F40FA9F41F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture, acting through the Chief of the Forest Service—</text> <paragraph id="H1913539B486F44649ADAFB63B7623542"><enum>(1)</enum><text>shall—</text> 
<subparagraph id="H154C53C221584A9BB205031DDF93197D"><enum>(A)</enum><text display-inline="yes-display-inline">to the maximum extent practicable—</text> <clause id="HBDE829282B7B4C7C83F6C5F34AECA00D"><enum>(i)</enum><text display-inline="yes-display-inline">use all available resources to carry out wildfire suppression with the purpose of extinguishing wildfires detected on National Forest System lands not later than 24 hours after such a wildfire is detected; and</text></clause> 
<clause id="H262ED70CB526457D9DC7E1E1294E6804"><enum>(ii)</enum><text>immediately suppress any prescribed fire that exceeds prescription; </text></clause></subparagraph> <subparagraph id="H97C2FD4FE5404284B7409D0D3B1BB240"><enum>(B)</enum><text>not inhibit the suppression efforts of State or local firefighting agencies that are authorized to respond to wildfire on National Forest System lands;</text></subparagraph> </paragraph> 
<paragraph id="H9CCEE7F8A04D4EBDB484FAFC0DBAC3C9"><enum>(2)</enum><text display-inline="yes-display-inline">may only use fire as a resource management tool if the fire is a prescribed fire that complies with applicable law and regulations;</text></paragraph> <paragraph id="H7724978B780E43A9AA57ECD0660276F2"><enum>(3)</enum><text>may only initiate a backfire or burnout during a wildfire by order of the responsible incident commander; and</text> </paragraph> 
<paragraph id="H130F3A35A9B7431F9269C96BFF7C3F66"><enum>(4)</enum><text>shall control any such initiated backfire or burnout until extinguished.</text></paragraph></subsection> <subsection id="HC81BFA6C2AFF4DC390B2A25CE66DFB7F" commented="no"><enum>(b)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any person aggrieved by a violation of paragraph (3) or (4) of subsection (a) may bring a civil action against the United States in the appropriate Federal district court for actual damages.</text> </subsection></section>
