and</text></paragraph><paragraph id="H1231D508EEED46E19D46EF17754BE02F"><enum>(2)</enum><text>in subsection (b) by striking <quote>fiscal years 2020 and 2021</quote> and inserting <quote>fiscal years 2022 and 2023</quote>. </text></paragraph></section><section id="H38700943AB0B4F8DBF47B6A31E9963C0"><enum>103.</enum><header>Shoreside infrastructure and facilities</header><subsection id="H3396815286BE434F80420EAC17D79D7B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Of the amounts authorized to be appropriated under section 4902(2)(A) of title 14, United States Code, for each of fiscal years 2022 and 2023, up to $585,000,000 shall be authorized for the Secretary of the department in which the Coast Guard is operating to fund the acquisition, construction, rebuilding, or improvement of Coast Guard shoreside infrastructure and facilities necessary to support Coast Guard operations and readiness.</text></subsection><subsection id="H628FF6FB1C1543C2B241E3F924FF2253"><enum>(b)</enum><header>Baltimore Coast Guard Yard</header><text>Of the amounts set aside under subsection (a), up to $175,000,000 shall be authorized to improve facilities at the Coast Guard Yard in Baltimore, Maryland, including improvements to piers and wharves, dry dock, capital equipment utilities, or dredging necessary to facilitate access to such Yard.</text></subsection><subsection id="H82102369769E436481EA7543B06CE12E" commented="no"><enum>(c)</enum><header>Training center Cape May</header><text display-inline="yes-display-inline">Of the amounts set aside under subsection (a), up to $60,000,000 shall be authorized to fund Phase I, in fiscal year 2022, and Phase II, in fiscal year 2023, for the recapitalization of the barracks at the United States Coast Guard Training Center Cape May in Cape May, New Jersey.</text></subsection><subsection id="HAF00B1FBBC314F859D6F338018AEDB4B"><enum>(d)</enum><header>Mitigation of hazard risks</header><text display-inline="yes-display-inline">In carrying out projects with funds authorized under this section, the Coast Guard shall mitigate, to the greatest extent practicable, natural hazard risks identified in any Shore Infrastructure Vulnerability Assessment for Phase I related to such projects.</text></subsection></section><section id="HA17B0366BAA64C48B7DB09C46C84EF59"><enum>104.</enum><header>Availability of amounts for acquisition of additional cutters</header><subsection id="HA2BE443B9FBD4C838A1448740A4DFA3F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Of the amounts authorized to be appropriated under—</text><paragraph id="H61B93655399840238E35715778E14A8F"><enum>(1)</enum><text>section 4902(2)(A)(i) of title 14, United States Code, as amended by section 101 of this title, for fiscal year 2022—</text><subparagraph id="H999340C622EE42E1960FEEBEFFFA94E1"><enum>(A)</enum><text>$300,000,000 shall be authorized for the acquisition of a twelfth National Security Cutter; and</text></subparagraph><subparagraph id="HC60F9CDEC165474590F35F28589FCD3F"><enum>(B)</enum><text display-inline="yes-display-inline">$210,000,000 shall be authorized for the acquisition of 3 Fast Response Cutters; and</text></subparagraph></paragraph><paragraph id="H96EACAEF99E74D599A378991B8358F34"><enum>(2)</enum><text>section 4902(2)(A)(ii) of title 14, United States Code, as amended by section 101 of this title, for fiscal year 2023—</text><subparagraph id="HC91680E5EAC049239248EB8BE7408A7E"><enum>(A)</enum><text display-inline="yes-display-inline">$300,000,000 shall be authorized for the acquisition of a twelfth National Security Cutter; and</text></subparagraph><subparagraph id="H64E13A378BA44F7E99D11AEEF3372F49"><enum>(B)</enum><text display-inline="yes-display-inline">$210,000,000 shall be authorized for the acquisition of 3 Fast Response Cutters.</text></subparagraph></paragraph></subsection><subsection id="H92CB8C27B022424EA1DBE31393897C81"><enum>(b)</enum><header>Treatment of acquired cutter</header><text display-inline="yes-display-inline">Any cutter acquired using amounts authorized under subsection (a) shall be in addition to the National Security Cutters and Fast Response Cutters approved under the existing acquisition baseline in the program of record for the National Security Cutter and Fast Response Cutter.</text></subsection><subsection id="H2D181E1C37E942A88A629DF914508EF4"><enum>(c)</enum><header>Great Lakes icebreaker acquisition</header><text>Of the amounts authorized to be appropriated under section 4902(2)(A)(ii) of title 14, United States Code—</text><paragraph id="HAF63B13686504C16A4B7EC01AF07C634" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">for fiscal year 2022, $350,000,000 shall be authorized for the acquisition of a Great Lakes icebreaker at least as capable as Coast Guard Cutter Mackinaw (WLBB–30); and</text></paragraph><paragraph id="HF47B0392ABB143F6B0B32474BA46FCCB" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">for fiscal year 2023, $20,000,000 shall be authorized for the design and selection of icebreaking cutters for operation in the Great Lakes, the Northeastern United States, and the Arctic, as appropriate, that are at least as capable as the Coast Guard 140-foot icebreaking tugs.</text></paragraph></subsection></section></title><title id="H1758AA68B25C4ECAA85F1CEBDBC0E862"><enum>II</enum><header>Coast Guard</header><subtitle id="H1C6C5747D37B4E578073A1D012F0261B"><enum>A</enum><header>Military Personnel Matters</header><section id="H810697E9844643CDB2D0B9DCE6549A54" section-type="subsequent-section"><enum>201.</enum><header>Authorized strength</header><text display-inline="no-display-inline">Section 3702 of title 14, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H8714C65B2DF1430A8DBFF9CB050FB72F" display-inline="no-display-inline"><subsection id="HB809BA370D9644BBAF0CFEA35F5E5476"><enum>(c)</enum><text display-inline="yes-display-inline">The Secretary may vary the authorized end strength of the Coast Guard Selected Reserves for a fiscal year by a number equal to not more than 3 percent of such end strength upon a determination by the Secretary that varying such authorized end strength is in the national interest.</text></subsection><subsection id="H46A7EDD3129043F98CE950FF8BDBB6CE"><enum>(d)</enum><text display-inline="yes-display-inline">The Commandant may increase the authorized end strength of the Coast Guard Selected Reserves by a number equal to not more than 2 percent of such authorized end strength upon a determination by the Commandant that such increase would enhance manning and readiness in essential units or in critical specialties or ratings.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HBD4E5EE45B754014A924E19E06361243" commented="no"><enum>202.</enum><header>Continuation of officers with certain critical skills on active duty</header><subsection id="H172E69A27974495D8DA579B135C40A10" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/21">Chapter 21</external-xref> of title 14, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/14/2165">section 2165</external-xref> the following:</text><quoted-block style="USC" id="HDC4E2AEB4BEC4F7AA804033B95CC6EB9" display-inline="no-display-inline"><section id="HE0D741E53D4241B8A8A0CEC616C89809" commented="no"><enum>2166.</enum><header>Continuation on active duty; Coast Guard officers with certain critical skills</header><subsection id="HAC5BD0A660AC4F77977508826E21AC4D" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Commandant may authorize an officer in a grade above grade O–2 to remain on active duty after the date otherwise provided for the retirement of such officer in section 2154 of this title, if the officer possesses a critical skill, or specialty, or is in a career field designated pursuant to subsection (b).</text></subsection><subsection id="H3201C9256F4C436FAD17A8E8785D9FCB" commented="no"><enum>(b)</enum><header>Critical skills, specialty, or career field</header><text>The Commandant shall designate any critical skill, specialty, or career field eligible for continuation on active duty as provided in subsection (a). </text></subsection><subsection id="H816E3EED7F5040C49E1B51379C22B8FF" commented="no"><enum>(c)</enum><header>Duration of continuation</header><text display-inline="yes-display-inline">An officer continued on active duty pursuant to this section shall, if not earlier retired, be retired on the first day of the month after the month in which the officer completes 40 years of active service.</text></subsection><subsection id="H9F2FB9E880E2462F9EF6C0BCA7D24397" commented="no"><enum>(d)</enum><header>Policy</header><text display-inline="yes-display-inline">The Commandant shall carry out this section by prescribing policy which shall specify the criteria to be used in designating any critical skill, specialty, or career field for purposes of subsection (b).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA2A526E9BA0242839779216F2F997487" commented="no"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/21">chapter 21</external-xref> of title 14, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/14/2165">section 2165</external-xref> the following: </text><quoted-block style="USC" id="H401B2AB4A9A344D48F02370F95757D7E" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">2166. Officers not on active duty promotion list.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H17DAF6383A9B422F8D242E98789D55D0" section-type="subsequent-section" commented="no"><enum>204.</enum><header>Coast Guard behavioral health policy</header><subsection id="HED318C4718BB4350AD56D4594A6C13D2" commented="no"><enum>(a)</enum><header>Interim behavioral health policy</header><text>Not later than 60 days after the date of enactment of this Act, the Commandant of the Coast Guard shall establish an interim behavioral health policy for members of the Coast Guard equivalent to the policy described in section 5.28 (relating to behavioral health) of Department of Defense Instruction 6130.03, volume 2, <quote>Medical Standards for Military Service: Retention</quote>.</text></subsection><subsection id="HC05828C0403C44CE9E7FB7A9DE751170" commented="no"><enum>(b)</enum><header>Termination</header><text display-inline="yes-display-inline">The interim policy established under subsection (a) shall remain in effect until the date on which the Commandant issues a permanent behavior health policy for members of the Coast Guard which is, to the extent practicable, equivalent to such section 5.28.</text></subsection></section><section id="HE67310C6C77849B489977C7A70DBC8A4"><enum>205.</enum><header>Improving representation of women and of racial and ethnic minorities among Coast Guard active-duty members</header><subsection id="H07569A5B8A794E89883900C3C420AB68"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Commandant of the Coast Guard shall—</text><paragraph id="H0ACCAE5C464249318941A51BFE660E87"><enum>(1)</enum><text>determine which recommendations in the RAND representation report can practicably be implemented to promote improved representation in the Coast Guard of—</text><subparagraph id="H115F66943F5040E0BF87A386CA553D7A" commented="no"><enum>(A)</enum><text>women; and</text></subparagraph><subparagraph id="H38F7BE4CBCD64399938B917DDB5FCC0E" commented="no"><enum>(B)</enum><text>racial and ethnic minorities; and</text></subparagraph></paragraph><paragraph id="H3100C53F0E294596AFD6BEE231C938E5"><enum>(2)</enum><text>submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the actions the Commandant has taken, or plans to take, to implement such recommendations.</text></paragraph></subsection><subsection id="HEA59433E68464210AF4934ED81F89874"><enum>(b)</enum><header>Curriculum and training</header><text>The Commandant shall update, to reflect actions described under subsection (a)(2), the curriculum and training materials used at—</text><paragraph id="HDA92BDA81E95414C8F2A6A5E55873725"><enum>(1)</enum><text>officer accession points, including the Coast Guard Academy and the Leadership Development Center;</text></paragraph><paragraph id="H008F2BE639344A71B7AB5122C33EFDC5"><enum>(2)</enum><text>enlisted member accession at the United States Coast Guard Training Center Cape May in Cape May, New Jersey; and</text></paragraph><paragraph id="HE20BF3BE0004412080719D5062DF3C17"><enum>(3)</enum><text>the officer, enlisted member, and civilian leadership courses managed by the Leadership Development Center.</text></paragraph></subsection><subsection id="H8BE3F397A1B34032B485907E9DF0026A"><enum>(c)</enum><header>Definition</header><text>In this section, the term <term>RAND representation report</term> means the report titled <quote>Improving the Representation of Women and Racial/Ethnic Minorities Among U.S. Coast Guard Active-Duty Members</quote> issued by the Homeland Security Operational Analysis Center of the RAND Corporation on August 11, 2021.</text></subsection></section></subtitle><subtitle id="H24EB15BB3B2048BD90B910E0801C2807"><enum>B</enum><header>Operational Matters</header><section id="HE4BDBC8BC84649D4992337B756B72EDC" display-inline="no-display-inline"><enum>206.</enum><header>Pilot project for enhancing Coast Guard cutter readiness through condition-based maintenance</header><subsection id="HDFD164881B3541AFB6711E7999A8DCBE"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Commandant of the Coast Guard shall conduct a pilot project to enhance cutter readiness and reduce lost patrol days through the deployment of commercially developed condition-based program standards for cutter maintenance, in accordance with the criteria set forth in subsection (b). </text></subsection><subsection id="H2E91EBFDCAAF4966BF4C673EAE501077"><enum>(b)</enum><header>Criteria for condition-Based maintenance evaluation</header><text>In conducting the pilot project under subsection (a), the Commandant shall—</text><paragraph id="H74306C7941B140A1A431F23E338264B0" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">select at least 1 legacy cutter asset and 1 class of cutters under construction with respect to which the application of the pilot project would enhance readiness; </text></paragraph><paragraph id="H960F9AFF30EF4417B1AC475B45EF6C6B" commented="no"><enum>(2)</enum><text>use commercially developed condition-based program standards similar to those applicable to privately owned and operated vessels or vessels owned or operated by other Federal agencies (such as those currently operating under the direction of Military Sealift Command); </text></paragraph><paragraph id="HA81D262F3FAE4FE88AC9EA2B0325B0D9"><enum>(3)</enum><text>create and model a full ship digital twin for the cutters selected under paragraph (1);</text></paragraph><paragraph id="H557D4AB2DFE74F52BC98A74840C027F4"><enum>(4)</enum><text>install or modify instrumentation capable of producing full hull, mechanical, and electrical data necessary to analyze cutter operational conditions with active maintenance alerts; and</text></paragraph><paragraph id="H68C0CE724C3C4BC8A4847554606F5565"><enum>(5)</enum><text>deploy artificial intelligence, prognostic-based integrated maintenance planning modeled after standards described in paragraph (2).</text></paragraph></subsection><subsection id="HAF46CE43DC6740999A2837C0AD6491AA"><enum>(c)</enum><header>Report to Congress</header><text>The Commandant shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives—</text><paragraph id="HAFCF2BF246B24F4198B1D495D1790AD0"><enum>(1)</enum><text>an interim report not later than 6 months after the date of enactment of this Act on the progress in carrying out the pilot project described in subsection (a); and</text></paragraph><paragraph id="H5ABBC57943E44A95B8E05D79B7E638B7"><enum>(2)</enum><text display-inline="yes-display-inline">a final report not later than 2 years after the date of enactment of this Act on the results of the pilot project described in subsection (a) that includes—</text><subparagraph id="HB29FAC61AE5F4A33B7939ED5B7B4E05E"><enum>(A)</enum><text>options to integrate commercially developed condition-based program standards for cutter maintenance to Coast Guard cutters; and</text></subparagraph><subparagraph id="H8EDC85EEA28F43A8A940B398064AE70D"><enum>(B)</enum><text>plans to deploy commercially developed condition-based program standards for cutter maintenance to Coast Guard cutters.</text></subparagraph></paragraph></subsection></section><section id="HC4092C4DDDF34E2CBC790B117231D242" section-type="subsequent-section" display-inline="no-display-inline"><enum>207.</enum><header>Unmanned systems strategy</header><subsection id="H91AACF2F2329434CA5DD09A1A7CA70B6"><enum>(a)</enum><header>Submission to Congress</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a detailed description of the strategy of the Coast Guard to implement unmanned systems across mission areas, including—</text><paragraph id="HB99FDE09D6DC4314811044435D79C902"><enum>(1)</enum><text display-inline="yes-display-inline">the steps taken to implement actions recommended in the consensus study report of the National Academies of Sciences, Engineering, and Medicine published on November 12, 2020, titled <quote>Leveraging Unmanned Systems for Coast Guard Missions: A Strategic Imperative</quote>;</text></paragraph><paragraph id="HD8A26BCBCA6040C5A00EC0520D7F38CF"><enum>(2)</enum><text display-inline="yes-display-inline">the strategic goals and acquisition strategies for proposed uses and procurements of unmanned systems;</text></paragraph><paragraph id="H969E1685E91544A88BF41148A19B5B18"><enum>(3)</enum><text display-inline="yes-display-inline">a strategy to sustain competition and innovation for procurement of unmanned systems and services for the Coast Guard, including defining opportunities for new and existing technologies; and</text></paragraph><paragraph id="HDA5E5BA09D6D40FCB1BA29BC3E7E6A9F"><enum>(4)</enum><text display-inline="yes-display-inline">an estimate of the timeline, costs, staff resources, technology, or other resources necessary to accomplish the strategy.</text></paragraph></subsection><subsection id="HA36263E4CC594A789B9D89454EEDBF40" commented="no"><enum>(b)</enum><header>Pilot project</header><paragraph id="H84DBF6C98634421887BB69225A6A29A5" commented="no"><enum>(1)</enum><header>Autonomous control and computer vision technology</header><text>The Commandant of the Coast Guard, acting through the Blue Technology Center of Expertise, shall conduct a pilot project to retrofit an existing Coast Guard small boat with—</text><subparagraph id="H92643B991F1C4DEA9DC500805C53D770" commented="no"><enum>(A)</enum><text>commercially available autonomous control and computer vision technology; and</text></subparagraph><subparagraph id="H4D0432BA348A428A91C93668AAC0F4F2" commented="no"><enum>(B)</enum><text>such sensors and methods of communication as are necessary to demonstrate the ability of such control and technology to assist in conducting search and rescue, surveillance, and interdiction missions. </text></subparagraph></paragraph><paragraph id="H55B1F047E0E54C78BF836F3B82636732" commented="no"><enum>(2)</enum><header>Collection of data</header><text display-inline="yes-display-inline">The pilot project under paragraph (1) shall evaluate commercially available products in the field and collect operational data to inform future requirements. </text></paragraph><paragraph id="H8C2F4F34AFFB4716B536F2A53468B74D" commented="no"><enum>(3)</enum><header>Briefing</header><text>Not later than 6 months after completing the pilot project required under paragraph (1), the Commandant shall brief the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on the evaluation of the data derived from the project. </text></paragraph></subsection></section><section id="H67A602AA7D6A47138B8B6C2479301DDA" section-type="subsequent-section"><enum>208.</enum><header>Budgeting of Coast Guard relating to certain operations</header><subsection id="HB8F656B48DD741009452FCC1C68A81D8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/51">Chapter 51</external-xref> of title 14, United States Code, is further amended by adding at the end the following: </text><quoted-block style="USC" id="H35FC3A8A1ED1496995E3DC5819B24BE2" display-inline="no-display-inline"><section id="H142C2933A9424D0BBC1557B4AEDDCF4B"><enum>5114.</enum><header>Expenses of performing and executing defense readiness mission activities</header><text display-inline="no-display-inline">The Commandant of the Coast Guard shall include in the annual budget submission of the President under section 1105(a) of title 31, a dedicated budget line item that adequately represents a calculation of the annual costs and expenditures of performing and executing all defense readiness mission activities, including—</text><paragraph id="H1FC1A932460F4F159D54041F83DEC48E"><enum>(1)</enum><text>all expenses related to the Coast Guard’s coordination, training, and execution of defense readiness mission activities in the Coast Guard’s capacity as an Armed Force (as such term is defined in section 101 of title 10) in support of Department of Defense national security operations and activities or for any other military department or defense agency (as such terms are defined in such section);</text></paragraph><paragraph id="H98AB462815754D2F84D07F04D1A6F903"><enum>(2)</enum><text>costs associated with Coast Guard detachments assigned in support of the Coast Guard’s defense readiness mission; and </text></paragraph><paragraph id="H9F44C3CB89B24DC0B577AE95868824C8"><enum>(3)</enum><text>any other expenses, costs, or matters the Commandant determines appropriate or otherwise of interest to Congress.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF7BCA267C5B4496ABC8879A167735D70"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/51">chapter 51</external-xref> of title 14, United States Code, is further amended by adding at the end the following: </text><quoted-block style="USC" id="H7429BB1EEFFB4B569FA42B160DC8EE8F" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">5114. Expenses of performing and executing defense readiness mission activities.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H60EBCFAE65E54EA6B2E76D49BF7B8CC7" commented="no"><enum>209.</enum><header>Report on San Diego maritime domain awareness</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report containing—</text><paragraph id="H697530AAD16F4466B84AB0FB86933A07" commented="no"><enum>(1)</enum><text>an overview of the maritime domain awareness in the area of responsibility of the Coast Guard sector responsible for San Diego, California, including—</text><subparagraph id="HB8D6A73630CD4FBAA351204BD46F7604" commented="no"><enum>(A)</enum><text>the average volume of known maritime traffic that transited the area during fiscal years 2020 through 2022;</text></subparagraph><subparagraph id="HE611B98CBC8643EAA39EDCF15ABE77BC" commented="no"><enum>(B)</enum><text>current sensor platforms deployed by such sector to monitor illicit activity occurring at sea in such area; </text></subparagraph><subparagraph id="H54AF494B66AA42BEB8AD575E2A3A5EDE" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">the number of illicit activity incidents at sea in such area that the sector responded to during fiscal years 2020 through 2022; </text></subparagraph><subparagraph id="HEF900F327D594A5EB95F8D21F0C50374" commented="no"><enum>(D)</enum><text>an estimate of the volume of traffic engaged in illicit activity at sea in such area and the type and description of any vessels used to carry out illicit activities that such sector responded to during fiscal years 2020 through 2022; and</text></subparagraph><subparagraph id="HB0B3A31140204E53A1923E3425405A58" commented="no"><enum>(E)</enum><text>the maritime domain awareness requirements to effectively meet the mission of such sector;</text></subparagraph></paragraph><paragraph id="HB7B026C5B11D418088A848389FDC7D4D" commented="no"><enum>(2)</enum><text>a description of current actions taken by the Coast Guard to partner with Federal, regional, State, and local entities to meet the maritime domain awareness needs of such area;</text></paragraph><paragraph id="H1D6825801F564D1AAB917D359D98998E" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">a description of any gaps in maritime domain awareness within the area of responsibility of such sector resulting from an inability to meet the enduring maritime domain awareness requirements of the sector or adequately respond to maritime disorder;</text></paragraph><paragraph id="H7286AD60379C4818AB1C84E0A9C5ACE5" commented="no"><enum>(4)</enum><text>an identification of current technology and assets the Coast Guard has to mitigate the gaps identified in paragraph (3);</text></paragraph><paragraph id="HE35BA5C62FFE417D9E570F3004AF640C" commented="no"><enum>(5)</enum><text>an identification of capabilities needed to mitigate such gaps, including any capabilities the Coast Guard currently possesses that can be deployed to the sector;</text></paragraph><paragraph id="HB1764FBB0B79402AAEE138C4BB3F6CC1" commented="no"><enum>(6)</enum><text>an identification of technology and assets the Coast Guard does not currently possess and are needed to acquire in order to address such gaps; and</text></paragraph><paragraph id="HB496EFCE72BD47A6947F3EB58C562623" commented="no"><enum>(7)</enum><text>an identification of any financial obstacles that prevent the Coast Guard from deploying existing commercially available sensor technology to address such gaps.</text></paragraph></section><section id="H5C169795ADE3426CAC2DC8CDA4B8ED52"><enum>210.</enum><header>Great Lakes winter shipping</header><subsection id="HFF33BC710B6B444199766108D8417901" commented="no"><enum>(a)</enum><header>Great Lakes icebreaking operations</header><paragraph id="H65485CE7524C486F8E04F2A146F59075" commented="no"><enum>(1)</enum><header>Government Accountability Office report</header><subparagraph id="H317AC9BE4A5A43A186F9936493D4A29E" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report on Coast Guard icebreaking in the Great Lakes.</text></subparagraph><subparagraph id="H25ED3CE8F889472DBFBFC82C5E13DC72" commented="no"><enum>(B)</enum><header>Elements</header><text>The report required under subparagraph (A) shall—</text><clause id="H3C250C04A33C4F468AA7FA55FE611321" commented="no"><enum>(i)</enum><text>evaluate—</text><subclause id="H6445168039CD4ADC89A1A201B11468AD" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">the economic impact related to vessel delays or cancellations associated with ice coverage on the Great Lakes;</text></subclause><subclause id="HD4D4907C4D9D4B52BA62DB56913332CC" commented="no"><enum>(II)</enum><text>the impact the standards proposed in paragraph (2) would have on Coast Guard operations in the Great Lakes if such standards were adopted;</text></subclause><subclause id="H878CB8520ED64E5AAFCB3089B4FC501D" commented="no"><enum>(III)</enum><text>the fleet mix of medium icebreakers and icebreaking tugs necessary to meet the standards proposed in paragraph (2); and</text></subclause><subclause id="H13C0A5A5784C4BF1A1340810981D90D5" commented="no"><enum>(IV)</enum><text>the resources necessary to support the fleet described in subclause (III), including billets for crew and operating costs; and</text></subclause></clause><clause id="H3FFBDA59D1F04F55BF678D111306201A" commented="no"><enum>(ii)</enum><text>make recommendations to the Commandant for improvements to the Great Lakes icebreaking program, including with respect to facilitating shipping and meeting all Coast Guard mission needs.</text></clause></subparagraph></paragraph><paragraph id="HDD86487EA2004A5E92D9F596E7843121" commented="no"><enum>(2)</enum><header>Proposed standards for icebreaking operations</header><text>The proposed standards, the impact of the adoption of which is evaluated in subclauses (II) and (III) of paragraph (1)(B)(i), are the following:</text><subparagraph id="H0E39B5AE490743F19A436712A37364D4" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the ice-covered waterways in the Great Lakes shall be open to navigation not less than 90 percent of the hours that vessels engaged in commercial service and ferries attempt to transit such ice-covered waterways.</text></subparagraph><subparagraph id="H9104B05EB24C4B2AA893AAAC469C4CFA" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">In a year in which the Great Lakes are not open to navigation, as described in subparagraph (A), because of ice of a thickness that occurs on average only once every 10 years, ice-covered waterways in the Great Lakes shall be open to navigation at least 70 percent of the hours that vessels engaged in commercial service and ferries attempt to transit such ice-covered waterways.</text></subparagraph></paragraph><paragraph id="HA68A9CD7A9BC47DD83E8403089C4C2D4" commented="no"><enum>(3)</enum><header>Report by Commandant</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the Comptroller General submits the report under paragraph (1), the Commandant shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that includes the following:</text><subparagraph id="HCD19FA410F064DD3ADD484983D3B49CA" commented="no"><enum>(A)</enum><text>A plan for Coast Guard implementation of any recommendation made by the Comptroller General under paragraph (1)(B)(ii) with which the Commandant concurs.</text></subparagraph><subparagraph id="H10787496796B4793B9831AFC51176A79" commented="no"><enum>(B)</enum><text>With respect to any recommendation made under paragraph (1)(B)(ii) with which the Commandant does not concur, an explanation of the reasons why the Commandant does not concur.</text></subparagraph><subparagraph id="HA02E01B4DDD84F16939A0DE4EB3952BA" commented="no"><enum>(C)</enum><text>A review of, and a proposed implementation plan for, the results of the fleet mix analysis under paragraph (1)(B)(i)(III).</text></subparagraph><subparagraph id="H66D505E4D50B470E879E13738B82D2E7" commented="no"><enum>(D)</enum><text>Any proposed modifications to current Coast Guard standards for icebreaking operations in the Great Lakes.</text></subparagraph></paragraph><paragraph id="HF70B8A194ABF4710BA0F9CD195E78272" commented="no"><enum>(4)</enum><header>Pilot program</header><text display-inline="yes-display-inline">During the 5 ice seasons following the date of enactment of this Act, the Coast Guard shall conduct a pilot program to determine the extent to which the current Coast Guard Great Lakes icebreaking cutter fleet can meet the proposed standards described in paragraph (2).</text></paragraph></subsection><subsection id="H43CDEED591F147C6BBE38540A0811171" commented="no"><enum>(b)</enum><header>Data on icebreaking operations in the Great Lakes</header><paragraph id="H5A40BA370210465393EE5810289C7CFD" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commandant shall collect, during ice season, archive, and disseminate data on icebreaking operations and transits on ice-covered waterways in the Great Lakes of vessels engaged in commercial service and ferries.</text></paragraph><paragraph id="H28E54A66299B43DF93A687F6A1474B97" commented="no"><enum>(2)</enum><header>Elements</header><text display-inline="yes-display-inline">Data collected, archived, and disseminated under paragraph (1) shall include the following:</text><subparagraph id="H1245A4083506434899D546C01A101AEB" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Voyages by vessels engaged in commercial service and ferries to transit ice-covered waterways in the Great Lakes that are delayed or canceled because of the nonavailability of a suitable icebreaking vessel.</text></subparagraph><subparagraph id="HEE271E6A60B24FBAA0C83CB711C21987" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">Voyages attempted by vessels engaged in commercial service and ferries to transit ice-covered waterways in the Great Lakes that do not reach their intended destination because of the nonavailability of a suitable icebreaking vessel.</text></subparagraph><subparagraph id="HC1F4566AEEBC49BEBA3C290CA8806B24" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">The period of time that each vessel engaged in commercial service or ferry was delayed in getting underway or during a transit of ice-covered waterways in the Great Lakes due to the nonavailability of a suitable icebreaking vessel.</text></subparagraph><subparagraph id="HD44C0D646D6D4AB78DBBCE356BC518CA" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">The period of time elapsed between each request for icebreaking assistance by a vessel engaged in commercial service or ferry and the arrival of a suitable icebreaking vessel and whether such icebreaking vessel was a Coast Guard or commercial asset.</text></subparagraph><subparagraph id="HFC7E658BA12A4766AD19D56C73CE2FC5" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">The percentage of hours that Great Lakes ice-covered waterways were open to navigation while vessels engaged in commercial service and ferries attempted to transit such waterways for each ice season after the date of enactment of this Act.</text></subparagraph><subparagraph id="H9F201D31863748BE904F11E11A1D6342" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">Relevant communications of each vessel engaged in commercial service or ferry with the Coast Guard or commercial icebreaking service providers with respect to subparagraphs (A) through (D).</text></subparagraph><subparagraph id="H00D21B5631664E5BAB9697038408890D" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">A description of any mitigating circumstance, such as Coast Guard Great Lakes icebreaker diversions to higher priority missions, that may have contributed to the amount of time described in subparagraphs (C) and (D) or the percentage of time described in subparagraph (E).</text></subparagraph></paragraph><paragraph id="HFB4277A1424B4EA6A6F532DEAE982316" commented="no"><enum>(3)</enum><header>Voluntary reporting</header><text>Any reporting by operators of commercial vessels engaged in commercial service or ferries under this section shall be voluntary.</text></paragraph><paragraph id="H8653EB825C8747B68163660405A7AF03" commented="no"><enum>(4)</enum><header>Public availability</header><text display-inline="yes-display-inline">The Commandant shall make the data collected, archived, and disseminated under this subsection available to the public on a publicly accessible internet website of the Coast Guard.</text></paragraph><paragraph id="HE5DF3BFDDD6541D68204C0F5CC27F3E4" commented="no"><enum>(5)</enum><header>Consultation with industry</header><text display-inline="yes-display-inline">With respect to the Great Lakes icebreaking operations of the Coast Guard and the development of the data collected, archived, and disseminated under this subsection, the Commandant shall consult operators of—</text><subparagraph id="H0B9FA7E360A547CF80C72AA07140B901"><enum>(A)</enum><text>vessels engaged in commercial service; and</text></subparagraph><subparagraph id="H511986FE33E1457890ED44D772088C4D"><enum>(B)</enum><text>ferries.</text></subparagraph></paragraph></subsection><subsection id="H89DAC91EEAAD4680AE5DA814E4922B31" commented="no"><enum>(c)</enum><header>Report on common hull design</header><text display-inline="yes-display-inline">Section 8105 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>) is amended by striking subsection (b) and inserting the following: </text><quoted-block style="OLC" id="H415CADAE9B054C01AF74746D1898914C" display-inline="no-display-inline"><subsection id="H64DA5079CD834247ACBF2425A8DCB541" commented="no"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this subsection, the Commandant shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report on the operational benefits and limitations of a common hull design for icebreaking cutters for operation in the Great Lakes, the Northeastern United States, and the Arctic, as appropriate, that are at least as capable as the Coast Guard 140-foot icebreaking tugs. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H92AF09A2E2784CD1A44B54B8914A2D06" commented="no"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H5116AC2C0E3F4A09A73EA2572578EC97" commented="no"><enum>(1)</enum><header>Commercial service</header><text>The term <term>commercial service</term> has the meaning given such term in section 2101 of title 46, United States Code.</text></paragraph><paragraph id="HB07B7DAE518840F1932289B84F08FA77" commented="no"><enum>(2)</enum><header>Great Lakes</header><text>The term <term>Great Lakes</term>—</text><subparagraph id="H19B2CF2164E84A34BF5FD8B5948F51E6" commented="no"><enum>(A)</enum><text>has the meaning given such term in section 118 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1268">33 U.S.C. 1268</external-xref>); and</text></subparagraph><subparagraph id="H5231D03680AB48C4AA2DF6D5779D25F0" commented="no"><enum>(B)</enum><text>includes harbors adjacent to such waters.</text></subparagraph></paragraph><paragraph id="HAE46DA2B0B8744E99CAB0F33BE404AD2" commented="no"><enum>(3)</enum><header>Ice-covered waterway</header><text display-inline="yes-display-inline">The term <term>ice-covered waterway</term> means any portion of the Great Lakes in which vessels engaged in commercial service or ferries operate that is 70 percent or greater covered by ice, but does not include any waters adjacent to piers or docks for which commercial icebreaking services are available and adequate for the ice conditions.</text></paragraph><paragraph id="H7F5122AEC58B414FADABA3EA061B9321" commented="no"><enum>(4)</enum><header>Open to navigation</header><text display-inline="yes-display-inline">The term <term>open to navigation</term> means navigable to the extent necessary to—</text><subparagraph id="HDF6E855431D24C1B8A23A8B584636BE7"><enum>(A)</enum><text>meet the reasonable demands of shipping;</text></subparagraph><subparagraph id="H05EC17D4C43E4915AC9EAA8AF6D9DCB2"><enum>(B)</enum><text>minimize delays to passenger ferries;</text></subparagraph><subparagraph id="HE802E065EF4947F4935625B10A2A20D6"><enum>(C)</enum><text>extricate vessels and persons from danger;</text></subparagraph><subparagraph id="H07B0FA21856145BA98BBC25403423FAA"><enum>(D)</enum><text>prevent damage due to flooding; and</text></subparagraph><subparagraph id="HA2D8F29A09724946818D50E5B24F8C79"><enum>(E)</enum><text>conduct other Coast Guard missions, as required.</text></subparagraph></paragraph><paragraph id="H562AA7CEAB5C4D3E84B46408416A54B7" commented="no"><enum>(5)</enum><header>Reasonable demands of shipping</header><text display-inline="yes-display-inline">The term <term>reasonable demands of shipping</term> means the safe movement of vessels engaged in commercial service and ferries transiting ice-covered waterways in the Great Lakes to their intended destination, regardless of type of cargo.</text></paragraph></subsection></section><section id="H6DE1AD09160C41DC8FD9E9EDD3CB7663" section-type="subsequent-section"><enum>211.</enum><header>Center of expertise for Great Lakes oil spill search and response</header><text display-inline="no-display-inline">Section 807(d) of the Frank LoBiondo Coast Guard Authorization Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/14/313">14 U.S.C. 313</external-xref> note) is amended to read as follows:</text><quoted-block style="OLC" id="H64F6F6F5283748A2B4E697F259297F82" display-inline="no-display-inline"><subsection id="HA2CF8B1015C644069E3BD9D933120255"><enum>(d)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>Great Lakes</term> means—</text><paragraph id="H1C819047523A4156859255B717E27FD7"><enum>(1)</enum><text>Lake Ontario;</text></paragraph><paragraph id="H7C0FC3D84AFC4F04A570956D9BB0B6B4"><enum>(2)</enum><text>Lake Erie;</text></paragraph><paragraph id="H79EA6B8839494B7BA1DDB36410C6CED1"><enum>(3)</enum><text>Lake Huron (including Lake St. Clair);</text></paragraph><paragraph id="HC9C43DF5AEC84074B396A7105CC1D9A8"><enum>(4)</enum><text>Lake Michigan;</text></paragraph><paragraph id="HAE297739EB9D49098E6A681F86D3C557"><enum>(5)</enum><text>Lake Superior; and</text></paragraph><paragraph id="HC8579F7DFFAA4C64A6DF3276D8B537E1"><enum>(6)</enum><text display-inline="yes-display-inline">the connecting channels (including the following rivers and tributaries of such rivers: Saint Mary’s River, Saint Clair River, Detroit River, Niagara River, Illinois River, Chicago River, Fox River, Grand River, St. Joseph River, St. Louis River, Menominee River, Muskegon River, Kalamazoo River, and Saint Lawrence River to the Canadian border).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle><subtitle id="H507D4993A12C466EBD81860949F0679B"><enum>C</enum><header>Other Matters</header><section id="HD7398312EF844B80BEB689329A459513" section-type="subsequent-section"><enum>212.</enum><header>Responses of Commandant of the Coast Guard to safety recommendations</header><subsection id="HF367D204B48C4958A33C476974D0A8BA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/7">Chapter 7</external-xref> of title 14, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H4B4154310A4F45D2B3FED2563080316D" display-inline="no-display-inline"><section id="H817C8DDEF04F41F2A31A5D9DB825EB07"><enum>721.</enum><header>Responses to safety recommendations</header><subsection id="H2A6D1B4025EA47D9B349643BB72326D6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the submission to the Commandant of the Coast Guard of a recommendation by the National Transportation Safety Board relating to transportation safety, the Commandant shall submit to the Board a written response to each recommendation, which shall include whether the Commandant—</text><paragraph id="HE4412FA0ADC34544A882598C7716F742"><enum>(1)</enum><text>concurs with the recommendation;</text></paragraph><paragraph id="H535CE3018A4B42E98BD6B259AD6DF06F"><enum>(2)</enum><text>partially concurs with the recommendation; or</text></paragraph><paragraph id="H87385945EF7D4629A511E7084FD1F7CE"><enum>(3)</enum><text>does not concur with the recommendation.</text></paragraph></subsection><subsection id="HFAABC15E3F9E438F98425A5D2CA549F2"><enum>(b)</enum><header>Explanation of concurrence</header><text>A response under subsection (a) shall include—</text><paragraph id="HDE7D57DB4BE248B9B591893E338F5FC1"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to a recommendation to which the Commandant concurs, an explanation of the actions the Commandant intends to take to implement such recommendation;</text></paragraph><paragraph id="HCB0B59FF645F4CABA2CEE5F8FBAF957F"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to a recommendation to which the Commandant partially concurs, an explanation of the actions the Commandant intends to take to implement the portion of such recommendation with which the Commandant partially concurs; and</text></paragraph><paragraph id="HB7C09D7C6A5B4B86B31703847A087275"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to a recommendation to which the Commandant does not concur, the reasons why the Commandant does not concur with such recommendation.</text></paragraph></subsection><subsection id="H1C73AF3E3DAA48BC8353091496B90E80"><enum>(c)</enum><header>Failure To respond</header><text display-inline="yes-display-inline">If the Board has not received the written response required under subsection (a) by the end of the time period described in such subsection, the Board shall notify the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate that such response has not been received.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1CCCBE5FE6914866A81CA41D2263A09D"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/7">chapter 7</external-xref> of title 14, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/14/720">section 720</external-xref> the following: </text><quoted-block style="USC" id="H7F707054E05B4E57B7CABAB45AC018FF" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">721. Responses to safety recommendations.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H62D36B748D2A467F876FF4C6CD3E55D3"><enum>213.</enum><header>Conveyance of Coast Guard vessels for public purposes</header><subsection id="HB8B8B9BDD690459DA0880EC59BEBB44D"><enum>(a)</enum><header>Redesignation and transfer</header><text display-inline="yes-display-inline">Section 914 of the Coast Guard Authorization Act of 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/281">Public Law 111–281</external-xref>) is transferred to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/5">chapter 5</external-xref> of title 14, United States Code, inserted after section 508, and redesignated as section 509.</text></subsection><subsection id="H297D3D637600417889C551C1719D3B00"><enum>(b)</enum><header>Conveyance of Coast Guard vessels for public purposes</header><text>Section 509 of title 14, United States Code (as redesignated under subsection (a)), is amended—</text><paragraph id="H9D54C7E2C03B41C2A78DAD14FE98EDBA"><enum>(1)</enum><text>by amending subsection (a) to read as follows:</text><quoted-block style="USC" id="H2F8D807543D54BEDB852645F3ED0C6DD" display-inline="no-display-inline"><subsection id="HC31A98A64E064C109F75F5A0D8B8E1B5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">At the request of the Commandant, the Administrator of the General Services Administration may transfer ownership of a Coast Guard vessel or aircraft to an eligible entity for use for educational, cultural, historical, charitable, recreational, or other public purposes if such transfer is authorized by law. </text></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="HE851FDC7781042068238A67CB3745740"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HDE9668EEE23F4AABA7D804FAFB4B7C6A"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H9B7F63FCDE6A44339A8504C05ECB2C58"><enum>(i)</enum><text>by inserting <quote>as if such a request were being processed</quote> after <quote>vessels</quote>; and</text></clause></subparagraph><subparagraph id="H16DA5AB9A15B4F1D80410B2CAB2D62E1"><enum>(B)</enum><text>in paragraph (2) by inserting <quote>, as in effect on the date of enactment of the Coast Guard Authorization Act of 2021</quote> after <quote>such title</quote>. </text></subparagraph></paragraph></subsection></section><section id="HDDEE3DC36C2D45D0894047C3CDF578F5" section-type="subsequent-section"><enum>214.</enum><header>Acquisition life-cycle cost estimates</header><text display-inline="no-display-inline">Section 1132(e) of title 14, United States Code, is amended by striking paragraphs (2) and (3) and inserting the following:</text><quoted-block style="USC" id="H5DE67A786ABD464E8F2080CB8A489872" display-inline="no-display-inline"><paragraph id="H5BE0B48176A244CA8BE2403FAD4F78FE"><enum>(2)</enum><header>Types of estimates</header><text display-inline="yes-display-inline">For each Level 1 or Level 2 acquisition project or program, in addition to life-cycle cost estimates developed under paragraph (1), the Commandant shall require that—</text><subparagraph id="H0D148B835F634994ACD4A5DF465BBE78"><enum>(A)</enum><text display-inline="yes-display-inline">such life-cycle cost estimates be updated before—</text><clause id="H51CA4315E94D4130BEDD3AAE552EAE83"><enum>(i)</enum><text>each milestone decision is concluded; and </text></clause><clause id="H757BC15AAB30464590424A628A496231"><enum>(ii)</enum><text>the project or program enters a new acquisition phase; and</text></clause></subparagraph><subparagraph id="H02C0D5E6E6CC439B97D3AB205258A9E4"><enum>(B)</enum><text display-inline="yes-display-inline">an independent cost estimate or independent cost assessment, as appropriate, be developed to validate such life-cycle cost estimates developed under paragraph (1).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H0CB60ACC86D74FD68A3274D1BAB3BD2E"><enum>215.</enum><header>National Coast Guard Museum funding plan</header><text display-inline="no-display-inline">Section 316(c)(4) of title 14, United States Code, is amended by striking <quote>the Inspector General of the department in which the Coast Guard is operating</quote> and inserting <quote>a third party entity qualified to undertake such a certification process</quote>.</text></section><section id="H54A1E3D97E1742C49D00CD05E3BA33C4" commented="no"><enum>216.</enum><header>Report on Coast Guard explosive ordnance disposal</header><subsection id="H834548AF042F404A94EDABF67B4E1521" commented="no"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the viability of establishing an explosive ordnance disposal program (hereinafter referred to as the <quote>Program</quote>) in the Coast Guard.</text></subsection><subsection id="H3D48E03AC82240D5A44526DE6B22A7DC" commented="no"><enum>(b)</enum><header>Contents</header><text>The report required under subsection (a) shall contain, at a minimum, an explanation of the following with respect to such a Program:</text><paragraph id="H2C01AB6D88B84B31A6E8DA8074D7437B" commented="no"><enum>(1)</enum><text>Where within the organizational structure of the Coast Guard the Program would be located, including a discussion of whether the Program should reside in—</text><subparagraph id="HEE611BB5BD954431A84DD98862EDF573" commented="no"><enum>(A)</enum><text>Maritime Safety and Security Teams;</text></subparagraph><subparagraph id="HC898C1F2B5AB4E12A2123828C69485C0" commented="no"><enum>(B)</enum><text>Maritime Security Response Teams;</text></subparagraph><subparagraph id="H4D9361BC58B4472F8A3EBA6ED0686BF8" commented="no"><enum>(C)</enum><text>a combination of the teams described under subparagraphs (A) and (B); or</text></subparagraph><subparagraph id="HF59E3DC68E5847B1AFBAEF41CFBBC86F" commented="no"><enum>(D)</enum><text>elsewhere within the Coast Guard.</text></subparagraph></paragraph><paragraph id="H023BBB02F5CD4B358B3FF802E4D0F5E1" commented="no"><enum>(2)</enum><text>The vehicles and dive craft that are Coast Guard airframe and vessel transportable that would be required for the transportation of explosive ordnance disposal elements.</text></paragraph><paragraph id="HD0ACD35313364335A94966434378BE4A" commented="no"><enum>(3)</enum><text>The Coast Guard stations at which—</text><subparagraph id="H7F5EA69726BC463889D4CB025EB516D1" commented="no"><enum>(A)</enum><text>portable explosives storage magazines would be available for explosive ordnance disposal elements; and</text></subparagraph><subparagraph id="H2FC4BEEAD3274009B1BAAABABF1FCAA7" commented="no"><enum>(B)</enum><text>explosive ordnance disposal elements equipment would be pre-positioned.</text></subparagraph></paragraph><paragraph id="HCDC3CA0C7E6E403D953C0C5E883E378E" commented="no"><enum>(4)</enum><text>How the Program would support other elements within the Department of Homeland Security, the Department of Justice, and in wartime, the Department of Defense to—</text><subparagraph id="H176394ABBDA54C8999D893F171CC76D4" commented="no"><enum>(A)</enum><text>counter improvised explosive devices;</text></subparagraph><subparagraph id="H3DADFF7BFAFA4A7C962CC996ABE7EF3F" commented="no"><enum>(B)</enum><text>counter unexploded ordnance;</text></subparagraph><subparagraph id="HE7E66C512EAF4098BE375C86535B1D08" commented="no"><enum>(C)</enum><text>combat weapons of destruction;</text></subparagraph><subparagraph id="H98CF133780EA4FFCB3E6FFE71A2B47DB" commented="no"><enum>(D)</enum><text>provide service in support of the President; and</text></subparagraph><subparagraph id="H88B65DCEF8A14DA1A0B4903C2A6F7258" commented="no"><enum>(E)</enum><text>support national security special events.</text></subparagraph></paragraph><paragraph id="H13C46B96A3F44333A9A6BB42FFC516C2" commented="no"><enum>(5)</enum><text>The career progression of Coast Guardsman participating in the Program from—</text><subparagraph id="H6971CC77701043029DF1EED9E7A258B4" commented="no"><enum>(A)</enum><text>Seaman Recruit to Command Master Chief Petty Officer;</text></subparagraph><subparagraph id="HD386040B2343455AABC2A7CD9C2C16DE" commented="no"><enum>(B)</enum><text>Chief Warrant Officer 2 to that of Chief Warrant Officer 4; and</text></subparagraph><subparagraph id="H795808D8003542D68FB9242D0804C951" commented="no"><enum>(F)</enum><text>overseas contingency operations.</text></subparagraph></paragraph></subsection></section><section id="H3EBB936C8159462C822755039716866B"><enum>217.</enum><header>Pribilof Island transition completion actions</header><subsection id="H4CA5E08894F44C7AAA17ED7D9A406DB1"><enum>(a)</enum><header>Extensions</header><text display-inline="yes-display-inline">Section 524 of the <short-title>Pribilof Island Transition Completion Act of 2016</short-title> (<external-xref legal-doc="public-law" parsable-cite="pl/114/120">Public Law 114–120</external-xref>)—</text><paragraph id="HF80110CC7A6E404DA5C20683A97B7995"><enum>(1)</enum><text>in subsection (b)(5) by striking <quote>5 years</quote> and inserting <quote>6 years</quote>; and</text></paragraph><paragraph id="HF95684468569410B9B69B74BEB79B2B1"><enum>(2)</enum><text>in subsection (c)(3) by striking <quote>60 days</quote> and inserting <quote>120 days</quote>.</text></paragraph></subsection><subsection id="HCD9EB4B4EE5747569E5562A60E3C1716"><enum>(b)</enum><header>Actual use and occupancy reports</header><text display-inline="yes-display-inline">Not later than 90 days after enactment of this Act, and quarterly thereafter, the Secretary of the department in which the Coast Guard is operating shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report describing—</text><paragraph id="HA5B3C082EA584E3594645E73A218B674"><enum>(1)</enum><text>the degree to which Coast Guard personnel and equipment are deployed to St. Paul Island, Alaska, in actual occupancy of the facilities, as required under section 524 of the Pribilof Island Transition Completion Act of 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/120">Public Law 114–120</external-xref>); and</text></paragraph><paragraph id="HB1D665185651440CAC53E2007FD859E2"><enum>(2)</enum><text>the status of the activities described in subsections (c) and (d) until such activities have been completed.</text></paragraph></subsection><subsection id="HCC371AEE99AC45E5877EDE738C5DE42F"><enum>(c)</enum><header>Aircraft hanger</header><text>The Secretary may—</text><paragraph id="HF4D30442E3F144018B0FECF193CC784A"><enum>(1)</enum><text>enter into a lease for a hangar to house deployed Coast Guard aircraft if such hanger was previously under lease by the Coast Guard for purposes of housing such aircraft; and</text></paragraph><paragraph id="H128CED2784DA4F539E4B951E3192A010"><enum>(2)</enum><text display-inline="yes-display-inline">may enter into an agreement with the lessor of such a hanger in which the Secretary may carry out repairs necessary to support the deployment of such aircraft and the cost such repairs may be offset under the terms of the lease.</text></paragraph></subsection><subsection id="H20181F86BE5B4B1CB855D696BD02184F"><enum>(d)</enum><header>Fuel tank</header><paragraph id="HAA7F0BAE6D7440C2A813050B5286BE42"><enum>(1)</enum><header>Determination</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Secretary shall determine whether the fuel tank located on St. Paul Island, Alaska, that is owned by the Coast Guard is needed for Coast Guard operations.</text></paragraph><paragraph id="HF8CF0D7BD2A2406B9C5C388F30CF079C"><enum>(2)</enum><header>Transfer</header><text display-inline="yes-display-inline">Subject to paragraph (3), if the Secretary determines such tank is not needed for operations, the Secretary shall, not later than 90 days after making such determination, transfer such tank to the Alaska Native Village Corporation for St. Paul Island, Alaska.</text></paragraph><paragraph id="HBD20B7C2591A42D2906C1D2F3240D40A"><enum>(3)</enum><header>Fair market value exception</header><text display-inline="yes-display-inline">The Secretary may only carry out a transfer under paragraph (2) if the fair market value of such tank is less than the aggregate value of any lease payments for the property on which the tank is located that the Coast Guard would have paid to the Alaska Native Village Corporation for St. Paul Island, Alaska, had such lease been extended at the same rate.</text></paragraph></subsection><subsection id="HFCAFD680B64449688AA28E0401F99FBC"><enum>(e)</enum><header>Savings clause</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to limit any rights of the Alaska Native Village Corporation for St. Paul to receive conveyance of all or part of the lands and improvements related to Tract 43 under the same terms and conditions as prescribed in section 524 of the <short-title>Pribilof Island Transition Completion Act of 2016</short-title> (<external-xref legal-doc="public-law" parsable-cite="pl/114/120">Public Law 114–120</external-xref>).</text></subsection></section><section id="HAC4D74CB7A6943A185D5645EBADD1DFF" section-type="subsequent-section"><enum>218.</enum><header>Notification of communication outages</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that—</text><paragraph id="H46501B86EE354A90A3C45FCA36D206AB"><enum>(1)</enum><text>contains a plan for the Coast Guard to notify mariners of radio outages for towers owned and operated by the Coast Guard in District 17;</text></paragraph><paragraph id="H97C4CB861693465FA01150582DCC636F"><enum>(2)</enum><text>address in such plan how the Coast Guard in District 17 will—</text><subparagraph id="HA229CF6A64B54D8CA66D528F8EF424D8"><enum>(A)</enum><text>disseminate outage updates regarding outages on social media at least every 48 hours;</text></subparagraph><subparagraph id="H3E7B52192F0E4EADB81DC9A89DD57363"><enum>(B)</enum><text>provide updates on a publicly accessible website at least every 48 hours;</text></subparagraph><subparagraph id="HB92D56420A5D48C9881065E3AFEA92ED"><enum>(C)</enum><text>develop methods for notifying mariners where cellular connectivity does not exist;</text></subparagraph><subparagraph id="HF8121F4FE1264BF085868AD73454B930"><enum>(D)</enum><text>generate receipt confirmation and acknowledgment of outages from mariners; and</text></subparagraph><subparagraph id="H6229C48627D74733B9A2C537BAA0CCC4"><enum>(E)</enum><text>develop and advertise a web-based communications update hub on AM/FM radio for mariners; and</text></subparagraph></paragraph><paragraph id="H47F20E2701864BF085D3ACF30BDAB7F2"><enum>(3)</enum><text>identifies technology gaps necessary to implement the plan and provide a budgetary assessment necessary to implement the plan. </text></paragraph></section></subtitle></title><title id="H664BF28D8B9944439DD609E68F686740"><enum>III</enum><header>Maritime</header><subtitle id="H905C8095FC8341F3B9D31452112B2068"><enum>A</enum><header>Shipping</header><section id="H32BEB154032A42F58EF0E1DA923FAFD9" section-type="subsequent-section"><enum>301.</enum><header>Nonoperating individual</header><text display-inline="no-display-inline">Section 8313(b) of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>) is amended by striking <quote>the date that is 2 years after the date of the enactment of this Act</quote> and inserting <quote>January 1, 2025</quote>.</text></section><section id="HDC9A90FB3691452D9C34FB8CB55E3D15"><enum>302.</enum><header>Oceanographic research vessels</header><subsection id="HC2DEAC002A8E46AA815EF9CC98E38B45"><enum>(a)</enum><header>Report required</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation, in consultation with the Secretary of the department in which the Coast Guard is operating, shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report detailing the total number of vessels known or estimated to operate or to have operated under section 50503 of title 46, United States Code, during each of the past 10 fiscal years.</text></subsection><subsection id="H3AC8DF7C7A1048C98128A71A9AD1E2AF"><enum>(b)</enum><header>Contents</header><text>The report required by subsection (a) shall include the following elements:</text><paragraph id="H14445ACF1A474F30A622E6C21C303E2B"><enum>(1)</enum><text>The total number of foreign-flagged vessels known or estimated to operate or to have operated as oceanographic research vessels (as such term is defined in section 2101 of title 46, United States Code) during each of the past 10 fiscal years.</text></paragraph><paragraph id="HF6DAFE2FED294282A9C65AD385A81F6F"><enum>(2)</enum><text>The total number of United States-flagged vessels known or estimated to operate or to have operated as oceanographic research vessels (as such term is defined section 2101 of title 46, United States Code) during each of the past 10 fiscal years.</text></paragraph></subsection></section><section id="HA360FC8D840D4225AC1404E8DFE64FA3" section-type="subsequent-section" commented="no"><enum>303.</enum><header>Atlantic Coast port access routes briefing</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, and every 30 days thereafter until the requirements of section 70003 of title 46, United States Code, are fully executed with respect to the Atlantic Coast Port Access Route, the Secretary of the department in which the Coast Guard is operating shall brief the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on any progress made to execute such requirements. </text></section></subtitle><subtitle id="HBE6E2D1A907543CCB948BFF0481EC9D4"><enum>B</enum><header>Vessel Safety</header><section id="HD29AC59740D74306B15B6D43B7375C1C" section-type="subsequent-section"><enum>304.</enum><header>Fishing vessel safety</header><subsection id="H0C0D6AB3DE2C4B81A43B67A9DDC88879"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/45">Chapter 45</external-xref> of title 46, United States Code, is amended—</text><paragraph id="HEBFB30001FA941329AC3B15F82030237"><enum>(1)</enum><text display-inline="yes-display-inline">in section 4502(f)(2) by striking <quote>certain vessels described in subsection (b) if requested by the owner or operator; and</quote> and inserting </text><quoted-block style="OLC" id="H0BCC8A0342DA49BF8AAB66C1F223F6BA" display-inline="yes-display-inline"><text>vessels described in subsection (b) if—</text><subparagraph id="H35E4A23A40994E8EB4DDF735AB5A081F"><enum>(A)</enum><text display-inline="yes-display-inline">requested by an owner or operator; or</text></subparagraph><subparagraph id="H4C4FBCC1BC6E4F649B4E3D75E5B9C5E9"><enum>(B)</enum><text>the vessel is—</text><clause id="H861B39DB70D0479F885481DAA7280C00"><enum>(i)</enum><text>at least 50 feet overall in length;</text></clause><clause id="H6505EACEA3EE40E88FA7F58F00BF9E15"><enum>(ii)</enum><text>built before July 1, 2013; and</text></clause><clause id="HACFF3F3BF1DB44779F9B711DFFA42FD9"><enum>(iii)</enum><text>25 years of age or older; and</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H9EB56B2A37B2433BAB7D8851F802EA1D"><enum>(2)</enum><text>in section 4503(b) by striking <quote>Except as provided in section 4503a, subsection (a)</quote> and inserting <quote>Subsection (a)</quote>; and</text></paragraph><paragraph id="HA4CF9918CEF141238CDE2DD6015C1E27"><enum>(3)</enum><text>by repealing section 4503a.</text></paragraph></subsection><subsection id="H11367EAF052349FA80BA30BFCD4BE5A8"><enum>(b)</enum><header>Alternative safety compliance agreements</header><text>Nothing in this section or the amendments made by this section shall be construed to affect or apply to any alternative compliance and safety agreement entered into by the Coast Guard that is in effect on the date of enactment of this Act.</text></subsection><subsection id="HB4C3D23EF8EE4F9FB4203CBB2D21AA5A"><enum>(c)</enum><header>Conforming amendments</header><text>The table of sections in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/45">chapter 45</external-xref> of title 46, United States Code, is amended by striking the item relating to section 4503a.</text></subsection></section><section id="HC638E8C1D21C40B1899ED2342C1716C7" display-inline="no-display-inline" commented="no"><enum>305.</enum><header>Requirements for DUKW-type amphibious passenger vessels</header><subsection id="H1F0FDD48675A475EA0C5878D43291685" commented="no"><enum>(a)</enum><header>Regulations required</header><text>Not later than 1 year after the date of enactment of this Act, the Commandant of the Coast Guard shall issue regulations for DUKW-type amphibious passenger vessels operating in waters subject to the jurisdiction of the United States, as defined in section 2.38 of title 33, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></subsection><subsection id="H4597C7BCC3694AB38BFF13AF85F3C9DF" commented="no"><enum>(b)</enum><header>Deadline for compliance</header><text>The regulations issued under subsection (a) shall take effect not later than 24 months after the date of enactment of this Act.</text></subsection><subsection id="H5E42175353B74325A4968E8C4677E8F0" commented="no"><enum>(c)</enum><header>Requirements</header><text>The regulations required under subsection (a) shall include the following:</text><paragraph id="H16B179D3C42642D2A6C6F13E3F762CFB" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">A requirement that operators of DUKW-type amphibious passenger vessels provide reserve buoyancy for such vessels through passive means, including watertight compartmentalization, built-in flotation, or such other means as determined appropriate by the Commandant, in order to ensure that such vessels remain afloat and upright in the event of flooding, including when carrying a full complement of passengers and crew.</text></paragraph><paragraph id="H918B450A02F24B80A471A777562C7891" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">A requirement that an operator of a DUKW-type amphibious passenger vessel—</text><subparagraph id="H0B59FBECBF9D45999E2620F72F0B3B2D" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">review and notate the forecast of the National Weather Service of the National Oceanic and Atmospheric Administration in the logbook of the vessel before getting underway and periodically while underway; </text></subparagraph><subparagraph id="H19EE21740BAE4F1CB92FEB14B247B396" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">proceed to the nearest harbor or safe refuge in any case in which a watch or warning is issued for wind speeds exceeding the wind speed equivalent used to certify the stability of such DUKW-type amphibious passenger vessel; and</text></subparagraph><subparagraph id="H9FE2D44AA5FD495F8E2BB24742DA334E" commented="no"><enum>(C)</enum><text>maintain and monitor a weather monitor radio receiver at the operator station of the vessel that is automatically activated by the warning alarm device of the National Weather Service.</text></subparagraph></paragraph><paragraph id="H785BB427E9564F999C4B281CCBC0AFB9" commented="no"><enum>(3)</enum><text>A requirement that—</text><subparagraph id="HA7BEE2EAC0C84D7F8A54AC0B76119036" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">operators of DUKW-type amphibious passenger vessels inform passengers that seatbelts may not be worn during waterborne operations;</text></subparagraph><subparagraph id="HB54A52CB70A84E699CBFCF8058B76BF1" commented="no"><enum>(B)</enum><text>before the commencement of waterborne operations, a crew member shall visually check that the seatbelt of each passenger is unbuckled; and</text></subparagraph><subparagraph id="HC42029F173534C8482D3E06510C46A19" commented="no"><enum>(C)</enum><text>operators or crew maintain a log recording the actions described in subparagraphs (A) and (B).</text></subparagraph></paragraph><paragraph id="H11102691804A4718A3263502AF72BA5F" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">A requirement for annual training for operators and crew of DUKW-type amphibious passengers vessels, including—</text><subparagraph id="H63560B3C513B4C4A80AC714FC89DA08A" commented="no"><enum>(A)</enum><text>training for personal flotation and seatbelt requirements, verifying the integrity of the vessel at the onset of each waterborne departure, identification of weather hazards, and use of National Weather Service resources prior to operation; and</text></subparagraph><subparagraph id="HE7E35AA458CD461AB5C94118992D77D8" commented="no"><enum>(B)</enum><text>training for crew to respond to emergency situations, including flooding, engine compartment fires, man-overboard situations, and in water emergency egress procedures.</text></subparagraph></paragraph></subsection><subsection id="HF06E32805F58434A9156FAF34805F5DC"><enum>(d)</enum><header>Consideration</header><text display-inline="yes-display-inline">In issuing the regulations required under subsection (a), the Commandant shall consider whether personal flotation devices should be required for the duration of the waterborne transit of a DUKW-type amphibious passenger vessel.</text></subsection><subsection id="H3055126381974A3DA7F0E45346FF8638" commented="no"><enum>(e)</enum><header>Interim requirements</header><text display-inline="yes-display-inline">Beginning on the date on which the regulations under subsection (a) are issued, the Commandant shall require that operators of DUKW-type amphibious passenger vessels that are not in compliance with such regulations shall be subject to the following requirements:</text><paragraph id="HE0C32F5156D84075B110A08FDA9554FA" commented="no"><enum>(1)</enum><text>Remove the canopies and any window coverings of such vessels for waterborne operations, or install in such vessels a canopy that does not restrict horizontal or vertical escape by passengers in the event of flooding or sinking.</text></paragraph><paragraph id="HCB923E32DF7E439BA62F1F5B6279A0B0" commented="no"><enum>(2)</enum><text>If a canopy and window coverings are removed from any such vessel pursuant to paragraph (1), require that all passengers wear a personal flotation device approved by the Coast Guard before the onset of waterborne operations of such vessel.</text></paragraph><paragraph id="HE6C3424ACABF49C88774DB5137850582" commented="no"><enum>(3)</enum><text>Reengineer such vessels to permanently close all unnecessary access plugs and reduce all through-hull penetrations to the minimum number and size necessary for operation.</text></paragraph><paragraph id="HD2CCEAE8E6964BF2993C3DB664E4C209" commented="no"><enum>(4)</enum><text>Install in such vessels independently powered electric bilge pumps that are capable of dewatering such vessels at the volume of the largest remaining penetration in order to supplement an operable Higgins pump or a dewatering pump of equivalent or greater capacity.</text></paragraph><paragraph id="H1FA582B1F7E04F83B951E2A64CBCD57B" commented="no"><enum>(5)</enum><text>Install in such vessels not fewer than 4 independently powered bilge alarms.</text></paragraph><paragraph id="HFB3D2A6716C3426DBCE7F34D21D490C7" commented="no"><enum>(6)</enum><text>Conduct an in-water inspection of any such vessel after each time a through-hull penetration of such vessel has been removed or uncovered.</text></paragraph><paragraph id="H0DC0242739C641BDA2F19734AB0CE190" commented="no"><enum>(7)</enum><text>Verify through an in-water inspection the watertight integrity of any such vessel at the outset of each waterborne departure of such vessel.</text></paragraph><paragraph id="H01EB54958740438184C6B6FE03C54951" commented="no"><enum>(8)</enum><text>Install underwater LED lights that activate automatically in an emergency.</text></paragraph><paragraph id="HF0F05BF90654489E85A4D52EE04E0189" commented="no"><enum>(9)</enum><text>Otherwise comply with any other provisions of relevant Coast Guard guidance or instructions in the inspection, configuration, and operation of such vessels.</text></paragraph></subsection></section><section id="H0360F773C13B4D2EB884FF7D04ACC089" commented="no"><enum>306.</enum><header>Exoneration and limitation of liability for small passengers vessels</header><subsection id="H3AA7BF37CF1040F7B769C5ECAE32768E" commented="no"><enum>(a)</enum><header>Restructuring</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/305">Chapter 305</external-xref> of title 46, United States Code, is amended—</text><paragraph id="H1828A3C505B44C8E99C7C9CED012A994" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting the following before section 30501:</text><quoted-block style="USC" display-inline="no-display-inline" id="H096E4D42726345F18585522533FA211C" commented="no"><enum>(i)</enum><text>not a wing-in-ground craft; and</text></clause><clause id="H9CF9AEECE7E84E37908735305FC9C1C4" voyage; and</text></subclause><subclause id="H7626823930DA464C946B13641C6FF0D2" commented="no"><enum>(II)</enum><text>not more than 150 passengers on any voyage that is not an overnight domestic voyage; and</text></subclause></clause></subparagraph><subparagraph id="H0E1F3042A86E41C9A51F6D92AEB8C248" commented="no"><enum>(B)</enum><text>includes any wooden vessel constructed prior to March 11, 1996, carrying at least 1 passenger for hire.</text></subparagraph></paragraph><paragraph id="H2318F002270848F794533B2741448BD0" commented="no"><enum>(2)</enum><header>Owner</header><text display-inline="yes-display-inline">The term <term>owner</term> includes a charterer that mans, supplies, and navigates a vessel at the charterer's own expense or by the charterer’s own procurement.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H163FD71F9CAF49E1AE009F3EB927C4F3"><enum>(c)</enum><header>Clerical amendment</header><text>The item relating to section 30501 in the analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/305">chapter 305</external-xref> of title 46, United </text></subparagraph><subparagraph id="H6FD7C9044C694A2AA9FC4C5A9785FECC"><enum>(C)</enum><text display-inline="yes-display-inline">to convert a civilian vessel of the United States to a more useful military configuration; </text></subparagraph><subparagraph id="HCC6A347ED73245B0A4CB929B2910242D"><enum>(D)</enum><text>for any vessel under contract to the Federal Government; or</text></subparagraph><subparagraph id="H155135D851574F84A9FFF1272A34535F"><enum>(E)</enum><text display-inline="yes-display-inline">for any vessel participating in—</text><clause id="H63428A0C42E4437D92885131A5486633"><enum>(i)</enum><text>the Maritime Security Program under chapter 531; </text></clause><clause id="H105BE08AFA0C43BFA66EECE5BA640398"><enum>(ii)</enum><text>the Cable Security Fleet under chapter 532; or </text></clause><clause id="H666857BA4FBC442DBBE7EBAA48E62EE3"><enum>(iii)</enum><text>the Tanker Security Fleet under chapter 534.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HFF634359E4BF494286BEACDF7E747751" section-type="subsequent-section" display-inline="no-display-inline" commented="no"><enum>308.</enum><header>Qualified vessel</header><subsection id="H53F89FE8338D4B309501D1C25DCF030D"><enum>(a)</enum><header>Eligible vessel</header><text display-inline="yes-display-inline">Section 53501(2) of title 46, United States Code, is amended—</text><paragraph id="HC8D9C6743BBE41EEB4F9CD9D7DE8837B" commented="no"><enum>(1)</enum><text>in subparagraph (A)(iii) by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H9FC12AB11C094638B58EAD4EED6D8FF9"><enum>(2)</enum><text>in subparagraph (B)(v) by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="H8E04A803A78E48B185F1F48B5D5DF68A" commented="no"><enum>(D)</enum><text>a passenger vessel or small passenger vessel, as such terms are defined in section 2101, that has a passenger capacity of 50 passengers or greater.</text></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection></section><section id="H04E08CADEA4C404CBEE8ECF112EB3934"><enum>309.</enum><header>Establishing a capital construction fund</header><text display-inline="no-display-inline">Section 53503(b) of title 46, United States Code, is amended by inserting <quote>(including transportation on a ferry, passenger vessel, or small passenger vessel, as such terms are defined in section 2101, that has a passenger capacity of 50 passengers or greater)</quote> after <quote>short sea transportation</quote>. </text></section></subtitle></title><title id="H3DDEAC601FF343B9B2CBED829E02047C"><enum>IV</enum><header>Miscellaneous</header><subtitle id="H0D2449193B944EC2BA55BBBFDECDFEE1"><enum>A</enum><header>Navigation</header><section id="H9442D09EC0F94D33B7790A836C257765" commented="no"><enum>401.</enum><header>Restriction on changing salvors</header><text display-inline="no-display-inline">Section 311(c)(3) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321(c)(3)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H7226D16ABFD04E94A6D8D86DDD654729" display-inline="no-display-inline"><subparagraph id="H256B5F60FFF84642BF99A4E47706E8D4" commented="no" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">An owner or operator may not change salvors as part of a deviation under subparagraph (B) in cases in which the original salvor satisfies the Coast Guard requirements in accordance with the National Contingency Plan and the applicable response plan required under subsection (j).</text></subparagraph><subparagraph id="H9B7E0F581C0C48DB849115703029CEA8" commented="no" indent="up1"><enum>(D)</enum><text>In any case in which the Coast Guard authorizes a deviation from the salvor as part of a deviation under subparagraph (B) from the applicable response plan required under subsection (j), the Commandant shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report describing the deviation and the reasons for such deviation. </text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H89D501E36DF847CDB92A499DC17274C5" display-inline="no-display-inline"><enum>402.</enum><header>Towing vessel inspection fees</header><text display-inline="no-display-inline">Notwithstanding section 9701 of title 31, United States Code, and section 2110 of title 46, United States Code, the Secretary of the department in which the Coast Guard is operating may not charge an inspection fee for towing vessels required to have a Certificate of Inspection under subchapter M of title 46, Code of Federal Regulations, until—</text><paragraph id="HDBE4435C364D443AAD936D11612CBB03"><enum>(1)</enum><text display-inline="yes-display-inline">the completion of the review required under section 815 of the Frank LoBiondo Coast Guard Authorization Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/282">Public Law 115–282</external-xref>); and</text></paragraph><paragraph id="H3CDF7FD7EA5C43E8B02E46FB5CAF1F9C"><enum>(2)</enum><text>the promulgation of regulations to establish specific inspection fees for such vessels.</text></paragraph></section><section id="H7F2E9F26AFCD4CB3A498366BFBF25F81" commented="no"><enum>403.</enum><header>Providing requirements for vessels anchored in established anchorage grounds</header><subsection id="H2355DFCE16C34465833D11036CA3A138" commented="no"><enum>(a)</enum><header>In general</header><text>Section 70006 of title 46, United States Code, is amended to read as follows: </text><quoted-block id="H9DF129BC2CE24F8D830D129AE30BAED9" style="USC"><section id="H3E8B01E2901B445C9FE60A0CF53A3EB5" commented="no"><enum>70006.</enum><header>Anchorage grounds</header><subsection id="H19930EC4C32E4D6DA696CB552A86D971" commented="no"><enum>(a)</enum><header>Anchorage grounds</header><paragraph id="H935FB697AAE94B7087ADFECF7971F5AC" display-inline="no-display-inline" commented="no"><enum>(1)</enum><header>Establishment</header><text>The Secretary of the department in which the Coast Guard is operating shall define and establish anchorage grounds in the navigable waters of the United States for vessels operating in such waters.</text></paragraph><paragraph id="HBCA0D865FB7445ADA8D4B589D61576D5" commented="no"><enum>(2)</enum><header>Relevant factors for establishment</header><text>In carrying out paragraph (1), the Secretary shall take into account all relevant factors concerning navigational safety, protection of the marine environment, proximity to undersea pipelines and cables, safe and efficient use of Marine Transportation System, and national security.</text></paragraph></subsection><subsection id="H374C44A15BAA4C7EB720AC110782AF40" commented="no"><enum>(b)</enum><header>Vessel requirements</header><text>Vessels, of certain sizes or type determined by the Secretary, shall—</text><paragraph id="HDDECB48C60E24B589092848D5CF1887F" commented="no"><enum>(1)</enum><text>set and maintain an anchor alarm for the duration of an anchorage;</text></paragraph><paragraph id="H0DC01C1C05E049FDB67EAE2B8827F37F" commented="no"><enum>(2)</enum><text>comply with any directions or orders issued by the Captain of the Port; and</text></paragraph><paragraph id="H2E34A963DFA147E9A219DB2C74DC17F4"><enum>(3)</enum><text>comply with any applicable anchorage regulations.</text></paragraph></subsection><subsection id="H344178B4BF1E42F6B603A5F092BF71C3" commented="no"><enum>(c)</enum><header>Prohibitions</header><text display-inline="yes-display-inline">A vessel may not—</text><paragraph id="H76BDED6C6A0D4F0F846484920AAA1F88" display-inline="no-display-inline" commented="no"><enum>(1)</enum><text>anchor in any Federal navigation channel unless authorized or directed to by the Captain of the Port;</text></paragraph><paragraph id="HBEFC60B2966B43F89CD961786AC060B1" commented="no"><enum>(2)</enum><text>anchor in near proximity, within distances determined by the Coast Guard, to an undersea pipeline or cable, unless authorized or directed to by the Captain of the Port; and</text></paragraph><paragraph id="HAA707AE954224C9FBD57C44CA3327F4B" commented="no"><enum>(3)</enum><text>anchor or remain anchored in an anchorage ground during any period in which the Captain of the Port orders closure of the anchorage ground due to inclement weather, navigational hazard, a threat to the environment, or other safety or security concern.</text></paragraph></subsection><subsection id="HB5CDE224FC0F488EB7DB535B7FC874FB" commented="no"><enum>(d)</enum><header>Safety exception</header><text>Nothing in this section shall be construed to prevent a vessel from taking actions necessary to maintain the safety of the vessel or to prevent the loss of life or property.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE50DA6682D8940B9830CB93FBAAEBF2B" commented="no"><enum>(b)</enum><header>Regulatory review</header><paragraph id="H664D784A35ED462CBE37E39640BAD5E5" display-inline="no-display-inline" commented="no"><enum>(1)</enum><header>Review required</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall complete a review of existing anchorage regulations and identify regulations that may need modification—</text><subparagraph id="H21039AD29C564FB18CBEAC717A1A43E8"><enum>(A)</enum><text>in the interest of marine safety, security, and environmental concerns, taking into account undersea pipelines, cables, or other infrastructure; and</text></subparagraph><subparagraph id="HECBA9EF066A74D75B0DA046F32ED415A"><enum>(B)</enum><text>to implement the amendments made by this section.</text></subparagraph></paragraph><paragraph id="HDEC1211A8A7A4F27B78A5CCE23BA61AE" commented="no"><enum>(2)</enum><header>Briefing</header><text>Upon completion of the review under paragraph (1), but not later than 2 years after the date of enactment of this Act, the Secretary shall provide a briefing to the Committee on Commerce, Science, and Transportation of the Senate and the Subcommittee on Coast Guard and Maritime Transportation of the Committee on Transportation and Infrastructure of the House of Representatives that summarizes the review.</text></paragraph></subsection><subsection id="HB353BF6FF29A49B3A1B5335DFB64D429" commented="no"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/700">chapter 700</external-xref> of title 46, United States Code, is amended by striking the item relating to section 70006 and inserting the following:</text><quoted-block style="USC" id="H9B8EBC18539B4AB68FE1C4FF17D23409" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">70006. and</text></subparagraph><subparagraph id="HCC3EBD8B876B41E199AC00A3957868CB"><enum>(B)</enum><text display-inline="yes-display-inline">inspecting recreational vessels in a manner that minimizes disruptions to public access for boating and recreation in non-contaminated vessels.</text></subparagraph></paragraph><paragraph id="HB599E3019E1E4680B2024E3989DA2535"><enum>(5)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out paragraph (4), including the development of recommendations, the Task Force may consult with—</text><subparagraph id="H2CE38C69829C41EEB997F140B2F92299"><enum>(A)</enum><text>State fish and wildlife management agencies;</text></subparagraph><subparagraph id="H99E679D7BBFB4F81970ECDD466C757BB"><enum>(B)</enum><text>other State agencies that manage fishery resources of the State or sustain fishery habitat; and</text></subparagraph><subparagraph id="H0E3615D448F64B4B9D0022B9B6EE47CA"><enum>(C)</enum><text>relevant nongovernmental entities.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H8EE457401B6948BB853258D2912D20DA"><enum>(2)</enum><text>in subsection (k) by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC9FE3884C1CF4D2684DE05B80D9FED27"><paragraph id="HF286F64B98D04531A66A96DA00A165E6"><enum>(3)</enum><text>Not later than 90 days after the date of enactment of the <short-title>Coast Guard Authorization Act of 2022</short-title>, the Task Force shall submit a report to Congress recommending legislative, programmatic, or regulatory changes to eliminate remaining gaps in authorities between members of the Task Force to effectively manage and control the movement of aquatic nuisance species.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB2022468DD6746DBBF85AD5DA4ADD1B7" commented="no"><enum>(e)</enum><header>Technical corrections and conforming amendments</header><text>The Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4701">16 U.S.C. 4701 et seq.</external-xref>) is further amended—</text><paragraph id="HFE020A585EDF4698963562CF1EAFD933" commented="no"><enum>(1)</enum><text>in section 1002(b)(2), by inserting a comma after <quote>funded</quote>;</text></paragraph><paragraph id="H133F99482F8B4AA1B8310542D8FAD3A4"><enum>(2)</enum><text>in section 1003, in paragraph (7), by striking <quote>Canandian</quote> and inserting <quote>Canadian</quote>;</text></paragraph><paragraph id="HB1BFB111C1434AF9879424C56EE74658"><enum>(3)</enum><text>in section 1203(a)—</text><subparagraph id="H5D589BE627904CB3BDA0ED35BF7F0F96"><enum>(A)</enum><text>in paragraph (1)(F), by inserting <quote>and</quote> after <quote>research,</quote>; and</text></subparagraph><subparagraph id="H0252E57E758F4541A0BB6E241C72C4E4"><enum>(B)</enum><text>was, at the time of injury, engaged in aquaculture in a place where such individual had lawful access.</text></subparagraph></paragraph><paragraph id="H657661A3A59C4066B47BB7CD02100EF2"><enum>(2)</enum><header>Aquaculture worker defined</header><text>In this subsection, the term <term>aquaculture worker</term> means an individual who—</text><subparagraph id="HE6127C835DE6470C9F50488FBE079600"><enum>(A)</enum><text>is employed by a commercial enterprise that is involved in the controlled cultivation and harvest of aquatic plants and animals, including—</text><clause id="H6151D4583E4E4304B4F647E3E197E71B"><enum>(i)</enum><text>the cleaning, processing, or canning of fish and fish products;</text></clause><clause id="H88B0A925124D4FFE80EAF7C20CCC42FF"><enum>(ii)</enum><text>the cultivation and harvesting of shellfish; and</text></clause><clause id="H6168C2E2336B4E33BE59986508F1DB88"><enum>(iii)</enum><text>the controlled growing and harvesting of other aquatic species;</text></clause></subparagraph><subparagraph id="H4B704E75DBC346C0B830F24B57CAE5C2"><enum>(B)</enum><text>does not hold a license issued under section 7101(c); and</text></subparagraph><subparagraph id="H38C89D576F894872A85B60C737FB9F59"><enum>(C)</enum><text>is not required to hold a merchant mariner credential under part F of subtitle II.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H97D53BDDADED4AD7B753AEEB812E5B90"><enum>(b)</enum><header>Applicability</header><text>The amendments made by this section shall apply to an injury incurred on or after the date of enactment of this Act.</text></subsection></section></subtitle><subtitle id="HE423F138FBC3445CB2317A9F2D272A98"><enum>B</enum><header>Other Matters</header><section id="HFA9758221E6D49FBAB4920AB0D50B34E"><enum>406.</enum><header>Information on type approval certificates</header><subsection id="H839D2D28FC044438AA2AF196439E264F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title IX of the Frank LoBiondo Coast Guard Authorization Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/282">Public Law 115–282</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="HDD6C04FCCEB743B7B2DF9FAEFA593922" display-inline="no-display-inline"><section id="H3F64EFF72D3742028E05F14E3C42EEAF"><enum>904.</enum><header>Information on type approval certificates</header><text display-inline="no-display-inline">The Commandant of the Coast Guard shall, upon request by any State, the District of Columbia, or territory of the United States, provide all data possessed by the Coast Guard pertaining to challenge water quality characteristics, challenge water biological organism concentrations, post-treatment water quality characteristics, and post-treatment biological organism concentrations data for a ballast water management system with a type approval certificate approved by the Coast Guard pursuant to subpart 162.060 of title 46, Code of Federal Regulations. </text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H18755052FD9C40B68BF07434DF814EE5" commented="no"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for the Frank LoBiondo Coast Guard Authorization Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/282">Public Law 115–282</external-xref>) is amended by inserting after the item relating to section 903 the following: </text><quoted-block style="OLC" id="H1AD0DF0E5E714D3C892320317F9FC7A2" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">904. Information on type approval certificates.</toc-entry></toc><after-quoted-block>. </after-quoted-block></quoted-block></subsection></section><section id="H131644373384494CA94BC5BFA9931421" section-type="subsequent-section"><enum>407.</enum><header>Passenger vessel security and safety requirements</header><text display-inline="no-display-inline">Section 3507(k)(1) of title 46, United States Code, is amended—</text><paragraph id="HE763924D9A204D03ABF1F7B0086A5377"><enum>(1)</enum><text>in subparagraph (A) by striking <quote>at least 250</quote> and inserting <quote>250 or more</quote>; and</text></paragraph><paragraph id="H7D340EA755754629931209A12F0C4033"><enum>(2)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="USC" id="H2A43AA94414B414397F72F083063C965" display-inline="no-display-inline"><subparagraph id="H63AA115E20864C60B01DC9E7436E0B5B"><enum>(B)</enum><text display-inline="yes-display-inline">has overnight accommodations for 250 or more passengers; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H5C7B13D817264C12916420D4AC8C4813"><enum>408.</enum><header>Cargo waiting time reduction</header><subsection id="H131CACA2001B4BA186565E538AE47EB7"><enum>(a)</enum><header>Interagency task force</header><text display-inline="yes-display-inline">The President shall, acting through the Supply Chain Disruptions Task Force established under Executive Order 14017 (relating to supply chains) of February 24, 2021 (86 Fed. Reg. 11849) (hereinafter referred to as the <quote>Task Force</quote>), carry out the duties described in subsection (c).</text></subsection><subsection id="HA2D3ABCFF3D841D7AFB5B6476003A161"><enum>(b)</enum><header>Duties</header><text>In carrying out this section, the Task Force shall—</text><paragraph id="H3AD3C312BE9D44C4AD89B21F48428F62"><enum>(1)</enum><text>evaluate and quantify the economic and environmental impact of cargo backlogs;</text></paragraph><paragraph id="H830EEF8850BE4EC69CB1F149BCCB694B"><enum>(2)</enum><text>evaluate and quantify the costs incurred by each Federal agency represented on the Task Force, and by State and local governments, due to such cargo backlogs;</text></paragraph><paragraph id="HD1A7B70B2C2042E19A1ECFDDB4BCA026"><enum>(3)</enum><text>evaluate the responses of each such Federal agency to such cargo backlogs; and</text></paragraph><paragraph id="H2734141EA86E497191C6CA3F60FC0846"><enum>(4)</enum><text>not later than 90 days after the date of enactment of this Act—</text><subparagraph id="H69F7BB76BFAF44D6B369AC4FCB39C4B1"><enum>(A)</enum><text>develop a plan to—</text><clause id="H334D3049B0D74A6BBEEB3C570139F255"><enum>(i)</enum><text>significantly reduce or eliminate such cargo backlog; and</text></clause><clause id="H1D00E455BB764F348341F2BB25E8AA85"><enum>(ii)</enum><text>reduce nationwide cargo processing delays, including the Port of Los Angeles and the Port of Long Beach; and</text></clause></subparagraph><subparagraph id="H9272C88BE05945CE848F56CE660F2312"><enum>(B)</enum><text>submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report containing the plan developed under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="HAD1FA73A075E43C99F4D8E78F4C7BBDB"><enum>(c)</enum><header>Report of the Commandant</header><text>No later than 90 days after the date of enactment of this Act, the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on cargo backlogs that includes—</text><paragraph id="H979669AC719A4C18803262ED2F1ABEF7"><enum>(1)</enum><text>an explanation of the extent to which vessels carrying cargo are complying with the requirements of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/700">chapter 700</external-xref> of title 46, United States Code;</text></paragraph><paragraph id="H6F64D0818F794352A24852D2BFAF5B1D"><enum>(2)</enum><text>the status of the investigation on the cause of the oil spill that occurred in October 2021 on the waters over the San Pedro Shelf related to an anchor strike, including the expected date on which the Marine Casualty Investigation Report with respect to such spill will be released; and</text></paragraph><paragraph id="H80185502983B43FABF12E7E4BE609333"><enum>(3)</enum><text>with respect to such vessels, a summary of actions taken or planned to be taken by the Commandant to—</text><subparagraph id="H96266DDFBBDC42E5ADFFFCB4F560A5DD"><enum>(A)</enum><text>provide additional protections against oil spills caused by anchor strikes; and</text></subparagraph><subparagraph id="HA14D53FB88D6421F9B0E50FED9449946"><enum>(B)</enum><text>address other safety concerns and environmental impacts.</text></subparagraph></paragraph></subsection></section><section id="H26BB273C13844EDD8CA79A9C27FC748E"><enum>409.</enum><header>Limited indemnity provisions in standby oil spill response contracts</header><subsection id="HC9B1C612E21046BFB2A93AA8CD257A04"><enum>(a)</enum><header>In general</header><text>Subject to subsections (b) and (c), a contract for the containment or removal of a discharge entered into by the President under section 311(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321(c)</external-xref>) shall contain a provision to indemnify a contractor for liabilities and expenses incidental to the containment or removal arising out of the performance of the contract that is substantially identical to the terms contained in subsections (d) through (h) of section H.4 (except for paragraph (1) of subsection (d)) of the contract offered by the Coast Guard in the solicitation numbered DTCG89–98– A–68F953, dated November 17, 1998.</text></subsection><subsection id="H3E88712232AD4A51B1E9BA9A0F2DDF31"><enum>(b)</enum><header>Requirements</header><paragraph id="HE4B8F47BE5914162B04DF3A709873E75"><enum>(1)</enum><header>Source of funds</header><text>The provision required under subsection (a) shall include a provision that the obligation to indemnify is limited to funds available in the Oil Spill Liability Trust Fund established by <external-xref legal-doc="usc" parsable-cite="usc/26/9509">section 9509(a)</external-xref> of the Internal Revenue Code of 1986 at the time the claim for indemnity is made.</text></paragraph><paragraph id="HCE2CEDA454E04EBBAB1F00AB8D04C4A6"><enum>(2)</enum><header>Uncompensated removal</header><text>A claim for indemnity under a contract described in subsection (a) shall be made as a claim for uncompensated removal costs under section 1012(a)(4) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2712">33 U.S.C. 2712(a)(4)</external-xref>).</text></paragraph><paragraph id="H50DB765D1D0F42AE849D4DCFA3EB7DF8"><enum>(3)</enum><header>Limitation</header><text>The total indemnity for a claim under a contract described in subsection (a) may not be more than $50,000 per incident.</text></paragraph></subsection><subsection id="HDC5C4F6E485745A19F5E320E31EBE45B"><enum>(c)</enum><header>Applicability of exemptions</header><text>Notwithstanding subsection (a), the United States shall not be obligated to indemnify a contractor for any act or omission of the contractor carried out pursuant to a contract entered into under this section where such act or omission is grossly negligent or which constitutes willful misconduct.</text></subsection></section><section id="H6C570B8F6FDF4AB49578DDCACD0058F2" section-type="subsequent-section"><enum>410.</enum><header>Port Coordination Council for Point Spencer</header><text display-inline="no-display-inline">Section 541 of the Coast Guard Authorization Act of 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/120">Public Law 114–120</external-xref>) is amended—</text><paragraph id="H5022EE1B7A80488082D45D61B45D1A96"><enum>(1)</enum><text>in subsection (b) by striking paragraphs (1) and (2) and inserting the following:</text><quoted-block style="USC" id="H977A81C9F1574B6B8C3E3F546F1F1D50" display-inline="no-display-inline"><paragraph id="H087B2C2F87C24485AF7D04AD1A1D6EED"><enum>(1)</enum><text display-inline="yes-display-inline">BSNC (to serve as Council Chair).</text></paragraph><paragraph id="HE984A5F8EFE044B1B6B4A7DD722B4FB5"><enum>(2)</enum><text>The Secretary of Homeland Security.</text></paragraph><paragraph id="HD05AB2CA66CD49E1AC0DD74461D78789"><enum>(3)</enum><text display-inline="yes-display-inline">An Oil Spill Response Organization that serves the area in which such Port is located. </text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="H58FF61FD18F14B9E902324DD40BAC984"><enum>(2)</enum><text>in subsection (c)(1)—</text><subparagraph id="H7522CFE6ED634B66A002827044BF9C44"><enum>(A)</enum><text>in subparagraph (B) by adding <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="HD4A5ED420C3545009C1806F394405541"><enum>(B)</enum><text>by striking subparagraphs (C) and (D) and inserting the following:</text><quoted-block style="OLC" id="H2CC80AC2162E4F9297448BF05FC206B9" display-inline="no-display-inline"><subparagraph id="HCBDDEC3F0347416285E4236CD9C5F81B"><enum>(C)</enum><text display-inline="yes-display-inline">land use planning and development on the Bering Sea, the Chukchi Sea, and the Arctic Ocean, in support of—</text><clause id="H698DC6ABE30D498C85365481F16B402A"><enum>(i)</enum><text>search and rescue;</text></clause><clause id="H94E4ACCBDDC2482DA3B3ED6655FC1EF1"><enum>(ii)</enum><text>shipping safety;</text></clause><clause id="HD245CA9A43684E25895678A1B915EA0D"><enum>(iii)</enum><text>economic development;</text></clause><clause id="HE0A7A9A4B4AB4AB692EEA4A1A97BD677"><enum>(iv)</enum><text>oil spill prevention and response;</text></clause><clause id="H07781DB545294AAB920D336E88EDEA00"><enum>(v)</enum><text>national security;</text></clause><clause id="HB41A32123EED4A2A82A73838ED3311FA"><enum>(vi)</enum><text>major marine casualties;</text></clause><clause id="H96CC5A051DC1473D8BD3DC1CBD715351"><enum>(vii)</enum><text>protection of Alaska Native archaeological and cultural resources; and </text></clause><clause id="H9DFC06CF53E642E3ADC3A2273EB7B682"><enum>(viii)</enum><text>port of refuge, arctic research, and maritime law enforcement.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HBC72A444ECD34DDDA43A8517DFE4377D"><enum>(3)</enum><text>by amending subsection (c)(3) to read as follows: </text><quoted-block style="OLC" id="HC3D6B9D26C9144B7BDA6736176335D72" display-inline="no-display-inline"><paragraph id="HE0F946E60CD64851A3510E3D58FB2EEF"><enum>(3)</enum><text display-inline="yes-display-inline">Facilitate coordination among members of the Council on the development and use of the land and coastline of Point Spencer, as such development and use relate to activities of the Council at the Port of Point Spencer. </text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="H0C7A50A2CE7040CE81F351AA77CB6BC7"><enum>(4)</enum><text>in subsection (e)—</text><subparagraph id="H75B471F552334F43909CDB0D5FCEACA5"><enum>(A)</enum><text>by striking <quote>Operations and management costs</quote> and inserting the following: </text><quoted-block style="OLC" id="HA557E604034F4300AD65F14E4F76CC4F" display-inline="no-display-inline"><paragraph id="HA2764122E2CB473B99EF977D56F7A15E"><enum>(1)</enum><header>Determination of costs</header><text>Operations and management costs</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph><subparagraph id="H9F11B773197A4AF09418D47B1B103B33"><enum>(B)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H96AEB2693E794BE0A256BF8BC338DBBA" display-inline="no-display-inline"><paragraph id="HB93FDA101D684CBC9E12D527495D6474"><enum>(2)</enum><header>Funding</header><text>To facilitate the mooring buoy system in Port Clarence and to assist the Council in the development of other oil spill prevention and response infrastructure, including reactivating the airstrip at Point Spencer with appropriate technology and safety equipment in support of response operations, there is authorized to be made available $5,000,000 for each of fiscal years 2023 through 2025 from the interest generated from the Oil Spill Liability Trust Fund.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H9F6B51B77D7A430197A21640F8A75225"><enum>411.</enum><header>Alaska oil spill planning criteria</header><subsection id="H3E8ACE873D2346328FE46677BA14BCEF"><enum>(a)</enum><header>Alaska oil spill planning criteria</header><text display-inline="yes-display-inline">Section 311(j)(5) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321(j)(5)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HDAA09CAD35174A87856A0CCA4FF95149" style="OLC"><subparagraph id="H20709139996C4584AF3E7DEBB39B164F" indent="up1"><enum>(J)</enum><clause commented="no" display-inline="yes-display-inline" id="HEAF3A7C797BC4A3DB85434CE1EAA1B12"><enum>(i)</enum><text display-inline="yes-display-inline">Except as provided in clause (iv), in any case in which the Secretary has determined that the national planning criteria established pursuant to this subsection are inappropriate for a vessel operating in the area of responsibility of Coast Guard Sector Anchorage, a response plan required under this paragraph with respect to a discharge of oil for the vessel shall comply with the planning criteria established under clause (ii), which planning criteria shall, with respect to a discharge of oil from the vessel, supercede the national planning criteria and apply in lieu of any alternative planning criteria approved for vessels operating in such area.</text></clause><clause id="H038FF54948C7447393B7487567098777" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The President shall establish planning criteria for a worst case discharge of oil, and a substantial threat of such a discharge, within the area of responsibility of Coast Guard Sector Anchorage, including planning criteria for the following: </text><subclause id="HFAFB09B9E14043B28C5D26C243AD73BE"><enum>(I)</enum><text>Mechanical oil spill response resources that are required to be located within such area.</text></subclause><subclause id="H9126EC70472E40529C50CB692590D9C4"><enum>(II)</enum><text display-inline="yes-display-inline">Response times for mobilization of oil spill response resources and arrival on the scene of a worst case discharge of oil, or substantial threat of such a discharge, occurring within such area.</text></subclause><subclause id="H6B140929184B4E0AB1458296CFBF3EEB"><enum>(III)</enum><text>Dedicated vessels for oil spill response that are capable of operating in the ocean environment and required to be located within such area.</text></subclause><subclause id="H46A3FD05CAC041D398D7EE33B56E641D"><enum>(IV)</enum><text>Ensuring the availability of at least one oil spill removal organization that is classified by the Coast Guard and that—</text><item id="H6FAE7A7C56F3444288393F88D84FAFC5"><enum>(aa)</enum><text>is capable of responding in all operating environments in such area;</text></item><item id="H532222E656B3456EA8E0A3425EF5FA1D"><enum>(bb)</enum><text>provides vessel routing measures consistent with international routing measure deviation protocols;</text></item><item id="H5DD6BC659DD24815B5C86B4D3BBDABBB"><enum>(cc)</enum><text>maintains real-time continuous vessel tracking, monitoring, and engagement protocols with the ability to detect and address vessel operation anomalies;</text></item><item id="HAFE83B82622D4AA4889829B5BF6EC75F"><enum>(dd)</enum><text>has the capability to manage wildlife protection and rehabilitation;</text></item><item id="H063BF8868CB2441C88FEFB251292A965" commented="no"><enum>(ee)</enum><text display-inline="yes-display-inline">controls oil spill response resources of dedicated and nondedicated resource providers within such area, through ownership, contracts, agreements, or other means approved by the President, sufficient to mobilize and sustain a response to a worst case discharge of oil and to contain, recover, and temporarily store discharged oil; and </text></item><item id="H332225C5823D4F249329FF765C203929"><enum>(ff)</enum><text display-inline="yes-display-inline">has pre-positioned all of its oil spill response resources in strategic locations throughout such area in a manner that ensures the ability to support response personnel, marine operations, air cargo, or other related logistics infrastructure.</text></item></subclause><subclause id="H5CB69D7CB10F4F3592A6502A87D7016D"><enum>(V)</enum><text>Temporary storage capability using both dedicated and non-dedicated assets located within such area.</text></subclause><subclause id="H548BB9543A6042159C4F694ACFE3175C" commented="no"><enum>(VI)</enum><text>Non-mechanical oil spill response resources, to be available under contracts, agreements, or other means approved by the President, capable of responding to both a discharge of persistent oil and a discharge of non-persistent oil, whether the discharged oil was carried by a vessel as fuel or cargo.</text></subclause><subclause id="H721E3CDBA34746778F70F38356AFDC0D"><enum>(VII)</enum><text display-inline="yes-display-inline">With respect to tank barges carrying non-persistent oil in bulk as cargo to be delivered to communities within such area, oil spill response resources that is required to be carried on board.</text></subclause><subclause id="H3AF7F8FA194A4875B6467B63E4048261" commented="no"><enum>(VIII)</enum><text display-inline="yes-display-inline">Ensuring that oil spill response resources otherwise required to be included in a response plan for purposes of compliance with salvage and marine firefighting requirements are not used to meet the requirements of this subparagraph.</text></subclause><subclause id="HE7039E34B86148C0ADF474F33BAFE3E1" commented="no"><enum>(IX)</enum><text>Specifying a minimum length of time that approval of a response plan under this subparagraph is valid.</text></subclause></clause><clause id="H489379F7077F4F5086E603BF6498D349" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">The President may approve a response plan for a vessel under this subparagraph only if the owner or operator of the vessel demonstrates the availability of the oil spill response resources required to be included in the response plan under the planning criteria established under clause (ii).</text></clause><clause id="H63968A028A7F42D4846656210E4902C3" indent="up1"><enum>(iv)</enum><text>Nothing in this subparagraph affects—</text><subclause id="HB860BDF5CAE24222B1E75631D73F4991"><enum>(I)</enum><text display-inline="yes-display-inline">vessels operating within the area of responsibility of the Coast Guard sector responsible for Anchorage, Alaska, with primary operations occurring within Cook Inlet, Alaska; or</text></subclause><subclause id="H2B391710106B4D27A8971E31F6231137"><enum>(II)</enum><text>the requirements applicable to tank vessels subject to section 5005 of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2735">33 U.S.C. 2735</external-xref>).</text></subclause></clause></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H55B81B3E4CA74C5294C16486DA74FE4A"><enum>(b)</enum><header>Establishment of Alaska oil spill planning criteria</header><paragraph id="HD3770CB2030C43F6BDE7AEFEA6949470"><enum>(1)</enum><header>Deadline</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the President shall establish the planning criteria required to be established under subparagraph (J) of section 311(j)(5) of the Federal Water Pollution Control Act of (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321(j)(5)</external-xref>), as added by this section.</text></paragraph><paragraph id="H09FCF27DE2654C0D81FEEFFA8536BCBF"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">In establishing such planning criteria, the President shall consult with the State of Alaska, owners and operators of vessels subject to such planning criteria, oil spill removal organizations, Alaska Native organizations, and environmental nongovernmental organizations located within the State of Alaska.</text></paragraph></subsection><subsection id="H0F3E7CC0380A49A09711ACF180C579D6"><enum>(c)</enum><header>Congressional report</header><text>Not later than one year after the date of enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall submit to Congress a report regarding the status of implementing the requirements of subparagraph (J) of section 311(j)(5) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321(j)(5)</external-xref>), as added by this section.</text></subsection></section><section id="HC3DC8F8D0BF844D4A8CDBAF8F30E837C"><enum>412.</enum><header>Nonapplicability</header><text display-inline="no-display-inline">Requirements under sections 3507(d), 3507(e), 3508, and 3509 of title 46, United States Code, shall not apply to the passenger vessel American Queen (U.S. Coast Guard Official Number 1030765) or any other passenger vessel—</text><paragraph id="HE94EE61ECA6D4E328C9E7A6DE65B23C0"><enum>(1)</enum><text>on which construction identifiable with the specific vessel begins prior to the date of enactment of this Act; and</text></paragraph><paragraph id="H3879442A52F1406794150256D40D8DA4"><enum>(2)</enum><text>to which sections 3507 and 3508 would otherwise apply when such vessels are operating inside the boundary line.</text></paragraph></section></subtitle></title><title id="H64FD1D0663424B67AAF582CB8C6B54E8"><enum>V</enum><header>Sexual Assault and Sexual Harassment Prevention and Response</header><section id="HA02AF5FE4B504C41A2DD3AC17E5DF2E7" display-inline="no-display-inline"><enum>501.</enum><header>Definitions</header><subsection id="H3A0CAC9298E74001BF5697319A6315B8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2101 of title 46, United States Code, is amended—</text><paragraph id="HE1F51F440A264ADE8A4A28DEA6AC955A"><enum>(1)</enum><text>by redesignating paragraphs (45) through (54) as paragraphs (47) through (56), respectively; and</text></paragraph><paragraph id="HCE30F7D166AD4BD68AD94AE11DD8BA2B"><enum>(2)</enum><text>by inserting after paragraph (44) the following:</text><quoted-block id="H3C241DA071A942CF8A17C1D98FBB2BB8" style="USC"><paragraph id="H3BA222807B5948E7B5C9E1F5BC0E931F"><enum>(45)</enum><text><quote>sexual assault</quote> means any form of abuse or contact as defined in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/109A">chapter 109A</external-xref> of title 18, or a substantially similar State, local, or Tribal offense.</text></paragraph><paragraph id="HE6D612CC6ACC4A3585E2ECA6C184D145"><enum>(46)</enum><text><quote>sexual harassment</quote> means—</text><subparagraph id="HCB932D81A9A74BEBA3D490C55A00A3AF"><enum>(A)</enum><text>conduct that—</text><clause id="H9F4B120880BB4A0D84247B8FB53086D1"><enum>(i)</enum><text>involves unwelcome sexual advances, requests for sexual favors, or deliberate or repeated offensive comments or gestures of a sexual nature if any—</text><subclause id="H58A38B9BEF2D4F0593ED8B30EB7C62F6"><enum>(I)</enum><text>submission to such conduct is made either explicitly or implicitly a term or condition of employment, pay, career, benefits, or entitlements of the individual; </text></subclause><subclause id="H4BBFA4B014694978BE84921A489B93C4"><enum>(II)</enum><text>submission to, or rejection, of such conduct by an individual is used as a basis for decisions affecting that individual’s job, pay, career, benefits, or entitlements;</text></subclause><subclause id="H012446D610C24449B482B4D6FC38714B"><enum>(III)</enum><text>such conduct has the purpose or effect of unreasonably interfering with an individual’s work performance or creates an intimidating, hostile, or offensive work environment; or</text></subclause><subclause id="HF8148D65108045328F7BE2B1AE5436B4"><enum>(IV)</enum><text>conduct may have been by an individual’s supervisor, a supervisor in another area, a co-worker, or another credentialed mariner; and</text></subclause></clause><clause id="H5E51FA43490349DBA2FB0A1B9F3B3184"><enum>(ii)</enum><text>is so severe or pervasive that a reasonable person would perceive, and the victim does perceive, the environment as hostile or offensive;</text></clause></subparagraph><subparagraph id="HB5E947FFC1494D2E865D0F4CCA91B056"><enum>(B)</enum><text>any use or condonation associated with firsthand or personal knowledge, by any individual in a supervisory or command position, of any form of sexual behavior to control, influence, or affect the career, pay, benefits, entitlements, or employment of a subordinate; and</text></subparagraph><subparagraph id="HE895135857E34D5DB56C14B920C3058B"><enum>(C)</enum><text>any deliberate or repeated unwelcome verbal comment or gesture of a sexual nature by any fellow employee of the complainant.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H08C082E468A84B45BDD03AEB7C243ED3" commented="no"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report describing any changes the Commandant may propose to the definitions added by the amendments in subsection (a).</text></subsection></section><section id="H0F4F80ACD11E4DC5A61C57B3E30EE1F1"><enum>502.</enum><header>Convicted sex offender as grounds for denial</header><subsection id="H8F6B5B449AC84583B8CE2B866BA35B75"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/75">Chapter 75</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block id="HD63CB5C2E84F45E68C9DB5C7C1FAACAA" style="USC"><section id="HD3A34106452B45C28AA7396CE52C1C4F"><enum>7511.</enum><header>Convicted sex offender as grounds for denial</header><subsection id="HC146ACF2F4B241F2B003BB0F89E02EBE"><enum>(a)</enum><header>Sexual abuse</header><text>A license, certificate of registry, or merchant mariner’s document authorized to be issued under this part shall be denied to an individual who has been convicted of a sexual offense prohibited under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/109A">chapter 109A</external-xref> of title 18, except for subsection (b) of section 2244 of title 18, or a substantially similar State, local, or Tribal offense.</text></subsection><subsection id="HBABB10E276AF461C8788D1184296919E"><enum>(b)</enum><header>Abusive sexual contact</header><text>A license, certificate of registry, or merchant mariner’s document authorized to be issued under this part may be denied to an individual who within 5 years before applying for the license, certificate, or document, has been convicted of a sexual offense prohibited under subsection (b) of section 2244 of title 18, or a substantially similar State, local, or Tribal offense.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9BDD2216A82A485DB003E3F3CBBAD05B"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/75">chapter 75</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block id="HA014A90221F14091B76422103F7EAA24" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">7511. Convicted sex offender as grounds for denial.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H7FA5DC5CA14743878517C65A4BB0F5B0"><enum>503.</enum><header>Sexual harassment or sexual assault as grounds for suspension or revocation</header><subsection id="HB592EAF5043F476897886EFE374AA9A9"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/77">Chapter 77</external-xref> of title 46, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/46/7704">section 7704</external-xref> the following:</text><quoted-block id="H8D39AC2431F6470597616B143757636A" style="USC"><section id="HF3BFF0E3D1CC4ADDB9AEA54CF50864EE"><enum>7704a.</enum><header>Sexual harassment or sexual assault as grounds for suspension or revocation</header><subsection id="HFE852D9C4DFE4F1689EBED9E9325AE52"><enum>(a)</enum><header>Sexual harassment</header><text>If it is shown at a hearing under this chapter that a holder of a license, certificate of registry, or merchant mariner’s document issued under this part, within 5 years before the beginning of the suspension and revocation proceedings, is the subject of an official finding of sexual harassment, then the license, certificate of registry, or merchant mariner’s document may be suspended or revoked.</text></subsection><subsection id="HCEFAAE067C2642039BDFEFF71BEF311D"><enum>(b)</enum><header>Sexual assault</header><text>If it is shown at a hearing under this chapter that a holder of a license, certificate of registry, or merchant mariner’s document issued under this part, within 10 years before the beginning of the suspension and revocation proceedings, is the subject of an official finding of sexual assault, then the license, certificate of registry, or merchant mariner’s document shall be revoked.</text></subsection><subsection id="H35825CE1260C4858B6809201ACDB6619"><enum>(c)</enum><header>Official finding</header><paragraph id="H775746CD00444BAC8D812A408E38CA04"><enum>(1)</enum><header>In general</header><text>In this section, the term <quote>official finding</quote> means—</text><subparagraph id="HC96DBAE6E19A4CB1998EAC515BC67B7B"><enum>(A)</enum><text>a legal proceeding or agency finding or decision that determines the individual committed sexual harassment or sexual assault in violation of any Federal, State, local, or Tribal law or regulation; or</text></subparagraph><subparagraph id="HFF1235E4100D41EB980BABAEC1AD3A56"><enum>(B)</enum><text display-inline="yes-display-inline">a determination after an investigation by the Coast Guard that, by a preponderance of the evidence, the individual committed sexual harassment or sexual assault if the investigation affords appropriate due process rights to the subject of the investigation.</text></subparagraph></paragraph><paragraph id="H853CF997BD3247EFB8E9BF9EFC8E0D31"><enum>(2)</enum><header>Investigation by the Coast Guard</header><text>An investigation by the Coast Guard under paragraph (1)(B) shall include, at a minimum, evaluation of the following materials that, upon request, shall be provided to the Coast Guard:</text><subparagraph id="HDF51FA2F8B2641238BBF1664AD1111BA"><enum>(A)</enum><text>Any inquiry or determination made by the employer or former employer of the individual as to whether the individual committed sexual harassment or sexual assault.</text></subparagraph><subparagraph id="H1501792A4C8148E1A6AE99A1B7A3E6AF"><enum>(B)</enum><text>Any investigative materials, documents, records, or files in the possession of an employer or former employer of the individual that are related to the claim of sexual harassment or sexual assault by the individual.</text></subparagraph></paragraph><paragraph id="H70C0D63BED0041A48E733E4BC1180D5B"><enum>(3)</enum><header>Administrative Law Judge review</header><subparagraph id="HE09D2B8F3BB7417CBE16213BE08FBBFE"><enum>(A)</enum><header>Coast Guard investigation</header><text>A determination under paragraph (1)(B) shall be reviewed and affirmed by an administrative law judge within the same proceeding as any suspension or revocation of a license, certificate of registry, or merchant mariner’s document under subsection (a) or (b).</text></subparagraph><subparagraph id="H496876BCA05B4CB28DF04D2383EBD7BE"><enum>(B)</enum><header>Legal proceeding</header><text display-inline="yes-display-inline">A determination under paragraph (1)(A) that an individual committed sexual harassment or sexual assault is conclusive in suspension and revocation proceedings.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1E7FB571425A4ADCB22CC2DFCE3E12BA"><enum>(b)</enum><header>Clerical amendment</header><text>The chapter analysis of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/77">chapter 77</external-xref> of title 46, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/46/7704">section 7704</external-xref> the following:</text><quoted-block id="H5E03D0E11C52449B88D74F3F6FE57AEC" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">7704a. Sexual harassment or sexual assault as grounds for suspension or revocation. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HE18F844C2807445DA365C26A3DAF6699"><enum>504.</enum><header>Accommodation; notices</header><text display-inline="no-display-inline">Section 11101 of title 46, United States Code, is amended—</text><paragraph id="H2BAD393178CE4A28A6C5A1403D29EC93"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(3), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HE13FBC3D4F9E44B680B0C1122DEE65E9"><enum>(2)</enum><text>in subsection (a)(4), by striking the period at the end and inserting <quote>; and</quote>; </text></paragraph><paragraph id="HFF435221B6D843C3BEE8745708B6F650"><enum>(3)</enum><text>in subsection (a), by adding at the end the following:</text><quoted-block style="USC" id="H8FAEC7C9205A4E50AD83F0FFEEAAD38E" display-inline="no-display-inline"><paragraph id="H6799D3F407F146D18C3AC64FF70CD2EF"><enum>(5)</enum><text>each crew berthing area shall be equipped with information regarding—</text><subparagraph id="H81AAC697C7AE4AE698D3DFDE8FE525C3"><enum>(A)</enum><text display-inline="yes-display-inline">vessel owner or company policies prohibiting sexual assault and sexual harassment, retaliation, and drug and alcohol usage; and</text></subparagraph><subparagraph id="H0FBF62AF82104D37AF3410980C2BC61E"><enum>(B)</enum><text>procedures and resources to report crimes, including sexual assault and sexual harassment, including information—</text><clause id="H9C31939AD7844C7095962243011986F9"><enum>(i)</enum><text display-inline="yes-display-inline">on the contact information, website address, and mobile application to the Coast Guard Investigative Services for reporting of crimes and the Coast Guard National Command Center;</text></clause><clause id="H7C1741C5F77242FCB7974BFBDF3C2EF5"><enum>(ii)</enum><text>on vessel owner or company procedures to report violations of company policy and access resources;</text></clause><clause id="H47DC1B0AE2194EF0A230D5783FCE96D7"><enum>(iii)</enum><text>on resources provided by outside organizations such as sexual assault hotlines and counseling; </text></clause><clause id="HA8170D91E8F14DAB85E4A7F3BC1E2D90"><enum>(iv)</enum><text>on the retention period for surveillance video recording after an incident of sexual harassment or sexual assault is reported; and</text></clause><clause id="H0581EFB9BB7540318C4F03713B22543F"><enum>(v)</enum><text>additional items specified in regulations issued by, and at the discretion of, the Secretary of the department in which the Coast Guard is operating.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HC64665CD5FCB418097D36143478F09D9"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (d), by adding at the end the following: <quote>In each washing space in a visible location there shall be information regarding procedures and resources to report crimes upon the vessel, including sexual assault and sexual harassment, and vessel owner or company policies prohibiting sexual assault and sexual harassment, retaliation, and drug and alcohol usage.</quote>. </text></paragraph></section><section id="H8108E6F50DF54AC587B3C4003D59F12B"><enum>505.</enum><header>Protection against discrimination</header><text display-inline="no-display-inline">Section 2114(a)(1) of title 46, United States Code, is amended—</text><paragraph id="H9B57EB896CCC440F8EE4EC54293481E2"><enum>(1)</enum><text>by redesignating subparagraphs (B) through (G) as subsections (C) through (H), respectively; and</text></paragraph><paragraph id="HFBF5165A55684002A0F1AFC687073CFE"><enum>(2)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block id="H9FEAC680C64F449CB48B60C854F2A80C" style="USC"><subparagraph id="H76B89B330E694400B971BCE11883CB37" indent="up1"><enum>(B)</enum><text>the seaman in good faith has reported or is about to report to the vessel owner, Coast Guard or other appropriate Federal agency or department sexual harassment or sexual assault against the seaman or knowledge of sexual harassment or sexual assault against another seaman;</text></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section><section id="HF30DA55DB913430C9B98C3677ADF9838" commented="no"><enum>506.</enum><header>Alcohol prohibition</header><subsection id="H9E327196534044C781ED8962FA0D32BC"><enum>(a)</enum><header>Regulations</header><paragraph id="HD3C53626474A452EB3635047ED778299"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall, taking into account the safety and security of every individual on documented vessels, issue such regulations as are necessary relating to alcohol consumption on documented vessels, according to the following requirements:</text><subparagraph id="H95BC42CF5C694D5A86538198DA9C3253"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary shall determine safe levels of alcohol consumption by crewmembers aboard documented vessels engaged in commercial service.</text></subparagraph><subparagraph id="H6C27918D0DD34B149909AEBB8937EED2"><enum>(B)</enum><text display-inline="yes-display-inline">If the Secretary determines there is no alcohol policy that can be implemented to ensure a safe environment for crew and passengers, the Secretary shall implement a prohibition on possession and consumption of alcohol by crewmembers while aboard a vessel, except when possession is associated with the commercial sale or gift to non-crew members aboard the vessel.</text></subparagraph></paragraph><paragraph id="HA47D5C895DB740388FAC2784531917A6"><enum>(2)</enum><header>Immunity from civil liability</header><text display-inline="yes-display-inline">Any crewmember who reports an incident of sexual assault or sexual harassment that is directly related to a violation of the regulations issued under paragraph (1) is immune from civil liability for any related violation of such regulations.</text></paragraph></subsection></section><section id="HC56BB58AE61F4E2F9B20DD668320BBF0"><enum>507.</enum><header>Surveillance requirements</header><subsection id="HF179C976B37544A389DFE1697ED23A8E"><enum>(a)</enum><header>In general</header><text>Part B of subtitle II of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H1A2221313B5546D5980BFED89C1AC6F8" display-inline="no-display-inline"><chapter id="H0A26DCF6B01A4D37A41B999ECF0CE6C1"><enum>49</enum><header>Oceangoing Non-Passenger Commercial Vessels</header><toc container-level="chapter-container" quoted-block="no-quoted-block" lowest-level="section" idref="H0A26DCF6B01A4D37A41B999ECF0CE6C1" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"><toc-entry idref="H508C155ECABD4081864717D21D3AA889" level="section">Sec. </toc-entry><toc-entry level="section">4901. Surveillance requirements. </toc-entry></toc><section id="H508C155ECABD4081864717D21D3AA889"><enum>4901.</enum><header>Surveillance requirements</header><subsection id="H10E6D9374A204B7C96EC8EF42AFB8ACC"><enum>(a)</enum><header>In general</header><text>A vessel engaged in commercial service that does not carry passengers, shall maintain a video surveillance system.</text></subsection><subsection id="H393B7A2FF16946769479100AAF23DB50"><enum>(b)</enum><header>Applicability</header><text>The requirements in this section shall apply to—</text><paragraph id="HD576FCFC1AD14F579F7F1223A5FB403B"><enum>(1)</enum><text>documented vessels with overnight accommodations for at least 10 persons on board—</text><subparagraph id="HA9D85D210F1546E98594EF7D74E8FA88"><enum>(A)</enum><text>is on a voyage of at least 600 miles and crosses seaward of the Boundary Line; or</text></subparagraph><subparagraph id="H0DF789A5F8F146609BB8B951017FACF5"><enum>(B)</enum><text>is at least 24 meters (79 feet) in overall length and required to have a load line under chapter 51; </text></subparagraph></paragraph><paragraph id="HAA82B541FEE94C5B9490A76238DC9695"><enum>(2)</enum><text>documented vessels of at least 500 gross tons as measured under section 14502, or an alternate tonnage measured under section 14302 as prescribed by the Secretary under section 14104 on an international voyage; and</text></paragraph><paragraph id="H5F88F8D8894443BBA09DD3BD238C478C"><enum>(3)</enum><text>vessels with overnight accommodations for at least 10 persons on board that are operating for no less than 72 hours on waters superjacent to the Outer Continental Shelf.</text></paragraph></subsection><subsection id="HD756FFDEAD4649A2B3F3851360FA47F6"><enum>(c)</enum><header>Placement of video and audio surveillance equipment</header><paragraph id="HFE59C18721084693B5BA7CEC156AAC6F"><enum>(1)</enum><header>In general</header><text>The owner of a vessel to which this section applies shall install video and audio surveillance equipment aboard the vessel not later than 2 years after enactment of the <short-title>Coast Guard Authorization Act of 2022</short-title>, or during the next scheduled drydock, whichever is later.</text></paragraph><paragraph id="H02A476082F564A6E87565B63F3A61335"><enum>(2)</enum><header>Locations</header><text>Video and audio surveillance equipment shall be placed in passageways on to which doors from staterooms open. Such equipment shall be placed in a manner ensuring the visibility of every door in each such passageway.</text></paragraph></subsection><subsection id="H6806D6A24F3D48CAB50B5C37D5A0887F"><enum>(d)</enum><header>Notice of video and audio surveillance</header><text>The owner of a vessel to which this section applies shall provide clear and conspicuous signs on board the vessel notifying the crew of the presence of video and audio surveillance equipment.</text></subsection><subsection id="H99A7A7A2B7744B778897362663214CCF"><enum>(e)</enum><header>Access to video and audio records</header><paragraph id="HE359C32075D04CC8AA863C75C778B994"><enum>(1)</enum><header>In general</header><text>The owner of a vessel to which this section applies shall provide to any Federal, State, or other law enforcement official performing official duties in the course and scope of a criminal or marine safety investigation, upon request, a copy of all records of video and audio surveillance that the official believes is relevant to the investigation.</text></paragraph><paragraph id="HB5BE4B296E0048829D6EDA2AD03A207B"><enum>(2)</enum><header>Civil actions</header><text>Except as proscribed by law enforcement authorities or court order, the owner of a vessel to which this section applies shall, upon written request, provide to any individual or the individual’s legal representative a copy of all records of video and audio surveillance—</text><subparagraph id="H58685586A60D413EB6875AA6806D58D3"><enum>(A)</enum><text>in which the individual is a subject of the video and audio surveillance;</text></subparagraph><subparagraph id="H7F485F73990A4D6EAA25D4E005851A89"><enum>(B)</enum><text>the request is in conjunction with a legal proceeding or investigation; and</text></subparagraph><subparagraph id="H96B9792D6381476E91C56367B9D3EE6D"><enum>(C)</enum><text>that may provide evidence of any sexual harassment or sexual assault incident in a civil action.</text></subparagraph></paragraph><paragraph id="H6112B1A90FD947CC9BA910AF9750CEB9"><enum>(3)</enum><header>Limited access</header><text>The owner of a vessel to which this section applies shall ensure that access to records of video and audio surveillance is limited to the purposes described in this paragraph and not used as part of a labor action against a crew member or employment dispute unless used in a criminal or civil action.</text></paragraph></subsection><subsection id="HC4408C36A02347FDB38FC26192F84AC2"><enum>(f)</enum><header>Retention requirements</header><text>The owner of a vessel to which this section applies shall retain all records of audio and video surveillance for not less than 150 days after the footage is obtained. Any video and audio surveillance found to be associated with an alleged incident should be preserved for not less than 4 years from the date of the alleged incident. The Federal Bureau of Investigation and the Coast Guard are authorized access to all records of video and audio surveillance relevant to an investigation into criminal conduct.</text></subsection><subsection id="H80DDAB12227447C798924254878921E0"><enum>(g)</enum><header>Definition</header><text>In this section, the term <quote>owner</quote> means the owner, charterer, managing operator, master, or other individual in charge of a vessel.</text></subsection><subsection id="H4EA76F012333433C8E9BBC08CDDCC798"><enum>(h)</enum><header>Exemption</header><text>Fishing vessels, fish processing vessels, and fish tender vessels are exempt from this section.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6523132DC6E441E9932ACFF25099F372"><enum>(b)</enum><header>Clerical amendment</header><text>The table of chapters for subtitle II of title 46, United States Code, is amended by adding after the item related to chapter 47 the following:</text><quoted-block style="USC" id="H48839F5A10774DCCB280CC75E6DDDA72" display-inline="no-display-inline"><toc regeneration="no-regeneration"><multi-column-toc-entry level="section" bold="on"><toc-enum>49.</toc-enum><level-header level="section" bold="on">Oceangoing non-passenger commercial vessels</level-header><target>4901</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HC3DBCB8B579145DEAA2F3C57C82F19D8"><enum>508.</enum><header>Master key control</header><subsection id="H000E2BC8009A40478D1BB0D6D9DF4587"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/31">Chapter 31</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block id="H09B3BE48BE7549F0BC14F9BE3BF1B732" style="USC"><section id="H7B734604B5E641C0A7EF2D5C7EF4C745"><enum>3106.</enum><header>Master key control system</header><subsection id="HF7CDCDA1A6AF4C7E837C05E1255E3689"><enum>(a)</enum><header>In general</header><text>The owner of a vessel subject to inspection under section 3301 shall—</text><paragraph id="H9FF3097790D641B0B2AFBEAC51AB9643"><enum>(1)</enum><text>ensure that such vessel is equipped with a vessel master key control system, manual or electronic, which provides controlled access to all copies of the vessel’s master key of which access shall only be available to the individuals described in paragraph (2);</text></paragraph><paragraph id="H7F8887F2039741F7BBAFD80B53BAA36F"><enum>(2)</enum><text>establish a list of all crew, identified by position, allowed to access and use the master key and maintain such list upon the vessel, within owner records and included in the vessel safety management system;</text></paragraph><paragraph id="HC3C6CC1154664A24BACD8CB29EC6DE8D"><enum>(3)</enum><text>record in a logbook, located in a centralized location that is readily accessible to law enforcement personnel, information on all access and use of the vessel’s master key; and</text></paragraph><paragraph id="H33840C4FE2A84454BBABA0756523869A"><enum>(4)</enum><text>make the list under paragraph (2) and the logbook under paragraph (3) available upon request to any agent of the Federal Bureau of Investigation, any member of the Coast Guard, and any law enforcement officer performing official duties in the course and scope of an investigation.</text></paragraph></subsection><subsection id="H6B4F2A9DA6A14BB7B5149A8299874491"><enum>(b)</enum><header>Prohibited use</header><text display-inline="yes-display-inline">Crew not included on the list described in subsection (a)(2) shall not have access to or use the master key unless in an emergency and shall immediately notify the master and owner of the vessel following use of such key.</text></subsection><subsection id="HE5BF848818E04924A4F27D771F79180A"><enum>(c)</enum><header>Requirements for logbook</header><text display-inline="yes-display-inline">The logbook described in subsection (a)(3)—</text><paragraph id="H3AC683B89E7D4B0FBF52A09A4B272232"><enum>(1)</enum><text>may be—</text><subparagraph id="HA56CB759D7884F378DC3C751CA5F43A2"><enum>(A)</enum><text>electronic; and</text></subparagraph><subparagraph id="H9F85F188A07644829ADDD4926A476A10"><enum>(B)</enum><text>included in the vessel safety management system; and</text></subparagraph></paragraph><paragraph id="H38AD86A37C254BE8947AE4F325B7050B"><enum>(2)</enum><text>shall include—</text><subparagraph id="H3D7DD17C3F644085986A68CDEA1DD32D"><enum>(A)</enum><text>dates and times of access;</text></subparagraph><subparagraph id="H08C1658D5B2D442781F6A2EFCF9E8610"><enum>(B)</enum><text>the room or location accessed; and</text></subparagraph><subparagraph id="H674EE02B410F4A4BA1352A346942387B"><enum>(C)</enum><text>the name and rank of the crew member who used the master key.</text></subparagraph></paragraph></subsection><subsection id="HB60C254CFB9A4484BC02CC81EA75B313"><enum>(d)</enum><header>Penalty</header><text>Any crew member who uses the master key without having been granted access pursuant to subsection (a)(2) shall be liable to the United States Government for a civil penalty of not more than $1,000 and may be subject to suspension or revocation under section 7703.</text></subsection><subsection id="H6EE871F07D12412890DFA9351A92C957"><enum>(e)</enum><header>Exemption</header><text display-inline="yes-display-inline">This section shall not apply to vessels subject to section 3507(f).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H12C89B25101D42EE8D11DC2143FFF24A"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/31">chapter 31</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block id="H6EA9F2A8E71C4262A44DD355228D7FDE" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">3106. and</text></subparagraph><subparagraph id="HBBD3449869204FF0AE56FAB870192CF9"><enum>(E)</enum><text>investigation;</text></subparagraph></paragraph><paragraph id="H24F7103762B94B308946992D1316236E"><enum>(6)</enum><text>the logbook required under section 3106;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HCCB94803F0054717BF64F8C20FFDD0CA"><enum>(2)</enum><text>by redesignating subsections (b) and (c) as subsections (c) and (d), respectively; and</text></paragraph><paragraph id="H7FC4343DF6FE4C5CA1E20CE279BED206"><enum>(3)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="USC" id="H49D9EDEC95E04D09B7E9C2AB34823F21" display-inline="no-display-inline"><subsection id="H44AED172D30647F4BB08CDFF818C1D7A"><enum>(b)</enum><header>Procedures and training requirements</header><text display-inline="yes-display-inline">In prescribing regulations for the procedures and training requirements described in subsection (a)(5), such procedures and requirements shall be consistent with the requirements to report sexual harassment or sexual assault under section 10104.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HBF60A23A9CF5490291BF754BB6B48C4A"><enum>510.</enum><header>Requirement to report sexual assault and harassment</header><text display-inline="no-display-inline">Section 10104 of title 46, United States Code, is amended by striking subsections (a) and (b) and inserting the following:</text><quoted-block id="HF4D72E18EEA6463DAF1CB38D197EF082" style="USC"><subsection id="HBBD148A09D7E47BAB4A8D61ACD308A9F"><enum>(a)</enum><header>Mandatory reporting by crew member</header><paragraph id="H0204E51B58FE4AA0AF56A850A0A4C63C"><enum>(1)</enum><header>In general</header><text>A crew member of a documented vessel shall report to the Secretary any complaint or incident of sexual harassment or sexual assault of which the crewmember has firsthand or personal knowledge.</text></paragraph><paragraph id="H8EF511C8D89242FCBDEC261848E36AC4"><enum>(2)</enum><header>Penalty</header><text>A crew member with firsthand or personal knowledge of a sexual assault or sexual harassment incident on a documented vessel who knowingly fails to report in compliance with paragraph (a)(1) is liable to the United States Government for a civil penalty of not more than $5,000.</text></paragraph><paragraph id="H5DFA86E4719D46EDAA1DD68A994BF895"><enum>(3)</enum><header>Amnesty</header><text display-inline="yes-display-inline">A crew member who fails to make the required reporting under paragraph (1) shall not be subject to the penalty described in paragraph (2) if the complaint is shared in confidence with the crew member directly from the assaulted individual or the crew member is a victim advocate as defined in section 40002(a) of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12291">34 U.S.C. 12291(a)</external-xref>).</text></paragraph></subsection><subsection id="H2C8AE44E0C3A45C0B55BD1492E594500"><enum>(b)</enum><header>Mandatory reporting by vessel owner</header><paragraph id="HC3C7AD55CD4C47D489D30B135445C479"><enum>(1)</enum><header>In general</header><text>A vessel owner or managing operator of a documented vessel or the employer of a seafarer on that vessel shall report to the Secretary any complaint or incident of harassment, sexual harassment, or sexual assault in violation of employer policy or law, of which such vessel owner or managing operator of a vessel engaged in commercial service, or the employer of the seafarer is made aware. Such reporting shall include results of any investigation into the incident, if applicable, and any action taken against the offending crewmember.</text></paragraph><paragraph id="HA7CA730FA8174824B9EFF09BF8ED4770"><enum>(2)</enum><header>Penalty</header><text>A vessel owner or managing operator of a vessel engaged in commercial service, or the employer of a seafarer on that vessel who knowingly fails to report in compliance with paragraph (1) is liable to the United States Government for a civil penalty of not more than $25,000.</text></paragraph></subsection><subsection id="HD360DD1A238A4DD6BDFD9624280133B6"><enum>(c)</enum><header>Reporting procedures</header><paragraph id="H0EEF46EC94ED4F8587D003C0ADD86168"><enum>(1)</enum><text>A report required under subsection (a) shall be made as soon as practicable, but no later than 10 days after the individual develops firsthand or personal knowledge of the sexual assault or sexual harassment incident to the Coast Guard National Command Center by the fastest telecommunication channel available.</text></paragraph><paragraph id="H7FDF6AAF9D1B49129E2BF2201994B062"><enum>(2)</enum><text display-inline="yes-display-inline">A report required under subsection (b) shall be made immediately after the vessel owner, managing operator, or employer of the seafarer gains knowledge of a sexual assault or sexual harassment incident by the fastest telecommunication channel available, and such report shall be made to the Coast Guard National Command Center—</text><subparagraph id="HEBA052DB89EC48E5822752F80A84F3B3"><enum>(A)</enum><text display-inline="yes-display-inline">the nearest Coast Guard Captain of the Port; or</text></subparagraph><subparagraph id="HBD7E72DDB50042238E5E59FC5E2389C3"><enum>(B)</enum><text>the appropriate officer or agency of the government of the country in whose waters the incident occurs.</text></subparagraph></paragraph><paragraph id="HDE6EEB39EA6647CBA060796A1DF61689"><enum>(3)</enum><text>A report required under subsections (a) and (b) shall include, to the best of the reporter’s knowledge—</text><subparagraph id="H7F942464770F426487A7F424E8CD74CE"><enum>(A)</enum><text>the name, official position or role in relation to the vessel, and contact information of the individual making the report;</text></subparagraph><subparagraph id="HE48110CEAFE9435AB537C09D321F318E"><enum>(B)</enum><text>the name and official number of the documented vessel;</text></subparagraph><subparagraph id="HA892B0B08F994DBBA6F5F7475C796B3B"><enum>(C)</enum><text>the time and date of the incident;</text></subparagraph><subparagraph id="H01BEB8D690A54241A802F2B5BF15A3C7"><enum>(D)</enum><text>the geographic position or location of the vessel when the incident occurred; and</text></subparagraph><subparagraph id="HB9037B1C58BE4A7F9FB291BBC4B0EA2D"><enum>(E)</enum><text>a brief description of the alleged sexual harassment or sexual assault being reported.</text></subparagraph></paragraph><paragraph id="H26186DC13CBE4F828E7BBA6A217B6429"><enum>(4)</enum><text>After receipt of the report made under this subsection, the Coast Guard will collect information related to the identity of each alleged victim, alleged perpetrator, and witness through means designed to protect, to the extent practicable, the personal identifiable information of such individuals.</text></paragraph></subsection><subsection id="H49D2B3342C17449A9994C343E5B541ED"><enum>(d)</enum><header>Regulations</header><text>The requirements of this section are effective as of the date of enactment of <short-title>Coast Guard Authorization Act of 2022</short-title>.
