which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Families First Coronavirus Response Act and the CARES Act to establish new coverage and payment rules for certain COVID–19 diagnostic tests and related items and services, and for other purposes.</official-title></form><legis-body id="H242A77A3C76D490195A10B46BE4318BE" style="OLC"><section id="H7EC69611E1B8485B890C35C63A43C32D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Surprises for COVID–19 Tests Act</short-title></quote>.</text></section><section id="HD49C4DA29C534377AB5DD51BBC23A9E5" section-type="subsequent-section"><enum>2.</enum><header>Establishing new coverage and payment rules for certain COVID–19 diagnostic tests and related items and services</header><subsection id="HBB097E00FF70494F801AE3567A166045"><enum>(a)</enum><header>Extension of coverage requirement</header><text>Section 6001(a) of the Families First Coronavirus Response Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5</external-xref> note) is amended in the matter preceding paragraph (1) by striking <quote>any portion of the emergency period defined in paragraph (1)(B) of section 1135(g) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)</external-xref>) beginning on or after the date of the enactment of this Act</quote> and inserting <quote>the period beginning on the date of the enactment of this Act and ending on December 31, 2023</quote>. </text></subsection><subsection id="H63B7453F50FE4D80980E3E52F89CBD99"><enum>(b)</enum><header>Payment and billing rules for items and services furnished after end of public health emergency</header><paragraph id="HEF97873B2C064BC390A0AC4BF16065D1"><enum>(1)</enum><header>In general</header><text>Section 3202 of the CARES Act (42 U.S.C. <external-xref legal-doc="usc" parsable-cite="usc/42/256b">42 U.S.C. 256b</external-xref> note) is amended—</text><subparagraph id="H0C7E1D2EB4D34D7782B3656D51E42B4F"><enum>(A)</enum><text>in subsection (a), in the matter preceding paragraph (1), by inserting <quote>that are furnished before May 1, 2022,</quote> after <quote>(<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>)</quote>;</text></subparagraph><subparagraph id="H1C678B72F9884D35AEC6F543D2572BEC"><enum>(B)</enum><text>in subsection (b)(1), by striking <quote>emergency period declared under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>)</quote> and inserting <quote>period beginning on the date of the enactment of this subsection and ending on April 31, 2022</quote>; and </text></subparagraph><subparagraph id="H0308EDCB81BE4577B9D51B0A81A4ACE2"><enum>(C)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H0A1AF589ED2F422FB8AE43FA3BEDA187" display-inline="no-display-inline"><subsection id="H4D36E6928001475CA9D6DA3833D13EB8"><enum>(c)</enum><header>Application of surprise billing provisions</header><paragraph id="H51A7DACDB17E48AEA630A91ACCC7ECCC"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the provisions of sections 2799A–1 and 2799B–1 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-111">42 U.S.C. 300gg–111</external-xref>, 300gg–131), 716 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185e">29 U.S.C. 1185e</external-xref>), and 9816 of the Internal Revenue Code of 1986 shall apply to items and services described in section 6001(a) of division F of the Families First Coronavirus Response Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>) furnished on or after May 1, 2022, and before January 1, 2024, to an enrollee of a group health plan or group or individual health insurance coverage by a provider that does not have a negotiated rate in effect with such plan or coverage (as applicable) as if such items and services were emergency services furnished by a nonparticipating provider in an emergency department of a hospital.</text></paragraph><paragraph id="HCF7517998F2141F0AF3772DB56FCF542"><enum>(2)</enum><header>Nonapplication to over-the-counter tests</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply with respect to any over-the-counter test specified in the guidance document published by the Department of Labor on January 10, 2022, entitled <quote>FAQs about Affordable Care Act Implementation Part 51, Families First Coronavirus Response Act and Coronavirus Aid, Relief, and Economic Security Act Implementation</quote> or any other over-the-counter test specified by the Secretary pursuant to section 6001(a)(1) of the Families First Coronavirus Response Act.</text></paragraph><paragraph id="H5388A1CB633144F3912BE20BCB9DAA5F"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection, the terms <quote>emergency services</quote> and <quote>nonparticipating provider</quote> have the meanings given such terms in subparagraphs (C)(i) and (G), respectively, of sections 2799A–1(a)(3) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-111">42 U.S.C. 300gg–111(a)(3)</external-xref>), 716(a)(3) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185e">29 U.S.C. 1185e(a)(3)</external-xref>), and <external-xref legal-doc="usc" parsable-cite="usc/26/9816">section 9816(a)(3)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HC1AC3DE067474103A871BB3F406A8A9C"><enum>(2)</enum><header>Implementation</header><text>Notwithstanding any other provision of law, the Secretaries of Health and Human Services, Labor, and the Treasury may implement the amendments made by this subsection by subregulatory guidance or otherwise.</text></paragraph></subsection></section></legis-body></bill>
