Maloney of New York</sponsor> (for herself, <cosponsor name-id="B001257">Mr. Bilirakis</cosponsor>, <cosponsor name-id="A000371">Mr. Aguilar</cosponsor>, <cosponsor name-id="A000378">Mrs. Axne</cosponsor>, <cosponsor name-id="B001298">Mr. Bacon</cosponsor>, <cosponsor name-id="B000490">Mr. Bishop of Georgia</cosponsor>, <cosponsor name-id="C001068">Mr. Cohen</cosponsor>, <cosponsor name-id="D000191">Mr. DeFazio</cosponsor>, <cosponsor name-id="F000466">Mr. Fitzpatrick</cosponsor>, <cosponsor name-id="H001085">Ms. Houlahan</cosponsor>, <cosponsor name-id="H001068">Mr. Huffman</cosponsor>, <cosponsor name-id="L000592">Mr. Levin of Michigan</cosponsor>, <cosponsor name-id="M001143">Ms. McCollum</cosponsor>, <cosponsor name-id="M001206">Mr. Morelle</cosponsor>, <cosponsor name-id="M001196">Mr. Moulton</cosponsor>, <cosponsor name-id="N000191">Mr. Neguse</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="P000608">Mr. Peters</cosponsor>, <cosponsor name-id="P000618">Ms. Porter</cosponsor>, <cosponsor name-id="R000515">Mr. Rush</cosponsor>, <cosponsor name-id="S001150">Mr. Schiff</cosponsor>, <cosponsor name-id="S001200">Mr. Soto</cosponsor>, <cosponsor name-id="S001201">Mr. Suozzi</cosponsor>, <cosponsor name-id="T000472">Mr. Takano</cosponsor>, <cosponsor name-id="T000481">Ms. Tlaib</cosponsor>, <cosponsor name-id="V000081">Ms. Velázquez</cosponsor>, and <cosponsor name-id="W000826">Ms. Wild</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for a Medicare demonstration project to evaluate the fiscal impact of covering low vision devices as durable medical equipment under part B of the Medicare program.</official-title></form><legis-body id="H98D242DDA2854A3C829368B435355B0F" style="OLC"><section id="HB153D3E2BC104778BBFAA8A85F7807BB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Demonstration of Coverage for Low Vision Devices Act of 2022</short-title></quote>.</text></section><section id="H4D099831E5854FC698C5EF4A7F09BAD9"><enum>2.</enum><header>Demonstration project on Medicare coverage of low vision devices as durable medical equipment</header><subsection id="HF06DA1F0240546AF909C748ECE3157CE"><enum>(a)</enum><header>Establishment of demonstration project</header><paragraph id="HC8F998B1409142D9A7D372E8C92AFC73"><enum>(1)</enum><header>In general</header><text>Beginning not later than 1 year after the date of the enactment of this Act, the Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall commence a project (in this section referred to as the <quote>demonstration project</quote>) to demonstrate and evaluate the fiscal impact of covering low vision devices (including subsets of such devices) under part B of title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395j">42 U.S.C. 1395j et seq.</external-xref>) in the same or similar manner as coverage is provided for durable medical equipment under such part.</text></paragraph><paragraph id="HDDCE1F511A204219AB74C18A75505FF2"><enum>(2)</enum><header>Low vision device defined</header><text>In this section, the term <term>low vision device</term> means a device, prescribed by a physician, that magnifies, enhances, or otherwise augments or interprets visual images irrespective of the size, form, or technological features of such device and does not include ordinary eyeglasses or contact lenses. In the previous sentence, the term <term>ordinary eyeglasses or contact lenses</term> means lenses that are intended to fully correct visual acuity or fully eliminate refractive error.</text></paragraph></subsection><subsection id="H2EEE7C78FF934BDD825BB25D1E1EB07B"><enum>(b)</enum><header>Project details</header><paragraph id="H09FF7383088943B4A929616CDE1B180B"><enum>(1)</enum><header>Eligible participants</header><text>An individual enrolled under such part is eligible to participate in the demonstration project if an ophthalmologist or optometrist, after a clinical evaluation, has determined and certifies through a prescription that furnishing a low vision device to the individual is medically necessary.</text></paragraph><paragraph id="H609E0F6E17BE4C4B8B1281EF2122F79D"><enum>(2)</enum><header>National scope and duration</header><text>The demonstration project shall be national in scope and shall be conducted for a period of 5 years.</text></paragraph><paragraph id="H4EEE156F638D43D0B05AA6D67ADE72A5"><enum>(3)</enum><header>Project design</header><text display-inline="yes-display-inline">The Secretary shall design the demonstration project in a manner so as to provide a rich, well-structured, and defined data set from which inferences about the fiscal impact on the Federal Supplementary Medical Insurance Trust Fund under section 1841 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395t">42 U.S.C. 1395t</external-xref>) resulting from the permanent coverage under part B of title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395j">42 U.S.C. 1395j et seq.</external-xref>) of low vision devices (including coverage for subcategories or subsets of such devices) can be made using appropriate statistical methods. To the maximum extent possible, such demonstration project shall evaluate the fiscal impact of permanent coverage under such part for the most function-rich, most powerful, and most expensive low vision devices.</text></paragraph><paragraph id="HF2FB1657665F403B844B8DF5BA0B38C4"><enum>(4)</enum><header>Consultation</header><text>In conducting the demonstration project the Secretary shall consult with organizations of consumers with vision loss and other stakeholder organizations.</text></paragraph></subsection><subsection id="HB019BA252C364B6E8A8E738C9E734103"><enum>(c)</enum><header>Reports</header><paragraph id="H8991494F04BD4135A77B6181C3F86D5B"><enum>(1)</enum><header>Interim report</header><text>Not later than 180 days after the last day of the third year of the demonstration project, the Secretary shall submit to the Committee on Finance of the Senate and to the Committees on Ways and Means and Energy and Commerce of the House of Representatives a report that describes the progress and preliminary findings from the demonstration project.</text></paragraph><paragraph id="H55AD439BB86F4DB6B1B594D0AC4C232D"><enum>(2)</enum><header>Final report</header><text>Not later than 180 days after the last day of the demonstration project and after solicitation and consideration of formal written input on the project from organizations representing consumers with vision loss and other stakeholder organizations, the Secretary shall submit to such Committees a final report on the project. Such report shall include an evaluation of the fiscal impact on the Medicare program under part B of title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>) of providing coverage of low vision devices (including coverage for subcategories or subsets of such devices) and such other findings and recommendations as the Secretary deems appropriate.</text></paragraph></subsection><subsection id="H4BDC393CDD09484A843BFAC09E91A6A9"><enum>(d)</enum><header>Funding</header><text display-inline="yes-display-inline">For fiscal year 2022 and for each of the four succeeding fiscal years, out of any funds in the Treasury not otherwise appropriated, $2,500,000 is appropriated to the Secretary to carry out the demonstration project.</text></subsection></section></legis-body></bill>
