R. 6844</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220225">February 25, 2022</action-date><action-desc><sponsor name-id="K000394">Mr. Kim of New Jersey</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committees on <committee-name committee-id="HBA00">Financial Services</committee-name>, <committee-name committee-id="HAG00">Agriculture</committee-name>, <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, <committee-name committee-id="HHA00">House Administration</committee-name>, and <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit Federal officials from owning covered investments, and for other purposes.</official-title></form><legis-body id="H483347D310A549CE97827F43E320D043" style="OLC"><section id="H127908CAEF3545B59E52336ADE2F7727" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Trust in Public Servants Act</short-title></quote>.</text></section><section id="H983AA0A604294046A2FF05EA2D873094"><enum>2.</enum><header>Ownership of covered investments</header><subsection id="H8097585221CE42D4AC5DD3227736538F"><enum>(a)</enum><header>Ownership of covered investments</header><paragraph id="H14B661C659A44918BAAE64E9D83A5BE3" commented="no"><enum>(1)</enum><header>Conduct during Federal service</header><text display-inline="yes-display-inline">Except as described in paragraph (2), no covered official or family member of a Member of Congress may own or trade any covered investment.</text></paragraph><paragraph id="H7C221A4E444C4008A957313C7C6D3178" commented="no"><enum>(2)</enum><header>Compliance</header><subparagraph id="HF7EED02417C5460986AFE7022B0ABE43" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), to comply with the requirements under paragraph (1), a covered official or family member of a Member of Congress shall divest of any covered investment prior to the expiration of the applicable compliance period.</text></subparagraph><subparagraph id="H4071FC34E9354B8BA1B8E921D0C53EF1" commented="no"><enum>(B)</enum><header>Applicable compliance period</header><text display-inline="yes-display-inline">In this subsection, the term <term>applicable compliance period</term> means—</text><clause id="H7666B416BBEC45D88E1E84DB57D2A482"><enum>(i)</enum><text>with respect to a covered investment held by a covered official or family member of a Member of Congress on the date of the enactment of this Act, the 90-day period which begins on the date of the enactment of this Act;</text></clause><clause id="HDE7249DE66924A88A2A65AFA56B706F5"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to a covered investment held by an individual on the date on which the individual becomes a covered official or becomes a family member of a Member of Congress after the date of the enactment of this Act, the 90-day period which begins on the date on which the individual becomes a covered official or becomes a family member of a Member of Congress; and</text></clause><clause id="H062E1F4400854CD9B0D7C164548BE454"><enum>(iii)</enum><text>with respect to a covered investment which is first held by a covered official or a family member of a Member of Congress after the last day of either of the periods described in clauses (i) or (ii), the 90-day period which begins on the date on which such investment was first held by such official or family member.</text></clause></subparagraph></paragraph></subsection><subsection id="H9E061FF61A4E4A2A89452475C3794CBD" commented="no"><enum>(b)</enum><header>Penalties</header><paragraph id="H7E34EC7B40AE4766B0076968F50A1D10" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a covered official in violation of this section, as determined by the supervising ethics office, shall pay a penalty in an amount equal to the fee set forth under <external-xref legal-doc="usc-act" parsable-cite="usc-act/Ethics in Government Act of 1978 /104">section 104(d)(1)</external-xref> of the Ethics in Government Act of 1978 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/104">5 U.S.C. App. 104(d)(1)</external-xref>) for each such violation.</text></paragraph><paragraph id="H7A0DE090D9AB4FECAD5365A12FFBC9DC" commented="no"><enum>(2)</enum><header>Exception</header><subparagraph id="H20A68EB5502C422E97866E64BE29C356"><enum>(A)</enum><header>Penalty</header><text display-inline="yes-display-inline">An individual described in subparagraph (C) who during any month is in violation of this section with respect to a covered investment, as determined by the supervising ethics office, shall pay a penalty in an amount equal to—</text><clause id="H0A66C45E976C4038AB963E8C09EE22D0"><enum>(i)</enum><text>in the case of an individual who is a covered official, the salary of such official for that month; or</text></clause><clause id="HDB3D187C776549DB9599C5D53166306F"><enum>(ii)</enum><text>in the case of an individual who is a family member of a Member of Congress, the salary of the Member of Congress for that month.</text></clause></subparagraph><subparagraph id="H30FA54C2973641DF8F564E4142E07CED"><enum>(B)</enum><header>Amount determined without regard to number of violations</header><text>The amount of the penalty imposed under subparagraph (A) shall apply to an individual without regard to the number of covered investments with respect to which the individual is in violation during the month in which the penalty is imposed.</text></subparagraph><subparagraph id="H7B200EADB2294633A0CC00C6D25AEDEC"><enum>(C)</enum><header>Individuals described</header><text>The individuals described in this paragraph are the following:</text><clause id="HB62DCCDCF017415086B2D82E9D219590"><enum>(i)</enum><text display-inline="yes-display-inline">A Member of Congress or a family member of a Member of Congress.</text></clause><clause id="HF106920A421A4F678BEC11E2F64D5D7E"><enum>(ii)</enum><text>The President.</text></clause><clause id="HF08E61E4D5CC4B10924013651DFAD003"><enum>(iii)</enum><text>The Vice-President.</text></clause><clause id="HC10E123B8EB846F9AA16FA8EF0A3B199"><enum>(iv)</enum><text>A political appointee who was appointed to such position by the President, by and with the advice and consent of the Senate.</text></clause><clause id="H90F38104D3ED409C8DC1EF8DD3050B83"><enum>(v)</enum><text>A judicial officer.</text></clause></subparagraph></paragraph></subsection><subsection id="HD8FE0B92E2B04C108E80019CB36D6A0C" commented="no"><enum>(c)</enum><header>Publication</header><text display-inline="yes-display-inline">For each individual in violation of this section as determined by the supervising ethics office, such office shall make available a list, on a publicly accessible website of such office, detailing the names, occupation, and office of employment for each such individual, or in the case of a family member of a Member of Congress, the name of such family member and of such Member of Congress.</text></subsection><subsection id="H2F3B72F603E64961B93729F9561D6AE0" commented="no"><enum>(d)</enum><header>Application of certificate of divestiture program</header><text display-inline="yes-display-inline">For purposes of <external-xref legal-doc="usc" parsable-cite="usc/26/1043">section 1043</external-xref> of the Internal Revenue Code of 1986—</text><paragraph id="H8A56974300634E2393EBCF7F56DCD947" commented="no"><enum>(1)</enum><text>any person required to dispose of any property by reason of this section shall be treated as an eligible person;</text></paragraph><paragraph id="H5923A55CB1304DABADD1570A50EBAF1A" commented="no"><enum>(2)</enum><text>this section shall be treated as a Federal conflict of interest statute; and</text></paragraph><paragraph id="HB81141E4743D4D72A0239DEEF227B865" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">in the case of an individual described in subsection (e)(2)(A), the requirement of section 1043(b)(2)(B) of such Code shall be treated as satisfied with respect to any written determination if such determination is issued by the supervising ethics office.</text></paragraph></subsection><subsection id="H4685C997CFDE4F789ECB1807FDC6B335"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H0AA2313416E1416EA0F4E945D366E2AE"><enum>(1)</enum><header>Covered investment</header><subparagraph id="HA6462F9F65264AFCA2E85D2847397FAB"><enum>(A)</enum><header>In general</header><text>The term <term>covered investment</term> means—</text><clause id="H14F885CB1C0045848D0BC94E94A6E415"><enum>(i)</enum><text>an investment in a security, a commodity, or a future; and</text></clause><clause id="H9E879B8827C140F8B531CA8160A8BCD2"><enum>(ii)</enum><text>any economic interest comparable to an interest described in clause (i) that is acquired through synthetic means, such as the use of a derivative, including an option, warrant, or other, similar means.</text></clause></subparagraph><subparagraph id="H803B2ABBAEF64241A34314BA4D103B5A"><enum>(B)</enum><header>Inclusions</header><text>The term <term>covered investment</term> includes an investment or economic interest described in subparagraph (A) that is held directly, or in which an individual has an indirect, beneficial, or economic interest, through—</text><clause id="H1599A50BE0A143F49F1A611B16E19EB4"><enum>(i)</enum><text>an investment fund;</text></clause><clause id="HE2D25F379F5D4D2381D7F2117BA9CAA6"><enum>(ii)</enum><text>a trust;</text></clause><clause id="H7808A2CFA14B4FB6B4998C854F84B29F"><enum>(iii)</enum><text>an employee benefit plan; or</text></clause><clause id="H1819B5A20D354DC28112B04F562B4F70"><enum>(iv)</enum><text>a deferred compensation plan, including a carried interest or other agreement tied to the performance of an investment, other than a fixed cash payment.</text></clause></subparagraph><subparagraph id="H9D05C95DAB854A9BB669DDAE4DEDF109"><enum>(C)</enum><header>Exclusions</header><text>The term <term>covered investment</term> does not include—</text><clause id="HA58788515B4D4998914FA7CE302DBD34"><enum>(i)</enum><text>a diversified mutual fund (including any holdings of such a fund);</text></clause><clause id="H8CE769CF5AAA46349E26A9EE03192D19"><enum>(ii)</enum><text>a diversified exchange-traded fund (including any holdings of such a fund);</text></clause><clause id="HCD9E8B21B1A94A73A32D7F18EFB9035C"><enum>(iii)</enum><text>a United States Treasury bill, note, or bond;</text></clause><clause id="H25B95D186C9645DB868E9AEDC0F8C4BF"><enum>(iv)</enum><text>compensation from the primary occupation of a spouse or dependent of a Member of Congress; or</text></clause><clause id="HF04D29557CB946F8A6B18E3CE4D51AC0"><enum>(v)</enum><text>any investment fund held in a Federal, State, or local government employee retirement plan.</text></clause></subparagraph><subparagraph id="H2B662E165AB94104BDA0BA42D6BA3C5F"><enum>(D)</enum><header>Clarification</header><text>An investment that achieves compliance with applicable environmental, social, and governance criteria shall not be considered to be a covered investment solely by reason of that compliance.</text></subparagraph></paragraph><paragraph id="HCF8A53B415874A71866C6CF3EA3BC69A" commented="no"><enum>(2)</enum><header>Covered official</header><text>The term <term>covered official</term> means the following:</text><subparagraph id="H295CB3C70E7B4132BC08B8994934F32F" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">In the legislative branch, a Member of Congress and each of the following (other than an employee who is considered an intern or a fellow for purposes of any law or regulation establishing a limit on the number of employees of an office of the House of Representatives or Senate):</text><clause id="H5E212ACFB9E644C0B3BC892F1F838036" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">An employee of a Member of the House of Representatives (as described in section 207(e)(9)(E) of title 18, United States Code).</text></clause><clause id="HBB73F11C68E546C8937462159BF42F61" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">An employee of a Senator (as described in section 207(e)(9)(F) of title 18, United States Code).</text></clause><clause id="HF5DA08046E994243A3443C6ED98FDA44"><enum>(iii)</enum><text display-inline="yes-display-inline">An employee of a committee of Congress (as defined in section 207(e)(9)(A) of title 18, United States Code).</text></clause><clause id="H10C24323462C4025BFE8CC188A0A5EE3"><enum>(iv)</enum><text>An employee on the leadership staff of the House of Representatives (as defined in section 207(e)(9)(H) of title 18, United States Code).</text></clause><clause id="HD7971ACD0DBA41C99DB362E9E82E452B"><enum>(v)</enum><text>An employee on the leadership staff of the Senate (as defined in section 207(e)(9)(I) of title 18, United States Code).</text></clause></subparagraph><subparagraph id="H5D3CD42862324EC687560FC3E787AD5F" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">In the executive branch—</text><clause id="H652C0E29E8BC4AE4BF932D63B5DC9AFC" commented="no"><enum>(i)</enum><text>the President;</text></clause><clause id="H3E9E5C458CDA4C6192DC752ECC033E0C" commented="no"><enum>(ii)</enum><text>the Vice-President;</text></clause><clause id="H9466F5431A3D47D085F5422AC4A5EEA6" commented="no"><enum>(iii)</enum><text>a political appointee; or</text></clause><clause id="H728A8A6D4D21459E9C62A7DD18C2380E" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">any officer or employee of the executive branch who is—</text><subclause id="H309570E961A643FDA787AC8E699C14BC"><enum>(I)</enum><text>not a political appointee; and</text></subclause><subclause id="H2903791985864161ADADEB03029A8942"><enum>(II)</enum><text>occupies a position described under paragraphs (3) through (8) of section 101(f) of the Ethics in Government Act of 1978. (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/101">5 U.S.C. App. 101</external-xref>).</text></subclause></clause></subparagraph><subparagraph id="HDDD2B8244EA8483587909DF25A7352F0" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">A judicial officer.</text></subparagraph></paragraph><paragraph id="H14A091AD8C394629AA98C19B703608AD" commented="no"><enum>(3)</enum><header>Executive branch</header><text display-inline="yes-display-inline">The term <term>executive branch</term> has the meaning given such term defined in <external-xref legal-doc="usc-act" parsable-cite="usc-act/Ethics in Government Act of 1978 /109">section 109</external-xref> of the Ethics in Government Act of 1978 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/109">5 U.S.C. App. 109</external-xref>).</text></paragraph><paragraph id="H9190EF43BA484E54A6668310C1F10ADA"><enum>(4)</enum><header>Family member</header><text display-inline="yes-display-inline">The term <term>family member</term> means a spouse or a dependent child as defined in <external-xref legal-doc="usc-act" parsable-cite="usc-act/Ethics in Government Act of 1978 /109">section 109</external-xref> of the Ethics in Government Act of 1978 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/109">5 U.S.C. App. 109</external-xref>).</text></paragraph><paragraph id="H7A734C48544A4D5C94A654854BD53589"><enum>(5)</enum><header>Judicial officer</header><text>The term <term>judicial officer</term>—</text><subparagraph id="H20B640AECDB84B52A7EA0A6F922C4926"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given such term in <external-xref legal-doc="usc-act" parsable-cite="usc-act/Ethics in Government Act of 1978 /109">section 109</external-xref> of the Ethics in Government Act of 1978 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/109">5 U.S.C. App. 109</external-xref>); and</text></subparagraph><subparagraph id="H2FE2D77F32B644B9886D636F98BC70B6"><enum>(B)</enum><text>includes bankruptcy judges and magistrate judges.</text></subparagraph></paragraph><paragraph id="HE55CE17860A34E4C8B82DFCCEDD2D1E3"><enum>(6)</enum><header>Member of Congress</header><text display-inline="yes-display-inline">The term <term>Member of Congress</term> has the meaning given such term defined in <external-xref legal-doc="usc-act" parsable-cite="usc-act/Ethics in Government Act of 1978 /109">section 109</external-xref> of the Ethics in Government Act of 1978 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/109">5 U.S.C. App. 109</external-xref>).</text></paragraph><paragraph id="H9047293A205C461BB0D1FC69CC3C2899"><enum>(7)</enum><header>Political appointee</header><text display-inline="yes-display-inline">The term <term>political appointee</term> means any individual occupying a position in the executive branch of Government—</text><subparagraph id="H815CF0DBE33D4ED2B59F80DF95CAFA5A"><enum>(A)</enum><text>who was appointed to such position by the President, by and with the advice and consent of the Senate;</text></subparagraph><subparagraph id="HE885916FFB1E4970872B1FBD68642BA8"><enum>(B)</enum><text>described under sections 5312 through 5316 of title 5, United States Code (relating to the Executive Schedule);</text></subparagraph><subparagraph id="HE1AF772C3CDA485C9515B8538CF55E80"><enum>(C)</enum><text>as a noncareer appointment in the Senior Executive Service, as defined under paragraph (7) of section 3132(a) of such title; or</text></subparagraph><subparagraph id="H2154ECF0BEF3447EA6C44A2F96A1A3B5"><enum>(D)</enum><text>that is of a confidential or policy-determining character under schedule C of subpart C of part 213 of title 5, Code of Federal Regulations, or any other position that is excepted from the competitive service because of its confidential policy-determining, policy-making or policy-advocating character.</text></subparagraph></paragraph><paragraph id="H0622268F82F94381B8285609A7375699"><enum>(8)</enum><header>Supervising ethics office</header><text>The term <term>supervising ethics office</term> means any of the following:</text><subparagraph id="HCA8D781CE4094223AD64328B9AB02A1D" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">In the case of an individual described in paragraph (2)(A)—</text><clause id="H81655A6FD44D4F9DA99E02204077B3DB" commented="no"><enum>(i)</enum><text>the Select Committee on Ethics of the Senate; or</text></clause><clause id="HCD4A55354D3B4C0DB941F5E98BC20F89" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on Ethics of the House of Representatives.</text></clause></subparagraph><subparagraph id="H75E2A2F67CCC4FD78D6C9C82A2B4A208" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>In the case of an individual described in paragraph (2)(B), the Office of Government Ethics.</text></subparagraph><subparagraph id="H73EEC9A13071463584ADF3E12D81F4A4"><enum>(C)</enum><text>In the case of a judicial officer, the Judicial Conference.</text></subparagraph></paragraph></subsection></section><section id="HAF180CA326EE402B94561A1F159FAA62" commented="no"><enum>3.</enum><header>Ban on all outside earned income and all service on boards by Members of Congress</header><subsection id="H62CBC9683F58489997295185B2811942"><enum>(a)</enum><header>Outside earned income</header><paragraph id="HF9527878B07F410DB2E5F1EA3125ACCE"><enum>(1)</enum><header>In general</header><text>Section 501(a)(1) of the Ethics in Government Act of 1978 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/501">5 U.S.C. App. 501(a)(1)</external-xref>) is amended by striking <quote>outside earned income attributable to such calendar year which exceeds 15 percent</quote> and inserting <quote>any outside earned income attributable to such calendar year, except that such an officer or employee may have outside earned income attributable to such calendar year which does not exceed 15 percent</quote>.</text></paragraph><paragraph id="H49CA3047C59B4A62923EAA99620FA28D"><enum>(2)</enum><header>Individuals becoming Members during calendar year</header><text>Section 501(a)(2) of such Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/501">5 U.S.C. App. 501(a)(2)</external-xref>) is amended—</text><subparagraph id="H006DC292ABB943FBA0E07BBB399540A3"><enum>(A)</enum><text>by striking <quote>outside earned income attributable to the portion of that calendar year which occurs after such individual becomes a Member or such an officer or employee which exceeds 15 percent</quote> and inserting <quote>any outside earned income attributable to the portion of that calendar year which occurs after such individual becomes a Member or such an officer or employee, except that such an officer or employee may have outside earned income attributable to such portion of that calendar year which does not exceed 15 percent</quote>; and</text></subparagraph><subparagraph id="H725E071965484DF89296A83B9FE1AE86"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>such individual is a Member or such officer or employee </quote> and inserting <quote>such individual is such an officer or employee</quote>.</text></subparagraph></paragraph><paragraph id="HE273A13ED7E7408A998F78B60DBC23A8"><enum>(3)</enum><header>Preserving authority of officers and employees of Congress to earn compensation from practicing medicine</header><text>Section 502(a) of such Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/502">5 U.S.C. App. 502(a)</external-xref>) is amended by striking <quote>fiduciary relationship</quote> each place it appears in paragraphs (1) and (3) and inserting <quote>fiduciary relationship, except that such an officer or employee of the House of Representatives or Senate may receive such compensation if the fiduciary relationship involves the practice of medicine</quote>.</text></paragraph><paragraph id="H31F9ED0EF36A4E1EAD84EC1908A202E8"><enum>(4)</enum><header>Application of ban to income earned from teaching</header><text>Section 502(a)(5) of such Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/502">5 U.S.C. App. 502(a)(5)</external-xref>) is amended by striking <quote>without the prior notification</quote> and inserting <quote>except that such an officer or employee may receive compensation for teaching with the prior notification</quote>.</text></paragraph><paragraph id="HE2109CAA6C1248F88C73958E765D64FA"><enum>(5)</enum><header>Definition</header><text>Section 505 of such Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/505">5 U.S.C. App. 505</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H8B4AC532B8DD497AAD62EEDB325C0732" display-inline="no-display-inline"><paragraph id="HA8BFF8F88C3D4DF1B1CCD2F1340199B8"><enum>(6)</enum><text display-inline="yes-display-inline">The term <term>outside earned income</term>, with respect to a Member of Congress, has the meaning given such term in clause 4(d) of rule XXV of the Rules of the House of Representatives for the One Hundred Seventeenth Congress, except that paragraph (d)(1)(D) of such clause shall not apply. Such term shall apply with respect to a Senator in the same manner as such term applies to a Member of the House of Representatives under such clause.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1C66D1CED4024010A9E5721C8B2667C8"><enum>(b)</enum><header>Service on boards</header><text>Section 502(a)(4) of such Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/502">5 U.S.C. App. 502(a)(4)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H9B645A00D2F34852A71D8E95EF148FDC" display-inline="no-display-inline"><paragraph id="H38116AD8CDC546DFB1A1A282218AB849"><enum>(4)</enum><text display-inline="yes-display-inline">serve as an officer or member of the board of any association, corporation, or other entity, except that—</text><subparagraph id="HDF951F9544254495B6E8639451235828"><enum>(A)</enum><text>a Member and such an officer or employee may serve without compensation as an officer or member of the board of any nonprofit association, nonprofit corporation, or other nonprofit entity, and</text></subparagraph><subparagraph id="H830FA2F4FBD34319A5A1F2271C82F0D6"><enum>(B)</enum><text>such an officer or employee may serve without compensation as an officer or member of any other association, corporation or other entity; or</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H521E388940FD4E5588201A71A0A66C73"><enum>4.</enum><header>Lifetime lobbying ban</header><subsection id="H42953DC704E449328E743764EBF09EA6" commented="no"><enum>(a)</enum><header>In general</header><text>Section 207(e) of title 18, United States Code, is amended as follows:</text><paragraph id="H7114AE797933404D910DC6741B19F918" commented="no"><enum>(1)</enum><text>Paragraph (1) is amended to read as follows:</text><quoted-block id="H85AFB6CEBB7C4B79877ACEA404A60A10" style="OLC"><paragraph id="HF94F596EAEED44FD9D900778C04991D3" commented="no"><enum>(1)</enum><header>Members of congress</header><subparagraph id="HB1345C2DC26249478FEB2210239A144F" commented="no"><enum>(A)</enum><header>In general</header><text>Any person who is a Senator or a Member of the House of Representatives and who, after that person leaves office, knowingly makes any lobbying contacts to, or engages in lobbying activities with, a covered executive branch official, or to any Member, officer, or employee of either House of Congress, shall be punished as provided in section 216 of this title.</text></subparagraph><subparagraph id="HE0FBDD24792D42BB84C0D8F44C2995B2" commented="no"><enum>(B)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="H4855AEBC79C842E382E01F2A45E09FB8" commented="no"><enum>(i)</enum><text>The terms <term>lobbying activities</term>, and <term>covered executive branch official</term> have the meanings given those terms in section 3 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1602">2 U.S.C. 1602</external-xref>).</text></clause><clause id="H0F1395ADB5154F87A6ECB04BEEFF446D" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">The term <term>lobbying contact</term> has the meaning given such term in section 3(8) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1602">2 U.S.C. 1602(8)</external-xref>) except that subparagraph (B)(iv) of such paragraph shall not apply.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H92DE0CF423674CE2B4F3E9CC7074C633" commented="no"><enum>(2)</enum><text>Paragraph (2) is amended—</text><subparagraph id="H73A160892D7E41429A3444A9BF9E982E" commented="no"><enum>(A)</enum><text>by striking <quote>(2) Any person</quote> and inserting the following:</text><quoted-block id="HA828DDF4A2AF4E0DA1E8FA87574AC184" style="OLC"><paragraph id="HBE246423C8024A43AAEFE722FCD455FC" commented="no"><enum>(2)</enum><header>Officers and certain staff</header><subparagraph id="H08F00AAB82634326A3F3640748C40D46" commented="no"><enum>(A)</enum><header>Officers and staff of the senate</header><text>Any person</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HBD59EF78F7AF4CC48EF6750CBE897856" commented="no"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="H5302C49D4F95490E8B545F919542B7A5" style="OLC"><subparagraph id="H84657ED684BE4F19A3A4E681AE5BC8C4" commented="no"><enum>(B)</enum><header>Officers of the house of representatives</header><clause id="H466C0800E3D040B4B80DA8F00B3C5214" display-inline="no-display-inline" commented="no"><enum>(i)</enum><text>Any person who is an elected officer of the House of Representatives and who, within 1 year after that person leaves office, knowingly makes, with the intent to influence, any communication to or appearance before any of the persons described in clause (ii), on behalf of any other person (except the United States) in connection with any matter on which such elected officer seeks action by a Member, officer, or employee of either House of Congress, in his or her official capacity, shall be punished as provided in section 216 of this title.</text></clause><clause id="HE9108FB38E06489F95EEBA4E07137E56" commented="no"><enum>(ii)</enum><text>The persons referred to in clause (i) with respect to appearances or communications by a former elected officer are any Member, officer, or employee of the House of Representatives.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HD8FA2C8D12ED48C7AFAAE5DF8E07B269" commented="no"><enum>(b)</enum><header>Restrictions relating to foreign entities</header><text>Section 207(f) of title 18, United States Code, is amended—</text><paragraph id="H47827B94BC0048929F2EBDF4D8E69104" commented="no"><enum>(1)</enum><text>in paragraph (1), by striking <quote>Any person</quote> and inserting <quote>Except as provided in paragraph (2), any person</quote>;</text></paragraph><paragraph id="H663DBE19BD484CF9991F7B0C1421E197" commented="no"><enum>(2)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively;</text></paragraph><paragraph id="H7B0B083CDAE545A895699503405A54BD" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">by adding after paragraph (1) the following new paragraph:</text><quoted-block style="OLC" id="H0BFB992CEB6B4CA6A2822AC92B155ECB" display-inline="no-display-inline"><paragraph id="H5EC5E651963D474F95959844639A9FFB" commented="no"><enum>(2)</enum><header>Member of Congress</header><text display-inline="yes-display-inline">With respect to the restrictions under paragraph (1), any person who is a Member of Congress may not engage in any of the activities under such paragraph at any time after leaving office.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HDEBED9E25C7B4D0699B57E72BBC28B20" commented="no"><enum>(4)</enum><text>in paragraph (4), as redesignated by paragraph (2)—</text><subparagraph id="H971094CA758B4D7FA9F77671E78E430C" commented="no"><enum>(A)</enum><text>by striking <quote>means</quote> and inserting <quote>means—</quote>;</text></subparagraph><subparagraph id="HC1997AB5161148558582A598A781A93D" commented="no"><enum>(B)</enum><text>by striking <quote>the government</quote> and inserting <quote>(A) the government</quote>;</text></subparagraph><subparagraph id="HABC8B58007D0449F8BE1224D482912DA" commented="no"><enum>(C)</enum><text>by striking the period and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="H31FB18D105FC4F02AF7FA5782DAECF7A" commented="no"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HAC50871F55754150AD200456244B0DE4" display-inline="no-display-inline"><paragraph id="HAF4E7C75F37B40D8A81BE41F193A5F63" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a Member of Congress, any foreign principal as defined in section 1(b) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611(b)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HBC29D8D667FA4707B301FFB77DF79E68" commented="no"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to individuals who leave office or employment to which such amendments apply on or after the date of commencement of the first session of the One Hundred Eighteenth Congress sine die or January 3, 2023, whichever date is earlier.</text></subsection></section></legis-body></bill>
